2019 Legislative Session Final Report Prepared by Ricardo Rel, Office of Government Relations April 18, 2019 During a 60‐day session both fiscal and policy related matters are germane to the session. Next year will be a 30‐day session which only fiscal related matters are germane unless the Governor puts them on the call. Below is a preliminary summary of the post session results for the 2019 legislative session for the general appropriations, capital outlay, and policy related bills. For FY20, the legislature passed three general appropriation bills. They passed HB2 which is the general appropriations bill and two other bills HB548 and SB536 which are generally referred to as HB2 junior bills. The legislature passed, and the Governor approved $18.5 million in recurring and non‐recurring funding with the enactment of all 3 appropriation bills. Details of all three bills are included below. Please note that some projects may have been funded in two to three of the bills and are summarized on page 14. The Department of Finance and Administration released the scoring of the recurring status of the HB2 Junior Bills and is summarized on page 5. In addition to the general appropriation bills, SB280 was enacted and provides funding for capital related projects. A total of $29.3 million was enacted for several New Mexico State University related projects (see pages 19‐25). A total of $47.8 million was enacted for NMSU in both general appropriations and capital outlay. During a 60‐day session both fiscal and policy related matters are germane to the 

session.  Next year will be a 30‐day session which only fiscal related matters are 

germane unless the Governor puts them on the call.  Below is a preliminary 

summary of the post session results for the 2019 legislative session for the 

general appropriations, capital outlay, and policy related bills.  

For FY20, the legislature passed three general appropriation bills. They passed 

HB2 which is the general appropriations bill and two other bills HB548 and SB536 

which are generally referred to as HB2 junior bills.  The legislature passed, and the 

Governor approved $18.5 million in recurring and non‐recurring funding with the 

enactment of all 3 appropriation bills.  Details of all three bills are included below.  

Please note that some projects may have been funded in two to three of the bills 

and are summarized on page 14.  The Department of Finance and Administration 

released the scoring of the recurring status of the HB2 Junior Bills and is 

summarized on page 5.     

In addition to the general appropriation bills, SB280 was enacted and provides 

funding for capital related projects.  A total of $29.3 million was enacted for 

several New Mexico State University related projects (see pages 19‐25).   

A total of $47.8 million was enacted for NMSU in both general appropriations and 

capital outlay. 

Other appropriations in HB2 that impact higher education include: 

$20 million to the higher education department to replenish the

college affordability endowment fund (Section 5‐109) and $5 million

in Section 5‐34 contingent upon available funds as determined by the

August 2019 revenue estimate;

$1 million for the higher education department for the Centers of

Excellence (NMSU is included for the Center of Agriculture) (Section

4J;

$3 million for a pilot adult education services for students involved in

the criminal justice system;

$138,000 for workforce development programs at community

colleges that primarily educate and retrain displaced workers;

$10 Million to the College of Education Affordability Act (HB 275,

Chapter 193) (Section 12‐7 of HB2).

NMSU requested two policy related initiatives (HB237 – Extend University Police 

Officer Jurisdiction and SB314 – NMSU Campus in San Luis Potosi, Mexico) and 

both were signed by the Governor.  Other enacted legislation includes: 

HB7 – Higher Education Centers of Excellence (Chapter 60) HB127 – College Affordability Act Changes (Chapter 56) HB275 – College of Education Affordability (Chapter 193) HB360 – Educational Retirement Changes (Chapter 258) HB420 – School Advanced Placement Policy and Reporting (Chapter 139) SB157 – Sick Leave for Educational Retirement (Chapter 31) SB447 – Engineering and Surveying Scholarship and License (Chapter 220) SB664 – Educational Benefits to Spouses/Domestic Partner (Chapter 173)

Line Item Veto Status of General Appropriation and Capital Outlay Bills  

The Governor kept all funding items intact for items specific to New Mexico State University, however 

she did veto some language that was associated with some of the items for the various general 

appropriation and capital outlay bills as summarized below.    

 

HB2 (GENERAL APPROPRIATIONS) LINE ITEM VETOES 

Section 4J (6) Department of Agriculture 

The general fund appropriation includes sufficient funding to the department of agriculture at New Mexico

state university to promulgate rules to solely regulate seed.

Section 8A (5) 

The Governor’s House Executive Message No 23 includes the following intent and the language with the line item veto: 

“On page 201, line 10, I have vetoed the words “average salary”.  I have vetoed the words “average salary” on pages 200 and 201 to ensure that every employee contemplated by Section 8(A)(1)‐(4) of the General Appropriations Act receives a four percent salary increase. “  

(5) twenty-three million two hundred eighty-two thousand five hundred dollars ($23,282,500) to the higher education department to provide faculty and staff of two-year and four-year public post-secondary educational institutions, New Mexico military institute, New Mexico school for the blind and visually impaired and New Mexico school for the deaf with an average salary increase of four percent.

Department of Finance and Administration Scoring of HB2 Junior Bills 

The Department of Finance and Administration (DFA) is the final authority in 

scoring the recurring status of funding included in the HB2 Junior Bills.  A report 

was released by the Higher Education Department that provides the recurring 

status of the higher education related projects.  The recurring status changed for 

several higher education projects including NMSU projects.  The DFA reclassified 

16 projects totaling $1.4 million from recurring to a non‐recurring status and are 

summarized below.

department shall allocate money to public post‐secondary educational 

institutions and tribal colleges based on a student need formula calculated 

according to income reported on the FAFSA and on the percentage of the 

institution's students classified as returning adults who are otherwise ineligible 

for state financial aid.  $20 million is included in Section 5 of HB2.  An additional 

$5 million is included Section 5‐34 subject to available funds as determined by 

the August 2019 revenue estimate.

school districts to their tax district.  The proposed addition would require a 

petition from said school district signed by 10% of the electorate to the higher 

education department and if viable an election in the indicated district would 

take place.  This language is needed in order to grant the branch community 

colleges the same options as the independent community colleges.  School 

districts are approaching branch campuses to inquire into the ability to join the 

campus tax district and at this time there is no pathway for that addition to 

occur.

Adding tribal colleges to receive funds from the lottery tuition fund; including 

the definition of a tribal college to mean a tribally, federally or congressionally 

chartered post‐secondary educational institution located in New Mexico that is 

accredited by the north central association of colleges and schools (removed by 

amendment and replaced with "higher learning commission"). Students 

enrolled at tribal colleges will receive the same amount of tuition coverage as 

those enrolled in comprehensive institutions of one thousand twenty dollars 

($1,020).

Allowing Northern New Mexico College to administer a branch community 

college that one or more area school districts create to provide technical and 

vocational courses

Amendments: clarifies that Northern New Mexico College (NNMC) is to offer its 

technical and vocational courses through the branch community college, rather 

than transfer those courses to the branch campus. The amendment also 

indicates for the branch community college of NNMC, any courses, students, 

credit hours, degrees and certificates awarded are to be reported to the Higher 

Education Department (HED) in the same manner as required of the main 

campus, and are to be included in all reports and funding formula

calculations for NNMC.
