The Ontario County Traffic Safety Board was established on May 29, 1971 by the Ontario County Board of

Supervisors pursuant to article forty-three, section sixteen hundred seventy two of the Vehicle and Traffic law of

the State of New York. The Traffic Safety Board provides oversight for the Ontario County STOP-DWI program

and is committed to its mission of traffic safety in Ontario County.

Thank you to all the members of the Traffic Safety Board for your dedication in making our highways safer for

all those who travel in Ontario County.

STOP-DWI PROGRAM

2015 MISSION AND OVERVIEW

The STOP-DWI Program was created by the State Legislature in 1981 and stands for "Special Traffic Options

Program for Driving While Intoxicated". STOP-DWI is based on the philosophy that innovative local efforts are the

key to solving the drinking and impaired driving problem. The intention of the legislation creating the program was

to provide funding for the improvement and expansion of existing programs, and to develop new methods for the

evaluation of progress. STOP-DWI programs are funded entirely from fines paid by convicted impaired drivers, no

tax dollars are used.

The mission of STOP-DWI is to reduce the number of persons killed or injured in alcohol and/or other drug-related

crashes, to promote DWI prevention as a public priority, and to coordinate local efforts in law enforcement,

prosecution, probation, rehabilitation, public information, education and administration.

The emphasis of the Ontario County STOP-DWI Program is to coordinate as many deterrents as possible and to

provide comprehensive solutions based on the county’s needs. Since 1983, the Ontario County STOP-DWI

Program has been responsible for the development of local programs which educate the community of the dan-

gers of drinking and impaired driving. It is our desire to make Ontario County’s streets, roads and highways the

safest in the New York State.

STOP-DWI PUBLIC INFORMATION AND EDUCATION

COMMUNITY PRESENTATIONS:

For a second year, the Ontario County STOP-DWI Program presented at the Ontario County Citizen’s Academy. 23

students later graduated (pictured at the Ontario County Court House).

FAIR (Server Training):

Thirteen F.A.I.R. (Fundamentals of Alcohol Intoxication Recognition) presentations were conducted throughout

2015 for various establishments that serve alcohol in Ontario County. F.A.I.R. training reviews the rules/laws

governing Alcoholic Beverage Control, Social Host laws, and the serving and selling of alcohol. Detection of fake

identification and acceptable identification in New York is also reviewed.

MEDIA:

During 2015, the Ontario County Traffic Safety Board partnered with the Ontario County STOP-DWI program and

focused on school bus safety. In late August, a public service announcement began broadcasting on Time Warner

stations along with a smart phone app that focused on school bus safety and awareness.

UNDERAGE STINGS:

Underage stings were conducted during 2015 throughout Ontario County with assistance from the Ontario County

Sheriff’s Office, Geneva Police Department, New York State Police, State Liquor Authority, Department of Motor

Vehicles and the STOP-DWI program.

VICTIM IMPACT PROGRAMS:

During 2015, seven Victim Impact Panels were presented to 314 DWI offenders at the Ontario County Public Safety

Facility. Information and education was provided by the Ontario County Probation Department, District Attorney’s

office, Ontario County Sheriff’s Office, FLACRA, Celebrate Recovery, Herb Haven, Safe Harbors, and AA.

VICTIM IMPACT PANEL APPRECIATION DINNER:

The 2nd Annual Victim Impact Panel Appreciation Dinner was held on 12/03/15 at the Canandaigua Inn on the Lake.

33 volunteers and victim speakers attended. STOP-DWI is grateful to its 2015 DWI victim speakers Bo Jeffries,

Marianne Angelillo, Sarah Palermo (pictured below), and Mike Sheehe (pictured below) for their service to the On-

tario County Victim Impact Panel.

2015 1ST ANNUAL LAW ENFORCEMENT TRAINING:

During March, STOP-DWI hosted its 1st Annual Law Enforcement Training. The event was held at the

Canandaigua Inn on the Lake and was attended by over 120 law enforcement officers. Presenters included fea-

tured speaker Sheriff Michael Lewis of Wicomico, Maryland, Charles Rutherford, GTSC liaison, Ontario County

Sheriff Phil Povero, Neal McClelland, Ontario County District Attorney’s Office, STOP-DWI Administrator Sue

Cirencione, and Drug Recognition Experts Deputy Everett Roach (OCSO), Sgt. Todd Ford (OCSO) and Detective

Nathan Lawrence (CPD).

IGNITION INTERLOCK PROGRAM

On October 1, 2014, the Ontario County STOP-DWI program became the Ignition Interlock Monitor for all one-year

Conditional Discharge ignition interlock eligible cases. During 2015, STOP received 304 cases. Of those cases, 177

installed an ignition interlock device in their vehicle for a 58.22% installation rate.

During 2015,138 violations were filed. 11 individuals were violated for failing to install an interlock device and 56

were violated for testing positive for alcohol. Of the violations filed, two individuals were resentenced to Probation

and one individual was resentenced to jail. In 2015, 16 individuals were arrested for operating a vehicle without an

Ignition Interlock as required by law.

The STOP-DWI program was reimbursed $22,950.00 from New York State ($135/per IID case).

2015 STOP-DWI BUDGET AND REVENUE

The Ontario County STOP-DWI program is funded entirely from fines paid by convicted impaired

drivers, no tax payer dollars are used. In 2015, the STOP-DWI budget was $330,573.00.

ONTARIO COUNTY LAW ENFORCEMENT

Ontario County DWI/DWAI arrests totaled 499 in 2015 with arrests made by the Geneva Police Department, Canandaigua Police Department, New York State Police, the Ontario County Sheriff’s Office and the Phelps Police Department. Ontario County Law Enforcement agencies received $30,800 from the STOP-DWI program for their use in DWI enforcement. ONTARIO COUNTY SHERIFF’S OFFICE: In 2015, the Ontario County Sheriff’s Office had a total of 277 DWI/DWAI arrests which accounted for 55.51% of all DWI/DWAI arrests in Ontario County. Of the 277 arrests, 58 (21%) were involved in a motor vehicle crash.

CANANDAIGUA POLICE DEPARTMENT:

In 2015 the Canandaigua Police Department had a total of 74 DWI/DWAI arrests which accounted for 14.83% of all

DWI/DWAI arrests in Ontario County. Of the 74 arrests, 12 (16.22%) were involved in a motor vehicle crash.

GENEVA POLICE DEPARTMENT:

In 2015, the Geneva Police Department had a total of 52 DWI/DWAI arrests which accounted for 10.42% of all DWI/

DWAI arrests in Ontario County. Of the 52 arrests, ten(19.23%) were involved in a motor vehicle crash.

NEW YORK STATE POLICE:

In 2015, the New York State Police had a total of 94 DWI/DWAI arrests which accounted for 18.84% of all DWI/

DWAI crashes in Ontario County. Of the 94 arrests, five were made on the NYS Thruway. There were 19 arrests

where a crash was involved (21.21%).

NYS STOP-DWI ENFORCEMENT CRACKDOWNS

The Ontario County Sheriff’s Office, along with the Canandaigua and Geneva Police Departments participated in

the New York State STOP-DWI Enforcement Crackdown Grant in 2015. The grant was funded through the NYS

STOP-DWI Foundation.

254 hours of saturated patrols and roadblocks were conducted yielding 12 DWI/DWAI arrests during holiday

periods including Halloween, Thanksgiving, Christmas/New Years, Super Bowl, St. Patrick’s Day, Memorial Day, 4th

of July and Labor Day. Five criminal arrests were made and 105 vehicle and traffic tickets were issued. The grant

reimbursed Ontario County $11,503.63.

ONTARIO COUNTY PROBATION DEPARTMENT

The Ontario County Probation Department received $76,171 from STOP-DWI in 2015 to fund a Senior Probation

Officer position as well as 30% of a Human Service Worker for assistance with the collection of DWI fines.

Senior Probation Officer Kevin Case is currently the STOP-DWI Probation Officer whose duties include monitoring

compliance with court ordered conditions of Probation for those convicted of DWI/DWAI. Officer Case also

supervises “Operation Nightwatch” which pairs Probation Officers with Sheriff’s Deputies as they conduct

surveillance, make home visits and check bars for Probationers in violation of their Probation conditions.

The Ontario County Probation Department completed 186 Pre-Sentence Investigations in 2015 on individuals

charged with DWI/DWAI. 154 individuals were sentenced to Probation in 2015 after pleading guilty to DWI/DWAI.

The Probation Department also collected fine money related to DWI offenses including alcohol related AUO 1st and

2nd, DWAI 1st and 2nd offense, DWI 1st and 2nd offense, Aggravated DWI 1st offense, Driving While Impaired by Drugs

or Combined 1st offense, and Operating a Commercial Vehicle While Intoxicated 1st offense. During 2015, the Pro-

bation Department collected $118,619.13. Fine money directly funds STOP-DWI programs.

ONTARIO COUNTY DISTRICT ATTORNEY’S OFFICE

STOP-DWI funded the Ontario County District Attorney’s Office with $95,000.00 for the prosecution services of

two DWI Assistant District Attorneys.

On January 30, 2015, Assistant District Attorney Neal McClelland retired after over 30 years of service. In April of

2015, ADA McClelland (pictured below) was awarded the MADD Lifetime Achievement Award at a luncheon held

at Mallozzi’s Restaurant in Schenectady, NY.

In July of 2015, the Ontario County District Attorney’s Office learned that they had once again ranked #1 in DWI

convictions in New York State with a conviction percentage of 92.02% for the 2014 calendar year.

Shortly after ADA McClelland’s retirement, Assistant District Attorney Zachary Maurer

(pictured above) was hired to fill Neal McClelland’s shoes. Both ADA Maurer and ADA

Chris Eaggleston work tirelessly prosecuting DWI ‘s in Ontario County.

2015 DWI/DWAI FATALITIES

During 2015, 16 people lost their lives in fatal car crashes. Six of those individuals were killed as the result of an

impaired driver. Four of the six were driving under the influence of alcohol (two were operating motorcycles). Two

of the six killed were passengers in a vehicle where the operator was under the influence of alcohol.

STOP-DWI AWARDS

In 2015, STOP-DWI recognized law enforcement personnel in Ontario County for their efforts in the fight

against impaired driving.
