On October 20, 2009 a pre-vious foreclosure sale was conducted under the power and authority contained in the Deed of Trust (as de-fined herein) but the fore-closure proceeding was stayed as a result of Pre-scot Development, LLC fil-ing a bankruptcy petition on October 30, 2009 with the United States Bank-ruptcy Court for the West-ern District of North Caroli-na, Case Number 09-33036.
