Except where a standard form is used, all notices for publication must have a covering instruction setting out requirements. A typewritten original or good copies are to be provided, wherever possible double-spaced, with a margin surrounding the typewritten matter. Copy is to be confined to one side of the paper, sheets are to be of uniform size (preferably A4), numbered consecutively and fastened securely together. Dates, proper names and signatures particularly are to be shown clearly.

Copy will be returned unpublished if not submitted in accordance with these requirements.

KNVXRONMKNT PROTECTION (SEA DOHPING) ACT 1981

Pursuant to section 25 of the Environment Protection (Sea Dumping) Act 1981,, notice is given that a general permit was granted on 30 October 1991 to Harbour Waterfront Developments Pty Ltd, Level 1, 1 Newcastle Street, Rose 3ay, NSW 2029 to load and to dump up to 1340 cubic metres of spoil derived from the harbour bed in front of 5 Viret Street, Hunters Hill NSW and 15 Sutherland Crescent, Darling Point NSW.

Dximping of the spoil is to taJce place within a circular area of radius 400 metres centred at 33® 52.6' S, 151® 25.3" E.

On 30 July 1991 a notice was published under subsection 269TC(4) of the Customs Act 1901 notifying an inquiry into the alleged dumping and subsidisation of glace cherries from France and Italy. Notification was made following an application by ITC (Australia) for the publication of dumping and countervailing duty notices,

I have considered the application, taking into account submissions received and any other matters considered relevant. NOTICE UNDER SUBSECTION 269TD(2) OF THE CUSTOMS ACT 1901

I have made a preliminary finding that there are sufficient grounds for the publication of dumping and countervailing duty notices in respect of glace cherries exported from France and Italy. I will within seven days of the publication of this Notice^ refer to the Anti-Dumping Authority the question as to whether the publication of dumping and countervailing duty notices for glace cherries exported from France and Italy sought by ITC (Australia) is so justified, as required by paragraph 269TD(2)(b) of the Customs Act 1901.

I consider it appropriate to require and take securities under section 42 of the Customs Act 1901 in respect of any dumping or countervailing duties that may become payable on entry for home consumption on or after 8 November 1991 of glace cherries from France and Italy.

APPLICATIONS

Application for the award of a permit over area AC91-1 are required to be made in the following manner and must cover all blocks on offer in the specified area.

The application must include details of:

the company or consortium making the application, and in the case of the latter the percentage participating interest of each company;

in a sealed envelope, the amount that the applicant is prepared to pay in a single payment to the Commonwealth of Australia for the award of the permit;

the technical qualifications of the applicant and of its employees;

the technical advice available to the applicant;

the financial resources available to the apphcant as well as a statement of existing exploration plans and commitments over the next 6 years, and a copy of the latest annual report for each applicant company; and

the viability of the consortium lodging the application, including evidence that a satisfactory settlement has been or can be reached on the joint operating agreement (a copy of a Heads of Agreement dealing will generally suffice).

A fee of $1,200, (non refundable) payable to the Commonwealth of Australia through an AustraUan Bank or by bank cheque, is required to be paid at the time the application is submitted. See lodgement requirements below.

Assessment of Applications

The Designated Authority may reject applications where he is satisfied that the applicant has insufficient technical or financial resources to effectively carry out exploration operations in the permit area. In addition, applications may be rejected if the Designated Authority is of the view that bids are inadequate because of insxifficient competition, including any situation where he is satisfied that there has been collusive bidding.

Conditions

A permit awarded under this invitation will be for one 6 year term and will not be able to be renewed. Special provisions in the Act will allow the permit to continue in force where an application for a location, retention lease or production licence has been lodged.

Permittees will be required to comply with the provisions of the Act and Acts with which it is incorporated, and with the Regulations and Directions issued imder the Act.

Further details of the cash bidding system including the criteria for assessment of applications and the conditions to apply following the award of a permit are available from the Director of Energy, Department of Mines and Energy in Darwin and fi-om the Petroleum Division, Department of Primary Industries and Energy in Canberra.

Veterans' Entitlements Act 1966

DETERMINATION AS TO ELIGIBILITY FOR MEDICAL TREATMENT UNDER PART V OF THE VETERANS' ENTITLEMENTS ACT 19 86 FOR AUSTRALIAN

MARINERS EMPLOYED DURING WORLD WAR 1

I, BENJAMIN CHARLES HUMPHREYS, Minister of State for Veterans' Affairs, pursuant to paragraph 5R(l){a) of the Veterans' Entitlements Act 1986, hereby determine that, on and from 1 December 1991, Part V of the Veterans' Entitlements Act 1986 shall apply in relation to a person included in the following class of persons, as if that person, while rendering service during World War 1 of a kind specified in this determination, was a member of the Defence Force rendering continuous full-time service for the purposes of this Act:

(1) a master, officer or seaman employed under agreement, or an apprentice employed under indenture, in sea-going service on a ship registered in Australia that was engaged in trading between a port in a State or Territory and any other port; or

(2) a master, officer or seaman employed under agreement, or an apprentice employed under indenture, in sea-going service on a ship registered outside Australia who was, or whose dependants were, resident in Australia for at least 12 months immediately before he or she entered into the agreement or indenture; or

(3) a master, officer, seaman or apprentice employed on a lighthouse tender, or pilot of the ship of the Commonwealth or of a State; or

(4) a pilot employed or licensed by Australia or a State or by an authority constituted by or under a law of the Commonwealth or of a State; or

(5) a master, officer, seaman or apprentice employed in sea-going service on a ship owned in Australia and operating from an Australian port, being a hospital ship, troop transport, supply ship, tug, cable ship, salvage ship, dredge, fishing vessel or fisheries investigation vessel; or


(6) a master, officer, seaman or apprentice employed in sea-going service on a ship registered in New Zealand who the Commission is satisfied was engaged in Australia and is not entitled to compensation under a law of a Commonwealth country providing for payment of pensions and other payments to seamen who suffered death or disablement as a result of World War 1.

For the purposes of this Determination, "World War 1" has the same meaning as it has in section 5B of the Veterans' Entitlements Act 1986.

UNIT CITATIONS DETCRMINATION

I, WILLIAM GEORGE HAYDEN, Governor-General of the Commonwealth of Australia, having received the approval of Her Majesty Queen Elizabeth n for the designs of the Unit Citation for Gallantry and the Meritorious Unit Citation, and acting imder regulations 4 and 5 of the Unit Citation Regulations, determine as follows:

A. The Unit atation for GaOantry Award of Unit Gtation for Gallantry 1. The Unit Citation for Gallantry comprises an award of a Certificate of Citation to a Unit signed by the Governor-General and insignia of the CiUtion worn by members of the Unit. Tnrfgnia rfpgigi^ 2.1 The insignia of the Citation is a gilt sterling silver rectangular frame 32 miUimetres wide and 15 millimetres deep surrounding a deep-green ribbon bar 28 millimetres wide and 10 millimetres deep with a design of flames emanating from the frame's outer edges to the centre. Z2 A gilt sterling silver Federation Star 7 millimetres in diameter is placed at the centre of the ribbon bar in accordance with paragraph 3.1. Entitlement to wear insignlft 3.1 When a Unit is awarded a Citation, each person who was a member of the Unit at the time of the action for which a Citation is awarded, or during the period to which the Citation relates, is entitled to wear the Federation Star. 3.2, The insignia of the Citation and Federation Star may be worn by those members mentioned in paragraph 3.1 whenever full size orders, decorations and medals are worn. 3.3 A person who joins the Unit after the time for which a Citation has been awarded may be entitled, while the person remains a member of the Unit, to wear the insignia of the Citation without the Federation Star according to the relevant Service dress regulations.

Wearing of ingignia dress 4. The Chief of Staff or the delegate of the Chief of Staff of each arm of the Defence Force may determine eligibility to wear the insignia of the Citation and its manner of wearing in accordance with:

(a) the ciistom of wearing on the left breast honours and awards instituted by The Sovereign; and

(b) the relevant Service dress regulations.

Insignia miniatore 5.1 The insignia miniature is a two-thirds size replica of the insignia of the Citation surroimding a miniauire ribbon bar 18 millimetres wide.

5.2 The miniature is worn in accordance with the appropriate Service dress regulations whenever miniatures of orders, decorations and medals are worn.

Farther awards 6.1. Second and subsequent awards are recognised by the presentation of a further Certij5cate of Citation to the Unit signed by the Governor-General,

6.2. Only one insignia of the Citation may be wom by a member.

B. The Meritorions Unit atation

Award of Meritorious Unit Citation 7. The Meritorious Unit Citation comprises an award of a Certificate of Citation to a Unit signed by the Governor-General and insignia of the Citation wom by membeis of the Unit.

Insignia design 8.1 The insignia of the Citation is a rhodium plated sterling silver rectangular frame 32 millimetres wide and 15 millimetres deep surrounding a ribbon bar of old gold 28 millimetres wide and 10 millimetres deep with a design of flames emanating from the frame's outer edges to the centre.

8.2 A rhodium plated sterling silver Federation Star 7 millimetres in diameter is placed at the centre of the ribbon bar in accordance with paragraph 9.1.

DETERMINATION UNDER SUBREGULATION 4(2)

I, WILLIAM GEORGE HAYDEN, Governor-General of the CoiTOTonwealth of Australia, on the recommendation of the Minister of State for Defence Science and Personnel, hereby :

(a) under regulation 3 of the Australian Service Medal regulations which are set out in the Schedule to the Letters Patent given on 13 September 1988, declare the Australian Defence Force activity in Western Sahara with effect from 5 September 19 91 to be a prescribed operation for the purposes of those Regulations, and

(b) under sub regulation 4 (2) of those Regulations determine that the conditions for the award of the Australian Service Medal in respect of the prescribed operation are :

(i) the Medal may be awarded to a member of the Australian Defence Force who rendered service while posted to or serving as a member of the Australian element of the activity at paragraph (a) for a period of not less than an aggregate of 30 days;

(ii) the Medal may be awarded to a member of the Australian Defence Force who rendered service of the same or similar purpose as that at paragraph (a) while on secondment or exchange with a Foreign Defence Force fcr a period of not less than an aggregate of 30 days;

(A) was terminated owing to death, evacuation owing to illness or injury or other disability due to service;

(B) was terminated due to Government or Defence Force reasons; or

(C) was terminated due to Foreign Government or Foreign Defence Force reasons.

(a) arrangements have been made under which Judges will not be appointed to the Family Court of Western Australia except with the approval of the Attorney-General of the Commonwealth;

(b) Judges appointed to that Court are by reason of training, experience and personality, suitable persons to deal with matters of f ^ i l y law and cmmot hold office beyond the age of 70 years; and

(c) counselling facilities will be available to that Court; declare under subsection 41 (2) of the Family Law Act 1975 that, on and after 5 November 1991, section 41 of the Family Law Act 1975 applies to the Family Court of Western Australia.

NOTICE OF INQUIRY INQUIRY INTO CLASSIFICATION OF PROGRAM MATERIAL ON TELEVISION

SUBMISSIONS ARE INVITED

The Australian Broadcasting Tribunal has started an inquiry to review its current standards covering the classification of programs and advertisements on television. The current standards reflect the basic classification framework which has been in place since the introduction of television in Australia in 1956. There are 14 standards under review which set out the criteria by which television stations classify television programs and advertisements as G (General), PGR (Parental Guidance Recommended), AO (Adults Only) and not suitable for television, and which set down the times of day when these programs can be broadcast. These are Television Program Standards (TPS) 3 to 11; 13 and 21; and Television Advertising Conditions (TAG) 6, 8 & 9. An explanation of the relevant standards is included in the Information Paper. The aim of this inquiry is to find out whether the current standards are operating effectively. The inquiry particularly wants to assess whether the current classification standards adequately reflect community attitudes. The inquiry will be conducted in two stages. The first stage of the inquiry will evaluate the current standards and the second stage will consider whether there should be any changes to the existing standards or formulation of new standards and what form the changes or new standards should take. In relation to the first stage to review the effectiveness and appropriateness of the current standards the Tribunal will consider your comments on any or all of the following: 1) whether the criteria which are used to classify programs

(including advertisements) as G, PGR, AO and not suitable for television, and which cover the representation of such things as violence, sex, nudity, use of offensive language and drugs, are in tune with current community attitudes;

2) whether the times of day at which programs (including advertisements) classified as G, PGR and AO may currently be shown on television are suitable and in line with current community expectations;

3) how individual television stations apply the current criteria when they classify and schedule programs (and advertisements)^ and is there uniformity between stations in the way that they apply these criteria.

4) whether the classification symbols G, PGR and AO provide enough information for viewers about the content of television programs, and whether the current method and frequency of broadcasting classification symbols is adequate;

5) whether current community attitudes are reflected in the specific restrictions on when television advertisements can be shown for cinema films and home videos, alcohol, betting and gambling, and personal products (such as tampons and condoms); or when clips can be shown from cinema release films being reviewed or discussed on television;

6 ) dLTvy other matter/s arising from submissions which may be relevant to the first stage of the inquiry.

The Information Paper for this inquiry sets out in detail the current standards, their history, a background to the inquiry and information on related areas (including recent recommendations from the Australian Law Reform Commission) • This paper will help you in preparing your submission and is available from the Tribunal's offices.

The Tribunal will publish its evaluation on the first stage, and invite comment on any further matters which it considers relevant to the second stage of the inquiry, including any proposals for change and the results of research undertaken for the Tribunal.
