ኦዲተር መስሪያ ቤት ሇማቋቋምና

ስሌጣንና ተግባራት ሇመወሰን የወጣውን

አዋጅ ሇማሻሻሌ የወጣ አዋጅ፤

የክሌለን ኦዲት ሥርዓት በሚገባ ማጠናከሩ የክሌለን

ኢኮኖሚ ከግሌጽነትና ከተጠያቂነት ጋር ይበሌጥ

አቀናጅቶ ሇመምራትና ሇማስተዳዯር የሚያስፇሌገውን

አስተማማኝ መረጃ በማግኘት ረገድ ከፍተኛ ፊይዳ

እንዯሚኖረው በመታመኑ፤

WHEREAS, it is believed that strengthening

properly the Audit system of the Region has great

contribution to having access to reliable data

necessary to manage and administer the regional

Economy better integrating with Transparency and

Accountability;

በክሌለ ውስጥ በተሇያዩ የሌማትና የአስተዳዯር

መስኮች የተሰማሩ የመንግሥት መሥሪያ ቤቶችና

ድርጅቶች የገንዘብም ሆነ የንብረት አያያዛቸው

ተገቢውን የሂሳብ አያያዝ ስርዓት የተከተሇ፣ የገቢ

አሰባሰባቸው፣ የወጪ አፇቃቀዳቸውም ሆነ የሀብት

አጠቃቀማቸው የመንግሥትን ሕጎች፤ ዯንቦችና

መመሪያዎች ተከትል የተፇፀመ መሆኑን እና

እቅድና ፕሮግራማቸውን በቅሌጥፍናና ኢኮኖሚያዊ

በሆነ መንገድ በማከናወን የሚጠበቅባቸውን ገቢ

ማሟሊታቸውን ማረጋገጥ አስፇሊጊ ሆኖ በመገኘቱ፤

ክሌለ ግሌጽነትና ተጠያቂነትን ሇማስፇን

የሚያዯርገው ሁለን አቀፍ እንቅስቃሴ ውጤታማነት

እንዲኖረው የክሌለን ዋና ኦዲተርና የመሥሪያ ቤቱን

የሙያ ነጻነት፣ አዯረጃጀትና አሠራር ይበሌጥ

የማሻሻለና የማጠናከሩ አስፇሊጊነት ስሇታመነበት፤

የኦዲት ስራው በወቅቱ ያሇውን ዓሇም-አቀፍ የሙያ

መርህና ዯረጃ የጠበቀ፤ በክሌለ ተቋማትና በጀት

ስፊት አንጻር አገሌግልቱን ማዳረስና የጥራት

ዯረጃውንም ማጠናከር በማስፇሇጉ፤

የአማራ ክሌሌ ምክር ቤት በተሻሻሇው የአማራ

ብሔራዊ ክሌሊዊ ሕገ-መንግሥት አንቀፅ 49 ንዑስ

አንቀፅ 3(1)ና ንኡስ አንቀጽ (8) ድንጋጌዎች

መሠረት የሚከተሇውን አውጇሌ፡፡

WHEREAS, it has become necessary to ascertain that

the government offices and organizations engaged in

various development and administrative sectors fulfill

their expected revenue by following proper accounting

procedures in the manner of finance and property

handling, revenue collection, fund disbursement as well

as property utilization is executed in accordance with

government rules, regulations and directives and that

their plans are carried out efficiently and economically;

WHEREAS; it has been believed that professional

independence, structure and procedure of the regional

auditor general office should be further improved and

strengthened so that the all-inclusive movement of the

region to realize transparency and accountability;

WHEREAS, it is necessary to address the service and

strengthened the quality standard of the the audit work

having the contemporary international professional

principle and standard on the basis of budget and

wideness of the regional institutions;

NOW, THEREFORE, the Council of the Amhara

National Region, in accordance with the powers vested

in it under Sub-atrticle 3(1) and /8/ of Article 49 of the

Revised Constitution of the Region, hereby

proclamimed as follows:


ክፍሌ አንድ

ጠቅሊሊ ድንጋጌዎች

አጭር ርዕስ

ይህ አዋጅ ‘’በአማራ ብሔራዊ ክሌሊዊ መንግሥት

የዋና ኦዲተር መስሪያ ቤት ማቋቋሚያና ስሌጣንና

ተግባራት መወሰኛ አዋጅን ሇማሻሻሌ የወጣ

አዋጅ ቁጥር 267/2011 ዓ.ም‘’ ተብል ሉጠቀስ

ይችሊሌ፡፡

1. በአዋጅ ቁጥር 186/2003 በአንቀጽ 2

‹‹ትርጓሜ›› በሚሇው ስር ከተመሇከቱት 4

የቃሊት ትርጓሜዎች በተጨማሪ የሚከተለት 7

የቃሊት ትርጉሞች ተካተዋሌ፡፡

1. “መሥሪያ ቤት” ማሇት የአማራ ብሔራዊ

ክሌሊዊ መንግሥት ዋና ኦዲተር

መሥሪያ ቤት ነው፡፡

2. ‹‹ኦዲተር›› ማሇት በክሌለ ዋና ኦዲተር

መስሪያ ቤት ውስጥ በፋይናንስና

ህጋዊነት፣ በክዋኔ፤ በአካባቢ ጥበቃ፣

በኦዲት ምርምርና ስርጸት፣ በመረጃ

ቴክኖልጂ፣ በሌዩ ኦዲትና በላልች

የኦዲት አይነቶች በየትኛውም ደረጃ

በኦዲተርነት ተመድቦ የሚያገሇግሌ

ሙያተኛ ሲሆን በኮንትራት

የሚቀጠሩትንም ይጨምራሌ፡፡

3. "ዋና ኦዲተር" እና "ምክትሌ ዋና

ኦዲተር" ማሇት በተሻሻሇው የአማራ

ብሔራዊ ክሌሌ ሕገ-መንግሥት አንቀጽ

116 ንኡስ አንቀጽ (1) ድንጋጌ መሠረት

የተሾሙ የስራ ኃሊፊዎች ናቸው፡፡

PART ONE

GENERAL PROVISIONS

Short Title

This proclamation may be cited as “A proclamation

Issued to Amend the Auditor General Office

Establishment and Determination of Its Powers and

Duties Proclamation No. 267/2019.”

1. In addition to the four definitions of words

given under “Definition” in Article 2 of

Proclamation No. 186/2011, the following

seven definitions are included.

1. “Office” means the Amhara National Regional

State Auditor General Office.

2. “Auditor” means an expert who is assigned as

an auditor including contractual employees to

serve in the regional auditor general office in

finance and legality, performance,

environmental protection, audit research and

indoctrination, information technology, special

audit and other audit types at any level.

3. “Auditor General” and “Deputy Auditor

General” means Heads assigned in accordance

with the Provision of Article 116, Sub-article

(1) of the Revised Amhara National Regional

Constitution.


4. “ዓሇም-አቀፍ የኦዲት ዯረጃዎች” ማሇት

በዓሇም-አቀፈ የዋና ኦዲተሮች ድርጅትና

የአፍሪካ ዋና ኦዲተሮች ተቋም አማካኝነት

በየጊዜው እየተሻሻለ በስራ ሊይ የዋለትና

ሃገራችን የተቀበሇቻቸው ዓሇም-አቀፊዊ

የኦዲት አሰራርና አፇፃጸም ዯረጃዎች

ናቸው፡፡

5. “ቢሮ” ማሇት የአማራ ብሔራዊ ክሌሊዊ

መንግስት የገንዘብና ኢኮኖሚ ትብብር ቢሮ

ነው።

6. "ሰው" ማሇት የተፇጥሮ ሰው ወይም በሕግ

የሰውነት መብት የተሰጠው አካሌ ነው፡፡

7. በዚህ አዋጅ ውስጥ በወንድ ጾታ

የተዯነገገው ሁለ የሴትንም ጾታ

ይጨምራሌ፡፡

ክፍሌ ሁሇት

ስሇ ዋና ኦዲተር መ/ቤት እንደገና መቋቋም፤

አሊማ፤ ስሌጣን፤ አደረጃጀትና አመራር


‹‹የመስሪያ ቤቱ ስሌጣንና ተግባር›› በሚሇው

በንዐስ አንቀጽ 2 ስር ከተመሇከቱት የመስሪያ

ቤቱ ስሌጣንና ተግባራት ከፊደሌ ተራ ኀ፤ ነ

እና ኘ ሊይ የተመሇከቱት ስሌጣንና ተግባራት

በሚከተሇው ሁኔታ ተሻሽሇዋሌ፤ ከዚህ

በተጨማሪም በዚሁ ንዐስ አንቀጽ ስር

በተጨማሪ ተግባርና ሃሊፊነት በፊደሌ ተራ ‹‹አ››

እና ‹‹ከ›› እንደሚከተሇው ተጨምሯሌ፡፡

4. “International Audit Standards” means

international audit procedure and performance

standards that are applicable, being improved

from time to time by the International Auditor

Generals Organization and the African Auditor

Generals Institution, and that our country has

adopted.

5. “Bureau” means the Amhara National Regional

State Finance and Economic Cooperative

bureau.

6. “Person” means any natural or legal body.

7. All expressions throughout this proclamation in

the masculine gender shall also include the

feminine gender.

PART TWO

Re-Establishment, Objective, Power, Structure and

Leadership of Office of the Auditor General.

2. The powers and duties mentioned in Letters

L, M, N in Article 6 stipulating “Powers and

Duties of the office” under Sub-article 2 of

Proclamation No. 186/2011 are amended as

follows; in addition to this, additional powers

and duties in Letters “O” and “P” are added

under the same sub-article.


ኀ. አስፇሊጊ ሆኖ ሲያገኘው የፊይናንስና ሕጋዊነት

ኦዲት ስራን የብቃት ማረጋገጫ የምስክር

ወረቀት ሊሊቸው የግሌ ኦዲተሮች ኦዲት

እንዲያዯርጉ በመስጠት የኦዲት ዯረጃውን

ጠብቆ ስሇመከናወኑ ይቆጣጠራሌ፤

ያረጋግጣሌ፡፡

ነ. የኦዲት ተግባሩን እንዲያከናውኑ ሀሊፉነቱ

የተሰጣቸውን የግሌ ኦዲተሮች በተመሇከተ

የመመሌመያ መስፇርቶችና ተያያዥ ጉዳዮች

የሚወስን ዝርዝር የአፇጻጸም መመሪያ

ያወጣሌ፤

ኘ. ጉዳዩ ከሚመሇከተው አካሌ ውክሌና ሲሰጠው

በክሌለ ውስጥ ሇሚኖሩና የሙያ ብቃት

ማረጋገጫ የምስክር ወረቀት ሇማግኘት ዝቅተኛ

መስፇርቱን አሟሌተው ሇሚያመሇክቱ

ባሇሙያዎች በኦዲት ሙያ ወይም በሂሳብ

አያያዝ ሥራ ሇመሠማራት የሚያስችሊቸውን

የሙያ ብቃት ማረጋገጫ የምስክር ወረቀት

ይሰጣሌ፣ ይከታተሊሌ፤ ያድሳሌ፣ ያግዳሌ፣

ይሠርዛሌ፣ ስሌጠናና ምክር ይሰጣሌ፣

ሇሚሰጣቸው አገሌግልቶችም ተገቢውን ዋጋ

ያስከፍሊሌ፡፡

አ. የክሌለ መንግስት የሌማት ድርጅቶችና የህዝብና

የመንግስት ጥቅም ያሇባቸው አካሊትን

አስመሌክቶ ኦዲት እንዲያዯረጉ በፍትሕ

አካሊትና በላልችም ጉዳዩ የሚመሇከታቸው

ተቋማት የሚቀርቡ ትዕዛዝና ጥያቄዎችን

በመቀበሌ ኦዲት ሉያዯርግ/ሉያስዯርግ ይችሊሌ፡፡

L. When it gets necessary, it gives the finance

and legal audit work to private auditors who

have certificate of quality assurance to audit,

and it controls and ensures the work whether it

is done based on standard.

M. Issues particular performance directives of

recruitment criteria and other related cases

concerning private auditors who have given

responsibility to carry out the audit work.

N. When it is given deligation from the

concerning body, it gives certificate of

professional quality assurance, which makes

them to be able to engage in auditing and

accounting, for professionals residing in the

region who met the minimum requirement to

get certificate of professional quality assurance;

follows up, renews, suspends, cancels, gives

training and advice, and makes an appropriate

fee is paid for the service they render.

O. It may audit and cause to be audited

concerning the regional public development

organizations and bodies those have public and

government interests when orders are presented

by justice bodies and other concerning

institutions to make audit.


ከ. ከሊይ በዚህ አንቀጽ ንዑስ አንቀጽ 2 (አ)

የተመሇከተውን ተግባር ሇማስፇጸም ይቻሌ

ዘንድ የክሌለ መንግስት እንዳስፇሊጊነቱ በራሱ

ገቢ የሚተዳዯርና በሙያው ሇክሌለ ዋና

ኦዲተር መሥሪያ ቤት ተጠሪ የሆነ ክሌሊዊ

የኦዲት ሰርቪስ ኮርፖሬሽን ሉያቋቁም ይችሊሌ፡፡

ዝርዝር አዯረጃጀቱ በዯንብ ይወሰናሌ፡፡


‹‹ድርጅታዊ አቋም›› ስር በንዐስ አንቀጽ 1

ከፊደሌ ተራ ‹‹ሏ›› እስከ ‹‹ሠ›› እና አንቀጽ

2 በሚከተሇው ንዐስ አንቀጾች

ተተክተዋሌ፡፡

ሏ. የቅርንጫፍ ጽህፈት ቤት ኃሊፊዎች

ወይም አስተባባሪዎች፤

መ. የየዘርፉ ዳይሬክተሮች፤

ሠ. ፈጻሚ ኦዲተሮችና ላልች አስፈሊጊ

ሠራተኞች፡፡

2. የመሥሪያ ቤቱ ሥራ አመራር በዋና ኦዲተሩ

የሚመራ ሆኖ ምክትሌ ዋና ኦዲተሮችን፣

የቅርንጫፍ ጽህፈት ቤት ኃሊፊዎችን፣

የየዘርፉን ዳይሬክተሮችና እንዳስፈሊጊነቱ

የኦዲት ቡድን መሪዎችን ወይም ኦዲት

ማኔጀሮችን ሉያካትት ይችሊሌ፡፡


‹‹ስሇሠራተኛ አስተዳደር ህግ›› በንዐስ

አንቀጽ 1 እና 2 የተመሇከቱት በዚህ

ማሻሻያ በአንቀጽ 10 ንዐስ አንቀጽ 10 ስር

በሚከተሇው ሁኔታ ተሻሽሎሌ፡፡

P. So as to enable to cause the execution of the

activity stipulated in sub-article 2 of this Article

above, the regional state may, as deemed as

necessary, establish a Regional Audit Service

Corporation which is administered in its own

revenue and accountable to the Regional

Auditor General in its profession. The detail

structure shall be determined by a regulation.

3. From Letters “C to E” in Sub-article 1 and

Article 2 under “organizational Structure”

in Article 7 of Proclamation No. 186/2011 are

replaced by the following sub-articles:

C. Heads of Branch Office or Coordinators,

D. Sectoral Directors,

E. Performing auditors and other necessary

staffs.

2. While the leadership of the office is led by the

auditor general, it may comprise deputy auditor

generals, heads of branch office, sectoral

directors and as deemed as necessary, audit

team leaders or audit managers.

4. “Workers Administration Law” stipulated in

Article 1 and 2 under Article 8 of Proclamation

No. 186/2011 are amended in Article 10, Sub-

article 10 in this amendment as follows:


10. የመሥሪያ ቤቱን መዋቅርና የደመወዝ ስኬሌ

በማዘጋጀትና በክሌለ ምክር ቤት እንዲጸድቅ

በማድረግ የኦዲተሮችን ደመወዝና ጥቅማ

ጥቅሞቻቸውን ክፍያ ይፈጽማሌ፡፡ ዝርዝር

አፈጻጸሙን አስመሌክቶ በምክር ቤቱ በኩሌ

የማስፈጸሚያ ደንብ እንዲወጣ ይጠይቃሌ።

በክሌለ የሲቪሌ ሰርቪስ አስተዳደር ሕግና

ደንብ ውስጥ የተመሇከቱ መሠረታዊ

ዓሊማዎችን ጠብቆ መሥሪያ ቤቱ

የሚያዘጋጀውን የሰው ሃይሌ ስምሪት ደንብ

በክሌለ ምክር ቤት በማስጸደቅ ሇመሥሪያ

ቤቱ ሥራ አስፈሊጊ የሆኑ የኦዲተሮችን

ቅጥር፤ ዝውውር፤ ደረጃ እድገት፤

የማስተዳደርና የስንብት ተግባራትን

በሚጸድቀው ደንብ መሠረት ይፈጽማሌ፡፡

5. በአዋጅ ቁጥር 186/2003 በአንቀጽ 11 ከንዑስ

አንቀጽ 1 እስከ 3 ስሇ ምክትሌ ዋና ኦዲተር

ስሌጣንና ተግባር የተመሇከተው ከዚህ

የማሻሻያ አዋጅ ቀጥል በተመሇከቱት 4

አንቀጾች ተተክተዋሌ፡፡

የምክትሌ ዋና ኦዲተሮች ተጠሪነት ሇዋና ኦዲተሩ

ሆኖ የሚከተለት ተግባራትና ኃሊፉነቶች አሎቸው::

1. የቴክኒክ ዘርፍ ምክትሌ ዋና ኦዲተር የዋናውንና

የቅርንጫፍ ጽህፇት ቤቱን የቴክኒክ ዘርፎች

ተግባራትና ኃሊፉነቶች እንዲሁም የኦዲት

ሥራዎች ከሚመሇከታቸው ጋር ሆኖ በማቀድ

በማዯራጀት፤ በመምራት፤ በማስተባበርና

በመከታተሌ ዋና ኦዲተሩን ይረዳሌ፡

10. Effects payment of auditors’ salalry and

allowances by preparing the structure and salary

scale of the office and getting approved same

by presenting to the regional council.

Concerning the particular performance, it

requests, through the council, executing

regulation to be issued. By respecting the basic

objectives of the regional civil service

administration law and regulation, and getting

approved the office’s human operation

regulation by the regional council; it executes

the employment, transfer, promotion,

administration and dismissal of auditors

necessary to the office on the basis of the

regulation to be approved.

5. The powers and duties of deputy auditor

general stipulated in Article 11, sub-article

from 1 to 3 of Proclamation No. 186/2011 are

replaced by the following 4 articles following

the amendment of this proclamation:

The Deputy Auditor Generals, being accountable to the

Auditor General, have the following duties and

responsibilities:

1. The Technic Sector Deputy Auditor General

helps the Auditor General by planning,

organizing, leading, coordinating and following

up_ with concerning bodies, the activities and

responsibilities of the main and branch office

technic sector as well as audit works.


2. የአስተዳዯር ዘርፍ ምክትሌ ዋና ኦዲተር

የዋናውን መስሪያ ቤትና የቅርንጫፍ ጽህፇት

ቤቱን የአስተዳዯርና የፊይናንስ ድጋፍ ሰጭ

አገሌግልቶችን ተግባራትና ኃሊፉነቶች

ከሚመሇከታቸው ጋር ሆኖ በማቀድ፤

በመምራት፤ በማስተባበርና በመከታተሌ ዋና

ኦዲተሩን ይረዳሌ፡፡

3. ዋና ኦዲተሩ በማይኖርበት ወይም ሥራውን

ሇማከናወን በማይችሌበት ጊዜ ሇየዘርፊቸው

የተሰጡትን ተግባራትና ኃሊፉነቶች እርሱን

ተክተው ይሠራለ፡፡

4. በዋና ኦዲተሩ የሚመሩሊቸውን ላልች

ተግባራት ያከናውናለ፡፡

6. በአዋጅ ቁጥር 186/2003 ያሌነበረ አዲስ

የቅርንጫፍ ጽህፈት ቤት ኃሊፊ /አስተባባሪ/

ስሌጣንና ተግባር በተመሇከተ በዚህ ማሻሻያ

አዋጅ ሊይ አንቀጽ 12 ሆኖ በስሩ 5 ንዐስ

አንቀጾች እንደሚከተሇው ተጨምሯሌ፡፡

የቅርንጫፍ ጽህፈት ቤት ኃሊፊዎች ወይም አስተባባሪዎች የሚከተለት ሥሌጣንና ተግባራት ይኖሯቸዋሌ፡-

1. በስራቸው በታቀፉ የያካባቢው መንግሥታዊ

መሥሪያ ቤቶችና ድርጅቶች የኦዲት ሥራዎችን

ከዋናው መስሪያ ቤት የሚመሇከተው አካሌ ጋር

በመቀናጀት ያቅዳለ፣ ያደራጃለ፣ ይመራለ፣

ያስተባብራለ፣ ይከታተሊለ፡፡

2. በስራቸው የተመደቡ ዳይሬክተሮችን፣ ኦዲተሮችንና

ላልች የአስተዳደር ሠራተኞችን በቅርበት ሆኖ

ይመራለ፣ ያስተዳድራለ፤ ከዋናው መሥሪያ ቤት ጋር

በመመካከርና በመቀናጀት የቅጥር፤ የዝውርር፤ የምደባ፤

ስምሪትና ዲሰፕሉን የስምሪት ሥራዎችን ያከናውናለ፡፡

2. The Administration Sector Deputy Auditor

General helps the Auditor General by planning,

organizing, leading, coordinating and following

up_ with concerning bodies, the administration

and finance support services activities and

responsibilities of the main and branch office.

3. Carries out their own sector duties and

responsibilities on behalf of the auditor general

when he is absent or unable to carry out his

duties.

4. Performs other activities referred to them by the

auditor general.

6. Regarding the Powers and Duties of Head of

Branch Office or Coordinator, which was

not present in Proclamation No. 186/2011, 5

Sub-articles are added being under Article

12, in this amendment proclamation, as

follows:

The Heads of Branch Office or Coordinators

have the following powers and duties:

1. Plans, organizes, leads, coordinates and

follows up audit works of local government

offices and organizations embraced under

them _integrated with concerning body of

the head office.

2. Administers and leads directors, auditors

and other administrative workers assigned

under them, and carries out works of

employment, transfer, assignment, operation

and discipline in consultation and

integration with the head office.


3. ሇየቅርንጫፍ ጽህፈት ቤቶች የተመደበውን

በጀትና ማንኛውም ሃብት ወይም ንብረት ከዋናው

መስሪያ ቤት የሚመሇከተው አካሌ ጋር

በመመካከር በአግባቡ ሥራ ሊይ ያውሊለ፤ መዋለን

ይከታተሊለ፡፡

4. በቅርንጫፍ ጽህፈት ቤቱ ሥር የሚከናወኑ

አጠቃሊይ ሥራዎችን በቅርበት ይመራለ፤

የአፈጻጸም ውጤቱንም በየጊዜው ሇዋናው መሥሪያ

ቤት ሪፖርት ያቀርባለ፡፡

የሚመሩሊቸውን ላልች ተግባራት ያከናውናለ፡፡

7. በአዋጅ ቁጥር 186/2003 በአንቀጽ 20 ‹‹ ስሇ

ኦዲት ወሰንና የጊዜ ገዯብ›› ንዑስ አንቀጽ 2

እንዯሚከተሇው የተሻሻሇ ሲሆን በተጨማሪም

ንዑስ አንቀጽ 3 እንዯሚከተሇው ተጨምሯሌ፡፡

2. መሥሪያ ቤቱ የኦዲት ሥራዎችን

በሚያከናውንበት ጊዜ ኦዲት ከሚያዯርግበት

የበጀት ዓመት ወዯኋሊ ከ5 የበጀት ዓመታት

ማሇፍ የሇበትም፡፡ ሆኖም ወንጀሌ ተፇጽሟሌ

ብል ያመነ እንዯሆነ ወዯ ኋሊ እስከ 10

ዓመት ያሇን ጉዳይ ኦዲት ከማድረግ በዚህ

ድንጋጌ አይታገድም፡፡

3. Properly utilizes and follows up its

utilization of the appropriated budget and

any wealth or property of each branch office

in consultation with concerned body of the

head office.

4. Leads general activities performed in the

branch office, and periodically sends

performance reports to the head office.

5. Carries out other activities referred to them

by the auditor general and deputy auditor

generals.

PART THREE

MISCELLANEOUS PROVISIONS

7. Where as Sub-article 2, about “Audit

and Time Limit” in Article 20 of

Proclamation No. 186/2011, is amended

as follows, Sub-article 3 is added as

follows:

2. While the office is performing audit

works, it shall not traceback after 5 years

from the auditing budet year. However, it

shall not be prohibited in this provision

from auditing by tracingback upto 10 years

when it believed that crime is committed.

3. በዚህ አንቀጽ ንዑስ አንቀጽ (2) ስር

የተዯነገገው ቢኖርም ሇኦዲት ውጤቱ

አስተማማኝነትና ሕጋዊነት አስፇሊጊ የሆኑ

ማስረጃዎችን የሚያቀርቡና መረጃዎችን

የሚሰጡ ብልም ተጠያቂ የሚሆኑ አካሊት

በተሇያዩ ተጨባጭ ምክንያቶች አሇመኖራቸው

በዋና ኦዲተሩ ከታመነበት ሥራው

እንዳይጀመር ወይም የተጀመረው እንዲቋረጥ

ዋና ኦዲተሩ ሉወስን ይችሊሌ፡፡

8. በአዋጅ ቁጥር 186/2003 በአንቀጽ 21 ‹‹ስሇ

ኦዲት ተዯራጊዎች ግዴታ›› የሚሇው በዚህ

የማሻሻያ አዋጅ በአንቀጽ 21 የተሰየመ ሲሆን በስሩ

ከተመሇከቱት 4 ንዑስ አንቀፆች በተጨማሪ ንዑስ

አንቀጽ 5 እንዯሚከተሇው ተጨምሯሌ፡፡

5. የማናቸውም ኦዲት ተደራጊ ተቋም ስራ

አመራር፤ የአካባቢ አስተዳደር ወይም

ከንቲቫ እና የምክር ቤት አፈ-ጉባዔዎች

መስሪያ ቤቱ የኦዲት ስራውን

በሚያከናውንበት ወቅት በኦዲተሮችም ሆነ

በኦዲት ሥራው ሊይ የትኛውም ዓይነት

አካሊዊና ህሉናዊ ተጽዕኖ እንዳይደርስ

ማድረግ ወይም ደህንነታቸውን የማስጠበቅ

ግዴታ ይኖርባቸዋሌ፡፡

9. በአዋጅ ቁጥር 186/2003 ሊይ አንቀጽ 23 ‹‹ዋና

ኦዲተሩን ጨምሮ የኦዲት ባሇሙያዎች ስነ-

ምግባርና የሙያ ከሇሊ›› የሚሌ አዲስ አንቀጽና

በስሩ 4 ንዐስ አንቀጾች እንደሚከተሇው

ተካቷሌ፡፡

3. Notwithstanding the provision stipulated

under Sub-article (2) of this this Article, when

the auditor general believed that bodies who

presents the necessary data and evidences as

well as being accountable are not present due to

concret reasons for the sake of reliability and

legality of the audit result, the auditor general

may decide the work not be commenced or the

commenced one to be resumed.

8. Where as “Duties of those Subject to

Auditing” in Article 21 of Proclamation No.

186/2011, is entitled in Article 21 of this

amendment proclamation, Sub-article 5 is

added in addition to the existing 4 sub-

articles.

5. Leader of any institution subject to auditing,

local administrator or mayor and house speakers

of councils have obligations to cause secure the

auditors, and the work, from any physical as

well as psychological impact while the office is

performing its duties.

9. From Proclamation No. 186/2011, new Article 23

entitled “Code of Ethics and Protection of Auditors

including the Auditor General” is added and 4 Sub-

articles are included as follows:


1. በመሥሪያ ቤቱ ውስጥ ተቀጥረው ወይም

ተመድበው የሚያገሇግለ እና የሙያ ፈቃድ

ይዘው በክሌለ የመንግሥት መሥሪያ

ቤቶችና የሌማት ድርጅቶች ውስጥ በውጭ

ኦዲተርነት ተሰይመው የሚያገሇግለ የግሌ

ኦዲተሮች ዋና ኦዲተሩ ከሀገር አቀፍ

የሙያው ስነ ምግባር ደንብ ጋር በተገናዘበ

ሁኔታ የሚያወጣውን የሙያ ስነ-ምግባር

መመሪያ አክብረው የመሥራት ግዴታ

አሇባቸው፡፡

2. በፍርድ ቤት ካሌታዘዘ ወይም በዋና ኦዲተሩ

ካሌተፈቀደ በስተቀር ማንኛውም የመሥሪያ

ቤቱ ተሿሚ፣ ባሇሙያ ወይም ሠራተኛ እና

በዚህ አዋጅ አንቀጽ 10 ንዐስ አንቀጽ 9

እና አንቀጽ 13 መሠረት ውክሌና በተሰጠው

አካሌ የተመደበ ባሇሙያ በሥራው አጋጣሚ

ያወቀውን ወይም ያገኘውን ምስጢር ሕግ

ከሚያስገድደው በስተቀር በማንኛውም ጊዜ

የመጠበቅ ግዴታ አሇበት፡፡

3. ይህንን አዋጅ በመከተሌ ተዘጋጅተው

ሇምክር ቤቱ የሚቀርቡ ሪፖርቶች በዋና

ኦዲተሩ ሊይ የፍትሏብሔርም ሆነ የወንጀሌ

ክሶችን ሇመመስረት በጥቅም ሊይ ሉውለ

አይችለም፡፡

4. ኦዲተሮች ስራቸውን በሚያከናውኑበት

ስፍራና ጊዜ የጸጥታ ችግር ሲያጋጥማቸው

ወይም እንደሚገጥማቸው በመስሪያ ቤቱ

ሲታመንበት ዋና ኦዲተሮች ገሇሌተኛ

የደህንነት ጥበቃ እንዲደረግሊቸው

ሁኔታዎችን ያመቻቻለ፡፡

1. Auditors those serve being employed or assigned

in the office or private auditors serving in the

regional state offices and development

enterprises assigned as external auditors having

professional lisence shall have the duty to respect

the Directive of Code of Ethics to be issued by

the auditor general in line the National Code of

Ethics.

2. Unless it is ordered by court or permited by the

auditor general, any appointee of the office or

expert or worker and any expert who has been

given deligation according to Sub-articles 9 and

of Article 10 and Article 13 in this proclamation,

shall have the duty to be confidencial of he has

known in his work except legally obligated.

3. Reports prepared and presented to the council

following this proclamation shall not be used to

institute civil or criminal charges on the auditor

general.

4. When and wherever auditors face security

problem while performing their work or when

the office believed that they will face security

problem, the auditor generals facilitate

conditions that neutral security protection to be

assigned for the auditors.


10. በአዋጅ ቁጥር 186/2003 ከአንቀጽ 24 ‹‹ጥፋትና

ቅጣት›› በሚሌ በተመሇከተው አንቀጽ ስር ንዐስ

አንቀጽ 2 በሚከተሇው ላሊ አንቀጽ ተተክቶ

የቀድሞው ንዐስ አንቀጽ 2 ወደ 3 ተሸጋሽጓሌ፡፡

2. ከዚህ በሊይ በንኡስ አንቀጽ (1) ስር የሰፈሩት

ድንጋጌዎች እንደተጠበቁ ሆነው ጥፋቱን

የፈፀመው ሰው ተሿሚ የሆነ እንደሆነ

በሾመው አካሌ አማካኝነት ከስሌጣን

እስከማንሳት ተጨማሪ እርምጃ

ይወሰድበታሌ፡፡

በተጨማሪም ንኡስ አንቀጽ 4 እንሚከተሇው

ተጨምሯሌ፡፡

4. ከዚህ በሊይ በንኡስ አንቀጽ (3) ስር የሰፈሩት

ድንጋጌዎች እንደተጠበቁ ሆነው ጥፋቱን የፈፀመው

ኦዲተር ተሿሚ የሆነ እንደሆነ በሾመው አካሌ

አማካኝነት ከስሌጣን እስከ ማንሳት እርምጃ

ይወሰድበታሌ፡

11. በአዋጅ ቁጥር 186/2003 ከአንቀጽ 27

‹‹አዋጅ የሚጸናበት ጊዜ›› የነበረው አንቀጽ

‹‹መመሪያ የማውጣት ስሌጣን›› በሚሌ በአዲስ

ርዕስ አንቀጽ ተተክቶ የቀድሞው አንቀጽ 27

ወደ ቀጣዩ አንቀጽ 28 ተሸጋሽጓሌ፡፡

መሥሪያ ቤቱ ሇዚህ አዋጅ ወይም በአዋጁ

መሠረት ሇሚወጡት ደንቦች የተሟሊ ተፈፃሚነት

የሚረዱትን ዝርዝር መመሪያዎች ሉያወጣ

ይችሊሌ፡፡

10. Under Article 24 entitled “Offences and

Penalty” in Proclamation No. 186/2011, Sub-

article 2 is replaced as follows and the

previous Sub-article 2 is forwarded to Sub-

article 3:

2. Without prejudice to the provisions stipulated

in sub-article (1) above, if the person who

committed the crime is an appointee, a measure

shall be taken on him from lifting of

appointment through the appointer to additional

measure.

In addition, Sub-article 4 is added as

follows:

4. Without prejudice to the provisions stipulated in

sub-article (3) above, if the auditor who

committed the crime is an appointee, a measure

shall be taken on him from removal of

appointment through the appointer.

11. The previous Article 27 entitled “Effective

Date the proclamation” in Proclamation No.

186/2011, is replaced by “Power to Issue

Directives” and the previous Article 27 is

forwarded to Article 28.

The office may issue detail directives necessary for

the implementation of this proclamation and

regulations to be issued based on the proclamation.


12. አዋጁ የሚጸናበት ጊዜ፤

ይህ አዋጅ በክሌለ መንግሥት ዝክረ-ሕግ ጋዜጣ

ታትሞ ከወጣበት ቀን ጀምሮ የጸና ይሆናሌ፡፡

12. Effective Date of the Proclamation

This proclamation shall come into force as of its

publication in the regional state Zikre Hig
