Lisa Vincent announced Gabriel Garcia will no longer be our WIA Regional Advisor, and at this time we do not know who his replacement will be.

2. Call to Order / Establish Quorum Meeting called to order at 8:27 a.m. with quorum present.

3. Agenda Review and Order Approval Raymond Rivera moved to approve the agenda; Maggie Campbell seconded; motion passed.

4. Approve Executive Committee Minutes of February 25, 2015 Raymond Rivera moved to approve minutes for the February 25, 2015 meeting; Angelina Veal seconded; motion passed.

5. Receive resignation of YYOC member; Claudia Aguilera Magana/Out-of-School Youth Executive Members received Claudia Aguilera Magana’s resignation from the Yolo Youth Opportunity Council as an Out-of-School Youth.

6. Receive/Review/Discuss WIB membership documents; roster, member matrix, and attendance Discussion of several WIB membership terms reaching expiration date, and how to proceed with the changes with the new WIOA and WIB. Members decided to create a small group to discuss the process further and Gary will draft a reappointment letter for the workgroup to discuss.

7. Discuss WIB Meeting Wrap Up of March 11, 2015 Gary Pelfrey discussed the outcome of the survey following the March 11, 2015 WIB Meeting.

8. Receive/Review/Approve Draft WIB Agenda for May 13, 2015

Gary Pelfrey announced Gary Panepinto, Regional Manager of Manex will be the guest speaker at the May 13, 2015 WIB meeting. On the agenda Gary would also like to include a section for WIOA updates. Lisa Vincent asked if a WIB letter of support for the Supervised population Workforce Training Grant Program could be included on the agenda. Maggie Campbell moved to include the guest speaker, a section for WIOA updates, and a letter of support be included on the May 13, 2015 WIB Agenda; Angelina Veal seconded; motion passed.

9. Feedback/Planning updates from NAWB Conference to include WIA to WIOA transition strategies

Gary Pelfrey stated he learned a lot at the NAWB Conference about the changes from WIA to WIOA. Gary also put together and handed out suggested steps for WIOA Planning and Implementation. He stated the new program starts July 1, 2015; and wants to set up a sub-meeting to get going on a layout timeline with goals, programs, policy and procedures.

10. Receive Workforce Services Draft Directive (WSDD) 114/Waivers for OJT and Youth Procurement and New Waiver Process This directive provides policy guidance pertaining to two statewide waivers granted to California under the Workforce Investment Act.

11. Receive WSDD 115/WIA Closeout Handbook This draft directive will supersede Directive WSD09-12, dated March 3, 2010. The revisions to this directive are focused on updated the procedures to reflect the new CalJOBSSM system.

12. Receive Workforce Services Directive 14-11/Salary and Bonus Limitations for 2015 This directive issues the 2015 salary and bonus limitation for individuals compensated by monies appropriated to Department of Labor, Employment and Training Administration funded programs.

13. Receive Workforce Services Information Notice (WSIN) 14-35/CalJOBSSM User Group Meeting April 15-16, 2015 The Workforce Services Branch invites all Local workforce Investment Area Management Information System Administrators, CalJOBSSM Super Trainers, and Employment Development Department Single Points of Contact/Ambassadors to attend the upcoming CalJOBSSM User Group Meeting.

14. Receive WSIN 14-36/DOL American Apprenticeship Initiative Grant The State of California’s Labor and Workforce Development Agency and the California Community college Chancellor’s Office formed an Interagency Taskforce on Apprenticeship Expansion.

15. Receive WSIN 14-37/Webinar – Implementing Effective Work Experience Models for Youth The Department of Labor is hosting the second of a three-part webinar series for the youth community to inspire strategic planning and action in anticipation of the July 1, 2015 implementation date of the Workforce Innovation and Opportunity Act.

16. Receive WSIN 14-38/AB 2060 Supervised Population Workforce Training Grant Program With the passing of Assembly Bill 2060, approximately $875,000 have become available for grants as part of the Supervised population workforce training Grant Program.

17. Receive WSIN 14-39/Grant Application Opportunity-Face Forward 3 The Face Forward grant program provides work-based learning opportunities and support services to youth ages 14-24 who have been through the juvenile justice system.

18. Receive WSIN 14-40/Local Board Conflict of Interest Code Requirements The California Workforce Investment Board has received concerns from Local Workforce Development Board members that are being required to regularly recuse themselves from participating in local board actions due to a preconceived conflict of interest.

19. Receive WSIN 14-42/Partnership Opportunities: Family Stabilization and Reunification The California Workforce Investment Board is seeking partnerships with Local Workforce investment Boards, America’s Job Centers of CaliforniaSM, county child welfare, health and human services, probation departments, housing and corrections agencies, workforce development agencies, and community/faith based organizations currently working with biological parents of children in foster care interested in testing new ideas and services strategies to reunite parents with their children.

20. Receive WSIN 14-43/TAA Program Petitions and Partnering with Rapid Response Teams Trade Adjustment Assistance (TAA) program is a federal program that provides a path for employment growth and opportunity through aid to United States workers who have lost their jobs as a result of foreign trade.

Receive WSIN 14-44/Grant Application Opportunity – Training to Work 3 – Adult ReentryThe Training to Work 3 – Adult Reentry grants provide organizations the opportunity to develop and implementcareer pathways programs in demand sectors and occupations for men and women, including veterans and peoplewith disabilities, who are at least 18 years old and enrolled in work release programs.

22. Receive WSIN 14-45/California ETPL Only Accessible Through CalJOBSSM

The California Eligible Training Provider List supports customer-focused employment training for adults anddislocated workers.

23. Receive WSIN 14-46/Wagner-Peyser Funds–Deaf and hard of Hearing ServicesThe Employment Development Department announces the availability of Wagner-Peyser 10 Percent Governor’sDiscretionary funds in a Solicitation for Proposal.

24. CWA/WIA/WIOA – UpdatesLisa Vincent reported she has not heard anything yet on the approval regarding the application to the BOS for the InitialLocal Area Designation and Initial Local Board Certification under Workforce Innovation and Opportunity Act.

25. Reports:a. Yolo Youth Opportunity Council – Judy Needham

Judy asked for a letter of support to the Board of Supervisors to disband the YYOC under WIA as of June 30,2013; and to recommend a youth services standing committee of the local board under Workforce Innovation andOpportunity Act as of July 1, 2015.

b. Criminal Justice/Public Defenders/Employment (WIB Member Committee) – Gary PelfreyGary announced Amanda Amos is back and trying to get things back on track again; and she is trying to find otherresources in the community.Gary reported he and Maggie Campbell have a 62-63 percent hire rate with the people they have worked with.

c. Executive Director – Elaine LytleElaine announced DESS will be hosting a Job Fair on June 19th along with Congressman Garamendi; and we will beasking the WIB members to help.

d. One-Stop – Raymond RiveraRaymond went over the Career Center’s statistical report and announced the Employment Center in Davis is now upand running.

26. Other Business That May Come Before the BoardLisa Vincent announced Northern California Construction Training (NCCT) is now on the ETPL, which help WIAclients to be in the apprenticeship program.

27. AdjournRaymond Rivera moved to adjourn the meeting; Angelina Veal seconded; meeting adjourned at 10:20 a.m.

ACTIVITIES This Information Notice (IN) supersedes WSIN14-15. The guidance for Funding Limits and Reporting for WIOA Transitional Activities has been revised due to the U. S. Department of Labor’s decision to overturn the 0.0554 percent rescission contained in the Continuing Appropriations Resolution, 2015, which was applied to round two allotments. Funding limits and reporting of Workforce Investment Act (WIA) Program Year (PY) 2014-15 funds for Workforce Innovation and Opportunity Act (WIOA) transitional activities must conform to the following guidance. Funding Limits Section 503(g)(2) of WIOA states that two percent of each of the PY 2014-15 WIA formula allotments for Youth, Adult, and Dislocated Worker funding streams is available to states for transition activities related to WIOA, and of that amount, no less than 50 percent shall be provided to Local Workforce Investment Areas (local areas) for their transitional activities. On October 28, 2014, the U.S. Department of Labor Employment and Training Administration released Training and Employment Guidance Letter (TEGL) 12-14, which provides guidance to states and other recipients of funds under Title I of WIA on the use and reporting of PY 2014-15 funds for the planning and implementation activities associated with the transition to WIOA. It also describes the methodology for calculating transitional funding limits to the states. The amounts available based on the methodology described in TEGL 12-14 for California and the total amounts available to the local areas have been revised as follows:

funding limits for each local area were calculated by using their relative share of the total allocation for each program. For example, if a local area received 1.8 percent ($1,874,950) of the total WIA Adult formula allocation ($104,163,890), then they were allocated 1.8 percent ($20,547) of the total local area transition funding allocation ($1,141,522) for WIA Adult formula. The amounts available for each local area by program are shown in the Funding Limits for WIOA Transitional Funds attachment. Financial Reporting Transition funding will not be subject to WIA or WIOA’s administrative cost limitations, and local areas may blend WIA Youth, Adult, and Dislocated Worker formula funds that are used for transition purposes. However, for tracking purposes, the funds must be reported to the state under the program where expenditures were incurred. For example, a local area may choose to exhaust their Youth allocation for transition activities first before using their Adult and Dislocated Worker portions. In this case, the costs associated with transition activities that were paid for with Youth funds should be reported and tracked under “Youth” until the limit is reached. Costs related to transition activities will be reported under “Section VII, Miscellaneous Items, line 2 - State Mandated Match, of the WIA Summary of Expenditures Report” in CalJOBSSM. The “State Mandated Match” line-item on the WIA “Summary of Expenditures Report” will be used as a temporary method for the Employment Development Department to track costs related to transition activities. Nothing else should be accounted for in “Section VII, Miscellaneous Items, Line 2 - State Mandated Match,” except those expenditures spent on WIOA transition activities. These costs should be traceable through the local area’s accounting system. We suggest that local areas use a unique identifier for these expenses for tracking and reporting purposes, and input the actual expenditures under “Section V -Cumulative Expenditures (Program) the WIA Summary of Expenditures Report” in CalJOBSSM to allow drawdown of cash. Any costs incurred for transitional activities must be reasonable, allowable, and allocable to WIOA authorized program activities and supported through sufficient documentation for monitoring and auditing purposes. All funds must be used for a WIOA authorized purpose. Funds may not be spent on activities prohibited under WIA or WIOA, such as purchase of real property. For additional information and guidance regarding WIOA transition activities, allowable and prohibited use of WIA transition funds, as well as high priority activities, refer to TEGL 12-14 or consult with your Regional Advisor regarding specific questions about allowable transition costs. Expiration Date: 06/13/17 69:167:vn:17487 TO: WORKFORCE DEVELOPMENT COMMUNITY SUBJECT: WIOA FORMULA ALLOCATIONS—PY 2015-16 The Workforce Innovation and Opportunity Act (WIOA) formula fund allocations for each Local Workforce Investment Area (Local Areas), Adult, Youth, and Dislocated Worker (DW) funding streams for Program Year (PY) 2015-16, have been released. These allocations are based on the allotments issued by the U.S. Department of Labor (DOL) to the states (DOL Training and Employment Guidance Letter (TEGL) 29-14, Change 1, dated May 1, 2015). In addition, TEGL 29-14, Change 1, clarifies that the amount available to the Governor for statewide workforce investment activities has been increased from eight and three-quarter percent to ten percent. The PY 2015-16 allotment was awarded from the DOL after December 26, 2014, therefore the new Federal Uniform Guidance (Uniform Administrative Requirements, Cost Principals, and Audit Requirements for Federal Awards; Final Rule) will apply. The state has received the first WIOA allotment for the youth program. Operational implementation of the WIOA youth program begins on July 1, 2015. The PY 2015-16 WIOA youth allotment distributed in April 2015 is for preparation and programmatic activities for WIOA youth program implementation on July 1, 2015. Notably, WIOA shifts the primary program focus of Title I youth formula programs to support the educational and career success of out-of-school youth (OSY). A minimum of 75 percent of WIOA youth funds, after subtracting funds spent on administrative costs, is required to be spent on OSY, which is an increase from the minimum 30 percent under the Workforce Investment Act (WIA). For the PY 2014-15 WIA youth allotment, including unobligated PY 2014-15 funds carried over to PY 2015-16, the 30 percent OSY expenditure minimum will still apply. Additionally for PY 2015-16 WIOA youth funds, Local Areas must spend a minimum of 20 percent of non-administrative local area funds on work experience. Local Areas must track funds spent on work experience beginning with PY 2015-16 funds. An Information Notice will be posted with additional information. Refer to TEGL 23-14, dated March 26, 2015, for further details on the youth program transition. Please be aware that this notice is being issued for planning and budgeting purposes only because the state has not yet received the federal Notice of Obligations (NOO) for any of the funding streams. Once the NOO has been received, Youth allocations will be released to Local Areas immediately. The Adult and DW allocations will be released as soon as we receive federal and state spending authority for these funds.

Under WIA, the method used to calculate hold harmless allocation levels for sub-state areas was prescribed for the Adult and Youth programs. There were no provisions in the WIA regulations that provided guidance on the calculation of the sub-state hold harmless levels for DW Program funds. As a result, a slightly different calculation method was developed in California to determine sub-state hold harmless allocation levels for DW Program funds. Unlike WIA, the WIOA prescribes a specific method to calculate sub-state hold harmless levels for DW Program funds. The new WIOA regulations now require a specific method to calculate sub-state hold harmless allocation levels for the DW program funds. As a result, there is an alignment in the WIOA hold harmless provisions across the Adult, Youth, and DW programs. The calculation method used to determine sub-state hold harmless Adult and Youth program fund allocations WIOA is unchanged from the WIA method. These hold harmless provisions were established to help mitigate year-to-year volatility in funding levels. Under WIOA Hold harmless provisions ensure that each area receives no less than 90 percent of their average percentage share from the two prior years. The Local Areas that receive more than 100 percent of their average percentage share from the previous two years will be proportionately reduced by the amount of total funding necessary to ensure that all Local Areas receive at least 90 percent of their average percentage share from the two prior years. The allotment to California and the amounts available for the formula allocation to the Local Areas are listed below. Attachment 1 reflects the total amount Local Areas will receive for each of the funding streams during the PY 2015-16. Additionally, Attachment 2 provides a breakdown of how each of the three funding streams is allocated.

2014-15 This Information Notice supersedes WSIN14-33. The Employment Development Department is now announcing the revised allocations for round two (commonly referred to as “advanced” funds) Workforce Investment Act (WIA) formula funds for each Local Workforce Investment Area (Local Area) for the Adult and Dislocated Worker funding streams for Program Year (PY) 2014-15. The U.S. Department of Labor (DOL) has overturned the 0.0554 percent rescission contained in the Continuing Appropriations Resolution, 2015, which was applied to round two allotments. Since the rescission allotment was awarded from the DOL after December 26, 2014, the new Federal Uniform Guidance (Uniform Administrative Requirements, Cost Principals, and Audit Requirements for Federal Awards; Final Rule) will apply. However, to ease the burden on the Local Areas of tracking PY 2014-15 funding with two separate sets of rules, the Department disbursed the additional PY 2014-15 rescission funds from existing WIA funds in the Governor’s Discretionary budget. Therefore, the revised rescission funds that each Local Area will receive will be subject to WIA regulations instead of the new Uniform Guidance. The new Uniform Guidance will go into effect with PY 2015-16 allotments. The revised allotments to California, and the amounts available for formula allocation to the Local Areas, are listed below. Attachment 1 reflects the revised total amount Local Areas will receive for each of the funding streams during the PY 2014-15. Additionally, Attachment 2 provides a breakdown of how each of the three funding streams is allocated. Note that the rescission has been applied only to round two.
