Southern Nations, Nationalities and Peoples’ Regional

State Segen Area Peoples Zone Konso Woreda Cultural

Landscape Heritages

Preamble

Where As, it is necessary to conserve and protect the

Konso cultural landscape heritages to the coming

generation that are the result of a long century living

practice, natural process and human effort,

Where As, It is became necessary to demarcate the heritage

and the surrounding for the sake of protecting the heritages

from man made and natural disaster and it is appropriate to

ጥበቃንና ኀብረተሰቡ ከነሱ የሚያገኘውን ጥቅም

በማረጋገጥ የቅርሶቹን ጥበቃና ጠቀሜታ ማጣጣም ተገቢ

በመሆኑ፣

ቅርሶችን በሚመለከት በወጡ ክልላዊና ብሔራዊ ሕጎች

አማካይነት የኮንሶ ባህላዊ መልከአ ምድር ቅርሶችን

ማጥናት፣ መጠበቅ፣ ማልማትና ማስተዳደር

ለማህበራዊና ኢኮኖሚያዊ ጥቅም እንዲውሉ ማድረግ

በማስፈለጉ፤

ተሻሽሎ በወጣው የደቡብ ብሔሮች፣ ብሔረሰቦችና

ሕዝቦች ህገ መንግሥት አንቀጽ ፶፩ ንዑስ አንቀጽ ፫ (ሀ)

መሠረት የሚከተለው ታውጇል፡፡

ክፍል አንድ

ጠቅላላ

1. አጭር ርዕስ

ይህ አዋጅ በደቡብ ብሔሮች፣ ብሔረሰቦችና

ሕዝቦች ክልል መንግሥት “የኮንሶ ባህላዊ

መልክአ ምድር ቅርሶችን ለመጠበቅ የወጣ አዋጅ

ቁጥር -፻፵፩/፳፻፫” ተብሎ ሊጠቀስ ይችላል፡፡

2. ትርጓሜ

የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠው ካልሆነ

በስተቀር

1. “የክልል መንግሥት” ማለት የደቡብ

ብሔሮች፣ ብሔረሰቦችና ሕዝቦች ክልል

መንግሥት ነው፡፡

2. “ወረዳ” ማለት የኮንሶ ወረዳ ነው፡፡

3. “ቢሮ” ማለት የደቡብ ብሔሮች፣

ብሔረሰቦችና ሕዝቦች ክልል መንግሥት

የባህልና ቱሪዝም ቢሮ ነው፡፡

4. “ባህላዊ መልከአ ምድር” ማለት የሰው ስራና

የተፈጥሮ ሂደት የጋራ ውጤት ነው፡፡

compromise the conservation and importance of the Konso

cultural landscape heritages through ensuring the

conservation and community benefit from the heritages;

Where As, it is became necessary to study, conserve,

develop, and administer the Konso cultural landscape

heritages and apply for the socio economic benefit, in

accordance with the regional and federal laws issued

regarding heritages;

Now therefore, in accordance with Article 51 sub article

3(a) of the revised constitution of the South Nations,

Nationalities and Peoples’ Regional State hereby

proclaimed as follows.

Part OneGeneral

1) Short Title

This proclamation may be cited as the south

Nations, Nationalities and Peoples Regional State

“Proclamation to provide for the conservation of

Konso Cultural Landscape Heritage No.141/2011”

2) Definitions

In this proclamation, unless the context otherwise

requires:-

1. “Regional State” means the south Nations,

Nationalities and peoples’ regional State.

2. “Woreda” means Konso Woreda.

3. “Bureau” means the south Nations,

Nationalities and Peoples’ Regional State

Culture and Tourism Bureau.

4. “Cultural Landscape” means the common product

of both the labor of man and natural process.

5. “ቅርስ” ማለት በቅድመ ታሪክና በታሪክ

ዘመናት የሰው ፈጠራና ሥራ ውጤት

የሆነ የተፈጥሯዊ ለውጦች ነፀብራቅና

ምስክር የሆነና ከፍተኛ ሳይንሳዊ እሴትነት

ያለው ማንኛውም ግዙፍነት ያለው ወይም

ግዙፍነት የሌለው ነገር ነው፡፡

6. “የተከለከሉ መካነ ቅርሶች” ማለት ቅርሶችና

መካኖቻቸው ደህንነታቸው ተጠብቆና

ለልማት ውለው ዘላቂ ጥቅም እንዲሰጡ

ለማስቻል ከሚኖሯቸው ባህላዊ፤ ታሪካዊና

ስነ ህይወታዊ ገጽታዎች ከፍተኛ ዋጋ

የተነሳ የሚከለሉና የሚጠበቁ መካነ ቅርሶች

ናቸው፡፡

7. “የቅርስ አስተዳደር ኘላን” ማለት ቅርሶችን

ለመመዝገብ፣ ለማጠናት፣ ለመጠበቅ፣

ለመንከባከብ፣ ለማስተዋወቅና ጥቅም ላይ

ለማዋል የወጣ የዕቅድ ሠነድ ነው፡፡

8. “የቅርስ አስተዳደር ኮሚቴ” ማለት በኮንሶ

ወረዳና ቀበሌዎች የተቋቋመ የቅርስ

አስተዳደር ኮሚቴ ነው፡፡

9. “ፓሌታ ወይም ቀበሌ” ማለት በድንጋይ

ግንብ የታጠረ የኮንሶ ባህላዊ መንደር ወይም

የቀበሌ አስተዳደር ነው፡፡

፲ “ዋካ” ማለት የተለያዩ ቅርፆችን የያዘ በጀግና

መቃብር ላይ የሚቆም ከእንጨት የተሰራ

ሐውልት ነው፡፡

01. “ትክል ድንጋይ ወይም ዳካ ዲሩማ/ዳጋ

ሄላ” ማለት ለአንድ ትውልድ ወይም ግለሰብ

ጀግንነት ወይም ስኬታማነት መታሰቢያ

እንዲሆን በሞራ ውስጥ ወይም ከሞራ

ውጭ የሚተከል የድንጋይ ሐውልት ነው፡፡

5. “Heritage” means any tangible or intangible

item that is the product of the creativity and

labor of man during prehistoric and historical

periods, is the reflection of and testimony to

natural modification and is of high scientific,

historical, cultural, artistic and artisan values.

6. “Demarcated Heritage Sites” means heritage

sites that, for their cultural, historical and

biological features, are important enough to be

demarcated and protected in order to safeguard

and develop heritage and sites for sustainable

use.

7. “Heritage Administration Plan” means

strategic document in order to register, study

protect, conserve promote and use the heritages.

8. “Heritage Administration Committee” means

heritage Administration committee established

in Konso Woreda and its Kebeles.

9. “Paleta or Kebele” means Konso traditional

village, or Kebele administration encircled by

stone wall.

10. “Waka” means memorial wooden statue with

varied engravings that is placed on graves of

heroes.

11. “Stelae or Dhaka Diruma /Dhaga Hela”

means stone monument erected in “ Mora” or

outside “Mora” to commemorate the heroism

and success of a generation or an individual.

02. “ሞራ” ማለት ሕዝባዊ ስብሰባ ወይም

ባህላዊ ክንዋኔዎች የሚደረጉበት በውስጡ

ትልቅ ቤት ሊይዝ ወይም ላይዝ የሚችልና

ከባህላዊ መንደር ውስጥ ወይም ውጭ

የሚገኝ ቦታ ነው፡፡

03. “ኦላይታ” ማለት ለትውልድ መታሰቢያነት

ሞራ ላይ የሚተከል ረጅም የጥድ እንጨት

ነው፡፡

04. “ጥብቅ ባህላዊ ደን” ማለት ለባህላዊና

ማህበራዊ ጥቅም እንዲሁም ለብዝሀ

ህይወትና ለመሬት ጥበቃ ሲባል ለባህላዊ

መሪዎች በአደራነት የተሰጠ ባህላዊ ደን

ነው፡፡

05. “ጥብቅ ክልል” ማለት የቤት ሥራና ሌሎች

የግንባታና የልማት እንቅስቃሴዎች በድንጋይ

ግንብ ወደ ታጠሩ መንደሮች ዘልቆ

በመግባት እንዳይከናወኑ ለማድረግ በባህላዊ

መንደሮችና ለእርሻ ሆነ ለሌሎች ዓላማዎች

በሚውል መሬት መካከል የሚገኝ የተከለለ

ቦታ ነው፡፡

06. “ህርዳ ወይም ባህላዊ ኩሬ” ማለት ለረጅም

ጊዜ አገልግሎት እንዲሰጥ በማሰብ የኮንሶ

ሕዝብ በአፈርና በድንጋይ ካብ የሚሰሩት

ባህላዊ ውሃ ኩሬ ነው፡፡

07. “ዲና” ማለት ለመቃብር፣ ለእሳት ቃጠሎ

መቆጣጠሪያ ፣ ለመከላከያና ለቆሻሻ መጣያ

እንዲሆን በባህል የሚጠበቅ በፖሌታዎች

ወይም በታጠሩ መንደሮች ዙሪያ የሚገኝ

የተፈጥሮ ወይም ሰው ሰራሽ ደን ነው፡፡

08. “ሰው” ማለት የተፈጥሮ ሰው ወይም በህግ

የሰውነት መብት የተሰጠው አካል ነው፡፡

12. “Mora” means venue for public meetings and

cultural events that may be with or without a

large house and may be inside or outside

traditional village /Paletas.

13. “Olayta” means a tall piece of conifer wood

erected in Moras as a memorial to a generation.

14. “Protected cultural Forest” means cultural

forest entrusted to and protected by tribal chiefs

for communal and cultural use and preservation

of biodiversity and land.

15. “Protective Demarcation” means a

demarcated area that lies as a buffer between

cultural villages and land used for agricultural

or other purposes in order to stop housing and

other construction and development activities

from trespassing on the villages encircled by

stone

16. “Harda or Cultural Water Pond” means

traditional water pond made by the Konso

People by using soil and stone piles with the

aim of collecting and using water for long

period of time.

17. “Dina” means naturally grown forest or planted

groove found around palettes or walled villages

and that is traditionally protected for purposes

of cemetery, fire control, defense and waste

disposal.

18. “Person” means a natural or an entity bestowed

with juridical personality.

09. “ጉልት” ማለት ከድንጋይ ወይም ከብረት

ወይም ከሌላ ቋሚ ከሆነ ነገር ተሰርቶ

የተቀመጠ የወሰን መለያ ምልክት ነው፡፡

3. የተፈፃሚነት ወሰን

ይህ አዋጅ በደቡብ ብሔሮች፣ ብሔረሰቦችና

ሕዝቦች ክልል መንግሥት በኮንሶ ወረዳ ውስጥ

በሚገኙ የተከለሉ መካነ ቅርሶች ላይ ተፈፃሚ

ይሆናል፡፡

ክፍል ሁለት

4. ክለላና ወሰኖች

1. አጠቃላይ መግለጫ

በኮንሶ ወረዳ የሚገኘው የኮንሶ ባዓለዊ

መልክአ ምድር መካነ ቅርስ ስፋቱ ፩፻፵

ኪሎ ሜትር ካሬ ወይም ፲፬ሺ ሄክታር ሆኖ

በ፭ዐ፲፮’፲፭’’ እና በ፭ዐ፳፩’፳’’ ኬክሮስና

በ፴፯ዐ፳’፲፭’’ እና በ፴፯ዐ፳፮’፵፱’’ ኬንትሮስ

መስመሮች መካከል ያሉትን ቅርሶችና መካነ

ቅርሶች ይይዛል፡፡

፬.፪. በህግ የተከለሉ ሀብቶች

ከላይ በተገለፁት መልክአ ምድራዊ

ጠቅሚ መስመሮች ውስጥ ሚገኙና

ከዚህ ቀጥሎ ተለየተው የሚዘረዘሩት

ባህላዊ ሀብቶች በሕግ የተከለሉ

ይሆናል፡፡

ሀ. ባህላዊ የእርሻ እርከኖች

ለ. የታችኛ ዶካቱ ፓሌታ ባህላዊ

መንደር

ሐ. የሁልሜ ፓሌታ ባህላዊ መንደር

መ. የቡርቁዳ ፓሌታ ባህላዊ መንደር

ሠ. የደራ ፓሌታ ባህላዊ መንደር

19. “Post” means a boundary post made from stone

or metal or other stationary object to mark a

boundary.

3) Scope of application

This proclamation shall be implemented in the

southern Nations, Nationalities and Peoples’

Regional State demarcated heritage sites of Konso

Woreda.

Part Two

4) Demarcations and Boundaries

1. General Description

Konso Cultural Landscape Heritage site which

is located in Konso Woreda and covering and

area of 140 square Kilometers or 14000 hectares

consists of heritage and heritage sites

demarcated between 5016’15” and 5021’20”

Latitude and 37020’15” and 37026’49”

Longitude.

4.2. Legally demarcated Resources

All Cultural Resources properties located

with in the above demarcated geographical

coordinates and listed below are all

protected by law.

a. Traditional agricultural terraces.

b. Traditional village of Lower Dokatu

Paleta.

c. Traditional village of Hulme Paleta.

d. Traditional village of Burquda Paleta.

e. Traditional village of Dara Paleta.

ወ. የመጨቄ ባህላዊ ኩሬ (ሀርዳ)

፬.፫. ከላይ በንዑስ አንቀጽ ፪ የተዘረዘሩት

ባህላዊ ከተሞችና በዙሪያቸው ሞራ

የተባሉ ባህላዊ ክፍት ቦታዎች፣ ኦላይታ

ዛፎች፣ ለጀግናና ለትውልድ መታሰቢነት

የቆሙ ሐውልቶች (ዳጋ ዲሩማ፣ ዳጋ

ሄላ፣ ዋካ) ጥንታዊ መቃብሮችና

ዲና(ደን) የሚገኙባቸው ናቸው፡፡

፬.፬. ከዚህ በታች የተዘረዘሩት

በአስተዳደራዊው ከተማ ካራትና በዱካቱ

ገበያ አቅራቢያ የሚገኙ ባህላዊ

መንደሮች የተለየ ሕጋዊ ጠበቃ

ይደረግላቸዋል፡፡

፬.፬.፩ የደራ ባህላዊ መንደር እንደሚከተለው

ይዋሰናል፤ በስተሰሜን፡- ከሰሜን ወደ

ምስራቅ በሚፈሰው የኮሮኮ ወንዝ

(ጉልት ቁጥር አንድ) በስተምስራቅ፡-

በደራሃ በጃርሶ ፓሌተዎች መካከል

የሚገኘውና ባህላዊ ወሰን የሆነው

f. Traditional village of Olanta Paleta.

g. Traditional village of Gamole Paleta.

h. Traditional village of /Gocha Paleta.

i. Traditional village of Mecheke Paleta.

j. Traditional village of Mechello Paleta.

k. Traditional village of Buso Paleta.

l. Traditional village of Burjo Paleta.

m. Protected forest of Kala.

n. Protected forest of Qufa.

o. Protected forest of Bamale.

p. Traditional Pond of Dokatu /Harda/.

4.3.The traditional towns mentioned under sub-

article 2 above include cultural spaces called

Moras, and Olayta trees, hero and generation

memorial stelae (daga – Diruma and Daga-

Hela), waka, ancient cemeteries and dina

(forests) around them.

4.4.Traditional villages mentioned below and

located near the administrative town of Karat

and Dokatu Market shall have special legal

protection.

4.4.1- The Dara traditional village - is bounded

as follows: To the North- The Koroko River

running from north towards east (“Post” No.

1).-To the East- The traditional boundary

defined by the foot trail between Dara and

Jarso communities (“Post” No. 2). To the

ይዋሰናል፤ በስተሰሜን- የኪልኪሎ ወንዝ

(ጉልት ቁጥር አንድ) በስተምስራቅ-

የኦላንታና የበቃውሌ ከተሞችን

የሚያገናኘው መንገድ (ጉልት ቁጥር

ሁለት) በስተደቡብ-ከባማሌ የተከበረ

የእምነት ጫካ ወደ ምስራቅ የሚፈሰው

የካውሼ ወንዝ (ጉልት ቁጥር ሦስት)

በስተምዕራብ-እስከ ባማሌ የተከበረ

የእምነት ጫካ ድረስ በሚዘልቁ የእርሻ

እርከኖችና ዲና የሚዋሰን (ጉልት ቁጥር

አራት) በመሆኑ አማካይ

ስለማያስፈልገው በአሁን አጠቃቀሙ

ይቀጥላል፡፡

፬.፬.፫ የታችኛው ዶካቱ ባህላዊ መንደር

እንደሚከተለው ይዋሰናል፤ በስተሰሜን

በባህላዊ የእርሻ እርከኖች (ጉልት ቁጥር

አንድ) ስለሚዋሰን አማካይ ወሰን

አያስፈልገውምና በአሁን አጠቃቀሙ

ይቀጥላል፡፡ በስተምስራቅ-የሞይቴ ወንዝ

(ጉልት ቁጥር ሁለት) በስተደቡብ- የሄስ

የጉዞ «ኤኮ ሎጂ» የካራት-ጂንካ መንገድ

(ጉልት ቁጥር ሦስት) በስተምዕራብ

ከደቡብ ወደ ሰሜን የሚፈሰው የኩቲት

ወንዝ (ጉልት ቁጥር አራት)

South- The current Karat- Jarso dry weather

road (“Post No. 3) To the West- The

Porpuraite sacred groove and Dina (“Post

No. 4).

4.4.2- The Olanta traditional village - is bounded

as follows to the North- The Kilkilo River

(“Poslt” No.1) To the East- The road

between Olanta and Bekawle towns (“Post

No. 2).- To the South- The kawushe river

running from the Bamale sacred forest and

running towards East (“Post No. 3) – To the

West- There is no need for buffer as it is

bounded by the terraces and Dina (“Post

No. 4) all the way towards the Bamale

sacred forest; and to continue the current

use.

4.4.3- The Lower Dokatu traditional village – is

bounded as follows: To the North – There is

no need for buffer as it is bounded by

traditional terrace farms (“Post” No.1) to

continue the current use; to the East- The

Moyite River (“Post No. 2). To the south-

the current boundary of the Hess Travel

“Eco Lodge” and the Karat- Jinka Road

(“Post No. 3). To the West- The Kutit River

running from south to north (“Post No. 4).

፬.፬.፬ የላይኛው ዶካቱ ባህላዊ መንደር

እንደሚከተለው ይዋሰናል፤ በስተሰሜን-

የአሁኑ የካራት-ጂንካ መንገድ (ጉልት

ቁጥር አንድ) በስተምስራቅ-የእርሻ

እርከኖች (ጉልት ቁጥር ሁለት) ሲሆኑ

በአሁኑ ጥቅማቸው ይቀጥላሉ፡፡

በስተደቡብ - የባማሌ የተከበረ የእምነት

ጫካና የእርሻ እርከኖች (ጉልት ቁጥር

ሦስት) ሲሆኑ በአሁኑ አጠቃቀማቸው

የሚቀጥል ይሆናል፡፡ በስተምዕራብ -

የዶካቱ ገበያንና የቡሶ ከተማ

የሚያገናኘው የደረቅ ወቅት መንገድና

የአሁኑ የዶካቱ ገበያ ወሰን (ጉልት

ቁጥር አራት)

፬.፬.፭ የካራ ባህላዊ ስርዓትና በውስጡ የያዛቸው

ባህላዊ ቅርሶች ጥበቃ ይደረግላቸዋል፡፡

ክፍል ሦስት

5. አስተዳደርና አደረጃጀት

፭.፩ የኮንሶ ባህላዊ መልክአ ምድር ቅርሶች

አስተዳደር የሚከተለው አደረጃጀት

ይኖረዋል፤

፭.፩.፩ የኮንሶ ወረዳ ደረጃ፣ የኮንሶ ባህላዊ

መልከዓ ምድር ቅርሶች አስተዳደር ጽ/ቤት፤

፭.፩.፪ በማኀበረሰቡ ደረጃ የ፲፪ ፓሌተዎች

/ቀበሌዎች/ የቅርስ አስተዳደር ኮሚቴ፡፡

6. መቋቋም

ተጠሪነቱ ለደቡብ ብሔሮች፣ ብሔረሰቦችና

ሕዝቦች ክልል መንግሥት የባሕልና ቱሪዝም

ቢሮ የሆነና ከመንግሥታዊና መንግሥታዊ

ካልሀኑ አካላት የተውጣጡ አባላት የሚኖሩት

4.4.4. The Upper Dokatu traditional Village is

bounded as follows: To the North- The

current Karat-Jinka road (“Post” No1.). To

the East – The terraces- whose current use

will be maintained “Post” No. 2.). To the

South- The Balame sacred forest whose

current use will be maintained “Post” No

3.). To the west- The current dry whether

governmental and non-governmental bodies is hereby

established.

7. Organization of the Office

The Office Shall be based in Karat town, the

administrative capital of Konso wored of Southern

Nation Nationalities and Peoples Regional State. It

shall have branch offices in the 12 Paleta community

administrations.

8. Structure of the Office

The office shall be composed of:-

1. Inspector’s Office

2. Head Office

3. Woreda Executive

4. Administration office of paletas committee

5. Plaetas communities heritage administration

committee.

6. General Manager , and

7. Other personnel necessary for the work.

9. The Inspector’ OfficePower and duty of the Inspector’s Bureau.

1. The southern Nations, Nationalities and PeoplesRegional State Culture and Tourism Bureau Shallbe the Inspector Authority of the Konso CulturalLandscape Administration Office.

2. Shall issue directive pursuant to the protection and

Administration of the Konso Cultural Landscape.

3. Supervise the work plan and activity of the Konso

cultural landscape heritages administration office

and gives technical support.

መካነ ቅርሶች ላይ አደጋ ሊያስከትሉ

የሚችሉ ሁኔታዎችን ይቆጣጠራል፤

መፍትሔ ይሰጣል፡፡

4. Device capacity building strategy for the Office and

enforce its implementation.

5. Create favorable ground for the allocation of the

necessary budget, and prepare project proposals to

raise funds, for the conservation and sustainable use

of the Konso cultural Landscape heritages.

6. Follows up the research conducted on Konso

protected cultural landscape heritages.

7. Promotes the Konso Cultural Landscape heritages.

8. Performs additional duties relevant to the purpose.

10. Head Office

Powers and Duties of the head office

1. The Office shall have the full protection /HautPatronage/ of the Executive committee of KonsoWoreda.

2. Shall implement and supervise the efficient

execution of the Konso cultural landscape heritages

administration.

3. Shall take part in the design of development and

infrastructural project that may have positive or

negative bearing on Konso Cultural Landscape

Heritage, and shall check the protection and

conservation of the heritage.

4. Shall check on conditions which bear risk to Konso

cultural landscape heritages and sites and provide

solutions where necessary

ከመንግሥት መስሪያ ቤቶች ጋር በመተባበር

የአካባቢው ልማዳዊ አስተዳደርና የመሬት፣

የባህልና የተፈጥሮ ሀብት ጥበቃ ደንቦችና

ሥርዓቶች ከመንግሥት ሕጎች ጋር

እንዲጣጣሙና ለሕብረተሰቡ አጠቃላይ

ልማት እንዲውሉ ያደርጋል፡፡

8. የአካባቢው ህብረተሰብ በባህሉና መንግሥት

በሚያወጣቸው ሕጎች መሠረት ቅርሶች

በሥርዓት ጥበቃና እንክብካቤ እንዲያገኙ

ያደርጋል፡፡

9. በቀበሌ ለሚገኙ ቅርሶች ጥበቃ

የሚያስፈልጉትን የበጀት ጥያቄና ፕላን

በማዘጋጀት ለክልሉ ባህልና ቱሪዝም ቢሮ

ያቀርባል፣ ሲፈቀድም በሥራ ላይ ያውላል፡፡

0. ከአካባቢው ሕዝብ ጋር በመተባበር ባህላዊ

ቅርሶች እንዲጠበቁና እንክብካቤ እንዲያገኙ

ያደርጋል፤ ከአቅም በላይ የሆኑ ሁኔታዎች

ሲከሰቱ ለወረዳ አስተዳደር ያሳውቃል፣

ውሣኔዎቹንም ይተገብራል፡፡

፲፩ ከቢሮ የሚሰጡ ተጨማሪ ተግባራትን

ያከናውናል፡፡

5. Shall devise, submit to concerned governmental

bodies and, when approved, execute projects that

consider the benefit, needs and development of the

society around the heritage to be compatible with

Konso Cultural Landscape heritage protection and

development;

6. Implement the directive which is issued by the

culture and tourism Bureau;

7. Shall cooperate with concerned local administrative

bodies and government organs in order that the

local traditional administration and traditional land,

culture and nature resource protection rule and

customs be compatible with governmental laws and

put into practice to contribute to the general

development of the society;

8. Shall execute the protection and conservation of the

heritage and apply the rules thereof according to

tradition and governmental laws;

9. Shall prepare and submit budgetary request and

plan for the conservation of heritage in Kebeles to

the Regional Bureau of culture and Tourism, and

implement same when approved;

10. Shall work in collaboration with the local people,for the traditional execution of the cultural heritageprotection and conservation works, and whereconditions lie beyond local capacity, bring same tothe notice of the Woreda administration and applydecision there-from;

11.Perform additional duties assigned by the Bureau

3. በየፓሌታቸው የሚገኙ ባህላዊ ሀብቶች ላይ

ብልሽት ወይም አጠራጣሪ የአደጋ ሁኔታ

ሲያጋጥም ይህንኑ ለወረዳው የኮንሶ ባህላዊ

መልክአ ምድር ቅርሶች አስተዳደር ጽሕፈት

ቤት ሪፖርት ያደርጋሉ፡፡

4. የቅርሶቹን ጥበቃ ሁኔታ በየጊዜው

ይቆጣጠራሉ፣ ስለወቅታዊ ጉዳይም

የአካባቢውን ሕዝብ ያወያያሉ፡፡

5. በባህላዊ መልክዓ ምድር የሚፈፀሙትን

ባህላዊ አጠቃቀምና የጥበቃ እንቅስቃሴዎች

ይከታተላሉ፡፡

6. ከወረዳው የባህለዊ መልክአ ምድር ቅርሶች

አስተዳደር ጽሕፈት ቤት ጋር ተባብረው

ይሠራሉ፡፡

02. ዋና ሥራ አስኪያጅ

የዋና ሥራ አስኪያጅ ስልጣንና ተግባር

1. የጽሕፈት ቤቱ ሥራ አስኪያጅ ተጠሪነቱ ለደቡብ

ብሔሮች፣ ብሔረሰቦችና ሕዝቦች ክልል

መንግሥት ባህልና ቱሪዝም ቢሮ ሆኖ የጽሕፈት

ቤቱን ሥራና አስተዳደር በበላይነት ይመራል፡፡

2. በዚህ አዋጅ አንቀፅ ፲ የተመለከቱትን የጽሕፈት

ቤቱን ሥልጣንና ተግበር በሥራ ላይ እንዲውሉ

ያደርጋል፡፡

11. Powers and duties of the Office of Paleta

Administration Committees:

1. The Twelve Paletas/Kebeles shall have their

respective heritage administration committees and

shall be accountable to the Konso Woreda cultural

Heritage administration Office.

2. Follow up the day to day conditions of the cultural

heritage which is found within their Paleta;

3. Report to the Konso Special Woreda cultural

landscape Heritage administration Office, In case of

any damage or suspected danger to the cultural

heritage within their respective Palets,s

4. Periodically supervise the conservation condition of

the heritages and discuss the local people on current

issue.

5. Follows up the cultural utilization, and conservation

activities within the cultural landscape;

6. Work closely with the Konso Special woreda

cultural landscape Heritages administration office.

12.General Manager

Power and function of the General Manager

1. The General Manager of the Office shall beaccountable to the Southern Nations, Nationalitiesand Peoples Regional State Culture and TourismBureau and shall lead the works and administrationof the office.

2. Shall implement the power and functions of the

Office stipulated in article 10 of this Proclamation.

3. በዚህ አንቀጽ ንዑስ አንቀጽ ፪ የተመለከተው

እንደተጠበቀ ሆኖ የሚከተሉትን ተግባራት

ይፈጽማል፡-

2. ጽሕፈት ቤቱ ከሶስተኛ ወገኖች ጋር

በሚያደርገው ግንኙነትና ጽሕፈት ቤቱ

በሚያቀርባቸውም ሆነ በሚቀርቡበት ክሶች

ጽሕፈት ቤቱን ወክሎ ይሠራል፤

3. ከጽሕፈት ቤቱ የሂሣብ ክፍል ኃላፊ ጋር

በመሆን በጽሕፈት ቤቱ ስም የባንክ ሂሣብ

ይከፍታል፣ ያንቀሳቅሳል፤

4. የጽሕፈት ቤቱን የሥራ ፕሮግራምና በጀት

እንዲሁም ውስጠ ደንቦች አዘጋጅቶ ለቢሮ

ያቀርባል፣ ሲፈቀድም በሥራ ላይ ያውላል፤

5. ለጽሕፈት ቤቱ በተፈቀደው የሥራ

ፕሮግራምና በጀት መሠረት የገንዘብ

ወጪዎችን ይፈፅማል፣ ሂሣቡን በአግባቡ

ይይዛል፣ በጽ/ቤቱ ሲጠየቅም ሂሣቡን

ያስመረምራል፤

6. የጽሕፈት ቤቱን የሥራ እንቅስቃሴና

የፋይናንስ አጠቃቀም በተመለከተ ወቅታዊ

ሪፖርት ያዘጋጃል፤

7. ከቢሮው የሚሠጡትን ተግባራት

ያከናውናል፤

8. ሌሎች የጽሕፈት ቤቱን ተግባራት

ያከናውናል፤

03. የኮንሶ ወረዳ የቅርስ አስተዳደር ኮሚቴ

የኮንሶ ወረዳ የቅርስ አስተዳደር ኮሚቴ

የሚከተሉት አባላት ይኖሩታል፡፡

1. የኮንሶ ወረዳ አስተዳዳሪ -ሊቀመንበር

3. In addition to Article 12 Sun article 2, shall perform

the following functions:

1. Organize , direct and administer the works of

the office;

2. Represent the office in its dealings with third

parties and legal matters;

3. Open band accounts and circulate together with

the Head of finance section of the office;

4. Prepare the work program, budget and internal

guidelines of the office and present it to the

Bureau and implement upon approval.

5. Execute financial expenditure in accordance

with the work Program, and budget permitted to

it, properly keeps the accounts and audited

when requested by the office;

6. Prepare periodic report on the overall activities

and financial utilization of the office.

7. Perform functions given by the Bureau.

8. Perform other activities of the office

ለምርምርና ለቱሪዝም እንዲያመች መረጃ

ይሰበስባል፣ በሠነድ ይያዛል፡፡

2. በኮንሶ ባህላዊ መልክአ ምድር ቅርሶች ላይ

ምርምር ለሚያደርጉ ኢትዮጵያዊያንና የውል

ምርምር ቡድኖች ከሚመለከታቸው

መ/ቤቶች ፈቃድ በማግኘት እንዲያጠኑ

ያደረጋሉ፡፡

3. የኮንሶ ባህላዊ መልክአ ምድር ቅርሶች

እንዲታወቁ፣ እንዲጐበኙና የሀገሪቱን ገጽታ

እንዲገነቡ ይደረጋል፣ ዝርዝሩ የባህልና

ቱሪዝም ቢሮ በሚያወጣው መመሪያ

ይወሰናል፡፡

06. ቅርሶችን ለጥቅም ስለማዋል

1. በኮንሶ ጥብቅ ባህላዊ መልክአ ምድር ውስጥ

የሚኖረው ሕዝብ ከጥብቅ ቅርሶች ወይም

መካነ ቅርሶች ጥቅም የማግኘት መብት

ይኖረዋል፡፡ ዝርዝሩ በመመሪያ ይወሰናል፡፡

2. በኮንሶ ጥብቅ ባህላዊ መልክአ ምድር መካነ

ቅርሶች ውስጥ የሚኖረው ሕዝብ የባህላዊ

7. Representative of the Kebele Youths-Member

Part Four

Registration, Study and Revitalization of

Cultural Landscape Heritages

15. Registration, Study, Inquiry and Promotionof Heritage1. Information shall be gathered for the purpose of

identification, supervision, study, inquiry and

tourism of the Konso cultural landscape Heritage

and documented same.

2. Those Ethiopian and foreign research teams who

wants to conduct research on the Konso cultural

landscape heritage shall get permit from the

concerned offices to study.

3. Konso Cultural Landscape Heritage shall be

promoted , visited and used for building the image

of the country. Details shall be determined by the

issuing guideline of the Bureau.

16.Revitalization of heritage.

1. People living within the protected Konso Cultural

Landscape shall have the right to benefit from the

protected heritages or heritages sites. Details shall

issue on directive.

2. People living within the protected Konso Cultural

Landscape Heritage sites shall, in a way not

ቅርስ ውስጥ የሚገኝ ንብረት ባለይዞታነት

ደብተር የተሰጠው ሰው የትርሶቹን ባህላዊ፣

ታሪካዊ፣ ሣይንሳዊና ስነጥበባዊ እሴቶች

በማይጎዳ መልኩ ቅርሶቹን ወይም በቦታው

የሚገኙ ይዞታችን ለተለመዱ ባህላዊ፣

ታሪካዊና እምነታዊ ድርጊቶች ሊያውል

ይችላል፡፡

4. ቅርስ ባለይዞታ የሆነ ሰው በሕግ

እስካልተከለከለ ድረስ ቅርሱን

እንዲጠቀምበትና እንዲጠብቀው ዋስትና

ይኖረዋል፡፡

07. በግል ስለተያዙ ቅርሶችና መካነ ቅርሶች

ጥበቃና እንክብካቤ

የቅርስና መካነ ቅርስ ባለ ይዞታ የሆነ ሰው

የሚከተሉት ግዴታዎች ይኖሩበታል፡-

1. በይዞታው ስር ለሚገኝ ቅርስ ወይም መካነ

ቀርስና በውስጡ ለሚኖሩ የዱር እንስሳት፣

አዕዋፍና አዘርእት ጥበቃና እንክብካቤ

የማደግ ወጪን ይሸፍናል፡፡

2. በሚመለከተው የመንግሥት አካል ደንብ

ሲወጣ ቅርሶችና መካነ ቀርስ

በትምህርታዊነት፣ መረጃነትና በሳይነሳዊነት

ጥቅም እንዲያሰገኙ ይፈቅዳል፡፡

3. A person with a certificate book of tenure to

hold property within the protected Konso

Cultural Landscape Heritage site may in a

manner not detrimental to the cultural,

historical, scientific and artistic values, use the

heritage or site holdings for customary cultural,

historical and ritual activities./

4. A person holding a heritage shall have the

guarantee of using and keeping the heritage,

unless banned with legal decision.

17. Protection and conservation of privately

held heritages and heritage sites

A person holding a heritage and heritage site shall

have the following duties;

1. Pay for the expenses of protecting and

conserving the heritage or heritage site in his

possession and wild animals, birds and plants

therein.

2. Permit the heritage and heritage site to be used

for educational, informational and scientific

purpose, when regulation issued by the

concerned state organ.

08. በጋራ ስለተያዙ ቅርሶችና መካነ

ቅርሶች ጥበቃ፣ እንክብካቤና አጠቃቀም፤

ማኀበረሰቡ፡-

1. በጋራ የተያዙ ቅርሶችና መካነ ቅርሶችእንዲሁም በነዚህ ውስጥ የሚኖሩ የዱርእንስሳት፣ አዕዋፍና አዘርአት ጥበቃናእንክብካቤ እንዲደርግላቸው በኀብረትየሠራል፤

2. በኀብረተሰቡ ተቀባይነት ያላቸውና ይህን

አዋጅ የማይቃረኑ እስከሆኑ ድረስ

የአካባቢው ባህላዊ ሥርዓቶችና ድርጊቶች

በጋራ ከተያዙት ቅርሶች ወይም መካነ

ቅርሶች ጋር በተገናኘ መፈፀማቸውን

የማረጋገጥ ግዴታ ይኖርበታል፤

3. አሁንም ሆነ ወደፊት ለአፈርና ውሀ

እንክብካቤ ሥራዎች ድጋፍና ጥበቃ

ያደርጋል፤

4. በባለ እርከን እርሻ መሬቶች ውስጥ የሚገኙ

የግል መሬት ይዞታዎችን ለመከለል

ከድንጋይ ወይም ሌላ ነገር የተሠሩ

አጥሮችን ይንከባከባል፤ ይጠብቃል፤

5. በጋራ የተያዙ ቅርሶችና መካነ ቅርሶች

እንዲሁም በአግባቡ እንዲጠበቁ ጥቅም ላይ

እንዲውሉ ለማድረግ ከመንግሥት ተቋማት

ጋር በመሆን የተቀናጀ የጥበቃ፣ የይዞታና

ጥቅም ላይ የማዋል ኘላን ያወጣላቸዋል፡፡

09. ስለ ጥብቅ ቅርሶችና መካነ ቅርሶች

ጥቅም ላይ የማዋል ኘላንና ጥናት፡-

1. የኮንሶ ባህላዊ ቅርሶችና ጥብቅ መካነ ቅርሶች

ጥቅም ላይ ስለሚውሉበት ዝርዝር ጥናት

ይደረጋል፡፡ ቅርሶችና መካነ ቅርሶች

ጠቀሜታ እንዲኖራቸው አቅም ባገናዘበና

ደረጃ በደረጃ የሚፈፀም ሲሆን ለተወሰነ

18. Protection conservation and utilization of

heritage and heritage sites held in common

The community shall :-

1. Jointly protect and conserve heritage and heritage

sites held in common and also the wild animals,

birds and plants therein;

2. Duty bound to verify the execution of the local

cultural rules and practices that are accepted by the

society and consistent with the proclamation are

treated in relation to heritage and heritage sites held

in common.

3. Support and protect present and future soil and

water conservation works;

4. Conserve and protect enclosure of stone or other

material built to demarcate private land holdings

found within terraced farm lands;

5. Issue an integrated protection, possession, and

revitalization plan with governmental institutions to

properly conserve and utilize heritages and heritage

sites held in common.

19. Revitalization plan and study for protected

heritage and heritage sites

1. Revitalization of Konso Cultural Heritage and

protected heritage sites shall be studied in detail.

The utilization of heritage and heritage site shall be

carried out in accordance with capacity and in

phases and, with respect to revitalization of heritage

ቅርሶችን ጥቅም ላይ የማዋል ሥራ

የሚከተሉትን ነጥቦች ታሳቢ የሚያደርግ

ይሆናል፡፡

ኘላኑ፡-

ሀ. በታወቁ ባህላዊ፣ ታሪካዊና ማኀበራዊ

እሴቶች እንዲሁም አካባቢያዊ፣

ኢኮኖሚያዊና ቴክኒካዊ መመዘኛዎች

መሠረት ጥቅሞች የሚያስገኝ መሆን

ይጠበቅበታል፡፡

ለ. በቅርሶች፣ መካነ ቅርሶችና አካባቢያቸው

ላይ አነስተኛ ወይም ምንም ዓይነት

ተጽእኖ የማያስከትል መሆን

ይኖርበታል፡፡

ሐ. በአካባቢው ሕዝብ ተቀባይነት ሊኖረው

ይገባል፡፡ በቅርሶችና መካነ ቅርሶች

አጠቃቀም ላይ የሚኖር ማንኛውም

ለውጥ የተሟላ ጥናት ውጤት የሆነና

ከሚመለከተው አካል ተቀባይነት ያገኘ

መሆን ይኖርበታል፡፡

፳ ቅርስን በጥቅም ላይ ስለማዋል የተከለከሉ

ተግባራት

1. የባለቤትነት ደብተር የያዘ ማንኛውም ሰው

የያዘውን ቅርስ ወይም የቅርስ ቦታ ባህላዊና

ታሪካዊ ይዘት፣ ቅርጽና ቦታ የመለወጥ መብት

አይኖረውም፡፡

2. የኮንሶ ባህላዊ ከተሞችንና (ፓሌታዎች) ቅርሶችን

ይዘቶች፣ ሚዛናዊነት፣ አሰራርና ማንኛውም

ዓይነት ዘመናዊነት፣ አሠራርና ቅርጽ

የሚጋርዱ፣ የሚለውጡና የሚያደበዝዙ

ማንኛውም ዓይነት ዘመናዊ ግንባታዎች

አይፈቀድም፡፡

and protected heritage sites for a limited purpose,

the following points shall be considered.

The Plan shall:-

a) Bring benefit in accordance with the recognized

cultural, historical and social values and

environmental, economic and technical criteria’s.

b) Have little or no negative impact on heritage,

heritage sites can surroundings.

c) Require to gain acceptance from the local people

and changes in utilization of heritages and heritages

sites need to be , the result of a study and accepted

by the concerned body.

20. Limits to Heritage revitalization

1. No one having ownership certificate shall be

entitled to change the cultural and historical

content, from and place of the heritage and

heritage place he is holding.

2. No modern construction work is allowed

that may obstruct, change, and obliterate the

cultural contents, style and forms of the

Konso traditional towns/pletas/ & heritages.

3. ከፓሌታዎች የውጭ ግንቦች ፶ ሜትር ርቀት

ውስጥ ምንም ዓይነት አዲስና ዘመናዊ ሕንፃ

ሊሰራ አይፈቀድም፡፡

4. የኮንሶ ባህላዊ የመልክአ ምድር ቅርሶች ባህላዊ

ድንቅ ሥራነት፣ ታሪክ፣ ይዘትና እሴት ላይ

ተጽእኖ ሊኖራቸው ሚችል የመንገድ ሥራዎችና

የድንጋይ ማውጣት ሥራዎች ወይም የባህላዊ

መልክአ ምድር ገጽታዎች ሊጐዱ የሚችሉ፣

የመሬት ንዝረቶችን የሚያስከትሉ ሥራዎች

ከመጀመራቸው በፊት ከቢሮ፣ ከኮንሶ ወረዳ

አስተዳደር፣ ከኮንሶ ወረዳ የቅርስ አስተዳደር

ጽሕፈት ቤትና ከሚመለከተው የፓሌታ ቅርስ

አስተዳደር ኮሚቴ ተቀባይነት ማግኘት

ያስፈልጋል፡፡

5. የፓሌታዎች (ግንብ መንደሮች) ጥበቃን

ቀጣይነት ለማረጋገጥ የቅርሶችን ባህለዊ፣ ስነ

ጥበባዊ፣ ሳይንሳዊና ታሪካዊ ይዘቶች ሊያበላሹ

የሚችሉ ማናቸውንም የእርሻ ሥራ ወይም

ሌሎች የግንባታ ሥራዎችን በጥብቅ ቦታ ውስጥ

ማከናወን የከለከለ ነው፡፡

፳፩ የገቢ ምንጭ

ጽሕፈት ቤቱ የሚከተሉት የገቢ ምንጮች

ይኖሩታል፡-

1. ከክልሉ መንግሥት የሚገኝ ገቢ

2. ከኮንሶ ወረዳ አስተዳደር ጽሕፈት ቤት

የሚመደብ በጀት

3. ከቅርስ ጥናትና ጥበቃ ባለስልጣን የሚገኝ

ገቢ

4. ከሌሎች ምንጮች የሚገኝ ገቢ

3. No new and modern construction is allowed

within 50 meters distant of the external

walls of the Paletas

4. Any Road construction and quarry works

that may affect the cultural splendor,

history. content or value of the Konso

cultural landscape heritage or works that

create tremors and affecting cultural

landscape features shall be necessary to find

acceptance from culture and tourism

Bureau, Konso woreda administration,

Konso woreda heritage administration office

and from the jconcerned paleta heritage

administration committee before launching.

5. Any agricultural activity or other

construction works that may damage the

cultural, artistic, scientific and historical

contents of heritage shall for the sustainable

protection of the Paletas /walled villages, be

prohibited from being under taken inside the

protected area

21.Source of Income

The office shall have the following incomesources;1. The Regional State.

2. The Konso Special Woreda Administration

Office.

3. Authority for Research and Conservation of

Heritage.

4. Income collected from other sources.

፳፪ የበጀት ዓመት

ጽሕፈት ቤቱ የበጀት ዓመት በየዓመቱ ከሐምሌ

፩ ቀን ጀምሮ በተከታዩ ዓመት ሰኔ ፴ ቀን

ይሆናል፡፡

፳፫ የሂሣብ መዝገቦች

1. ጽሕፈት ቤቱ የተሟላና ትክክለኛ የሂሣብ

መዝገብ ይይዛል፡፡

2. ጽሕፈት ቤቱ የሂሣብ መዛግብት ቢያንስ

በዓመት ፩ ጊዜ በውጭ ኦዲተሮች

ይመረመራል፡፡

ልዩ ልዩ ድንጋጌዎች

፳፬ የመተባበር ግዴታ

ማንኛውም ሰው ጽሕፈት ቤቱ በዚህ አዋጅ

የተሰጡትን ዓላማዎች ለማሳካት ለሚያደርገው

እንቅስቃሴ የመተባበር ግዴታ አለበት፡፡

፳፭ ደንብ የማውጣት ስልጣን

ይህንን አዋጅ ለማስፈፀም የክልሉ መስተዳድር

ምክር ቤት ደንብ ሊያወጣ ይችላል፡፡

፳፮ ተፈፃሚነት የሚኖራቸው ህጐች

የዓለም ቅርሶች ጥበቃንና አጠቃቀምን

በሚመለከት የወጡት የኢትዮጵያ ፌደራላዊ

ሕጎችና ደንቦች እንዲሁም የዩኔስኮ መመሪያዎች

ተፈፃሚነት ይኖራቸዋል፡፡

22.Fiscal year

The fiscal year of the office shall start on July 1

and ends on June 30 of the next year in

Ethiopian calendar.

23. Books of Account

1. The Office shall keep complete and

accurate books of accounts.

2. The Account Books of the Office shall be

audited at least once a year by external

auditor

Part Five

Miscellaneous provisions

24. Duty to Cooperate

Any person shall have a duty to cooperate with

the office in it activities to achieve the

objectives vested to it by this proclamation.

25.Power to issue Regulations

The Regional Administrative Council may issue

Regulation for the Implementation of this

proclamation

26.Applicable Laws

The Ethiopian Federal laws, regulations and the

UNESCO directives issued for the conservation

and utilization of world heritages shall be

applicable .

፳፯ ተፈፃሚነት የማይኖራቸው ህጐች

ከዚህ አዋጅ ድንጋጌዎች ጋር የሚቃረን

ማናቸውም አዋጅ፣ ደንብ፣ መመሪያና ልማዳዊ

አሠራር በዚህ አዋጅ በተሸፈነው ጉዳይ ላይ

ተፈፃሚነት አይኖረውም፡፡

፳፰ አዋጁ የሚፀናበት ጊዜ

ይህ አዋጅ በክልሉ መንግሥት ምክር ቤት

ከፀደቀበት ሐምሌ ፭ ቀን ፳፻፫ ዓ.ም. ጀምሮ

የፀና ይሆናል፡፡

27.Inapplicable laws

Any proclamation, regulation, directive and

customary practices inconsistent with the

provisions of this proclamation shall not be

applicable.

28.Effective Date

This Proclamation shall enter in to force as of

the date of the approval by the Regional State
