I, Joel F. Morgan, Ph.D., declare as follows:

1. I am a Clinical Neuropsychologist in private practice in Madison, New Jersey. I obtained a B.A. in Psychology from Rider University in 1973, an M.A. in School Psychology from Farleigh Dickinson University in 1975, and a Ph.D. in Clinical Psychology from the New School for Social Research in New York, New York, in 1986. I then completed postdoctoral supervision at the Department of Neurology/Neurology Service at University of Medicine and Dentistry of New Jersey (UMDNJ) in Newark, New Jersey and at the VA Medical Center in East Orange, New Jersey, from 1991 to 1993. I also completed additional postdoctoral supervision under the individual supervision of Lloyd I. Cripe, Ph.D., ABPP/ABCN from 1996 to 1998. I am Board Certified in Clinical Neuropsychology. 3. I am an editor of numerous publications in the field of neuropsychology. I am an Editorial Board Member and Special Section Editor for The Clinical Neuropsychologist, and a Senior Co-Editor for the American Academy of Clinical Neuropsychology/Psychology Press Co-Branded Continuing Education Book Series. I am also an Editorial Board Member for Neurocase; The Clinical Neuropsychologist, and an Editorial Reviewer for Ad Hoc: Ten professional journals.

4. I have served as an Oral Examiner on the Examination Committees of the American Board of Clinical Neuropsychology (ABCN) from 2004 to the present, and I am currently serving as an ABCN Executive Committee Board Member for the term of 2009-2014. I am also a work sample reviewer for the American Board of Clinical Neuropsychology/American Board of Professional Psychology (ABCN/ABPP)

5. I am a representative to the Council of the American Psychological Association (APA), the highest legislative body of the APA. I represent Division 40, the Division of Clinical Neuropsychology for the term of 2006-2012. I also served as an Accreditation Site Visitor for the APA from 1997-2002 and I have been the Chair of the APA's Site Visitor Committee since 2002.

6. I have personally examined Manssor Arbabsiar on several occasions at the Metropolitan Correctional Center (MCC) in New York, New York. Based on my examination and testing of Mr. Arbabsiar, it is my diagnosis that Mr. Arbabsiar suffers from bipolar disorder.

7. I performed the following testing of Mr. Arbabsiar:

a. Wechsler Adult Intelligence Scale, Fourth Edition (WAIS-IV) - measure of intellectual functioning;

b. California Verbal Learning Test (CVLT-II) - measure of verbal memory;

c. Rey-Osterrieth Complex Figure Test (ROC) - measure of visual memory;

d. Wechsler Memory Scale-Revised, or III (WMS-R, WMS-III) - measure of verbal and nonverbal memory;

8. The results of this testing are as follows:

impaired; h. Trail Making Parts A & B - impaired; i. Stroop Color and Word Test - low average; j. Test of Memory and Malingering (TOMM) - passed; k. Grooved Peg Board Test - average; 1. Victoria Symptom Validity Test - passed; m. Minnesota Multiphasic Personality Inventory, Second

Edition, Restructured Form (MMPI-II-RF) - consistent with mania and paranoia;

n. Wisconsin Card Sorting Test (WCST) - low average to borderline; and

o. Millon Clinical Multiaxial Inventory, Third Edition (MCMI-III)- consistent with bipolar manic, anxiety, and dependent personality, and major depression.

9. Based on my testing of Mr. Arbabsiar described above, it is my diagnosis that Mr. Arbabsiar suffers from impaired cognitive functioning that is substantially below his premorbid capacities.

10. I encountered some difficulty in administering these tests to Mr. Arbabsiar due to the conditions at the MCC. On May 5, 2012, I was unable to complete any testing of Mr. Arbabsiar because the MCC would not permit me to bring certain testing materials into the facility. I was permitted to visit Mr. Arbabsiar on May 12, 2012 with the correct testing materials, but I was unable to complete my standard neuropsychological examination at that time because we were placed in separate rooms and I was only able to interact with Mr. Arbabsiar through a screen and window. Finally, I visited Mr. Arbabsiar on June 1, 2012 and was able to conduct the testing under better circumstances, although one of Mr. Arbabsiar's hands was restrained throughout the examination.

11. Based on my testing, which showed some evidence suggesting brain abnormalities, I recommended that an MRI of Mr. Arbabsiar's brain be performed. The MRI was performed on June 13, 2012 and the results indicated abnormalities of the brain.
