    The U.S. Nuclear RegulatoryCommission (the Commission) hasgranted the request of Tennessee ValleyAuthority (TVA, the licensee) towithdraw its December 22, 2008,application for proposed amendment toFacility Operating License No. DPR52for the Browns Ferry Nuclear Plant Unit2, located in Limestone County,Alabama.

    The proposed amendment would, ona one-time basis, extend severalTechnical Specification surveillance

    frequencies approximately 45 days.The Commission had previously

    issued a Notice of Consideration ofIssuance of Amendment published inthe Federal Register on January 27,2009 (74 FR 4775). However, by letterdated March 6, 2009, the licenseewithdrew the proposed change.

    For further details with respect to thisaction, see the application foramendment dated December 22, 2008,and the licensees letter dated March 6,2009, which withdrew the applicationfor license amendment. Documents may

    SUPPLEMENTARY INFORMATION:

    I. Introduction

    On March 13, 2009, the Postal Servicefiled a formal request pursuant to 39U.S.C. 3642 and 39 CFR 3020.30 et seq.

    to add Priority Mail Contract 5 to theCompetitive Product List.1 The PostalService asserts that Priority MailContract 5 is a competitive product notof general applicability within themeaning of 39 U.S.C. 3632(b)(3). Id. at1. The Request has been assignedDocket No. MC200921.

    The Postal Servicecontemporaneously filed a contractrelated to the proposed new productpursuant to 39 U.S.C. 3632(b)(3) and 39CFR 3015.5. The contract has beenassigned Docket No. CP200926.

    Request. The Request incorporates (1)

    a redacted version of the GovernorsDecision authorizing the new product;(2) a redacted version of the contract; (3)requested changes in the MailClassification Schedule product list; (4)a statement of supporting justification asrequired by 39 CFR 3020.32; and (5)certification of compliance with 39U.S.C. 3633(a).2 Substantively, theRequest seeks to add Priority MailContract 5 to the Competitive ProductList. Id. at 12.

    In the statement of supportingjustification, Mary Prince Anderson,Acting Manager, Sales and

    Communications, Expedited Shipping,asserts that the service to be providedunder the contract will cover itsattributable costs, make a positivecontribution to institutional costs, andincrease contribution toward therequisite 5.5 percent of the PostalServices total institutional costs. Id.,Attachment D. Thus, Ms. Andersoncontends there will be no issue ofsubsidization of competitive products

    by market dominant products as a resultof this contract. Id.

    Related Contract. A redacted versionof the specific Priority Mail Contract 5is included with the Request. The

    contract is for 1 year and is to be

    effective 1 day after the Commissionprovides all necessary regulatoryapprovals. The Postal Service representsthat the contract is consistent with 39U.S.C. 3633(a) and 39 CFR 3015.7(c).See id., Attachment A and AttachmentE. It notes that actual performance

    under this contract could vary fromestimates, but concludes that the risksare manageable. Id. at Attachment A.

    The Postal Service filed much of thesupporting materials, including theGovernors Decision and the specificPriority Mail Contract 5, under seal. Inits Request, the Postal Service maintainsthat the contract and related financialinformation, including the customersname and the accompanying analysesthat provide prices, terms, conditions,and financial projections should remainunder seal. Id. at 23.

    II. Notice of Filings

    The Commission establishes DocketNos. MC200921 and CP200926 forconsideration of the Request pertainingto the proposed Priority Mail Contract 5product and the related contract,respectively. In keeping with practice,these dockets are addressed on aconsolidated basis for purposes of thisorder; however, future filings should bemade in the specific docket in whichissues being addressed pertain.

    Interested persons may submitcomments on whether the PostalServices filings in the captioneddockets are consistent with the policiesof 39 U.S.C. 3632, 3633, or 3642 and 39CFR part 3015 and 39 CFR 3020 subpartB. Comments are due no later thanMarch 25, 2009. The public portions ofthese filings can be accessed via theCommissions Web site (http://www.prc.gov).

    The Commission appoints Paul L.Harrington to serve as PublicRepresentative in these dockets.
