The Withers Advisory Committee has delegated authority as per Council Decision 13/14. Note: These minutes are subject to confirmation at the next Withers Advisory Committee Meeting.

All persons present are advised that the proceedings of this meeting will be recorded for record keeping purposes and to ensure accuracy in the minute taking process.
3. Announcements from the Presiding Member
The Committee is smaller than at the last meeting, due to Council Decision 326/14 to suspend the Withers Action Group representation on the Committee until compliance issues have been resolved. The process is underway, it was noted that the Convenor of the Withers Action Group and Community members attended the meeting. The South West Development Commission have approved the funding for the Local Area Plan (LAP) for Withers. The Withers Advisory Committee put a motion forward that a LAP for Withers be approved. The planners will look at Withers, how it is being planned, the road connections and how the suburb can be improved. This is a significant step forward that will address items on the Withers Action Plan that were out of reach of the Withers Advisory Committee.

6. Public Question Time
In accordance with Reg. 7(4)(a) of the Local Government (Administration) Regulations 1996, members of the public in attendance at the meeting may stand, state aloud their name and address, and ask a question in relation to any matter over which the municipality of Bunbury has jurisdiction or involvement. In accordance with Standing Order 6.7(3)(a) a person wishing to ask a question, must complete a question form which is provided in the trays at the back of the public gallery and on the City’s website. The completed form must include your name and address and contain no more than three (3) questions. If your question requires research or cannot be answered at the meeting, it will be taken on notice and you will receive a written response and a summary of your question (and any responses provided) will be printed in the minutes of the meeting.
6.1 Public Question Time
Glen Willetts, 40 Wilkerson Way, Withers Question 1: There is a deficit at Welcome Park. The park was opened in 2011/2012 to date
there is no sign. Request a sign. Answer: The question will be asked what can be done about installing the sign. Question 2: The 2014/2015 Allocation of monies consider more footpathing still needed in the
Withers Area and relook at what was suggested when the Withers Action Plan was done. The bus routes and getting footpaths to link up with bus routes. Such as Craven Court and Shaw Close going down from there for the seniors. Seniors having to use scooters and walking frames through dirt or on the road.
Answer: Footpaths have been completed as part of the Withers Action Plan, however there
is more work to do. The recent feedback indicated that footpaths are important. There are path projects to be considered in the agenda, and this suggestion will be considered for future project.
Barbara Watkins, 320 Ocean Drive, Withers Question 1: New Bus Stops on Ocean Drive, heading towards Washington Avenue from the
Ocean end, one of them is on the road, 1 metre from the road. Unless the speed limit comes down to 50 km/hr that is extremely dangerous.
Answer: Phil Harris, Director of Works and Services advised that there has been some
preliminary investigation into Ocean Drive speed limit, in consultation with Main Roads to implement short term and long term solution for Ocean Drive. Safety concerns can be looked at but any action needs to consider the final design or construction for Ocean Drive. (Note: the bus stops are more than one metre from the edge of seal)

6.2 Responses to Public Questions Taken ‘On Notice’
Donna Wolter, Unit 4, 31 Victoria Street, Bunbury Question 1: In reviewing the Financial Report of the WAC, item 9.1 table 2 summary of DWS 1
Expenditure Report, does the Chairperson agree that the financial report is correct, can the Chairperson explain why the sums in columns Committed Expenditure and Actual Expenditure do not add up?
Answer: The committee was advised upon review of the agenda that the figures in Item 9.1
table 2 summary of DWS 1 Expenditure Report were incorrect. The attachment DWS 1 Expenditure Report as at 08.09.14 is correct; however the figures were not transposed into the item correctly. This has been amended in the minutes as per WAC Decision 44/14.
Question 2: Can members of the WAC be confident in making financial decisions when the
figures outlined in table 2 Summary of DWS 1 Expenditure Report as at 8 September 2014, page 4 of the WAC agenda, do not match those same figures in the attachment? For example the actual expenditure to install CCTV in attachment DWS 1 states at 4 August 2014 actual expenditure is $176,731 but the cost provided to committee members in the body of the report states the actual expenditure for 8 September 2014 is $1,600? Which report is correct?
Answer: As stated above DWS 1 Expenditure Report as at 08.09.14 is the correct report and
there was a clerical error in not updating the figures in Item 9.1. The WAC members are confident that the information provided in DWS 1 Expenditure Report is correct.
Question 3: Why are WAC being asked to consider transferring funds from the Withers Reserve
when the current allocated budget of $300,000 for 14/15 has existing funding allocations which would cover over budget spending?
Answer: The $8,650 transfer from the Withers Reserve is required as the 2013/14
Devonshire Path project which was completed in the 2014/15 year is over budget as per update provided in Item 9.1. This ensures that the 2014/15 $300,000 allocation is apportioned to 2014/15 projects and not carry over projects.

The minutes for the Withers Advisory Committee meeting held on 8 August 2014 will be confimed at the next meeting on 14 November 2014.

Executive Recommendation
1. That the monthly financial report be received. 2. Transfer $8,650 from Withers Reserve for Devonshire Street path Project
Background Council Decision 128/11 provides that $300,000 per year for a period of five years to a total of $1,500,000 be allocated to Withers Action Projects. As of 1 January 2014 expenditure against the Withers Action Plan was recorded as $214,187 with $385,813 in the Withers Reserve and accounts for expenditure in years one and two of the five year period. $300,000 was available for the 2013/14 Withers Action Plan projects with a further $385,813 held in the Withers Reserve. Council Decision 99/14 approved the transfer of $129,000 from the Withers Reserve to Withers Projects. Council Decision 144/14 approved the transfer of $135,000 from the Withers Reserve to Withers Projects. Council Decision 274/14 approved the transfer of $30,804 into the Withers Reserve which represented savings from completed 13/14 Projects and the transfer of $42,000 from the Withers Reserve for the CCTV project. Effectively when the Withers Advisory Committee was formed the remaining funding available was $1,285,813. The balance of the Withers Reserve as at 8 August 2014 (excluding the 2015/16 allocation of $300,000) is $110,617. The total available for Withers Action Plan Projects for 14/15 is $410,617. $467,000 projects have been carried over from 13/14, these have been funded from 13/14 Allocation ($175,000), Withers Reserve ($192,000) and SWDC ($100,000) Officer Comments This report only covers expenditure and income from the City of Bunbury Withers Action Plan funded projects. Individual Project status PR 3435 Close Laneways Five PAWs have been closed – additional expenditure incurred in repairing adjoining property and making other laneways inaccessible. The gas main in Whitley Place / Hudson Road has been terminated and meetings have been held with adjourning landowners to establish MOU to close this laneway permanently. Land disposal amalgamation is ongoing with the remaining PAWs that do not have services and can be closed permanently.

PR 3258 New Paths Devonshire Street Work complete with total expenditure of $178,650 which is $8,650 above initial estimate. This is the completion of 2013/2014 Withers Action Plan projects are requires a transfer of $8,650 from the Withers Reserve as the project was over budget. The over expenditure relates to the number of property access points that had to be modified and sections of path replaced due to vandalism during construction.
PR 3618 Install CCTV Grant agreement has been signed and revised Purchase Order issued to the successful tenderer. Work in the Stephen Street Office has been completed work on site is ongoing with the first cameras due to come on line in the week ending 12 September 2014 (subject to weather and breakdowns). The system should be fully operational by late September. A detailed report is attached which includes expenditure, balance remain and status of projects is attached DWS-1 - Expenditure Report as at08 September 2014
Analysis of Financial and Budget Implications
At the 11 July 2014 Withers Advisory Committee meeting $30,804 was transferred into the Withers
Reserve as savings were achieved in the 2013/14 projects. The Devonshire Street path project was completed in August 2014 and is over budget by $8,650. 2014/2015 Available of funds will be as follows:-
