Hi fellow licensees, the holidays are behind us and the spring market will be here soon . I am looking forward to the change in seasons and what is traditionally a

busy time of year for real estate . Let’s make sure this season is a success for the consumers as well as all of the agents .

No agent (or consumer) really wants to be involved in legal issues over a real estate transaction . To mitigate legal issues some scenarios that may look familiar to many of you are noted below . I personally experienced or knew of these situations .

1 . In the first situation, I received a message from a fellow agent about a closing . The text read, “Hi Kathy, the buyers have signed, I’ll stop by and pick up the extra house keys from your office at 11AM, and will also give the keys in the lock box to the buyer .” I called the selling agent and said the keys would not be released until I was notified by the title company that the sale was on record at the court house . The agent was upset, they promised the buyer they could have possession as soon as closing documents were signed and their check was delivered to the title company .

2 . Another time the selling agent, without the listing agent’s knowledge, left the buyer at the house with the home inspector . After opening it for the inspection the agent left .

3 . Because a Friday closing was delayed due to lender error, both agents agreed to let the buyers move in over the weekend . Their moving van arrived and the property was vacant . Closing was scheduled for the next Monday . Neither agent had the principals sign an Early Occupancy Agreement .

These types of situations have been a recurring theme in our profession . Agents are eager to help the buyer, but there are laws and rules we as licensees have to follow .

Idaho Real Estate License Law 54-2060(3), 54-2086(1)(c), and 54-2087(5) make it abundantly clear that licensees must be accountable for property . As far as the law is concerned “property” includes: earnest money, keys, personal property of the seller .

So what can we do to correct these situations?

Obtain permission in writing from the seller for non licensees to be in the property without an agent or allowing possession prior to recordation . This is a good way to protect the property of the seller and you the agent .

Let’s Talk about Teams... Everyone Else is

Teams have become a popular business model in Idaho and nationwide . The Real Estate Commission has been observing and monitoring this phenomenon for some time and has some explanations for Designated Brokers and teams within their offices.

First, what is a team? While it is not “defined” in Idaho license law, it is commonly defined statutorily in other states as two or more real estate licensees from within the same real estate brokerage company that work together to perform acts that require a real estate license. Teams may also include unlicensed personnel .

Many states have taken additional steps and created specific requirements for teams, rather than simply using existing laws to regulate teams . The laws vary by state but almost all address advertising and prohibiting the use of team advertising that might lead consumers to believe that they are dealing with the brokerage independent of that which the team agents are actually associated . Some laws also address supervision and responsibilities of the teams, compensation, record keeping and education requirements. Maryland’s law was one of the first team regulations nationwide and is still one of the most comprehensive, requiring the team leader, in addition to the designated broker, to supervise the team members. Oklahoma requires the team to register with the real estate commission . As teams have been a growing trend in the industry, the Idaho Real Estate Commission frequently receives questions regarding how Idaho Real Estate law applies to real estate teams . At this point, Idaho has regulated teams through the use of existing laws .

Here’s how Idaho’s current license law applies to teams…

Advertising Advertising is the top license law issue for teams . Teams MUST adhere to the same advertising rules that apply to all licensees and brokerages .

• Teams may advertise the team name but always MUST include the broker’s full licensed business name .

• When advertising a team, ensure the roles of team members are clearly identified in the advertisement. Unlicensed assistants must be plainly identified as unlicensed .

• Be cautious of misleading advertising . o In some cases, a team may appear as its own

brokerage firm.

o A common complaint from the public and other licensees is that they can’t “get to” the person the need to talk to . This can be confusing to consumers if there is a problem with a transaction . Who is ultimately responsible and able to help? Often consumers think the team leader is the designated broker .

Agency• The agency relationship is a relationship between the

client and the Designated Broker, NOT the client and a team or team member .

• The confidentiality of the client MUST be maintained at all times .

• In limited dual agency without assigned agents, the brokerage and all licensees are agents for both clients equally and cannot advocate on behalf of one client over another, even if teams are involved .

• Because of the nature of teams, team members regularly meet and talk about transactions . In this situation there is some risk that agency relationships could be compromised (especially in limited dual agency)

Record Keeping MUST be handled as follows:• All transaction documents must be turned into the

Designated Broker in a timely manner .• All earnest money must be turned into the Designated

Broker immediately, even if the deposit will ultimately be held by a title company .

• If earnest monies are directly delivered to a title company, the responsible broker still must document this in transaction files and have receipt of such.

• Transaction files MUST be maintained at the main brokerage office even if the teams are in a separate office.

• Representation agreements and contracts MUST clearly identify the brokerage NOT the team name .

Unlicensed AssistantsAs a reminder, the Designated Broker is responsible to supervise all unlicensed staff’s actions as well, even if they are hired by a team .

The Real Estate Commission is tasked with protecting consumers . One way that we do this is by mandating a minimum amount of education a licensee must take . The primary goal of continuing education is to prevent or reduce the potential harm that could come to consumers if assisted by an untrained professional . It seems that many licensees are satisfied with the minimum amount and are limiting themselves to the required 12 elective hours and 2 Core classes . I’d like to suggest some reasons why additional education is a benefit to consumers and licensees.When selecting a professional, we often look to those that have more than just the minimum education and experience . Here’s a simple example . When getting a root canal, we’d look for the professional who has performed dozens of these surgeries, who continues to learn from other great dentists, and is constantly working to keep themselves abreast of the latest techniques. The same is true for real estate consumers . There is a great deal of peace of mind in knowing that the real estate professional that your elderly grandparents have listed their home with has weathered a few transactions, is looking at the most current negotiating techniques, is abreast of the latest developments in financing options, and invests their time in their education because it helps them to provide better service to their clients and customers .

I would venture to say that many real estate agents consider continuing education a huge inconvenience and interruption to working their business . I would even go so far as to say that many agents tend to do the minimum amount of work to get their required continuing education.

I would urge you to consider a different perspective when it comes to continuing education . Simply ask yourself, what education might help me be a better real estate agent? Or, is there a class that might help me become a better negotiator? Or, how can I manage my business more effectively? Or, maybe there is a topic that you might like to learn more about . The list could go on and on . As agents, we help our clients with the largest investment they may ever make and the responsibilities we have to the public and our clients in that process is considerable . Think about the Idaho Code (the license law) that governs our industry and the REALTOR® Code of Ethics that guides our behavior . The one constant is that things are always changing . That is one reason we have Core every year .

So, with that said, why not look at continuing education as a means to “help” you rather than something you “have” to get done . There are so many opportunities for continuing education and designations today . In fact, there are currently 404 classes approved by the Commission . Of those, 274 are CE electives . There is a total of 18 recognized designations, with 109 designation classes supporting them . Of the 404 classes approved by the Commission, 281 are live delivery and 123 are online delivery . You can also receive up to four hours of elective credit for attending a Commission meeting once during each licensing period . That is plenty of options and opportunities .

Personally, I am a big fan of attending a live class because of the interaction and discussions that take place . Some of the best lessons come from someone else’s story or experience . But, if you are a procrastinator, have a small window of time to get your education completed, or do well in a self-paced environment, online classes can be a great resource . Just be sure you budget the time the course indicates it will take . I hear some of them may take more time to complete than taking a live class, so don’t expect that online is a shortcut to getting your education hours completed faster .

I would encourage you to take advantage and set some higher education goals . And, why stop at the minimum number of hours just because that is all you need . You might just learn something new & refreshing .

As you start this new year, I want to challenge you to come up with a personal development plan that includes the education appropriate for your life and your career goals . Be thinking now about the ways that you can invest in yourself and your future success .

What Would Enforcement Do? Q: Can a brokerage advertise that anyone buying a home from them, during a specific time period, will receive a rebate?

A: Idaho Code 54-2054(2) allows a licensee to pay any part or share of a commission, fee or compensation received directly to a principal to the transaction . However, no commission, fee or compensation may be split with any party to the transaction in a manner which would directly or indirectly create a double contract, or which would otherwise mislead any broker, lender, title compa-ny, or government agency involved in the transac-tion regarding source of funds used to complete the real estate transaction or regarding the finan-cial resources or obligations of the buyer .

Idaho Code 54-2053(4) provides that no advertis-ing shall provide any information to the public or to prospective customers or clients, which is mis-leading in nature . Therefore, any limiting factors in the advertising must be clearly spelled out so as not to mislead anyone reading the advertisement . Additionally, any rebates made to purchasers that will affect their loans must be disclosed in the Pur-chase and Sales Agreement for the underwriter’s approval .

Turning in Documents

The Commission noticed a disturb-ing trend in the industry; whereby, Designated Brokers are instructing licensees not to turn in transaction documents until the contracts are accepted by all parties . In the nat-ural order of things, they asked me to write an article about it .

The law sets a brokerage up to serve as a repository for transaction documents . This includes all transaction docu-ments, not just those that become a contract . The brokerage is where attorneys, consumers, and even the Real Estate Commission will go to obtain copies of the documents . If those documents are not at the brokerage, it is a violation of the license law .Equally important is the Designated Broker’s responsibil-ity to supervise the licensees . Reviewing transaction doc-uments can head off many problems, like loan fraud and others . Any broker who instructs licensees not to turn in documents until they are accepted is failing to supervise the brokerage .Someone who needs a copy of a document may not be fo-cused on the responsible broker, or anyone at that broker-age . Perhaps they want to sue the seller, or seller’s agent . If they are prevented from seeking justice, because you don’t have a document at all, it is a serious problem .Require your licensees deliver all transaction documents to the brokerage, review them, and serve as a respectable re-pository for your transaction documents .

Formal Actions

Alexander, Lara Jane, associate broker in Garden Valley . Alexander met some buyers at a party in Garden Valley . These buyers were already clients of another brokerage at the time . With full knowledge, she proceeded to send them data on homes for sale, and showed them property . She assisted the buyers in unilaterally cancelling their Buyer’s Representation Agreement, even going so far as preparing an offer for them that she held until the cancellation oc-curred. The first brokerage did not agree to the cancella-tion, and the buyers are still liable to them. The first bro-ker asked for a referral fee, and Alexander refused . This led the broker to file this complaint. Alexander stipulated to violation of Idaho Code sections 54-2054(4) - interfer-ence with another broker’s representation agreement, 54-2060(12) - gross negligence or reckless conduct, because these buyers are still liable to the original brokerage, and 54-2085(1) - failure to provide the agency brochure to the buyers at their first substantial business contact. Given a Formal Reprimand, she is required to pay a $3,500 civil fine, $975 for the costs and attorney’s fees, and she must successfully complete Sales Pre-License Module 1 within six months .

Anderson, Carolyn K., inactive salesperson . Anderson failed to renew her errors and omissions insurance at the end of September, 2017 . Staff offered her a simple form stipulation, whereby she could enter into the stipulation or request a formal hearing on the matter. Anderson ignored the mailing . Over the following months, and fourteen dif-ferent contacts, Anderson either promised to enter into the stipulation and pay her $150 fine, or to enter into a vol-untary surrender of her license . At no time did Anderson do either, or request a formal hearing. Staff then initiated a formal investigation, and Anderson failed to respond to the investigative inquiry. Staff concluded its investigation, and uncovered some additional violations . Anderson failed to respond to the Notice of Proposed Disciplinary Action . Staff had Anderson served with a complaint, and at this time she agreed to enter into a stipulation . She stipulated to violation of Commission Rule 121 .02 - failure to maintain an active policy of errors and omissions insurance, Idaho Code sections 54-2013(1) - failure to maintain her insur-ance, 54-2018(9) - failure to update her address within 10 business days, and 54-2058 - failure to cooperate with the Commission’s investigation . Given a Formal Reprimand, required to pay a $500 civil fine, and $500 for the costs and attorney’s fees .

Brackett, Barry Levi, designated broker in Jerome . Alex Castaneda had his broker’s license revoked . He operates a business brokerage called The Transition Group . In May of 2017, Cushing obtained a listing for the Sweetwater Bakery, in Idaho, on behalf of The Transition Group . This contract specifically mentioned the transfer of an existing lease . Staff researched Cushing online and found twelve other Idaho businesses for sale, two of which included real property . Cushing and The Transition Group stipulated to violation of Idaho Code section 54-2002 - unlicensed prac-tice. Cushing and The Transition Group are required to pay a $3,000 civil fine and $450 for the costs and attorney’s fees. Cushing and The Transition Group are jointly and severally liable for the fine along with the costs and attorney’s fees.

Edwards, Kenneth Patrick, inactive broker . Edwards acted as a Limited Dual Agent in a transaction . Inspection revealed the need for electrical, plumbing, flooring, and paint repairs. A sequence of Addenda were exchanged, but none of them specified whether repairs would be made, or who would be responsible for the invoices . Edwards made verbal and text representations that he would cover the ex-penses . He did pay for plumbing and electrical repairs . He coerced the buyers into closing by telling them he would pay for the flooring repairs later on. The transaction closed, and the sales commissions were disbursed . The buyers pursued Edwards for a year over the flooring repairs, and eventually called the Designated Broker . The broker had no idea what was going on, because nothing was entered on the addenda . Edwards became non-responsive to Staff when the Notice of Proposed Disciplinary Action letter was mailed out . Staff had Edwards served with a Complaint, but Edwards remained non-responsive . Staff served him with a Notice of Proposed Default Order, which he never respond-ed to . The Commission entered its Final Order on May 10, 2018 . Edwards is in violation of Idaho Code 54-2051(4)(a) - failure to include all terms and conditions in the Purchase and Sale Agreement, 54-2060(2) - engaging in a continued or flagrant course of misrepresentation regarding the floor-ing repairs, and 54-2060(11) - dishonest and dishonorable dealings. Given a Formal Reprimand, required to pay a $1,300 civil fine, $900 in costs and attorney’s fees, and he must successfully complete Risky Business 1 & 2 within six months . Floyd, Tom Alan, salesperson in Caldwell . Floyd was dis-covered advertising multiple dairy properties without an active listing for the property, or by crediting a brokerage that did hold a listing . He did this at two different brokerag-es. Staff requested copies of the listings, and Floyd became non-responsive to the investigation . Stipulated to violation of Idaho Code sections 54-2053(4) - misleading advertis-ing, and 54-2058(3) - failure to cooperate with the Com-mission’s investigation . Given a Formal Reprimand, he is required to pay a $2,000 civil fine, $450 for the costs and attorney’s fees, and he must successfully complete Risky Business 1 and 2 within six months . His real estate license is suspended for a period of six months, but five of those months are withheld, providing he complies with the Final Order and commits no additional violations in this time . Graver, Timothy C., designated broker in Meridian . Grav-er obtained a “Lease Only” listing on a piece of property . He then entered the property on LoopNet and his personal website as being for sale . Graver also showed the property to a potential tenant, and told the current tenant the prop-erty was for sale. His client terminated the listing and filed this complaint . Stipulated to violation of Idaho Code 54-2053(4) - misleading advertising in promoting a property for sale without a valid listing agreement . Given a Formal Reprimand; required to pay a $500 civil fine, and $450 for the costs and attorney’s fees . Additionally, if he successful-ly completes a Post License Pricing, Marketing, and Ad-vertising class within six months, the $500 civil fine will be withheld . Hammitt, Heather, inactive salesperson . Pled guilty to possession of marijuana in an amount greater than 3 ounc-es; a felony . She failed to report this conviction to the Com-

mission in ten days as required by law. Stipulated to viola-tion of Idaho Code 54-2060(1)(a) - conviction of a felony, and 54-2061(3) - failure to report the conviction within ten days . Hammett's license is revoked, but the revocation is withheld providing she complies with the terms of her criminal probation. She is required to self-report any pro-bation violations within 20 days . She must reimburse the Commission $450 for the costs and attorney's fees. Hansen, Amanda L., inactive salesperson . Hansen listed a property in New Plymouth in April of 2017 . She moved to a different brokerage in June of 2017 . She was allowed to take this listing with her, but she did not follow the cor-rect procedure . She had the seller sign a new listing, but recycled the old paperwork . This means she represented herself as working at the new brokerage approximately two months before she was licensed there . Then she had the sellers sign an addendum cancelling the listing at the original brokerage . She was not licensed at the original brokerage at this time, and could not act on their behalf to cancel a listing of theirs . A competing brokerage presented an offer on the property . Hansen called her seller to present the offer, and made an appointment to meet and prepare a counter offer . Hansen never arrived at the appointment, and completely disappeared . Her new designated broker took over the transaction, and had to recreate the file by contacting the seller and the buyer’s agent, because Hansen never turned in any paperwork . Hansen was non-respon-sive to her broker, so the broker terminated her for cause, and notified the Commission. Staff initiated an investiga-tion, but Hansen was non-responsive to the investigative process . Staff had Hansen served with a Complaint, but she failed to respond to the Complaint . Staff issued a Notice of Proposed Default Order, but Hansen failed to respond to it . The Commission issued a Final Order on September 6, 2018, finding Hansen to be in violation of Idaho Code sec-tions 54-2012(1) - no Idaho sales associate may be licensed under or associated with more than one Idaho broker at a time; 54-2053(4) – failure to modify or remove advertising placed at her original brokerage when she moved to her second brokerage; 54-2056(5) - failure to surrender prop-erty of her second brokerage upon termination; 54-2058(3) - failure to cooperate with the Commission’s investiga-tion; 54-2060(3) - failure to account for or remit property; 54-2060(5) - failure to cooperate with the Commission’s investigation; 54-2060(12) - gross negligence or reckless conduct; 54-2087(1) - failure to perform the terms of the Seller Representation Agreement; 54-2087(2) - failure to exercise reasonable skill and care when she risked los-ing a buyer for her client by not preparing and presenting a counter offer; 54-2087(3) - failure to be available to the client to receive and timely present all written offers and counter offers; and 54-2087(4) - failure to promote the best interest of her seller client . Given a Formal Reprimand; her real estate license is revoked; and she is required to reim-burse the Commission $1,100 for costs and attorney’s fees. Hollingsworth, Bret, inactive salesperson . Hollingsworth was convicted of Felony aggravated battery on October 5, 2016 . Stipulated to violation of Idaho Code sections 54-2061(1)(a) - felony conviction, 54-2061(3) - failure to re-port his conviction to the Commission within 20 days, and 54-2018(9) - failure to update his address with the Commis-sion . The seller discov-ered his garage filled with personal property. Stipulated to violation of Idaho Code 54-2060(3) -failure to account for property, 54-2060(12) - reckless conduct due to the fact she acknowledged written instructions not to provide ac-cess to the property, and 54-2086(1)(c) - failure to account for property on behalf of the seller customer . Was given a Formal Reprimand; required to pay a $750 civil fine, $900 for the costs and attorney’s fees and she must successful-ly complete both Risky Business I and Risky Business II within six months . Longhurst, Brandon Gary, salesperson in Idaho Falls . Longhurst was suspended by the Commission for a previ-ous action . Language in that Stipulation, Final Order, and an attached copy of the Guideline for suspended licensees made him aware that he had to remove all real estate ad-vertising. Longhurst was aware of the requirements long before his Stipulation was presented to the Commission . He failed to remove a multitude of internet advertising . He stipulated to the following violations of Idaho Code: 54-2002 - unlicensed practice during his suspension, 54-2060(10) - violation of the terms of his Final Order . Given a Formal Reprimand; required to pay a $1,500 civil fine. He must reimburse the Commission $450 in costs and at-torney’s fees . Roberts, Eric D., salesperson in Meridian . Roberts passed his licensing exams on February 26, 2018, but he did not activate his license until April 2, 2018 . Between these dates, he posted on his Facebook page that he was a licensee, and offered his services to the public . He also sent letters to a seller expressing interest in her home, and representing that he was a licensee . This seller listed with an actual licens-ee, and the licensee followed up with Roberts, since he expressed interest in the property . She told him she was the listing agent and to make all future communications through her . This is constructive notice that the property was listed, but Roberts continued to contact the seller di-rectly. This led the listing agent to file this complaint. Stip-
