PREFACE

1. The delegation of powers made in this SOP is in exercise of the powers conferred on General Manager as detailed in Annexure II of

Chapter V of the Indian Railway Financial Code Vol. I and other Indian Railway Codes and Orders issued by Railway Board from time to time

in consultation with FA&CAO.

2. Subject to the observance of the delegation contained in this Schedule and canons of financial propriety and also subject to the

provisions of the existing codes, rules and regulations, officers and officials at various levels have power to sanction expenditure or to issue

orders in exercise of their authority as specified in the schedule, and also to re-delegate their powers or any portion of them, to authorities

subordinate to them in respect of those items in which special re-delegation has been specifically authorized, but only to the extent therein

authorized. When such powers of re-delegation are exercised, the orders should be recorded in writing advising all concerned including the HQ

Office. Simultaneously with the issue of orders, the extent to which authority has been re-delegated should be entered in the last column of the

Schedule.

3. There are nine different SOPs in this Railway.

4. This revised edition of SOP Part E - Works Matters is in supersession of all previous orders. While every possible care has been

taken to include all the items in this edition, it is possible that some items have not been specifically mentioned. In such cases the extant orders

will apply.

5. No officer is empowered, except in an emergency, to suspend the exercise of or to withdraw the powers of official subordinate to

him in respect of powers delegated in this Schedule. If any curtailment of the powers delegated to any official is considered necessary, a

reference should be made to the HQ Office.

6. It is emphasized that the powers delegated to officials of various grades can be exercised only by those officials or by other officials

to whom they may have been re-delegated. The powers cannot be exercised by any other official for or on their behalf.

7. To enable the FA & CAO to exercise a check over financial sanctions, he should be furnished by each sanctioning authority with a

copy of each sanction in duplicate immediately after issue. In the case of divisionalised departments such copies should be addressed to the

divisional Accounts Officer concerned.

8. Amendments to this Schedule of Powers will be issued in the form of correction slips which will be numbered serially, part wise

and dated. The number, date and other particulars of each correction slip as it is received, should be entered up in the register of correction slips

at the end of this booklet and either the minor corrections referred to therein should be carried out immediately or the correction slip pasted at the

appropriate place as directed therein. The official responsible for maintaining the Schedule of Powers up to date will initial against each entry in

the register of correction slips. If a correction slip is received out of sequence, the missing intermediate serial number or numbers should be

called for from the immediate superior of the official concerned. All the SOPs are also available in RAILNET which are being updated

regularly.

9. All Powers that have financial implications should be exercised with prior finance concurrence, unless otherwise stipulated vide

Board’s letter No.F(X) II/77/PW/5/Pt5-A dated 30.6.92.

10. Attention is also drawn to the Procedure Order for according financial concurrence vide FA&CAO’s Procedure Office Order

No.27/58 dated 26.3.1958.

11. When delegations “up to” certain monetary limits are referred to, it means that the powers delegated are up to the monetary limit

inclusive.

12. Any suggestions for a modification of the Schedule of Powers to enable the work to be done more expeditiously or more efficiently

should be addressed to the DGM(G) through the normal official channels.

NOTE: (i) All powers specified herein below shall be exercised subject to the prior concurrence of the associated Finance, unless specified otherwise.

(ii) Where, for an Item of delegated power a specific Authority is cited, any modification in the delegated power made therein shall be automatically applicable and the

concerned delegated powers enhanced or reduced as the case may be, without any further sanction consistent with the modifications made in the Authority except

for Items which are the redelegated powers of the General Manager in respect of which the Authorities cited in the SOP are the Railway Board’s letter

No.F(X)II/86/PR/6 dated 5th

May, 1987, No.F(X)II/91/PW/8 dated 08.11.1991 and F(X)II-2003/PW/10 dated 09.01.2004.

(iii) All powers specified herein below shall be exercised subject to the procedures/conditions/manner specified in the Codal provisions and other instructions issued

from time to time.

(iv) The expression “upto” wherever used in conjunction with a financial limit would denote that the related power is exercisable upto and inclusive of the specified

financial limit.

(v) The Authorities delegated the powers specified herein below shall exercise them only in respect of the matters arising within their Administrative jurisdictions.

(vi) A superior Authority shall always be competent to exercise any of the powers delegated to a lower Authority in the administrative hierarchy.

Conditions:

1) Normally powers to dispense with calling of tenders

should be exercised sparingly. The circumstances under

which quotations have to be called should be spelt out.

2) The work should not be split up for the purpose of

bringing it within the ambit of this dispensation.

3) The reasonableness of rates should be gone into

objectively and in detail by the accepting authority.

4) Quotations should not be for items which can be

executed through the existing contracts including zonal

contracts.

5)Quotations should not be for fancy (expensive but of

low utility) items.

6) Quotations should only be for works which are urgent

in nature.

7)Quotations should normally be invited from at least

three well experienced contractors/agencies not

necessarily borne on the approved list.

8) Accepting authority must take precaution to see that

the quotations are from genuine firms(and not from

fictitious firms).

9) A register showing the full particulars of works

authorised through quotation will be maintained by the

officer having powers to dispense with calling of

tenders. The register shall be sent to associate finance

while seeking their concurrence.

23.4.1

Open/Limited/Single tenders: Sanction of increase in contracted quantities- Where the interse position of the original tenderer is not affected.

Ref.: Rly Board’s letter No.2007/CE.I/CT/18 dt. 28.09.07 & Letter No.2007/CE-I/CT/18 Pt.XII, dated 31/12/2010. The procedure detailed below shall be adopted for dealing with variations in quantities during execution of works contracts: 1. Individual NS items in contracts shall be operated with variation of plus or minus 25% and payment would be made as per the agreement rate. For this, no finance concurrence would be required. 2. In case an increase in quantity of an individual item by more than 25% of the agreement quantity is considered unavoidable, the same shall be got executed by floating a fresh tender. If floating a fresh tender for operating that item is considered not practicable, quantity of that item may be operated in excess of 125% of the agreement quantity subject to the following conditions: (a) Operation of an item by more than 125% of the agreement quantity needs the approval of an officer of the rank not less than S.A. Grade. (i) Quantities operated in excess of 125% but upto 140% of the agreement quantity of the concerned item shall be paid at 98% of the rate awarded for the item in that particular tender: (ii) Quantities operated in excess of 140% but upto 150% of the agreement quantity of the concerned item shall be paid at 96% of the rate awarded for that item in that particular tender: (iii) Variation of quantities of individual items beyond 150% will be prohibited and would be permitted only in exceptional unavoidable circumstances with the concurrence of associate finance and item shall be paid at 96% of the rate of awarded for that item in that particular tender. (b) The variation in quantities as per the above formula will apply only to the Individual items of the contract and not on the overall contract value. (c) Execution of quantities beyond 150% of the overall agreemental value should not be permitted and, if found necessary, should be only through fresh tenders or by negotiating with existing contractor, with prior personal concurrence of FA&CAO/FA&CAO(C) and approval of General Manager. 3. In cases where decrease is involved during execution of contract: (a) The contract signing authority can decrease the item upto 25% of individual item without finance concurrence. (b) For decrease beyond 25% for individual items or 25% of contract agreement value, the approval of an officer not less than rank of S.A. Grade may be taken , after obtaining “No claim Certificate” from the contractor and with finance concurrence giving detailed reasons for each such decrease in the quantities. (c) It should be certified that the work proposed to be reduced will not be required in the same work. 4. The limit for varying quantities for minor value items shall be 100% ( as against 25% prescribed for other items). A minor value item for this purpose is defined as an item whose original agreement value is less than 1% of the total original agreement value. 5. No such quantity variation limit shall apply for foundation items. 6. As for as SOR items are concerned, the limit of 25% would apply to the value of SOR schedule as a whole and not an individual SOR items. However in case of NS items, the limit of 25% would apply on the individual items irrespective of the manner of quoting the rate (single percentage rate or individual item rate.) 7. For the tenders accepted at Zonal Railways level, variations in the quantities will be approved by the authority in whose powers revised value of the agreement lies. (except as provided for in Sr.No.23.4.2) 8. For the tender accepted by General Manager, variation upto 125% , of the original agreement value may be accepted by General Manager. 9. For tenders accepted by Board Members and Railway Minister, variations upto 110% of the original agreement value may be accepted by General Manager. 10. The aspect of vitiation of tender with respect to variation in quantities should be checked and avoided. In case of vitiation of the tender ( both the increase as well as decrease of value of contract agreement), sanction of the competent authority as per single tender should be obtained. 11. In terms of R.B. letter No. 2007/CE-1/CT/13(i) dt.26.11.2013, in case of department not headed by a PHOD rank officer in HAG, the power of acceptance of works tender will be- CHOD in a rank of SAG up to Rs.50 crores.

overaged stock under or overaged stock involved in accidents/non IRS type wagons/coaches of inherently weak design in cases where no financial justification is

necessary.

(iv) On the Divisions, the wagons/coaches, whether underaged or overaged are required to be inspected by any of the Dy. CME/Sr. DME/CWM/CWE/CME during his

inspection tours before the condemnation is approved.

(v) In all proposals for condemnation of underaged stock (premature condemnation) it should be categorically certified by CME/CWE/CWM that the stock to be

condemned will be replaced in due course and no reduction in the authorised stock will be involved. In the case of overaged stock such a certificate to be recorded

not only on the condition report itself but also notified through sanction over the signature of WM/Dy.CME incharge of workshops.

(vi) In all such cases of condemnation of overaged stock within the competence of Dy. CME/WM, prior approval of CME/CWE is not necessary but the letter should be

kept posted with all such cases of condemnation so that the records in the HQ office as also corrected and kept upto date.

- COM has powers for sale of coal and

cinders subject to the conditions noted

1) Steam coal and cinders will be sold at all

Locomotive sheds and elsewhere under the

special order of the COM to such staff as

are mentioned below for their own use at

rates sanctioned by the General Manager at

the beginning of each financial year or more

frequently as may be necessary. These rates

will be notified in the Railway Gazettee.

i) All Western Railway staff.

ii) Foreign railway staff at junction stations.

iii) Special trains, Saloons or Inspection

carriage for use by VIPs High Dignitaries,

High Government Officials and railway

officers.

3) The following are entitled to purchase steam coal or

cinders for their use. The quantity will be sanctioned

by the Divisional Officer authorising the sale taking the

actual requirements into account:

i) Railway Schools.

ii) Catering Contractors

iii) Reading Rooms

iv) All other institutions belonging to Western Railway

v) Local Welfare Centres

vi) Railway Hospitals and Dispensaries.

Note:

(a) Supervision charges should not be levied on the sale

of steam coal to Railway Schools.

(b) In the case of sale of steam coal to catering

contractors, cost will be recoverable as above in so far

as it is not inconsistent with their contract.

in any circumstances.

4) Applications for the purchase of steam coal and/or

cinders must be signed by the employees themselves

and countersigned by their immediate superiors, who

should submit these applications to the DRMs or works

Managers who will scrutinise the bonafides of

applications, enter them in manuscript register and

issue standing work orders sending a copy to the Loco

Foremen concerned. Applications from institutions

must be signed by their principal representative.

5) Steam coal required for boiling water for drinking

purposes will be supplied free of cost to Railway

Schools and debited to head J-110-99. The maximum

free supply will be 254 Kgs. Per month. The cost of

carriage should also be debited to J-110-99.

6) Carriage of steam coal from railway depots to the

residence of an applicant will have to be arranged for

by the applicant and the cost of carriage paid by him in

all cases except where arrangements made by the

railway for home delivery exist, in which case the

applicant will have to pay extra charges only for home

delivery.

45. Auction of cinders. - COM has full powers for auctioning cinders surplus to

the requirement of the railways.
