MADE by the Minister for the Environment, with the approval of His Excellency theGovernor, under section 6 of the Noise Abatement Act 1972 .

Citation .

1 . This Order may be cited as the Noise Abatement (Ethnic Arts Festival ofW.A.) Exemption Order 1985 .

Ethnic Arts . 2. The Noise Abatement (Neighbourhood Annoyance) Regulations 1979, theNoise Abatement (Noise Abatement Directions) Regulations 1981 and the rel-evant provisions of the Act do not apply in respect of the Acts or Thingsspecified in Schedule I to this Order, being Acts or Things forming part of theEthnic Arts Festival of W.A ., subject to the circumstances and conditions speci-fied in Schedule II to this Order .

The services provided to these lots are Water, Electricity,Drainage and Roads and the Ingoing Premium's as shown inthe schedule are payable within 30 days of acceptance of theapplication .The survey fees shown in the schedule are payable in cash

within 30 days of acceptance of application .Where the in-going lessee indicates that he anticipates a

requirement for freehold during the currency of the lease,the Hon. Minister shall signify the extent of development(which may be additional to that required as the basis forleasing the site) that will be necessary to enable the issue ofa Crown Grant.

Subject to agreement between the lessee and the Minister,the foregoing development obligations and other conditionsset out herein may be varied or added to from time to time .At any time during the currency of the lease, subject to the

Minister, the lesseemay surrender his lease to the intent that he may apply forpurchase of the said land . In this event a purchase price inaccordance with the Schedule shall apply for a period of 3years from the date of approval of the lease (following whichperiod the price shall be subject to review) and feesassociated with the issue of a Crown Grant shall be payable .

The land is made available for leasing subject to thefollowng conditions:-

1 . The land shall not be used for any purpose otherthan General Industry without the prior approvalin writing of the Minister for Lands and Surveys .

2 . The rent shall be subject to reappraisement at theend of the third year of the term of the lease andeach successive three yearly period thereafter .

3 . The lessee shall not without the previous consent inwriting of the Minister assign, transfer, mortgagesublet or part with the possession of the demisedland.

4. The land shall be occupied and used by the lesseefor the purpose specified within nine (9) months ofthe commencement of the lease and thereafter willbe continuously so used to the satisfaction of theMinister.

5. The lessee shall commence construction withinnine (9) months and thereafter continue construc-tion and complete and operate the works withintwo (2) years from the date of the commencementof the lease .

6 . All buildings, erections, paving, drainage and otherworks shall be to the approval of the Local Auth-ority and the lessee shall perform, discharge andexecute all requisitions and works unto the demisedland as are or may be required by any local orpublic authority operating under any statute by-lawor regulation .

7 . The lessee shall, within twelve months from com-mencement of the lease, fence the external bound-aries to comply with Shire of Broome by-laws tothe satisfaction of the Minister .

8 . The lessee shall maintain existing and future im-provements to the satisfaction of the Minister .

9 . All frontages shall be treated and maintained togive an appearance aesthetically pleasing consistentwith the purpose of the lease according to a plansubmitted to the Minister.

10. The lessee shall pay in cash the full value of allexisting improvements as determined by the Minis-ter .

11 . The lessee shall indemnify the Minister against allclaims for damage to property or persons arisingfrom the use of the land .

12. The Minister or his representative may enter theland for inspection at any reasonable time .

13 . The land shall be filled to levels specified by, andacceptable to the Minister or his nominee and theShire Council .

14 . Compensation will not be payable for damage byflooding of the demised land .

15. Compensation shall not be payable to the lessee inrespect of any improvements effected by him on thedemised land and remaining thereon at the expir-ation or earlier determination of the lease.

16 . It shall be lawful for the Lessee at any time withinthe three calendar months immediately followingthe expiration of the term or earlier determinationof the lease, to take down, remove, and carry awayany buildings, structures, improvements and plantthe property of the lessee .

17 . On determination of the lease, the lessee shall fillin, consolidate and level off any unevenness,excavation or hole caused by him during the termof the lease or by removal of his improvements andshall leave the demised land in a clean, neat andtidy condition to the satisfaction of the Ministerand shall remove any or all waste matter asrequired by the Minister .

A person in the employ of the State must apply throughthe Under Secretary for Lands for the Governor's per-mission to hold this land. Written approval of the Perma-nent Head concerned should accompany such application.

Applications must be lodged at the Department of Landsand Surveys, Perth on or before Wednesday, 8 January 1986accompanied by the deposit as shown in the scheduletogether with the required development details andcompleted Land Board Questionnaire .

Notice to Owners and/or Occupiers of Land .IN accordance with the provisions of section 33 of the Act .on or before 30 November 1985-or within 14 days of thedate of becoming owner/occupier after 30 November 1985-you must remove from the land you own or occupy, allinflammable material or clear firebreaks in accordance withthe following requirements, and then keep the land orfirebreaks clear of inflammable material up to and including12 April 1986 :

(1) Land having an area of 2 000 m 2 or more-afirebreak not less than three metres wideimmediately inside and around all external bound-aries of the land must be cleared by ploughing,cultivating, scarifying or burning ; or

(2) land having an area less than 2 000 m2 -a firebreaknot less than two metres wide immediately insideand around all external boundaries of the land mustbe cleared by cultivation, mowing, slashing orchemical application .

Wherever a firebreak is cleared by burning, the provisionsof the Act and regulations made thereunder must beobserved .

If pursuant to item (2) of this Notice, mowing or slashingis carried out, the height of the vegetation must not exceed,as far as is practicable, 20 mm over the entire area of theland. The use of chemicals is subject to all restrictionsimposed by the Department of Agriculture .

Attention is drawn to the Flammable Liquids Regulationsmade under the Explosives and Dangerous Goods Act 1961,which requires a site on which flammable liquid is stored tobe totally cleared of all inflammable material for a minimumdistance of 10 metres surrounding the site .

If it is considered to be impractical for any reason tocomply with the provisions of this Notice, application maybe made not later than 15 November 1985 to Council forpermission to provide alternative fire protection measures .If permission is not granted, the requirements of this Noticemust be complied with .

An owner or occupier of land who fails or neglects in anyrespect duly to comply with the requirements of this Noticeis liable to a fine of $400 . Irrespective of prosecution or fine,an owner or occupier remains responsible for the cost ofcarrying out the work stipulated in this Notice .

Project: W50.005AA .WHEREAS by the Water Authority Act 1984 it is providedthat, subject to the provisions of the Act, the Water Auth-ority, with the authorization of the Minister for Water Re-sources, has power to construct or provide major works, andwhereas the preliminary requirements of the said Act havebeen complied with now therefore, I Arthur Tonkin Ministerfor Water Resources, by and with thg advice of the WaterAuthority Board do hereby authorize the Water Authority toundertake the construction or provision of the followingworks, namely:

Pemberton Trout Hatchery Water Supply .Big Brook Dam .Manjimup Shire .

The proposed works consist of the construction of :A dam with a reservoir storage volume of 530 000 m 3 ,

consisting of a concrete ogee shaped spillway section 20metres long and approximately 6 metres high togetherwith reinforced concrete retaining walls and adjacentearth embankments of approximately 8 .3 metres height.

The above works are to be complete with all equipmentand materials necessary for the undertaking .

All of the proposed works will be wholly located withinState Forest No . 10 Big Brook Block .The above works and localities are shown on Plan WAWA

AA02-2-1 .The purpose of the proposed works is to provide water

storage for the Pemberton Trout Hatchery Water Supply .This Authority to construct and provide the works shall

NOTICE is hereby given that the Shire of Roebourne inpursuance of its powers under the Town Planning and De-velopment Act 1928 (as amended), has prepared a PlanningScheme to be referred to as the Karratha Townsite AreaScheme, as the Scheme boundary has been extended beyondthe townsite boundary in two places :-

(a) To high water mark beyond the Northern townsiteboundary to facilitate rational control and manage-ment of the foreshore dunes ;

(b) By approximately three kilometres to the southside of the North West Coastal Highway, and out-wards at the southeast corner, to control possibleribbon development along the Highway and allowfor control of possible future special industrial de-velopments in addition to the two existing in thisarea .

The townsite boundary to which reference is made in thisdiscussion is that expanded townsite boundary proposed bythe Department of Lands and Surveys for the future devel-opment of Karratha to a population of approximately 40 000and represented on the Department of Lands and Surveys"Karratha Townsite Conceptual Plan" (Plan No. CD1993A) .For the purpose of:-

(a) consolidating the existing development and to en-courage the upgrading of the standard of earlierdevelopments commensurate with current stan-dards ;

(b) setting standards for new development bycontrolling the development and use of all landwithin the townsite area ;

(c) controlling the development and guide the management of the various reserves to ensure the pro-vision and conservation of the various recreationaland leisure needs of current and future residents ;

(d) adapting normal standards to suit the specific re-quirements of Northern living, particularly in re-spect to climate, economic circumstances andphysical and social environment .

Citation .

1 . This Order may be cited as the Soil and Land Conservation (CarnamahSoil Conservation District) Amendment Order 1985 .

Principal order.

2 . In this Order the Soil and Land Conservation (Carnamah Soil Conser-vation District) Order 1985* is referred to as the principal order.

Clause 3

3 . Clause 3 of the principal Order is amended by inserting in the appropriateamended .

alphabetical position the following definitions-"appointed"appointed member" means a person appointed under clause 6 (1) (b), (c),

(d) or (e) to be a member of the committee ;"committee" means the District Advisory Committee for the Carnamah

Soil Conservation District ;"member" means a member of the committee ; .

4 . Clause 6 of the principal Order is amended-amended .

(a) in subclause (1)-(i) by deleting "9" and substituting the following-

" 10 " ; and(ii) in paragraph (e), by deleting "3" and substituting the following-

(b) by inserting after subclause (2) the following-(3)(3) Subject to this clause each appointed member shall hold officefor such period not exceeding 3 years as is specified in the instru-ment of his appointment and is eligible for reappointment .

(4) The Minister may grant leave of absence to an appointedmember on such terms and conditions as the Minister determines .

(5) The Governor may terminate the appointment of anappointed member for inability, inefficiency or misbehaviour .

(6) If an appointed member-(a) is or becomes an undischarged bankrupt or person whose

property is subject to an order or arrangement under thelaws relating to bankruptcy;

(b) has his appointment terminated by the Governor, pursu-ant to subclause (5) ;

(c) is absent, except on leave duly granted by the Minister,from 3 consecutive meetings of the committee of which hehas had notice ; or

(d) resigns his office by

the office of that appointed member becomes vacant . ' .Clause 7

5 . After clause 6 of the principal Order the following clause is inserted-inserted.

" 7 . (1) The committee shall hold its meetings at such place on such daysthe committee.

(a) a majority of the members constitute a quorum ;(b) the Chairman shall preside and where he is absent from the

meeting the members may appoint one of their number to pre-side at that meeting ;

1 . These regulations may be cited as the Enzootic Diseases AmendmentRegulations (No . 4) 1985 .

Regulation 27B

2 . After regulation 27A of the Enzootic Diseases Regulations 1970*, theinserted,

following regulation is inserted-27B. (1) In this regulation "feedlot" means an area (which may be

subdivided) where stock from one, or more than one, source are assembledand fed .

(2) Notwithstanding these regulations, stock-(a) in the same feedlot but assembled for export ; or(b) in the same feedlot but assembled for reasons other than export,

where that assembly is likely in the opinion of an inspector, tocontribute to the spread of disease,

shall be subject to quarantine under this regulation .(3) An inspector may require the person in charge of stock which is the

subject of quarantine under this regulation to comply with directions inwriting relating to movements of the stock on the premises where they areassembled and movement from those premises to some other area .

(4) An inspector may require the person in charge of stock which is thesubject of quarantine under this regulation to comply with directionsrelating to segregation and treatment of the stock within the premiseswhere they are assembled . ' .
