JANUARY 11, 1994 SESSION OF THE WALWORTH COUNTY BOARD OF SUPERVISORS The meeting was called to order at 9:35 a.m. by Chairman Byrnes in the County Board Room of the Walworth county Courthouse. Roll call was read with all supervisors present except Supervisors Bethke, Clark, Cummings, Lockwood.and Wenglowsky who had been excused. The minutes of the December 14, 1993 session were approved on motion by Supervisor Janowak, seconded by Supervisor Mikrut. Chairman Byrnes called on Peggy Mackelfresh, Clerk of Courts, to present the "Distinguished Employee of the Quarter" award. The award was presented to Penny True-Dauffenbach, an employee of the Clerk of Courts Department. A special Order of Business was presented at this time. Sergeant Allen Zimmerman of the Walworth County Sheriff's Department presented a report on the duties and responsibility of the Emergency Government Department. A history of· the 911 system in Walworth County was also given. On motion by Supervisor L. Scharine, seconded by supervisor Lauderdale the personal injury claim of Phil Fenner was allowed to be on the day's agenda. On motion by Supervisor Lauderdale, seconded by Supervisor Key, the claim was. denied. The following Reports of Zoning Gone Into Effect were read and placed on file. Edward M. Chairman Byrnes gave a Chairman's Report and informed theSupervisors of the following: A sympathy card is beingcirculated to the family of former County supervisor KittyStewart. An invitation from the Walworth County SnowmobileAlliance has been extended to all Walworth County Supervisors tothe first annual Trails Appreciation Day to be held January 22ndat the Walworth County Tucker Building on Hodges Road from noonuntil mid-evening. A transition overview from the present jailfacilities into the new one will be presented to all interestedcounty Board members on January 12, 1994. A copy of a proposedstatutory change in the 1994 BUdget Adjustment Bill relating topermitting trustees of a county hospital to join with a public orprivate organization, has been received from RepresentativeColeman. American Energy Management has made a donation to theCancer Research foundation in Walworth County's name.

Supervisor Lauderdale gave a Wisconsin Counties Director'sReport and informed the supervisors that due to the holidays,there has not been much activity and that an employee of WCA, JonHochkammer, will be leaving WCA.

The following petition to rezone, with recommendation todeny approval, was moved for adoption on motion by SupervisorMorrison, seconded by Supervisor Prusener. On motion bySupervisor Logterman, seconded by Supervisor Janowak, thepetition was referred back to the Park and Planning commission.Supervisors Morrison, J. Byrnes and Palzkill recorded their votesas "no". Chairman Byrnes entered into record a letter receivedfrom the Town of Darien recommending approval of this rezone.

On motion by Supervisor Prusener, seconded by SupervisorTilton, Resolution No. 49-01/94, authorizing the county toparticipate in a county environmental liability feasibility studywas adopted.

RESOLUTION NO. 49-1/94

RESOLUTION AUTHORIZING PARTICIPATION IN A COUNTYENVIRONMENTAL LIABILITY FEASIBILITY STUDY

WHEREAS, environmental clean-up has become a significantliability for county government since cqunties are often heldresponsible for the clean-up and repair of damages caused byenvironmental hazards, and

WHEREAS, counties are being held responsible not only forenvironmental hazards on county owned lands and county operatedfacilities, but also on tax deeded properties and non-countyowned waste disposal facilities that counties have used, and

WHEREAS, the Wisconsin county Mutual Insurance Corporationhas initiated a stUdy to det~rmine the county interest in and thefeasibility of creating an environmental liability protectionprogram for counties, and

WHEREAS, three concepts will be studied including:establishing a group purchase program for engineering, legal, andbasic environmental services, creating a legal defense andengineering service insurance program for environmental damageliability, and creating an environmental mutual to provideliability insurance for all types of environmental and pollutionexposure, and

WHEREAS, county Mutual has committed up to $50,000 tounderwrite the cost of the study, the cost for Walworth County toparticipate in the stUdy would be $500.00, and

WHEREAS, the $500.00 participation fee is non-refundable,however if funds from counties are in excess of the funds neededto complete the stUdy, a prorated share will be returned to thecounty, and

WHEREAS, the Solid Waste Management Department hassufficient funds to cover the participation fee and would be ableto obtain revenue to offset this cost from landfill revenuefunds.

NOW THEREFORE, BE IT RESOLVED, that the Walworth County

Board of supervisors agrees to participate in the CountyEnvironmental Liability Feasibility study and does hereby committhe sum of $500.00 to participate in the study, and

BE IT FURTHER RESOLVED, that the Executive committee hasdesignated the County Solid Waste Manager as the contact personfor this study, to receive all future correspondence and toparticipate in discussions regarding this study.

RESOLUTION BY THE LAND INFORMATION OFFICE AUTHORIZING THEWALWORTH COUNTY LAND INFORMATION CONTACT PERSON TO FILE A STATEGRANT APPLICATION

WHEREAS, Walworth county has created a Land InformationOffice pursuant to the requirements of SS 59.88 of the Wisconsinstatutes, and

WHEREAS, by Resolution No. 59-10/91, the Walworth CountyBoard adopted the Walworth County plan for land recordsmodernization as set forth in SEWRPC Community AssistancePlanning Report No. 139, A Land Information System Plan forWalworth County, and

WHEREAS, there are State grants-in-aid available from theWisconsin Land Information Board to assist in the implementationof the above-referenced Plan, and

WHEREAS, the above-referenced Walworth County Plan for landrecords modernization recommends that Walworth County seek qrantsfrom the Wisconsin Land Information Board in support ofactivities relating to completion of a county-wide automated basemap, and

WHEREAS, the members of the Walworth County Land InformationOffice unanimously recommended at a meeting held on December 20,1993 that the Walworth county Board of Supervisors submit a qrantapplication to the Wisconsin Land Information Board in January1994 in support of work activities being proqrammed for executionin 1994 as detailed in the grant application titled WalworthCounty 1994 Topoqraphic Mapping Program.

NOW THEREFORE, BE IT RESOLVED by the WALWORTH COUNTY BOARDOF SUPERVISORS that the Land Information Office contact person is

hereby authorized and directed to, on behalf of Walworth County,submit an application to the Wisconsin Land Information Board fora state grant in the amount of $95,000 in support of theacquisition of large scale topographic mapping in the mannerrecommended in the above-referenced Walworth County LandInformation Plan.

BE IT FURTHER RESOLVED that once funds are awarded, anadditional resolution shall be submitted to the Board to finalizethe work project and expenses.

G~ODETIC REFERENCE FRAMEWORK PLAN AND BUDGET (DELAVAN/WALWORTH)

WHEREAS, Resolution 59-10/91 approved the Walworth CountyPlan for Land Records Modernization as set forth in SEWRPCCommunity Assistance Planning Report No. 139 titled A LandInformation System Plan for Walworth County, and

WHEREAS, the Walworth County Plan for Land RecordsModernization was approved by the Wisconsin Land InformationBoard, which now gives authorization to Walworth County to exPendfunds from the retained Register of Deed's recording and filingfees to pursue activities in accordance with the plan, and

WHEREAS, Resolution 10-06/93 authorized our Land InformationOffice contact person to submit an application to the WisconsinLand Information Board for a State grant in the amount of$100,000 in support of geodetic reference framework developmentactivities in the survey townships of Delavan and Walworth, and

WHEREAS, the $100,000 grant application was SUbmitted, and a$50,000 grant has been awarded to Walworth County by theWisconsin Land Information Board, and

WHEREAS, Resolution 10-06/93 and our approved grant proposalstates that we will contract with Southeastern Wisconsin RegionalPlanning Commission (SEWRPC) to carry out the horizontal andvertical control survey activities, and

WHEREAS, the Land Information Office unanimously recommendsapproval of the attached agreement with SEWRPC, pending review bycorporation Counsel, for the work plan to carry out thehorizontal and vertical control survey activities in thedesignated Delavan/Walworth areas, and

WHEREAS, $100,000 was included in the 1994 BUdget forconsultants, and $14,700 was budgeted as use of equity, and

WHEREAS, the Personnel Committee reviews requests for thereallocation of existing positions to different pay ranges and

makes a determination taking into consideration job contentanalysis, internal equity, external market, and recruitment andretention factors, and

WHEREAS, the Personnel Committee has held in abeyance adecision on a pending request to reallocate Correctional Officer ~

positions due to the fiscal impact on such action and funds notbeing available in the Sheriff's 1994 salary account to implementany change, and

WHEREAS, management has reviewed the effectiveness of theuse of Lead Correctional Officer positions in lieu of staffingwith bona fide supervisory positions, and

WHEREAS, with rapid growth and expanded accountabilities inCorrections activities, the Law Enforcement Committee andPersonnel Committee recommend that the County Board addressrecruitment and retention problems, and provide effectivestaffing and supervisory support for the Corrections division ofthe Sheriff's Department.

NOW, THEREFORE, BE IT RESOLVED that ten (10) Correctionsfirst-line supervisory positions are created to providesupervisory coverage on all shifts, seven days per week,effective on or after July 1, 1994, and

BE IT FURTHER RESOLVED that upon the filling of the ten (10)supervisory positions twelve (12) Lead Correctional Officerpositions are abolished and two Correctional Officer positionsare created, and

BE IT FURTHER RESOLVED that the sum of $55,835 beappropriated from the contingency Fund to the Sheriff'sDepartment salary and fringe accounts, as shown on the attachedfiscal note, for the sole purpose of implementing necessary payadjustments for Correctional Officer classifications and for theimplementation of the supervisory positions, and

BE IT FURTHER RESOLVED that the Personnel Committee shall beresponsible for implementing this resolution in accordance withestablished personnel policies and labor relations law, effectiveon or after April 1, 1994.

Each county will be allowed one room at theheadquarters hotel and an average of the previous two year'sconvention registrations will permit each county to block thisnumber of rooms during the housing lottery. Legislationsupporting approval of the county Clerk and County Board before amunicipality purchases new voting equipment is being introduced.An update in the litigation regarding circuit court supportgrants was given.

Supervisor Morrison reported on the Highway DepartmentWinter Conference held in Fond du Lac, Wisconsin.

Supervisors Prusener and Lauderdale expressed concern thatneither of the Wisconsin Senators is among the co-sponsors ofSenate Bill 993, requesting that local governments be free offuture federal mandates. The Chairman stated that he would draftletters to Senator Feingold and Senator Kohl requesting theirposition on this bill.

Frank Dobbs, Director of Planning and Zoning, informed theSupervisors that the Wisconsin Power and Light Corporation hasbeen meeting with Walworth County and six other SoutheasternWisconsin counties regarding a campaign to bring more industry toSoutheastern Wisconsin. The campaign will be focused on Illinoisand Canadian companies.

A Special Order of Business was held at this time. LorenAnderson, Administrator, presented an update on Lakeland MedicalCenter. The Supervisors were brought up to date on the currentbuilding program and other programs related to the MedicalCenter.

WHEREAS, the Personnel committee and department heads haveapplied consensus decision making principles in arriving atinitial recommendations for 1994 revisions to the pay plan and

WHEREAS, as it may take several months to fUlly evaluatepending recommendations for changes in certain benefits, initialpay plan adjustments are included in this resolution, subject tomodification based on final 1994 compensation package adjustmentswhich will be presented to the county Board for approval by July1994, and

WHEREAS, the Personnel Committee recommends that therevisions identified herein be adopted by the Walworth countyBoard.

NOW, THEREFORE, BE IT RESOLVED that the management pay planand administrative support pay plan as identified under sections14.07(A) and 14.07(B) of the Personnel Code shall be increased bytwo and six-tenths percent (2.6%) effective January 1, 1994, and

RULES AND PROCEDURES

The Commission on Aging was created upon the authoritygranted pursuant to section 46.82, wis. statutes, by ResolutionNo. • This Commission will consist of nine (9) members,including the five (5) members of the Human Services ExecutiveCommittee (one of whom is non-elected) and four (4) members ofthe Council on Aging Executive Committee (all non-electedofficials), all to be appointed by the Walworth County Board ofSupervisors.

The Commission shall be a "governing and policy-making body"in accordance with requirements of the Federal Older AmericansAct. The Commission shall be responsible for those duties as setforth in section 46.82, wis. statutes. The composition and termsof the Commission shall be as set forth in section 46.82, Wis.Statutes. The Commission Chairman shall be the Chairman of theHuman Services Board.

The Commission shall meet at least four (4) times per year.

Human Services Board members on the Commission will receiveper diem and mileage, and the Council on Aging members willreceive mileage.

ACCRUED TIME OFF DONOR PROGRAM(Sections 25.31 - 25.35)

25.31 Eligibility and exclusions. The Accrued Time Off DonorProgram described in sections 25.31 through 25.35 and ashereinafter referred to as the "Donor Program" appliesonly to non-represented regular employees who havecompleted one year of active service in a regularposition, SUbject to any further restrictions containedherein. The Donor Program may also be extended torepresented employees, SUbject to the same termsapplicable to non-represented employees, only if thebargaining unit representatives have elected toparticipate in the Donor Program through a writtenmemorandum of agreement, or a collateral agreement, withWalworth County. Elected officers, county boardsupervisors, employees represented by non-participatingbargaining units, casual, limited term, and student workexperience employees are not eligible to participate inthese benefits.

25.32 criteria which apply to the recipient-employee. Thefollowing criteria must be met before an employee mayreceive accrued time-off donations from other employees:

(A) The employee must be unable, after reasonableaccommodation considerations, to perform their normal jobduties due to a serious medical condition affectingeither themselves or an immediate family member."Immediate family member" as used herein means the spouse

or child of the employee who is primarily dependent onthe employee for support.

(B) The employee must have exhausted all of theirpersonal available accrued benefits in accordance with25.09 (C) of the Personnel Code.

(C) The period of the employee's unpaid leave of absencemust be expected to exceed 60 calendar days as certifiedby the attending physician. The County may request asecond medical opinion to verify the nature of andduration of the disability.

(D) The loss of i~come must represent a significanthardship for the employee. The Personnel Committee shalldetermine when a significant hardship exists.

25.33 Procedure to request donated time off.

(A) A written request to request donated time off for anemployee must be presented to the county Department Headby 2 or more co-workers, and those co-workers must bepotential eligible donors under the Donor Program. Thewritten request must provide a complete justification ofneed which addresses all of the criteria establishedunder 25.32. The request can not be made greater than 45days prior to the date the employee's own accrued timeoff benefits are expected to be exhausted.

(B) The County Department Head shall review the requestand make recommendation for approval or denial to thePersonnel Committee.

(C) The Personnel Committee shall review each request toreceive benefits under the Donor Program on a case-by­case basis. The decision of the Personnel Committeeshall be non-precedential and final. The decision of thePersonnel Committee may not be appealed or grieved.

(D) The Personnel Director shall notify the employee andDepartment Head of the Personnel Committee's decision.If approved, the Personnel Department shall beresponsible for disseminating the necessary donor formsand information to the appropriate employees.

25.34 Conditions which apply to donated time off.

(A) An eligible employee may only donate their accruedand available vacation, holiday, or personal time. sickleave or compensatory time may not be donated. Donatedtime must be in increments of eight (8) hours. The

donor-employee's decision to donate time can not berevoked for any reason.

(B) The total amount of donated time cannot extend theemployee's regular pay beyond one hundred eighty (180)calendar days from the date the employee's own accruedbenefits were exhausted. The employee shall use thedonated time based upon their prevailing FTE rate.

(C) Donated time is paid at the recipient's rate of pay.The donor's rate of pay is not relevant.

(D) No additional vacation, sick or holiday benefitsshall accrue when the employee-recipient is receivingextended pay through donated time.

(E) The County shall continue to pay its share of thehealth and/or dental insurance premiums during thetemporary disability period which is paid from donatedtime. However, the County shall discontinue paying thehealth and/or dental insurance benefits as of the datethat a physician certifies that the employee ispermanently disabled. An employee is deemed to be"permanently disabled" when the employee is unable toengage in any substantial gainful activity by reason of amedically determinable phy~ical or mental impairmentwhich can be expected to result in death or to be oflong-continued and indefinite.duration.

(F) Life insurance benefits shall be administered inaccordance with the provisions of the life insurancecontract.

(G). The employee is sUbject to termination once aphysician has certified that the employee is permanentlydisabled (as defined under 25.34 (E». Upon terminationor death, any remaining donated benefits shall be paid asseverance pay on the same basis as any other termination.

25.35 Miscellaneous provisions

(B) The Personnel Committee shall approve any otheradministrative policies which may be necessary forimplementation of the Donor Program.

(C) The Donor Program is implemented on a trial basisfor a maximum period not to extend past December 31,~1994. Continuation of the Donor Program past

December 31, ~1994, requires approval of the CountyBoard.

(D) The county reserves the right to terminate the Donor/Program prior to December 31, ~1994, at the solediscretion of the Personnel Committee. Upon terminationof the Donor Program, any donated time which has alreadybeen approved by the Personnel Committee shall remain ineffect. The Personnel Committee shall notify the CountyBoard and all Department Heads of its decision toterminate the Donor Program prior to December 31,~1994.

The County Clerk informed the supervisors that the 1993Annual Reports have been printed and are available from theCounty Clerk's Office. '

On motion by Supervisor Lothian, seconded by SupervisorCummings, the Clerk was requested to read Resolution No. 62­03/94, authorizing the participation in the Wisconsin county Bondcommission. The resolution was moved for adoption on motion bySupervisor Lauderdale, seconded by Supervisor Janowak.Supervisor Lauderdale introduced Mark O'Connell from WisconsinCounties Association, who spoke to the board regarding theunfunded liability in regard to the Wisconsin Retirement System.Mr. O'Connell explained that unfunded liability occurs wheneverthe pension benefits are increased. Walworth County's unfundedliability to the Wisconsin Retirement System is $10,048,894. Mr.O'Connell explained that a solution would be for counties torefinance their unfunded liability at a lower interest rate byforming a Wisconsin County Bond Commission. SupervisorLauderdale introduced Dave DeYoung, Firstar Bank and FinancialAdvisor to the County. Mr. DeYoung explained borrowing for thepurpose of funding the unfunded pension liability. A questionand answer period was held. A motion by supervisor Bethke,seconded by Supervisor Prusener, to refer this resolution back tothe Finance Committee for one month was defeated by voice vote.Resolution No. 62-03/94 was adopted as presented. SupervisorsBethke, Prusener and, Grant recorded their vote as "no".

AUTHORIZING THE PARTICIPATION IN THEWISCONSIN COUNTY BOND COMMISSION

WHEREAS, the Wisconsin county Bond Commission (Commission)has been created under s. 66.30, Wis. Stats., to issue revenuebonds to refinance the County's unfunded pension liabilityobligation pursuant to s. 40.05(2)(b), Wis. Stats., and to enterinto contracts with the state of Wisconsin relating to therefinancing of the County's unfunded pension liability, and

WHEREAS, the Commission may also, at the direction of theBoard of Commissioners, issue revenue bonds for other purposespermitted under s. 66.30, Wis. Stats., as amended from time totime, and enter into contracts necessary to accomplish thefinancing objectives of its Members, and

WHEREAS, the Walworth County Board of Supervisors desires toparticipate in the benefits offered by the Commission, and

WHEREAS, the Walworth County Board of Supervisors hasreviewed the Intergovernmental Contract and Bylaws of thecommission, and

WHEREAS, the Walworth County Board of Supervisorsacknowledges that participation as a Member of the Commission mayrequire the issuance of general obligations of the County inorder to secure repayment of the Commission's revenue bonds, and

WHEREAS, the amount of the County's general obligation willdepend on the number and identity of the other Members of theCommission participating in each bond issue of the Commission,but such amount will correspond to the County's fairly allocableshare of the principal amount of the bond issue and the expensesrelated thereto.

NOW, THEREFORE, BE IT RESOLVED that the Walworth CountyBoard of Supervisors does hereby:

1. agree to become a Member of the Wisconsin county BondCommission, and

2. ratify, adopt and approve the IntergovernmentalContract to participate in the Wisconsin County BondCommission, and

3. recognize that the county shall not become obligated toparticipate in any bond issue or become obligated on orwith respect to any bonds or to pay any of the expensesrelated thereto, except as expressly set forth in acontract executed by the County pursuant to s. 66.30,Wis. Stats., as amended from time to time, authorizing

the County's participation in the applicable bond issueand setting forth the County's obligations relatedthereto, and

designate the County Board Chair or his designee as theCounty's initial Representative (as that term isdefined in the Intergovernmental Contract) for allpurposes under the Intergovernmental Contract, providedthat the Representative shall have no power toauthorize any debt or other financial obligation onbehalf of the County without further action by theBoard of Supervisors of the County.

MANAGEMENT ORDINANCE

FORWARD

The intent of this ordinance is to require erosion control andstormwater management practices which will reduce the amount ofsediment and other pollutants leaving construction sites duringland development or land disturbance activities and shall applyto all saeft land disturbance activities occurring after theadoption of this Ordinance.

SECTION 59.974.01 AUTHORITY.

This land use Ordinance is adopted under authority under section59.974, wis. Stats. to fulfill the objectives of 144.266, wis.stats., and under the authority of 66.038, wis. Stats.

59.974.02 FINDINGS AND PURPOSE.

(1) FINDINGS. Walworth County finds runoff from constructionsites and other manmade changes of the land surface carry asignificant amount of sediment and other pollutants to the watersof this County and this state and have caused increased potentialfor flooding on adjacent lands.

(2) PURPOSE. ·It is the purpose of this land use Ordinance topreserve the natural resources; to protect the quality of the

waters of the County and the state; and to protect and promotethe health, safety and welfare of the people, to the extentpracticable by minimizing the amount of sediment and otherpollutants carried by runoff or discharged from constructionsites and other manmade changes to the land surface to lakes,streams, channels, ditches, ponds, wetlands, and other watercourses and by preventing flooding on adjacent lands.

59.974.03 APPLICABILITY OF ORDINANCE.

This Ordinance applies to land dia~tirBiB~ developing and landdisturbing activities on lands situated within the boundaries ofWalworth County in unincorporated areas, except those landdisturbances and land disturbing activities which fall under thescope and authority of the Walworth County One-and Two-FamilyDwelling erosion control ordinance and building sites outsideshoreland areas under other municipal enforcement of theWisconsin Uniform Dwelling Code (UDC).

59.974.04. DEFINITIONS.

(6) "Control Measure" means a practice or combination of. practices to control erosion, stormwater and attendantpollution•

.all "stormwater" means precipitation runoff, snow melt runoff,surface runoff and drainage.

illl "stormwater Basin" means artificially created holding pondor other catchment for the purposes of retaining ordetaining stormwater.

~ "Retention Basin" means a type of stormwater basin which hasno direct outlet and empties by infiltration to the naturalsoil surface and by evaporation (to retain all water).

1Z!l "Detention Basin" means a type of stormwater basin which hasa direct outlet and serves to reduce water velocities andvolumes by outletting at designated flow rates (totemporarily detain water).

5.59.974.06 MAINTENANCE OF CONTROL MEASURES.

All sedimentation basins and other control measures necessary tomeet the requirements of this Ordinance shall be maintained bythe applicant and his or her successors or assigns during thependency of the period of land disturbance and development of thesite in a satisfactory manner so as to ensure adequateperformance and to prevent the occurrence of nuisances. Allstormwater basins shall remain permanent and be maintained onsite to the extent necessary to meet the stormwater standards setforth by this land use Ordinance. Standards for maintenance of

1.1 AUTHORITY. Walworth County is adopting this ordinancepursuant to authority granted by wis. Stats. 59.07(51) and101.65.

(a) Purpose. The purpose of this ordinance is to exercisejurisdiction on the issue of construction site erosioncontrol by plan review, permitting and inspections topromote pUblic health, safety and welfare.

(b) Scope. This ordinance shall apply to all one- and two­family dwellings, except manufactured (mobile) homes,not in "shorelands" as defined by Sec. 59.971 wis.Stats., whose initial construction started afterDecember 1, 1992. This ordinance shall apply in anytown that has not adopted the Wisconsin UniformDwelling Code (UOC) and in the following townships:

1.2 ADOPTION. The Wisconsin Administrative Code Chapters ILHR20 through 25 are hereby adopted and by reference, made apart of this ordinance. Any future amendments and revisionsof the ODC are also made a part of this ordinance in theinterest of statewide uniformity. A copy of the UDC shallbe kept on file in the office of the Building Inspector.

1.3 ENFORCEMENT. Only the pertinent administrative andtechnical sections of the ODC related to erosion control(Chapter ILHR 20 - Administration and Enforcement and Sec.ILHR 21.125 - Technical Requirements) will be enforced as apart of this ordinance.

1.4 INSPECTOR. There is hereby created the position ofInspector to administer and enforce this Erosion ControlOrdinance.

(a) Oualification. The Inspector shall be certified by theState per § ILHR 26.06.

(b) Records. The inspector shall keep records of all planreview, permit and inspection activity for periodic DILHRreview. The Inspector shall make an annual report to theappointing authority.

1.5 PERMIT REQUIREMENT. No person shall cause soil to bedisturbed for construction within the scope of thisOrdinance without first obtaining a permit for that workfrom the Inspector.

1.6 PERMIT FEES. Building permit fees which defray the cost ofcode enforcement, shall be determined by resolution of theBoard, and posted by the Building Inspector.

1.7 VIOLATION AND PENALTIES. When the Inspector citesviolations with this Ordinance, they shall be promptlycorrected.

(a) Orders. The Inspector shall cite orders in writtenform. The Inspector may issue stop construction orderswhen soil disturbance occurs and erosion controlmeasures are not taken. In addition, a stopconstruction "Red Tag" order shall be posted at theconstruction site. The stopped construction may resumewhen the site complies with the rules and the Inspectorauthorizes the re-start.

(b) Penalties. Any person in violation with this Ordinanceshall, upon conviction, be SUbject to forfeiture of notless than $25 or more than $500 together with cost ofprosecution. Each day that such violation continueswill constitute a separate offense.

1.8 EFFECTIVE DATE. This Ordinance shall beeffective upon passage andpUblication as provided by law.

WHEREAS, there are insufficient appropriations for certain departmentsin the 1993 budget, adopted November, 1992; and

WHEREAS, it is necessary and warranted that additional appropriationsbe made from the General Fund for these specific areas, and

WHEREAS, various departments underspent their 1993 appropriations andsaid moneys should lapse back to the General Fund, and

WHEREAS, $21,320 appropriated for the Capital Project Manager was notrequired to be spent and unused funds should lapse to the General Fund, and

WHEREAS, these are unaudited figures,

NOW THEREFORE BE IT RESOLVED, that the amount of $ 485,552 beappropriated from the General Fund .and applied to the following accountsand that any audit findings requiring an appropriation be handled in asimilar manner.

RESOLUTION NO. 67-03/94

SUPPLEMENTAL APPROPRIATION FOR WINTER HIGHWAY MAINTENANCE

WHEREAS, there has been an above average number of eventsand amount of snowfall in 1994, and

WHEREAS, many of these winter weather events have come afternormal work hours and on weekends, and

WHEREAS, to maintain dependable and safe travel conditionson County Roads, the Walworth County Highway Department hasprovided necessary winter maintenance services, and

WHEREAS, through February 18, 1994, the cost of theseservices has exceeded $301,000, or 95% of the Department's 1994bUdget allocation for winter maintenance, and

WHEREAS, it has been the practice of Walworth County to fundany winter road maintenance shortfalls, should they occur, fromCounty general funds.

NOW, THEREFORE, BE IT RESOLVED that the Walworth CountyBoard of Supervisors hereby transfers $157,737 from theContingency Fund and $42,263 from the General Fund to the HighwayDepartment Winter Maintenance Fund to cover anticipated cost for1994, and

BE IT FURTHER RESOLVED that should there by any unused fundsavailable in the Winter Maintenance Fund from this transfer, thatthese funds shall be returned to County general funds.

The Clerk announced that a copy of an application that LSP­Whitewater, L.P. filed with the Public Service commission ofWisconsin, for authority to construct and place in service a newcombined-cycle cogeneration power plant, known as the WhitewaterCogeneration Facility, was on file ~n the County Clerk's Office.
