Procuring Cause?! What you don't know can cost you serious money. In the unique language of real estate, “Procuring Cause”, as defined by the National Association of Realtors, is “the uninterrupted series of causal events that leads to a successful transaction.” In plain English, it's the method to determine who rightfully deserves a real estate commission for bringing about a sale. What it means to the home buyer or seller is that a real estate sales person with little or no participation in a deal can claim a commission from either the buyer or seller or both.

The Federal Housing Adminstration wants Congressional authority to trans-fer an FHA-insured mortgage to another servicing shop whenever a loan poses a threat to FHA’s mutual mortgage insur-ance fund.The plan, which FHA Commissioner Carol Galante proposed in written testi-mony before the Senate Committee on Appropriations, comes with a few inher-ent risks – namely the risk that Ginnie Mae could be adversely impacted by sudden transfers of FHA-insured loans underlying Ginnie Mae securities, said

K&L Gates attorneys Laurence Platt and Kathryn M. Baugher, who issued a report on the proposal.The attorneys explained in a research note, “The risk of FHA forcing a transfer of servicing may dilute the value of the contract right to service, because the servicer may be forced into a distressed sale, particularly if the required time period for the transfer is short.”Yet, Galante proposed the plan on the grounds that a transfer should occur when a ser-vicer is either at or below a servicer-tier ranking score of III or when it’s necessary to pre-serve the mutual mortgage insurance fund.If either of those conditions are met, Galante would like the FHA to have an option of trans-ferring a loan from one servicer to a specialty servicer or the ability to require a servicer to enter into a sub-servicing arrangement with an entity designated by the FHA. Another option would be requiring a servicer to contract with a third-party to assist with loss mitiga-tion issues.The idea is to prevent the FHA from facing losses tied to poor servicing.Given the proposals potential impact on Ginnie Mae, K&L Gates suggested the plan should be considered carefully.“While a requirement to transfer servicing is a less drastic alternative than the loss of FHA approval from the perspective of an approved mortgagee, the inability to realize fair mar-ket value for the mortgage servicing rights in question could have a significant adverse effect on a servicer,” K&L attorneys wrote.“We would hope that any proposed legislation in this area would not authorize FHA to impair valuable mortgage servicing rights without, at a minimum, building in robust due process protections and standards of materiality or material adverse effect.”By Kerri Ann Panchuk, HousingWire

A selling agent is only entitled to compensation if he or she is the procuring cause of the sale, which promise arises from the offer of cooperation and compensation in the listing, which must be specified and may not be assumed. Also, note that you must be a member of the listing service to claim that offer of cooperation and compensation.

My experience has been that agents generally understand the notion of procuring cause, but they lose sight of that requirement when they take on a buyer who has already viewed and seen the property and now wants to be represented in the negotiation. Representation and compensation is not the same thing! The buyer has every right in the world to be represented by an agent at that point, and the agent has every right in the world to represent the buyer at that point, but neither has the right to make the seller (or, if you prefer, the listing agent) pay for that representation.

RPAC Update, Keith Canty, RPAC Chair What a great month. Let me give a very hearty thank you to Peggy Todd for setting up and co-ordinating our very successful RPAC phone bank. And grateful appreciation to the members of the Public Policy Committee and committed agents who gave their time Tuesday staffing the phone bank. You all made it happen.

Realtors® Call for Legislative Changes to New Rules Limiting Affordable Borrowing Options

Congress should consider redefining the new ability-to-repay requirements for Qualified Mortgages to avoid limiting affordable borrowing options for creditworthy buyers, said the National Association of Realtors® in testimony before the House Financial Services Committee.

NAR President Gary Thomas implored Congress to revisit the definition of fees and points applied to affiliated mortgage lenders that require the counting of title company charges, the amount of homeowner’s insurance held in escrow, loan level price adjust-ments, and payments made by lenders in wholesale transactions towards the 3 percent cap in the QM rule. Thomas said the current calculation of fees and points discriminates against affiliated title companies, small and mid-size lenders, community banks and cred-it unions.

“Many of the mortgages available from affiliated businesses might not qualify as a QM without a higher interest rate,” said Thomas, broker-owner of Evergreen Realty, in Villa Park, Calif. “As the leading advocate for housing issues, NAR is committed to working with Congress to fix the unintended consequences of the ability-to-repay rule. To that end, NAR supports the bipartisan H.R. 1077/S.949, the Consumer Mortgage Choice Act, which would address the problematic fees and points definition and ensure broad con-sumer choice and access to safe, affordable mortgages.”

In his testimony, Thomas said that H.R. 1077 is essential to maintain competition and consumer choice in mortgage origination. Without this legislation, one-quarter to as much as one-half of loans currently being originated by affiliated lenders would likely not be eligible for the QM safe harbor, he said. Consequently, those loans would likely not be made or would be concentrated amongst the largest retail lenders, thereby limiting con-sumer choice.

Thomas said another area of concern about QM underwriting standards is the 43 percent debt-to-income limit on jumbo and non-government backed loans. He said it is particular-ly problematic in high cost areas where high-income borrowers are more likely to obtain jumbo financing. Thomas urged support for greater flexibility with regard to DTI limits so that credit would not be restrained in high cost communities.

Thomas also urged Congress to support regulatory changes to the proposed Qualified Residential Mortgage standards to substantially mirror the broad QM definition. NAR be-lieves that this would prevent possible issues with creating another class of loans, such as those that are QM but not QRM, which could affect their overall marketability and cost.

“Congress and the Consumer Financial Protection Bureau have done important work to protect consumers from predatory lending products and processes that led to the mort-gage crisis,” said Thomas. “Now is the time for additional steps to improve the QM and align the QRM with it so that consumers who have the ability to repay their loans will have access to affordable credit.”

I am amazed, we are starting JULY! And with everything going on, I thought, I want to garden again. But it is very difficult when you don’t have the space or equipment. So I started doing research on container gardening. And Houselogic.com has SO much infor-mation that I was reading on what I need and how I can do it with a small space. And then I started reading about cleaning with an onion. YES, an onion! Here is one:Shine grills: Heat the grill, then spear a half onion with a fork and glide it over the grates to remove grease and charred bits of food.

That seems easy! And that is how we want many things in our life, EASY.

What is RPR and how can it help your business?

REALTORS® across the country are increasing their income by using RPR, the Realtors Property Resource in their business. RPR is available at no cost to you, as a member ben-efit of the NATIONAL ASSOCIATION OF REALTORS®. It allows you to enhance the service you provide to Buyers and Sellers by giving you key insights into the market, like the ability to search for and identify foreclosure and pre-foreclosure properties and provide in-depth neighborhood and school information.

You will first need to create your account. Some important things to note are: RPR is for REALTORS® only, meaning you must be an active member of NAR. There are a few ways to access RPR, but to get started; you need to go to www.narrpr.com.

And to make it even EASIER, I or Rich Benet, IT Director, will be doing training sessions at offices and here at the Board offices. It will be about 2 months before the REIN information is available but we want to make sure you are up and running when the data information is complete. VPAR wants to make sure we help you say, “That really was EASY”!

HamptonThe City is a busy place! In progress or soon to be in progress are the following is-sues that VPAR is following: • Update of the Downtown Master Plan • Preparation of a Master Plan for development of Armistead Point • Purchase of Clear Zone Properties at Langley Air Force BaseThe Association is meeting next month with Planning Department staff to discuss in detail these various issues.

Isle of Wight CountyThe County is reviewing its cash proffer policy for the purpose of analyzing the funding strategy to meet the demands for public facilities generated by new development. The study includes updated residential and commercial cash proffer amounts for the existing four (4) categories consisting of schools, parks and recreation, fire and rescue, and government buildings, and adds a new separate category for law en-forcement, and libraries (previously included in the government buildings category). The updated Study also includes separate analysis for potential transportation and utility cash proffer categories.

One of the potential outcomes is for the County to suspend collecting cash proffers for three years to allow the economy time to rebound. Proffer negotiations will not be suspended, but the collection of the proffers will be put on hold.

VPAR is working with the County Planning Director on the policy review and potential language. Much more to come on this important development-related issue.

PoquosonVPAR is continuing to work with the City on its marketing campaign. The Association has enlisted the help of REIN to assist with a data share such that the City’s real estate listings can be available on the City’s website. Sharing this information is perceived by all parties to be a win-win-win: win for the City, win for VPAR agents and win for buyers and sellers. Details will be forthcoming.

York CountyThe Planning Commission approved the draft Comprehensive Plan last month. As you know, VPAR has been very active in those discussions and will continue to provide input as the Plan goes to the Board of Supervisors. The Code of Virginia gives the Board of Supervisors 90 days to do take action or take the Plan back to the Commission, so we expect action toward the late summer or early fall.

STATEThe statewide ticket now is in place after the June Republican Convention and Democratic Primary. The ballot in November will look like this:

More locally, VPAR will conduct candidate interviews on September 10th for the members of the Penin-sula Delegation of the Virginia House of Delegates.

VPAR submitted its position statement regarding the Department of Professional and Occupation-al Regulation (DPOR) and the transfer of licenses. We have suggested that the Code of Virginia be amended to require DPOR to treat real estate license transfers such that at the time they are delivered to and accepted by the Department, the real estate licensee shall be allowed to practice real estate unless otherwise prohibited under VREB regulations (as in the case of felony convictions, for example). The Department should be required to notify the licensee of any issues, mistakes or other changes that are required at the time of receipt. The complete transfer of license shall occur within a reasonable period of time that allows the licensee to continue to practice.

FEDERALUpdate on Flood Insurance Rate IncreasesWith NAR’s support, Representatives Bill Cassidy (R-LA) and Maxine Waters (D-CA) have successfully attached an amendment to the Homeland Security Appropriations Bill to delay removal of “grandfathered” flood insurance rates for one year. NAR is now working with Senators Mary Landrieu (D-LA) and David Vitter (R-LA) to include the delay in the Senate version of the Homeland Security bill.

The grandfathered and other subsidized flood insurance rates are being phased out under the Biggert-Waters Act that extended the National Flood Insurance Program for five years. The House amendment would delay the phase-out for properties “grandfathered” under older rates in areas remapped into a higher-priced flood zone before September 30, 2014. The law’s other phase-outs -- for older second homes and business properties and for homes purchased after July 2012 – will continue to take effect on October 1, 2013. NAR is working on a longer delay and expanding it to include the other subsidy phase-outs, in addition to grandfathered properties.

NAR has produced a video that helps explain the changes to the NFIP and rate schedules. NAR Presi-dent Gary Thomas has created a Presidential Advisory Group on the NFIP to address the issues related to recent changes to the NFIP. NAR Applauds the SAVE ActOn June 6, 2013, Senators Bennet (D-CO) and Isakson (R-GA) introduced S. 1106, the “Sensible Ac-counting to Value Energy (SAVE) Act”. The bill is an attempt to develop standards for valuing energy efficiency in the appraisal and mortgage underwriting processes.

For over two years, NAR has worked with the staffs of the sponsoring Senate offices, the Institute for Market Transformation (IMT), and the Leading Builders of America to craft a bill that encourages the use of energy efficient products and materials in both new and existing homes. The Association was con-scious of the potential impact on older homes and worked vigorously to ensure that the proposed legisla-tion did not stigmatize or disadvantage them in any way.

NAR applauds the Senators continued efforts to ensure that housing is affordable, and to promote the use of energy efficient products and materials as a means keep housing costs reasonable.

In the meantime, the Senate Banking Committee has agreed to hold a hearing on the affordability of the Biggert-Waters rate provisions. The hearing is expected to be conducted in July. NAR will continue to work with our Congressional allies on the NFIP issue and will keep you informed on our progress.

I am Marion Clarke the Chair of the new Affiliates Committee. Affiliates are a crucial part of VPAR and your Association recognized this by establishing it. The Affiliate Committee’s purpose is to bring more value to our membership and strengthen connections with REALTORS® by strengthening our networking and visibility throughout the Assocation.

Using the expression of ‘stepping up to the plate’ was intentional because it makes me remember ten years ago when I joined the industry as an Affiliate. I wanted to participate in everything so I recog-nized the value of being involved. After joining the local Associations in our area, I eagerly looked for opportunities to learn more and take part in the various activities. One of the first networking events I participated in was a softball game. Yes, I said softball. It’s memorable to me because I was ‘all in’ with my new career, but I hadn’t played softball for years. That first game had me standing at the plate with two strikes and three balls! I wasn’t going down standing at the plate with the bat on my shoulder! The pitch came, and I had a base hit. I ran down the line to first, trying to beat the throw to tag me out. In running through the base, I fell, and fractured my wrist. It was a great fun with the traditional cookout following the game, and I didn’t want to miss out on that fun, either so I ignored the pain. I said little to the CEO for our Regional office that had traveled into town to work with me. Although he didn’t attend that afternoon’s game, driving him around the territory attempting to play down the injury was tough. I was no wimp, and I was sure I could endure. Four days later, I went to see a doctor and left with a cast! I still chuckle about that early memory.

Over the years the games and activities may change, but the fun and camaraderie stayed the same. I mentioned earlier that I retired and started what I call my ‘encore career’ with HMS Home Warranty. In 2003 I just completed a thirty year career in teaching that began as an elementary classroom teacher, and ended with me teaching in the middle school. Coming from background in education, I had a great deal to learn in my new position that connected me with the real estate industry. I had no idea how private industry operated, and I viewed it as an exciting new challenge. My membership to the Associations provided an avenue for me to not only learn about the industry, but to become a resource to serve the real estate community. Reading is fundamental in our lives, and it is a means to better communication with those we come into contact whether it’s our career and private life. I realized that early on so as time went on, I developed a couple of classes related to my industry. Many Affiliates have done likewise. Regardless of what aspect of the industry the Affiliates come from, we are a wealth of information and provide a rich background of resources for Realtors to draw on. Not only that, but as Affiliates, we have learned much from each other. It may come as no sur-prise, but we rely on each other and provide services as well. The Association brings us together to learn and assist each other regardless of our business. Through VPAR we focus on the same goal of doing business together and providing support for one another’s industry. Over the years, I have participated in a number of committees, to learn more and network with various people in the indus-try. It’s been very rewarding and interesting to me. I hope that by joining the Association, you make your next move to look for opportunities to become involved and find a Committee that interests you to take an active part. “Step up to the plate” as I did, and find how enriching and engaging it can be. Just don’t break your arm!

• Kiln Creek Golf Club & Resort : It was a beautiful day for the SOLD OUT 23rd Annual GolfKiln Creek Golf Club & Resort : It was a beautiful day for the SOLD OUT 23 Annual Golf Tournament sponsored by the VPAR Charitable Foundation. We had more golfers than we really should have had. Multiple hole sponsors on every hole.  And best of all, a lot of fun people on the course, playing and working the holes for their companies.

•• Yes it was a little warm and there was a threat of thunderstorms that afternoon but everybody 

played and had a good time.  Even when they stopped play for the fast approaching storm, the fun and camaraderie still carried on upstairs in the Kiln Creek Club house.  Kiln Creek Owner Dick Ashe, Director of Golf Mark Houston and their staff took care of us like we were at the Masters Golf Tournament in Augusta.

• Comments’ circling around the Peninsula community were that it was one of the best tournaments ever put on by the Association.  On top of that, it was a huge success financially.  We don’t have all 

the final numbers in yet, but the VPAR Charitable Foundation is looking to receive more than $15,000 from the tournament.  This money will help support local charities related to homelessness on the Peninsula. Charities such as Youth Challenge, LINK, Menchville House, HELP, Transitions, Natasha House, Operation Breakthrough 

• and the Hampton‐ Newport News Community Services Board have all received numerous donations over the years.

•• The VPAR Charitable Foundation would like to thank the golf committee, volunteers, players, 

sponsors, Kiln Creek Golf Club & Resort and VPAR for all the support everyone gave before, during and after this great event.  We are already planning next year’s tournament tentatively in May in 2014
