username which is their first name, last name. The temporary password Is "password". Once

logged on, you will be required to change your password which is only accessed by you. Also,

TOWN CENTER RULES AND REGULATIONS

The following Rules and Regulations have been adopted and will be administered by the

VillageWalk at Lake Nona Board of Directors. The Rules and Regulations may be changed at any time by the Board. It is the intent of the Board to limit these Rules and Regulations so that every member and their guests will obtain maximum use and enjoyment of the facilities.

Renting Rooms at the Town Center: The Card/Meeting Room and Ballroom at the Town Center

are available to rent for private parties or meetings. At least two week's notice is required for the scheduling of the rooms along with a deposit for the room. The Card Room shall not be

used for private meetings without reservations. Please check with the front desk as to scheduling, deposit requirements and the fee for the rentals of rooms, call (407) 888-2704 or email

[email protected] for further information.

Library/Computers: Books in the library are available to check out for free. Books can be

checked out at the Town Center desk. Computers in the library have a l hour time limit per resident, per day. Please see Town Center staff for valid exceptions.

Fitness Classes: Fitness classes are available to VillageWalk residents. Class descriptions and times can be found on the calendar and newsletter available via email or for pick-up at the

Town Center.

GENERAL RULES AND REGULATIONS

l) Age requirements - Children under the age of sixteen (16) may not be left unattended

at the Town Center. For other amenities, please refer to the specific activity for

information on age requirements. All age requirements will be strictly enforced. It is theduty and responsibility of the member to become familiar with these requirements andto cooperate in the enforcement thereof.

2) Dress code - Proper attire is to be worn at all times in accordance with acceptablepractice for the particular facility. Shirt and shoes must be worn at all times whiles in the

Town Center. Appropriate attire and footwear must be worn while in the Fitness Center.

3) The hours of operation may be adjusted seasonally as usage dictates.

4) Parents will be responsible for the conduct of their children at all times.

5) Homeowners will be responsible for the behavior of their guests at all times.

6) MEMBERS AND GUESTS using the facility are responsible for leaving it clean after its use.

7) The cost of replacing any property that is broken damaged or removed by a memberor guest it shall be charged to the member.

8) NO pets shall be permitted anywhere in the Town Center, the basketball court, in oraround the pool or on the common areas immediately adjacent to these facilities.

NOTE: Any activity or aggressive behavior by any guest that poses a threat to any other guest,

employee or management will be denied further access to the facilities. The key card pass will be deactivated. The Association will not tolerate this type of behavior nor will it allow guests or employees to be exposed to it. Any activity of this nature should be reported immediately to the front desk as soon as it occurs.

TOWN CENTER BUILDING USE

FITNESS CENTER:

Members and guest(s) use the Fitness Center at your own risk.

It is strongly recommended that you consult your physician prior to beginning any exercise program.

The operation hours are 24 hours per day, daily.

1. Age requirements: Children under sixteen (16) years of age are not permitted in theworkout room. Pets are not allowed under any circumstances.

2. Everyone using the Fitness Center is required to bring a towel to wipe the equipment afteruse.

3. Gym TVs have no volume and are intended for use with headphones. Please refer to thestation posted on corresponding TV for a guide to set your personal radio.

4. Tennis or soft-soled athletic shoes must be worn at all times in the Fitness Center.Bare-feet, sandals and flip flops are expressly prohibited.

POOL:

The operating hours are daily from 8am-8pm for the resort pool and 5am-8pm for the lap pool. 5

1 . Smoking is not tolerated in or around the Pools.

2. Age requirement: Children under the age of twelve (12) are NOT permitted at the poolunless under the direct supervision of their parents, guardian or an accompanying adult.

3. A shower must be taken prior to entering the pool.

4. All persons using the pool must have a towel.

5. TOWELS MAY NOT BE USED TO RESERVE CHAIRS.

6. No glass or smoking is allowed in the pool or anywhere around the pool area or the deck.

7. No running, pushing or bolstering play is permitted on the pool deck.

8. ALL radios, CD's, tape decks, etc., are required to have a set of headphones when listening

to audio programming.

9. Pets are not allowed on the pool deck or in the pool.

10. Persons with open sores, cuts or communicable diseases may not enter the pool.

11. Diapered age children MUST wear rubber pants and swim suits in the pool.

12. Food or drinks must be kept a minimum of 5 feet back from the pool edge.

13. Floats may only be used if not creating a nuisance for other bathers.

BASKETBALL COURT:

The operating hours are from Monday through Saturday 9am-9pm and Sundays 12pm-6pm. Courts are open to residents and their guest(s) only, for key please see Town Center front desk personnel. Lights will be accessible via a timer and can be set for one-hour intervals.

No food will be permitted on the courts. Courts are not to be used for any purpose other than to conduct a game of basketball. Pets are not allowed on courts under any circumstance.

Children: Parents will be responsible for their children's behavior at all times on the courts and will be responsible for any damages caused by their children. Children under thirteen (13) years of age must be accompanied by an adult at all times, unless participating in an organized program.

• Basketball Dress Code: Tennis shoes must be worn at all times. Black-soled shoes or jogging

shoes are not allowed.

• Men's attire shall consist of: tennis shorts, shirts and/or appropriate warm-up suits.

• Women's attire shall consist of: shorts, shirts or appropriate warm-up suits.

• Bathing suits are not allowed.

Court Reservations:

Reservations are not necessary as the basketball court is used on a first come first serve basis. Please be prepared to relinquish the court when others are waiting after one hour's play.

For safety and enjoyment of others, please no excessive noise, ball abuse or profanity.

TENNIS:

The operation hours are daily from 7:00am to 1 O:OOpm. Lights automatically shut off at 1 O:OOpm

Attire: Appropriate attire, courteous behavior and proper language are required on the courts at all times. Tennis shirts, blouses, tennis, shoes, skirts, and socks are acceptable and required wear. Unacceptable wear includes bathing suits, tanks tops, cut-off jeans, sandals, etc. Excessive yelling, noise, profanity, and racquet throwing will not be tolerated at any time. No pets, bicycles, rollerblades, skateboards, scooters etc. are permitted on the courts. Parking of bicycles on the walkway between courts is not allowed. All bicycles must be parked in the bicycle rack.

Court Clean: Court will be groomed and maintained by VillageWalk maintenance personnel daily but as a courtesy to others, courts MUST be swept after each use. Any problems with the courts surfaces, lines, nets, etc. should be reported to the Town Center Front Desk.

Children: Parents will be responsible for their children's behavior at all times on the courts and will be responsible for any damages caused by their children. Children under thirteen (13) years of age must be accompanied by and adult at all times, unless participating in an organized program or tennis lesson.

Activities: Any type of tennis activity (e.g. tournaments, special events, league play, parties, etc.) must be presented to the VillageWalk Activities Director.

Rules Infractions: Rules infractions should be reported in writing to the VillageWalk Office via Town Center Front Desk.

Dear Member:

Welcome to VillageWalk at Lake Nona! As a member of the VillageWalk Homeowner Association your monthly association dues cover the following services and amenities:

In order to maintain these services homeowner association dues are paid on a monthly basis: Fees collected after the 30th day are considered late payments. Late/administrative fee is equal to 5% of the installment. Interest is equal to 18% per annum of accrued balance or 1.5% per month. VillageWalk at Lake Nona prides itself in having crisp and uniform aesthetics throughout the community. In order to maintain this uniformity, the following are just a few reminders of how you can do your part as a member of the VillageWalk Homeowners Association:

•!• Please store trash containers out of sight. Trash containers can be put out no earlier than 5pm the evening before and must be removed no later than midnight the day of pick up.

•!• Please do not park vehicles on the street overnight or blocking the sidewalk. •!• Please change all backings of your window coverings to white. •!• Please curb and use a leash when walking your dog.

Our violation policy provides for a fine of $100 per violation per day not to exceed $1 ,000 in the aggregate. From date of the violation, unit owner has seven (7) days from date of fine. Residents are provided with one ( l) courtesy door knocker, one ( 1 ) mailed warning notice and a the fine is levied upon the third notice. We look forward in our joint efforts in upholding the high-quality standards of living here at VillageWalk at Lake Nona. Rules and Regulations for Pool Use

Hours of Operation: Resort Pool: Dawn to Dusk Lap Pool: Dawn to Dusk

Capacity: Resort Pool: 155 persons Lap Pool: 66 persons

1. The use of the pools are at your own risk. THERE IS NO LIFEGUARD AT THE POOL.2. If an emergency, injury or incident occurs at the VillageWalk Town Center, please call 911.3. Glass bottles and containers are not allowed in any area of the pool.4. No food, drink or glass will be allowed in the pool or on pool wet deck.5. Children at the pool: Children 15 and under are not permitted without an adult over the age

of 18. Members are reminded that parents are responsible for the behavior and safety of theirchildren. Neither the Homeowners Association of VillageWalk, the Management Companyand/or the Developer assumes or accepts responsibility for supervision of children.

6. Children must be supervised at all times by a responsible adult. Supervision requires that theresponsible adult is at all times within visual and auditory contact with the child. If any childrequires the use of a personal floatation device and cannot swim, a responsible person mustsupervise such child and always be within arm’s reach of the child.

7. A person having or apparently having an infectious and/or communicable disease, opensore, or wounds, will not be permitted in the pool. Body casts, pads, adhesive tape, Band-aidsor bandages of any type are not permitted in the pool. Do not use pool if you are ill withdiarrhea.

8. All persons must vacate pool areas during thunder, lightning, or any other potential storm.Electrical storms are very dangerous.

9. All persons must leave the pool and pool areas if maintenance and/or managementpersonnel request the area be temporarily vacated for cleaning or service.

10. The Association may suspend a Member and the Member’s family, guests and tenant fromuse of the Pool facility, if Member's Association Assessments (HOA dues) are not current.

11. Limitations on Use: The Pool may not be used to conduct any activity, program or otherevent for profit by any Members, business or other person.

12. Each member household is limited to no more than five (5) guests per visit. Guest(s) must beaccompanied by a Member in good standing. Members are responsible for their guest'sactions, including but not limited to, any damage to the pool. All guests must be accompaniedby their Member host at all times when using the pool.

13. Other than those organized by Management and/or the HOA, parties of any kind are strictlyprohibited.

14. All swimmers must shower before entering the pool.15. All swimmers must wear proper swimming attire. Children who are not toilet trained must

wear a clean diaper and tight fitting plastic pants or a swim diaper when in the pool.16. Diving into the Pool is prohibited at all times.

17. Running, boisterous and rough play, ball throwing, diving or other accident prone anddisruptive activities are not permitted and will be strictly enforced.

18. No rafts, inner-tubes, floats, or balls will be allowed in pool unless during a supervised HOAapproved recreational program. Water wings and water safety rings for non-swimmers arepermitted. Kickboards are to be used only for instruction and lap swimming or organizedlessons. Noodles will be permitted for floating purposes only and not as toys.

19. No foreign objects or substances (bubble bath, soap, beverages, etc.) are permitted in thepool. Water balloons, squirting toys and wheeled toys or vehicles are not allowed, includingwithout limitation, skateboards, scooters, rollerblades or bicycles.

20. No animals will be allowed in any area of the pool.21. The use of tobacco products on the enclosed pool area or any facilities and within a fifty (50)

foot perimeter of these is prohibited. This restriction also applies to electronic or “e-cigarettes.” Smoking will be permitted ONLY in the designated smoking areas.

22. Persons who appear intoxicated, under the influence of narcotics, or under the influence ofdrugs or medications that may impair their ability to use the pool safely are prohibited to usethe pool. Additionally, any person who is prohibited to be in these types of areas inaccordance with local, state, and federal laws will also be prohibited by these Rules andRegulations.

23. Community members are not to attempt to reserve chairs by leaving personal items on thechairs unattended for any longer than 15 minutes. Neither the Homeowners Association ofVillageWalk, the Management Company and/or the Developer assumes or acceptsresponsibility for any lost or stolen items. Management reserves the right to remove anyitems left unattended.

24. Swimmers may not hang on any safety equipment that may be installed.25. All other general Rules and Regulations apply and must be followed. Additionally, any

signage specific to the area of use must also be followed.

a member in the Village Walk at Lake Nona Homeowners Association, Inc. Because the Association is so important to the community and your personal investment, please take a moment to read the following Frequently Asked Questions about community living here at Village Walk at Lake Nona. The following is intended to be a helpful summary but is not intended to replace, amend or modify the contents of your Homeowner Documents. If there is any conflict between this summary and the Homeowner Documents, you should rely upon the contents of the Homeowner Documents and not this summary.

Q. Where can I send payments?A. Please send all payments to our secure bank deposit box: PO Box 66035, Phoenix, AZ 85082-6035. Checks should be made payable to Village Walk at Lake Nona HOA, Inc. As a reminder, pleasenote your account number on all checks to ensure proper credit to your account. You can also signup for automatic debit from your checking or savings account. To do so, please visit the Town CenterConcierge for a form.

Q. What is the Vil/ageWalk at Lake Nona Homeowner Association?A. The VillageWalk at Lake Nona Homeowners Association (HOA) is a private, nonprofit,corporation in which all VillageWalk unit owners are members and have certain rights andobligations, governed by a recorded set of governing documents and administered by a Board ofDirectors. Association business expenses are funded through the collection of regular Assessmentspaid by each member. The first HOA Board of Directors is appointed by Pulte (the "Developer") fromthe development team of professionals. The governing documents for VillageWalk at Lake Nonawere written by the Developer and are based on years of successful implementation in countlesscommunities. The VillageWalk at Lake Nona governing documents have been carefully adaptedto meet the specific needs of your community. (Article I, §6)

About Your Governing Documents: The VillageWalk at Lake Nona governing documents include three major instruments: the Declarations of Covenants, Conditions and Restrictions; the Articles of Incorporation; and the By­laws.

The Declarations of Covenants, Conditions and Restrictions establish formal regulations for the community, establish the rights and responsibilities of the individual unit owners and the Association,

establish standards for maintenance upkeep by both the Association and the homeowners, and define amendment requirement

The Articles of Incorporation (Articles) is the corporate charter filed with the State of Florida. The Articles establish the Association as a legal entity (a corporation) and defines membership and voting rights. The Articles establish the Board of Directors and officers of the Association. The Association may begin operations when its Articles are filed with the state.

The By-Laws establish the procedures for carrying out the responsibilities created in the Declaration and in the Articles. The By-Laws spell out how to run the day-to-day operations of the Association, describe how the Rules and Regulations are made and amended and includes quorum requirements.

Make sure you have received a copy of your HOA governing documents.

Q. How does your HOA work?

A. You and your neighbors will ultimately direct the management company to handle the day-to-day business of VillageWalk at Lake Nona through a member-elected Board of Directors. At thistime, your Developer-appointed Board of Directors makes operational decisions and hires theservice contractors. When the community reaches a certain occupancy level, a Board of Directorswill be elected from the Members. When the Developer steps down from the Board of Directors; theBoard must consist of not less than three and not more than five members, elected in accordancewith the Articles and By-laws. The Board of Directors will assume responsibility for operating andmaintaining the common areas, developing financial plans, assessing fees and enforcing thegoverning documents and architectural controls. Committees and hired professionals may assist theBoard in its duties. Some of the community services currently contracted at VillageWalk includegeneral management, gatehouse and access control, landscape maintenance, irrigationmaintenance, lake maintenance, cable TV and internet service (Article V, § 1 ).

Q. Who is our management company and what do they do?

A. Access Management, is an outside vendor who handles the daily operations of yourcommunity. Although the Board of Directors hires the service providers, Access arranges for theoperation and maintenance of the common facilities. In addition, Access prepares the budget,monitors the financial operations and receives and handles complaints, plans and organizes andkeeps records of meetings, plans for adequate insurance coverage, issues work orders and enforces

the community covenants. Copies of your budget and corporate records are available through theAccess offices. The Access offices for VillageWalk at Lake Nona are located at the Town Centerand have 24-hour emergency coverage.

Q. I hove moved in and have questions about my new home. What do I do?A. For issues regarding your home's structure, appliances or systems, refer to the New Ownerpackage provided by Pulte, or contact your customer relations manager.

Q. I hove questions about the landscaping schedule. Who do I call?

A. Access Management can assist you with landscape questions. The landscape company is

contracted to maintain your lawn and shrubs and to perform a certain number of cuts and trims peryear. The frequency will vary according to season and weather conditions. Village Walk is scheduledto have the turf mowed 38 times per year; the shrubs trimmed once a month and the beds cleanedonce a month. Mulch is scheduled for one application per year, generally in the fall and fertilizer isapplied quarterly. Because their contract outlines specific duties, the workers cannot toke directionfrom individual homeowners. Their job is to perform community-wide lawn care and not privategardening (Article VIII,§ 1 (c)).

Q. My plants appear to be dying; do I call the landscaper, HOA or Pulte?

A. Generally speaking, the lawn, shrubs and smaller trees are installed and maintained by thelandscape company. Call the Town Center HOA Office or landscaping company directly and awork order will be issued to the appropriate people. Work orders are assigned a number and logged.

Monthly work order reports are generated which show what work has been completed and what jobs are still pending (Article VIII,§ l (c)).

Q. My irrigation system isn't working. Who do I call?A. Contact the Town Center HOA Office. Routine "wet checks" are performed and irrigationschedules are frequently adjusted according to current conditions. Do not attempt to re-set theirrigation timer yourself as you may cause a failure of the irrigation system at some other point in thedistribution, or you could damage the equipment (Article VIII,§ l (c)).

Q. I want to change my landscape plants. Do I need approval for exterior work?

A. Any exterior changes require Architectural Review Committee ("ARC") approval prior tostarting the work. ARC applications and guidelines can be obtained by calling the Town CenterHOA Office. The ARC meets the third Friday of every month to review applications. A security depositis required upon approval of the application if you expect to do any installation or construction thatmight require heavy trucks enter the community (Article VIII,§ l (c); Article IX,§§ 7 & 16).

Q. Who do I contact for pest control?A. You are responsible for pest control within your home. The HOA provides for pest control forthe lawn and shrubs. The Village Walk at Lake Nona HOA does not treat for white-footed or carpenterants. You may call the Town Center HOA Office to report pests on your shrubs or lawn.

Q. The lakes have growth in them. How do I report this?A. Some lake vegetation is normal and healthy. As a matter of fact, it is desirable for about 30%of the lake surface to have a vegetative coverage. Certain lake plants, such as Chara, are actuallywater clarifiers and should be present. VillageWalk lakes are generally treated for excessive growthon a monthly basis, but the level of the lake maintenance will vary according to the season. Lakelevels also fluctuate throughout the year (Article IX, §28).

Q. Does the HOA provide for insurance?

A. The HOA will insure the Association property only; each homeowner is responsible to insuretheir own property (Article X). Please call the Town Center HOA Office for insurance contactinformation.

Q. I have a complaint against my neighbor. How is that reported?

A. You may contact the Town Center HOA Office in writing in cases of true violations. Thehomeowner will be contacted and asked to comply. Violations are logged and tracked. If theviolation continues and reasonable efforts for compliance have failed, legal measures may betaken. Any and all complaints are kept confidential.

Q. We need another gate pass, as my child will be home from college for the summer. How dol get one?A. As a homeowner, you can be issued up to four (4) barcodes per address, free of charge. Toget your barcodes, you will need to provide the Town Center HOA Office with copies of the operatorsdriver's license, current vehicle registration and insurance card. The vehicle must be present, as theConcierge will need to verify the vehicle and properly install the barcode(s) on your vehicle(s).Additional barcodes may be purchased for $15 each.

Q. I plan to lease my home. Do I need to inform the HOA? What if I decide to sell?

A. The HOA needs to be notified in either situation. You may want to work with a Realtor asVillage Walk prohibits any type of sign age visible from the street. If leasing, remember that your lesseeis legally bound to act according to the governing documents. You, as the homeowner, areultimately responsible for the payment of assessments and the behavior of your lessee. The lease

term cannot be less than six (6) months. You can get additional information by calling the Town Center HOA Office (Article IX,§§ 5 & 19).

Q. Could I have a quick summary of the rules and regulations?

A. The VillageWalk Use Restrictions are detailed on pages 44-55 of your Declaration. Some ofthe most common violations include: parking on the street, parking prohibited vehicles outside ofthe garage overnight, parking commercial vehicles overnight, posting For Rent or For Sale signs, dogsnot leashed, failing to clean up after your pet and storing furniture or other miscellaneous items onthe front porch area (Article 11, §12; Article IX, §41).

Q. I want to contribute to my community's success. How do I get involved?

A. As Village Walk continues to grow and new neighbors are moving in, AD-hoc Committees andAdvisory Boards will be formed to work with the Board on such items as financial records, associationdocuments, common element construction warranties, etc. Community-wide letters and notices willbe sent asking for committee volunteers and/or Board nominees. You can also contact the TownCenter HOA Office and ask that your name by placed on the list of future community leaders. If youdon't have the time or interest to serve in such capacity, you can contribute to Village Wal k's successby cooperating with the rules and regulations, paying your assessments on time, and voting in yourcommunity elections! (Article I, §35; Article V, §2).

Q. What if someone would like to visit and I do not want them to gain access to the community?

A. Call the Town Center HOA Office and place a block on your address or for any specificindividual(s). The gate attendant will call you before granting access to the community.

Resale Information Checklist

Should you choose to sell your home, please be sure to check your Governing Documents

and/or Design Guidelines regarding advertising and signs.

Some financial institutions may require paperwork to be completed by the management

company in connection with the sale of your home. Please note that if a Status of Account

Letter, Estoppel Status Letter, or Project Questionnaire is required by one of the lending

institutions handling the sale, then fees will be charged to process the paperwork. Monies that

are paid for Association assessments do not cover the fees to process legal documents or

permits of any kind. Since these charges cover the staff time involved to run the requested

specific reports and/or research detailed inquiries, as well as the legal liability involved with the

verification of all of the data, they are solely the responsibility of the Owner requesting the

particular service.

At the time of closing, please request that the title transfer affidavit or warranty deed be

faxed to VillageWalk at Lake Nona at (407) 888-2948 immediately. This removes your name as

the party responsible for payment of Association assessment, and gives the Association the

name of the new owner for billing/information purposes.

The following items (if applicable) should be turned over to the purchaser at the time of the

closing:

• Payment statements or coupon books for use in paying Association assessments.

Tenant Information

A copy of the fully executed lease must be submitted to the Association's Board of Directors, c/o Access Management, 8524 Insular Lane, Orlando, FL 32827. Scan and e-mail to [email protected] or fax to 407-888-2948.

The Association's role in lease transaction is stated in Article IX. Sections 5 and 19 of the declaration. Not less than 20 days prior to the effective date of any lease. the owner shall notify the Association in

writing of Owner's intention to lease their Home and furnish with such notification a copy of the lease. The Association should review the lease for compliance with the following requirements in the Declaration.

1. Must be lease of entire Home.2. Must be a term of at least six (6) consecutive months.3. Must provide that the lessee shall be subject in all respects to the terms and provisions of the

Declaration and that any failure by the lessee under such lease agreement to comply with suchterms and conditions shall be a material default and breach of the lease agreement.

4. Delinquent Owners. Notwithstanding the provisions above, in the event that an Owner isdelinquent in paying any assessment. or the Owner or his buyer, family, guests. agents, licenseesor invitees are not in compliance with any provision of the YillageWalk at Lake Nona Documents.the Association has the right to disapprove of and to void any lease at any time prior to or duringthe leasehold tenancy until any delinquent assessment is paid and/or until any violation ofVillageWalk at Lake Nona Documents is corrected.
