R156-17b-303b. Licensure - Pharmacist- Pharmacy Internship Standards.

In accordance with Subsection 58-17b-303(1) (g), the following standards are established for the pharmacy internship required for licensure as a pharmacist:

(1) For graduates of all U.S. pharmacy schools:

(a) At least 1,740 hours of practice supervised by a pharmacy preceptor shall be obtained in Utah or another state or territory of the United States, or a combination of both~ according to the Accreditation Council for Pharmacy Education (ACPE), Accreditation Standards and [Guidelines] Key Elements for the Professional Program in Pharmacy Leading to the Doctor of Pharmacy Degree_,_ [Guidelines Version 2.0] Effective July 1, 2016 ("Standards 2016") [February 14, 2011], which is hereby incorporated by reference.

(b) Introductory pharmacy practice experiences (IPPE) shall account for not less than 300 hours [over the first three professional years] .

(c) A minimum of 150 hours of IPPE shall be balanced between community pharmacy and institutional health­system settings.

(d) Advanced pharmacy practice experiences (APPE) shall follow successful completion of all IPPE, and shall include at least 1,440 hours (i.e., 36 weeks) during the last academic year [and after all IPPE requirements are completed] .

(e) Required experiences shall:

(i) include primary, acute, chronic, and preventive care among patients of all ages; and

(ii) develop pharmacist-delivered patient care competencies in the community pharmacy, hospital or health-system pharmacy, ambulatory care, inpatient/acute care, and general medicine settings.

(f) Internship hours completed in another state or territory of the United States shall be accepted based on the approval of the hours by the pharmacy board in the jurisdiction where the hours were obtained.

(g) Evidence of completed internship hours shall be documented to the Division by the pharmacy intern at the time application is made for a Utah pharmacist license.

(h) Pharmacy interns participating in internships may be credited no more than 50 hours per week of internship experience.

(i) No credit will be awarded for didactic experience.

(j) If a pharmacy intern is suspended or dismissed from an approved College of Pharmacy, the intern shall notify the Division within 15 days of the suspension or dismissal.

(k) If a pharmacy intern ceases to meet all requirements for intern licensure, the pharmacy intern shall surrender the pharmacy intern license to the Division within 60 days unless an extension is requested and granted by the Division in collaboration with the Board.

(2) For graduates of all foreign pharmacy schools, at least 1,440 hours of supervised pharmacy practice in the United States.

(3) Up to 500 hours towards the requirements of Subsections (1) (a) or (2) may be granted, at the discretion of the Division in collaboration with the Board, for other experience substantially related to the practice of pharmacy.

Rl56-17b-303c. Qualifications for Licensure - Examinations.

(1) In accordance with Subsection 58-17b-303(1) (h), the examinations that shall be successfully passed by an applicant for licensure as a pharmacist are:

(2) An individual who has failed either examination [t~viee]

three times shall meet with the Board to request an additional authorization to test. The Division, in collaboration with the Board, may require additional training as a condition for approval of an authorization to retest.

(3) In accordance with Subsection 58-17b-303(3) (j), an applicant applying by endorsement is required to pass the MPJE.

(4) In accordance with Subsection 58-17b- 305(1) (g), an applicant applying for licensure as a pharmacy technician shall pass the PTCB or ExCPT with a passing score as established by the certifying body. The certificate shall exhibit a valid date and that the certification is active.

(5) A graduate of a foreign pharmacy school shall obtain a passing score on the Foreign Pharmacy Graduate Examination Committee (FPGEC) examination.

R156-17b-304. Temporary Licensure. (1) In accordance with Subsection 58-1-303(1), the Division may issue a temporary pharmacist license to a person who meets all qualifications for licensure as a pharmacist in Utah except for the passing of the required e xamination, if the applicant:

(a) is a graduate of an ACPE accredited pharmacy school within two months immediately preceding application for licensure, enrolled in a pharmacy graduate residency or fellowship program, or licensed, in good standing, to practice pharmacy in another state or territory of the United States;

(b) submit a complete application for licensure as a pharmacist except the passing of the NAPLEX and MJPE examinations;

(c) submits evidence of having secured employment conditioned upon issuance of the temporary license, and the employment is under the direct, on-site supervision of a pharmacist with an active, non-temporary license that may or may not include a controlled substance license; and

(d) has registered to take the required licensure examinations.

(2) A temporary pharmacist license issued under Subsection (1) expires the earlier of:

(a) six months from the date of issuance;

(b) the date upon which the Division receives notice from the examination agency that the individual has failed either examination [t·.viee] three times; or

(c) the date upon which the Division issues the individual full licensure.

(3) An individual who has failed either e x amination [tvvice] three times shall meet with the Board to request an additional authorization to test. The Division, in collaboration with the Board, may require additional training as a condition for approval of an authorization to retest.

(4) A pharmacist temporary license issued in accordance with this section cannot be renewed, [er] but may be extended up to six months, as approved by the Division in collaboration with the Board.

(1) In accordance with Subsection 58-17b-303(1)(h), the examinations that shall be successfully passed by an applicant

for licensure as a pharmacist are:

(a) the NAPLEX with a passing score as established by NABP; and

(b) the Multistate Pharmacy Jurisprudence Examination (MPJE) with a minimum passing score as established by NABP.

(2) An individual who has failed either examination twice shall meet with the Board to request an additional

authorization to test. The Division, in collaboration with the Board, may require additional training as a condition for

approval of an authorization to retest.

(3) In accordance with Subsection 58-17b-303(3)(j), an applicant applying by endorsement is required to pass the MPJE.

(4) In accordance with Subsection 58-17b-305(1)(g), an applicant applying for licensure as a pharmacy technician shall

pass the PTCB or ExCPT with a passing score as established by the certifying body. The certificate shall exhibit a valid

date and that the certification is active.

(5) A graduate of a foreign pharmacy school shall obtain a passing score on the Foreign Pharmacy Graduate Examination Committee (FPGEC) examination.

R156-17b-303d. Qualifications for Licensure - Meet with the Board .

In accordance with Subsections S8-1-202{1)(d) and 58-1-301{3), an applicant for licensure under Title 58, Chapter 17b

may be required to meet with the Board of Pharmacy for the purpose of evaluating the applicant's qualifications for licensure.

R156-17b-308. Term, Expiration, Renewal, and Reinstatement of License [Cycle] - Application Procedures.

In accordance with Sections 58-1-308 and 58-17b-506:

(1) In accordance with Subsection 58 1 308(1), t]The renewal date for the two- y ear renewal cy cle applicable to licensees under Title 58, Chapter 17b is established [by rule] in Section R156-1-308a.

(2) Renewal and reinstatement procedures shall be in accordance with Sections R156-1-308[e]a through R156-1 - 308l, except as provided in Subsection (3).

(3) An applicant whose license was active and in good standing at the time of e xpiration may apply for reinstatement between two years and eight years after the date of expiration , in accordance with the following practice re-entry requirements:

(a) Each applicant shall: (i) submit a reinstatement application demonstrating

compliance with all r equirements and conditions of license renewal;

(ii) pay all license renewal and reinstatement fees for the current renewal period; and

(iii) comply with any additional licensure requirements or conditions considered necessary by the Division and Board to protect the public and ensure the applicant is currently competent to engage in the profession, which may include:

(A) a background check; (B) conditional licensure; (C) additional refresher or practice re - entry

program requirements; (D) passing licensure e x ams; or (E) additional supervised practice requirements.

(b) An applicant apply ing up to fi v e y ears after expiration shall also:

(i) submit evidence that the applicant has completed: (A) all continuing education for each preceding

renewal period in which the license was e xpired; or (B) an approved refresher or practice re-entry

program; and (ii) if requested, meet with the Boar d for evaluation

of the applicant's qualifications for licensure.

(c) An applicant apply ing more than five y ears but less than eight y ears after e xpiration shall also:

(i) submit evidence that the applicant has: (A) within [## years?] preceding the application ,

passed the examinations required for licensure under Section R156-17b-303c (NAPLEX and MPJE for a pharmacist, or PTCB or ExCPT for a pharmacy technician) ; or

(B) completed an approved refresher or practice re-entry program;

(ii) meet with the Board for evaluation of the applicant's qualifications for licensur e; and

(iii) (A) for a pharmacist, successfully practice under conditional licensure during a period of general supervision by a superv ising pharmacist, for a period equal to at least 40 hours of general supervision for each e xpired y ear; and

(B) for a pharmacy technician, successfully practice under conditional licensure during a period of direct supervision of a supervising pharmacist, for a period equal to at least 40 hours of direct supervision for each e xpired y ear.

(4) The Division may approv e e x tension of an (AR] intern license [may be extended] upon the request of the licensee~ [and­approval by the Division] under the following conditions:

(a) the intern applied to the Division for a pharmacist license and to sit for the NAPLEX and MJPE e x aminations within three calendar months after obtaining ful l certification from the Foreign Pharmacy Graduate Equivalency Commission; or

(b) the intern lacks the required number of internship hours for licensure.

f. R156-1-308g. Reinstatement of Licensure which was Active and in Good Standing at the Time of Expiration of Licensure­Requirements.

The following requirements shall apply to reinstatement of licensure which was active and in good standing at the time of expiration of licensure:

(1) In accordance with Subsection 58-1-308(5), if an application for reinstatement is received by the Division between

the date of the expiration of the license and 30 days after the date of the expiration of the license, the applicant shall :

(a) submit a completed renewal form as furnished by the Division demonstrating compliance with requirements and/or conditions of license renewal; and

(b) pay the established license renewal fee and a late fee .

(2) In accordance with Subsection 58-1-308(5), if an application for reinstatement is received by the Division between 31

days after the expiration of the license and two years after the date of the expiration of the license, the applicant shall :

(a) submit a completed renewal form as furn ished by the Division demonstrating compliance with requirements and/or conditions of license renewal; and

(b) pay the established license renewal fee and reinstatement fee .

(3) In accordance with Subsection 58-1-308(6)(a), if an application for reinstatement is received by the Division more

than two years after the date the license expired and the applicant has not been active in the licensed occupation or

profession while in the full-time employ of the United States government or under license to practice that occupation

or profession in any other state or territory of the United States during the time the license was expired, the applicant

shall:

(a) submit an application for licensure complete with all supporting documents as is required of an individual making

an initial application for license demonstrating the applicant meets all current qualifications for licensure;

(b) provide information requested by the Division and board to clearly demonstrate the applicant is currently

competent to engage in the occupation or profession for which reinstatement of licensure is requested; and

(c) pay the established license fee for a new applicant for licensure.

(4) In accordance with Subsection 58-1-308(6)(b), if an application for reinstatement is received by the Division more

than two years after the date the license expired but the applicant has been active in the licensed occupation or

profession while in the full-time employ of the United States government or under license to practice that occupation or

profession in any other state or territory of the United States shall :

(a) provide documentation that the applicant has continuously, since the expiration of the applicant's license in Utah,

been active in the licensed occupation or profession while in the full -time employ of the United States government or

under license to practice that occupation or profession in any other state or territory of the United States;

(b) provide documentation that the appl icant has completed or is in compliance with any renewal qualifications;

(c) provide documentation that the applicant 's application was submitted within six months after reestablishing domicile

within Utah or terminating full-time government service; and

(d) pay the established license renewal fee and the reinstatement fee .

58-17b-303. Qualifications for licensure as a pharmacist.

(1) An applicant for licensure as a pharmacist shall: (a) submit an application in a form prescribed by the division;

(b) pay a fee as determined by the department under Section 63J -1-504;

(c) produce satisfactory evidence of good moral character as it relates to the applicant's ability to practice pharmacy;

(d) complete a criminal background check and be free from criminal convictions as described in Section 58-1-501 ;

(e) have no physical or mental condition of a nature which prevents the applicant from engaging in the practice of pharmacy with reasonable skill, competency, and safety to the public;

(f) have graduated and received a professional entry degree from a school or college of pharmacy which is accredited by the Accreditation Council on Pharmacy Education;

(g) have completed an internship meeting standards established by division rule made in collaboration with the board; and

(h) have successfully passed examinations required by division rule made in collaboration with the board.

(2) An applicant for licensure as a pharmacist whose pharmacy education was completed at a foreign pharmacy school shall, in addition to the requirements under Subsections (l)(a) through (e), (g), and (h), obtain a certification of equivalency from a credentialing agency required by division rule made in collaboration with the board.

(3) An applicant for a license by endorsement as a pharmacist under this section shall: (a) submit a written application in the form prescribed by the division;

(b) pay the fee determined by the department under Section 631-1-504;

(c) be of good moral character as required of applicants for licensure as pharmacists under Subsection ( 1 );

(d) complete a criminal background check and be free from criminal convictions as described in Section 58-1-501 ;

(e) have no physical or mental condition of a nature which prevents the applicant from engaging in the practice of pharmacy with reasonable skill, competency, and safety to the public;

(f) have lawfully practiced as a licensed pharmacist a minimum of 2,000 hours in the four years immediately preceding the date of application;

(g) produce satisfactory evidence of completing the professional education required under Subsection (1);

(h) be currently licensed in good standing as a pharmacist in another state, territory, or possession of the United States;

(i) produce satisfactory evidence that the examination requirements are or were at the time the license was issued, equal to those of this state; and

(j) pass the jurisprudence examination prescribed by division rule made in collaboration with the board.

R156-17b-309. Continuing Education.

++±+J In accordance with Section 58-17b-310 and Subsect i ons 58-1-203(1) (g) and 58-1-308(3) (b), there is created a requirement for the continuing education (CE) requirements for renewal or reinstatement of a pharmacist or pharmacy technician license for each two-year renewal cycle commencing on September 30 of each odd­numbered year issued under Title 58, Chapter 17b. are established as follows:

(2) Requirements shall consist of the following number of qualified continuing education hours in each preceding renewal period. (a) 30 hours for a pharmacist, and (b) 20 hours for a pharmacy technician.

(1) A pharmacist shall complete at least 30 CE hours, which shall include at minimum:

(a) 12 hours of live or technology enabled participation lectures, seminars, or workshops;

(b) 15 hours of

(d) if providing immunization administration as defined in R156-17b-621, two hours in immunization or vaccine-related topics;

(e) if providing administration of long- acting injectable drug therapy as defined in Rl56-17b-62la, two hours in topics related to long-acting injectables; and

(f) if dispensing self-administered hormonal contraceptives as defined in Title 26, Chapter 64 and Rl56-17b-###, two hours in topics related to hormonal contraceptive therapy.

(2) (a) A pharmacy technician shall complete at least 20 CE hours, which shall include at minimum:

(i) six hours of live or technology enabled participation at lectures, seminars, or workshops; and

(ii) one hour of pharmacy law or ethics. (b) Documentation of a pharmacy technician's current PTCB or ExCPT

certification will count for all CE requirements , except the six live or technology enabled hours required by Subsection (2) (a) (i) .

(a) If a licensee first becomes licensed during the two-year renewal cycle, the licensee's required number of CE hours shall be decreased proportionately according to the date of licensure .

(?b?) A licensee who completes more than the required number of CE hours during a two-year renewal cycle may carry over up to ## hours of the excess to the next two-year renewal cycle; however, education received prior to a license being granted may not be carried forward.

(c) The Division may defer or waive CE requirements as provided in Section Rl56-l-308d.

(4) CE credit shall be recognized as follows [Qualified continuing professional education hours shall consist of the follm:ing] :

(a) One "live or technology enabled" CE credit hour for each hour of volunteer service on boards, committees, or in leadership roles in any state, national, or international organization for the development and improvement of the licensee's profession, up to a maximum of ## CE hours during each two-year period.

------~(b~) Two CE hours for each hour of lecturing or instructing a CE course or teaching in a college or university in the licensee's profession, up to a maximum of 10?? CE hours during each two -year period . The licensee must document the course's content and intended audience (e.g., pharmacists, physicians, nurses). Public service programs, such as presentations to school children or service clubs, are not eligible for CE credit. Licensees may receive credit for lecturing or instructing the same course up to two times.

(?c?) One CE hour for each hour of [direct or general?] supervision of an indiv idual completing the experience requirement for licensure in a classification under Title 58, Chapter 17b, up to a maximum of ## hours.

(d) All CE shall be approved by, conducted by, or under the sponsorship of one of the following: (a) for pharmacists.

(i) institutes, seminars, lectures, conferences, workshops, various forms of mediated instruction, and programmed learning courses, presented by an institution, individual, organization, association, corporation or agency that has been approved by ACPE;

(ii) programs approved by health-related continuing education approval organizations_,_provided the continuing education is nationally recognized by a healthcare accrediting agency and the education is related to the practice of pharmacy;

(iii) training or educational presentations offered by the Division; ([t±]iv) for pharmacists, programs of certification by qualified

individuals, such as certified diabetes educator credentials, board certification in advanced therapeutic disease management or other certification as approved by the Division in consultation with the Board; and [(iv) traiAiAg or educatioAal preseAtatioAs offered by the Divisio!'l (b) for pharmacy techAiciaAs: (i) iAstitutes, semiAars, lectures, coAfereAces, v;orkshops, various forms of mediated iAstructioA, aAd programmed learning courses, preseAted by aA iAstituti:m, iAdividual, orgaAi'latioA, associatioA, corporatioA or ageAcy that has beeR approved by AGP-&, (ii) programs approved by healthrelated coAtiAuiAg educatioA approval orgaAi'latioA~provided the coAtiAuiAg educatioA is AatioAally recogni2:ed by a healthcae accreditiAg ageAcy aAd the education is relatecko the practice of pharmacy;]

(v) for pharmacy technicians, educational meetings that meet ACPE continuing education criteria sponsored by the Utah Pharmacist Association, the Utah Society of Health-System Pharmacists_,_or other professional organization or association. [-;--atffi (iv) traiAiRg or educatioAal preseAtatioAs offered by the Division.

(5) A licensee shall maintain adequate documentation as proof of compliance with this section , for a period of four years after the end of the renewal cycle for which the CE is due, by:

(a) for a pharmacist, maintaining registration with the free NABP e-Profile CPE Monitor plan (or the optional NAPB CPE Monitor Plus plan); and

(b) for a pharmacy technician, and for a pharmacist seeking credit for a non-ACPE program who has not registered with the CPE Monitor Plus plan, maintaining the following documentation:

(A) name of attendee; (B) name of course provider ; (C) name of instructor; (D) date of course (E) title of course; (F) number of CE hours; (G) course objectives; and (H) type of CE (i.e , seminar, real-time interactive distance learning, teaching , etc.) .
