Purpose This series of stakeholder consultation webinars is aimed to:

Gather input from state and local workforce leaders and practitioners, workforce system partners, customers, and other stakeholders on key implementation topics;

Inform development of regulations; and

Inform technical assistance strategies to support implementation.

Please note that ETA is also planning to conduct a series of Town Halls this Fall to gather input from the field, and that you are always welcome to send comments and questions to [email protected]

Our Federal Partners (ED and HHS) are also collecting input, and we are working closely together on implementing the new legislation.

Overview of the Workforce Innovation and Opportunity Act

President Barack Obama signed WIOA into law on July 22, 2014.

Passed by Congress with wide bipartisan majority (The Senate voted 93-5 and the House of Representatives voted 415-6).

Reaffirms ongoing role of American Job Centers.

Promotes program coordination and alignment of key employment, education, and training programs at the Federal, State, local, and regional levels.

Builds on proven practices such as sector strategies, career pathways, regional economic approaches, work-based training.

Complements and supports the President’s Job-Driven Workforce Vision.

Programs under the Workforce Innovation and Opportunity Act Supersedes the Workforce Investment Act of 1998 and retains and

amends the Adult Education and Family Literacy Act, the Wagner-Peyser Act, and the Rehabilitation Act of 1973.

Identifies “core programs”:

– Adults, Dislocated Workers, and Youth formula programs and Wagner-Peyser employment services administered by the Department of Labor; and

– Adult education and literacy programs and Vocational Rehabilitation state grant programs that assist individuals with disabilities in obtaining employment administered by the Department of Education.

Authorizes the Job Corps, YouthBuild, Indian and Native Americans, and Migrant and Seasonal Farmworker programs, and evaluation and research activities conducted by DOL.

Highlights of Reforms to the Public Workforce System under the Act Requires states to strategically align workforce development

programs to support job seekers and employers.

Promotes accountability and transparency of programs.

Fosters regional collaboration to meet the needs of regional economies.

Streamlines and strengthens the strategic roles of workforce development boards.

Enhances services provided to job seekers and employers through the American Job Center system.

Improves services to employers and promotes work-based training.

WIOA ensures that Federal investments in employment and training programs are evidence-based and data-driven, and accountable to participants and tax-payers.

The WIOA core programs include:

– Adult

– Dislocated Worker

– Youth

– Wagner-Peyser

– Adult Education

– Vocational Rehabilitation

Provisions Related to Performance Accountability Core programs and other authorized programs are required to

report on common performance indicators:

– Percentage of workers that entered employment

– Percentage of workers that retained employment

–Median wages of these workers

– Credential attainment of these workers

–Measurable skill gains of these workers.

– Effectiveness of services to employers.

Eligible training providers are required to provide data on performance outcomes for all students in a training program.

Provisions Related to Performance Accountability The Departments of Education and Labor, with input from stakeholders,

will establish a common performance accountability system for core programs, including common reporting templates.

Both negotiated levels of performance for common indicators and performance outcomes will be adjusted based on a statistical model that takes into account economic conditions and participant characteristics.

Performance reports for states, local areas, and eligible training providers will be made publicly available.

States will be sanctioned 5 percent (from Governor’s Reserve) for performance failure or failure to submit performance reports.

States will conduct evaluation of programs based on performance results.

Discussion Questions 1. WIOA increases accountability and information for job seekers,

employers, and the public. What opportunities and challenges do the provisions of section 116 on performance accountability present for states and local areas?

2. What technical assistance will be most useful to states and local areas

to prepare for successful implementation of common performance measures? And for new state and local performance reports?

3. What ideas do you have for the Department to consider in developing

regulations or guidance on accountability and transparency?

4. WIOA allows the Departments of Labor and Education to determine “exceptional circumstances” that might mitigate the application of a sanction for poor performance; what input might you have to identify such circumstances?

5. What should we take into consideration in defining performance failure?

6. WIOA includes several new performance measures and we would like to get your input on how we might define them, including: o Skills gain, o Effectiveness of serving employers, o Costs for training, and o Costs of career services.

Discussion Questions 7. WIOA makes available data on training providers’ performance

outcomes, based upon new reporting requirements for the Eligible Training Provider List. In the dialogue box below, please share your thoughts about the following: o What challenges do you anticipate to making such data available? What should

DOL consider in developing guidance for states and local areas? o Have states developed similar consumer information or “scorecards” that may

provide examples or models that can be shared? o What technical assistance will be useful for smaller training providers to be able to

comply with these new reporting requirements?

o Will States use WRIS for the Eligible Training Provider performance reports?
