PERSONAL PROTECTIVE EQUIPMENT (PPE)Some materials that are chemical-resistant to this product are listed below. For more options, follow the instructions for Category H on the chemical-resistance category selection chart. PPE constructed of Saranex, neoprene, and chlorinated polyethylene provide short-term contact or splash protection against liquid in this product. Longer-term protection is provided by PPE constructed of Viton, Teflon, and EVAL barrier laminates (for example, responder suits manufactured by Life-Guard or Silvershield gloves manufactured by North). Where chemical-resistant materials are required, leather, canvas, or cotton materials offer no protection from this product and must not be worn as the sole article of protection when contact with this product is possible.

When performing tasks with NO potential for contact with liquid fumigant, all handlers (including applicators) must:• Wear long-sleeved shirt, long pants, shoes and socks.• Not wear jewelry, goggles, tight clothing, chemical-resistant gloves, rubber protective

clothing, or rubber boots when handling. Methyl bromide can be trapped inside clothing and cause skin injury.

Handlers with no potential for contact with liquid fumigant (e.g. shovelers) may wear cotton, leather, or other porous, non-chemical-resistant gloves. If such gloves are exposed to liquid fumigant, they must immediately be removed and discarded.

When performing tasks with potential for contact with liquid fumigant, all handlers (including applicators) must wear:• Long-sleeved shirt and long pants,• Chemical-resistant gloves,• Chemical-resistant apron,• Protective eyewear (Do NOT wear goggles), and• Chemical-resistant footwear with socks.

In addition, when an air-purifying respirator is required under this label’s Directions for Use, Protection for Handlers, Respiratory Protection and Stop Work Triggers section, handlers (including applicators) must wear:• A NIOSH-certified full-facepiece air-purifying respirator with cartridges certified by the

manufacturer for protection from exposure to methyl bromide at concentrations up to 5 ppm (e.g., a 3M air-purifying respirator equipped with 3M Model 60928 Organic Vapor/Acid Gas/P100 cartridges).

IMPORTANT: A self-contained breathing apparatus (SCBA) is not permitted for routine handler tasks. If responding to an emergency when corrective action is needed to reduce air concentrations to acceptable levels, wear an SCBA. Escape-only SCBA respirators must not be used by handlers for responding to emergencies. In addition wear PPE required for potential contact with liquid fumigant.

Pre-Plant Soil Fumigant

Early symptoms of overexposure to methyl bromide are dizziness, headache, nausea and vomiting, weakness, and collapse. Lung edema may develop in 2 to 48 hours after exposure, accompanied by cardiac irregularities; these effects are the usual cause of death. Repeated overexposures can result in blurred vision, staggering gait, and mental imbalance, with probable recovery after a period of no exposure. Blood bromide levels suggest the occurrence, but not the degree, of exposure. Treatment is symptomatic.

USER SAFETY REQUIREMENTSFollow manufacturer’s instructions forcleaning/maintaining PPE. If no suchinstructions for washables exist, usedetergent and hot water. Keep and washPPE separately from other laundry.Discard clothing and other absorbentmaterials that have been drenched orheavily contaminated with this product’sconcentrate. Do not reuse them.

USER SAFETYRECOMMENDATIONS

Users should:• Wash hands before eating, drinking,

chewing gum, using tobacco, or using thetoilet.

• Remove clothing/PPE immediately ifpesticide gets inside. Then wash thoroughlyand put on clean clothing.

• Remove PPE immediately after handlingthis product. Wash the outside of glovesbefore removing. As soon as possible, washthoroughly and change into clean clothing.

ENVIRONMENTAL HAZARDSThis pesticide is toxic to mammals and birds.Do not apply directly to water, or to areas wheresurface water is present or to intertidal areasbelow the mean high water mark. Do notcontaminate water when disposing ofequipment washwaters or rinsate.

PHYSICAL ORCHEMICAL HAZARDS

Do not use containers or application equipmentmade of magnesium, aluminum, or their alloys,as under certain conditions this fumigant may beseverely corrosive to such metals. [See theCalibration, Set-up, Repair and Maintenance forApplication Rigs section of this labeling for furtherrequirements for application equipment.] Do notpermit water to be used to clean the fumigantpressure system, as corrosion will result. Dieseloil is satisfactory for this purpose.

This Standardcontains requirements for the protection ofagricultural workers on farms, forests,nurseries, and greenhouses, and handlersof agricultural pesticides. It containsrequirements for training, decontamination,notification, and emergency assistance. Therequirements in this box only apply to usesof this product that are covered by the WorkerProtection Standard (WPS). Noinstructions elsewhere on this labelingrelieve users from complying with therequirements of the WPS.

Terms Used in This LabelingSoil Fumigant Training Program: Certif iedapplicator training that provides information on (1)how to correctly apply the fumigant, including howto comply with new label requirements; (2) howto protect handlers and bystanders; (3) how todetermine buffer zone distances; (4) how tocomplete an FMP and the post-applicationsummary; (5) how to determine when weather andother site-specific factors are not favorable forfumigant application; (6) how to comply withrequired GAPs and how to document compliancewith GAPs in the FMP; and (7) how to developand implement emergency response plans.Fumigant Safe Handling Information: Informationthat must be provided annually to handlers mustinclude the following: (1) what fumigants are andhow they work, (2) safe application and handlingof soil fumigants, (3) air monitoring and respiratoryprotection requirements for handlers, (4) earlysigns and symptoms of exposure, (5) appropriatesteps to take to mitigate exposures, (6) what todo in case of an emergency, and (7) how to reportincidents.Application Block: Area within the perimeter of thefumigated portion of a field (including furrows,irrigation ditches, roadways). The perimeter of theapplication block is the border that connects theoutermost edges of total area treated with thefumigant product.Application Rate: The ratio of fumigant massapplied compared to the soil surface area (e.g.,pounds of product per acre). The application rateis expressed on this labeling in terms of eitherthe “treated area application rate” or the“broadcast equivalent application rate.” The“treated area application rate” relates to only therate of fumigant applied to the portion of the fieldthat is fumigated (e.g., rate within the bed orstrips). The “broadcast equivalent application rate”relates to the rate of fumigant applied within theentire perimeter of the application block. Forbedded and strip applications, the “broadcastequivalent application rate” must be calculated todetermine the buffer zone distance required bythis labeling.Start of the Application: The time at which thefumigant is first delivered/dispensed into the soilin the application block.Application is Complete: The time at which thefumigant has stopped being delivered/dispensedinto the soil and the soil has been sealed; driplines have been purged (if applicable).Entry Restricted Period: This period begins at thestart of the application and expires depending onthe application method and if tarps are used whenthe tarps are perforated and removed. Entry intothe application block during this period is onlyallowed for appropriately PPE-equipped handlersperforming handling tasks. See the EntryRestricted Period and Notification section foradditional information.

Methyl bromide and chloropicrin have certainproperties and characteristics in common withchemicals that have been detected ingroundwater (methyl bromide and chloropicrinare highly soluble in water and have lowadsorption to soil).For untarped applications of methyl bromideand chloropicrin, leaching and runoff may occurif there is heavy rainfall after soil fumigation.

Application Restrictions• The use of this product is restricted to the

methods described in this label.• This product may only be used for the following:

o Crops/uses at locations that at the time ofthe application qualify for exemptions underthe Montreal Protocol as identified in Table1 [Maximum Application Rates for Crops withCritical Use Exemptions (CUEs)] of thislabeling, or

o Crops/uses identified in Table 2 [MaximumApplication Rates for Quarantine Uses] ofthis labeling, or

o Crop/uses identified in Table 3 [MaximumApplication Rates for Crops without CriticalUse Exemptions (CUEs)] of this labeling.

• Tarps must be used for all applications, exceptfor deep shank orchard replant [California only]applications.

Product InformationSoil-borne pests controlled include wireworms andnematodes, weed and grass seeds, Granville Wilt,Black Shank, and other diseases caused bycertain species of Rhizoctonia, Pythium,Fusarium, and Phytophthora.

Use Precautions• Comply with all local regulations and

ordinances. Obtain an application permit fromAgricultural Regulatory Agencies as required.

• Users should handle this fumigant in the open,with the operator ‘upwind’ from the containerwhere there is good ventilation.

• When fumigating soil from a tractor, 5 gallonsof water must be carried on the tractor andplaced where it is readily accessible. In additionto water available on the tractor, at least 5gallons additional water must be available fromthe service truck. This water must be potableand in containers marked “Decontaminationwater not to be used for drinking”.

• Keep pets, livestock, and other domesticanimals out of the treated area duringapplication and during tarp perforation and/orremoval, if a tarp is used.

• Fumigation may temporarily raise the level ofammonia nitrogen and soluble salts in the soil.This is most likely to occur when heavy ratesof fertilizer and fumigant are applied to soilsthat are either cold, wet, acid, or high in organicmatter. To avoid injury to plant roots, fertilizeas indicated by soil tests made after fumigation.To avoid ammonia injury and/or nitratestarvation to crops, avoid using fertilizerscontaining ammonia salts and use onlyfertilizers containing nitrates until after the cropis well established and the soil temperature isabout 65º F. Liming highly acid soils beforefumigation stimulates nitrification and reducesthe possibility of ammonia toxicity.

Certified Applicator TrainingAny certified applicator supervising a soil fumigantapplication must have successfully completed oneof the soil fumigant training programs listed onthe following EPA website www.epa.gov/fumiganttraining for the active ingredient(s) in thisproduct. The training must be completed in thetime frames listed on the website. The FMP mustdocument the date and location where the soilfumigant training program was completed.

HandlersThe following activities are prohibited from beingperformed by anyone other than persons whohave been appropriately trained and equipped ashandlers in accordance with the requirements inWPS (40 CFR Part 170):• Monitoring fumigant air concentrations;• Cleaning up fumigant spills (this does not

include emergency personnel not associatedwith the application);

• Handling or disposing of fumigant containers;• Cleaning, handling, adjusting, or repairing the

parts of application equipment that may containfumigant residues; and

• Performing any handling tasks as defined bythe WPS (40 CFR 170).

The following activities are prohibited from beingperformed in the application block from the startof the application until the entry restricted periodends and in the buffer zone during the buffer zoneperiod by anyone other than persons who havebeen appropriately trained and equipped ashandlers in accordance with the requirements inWPS (40 CFR Part 170). (NOTE: personsrepairing and monitoring tarps are consideredhandlers for the duration listed below). Prohibitedactivities (except for trained and equippedhandlers) include:• Participating in the application as supervisors,

loaders, drivers, tractor co-pilots, shovelers,cross ditchers, or as other direct applicationparticipants;

• Installing, repairing, operating, or removingirrigation equipment;

• Performing scouting, crop advising, ormonitoring tasks;

• Installing, perforating (cutting, punching, slicing,poking), or removing tarps; and

• Repairing or monitoring tarps until 14 days afterapplication is complete if tarps are notperforated and removed during those 14 days.

Buffer Zone: An area established around theperimeter of each application block. The bufferzone must extend outward from the edge of theapplication block perimeter equally in alldirections.Buffer Zone Period: Begins at the start of theapplication and lasts for a minimum of 48-hours afterthe application is complete. Non-handlers must beexcluded from the buffer zone during the buffer zoneperiod.Difficult to Evacuate Sites: Pre-K to Grade 12schools, state licensed daycare centers, nursinghomes, assisted living facilities, hospitals, in-patientclinics, and prisons.Owner: Any person who has a present possessoryinterest (fee, leasehold, rental, or other) in anagricultural establishment. A person who has bothleased such agricultural establishment to anotherperson and granted that same person the right andfull authority to manage and govern the use of suchagricultural establishment is not an owner. Seedefinition of “owner” in WPS (40 CFR §170.3).Roadway: Portion of a street or highway improved,designed or ordinarily used for vehicular travel,exclusive of the sidewalk or shoulder even if suchsidewalk or shoulder is used by persons ridingbicycles. In the event a highway includes two or moreseparated roadways, the term roadway shall referto any such roadway separately.Representative Handling Task: For air monitoring,the locations and handler activities sampled mustrepresent each handler’s exposure occurringwithin the application block. For example, for anapplication consisting of a seven-handler crew (1tractor driver, 1 tractor co-pilot, 4 shovelers, and1 certified applicator supervising) two breathingzone samples could be collected: one sample forthe tractor co-pilot and one sample for a downwindshoveler. Results of previous sampling mayindicate which tasks and locations are worst caseand therefore representative of all handlers.

responsible for carrying out those activities theinformation necessary to comply with the labeland procedures described in the FMP (e.g.,emergency response plans and procedures).

IMPORTANT: This requirement does not overridethe requirements in the Worker ProtectionStandard for Agricultural Pesticides for informationexchange between operators of agriculturalestablishments and commercial pesticideapplicators.

The certified applicator must provide FumigantSafe Handling Information to each handler orconfirm that within the past 12 months, eachhandler has received Fumigant Safe HandlingInformation in a manner that he/she canunderstand. Fumigant Safe HandlingInformation will be provided where this productis purchased or at www.epa.gov/fumiganttraining.

For all handling tasks at least two handlers mustbe present.

Exception: After the application is complete,only one trained handler is required toperform fumigant site monitoring tasksoutside of the buffer zone.

Exclusion of Non Handlers from theApplication Block and Buffer Zone:The certified applicator supervising the applicationand the owner of the establishment where theapplication is taking place must make sure thatall persons who are not trained and PPE-equippedand who are not performing one of the handlingtasks as stated in this labeling are:• excluded from the application block during the

entry restricted period, and• excluded from the buffer zone during the buffer

zone period (see buffer zone exemption fortransit on roadways in Buffer ZoneRequirements section).

Protection for HandlersSupervision of Handlers:For all applications, from the start of theapplication until the application is complete, acertified applicator must be at the application blockin the line of sight of the application and mustdirectly supervise all persons performing handlingactivities.

For handling activities that take place after theapplication is complete until the entry restrictedperiod expires, the certified applicator is notrequired to be on-site, but must havecommunicated in a manner that can beunderstood by the site owner and handlers

Providing, Cleaning, and Maintaining PPE:The employer of any handler (as stated in thislabel) must make sure that all handlers areprovided and correctly wear the required PPE.The PPE must be cleaned and maintained asrequired by the Worker Protection Standard forAgricultural Pesticides.

NOTE: see Tarp Perforation and/or Removalsection on this labeling for requirements aboutwhen tarps are allowed to be perforated.

Handlers do not include local, state, or federalofficials performing inspection, sampling, or othersimilar official duties.

• The maximum application block sizes allowedare:o 100 acres for tarped bedded and broadcast

applicationso 40 acres for untarped deep applications (i.e.,

California orchard replant)

Local, state, or federal officials performinginspection, sampling, or other similar official dutiesare not excluded from the application block or thebuffer zone by this labeling. The certif iedapplicator supervising the application and theowner of the establishment where the applicationis taking place are not authorized to, orresponsible for, excluding those officials from theapplication block or the buffer zone.

Respirator Fit Testing, Medical Qualification,and Training:Using a program that conforms to OSHA’srequirements (see 29 CFR Part 1910.134),employers must verify that any handler who usesa respirator is:• Fit-tested and fit-checked,• Trained, and• Examined by a qualified medical practitioner

to ensure physical ability to safely wear the styleof respirator to be worn. A qualified medicalpractitioner is a physician or other licensedhealth care professional who will evaluate theability of a worker to wear a respirator. The initialevaluation consists of a questionnaire that asksabout medical conditions (such as a heartcondition) that would be problematic forrespirator use. If concerns are identified, thenadditional evaluations, such as a physicalexam, might be necessary. The initial evaluationmust be done before respirator use begins.Handlers must be reexamined by a qualifiedmedical practitioner if their health status orrespirator style or use-conditions change.

• Upon request by local/state/federal/tribalenforcement personnel, employers mustprovide documentation demonstrating how theyhave complied with these requirements.

• When using monitoring devices to monitor airconcentration levels, a direct read detectiondevice, such as an electronic device or acolorimetric device (e.g., Matheson-Kitagawa,Draeger, or Sensidyne) must be used. Thedevices must have sensitivity of at least 1 ppmfor methyl bromide and 0.15 ppm forchloropicrin. Persons using direct readdetection devices must follow themanufacturer’s directions.

• When breathing zone samples are required,they must be taken outside respiratoryprotection equipment and within a 10 inchradius of the handler’s nose and mouth.

• When full-facepiece air-purifying respirators areworn, air monitoring samples must be collectedat least every 2 hours in the breathing zone ofa handler performing a representative handlingtask.

• If at any time: (1) a handler experiencessensory irritation when wearing a full-facepieceair-purifying respirator, or (2) a methyl bromideair sample is greater than 5 ppm or achloropicrin air sample is greater than or equalto 1.5 ppm, then all handler activities mustcease and handlers must be removed from theapplication block and surrounding buffer zone.

• Handlers can resume work activities withoutfull-facepiece air-purifying respirators if twoconsecutive breathing zone samples taken atthe handling site at least 15 minutes apart showlevels of methyl bromide have decreased to lessthan 1 ppm and levels of chloropicrin havedecreased to less than 0.15 ppm, provided thathandlers do not experience sensory irritation.During the collection of air samples a full-facepiece air-purifying respirator must be wornby the handler taking the air samples. Samplesmust be taken at the location where: (1) theirritation was first experienced, or (2) where thesample(s) were greater than 5 ppm for methylbromide or, (3) where sample(s) were greaterthan or equal to 1.5 ppm for chloropicrin.

• Handlers can resume work activities if all ofthe following conditions exist provided a full-facepiece air-purifying respirator is worn:o two consecutive breathing zone samples for

methyl bromide taken at the handling site atleast 15 minutes apart each must be lessthan or equal to 5 ppm.

Air Purifying Respirator Availability:The employer of any handler must confirm thatan air-purifying respirator and appropriatecartridges of the type specified in the PPE sectionof this labeling are immediately available for eachhandler who will wear one. At a minimum twohandlers must have the appropriate air-purifyingrespirator and cartridges available (see RespiratorFit Testing, Medical Qualification, and Trainingsection for additional requirements).

Exception: Air-purifying respirators do notneed to be made available for handlersperforming fumigant site monitoring tasksoutside of the buffer zone.

• Handlers can remove full-facepiece air-purifyingrespirators or resume operations if twoconsecutive breathing zone samples taken atthe handling site at least 15 minutes apart showthat levels of methyl bromide have decreasedto less than 1 ppm and levels of chloropicrinhave decreased to less than 0.15 ppm, providedthat handlers do not experience sensoryirritation. During the collection of air samples,a full-facepiece air-purifying respirator must beworn by the handler taking the air samples.Samples must be taken at the location wherethe irritation was first experienced.

Respiratory Protection and Stop WorkTriggers:The following procedures must be followed todetermine whether a full-facepiece air-purifyingrespirator is required or if operations must ceasefor any person performing a handling task (exceptfor fumigant site monitoring outside of the bufferzone) as stated in this label.• If at any time any handler experiences sensory

irritation (tearing, burning of the eyes or nose),then either:o A full-facepiece air-purifying respirator must

be worn by all handlers who remain in theapplication block or surrounding buffer zone,or

o Operations must cease and handlers notwearing an air-purifying respirator must leavethe application block and surrounding bufferzone.

o two consecutive breathing zone samples forchloropicrin taken at the handling site at least15 minutes apart must be less than 1.5 ppm.

o handlers do not experience sensory irritationwhile wearing the full-facepiece air-purifyingrespirator, and

o f i l ter cartridges/canisters have beenchanged.

o During the collection of air samples a full-facepiece air-purifying respirator must beworn by the handler taking the air samples.Samples must be taken at the locationwhere: (1) the irritation was first experienced,or (2) where the sample(s) were greater than5 ppm for methyl bromide or, (3) wheresample(s) were greater than or equal to 1.5ppm for chloropicrin.

Tarp Perforation and/or RemovalIMPORTANT: Persons perforating, repairing,removing, and/or monitoring tarps are defined,within certain time limitations, as handlers (seeHandlers section), and they must be provided thePPE and other protections for handlers as requiredon this labeling and in the Worker ProtectionStandard for Agricultural Pesticides.• Tarps must not be perforated until a minimum

of 5 days (120 hours) have elapsed after theapplication is complete, unless a weathercondition exists which necessitates early tarpperforation or removal (see Early Tarp Removalfor Broadcast Applications Only and Early TarpPerforation during Flood Prevention Activitiesfor Bedded Applications Only requirements).

• If tarps are perforated within 14 days after theapplication is complete, tarp removal must notbegin until at least 2 hours after tarp perforationis complete and 2 consecutive methyl bromideair monitoring samples taken at least 15minutes apart are less than 5 ppm. Air samplesmust be taken in the breathing zone of thehandler. If the 2 consecutive air monitoringsamples indicate that methyl bromide levelsare:o Less than 1 ppm and no sensory irritation is

experienced, no respiratory protection isrequired to begin tarp removal.

o Between 1 ppm and 5 ppm, then an air-purifying respirator is required to begin tarpremoval.

o See the Respiratory Protection and StopWork Triggers and Personal ProtectiveEquipment (PPE) sections for additionalrequirements.

• If tarps are not perforated or removed within14 days after the application is complete,planting or transplanting may take place whilethe tarps are being perforated.

• Each tarp panel used for broadcast applicationmust be perforated.

• Tarps may be perforated manually ONLY forthe following situations:o At the beginning of each row when a coulter

blade (or other device which performssimilarly) is used on a motorized vehicle suchas an ATV.

o In fields that are 1 acre or less.o During flood prevention activities.

• In all other instances tarps must be perforated(cut, punched, poked, or sliced) only bymechanical methods.

• Tarp perforation for broadcast applications mustbe completed before noon.

• For broadcast applications, tarps must not beperforated if rainfall is expected within 12 hours.

• Early Tarp Removal for Broadcast ApplicationsOnly:o Tarps may be removed before the required

5 days (120 hours) if adverse weatherconditions have compromised the integrityof the tarp, provided that the compromisedtarp poses a safety hazard. Adverse weatherincludes high wind, hail, or storms that blowtarps off the field and create a hazard, e.g.,tarps blowing into power lines and ontoroads. A compromised tarp is a tarp that dueto an adverse weather condition is no longerperforming its intended function and iscreating a hazard.

• Early Tarp Perforation during Flood PreventionActivities for Bedded Applications Only:o Tarp perforation is allowed before the 5 days

(120 hours) have elapsed.o Tarps must be immediately retucked and

packed after soil removal.• When perforating any tarp that qualifies for a

60% or greater reduction in buffer zone distancefollowing broadcast shank applications:o All handlers must wear an air purifying

respirator when perforating the tarp; ando Tarp removal must not begin until at least 2

hours after tarp perforation is complete and2 consecutive air monitoring samples takenat least 15 minutes apart are less than 5 ppm.Air samples must be taken in the breathingzone of the handler. If the 2 consecutive airmonitoring samples indicate that methylbromide levels are:- Less than 1 ppm and no sensory irritation

is experienced, no respiratory protectionis required to begin tarp removal.

- Between 1 ppm and 5 ppm, then an air-purifying respirator is required to begin tarpremoval.

NotificationNotify workers of the application by warning themorally and by posting Fumigant Treated Area signs.The signs must bear the skull and crossbonessymbol and state:

“DANGER/PELIGRO,”“Area under fumigation, DO NOT ENTER / NOENTRE,”“Methyl Bromide and Chloropicrin Fumigant inUSE,”“the date and time of fumigation,the date and time entry restricted period is over,“TRI-CON 50/50”, andName, address, and telephone number of thecertified applicator in charge of the fumigation.

• Post the Fumigant Treated Area sign instead ofthe WPS sign for this application, but follow allWPS requirements pertaining to location, legibility,text size, and sign size (40 CFR §170.120).

• Post Fumigant Treated Area signs at all entrancesto the application block no sooner than 24 hoursprior to application.

• Fumigant Treated Area signs must remain postedfor no less than the duration of the entry restrictedperiod.

Identifying Unfavorable Weather ConditionsUnfavorable weather conditions block upwardmovement of air, which results in trappingfumigant vapors near the ground. The resultingair mass can move off-site in unpredictabledirections. These conditions typically exist withinan hour prior to sunset and continue past sunriseand may persist as late as noontime. Unfavorableconditions are common on nights with limitedcloud cover and light to no wind and their presencecan be indicated by ground fog or smog and canalso be identified by smoke from a ground sourcethat flattens out below a ceiling layer and moveslaterally in a concentrated cloud.

Soil Preparation• Soil must be properly prepared and at the surface

generally be free of large clods. The area to befumigated must be tilled to a depth of 5 to 8 inches.

• Field trash must be properly managed. Residuefrom a previous crop must be worked into thesoil to allow for decomposition prior to the start ofthe application. Little or no crop residue shall bepresent on the soil surface. Crop residue that ispresent must not interfere with the soil seal.Removing the crop residue prior to the start ofthe application is important to limit the natural“chimneys” that occur in the soil when cropresidue is present. These “chimneys” allow thesoil fumigants to move through the soil quicklyand escape into the atmosphere. This may createpotentially harmful conditions for workers andbystanders and limit the efficacy of the fumigant.However, crop residue on the field serves toprevent soil erosion from both wind and waterand is an important consideration. Toaccommodate erosion control, fumigant efficacy,and human health protection, clear fields of cropresidue as close to the start of the application aspossible to limit the length of time that the soilwould be exposed to potentially erosive weatherconditions.

Soil Moisture• The soil must be moist 9 inches below the

surface. The amount of moisture needed inthis zone will vary according to soil type.Surface soil generally dries rapidly and mustnot be considered in this determination.

• Soil moisture must be determined using one ofthe following methods:o the USDA Feel and Appearance Method for

testing (see below), oro an instrument, such as a tensiometer.

• Available water capacity must be equal to orgreater than 50% for shank applications. If thereis less than 50% available water capacity 9inches below the surface, the soil moisture mustbe adjusted. If irrigation is not available andthere is adequate soil moisture below 9 inches,soil moisture can be adjusted by discing orplowing before the start of the application. Toconserve existing soil moisture, pretreatmentirrigation or pretreatment tillage should be doneas close to the start of the application aspossible.

• Measure soil moisture at a depth of 9 inches ateither end of the field, no more than 48 hoursprior to the start of the application.

The USDA Feel and Appearance Method forestimating soil moisture as appropriate for the soiltexture:• For coarse textured soils (fine sand and loamy

fine sand), the soil is moist enough (50 to 75%available water capacity) to form a weak ballwith loose and clustered sand grains on fingers,darkened color, moderate water staining onfingers, will not ribbon.

• For moderately coarse textured soils (sandyloam and fine sandy loam), the soil is moistenough (50 to 75% available water capacity)to form a ball with defined finger marks, verylight soil/water staining on fingers, darkenedcolor will not stick.

• For medium textured soils (sandy clay loam,loam, and silt loam), the soil is moist enough(50 to 75% available water capacity) to form aball, very light staining on fingers, darkenedcolor, pliable, and forms a weak ribbon betweenthe thumb and forefinger.

• For fine textured soils (clay, clay loam, and siltyclay loam), the soil is moist enough (50 to 75%available water capacity) to form a smooth ballwith defined finger marks, light soil/waterstaining on fingers, ribbons between thumb andforefinger.

Entry Restricted Periodand Notification

Entry Restricted PeriodEntry into the application block (including earlyentry that would otherwise be permitted under theWPS) by any person – other than a correctlytrained and PPE-equipped handler who isperforming a handling task listed on this labeling– is PROHIBITED - from the start of the applicationuntil:• 5 days (120 hours) after the application is

complete for untarped applications, or• 5 days (120 hours) after the application is

complete if tarps are not perforated andremoved for at least 14 days after theapplication is complete, or

• 48 hours after tarp perforation is complete iftarps will be perforated within 14 days after theapplication is complete and will not be removedfor at least 14 days after the application iscomplete, or

• tarp removal is completed if tarps are bothperforated and removed less than 14 days afterthe application is complete.

• For fields with more than one soil texture, soilmoisture content in the lightest textured (most sandy)areas must comply with this soil moisturerequirement. Whenever possible, the field shouldbe divided into areas of similar soil texture, and thesoil moisture of each area should be adjusted asneeded. Coarser textured soils can be fumigatedunder conditions of higher soil moisture than finertextured soils; however, if the soil moisture is toohigh, fumigant movement will be retarded andeffectiveness of the treatment will be reduced.Previous and/or local experience with the soil to betreated or the crop to be planted can often serve asa guide to conditions that will be acceptable. If thereis uncertainty in determining the soil moisture contentof the area to be treated, a local extension serviceagent, soil conservationist, or pest control advisor(agriculture consultant) should be consulted forassistance.

• Tarps must be installed immediately after thefumigant is applied to the soil for bedded orbroadcast applications.

• A written tarp plan must be developed andincluded in the FMP.

• Once a tarp is perforated, the application is nolonger considered tarped.

Weather Conditions• To determine if unfavorable weather conditions

exist or are predicted (see IdentifyingUnfavorable Weather Conditions section) andwhether an application should proceed, theNational Weather Service weather forecastmust be checked by the certified applicatorsupervising the application:- on the day of, but prior to the start of the

application, and- on a daily basis during the application if the

time period from the start of the applicationuntil the application is complete is greaterthan 24 hours.

• Do not apply if an air stagnation advisory issuedby the National Weather Service is in effect forthe area in which the application is planned,during the application, or the 48 hours after theapplication is complete.

• Do not apply if light wind conditions (< 2 mph)are forecast to persist for more than 18consecutive hours from the time the applicationstarts until 48 hours after the application iscomplete.

• Detailed National Weather Service forecasts forlocal weather conditions, wind speed, and airstagnation advisories may be obtained on-lineat: http://www.nws.noaa.gov, on NOAA weatherradio, or by contacting your local NationalWeather Service Forecasting Office.

NOTES:• See Tarp Perforation and/or Removal section on

this labeling for requirements about when tarpsare allowed to be perforated.

• If early tarp removal occurs for a broadcastapplication, the entry restricted period is aminimum of 5 days after the application iscomplete.

• When listing application information for soilfumigant applications to comply with part 170.122of the WPS, list the entry restricted period timeframe in place of the REI.

Mandatory Good AgriculturalPractices (GAPs)

The following GAPs must be followed during allfumigant applications.

Tarps (required for all applications, except for deepshank orchard replant [California only] applications)

• Fumigant Treated Area signs must be removedwithin 3 days after the end of the entry restrictedperiod.

Soil Temperature• The maximum soil temperature at the depth of

injection must not exceed 90° F at the beginningof the application.

• If air temperatures have been above 100° F inany of the three days prior to the start of theapplication, then soil temperature must bemeasured and recorded in the FMP. Recordtemperature measurements at the applicationdepth or 12 inches, whichever is shallower.

Soil Sealing• For Broadcast Untarped Applications (CA orchard

replant only): Use a disc or similar equipment touniformly mix the soil to at least a depth of 3 to 4inches to eliminate the chisel or plow traces.Following elimination of the chisel trace, the soilsurface must be compacted with a cultipacker,ring roller, and roller in combination with tillageequipment.

• For Bedded Applications: Preformed beds mustbe sealed by disruption of the chisel trace usingpress sealers, bed shapers, cultipackers, or byre-shaping (e.g., relisting, lifting, replacing) thebeds immediately following injection. Bedsformed at the time of application must be sealedby disrupting the chisel trace using press sealers,or bed shapers.

• Rigs must include a flow meter or a constantpressure system with orifice plates to ensure theproper amount of fumigant is applied.

• To prevent the backflow of fumigant into thecompressed gas cylinder (e.g., nitrogen, otherinert gas, compressed air), if used, applicatorsmust:o Ensure that positive pressure is maintained in

the compressed gas cylinder at not less than200 psi during the entire time it is connectedto the application rig, if a compressed gascylinder is used. (This is not required for acompressed air system that is part of theapplication rig, because if the compressorsystem fails, the application rig will not beoperable.)

o Ensure that application rigs are equipped withproperly functioning check valves between thecompressed gas cylinder or compressed airsystem and the fumigant cylinder. The checkvalve is best placed on the outlet side of thepressure regulator, and is oriented to only allowcompressed gas to flow out of the cylinder orcompressed air out of the compressed airsystem.

o A pressure relief valve must be installedbetween the regulator and the check valve toensure a regulator failure does not overpressurize the fumigant cylinder.

o Always pressurize the system withcompressed gas or by use of a compressedair system before opening the fumigant cylindervalve.

• Before using a fumigation rig for the first time, orwhen preparing it for use after storage, theoperator must check the following items carefully:o Check the filter, and clean or replace the filter

element as required.o Check all tubes and chisels to make sure they

are free of debris and obstructions.o Check and clean the orifice plates and screen

checks, if installed.o Pressurize the system with compressed gas

or compressed air, and check all fittings, valves,and connections for leaks using soap solution.

• Install the fumigant cylinder, and connect andsecure all tubing. Slowly open the compressedgas or compressed air valve, and increase thepressure to the desired level. Slowly open thefumigant cylinder valve, always watching forleaks.

• When the application is complete, close thefumigant cylinder valve and blow residualfumigant out of the fumigant lines into the soilusing compressed gas or compressed air. If therig uses a centrifugal pump instead ofcompressed gas to inject fumigant into the soil,you may clear residual fumigant from the fumigantlines using an application wand connected to thesystem’s low point via a drain hose. Place thewand in the soil until all residual fumigant hasdrained from the system. The wand and drainhose must be free of dirt to allow proper drainage.

Planting IntervalPlanting or transplanting must not occur until atleast 14 days after the application is complete. Ifodors of the fumigant persist beyond this 14 dayperiod (and after tarps are perforated and/orremoved), delay planting and disc or plow the soilto help aeration. See Tarp Perforation and/orRemoval section on this labeling for furtherrequirements.

Pre-Plant Soil Fumigation in Greenhouses:Mandatory GAPs

• During the application keep all doors, vents,and windows to the outside open, and keep allfans or mechanical ventilation systems runningwithin the greenhouse.

• Seal gaps through which gases could leak intoadjacent enclosed areas.

• For Tarped-Broadcast and Tarped-BeddedApplications: The use of a tarp does noteliminate the need to minimize chisel tracesprior to application of the tarp, such as by usinga Noble plow or other injection shank thatdisrupts the chisel traces.

Prevention of End Row Spillage• Do not apply or allow fumigant to spill onto the

soil surface. For each injection line either havea check valve located as close as possible tothe final injection point, or drain/purge the lineof any remaining fumigant prior to liftinginjection shanks from the ground.

• Do not lift injection shanks from the soil untilthe shut-off valve has been closed and thefumigant has been depressurized (passivelydrained) or purged (actively forced out via aircompressor) from the system.

Application Depth and Spacing• For Tarped-Broadcast and Tarped-Bedded

Applications: The injection point must be aminimum of 8 inches from the nearest final soil/air interface. For tarped bedded applications,the injection depth must not be deeper thanthe lowest point of the tarp (i.e., the lowest pointof the tuck).

• For Untarped-Broadcast Applications (CAorchard replant only): The injection point mustbe a minimum of 18 inches from the nearestfinal soil/air interface.

• Apply Tri-Con 50/50 with chisel equipment. Theshank spacing should be equal to theapplication depth, but may be up to 1½ timesthe application depth, not to exceed 24 inches.When applying Tri-Con 50/50 with a Noble plow,use an outlet spacing of 9-12 inches along thesweeps.

Bedded and Broadcast Shank Applications:Additional Mandatory GAPs

In addition to the GAPs required for all soilfumigation applications, the following GAPs applyfor injection applications:

Calibration, Set-up, Repair, and Maintenancefor Application Rigs• Brass, carbon steel, or stainless steel fittings

must be used throughout. Polyethylene tubing,polypropylene tubing, Teflon® tubing or Teflon®-lined steel braided tubing must be used for alllow pressure lines, drain lines, and compressedgas or air pressure lines. All other tubing mustbe Teflon® -lined steel braided.

• Galvanized, PVC, nylon, or aluminum pipefittings must not be used.

• All rigs must include a filter to remove anyparticulates from the fumigant and for pressurizedsystems a check valve to prevent backflow of thefumigant into the pressurizing cylinder or thecompressed air system.

• At the end of the application season, disconnectall fumigant cylinders from the application rig. Atthe end of the season, seal all tubing openingswith tape to prevent the entry of insects and dirt.

• Application equipment must be calibrated and allcontrol systems must be working properly. Propercalibration is essential for application equipmentto deliver the correct amount of fumigantuniformly to the soil. Refer to themanufacturer’s instructions on how to calibrateyour equipment. Usually the equipmentmanufacturer, fumigant dealer, or CooperativeExtension Service can provide assistance.

This product may be used as part of a quarantine program as described below.

Quarantine applications with respect to methyl bromide, are treatments to prevent the introduction,establishment and/or spread of quarantine pests (including diseases), or to ensure their officialcontrol, where: (i) Official control is that performed by, or authorized by, a national (includingstate, tribal or local) plant, animal or environmental protection or health authority; (ii) quarantinepests are pests of potential importance to the areas endangered thereby and not yet presentthere, or present but not widely distributed and being officially controlled. This definition excludestreatments of commodities not entering or leaving the United States or any State (or politicalsubdivision thereof).

USDA-APHIS Quarantine UsesThis product may be used as a soil fumigant at any crop or non-crop site as part of a quarantineprogram established by the United States Department of Agriculture-Animal and Plant HealthInspection Service (USDA-APHIS) under the Plant Protection Act (7 U.S.C. 7701 et seq.).Limitations including but not limited to application rates and methods and crops and croppingpractices must be in accordance with those established by the USDA-APHIS quarantine program.

Other Quarantine Uses (not USDA-APHIS Quarantine uses)Quarantine use of methyl bromide is restricted to fields used for the production of plant propagativematerial listed below and unplanted areas immediately adjacent thereto, where all productionfrom the treated fields will be shipped to areas where a plant regulatory authority requires thesource or the incoming material to be free of quarantine pests or be accompanied by a certificateissued by a plant regulatory official.

Forest Seedlings:Conifer and hardwood seedling for reforestation, Christmas tree seedlings

Nursery Stock:Roses, strawberry transplants, sweet potato slips, caneberry and blueberrynursery stock , fruit and nut trees, garlic transplants, onion transplants, vineyard stock, seedpotato, tobacco seed beds, food crop transplants, and other wild or cultivated trees, shrubs,vines and forbs.

Ornamental Plants: Caladiums, chrysanthemums, flower bulbs, flowering plants, ornamentalgrasses, rhizomes, shrubs, trees, and other perennials and annuals.

Turf or Sod:For interstate and intrastate shipments to areas that require fumigation with methylbromide to meet quarantine/phytosanitary requirements.

The maximum application rate for quarantine uses shall be 700 lbs of Tri-Con 50/50 per acre, orless if specified in the applicable quarantine/phytosanitary requirements.

The U.S. Federal, state, or local plant, animal, environmental protection or health authorityrequiring the quarantine application and the particular quarantine/phytosanitary requirementmust be identified in the site-specific fumigant management plan. Additionally, the requirementfor the treatment (e.g., the State or Federal law) must be listed in the site-specific fumigantmanagement plan.

Calculating the Broadcast Equivalent Application Rate

To calculate the broadcast equivalent rate for bedded or strip applications the followinginformation is needed:• Pounds of product per treated acre• strip or bed bottom width (inches)• center-to-center row spacing (inches)• application block size (acres)

Pounds of product per treated acre is theratio of total amount of product applied tothe size of the total area treated (e.g., therate of product applied in the bed). Forbedded or strip applications, the total areatreated is the summation of the area (i.e.,length x width) of each treated bed bottomor strip that is located within the applicationblock as shown by the black areas in Figure1 (e.g., black areas are 0.6A or 60% of thearea within the application block). The areaof the space between the beds/strips is notfactored in the total area treated.

The application block size is the acreagewithin the perimeter of the fumigated portionof a field (including furrows, irrigation ditches,roadways). The perimeter of the applicationblock is the border that connects theoutermost edges of total area treated withthe fumigant product.

Buffer Zone RequirementsA buffer zone must be established for every fumigantapplication. The following describes the buffer zonerequirements:• The buffer zone must extend outward from the

edge of the application block perimeter equallyin all directions.

• All non-handlers, including field workers, residents,pedestrians, and other bystanders, must be excludedfrom the buffer zone during the buffer zone periodexcept for transit (see Buffer Zone Exemption forTransit on Roadways section).o Local, state, or federal officials performing

inspection, sampling, or other similar officialduties are not excluded from the applicationblock or the buffer zone by this labeling. Thecertified applicator supervising the applicationand the owner of the establishment where theapplication is taking place are not authorizedto, or responsible for, excluding those officialsfrom the application block or the buffer zone.

• For broadcast shank applications using any tarpthat qualifies for a 60% or greater reduction inbuffer zone distance:1. The buffer zone period begins at the start of

the application and ends after the tarps havebeen removed from the application block.

2. As an alternative to (1) above, two buffer zoneperiods may be established where the firstbuffer zone period begins at the start of theapplication and lasts for a minimum of 48 hoursafter the application is complete. The secondbuffer zone period begins when the tarps areperforated and ends after the tarps have beenremoved from the application block.

• For all other applications, the buffer zone periodbegins at the start of the application and lasts fora minimum of 48 hours after the application iscomplete.

1. The storage buildings are not occupied duringthe buffer zone period, and

2. The storage buildings do not share a commonwall with an occupied structure.

Areas not under the control of the owner of theapplication block• Buffer zones must not include residential areas

(e.g., employee housing, private property),buildings (e.g., commercial, industrial), outdoorresidential areas (e.g., lawns, gardens, playareas) and other areas that people may occupy,UNLESS:1. The occupants provide written agreement, prior

to the start of the application, that they willvoluntarily vacate the buffer zone during theentire buffer zone period, and

2. Reentry by occupants and other non-handlersmust not occur until,1) The buffer zone period has ended, and2) Sensory irritation is not experienced upon

re-entry.• Buffer zones must not include agricultural areas

owned and/or operated by persons other than theowner of the application block, UNLESS:1. The owner of the application block can ensure

that the buffer zone will not overlap with amethyl bromide buffer zone from any otherproperty owners, except as provided in theBuffer Zone Proximity section, and

2. The owner of the other property provides writtenagreement to the applicator that they, theiremployees, and other persons will stay out ofthe buffer zone during the entire buffer zoneperiod.

• Buffer zones must not include roadways andrights of way UNLESS:1. The area is not occupied during the buffer zone

period, and2. Entry by non-handlers is prohibited during the

buffer zone period.Buffer Zone Exemption for Transit onRoadwaysVehicular and bicycle traffic on public andprivate roadways through the buffer zone ispermitted. (NOTE: Buffer zones are notpermitted to include bus stops or otherlocations where persons wait for public transit.)

• For all other publicly owned and/or operated areassuch as parks, sidewalks, permanent walkingpaths, playgrounds, and athletic fields, bufferzones must not include these areas UNLESS:1. The area is not occupied during the buffer zone

period,2. Entry by non-handlers is prohibited during the

buffer zone period, and3. Written permission to include the public area

in the buffer zone is granted by the appropriatestate and/or local authorities responsible formanagement and operation of the area.

Buffer zone proximity• Before the start of application, the certified

applicator must determine whether their bufferzone will overlap any methyl bromide bufferzone(s).

• To reduce the potential for off-site movement frommultiple fumigated fields, buffer zones frommultiple methyl bromide application blocks mustnot overlap UNLESS:1. A minimum of 12 hours have elapsed from the

time the earlier application(s) is complete untilthe start of the later application, and

2. Fumigant Site Monitoring or ResponseInformation for Neighbors has beenimplemented if there are any residences orbusinesses within 300 feet of any of the bufferzones.

Structures under the control of the owner of theapplication block• Buffer zones must not include buildings used for

storage, (e.g., sheds, barns, garages) UNLESS:

Buffer Zone CreditsThe buffer zone distances for TRI-CON 50/50applications may be reduced by the percentageslisted below. Credits may be added, but creditscannot exceed 80%. Also, the minimum bufferzone distance is 25 feet, regardless of buffer zonecredits available.• See www.tarpcredits.epa.gov for a list of tarps

that have been tested and determined to qualifyfor buffer reduction credits. Only tarps listedon this website qualify for buffer reductioncredits.

• 15% reduction in buffer zone distance, IFpotassium thiosulfate (KTS) is applied at aminimum rate of 300 pounds per acre.

• 10% reduction in buffer zone distance, IF theorganic content of the soil in the applicationblock is > 1% - 2%; a 20% reduction in bufferzone distance, IF the organic content of the soilin the application block is > 2% - 3%; and a30% reduction in the buffer zone distance, IFthe organic content of the soil in the applicationblock is > 3%.

• 10% reduction in the buffer zone distance, IFthe clay content of the soil in the applicationblock is greater than 27%.

Examples of Buffer Zone Calculations with CreditsAppliedIf the buffer zone is 50 feet, and the applicationqualifies for a buffer zone credit since the soilorganic content is 1.5%, then the buffer zone canbe reduced by 10%, i.e., reduced by 5 feet basedon the following calculation: 50 feet – (50 feet x10%) = 45 feet.If the buffer zone is 50 feet, and the applicationqualifies for two buffer zone credits since the soilorganic content is 1.5% and the clay content isgreater than 27%, then the buffer zone can bereduced by 20% (10% organic content credit +10% clay content credit), i.e., reduced by 10 feetbased on the following calculation 50 feet - (50feet x 20%) = 40 feet.

Posting Fumigant Buffer Zones• Posting of a buffer zone is required unless

there is a physical barrier that preventsbystander access to the buffer zone.

• Buffer Zone signs must be placed along oroutside the perimeter of the buffer zone, at allusual points of entry and along likely routes ofapproach from areas where people not underthe owner’s control may approach the bufferzone.o Some examples of points of entry include,

but are not limited to, roadways, sidewalks,paths, and bike trails.

o Some examples of likely routes of approachinclude, but are not limited to, the areabetween a buffer zone and a roadway, or thearea between a buffer zone and a housingdevelopment.

o When posting, the certified applicatorsupervising the application must ensurecompliance with all local laws andregulations.

• Buffer Zone signs must meet the followingcriteria:o The printed side of the sign must face away

from the application block toward areas fromwhich people could approach.

o Signs must remain legible during the entireposting period and must meet the generalstandards outlined in the WPS for sign size,text size, and legibil ity (see 40 CFR§170.120).

o Signs must be posted no sooner than 24hours prior to the start of the application andremain posted until the buffer zone periodhas expired.

o Signs must be removed within 3 days afterthe end of the buffer zone period.

o Buffer Zone signs which meet the criteriaabove will be provided at points of sale forapplicators to use. Templates may bedownloaded from http://www.epa.gov/pesticides/reregistration/soil_fumigants/index.htm

o The Buffer Zone signs must contain thefollowing information:

The ‘Do Not Walk’ symbolDO NOT ENTER/NO ENTRE,Methyl Bromide Fumigant [TRI-CON 50/50] BUFFER ZONE,Contact information for the certifiedapplicator in charge of the fumigation

Certified applicators must comply with all local lawsand regulations.See the Posting section for additional requirementsthat may apply.

Exception: If multiple contiguous blocks arefumigated within a 14-day period, the entireperiphery of the contiguous blocks’ buffer zonesmay be posted. Buffer Zone signs must be postedno sooner than 24-hours prior to the start of thefirst application. The signs must remain posteduntil the last buffer zone period expires, and thesigns must be removed within 3-days after thebuffer zone period for the last block has expired.

Restrictions for Difficult to EvacuateSitesDifficult to evacuate sites are pre-K to grade 12schools, state licensed daycare centers, nursinghomes, assisted living facilities, hospitals, in-patient clinics, and prisons.• No fumigant application with a buffer zone

greater than 300 feet is permitted within 1/4mile (1320 feet) of difficult to evacuate sitesunless the site is not occupied by children fromstate-licensed day care centers, students (pre-K to grade 12), patients, or prisoners duringthe application and the 36-hour period followingthe end of the application.

• No fumigant application with a buffer zone of300 feet or less is permitted within 1/8 mile (660feet) of difficult to evacuate sites unless thesite is not occupied by children from state-licensed day care centers, students (pre-K tograde 12), patients, or prisoners during theapplication and the 36-hour period following theend of the application.

Emergency Preparednessand Response Measures:

If the buffer zone is 25 feet, then the EmergencyPreparedness and Response Measures are notapplicable.

Triggers for Emergency Preparedness andResponse MeasuresThe certified applicator must either follow thedirections under the Fumigant Site Monitoringsection or follow the directions under theResponse Information for Neighbors section if:• the buffer zone is greater than 25 feet but

less than or equal to 100 feet, and there areresidences or businesses within 50 feet fromthe outer edge of the buffer zone, or

• the buffer zone is greater than 100 feet butless than or equal to 200 feet, and there areresidences or businesses within 100 feetfrom the outer edge of the buffer zone, or

• the buffer zone is greater than 200 feet butless than or equal to 300 feet, and there areresidences or businesses within 200 feetfrom the outer edge of the buffer zone, or

• the buffer zone is greater than 300 feet orthe buffer zones overlap, and there areresidences or businesses within 300 feetfrom the outer edge of the buffer zone.

Fumigant Site MonitoringNOTE: Fumigant Site Monitoring is ONLYrequired if the Emergency Preparedness andResponse Measures are triggered ANDdirections from the Response Information forNeighbors section are not followed.

• Monitoring for sensory irritation must beginin the evening on the day of application andcontinue until the buffer zone period expires.Monitor a minimum of 8 times during thebuffer zone period, including these periods:- 1 hour before sunset,- during the night,- 1 hour after sunrise, and- during daylight hours.

Implement the emergency response planimmediately if a handler monitoring experiencessensory irritation.

Response Information for NeighborsNOTE: Response Information for Neighbors isONLY required if the Emergency Preparednessand Response Measures are triggered ANDdirections from the Fumigant Site Monitoringsection are not followed.

The certif ied applicator supervising theapplication must ensure that residences andbusinesses that trigger the requirement havebeen provided the response information at least1 week before the application starts. Theinformation provided may include applicationdates that range for no more than 4 weeks. Ifthe application does not occur when specified,the information must be delivered again.

Information that must be included:o The location of the application block.o Fumigant(s) applied including the active

ingredient, name of the fumigant product(s),and the EPA Registration number.

o Contact information for the applicator andproperty owner.

o Time period in which the application isplanned to take place (must not range morethan 4 weeks).

o Early signs and symptoms of exposure tothe fumigant(s) applied, what to do, and whoto call if you believe you are being exposed(911 in most cases).

o How to find additional information aboutfumigants.

The method used to share the responseinformation for neighbors can be accomplishedthrough mailings, door hangers, or othermethods that will effectively inform theresidences and businesses within the requireddistance from the edge of the buffer zone.

Location of the application blocks,Fumigant(s) applied including EPA registrationnumber(s),Applicator and property owner/operator contactinformation, andTime period that fumigation may occur.

Emergency Response PlanThe certified applicator must include in the FMPa written emergency response plan that identifies:

Evacuation routes,Locations of telephones,Contact information for first responders andlocal/state/federal/tribal personnel, andEmergency procedures/responsibilities (e.g.,adding water to the field, repairing tarps, fixingequipment, evacuating upwind) if:o there is an incident,o sensory irritation is experienced outside of

the buffer zone, and/oro there are equipment/tarp/seal failures or

complaints, or other emergencies.

Site-Specific FumigationManagement Plan (FMP)

Prior to the start of application, the certifiedapplicator supervising the application must verifythat a site-specific FMP exists for each applicationblock. In addition, an agricultural operationfumigating multiple application blocks may formatthe FMP in a manner whereby all of the informationthat is common to all the application blocks iscaptured once, and any information unique to aparticular application block or blocks is capturedin subsequent sections.The FMP must be prepared by the certifiedapplicator, the site owner, registrant, or other party.The certified applicator supervising the applicationmust verify in writing (sign and date) that the site-specific FMP(s) reflects current site conditionsbefore the start of application.Each site specific FMP must contain the followingelements:

Certified Applicator Supervising the Applicationo Name,o Phone number,o Pesticide applicator license and/or certificate

number,o Specify if commercial or private applicator,o Employer name,o Employer address, ando Date and location of completing EPA

approved soil fumigant training program.General site informationo Application block location (e.g., county,

o Name, address, and phone number ofapplication block owner

o Map, aerial photo, or detailed sketchshowing:• application block location• application block dimensions

• buffer zone dimensions• property lines• roadways• rights-of-ways• sidewalks• permanent walking paths• bus stops• nearby application blocks• surrounding structures (occupied and non-

occupied)• locations of Buffer Zone signs, and• locations of difficult to evacuate sites with

distances from the application blocklabeled.

Spill and Leak ProceduresIn case of a rupture of hose or fitting whileapplying fumigant, immediately stop tractorand motor. Evacuate everyone from theimmediate area of the spill or leak. Wear thepersonal protective equipment specified inthe Personal Protective Equipment (PPE)section of this labeling for entry into affectedarea to correct problems. Approach fromupwind to make necessary repairs. Do notenter area without the required PPE until thespill has evaporated or the leak has beenfixed. Contaminated soil, water, and othercleanup debris is a toxic hazardous waste.Report spill to the National Response Center(800-424-8802) if the reportable quantity of1000 lbs. is exceeded.

The certified applicator or the ownerof the application block must provide a copy of theFMP to any local/state/federal/tribal enforcementpersonnel who request the FMP. In the case of anemergency, the FMP must be made immediatelyavailable when requested by local/state/federal/tribalemergency response and enforcement personnel. Thecertified applicator supervising the application mustensure the FMP is at the application block during allhandler activities.

Within 30 days after the application is complete, thecertified applicator supervising the application mustcomplete a Post-Application Summary.
