No one knows Critical Path Method scheduling like we do.For decades, TRAUNER has advocated the use of CPMschedules, teaching contractors, owners, and A/E firmshow to develop and use these schedules effectively. Ourfirm has written dozens of CPM scheduling specificationsfor public agencies and private owners across the country.TRAUNER even drafted the model CPM schedulingspecification for Oracle’s Primavera P6 software.

During our critiques, we evaluated thesubmissions provided by thecontractor and subcontractor tosupport the delay-related andinefficiency damages they wereclaiming.

Many of the issues that wereevaluated on this project involvedwork performed previously underseparate contracts, changes toaccommodate new medicalequipment, and alleged delays andgovernment interference.

The primary challenges involvedunderstanding how work performedunder separate contracts may haveaffected the work of the contractorand subcontractors. It was difficult toreconcile the time extensions andassociated costs previously executedin change orders, as a result ofinaccurate analysis results. Lastly, itwas difficult to implement a delayanalysis procedure, consistent with

the VA guidelines, due to thenegotiation of the changes thatoccurred during the project.

We toured the site and worked closelywith the VA’s project site and CentralOffice staff to coordinate our analysisefforts. We also met with anddiscussed the analysis prepared bythe VA with regard to delays on theproject. We reviewed the scheduleinformation provided by the contractoras part of the claim submissions. Wealso offered significant criticisms ofthe method used by the contractorwhen evaluating its delays.

In preparation for trial for Claim Nos.1, 2, and 3, TRAUNER reviewed theanalysis performed by the VA team.We completed our own, independentanalysis of delay and submitted anexpert report prior to trial. The expertreport provided for an evaluation ofthe project delays and additionalcosts requested by the contractor andits subcontractors.

We also assisted the VA with thenegotiation of Claim Nos. 1 through 5.

The dispute was resolved without theneed for expensive and prolongedlitigation. The VA provided positivefeedback on TRAUNER’s work in itsContractor Performance AssessmentReport. When providing itsassessment, the VA stated thatTRAUNER “Demonstrated expertisein the field of claims resolution withrespect to delays, inefficiencies,acceleration, etc. Knowledgeable andhighly-responsive to customerneeds.” In addition, the VA stated,“Given what I know today about thecontractor’s ability to perform inaccordance with this contract ororder’s most significant requirements,I would recommend them for similarrequirements in the future.”

The case was settled successfullythrough negotiation.

TRAUNER was the claims consultantresponsible for the evaluation of the$130M in claims that were submittedby the contractors and subcontractorson the Bid Package #4 portion of themulti-phase, $675M, New VA MedicalCenter and campus in Orlando, FL.

We completed a critique of thecontractor’s and subcontractors’ fiveclaim submissions for completenessand compliance with the contract. Wethen prepared written reports,critiquing the claim submissions fortime extensions, delay damages,inefficiencies, and acceleration.

We prepared draft letters to serve asa basis for the Contracting Officer’sFinal Decision with regard to ClaimNos. 1 through 5. We also met withthe VA on many occasions to discussthe results of our reviews andanalyses and strategize with regard tothe VA’s approach to resolving thedispute.

The final TRAUNER report containedan analysis of the contractor’sdamages. Each line item of the $7Mclaim was reviewed and critiqued. Wealso incorporated the results of theVA’s audit of the claim. The finalreport served as the basis for the VAOffice of General Counsel’s mediationstatement.

TRAUNER worked closely with theContracting Officer and the VA Officeof General Counsel to develop anegotiation strategy for ADR. Wecompleted a mediation presentationthat served as the backbone of theVA’s position. We provided an oralpresentation of our report duringADR, questioned the opposingexpert’s incorrect analysis, andhelped to calculate an appropriatesettlement number. The case was notsettled during the initial ADR. Weattended a second ADR and providedsupport to the VA during thesenegotiations.

TRAUNER produced our:

• Preliminary report focused onanalysis of delays/responsibility

• Final report, including costanalysis of each line item in thecontractor’s claim

• Mediation presentation duringADR

• Automated spreadsheet thatallowed for quick calculation ofsettlement positions during ADR

We were also heavily involved in thefinal settlement negotiations betweenthe contractor and VA.

Because of our understanding of theVA Contract and the contractor’sclaim, the ADR judge was able to helpopposing counsel understand thelimitations of their clients’ potentialrecovery.

This understanding, combined withthe accuracy of TRAUNER’s delayand cost analysis, allowed the VA tosettle the case successfully without acostly trial. The contractor accepted a55% reduction in its claim amount.

After settlement, the Branch Chief forthe VAMHCS Construction Teamprovided a letter of recommendation.The letter included the following:

“I want to give you my sincerestthanks for a job well done onGSA Task Order VA245-16-F0015. ...(Y)ou did an amazingjob assisting the VA with settlinga very difficult and challengingclaim…

Your firm’s in-depth analysis ofproject scheduling, your firm’sextensive knowledge of VAARclauses language and yourpresentations during the 4-dayAlternate Disputes Resolution(ADR) mediation proceedingsreally helped to save the day.

In all aspects of the procurement,Trauner provided outstandingservice in a first classprofessional manner. I definitelywould recommend Trauner forfuture opportunities.”

The dispute was resolved without theneed for expensive and prolongedlitigation.

The 4C Patient Ward Renovation andExpansion Project involved therenovation of approximately 22,000square foot of interior space and theconstruction of 1500 square feet ofnew space at the VA’s medical facilityin Washington, DC. The ContractCompletion date for the project was365 calendar days from NTP.

During the project, the contractorsubmitted 134 change orders. A totalof 16 modifications were executed.Ultimately, the project finished 1,057calendar days late and the contractorfiled a $7M+ claim.

TRAUNER was engaged by the VAwith an expert report deadline of +/-45 days. In the initial stages of theproject, we traveled to the VA office inPerryville, MD, to review and collectrelevant documents.

Next, we submitted a preliminary draftof the expert report. This reportfocused on the analysis of delays andresponsibility. The report analyzedeach of the 13 major issues allegedby the contractor in its claim. Wedetermined how much total delay theVA was responsible for, as well as thetype of delay. The distinction betweensuspension and change order delaywas important for this Project as eachtype is compensated differently underthe VA’s Contract.

transportation alternatives, andconnect people to nature. GRGfunding for construction and long‐termO&M was identified in a localsales‐tax increase that passed in2013. They have committed nearly$80 million to improvements on thearch grounds.

In addition to funding for construction,CAR is managing the design of theproject and is donating the design tothe NPS. Construction of the projectelements will be contracted for andmanaged by the Denver ServiceCenter. There are seven majorcomponents of construction that willbe occurring on NPS property.

The NPS has engaged TRAUNER toassist them in providing real-timeclaim management services. Our firsttask was to evaluate the project risks,issues, and vulnerabilities on five ofthe seven projects.

Our second task is to provide on-callclaims management services to theNPS to six of the seven projects.

TRAUNER’s tasks have included:

• Initial Review of Documents andSeparate Reports regardingProject Risks and Vulnerabilitieson the Six Major JEFF Projects

• On-Site Meetings with NPSProject Management and City-Arch-River representatives

• Review of CPM ScheduleUpdates and Time ExtensionRequests regarding weatherissues on the South and NorthArch Grounds Projects

• Review of Time ExtensionRequests on the $96M VisitorCenter Project (Two Requests toDate)

• Review of Extended GeneralCondition Claims on the VisitorCenter Project

• Forensic Analysis of CPMSchedules on the Visitor CenterProject - analyzed overallProject Completion as well asinterim milestones such as thecompletion of the RenovationScope

• Reviewed CPM ScheduleUpdates for the Visitor CenterProject

The Jefferson National ExpansionMemorial (JEFF) is a CityArchRiver2015 partnership project that wascreated to renovate the Gateway ArchGrounds, renovate and updatefacilities and visitor services, andstrengthen ties to the St. LouisCommunity. Funding for the project isbeing donated to the National ParkServices (NPS) from the park’spartners in the project and is acombination of private donations andlocal sales tax revenue.

The NPS has entered into fundraisingand design agreements with theCityArchRiver Foundation (CAR).Their goal is to raise $250M ofprivately donated money to fundprojects on park lands as well asother projects immediately adjacent tothe park grounds.

The second major partner in theproject is Great Rivers GreenwayDistrict (GRG). GRG is a regionalpark agency with special taxingauthority that has a mission toconnect communities, provide

The project achieved LEED PlatinumCertification with sustainable designand construction including a livingroof, natural ventilation, energy-efficient lighting, and natural localclimate vegetation.

The prime contractor submitted acertified claim of $10,567,606 foralleged cost overruns in contingencyand allowance accounts.

It also included a claim from theelectrical subcontractor that includedallegations of delay and acceleration,trade stacking, out-of sequence work,and added work.

TRAUNER provided forensicaccounting services in which weevaluated the alleged overruns in theConstruction Contingency Allowanceand the alleged overruns in theUnallocated Direct Costs. We alsoperformed a Guaranteed MaximumPrice (GMP) audit on two portions ofthe overall claim.

TRAUNER presented its findingsorally via a web conference and alsoprepared a report summarizing thosefindings.

These efforts helped the GSA cometo an equitable settlement with thecontractor.

50 United Nations Plaza is acornerstone of the San FranciscoCivic Center and is listed on theNational Register of Historic Places.It is the home of the General ServicesAdministration's (GSA) regionalheadquarters offices for the PacificRim Region.

The 50 United Nations Plaza Projectwas a $100M renovation, seismicretrofit, and interior reconfiguration ofa 5-story, historic, federal building.

The construction project includedretrofitting the existing office layout toinclude opening up corridors, addingcollaboration space, and utilizingnatural lighting.

We performed CPM scheduleanalyses, including an analysis of

both the critical project delays anddelays to the critical path of therespective subcontract work, as wellas an analysis of responsibility forthose delays. We also analyzedalleged inefficiencies allegedlyassociated with specific technicaldesign issues.

Our expert report was based on areview of the available projectdocumentation including, but notlimited to, the project plans andspecifications, bid documents, projectschedules, change orders, RFI’s, fieldchange requests, engineering changenotices, submittals, depositiontranscripts, and exhibits.

Ultimately, a settlement favorable toour client was negotiated.

TRAUNER evaluated two claims, an$11.5M claim submitted by theelectrical subcontractor and an $8.5Mclaim submitted by the mechanicalsubcontractor on the $180M design-build construction of a Radiological

Lackland Air Force Base, San Antonio, TX

foundation piers for the newconstruction of a four-story, 272,000square foot building to house 1,200Air Force recruits in a basic militarytraining environment.

The contractor’s claim alleged that adefective pier design and relatedconstructive changes to the projectscope entitled it to a 60-day,compensable time extension andadditional compensation in theamount of $4,769,979.

We prepared an expert report andpresented expert testimony at trial.

In a follow-on claim on this project,the Contractor alleged that adefective masonry design and relatedconstructive changes entitled it to a10-month compensable timeextension as well as additionalcompensation in the amount of$8,795,700.

This second claim was resolved inmediation after the first was litigated.

TRAUNER was selected by the U.S.Army Corps of Engineers to performan independent review and objectiveanalysis to determine the merits of aclaim related to the construction of
