Offences and penaltiesPlease find attached a summary document of the Offences and Penalties as outlined in Division 5 of the Work Health and Safety Act 2011. This includes penalties for individuals, individuals as a person conducting a businessand body corporate. The attached document from the Safe Work SA has more information regards discriminatory, coercive or misleading conduct. It states that ‘the model WHS Act prohibits:any person authorising or assisting discriminatory conduct for a prohibited reason;coercion or inducement to exercise a power or role or not to exercise that power or role underthe model WHS Act; andmisrepresentation about a person’s rights, obligations or ability to make a complaint seekingcompliance with the model WHS Act.’

and responding to them• ensure processes for complying with duties are implemented, e.g. reporting, consultation
arrangements, training and instruction• verify the provision and use of resources for the matters listed above.
