Hi Linda,

Offences and penaltiesPlease find attached a summary document of the Offences and Penalties as outlined in Division 5 of the Work Health and Safety Act 2011. This includes penalties for individuals, individuals as a person conducting a businessand body corporate. The attached document from the Safe Work SA has more information regards discriminatory, coercive or misleading conduct. It states that ‘the model WHS Act prohibits:any person authorising or assisting discriminatory conduct for a prohibited reason;coercion or inducement to exercise a power or role or not to exercise that power or role underthe model WHS Act; andmisrepresentation about a person’s rights, obligations or ability to make a complaint seekingcompliance with the model WHS Act.’

They have a 5 minute video on this website (link to page below) which is targeted at Executive officers.It’s called ‘Executive officers: Know your responsibilities under the new laws.’ Maybe this is something you could distribute to the Board and Executive for them to watch.
