To request a DBS Certificate Disclosure or not?
o Apprentices involved in ‘regulated activity’ require a DBS certificate to undertake their roles.
o Traineeships do not require a DBS Certificate as they should NEVER be left unsupervised and therefore will NOT be undertaking any 'regulated activity’ as part of their training.
o The code of practice stipulates ‘It is the employer’s responsibility to identify those staff who will require a DBS certificate (based on their involvement in regulated activity)’
o It is illegal to request a DBS certificate for staff who DO NOT undertake regulated activity in their job roles.
o It is the employer’s responsibility to have an up to date safeguarding policy and procedures that ensure all the above are regulated and that all staff and children/young people are safe within their employment.

Regulated Activity - Children
1. Unsupervised activities: teaching, training, instructing, caring for, or supervised, or advised on well-being, driving (only for children).
2. Working for establishments ‘specified places’, with opportunity for contact, e.g. Schools, Children’s homes, childcare premises and FE Colleges that are mainly for educating children full-time. o Work at 1. or 2. above is regulated activity, only if done regularly.
Regular means: by same person frequently (once a week or more) or on 4 or more days in a 30 day period (or in some cases overnight)
o Relevant personal care, even if done once.

With the applicant’s permission, their employer can use their current DBS Certificate and carry out a free, online check to see if any new information has come to light since its issue.
*If the status of a Certificate changes it is no longer up-to-date.

The Government’s new Traineeships programme is available for young people aged 16-24 … and for young people with Learning Difficulty Assessments up to academic age 25 from August 2013.

o are not currently in a job and have little work experience, but who are focused on work or the prospect of it;
o 16-19 and qualified below L3 or 19-24 and not yet achieved a full L2, and
o providers and employers believe have a reasonable chance of being ready for employment or an apprenticeship within six months of engaging in a traineeship
The core target group will be young people who:

Traineeships are not intended for:
o the most disengaged young people, who require very intensive support;
o those who are already have the skills and experience required to start an apprenticeship or find work; or
o those already in a job/apprenticeship

24+ Advanced Learning Loans have been introduced by the UK government for learners aged 24 and over and studying at Level 3, Level 4 or Advanced and Higher Apprenticeships from August 2013.

You must be studying at a college or training provider in England approved for public funding.
