Campaign Contributions and Lobbying Expenditures of Tobacco Interests in California

2017-2018 Election Cycle: January - December 2017

IntroductionThis report shows that tobacco interests continue to maintain a strong presence in the California Legislature. During the first four quarters of the 2017-2018 election cycle, tobacco interests spent over $5.4 million on campaign contributions and lobbying expenditures to influence legislative policy and elections in California.

Tobacco interests spent over $1.1 million to lobby ten bills, administrative actions, and issue areas during the first year of the 2017-2018 election cycle.

During the first four quarters of this election cycle, tobacco interests have contributed over $4.2 million in campaign contributions to members of the California Legislature, statewide elected officials, and political committees.

BackgroundThe tobacco interests profiled in this report hire lobbyists and are therefore considered lobbyist employers by the Secretary of State. They are required to submit quarterly disclosure reports that detail which legislative or administrative actions, such as bills or regulations, were lobbied during that quarter. The reports also show how much money was spent on

payments to lobbying firms and activity expenses, which is defined to include gifts, honoraria, consulting fees and salaries. Each quarter covers three months out of the calendar year (January through March, April through June, July through September, and October through December) making a total of eight quarters for the two-year election cycle. The figures on lobbying expenditures in this update come from the first four of eight quarterly disclosure reports in the 2017-2018 election cycle.

For campaign contributions, these tobacco entities, like other interest groups, are required by law to submit statements to the Secretary of State twice annually and more often in election years. Campaign contributions include all monetary and non-monetary contributions, such as donated goods or services. The contribution limit is $4,400 per campaign for legislators, $7,300 for statewide officers, and $29,200 for the Governor.

Global, Inc. which had filed its contributions under the name Altria Group Inc.’s Affiliates. However, in 2007, Kraft Foods Global, Inc. was spun off from Altria Group Inc.’s Affiliates and stopped filing its campaign contributions under the Altria Group Inc.’s Affiliates name.

The seven active tobacco interests that are included in this report are listed below. Three new groups, the California Smoke Free Organization, Californians for Tobacco Harm Reduction, and JUUL Labs, have been added to the report. Two groups, NJOY, Inc. and SFATA (Smoke Free Alternatives Trade Association), are no longer active. They will not appear in the 2017-2018 election cycle's reporting but are included in long-term analysis when applicable. Throughout the report, all of the tobacco interests are identified under the name in which they are listed on the lobbying reports and contributions statements filed with the Secretary of State:

Altria Client Services LLC and its Affiliates —Parent company of Philip Morris USA, John Middleton, U.S. Smokeless Tobacco Company and Green Smoke Inc.

California Distributors Association—Trade group that represents tobacco wholesalers and distributors.

California Smoke Free Organization—Trade group that represents electronic cigarette/vapor product manufacturers, distributors, and retailers.

Californians for Tobacco Harm Reduction—Coalition of retailers and consumers to promote vapor products as replacements for tradition cigarettes.

Cigar Association of America—Trade group that represents cigar manufacturers, importers, and distributors.

JUUL Labs—New electronic cigarette producer.

RAI Services Company and its Affiliates—Parent company of RJ Reynolds Tobacco Company, American Snuff Company LLC, Santa Fe Natural Tobacco Company, Inc. and Vuse electronic cigarettes.

In these four quarters, the tobacco interests spent more than $1.1 million to lobby the legislature on two tobacco-related bills. Total spent by tobacco interests may not equal the amount paid to outside lobbying firms because of other costs associated with lobbying, some of which may be found in Table 2.

Table 2 details both the activity expenses and campaign contributions that are listed on the lobbying reports of tobacco interests. Lobbying reports include details about activity expenses, such as providing meals or drinks to a legislator. These activity expenses are included in the monetary totals found in Table 1, but the details are listed below in Table 2. The reports also include campaign contributions or gifts that are not reported elsewhere (for example if the total amount of contributions did not meet the minimum monetary threshold for filing a campaign contributions report for that time period). These are not included in the monetary totals found in Table 1. Finally, lobbyist employers must also disclose the amount paid in overhead and services that the employer would not have incurred if there were no lobbyist. These payments may fall into categories such as salary and/or compensation, goods and services, research and strategy, contracts with non-lobbying groups or individuals, advertising, events, or "other" expenses not covered by the preceding categories. During the first four quarters of this two-year election cycle, three of the tobacco interests made additional expenses and gave gifts.

While not able to vote on tobacco-related legislation as state legislators can, these elected officials influence laws and government actions related to the tobacco industry. For example, the Governor has the opportunity to sign or veto all bills passed by the legislature, the State Board of Equalization oversees the administration of cigarette and tobacco products taxes and tobacco licensing statutes and the Controller and Treasurer are members of the Public Employee Retirement System Board.
