I have the honour to enclose a statement issued by Mr. Zulfikar All Bhutto,Prime Minister of Pakistan, today. This is in response to an announcement of theGovernment of India dated 2k February 1975 regarding the agreement reached betweenthe Prime Minister of India and Sheikh Mohammad Abdullah about certain politicalarrangements in Indian-occupied Jammu and Kashmir in complete disregard of UnitedNations resolutions and the commitments of the parties to the dispute.

It is requested that this statement be circulated as a Security Councildocument.

LETTER DATED 30 AUGUST 1972 FROM THE PERMANENT REPRESENTATIVE OF PAKISTANTO THE UNITED NATIONS ADDRESSED TO THE SECRETARY-GENERAL

I have the honour to refer to previous communications regarding thecontinued detention in India of the Pakistan prisoners of war, numbering 80,000,and civilian internees, including women and children, numbering about 10,000,and to reproduce below the text of a statement issued on 2k August 1972, inGeneva, by the International Commission of Jurists:

"The International Commission of Jurists has urged the IndianGovernment to take immediately all necessary steps in order to liberateand repatriate the Pakistani prisoners of war detained in India.

"The Third Geneva Convention of 19 9 provides clearly that conclusionof a peace treaty or an armistice is not required between the parties ofthe conflict but that prisoners of war must be repatriated without delayafter cassation of hostilities. There cannot be any dispute that activehostilities have in fact ceased in view of the cease-fire, the actualcessation of fighting and above all the Simla Agreement which would appearto show that Governments of India and Pakistan are of the opinion thattheir countries are no longer in a state of active hostilities.

"The International Commission of Jurists believes that a plan forrepatriation of prisoners of war should now be prepared and carried outwithout delay in accordance with the Geneva Conventions. Public opinionis already beginning to ask questions about the future of these prisoners."

Addendum

Pursuant to rule 11 of the provisional rules of procedure of the SecurityCouncil, the Secretary-General is submitting the following summary statement.

The complete list of items of which the Security Council is seized is containedin document S/107TO of 22 August 1972. During the week ending 26 August 1972, theSecurity Council took action on the following item:

On 21 August 1972, China submitted a draft resolution (S/10768 and Corr.l)under the operative paragraphs of which the Security Council:

"l. P_ef ilJ-je§> to postpone consideration of the matter referred to indcpument S/10759, pending the full implementation of the above resolutions •/G-neral Assembly resolution 2793 (XXVI) and Security Council resolution307 (197117;

"2. Res.URsts_ the Secretary-General to report to the Security Councilat an earljr date on the full implementation of the above resolutions "by allthose concerned."

On 23 August, a draft resolution (S/10771) was submitted "by India, the Unionof Soviet Socialifit Republics, the United Kingdom of Great Britain and NorthernIreland and Yugoslavia, under the operative paragraph of which the Security Council:

"Recommends to the General Assembly that the People's Republic ofBangladesh be admitted to neiabership in the United Nations. "

Also on 23 August, the Committee on the Admission of New Members submitted itsreport (S/10773) to the Security Council concerning the application of the People'sRepublic of Bangladesh for membership in the United Nations.

REPORT OF THE SECURITY COUNCIL COMMITTEE ON THE ADMISSION OF HEWMEMBERS CONCERNING THE APPLICATION OF THE PEOPLE'S REPUBLIC OF

BANGLADESH FOR MEMBERSHIP IN THE UNITED NATIONS

1. At its 1658th meeting on 10 August 1972, the Security Council decided torefer to the Committee, for examination and report, the- application of the People'sRepublic of Bangladesh for admission to membership in the United Nations, placedbefore it in a note by the Secretary-General dated 8 August (S/10759).

2. At its Uoth meetingj held on 11 August, the Committee under the Chairmanshipof Mr. Van Ussel (Belgium) considered the application of the People's Republic ofBangladesh. The representatives of Argentina, Belgium, France, India, Italy,Japans Panama, the Union of Soviet Socialist Republics, the United Kingdom ofGreat Britain and Northern Ireland, the United States of America and Yugoslaviaexpressed their support for the application of Bangladesh which in their viewfulfilled all the requirements for membership laid down in Article k of the Charter.The representative of China stated that pending the full implementation of therelevant United Nations resolutions and a reasonable settlement of the issuesbetween India and Pakistan and between Pakistan and "Bangladesh", "Bangladesh" wasnot qualified at all to be admitted into the United Nations and, therefore, theChinese delegation was firmly opposed to consideration of the application by theSecurity Council under existing circumstances. The representatives of Guinea,Somalia and the Sudan indicated that their delegations would prefer to postponeconsideration of the application in order to permit more time for consultation andthe receipt of further information.

3. In the absence of any formal objection, it was decided, in accordance with aproposal made by the representative of Japan, that rule 59 of the provisional rulesof procedure should be waived in order to enable the Committee to report to theSecurity Council its conclusions on the item by 21 August.

U. At the Ulst meeting of the Committee, held on 21 August, the representativeof China reiterated his position. His delegation was submitting a draftresolution (S/10768) to the Security Council (annex) whereby the Council woulddecide to defer consideration of the question until the relevant resolutions hadbeen fully implemented. He expressed his delegation's readiness to consult withother members regarding that proposal and indicated that in the event the Councilwere convened formally on the question, his delegation would ask that its draftresolution be accorded precedence in accordance with the provisional rules ofprocedure.

I have the honour, under instructions of my Government, to refer to yourreport dated 12 May 1972 (S/10U67/Add.lO and to the letter from the PermanentRepresentative of India dated 12 May 1972 contained in document S/106 8 of15 May 1972 and to state that no flag meetings between Pakistan and Indianmilitary commanders have been held with regard to incidents along the cease-fireline in Jammu and Kashmir. Flag meetings between local commanders have beenheld only to look into incidents along the international border between Pakistanand India. It is clear that incidents along the cease-fire line should beinvestigated by UNMOGIP observers and flag meetings held under the auspices ofUNMOGIP, since both the Karachi Agreement of 19 9 and Security Councilresolution 307 (1971) of 21 December 1971 prescribe UNMOGIP's responsibilitiesin this regard.

It is my Government's view that the activation of the machinery of UNMOGIP onthe Indian side of the cease-fire line in Jammu and Kashmir would serve to preventincidents along this line.

It is requested that this letter may kindly be circulated as a document ofthe Security Council.

I have the honour, under instructions of my Government, to inform, you of thefollowing cease-fire violations committed by the Indian army during the period23 April to 1* May 1972:

A. Northern Areas

Mir.1. On 23 April the Indians fired on a Pakistan patrol opposite Chak SubhanThe patrol was well within Pakistan territory.

2. On the night of 23/2 April, Indian soldiers encroached into Pakistanarea and occupied high features north of the cease-fire line in Minimarg sector.The next morning Indians fired on a Pakistan patrol which was on routine patrol.The Indians were bringing in additional troops to reinforce their positions.

B. Kashmer sector

1. On 27 April at Ohio hours the Indians attacked a Pakistan post inLipa sector. The attack was preceded by heavy artillery and mortar fire.

2. On h May at 0 30 hours the Indians attacked another Pakistan post inLipa sector with two companies preceded by heavy artillery and mortar bombardment.

The Government of Pakistan has lodged a protest with the Government of Indiaagainst these serious violations of the cease-fire and asked them to take immediatesteps to ensure that such incidents were not repeated.

Your Excellency has been kept in touch with the continuing cease-fireviolations and the increasing scale and intensity of the incidents. Since thecessation of hostilities, well over 250 cease-fire violations, many of themserious, have been committed by the Indian armed forces. The need for reactivatingthe functions of the UNMOGIP observers on the Indian side of the cease-fire lineto enable them to supervise the cease-fire and to discharge their function ofreporting to Your Excellency on its observance has also been brought to yournotice. Reference in this connexion may kindly be made to our note No. 67 -3/71,

I have the honour, under instructions of my Government, to refer to YourExcellency's report on the implementation of Security Council resolution307 (1971) contained in Security Council document S/loW>7/Add.3, dated29 January 1972, and to invite Your Excellency's attention to the continuingrefusal by India to accord to the United Nations Military Observer Group in Indiaand Pakistan necessary facilities for movement and observation to enable them toverify complaints of cease-fire violations and otherwise discharge their functionof reporting to Your Excellency on the observance of the cease-fire. Whilestressing the need for such freedom of movement and observation for the Observersin paragraphs 6 to 8 of the report referred to above, Your Excellency had statedthat discussions in this regard between Pakistan military authorities and theChief United Nations Military Observer and his senior Military Assistants hadbeen satisfactorily concluded. Your Excellency had added that discussions withthe Indian authorities were continuing.

Although four months have elapsed since the cease-fire came into effect andthree months since Your Excellency's report was circulated, the Indian Governmenthave persisted in their refusal to accord necessary freedom of movement to theObservers. This is a matter of serious concern in view of the continuing threatto the durability of the cease-fire. Since the cessation of hostilities asmany as 2^1 cease-fire violations, many of them serious, have been committed bythe Indian armed forces.

While, as known to Your Excellency, the Government of Pakistan have providedall facilities to the United Nations Military Observer Group to investigatereported violations of the cease-fire and have assured the Chief Military Observerthat the United Nations Field Observers were at liberty to move within theirareas of responsibility, the Indian authorities have not only denied correspondingfacilities but have also tried to bypass the UNMOGIP machinery in matters arisingout of cease-fire violations.

The Indian attitude not only contravenes the Security Council resolution307 (1971) dated 21 December 1971, which in operative paragraph 1 acceptsUNMOGIP1s responsibility for supervision of the cease-fire line in Jammu and

I have the honour, under instructions from my Government, to invite YourExcellency's immediate attention to the serious concern of the Government ofPakistan over the reported intention on the part of the Indian Government to handover a substantial number of Pakistan prisoners of war to the "Bangla Desh'1'authorities for trial as "war criminals".

2. The holding of such trials, coming in the wake of the recent killings ofPakistan prisoners of war at the Ranchi and Ramgarh POW camps in India and thereports of the ICRC delegates of maltreatment and humiliations meted out toPakistan prisoners of war, is bound to exacerbate tensions in the subcontinent andto complicate an already difficult situation between the two countries. Thehanding over to "Bangla Desh" by India of Pakistan prisoners of war would "be aclear violation of the Geneva Conventions of 19 9 and will further delay, and inother ways make more difficult, the implementation of Security Councilresolution 307 (l97l) of 21 December 1971.

3. Both India and Pakistan have formally accepted Security Councilresolution 307 (1971) of 21 December 1971? operative paragraph 3 of which states:

''Calls upon all those concerned to take all measures necessary to preservehuman life and for the observance of the Geneva Conventions of 19 9 andto apply in full their provisions as regards the protection of the woundedand sick, prisoners of war and civilian population."

k. The Foreign Minister of India, Sardar Swaran Singh, in his statement afterthe adoption of the resolution, categorically stated, at the l621st meeting of theSecurity Council on 21 December 1971 (S/PV.1621):

"We have made it amply clear that the Indian armed forces shall be withdrawnfrom Bangla Desh as soon as practicable. With the independence »f Bangla Deshand the surrender of Pakistan troops there, their earliest possiblerepatriation from the eastern theatre has to be arranged. They are under

I have the honour, under instructions of my Government, to invite yourExcellency's attention to the steadily worsening treatment of the Pakistaniprisoners of war by the Indian authorities. Through my letter dated10 March 1972 (S/10!?6o), I had informed' your Excellency of the incident on7 March at the Ranchi Prisoners of War Camp in India, in which Indian guardsopened fire on Pakistani prisoners of war. According to Indian authorities,12 Pakistani prisoners of war were killed and an undetermined number seriouslyinjured. Since then, the Indian Defence'Minister has admitted in the IndianParliament the killing in an unidentified camp of one more Pakistani prisonerof war by an Indian guard. Your Excellency has also been apprised of India'sfailure to honour its commitment, made under the auspices of the International.Red Cross, for repatriation of the seriously wounded and sick prisoners of war,their families, army doctors and para-medics, in accordance with therequirements of the relevant Geneva Convention.

2. Serious complaints continue to be received regarding the maltreatment ofthe Pakistani prisoners of war. In describing conditions at the prisoners ofwar camp number 90 in Ambala, the latest official report of the delegates ofthe International Committee of the Red Cross has mentioned cases of officersbeing placed in solitary confinement for several days and the subjection ofone officer to electric shocks. The report also mentions complaints regardingoffensive comments made by Indian authorities at the Ranchi camp about thereligious susceptibilities of Pakistani Officers and the humiliating treatmentthrough certain methods of interrogation accorded to the prisoners by Indianintelligence authorities. According to the report, the Pakistani prisonersof war were subjected to public ridicule during their journey to the camp.At the camp, the Officers are not being provided with clothing in accordancewith their status.

3. The official report of the ICRC delegates also stated that the Mujahids(para-military) were not being treated at par with the regulars. There werealso serious complaints that civilian prisoners of war were being deprived ofmany facilities to which they were entitled.

I have the honour, under instructions of my Government, to refer to YourExcellency's report on the good offices mission of your Special Representativefor humanitarian problems under Security Council resolution 307 (1971) containedin Security Council documents S/10512/Add.l, dated 26 February and S/10512/Add.l/Corr.l, dated 28 February 1972, and to invite Your Excellency's attention tothe following points: • "

1. ' Although it was, presumably, not the intention of the report, the statementin paragraph lU that "the President insisted that questions of repatriationcould not be divorced from the over-all settlement that Islamabad would wish toreach with Delhi and Dac-ca on all outstanding matters", is capable of beinginterpreted as relating to repatriation of prisoners of war as well, which wouldnot be in keeping with Pakistan's stand in the matter or with the requirements ofthe relevant Geneva Convention, the observance of which has been enjoined by theSecurity Counc-il in paragraph 3 of its resolution 307 (1971) of'21 December 1971.

2. As Your Excellency is aware, the President of Pakistan has urged on more thanone occasion that in keeping with the Geneva Convention on the subject, theprisoners of war should be released and repatriated immediately.

3. The President had also reiterated to Mr. Vittorio Winspeare-Guicciardi,"his deep grief at the plight of the Biharis and other non-Bengalis in EastPakistan and his desire to help them". Paragraph 13 of Your Excellency's reporthowever, no doubt for the sake of brevity, restricts itself to quoting thePresident as "expressing an interest" in the matter.

2. These continuing incidents, involving most brutal killing of helpless Pakistanprisoners of war at the hands of Indian guards is a matter of serious concern tothe Government and the people of Pakistan. I have been instructed to inviteYour Excellency's attention to the situation and to request you to be good enoughto take up the matter strongly with the Government of India with a view toensuring that an impartial inquiry is made immediately into the killings ofPakistan prisoners and effective steps taken to prevent a repetition of suchincidents in future.

1. I have the honour, under instructions of my Government, to bring to YourExcellency's notice the deteriorating situation resulting from further cease-fireviolations by the Indian armed forces. My Government has lodged a strong protestwith the Government of India, through the Swiss Embassy in Islamabad, againstthese violations, which included unprovoked firing with automatic weapons, crossingof the cease-fire line by the Indian forces and intrusion into Pakistan's airspace by Indian aircraft.

2. In Jammu and Kashmir, during a period of four days, from 6 March to 9 March,as many as 20 cease-fire violations were committed by the Indian forces. InTithwal area, an Indian platoon crossed the cease-fire line and fired at Pakistanpositions with machine-guns and heavy mortars. Similar attacks occurred inChakoti, Hajira, Mirpur and other areas.

3. Cease-fire violations were also committed by the Indians in the Rajisthan andSulaimanki sectors. In the Kanangpur area of Sulaimanki sector, the Indiansattacked Pakistan's forward positions with automatic .weapons.

U. I have also been instructed by my Government to inform you of the continuingviolations of Pakistan's air space by Indian aircraft. There were intrusions byIndian Air Force planes in Jammu and Kashmir on 20 February, 28 February and10 March. On 20 February, a Vampire aircraft of the Indian Air Force penetratedseven miles inside north-east Kargil. An Indian helicopter carried out aerialreconnaisance in the Kotli area on 28 February, and a C-119 type Indian aircraftpenetrated 12 miles in the Kargil area on 10 March.

I have now been instructed to inform Your Excellency of aserious incident involving a raid today by 100 armed Indian soldiers against thevillage of Khubri (Tehsil Chachro) of Tharparkar district in the province ofSind in Pakistan. The raiding party kidnapped 50 Pakistan citizens afterovercoming the resistance of a small police force.

2. The Government of Pakistan is seriously concerned about the situation posedby the increasing intensity and scope of armed Indian attacks. I have beeninstructed to request Your Excellency to urge upon the Government of India theneed for putting an immediate stop to such serious provocations and breaches of thecease-fire. In this connexion Your Excellency's attention is also invited to theproposal made by my Government through our letter to the President of the SecurityCouncil dated 2U January 1972 (S/10525) for stationing of United Nations observersto ensure supervision of the cease-fire in terms of paragraph 1 of SecurityCouncil resolution 307 (1971).

I have the honour, under the instructions of my Government, to inform yourExcellency of the deteriorating situation resulting from continuing cease-fireviolations "by the Indian armed forces. In the Jammu and Kashmir sector alone theIndians committed 5^- cease-fire violations from 9 February to 27 February. Theseviolations included unprovoked firing by Indian forces on Pakistan troops, crossingof the cease-fire line, digging trenches and construction of bunkers by the Indianforces.

At the same time, the Indian air force violated Pakistan's air space on anumber of occasions. There were five such violations between 20 February and26 February in the Sialkot, Lahore, Kasur, Bhawalnagar and Rajasthan areas. Theaircraft used by the Indian air force in these violations included jets, helicoptersand light aircraft.

The Government of Pakistan has conveyed its serious concern to the IndianGovernment through the Swiss Embassy over these increasing violations which areplacing a serious strain upon the cease-fire arrangements.

I have the honour, under instructions of my Government., to invite YourExcellency's .attention to an incident that took place in an unidentifiedprisoners-of-war camp in India in which Indian guards opened fire on, andbrutally attacked, Pakistani prisoners of war causing a number of deaths andinjuries. This has been admitted by the Indian authorities and confirmed bygovernment-owned All India Radio. The incident has caused deep shock and profoundsorrow to the Government and the people of Pakistan.

This inhuman attack on helpless prisoners, in violation of the GenevaConventions and of .all norms of civilized behaviour, is an outcome of thecontinued illegal detention of the prisoners in a blatant attempt to coerce theGovernment of Pakistan into acceptance of arrangements injurious to Pakistan'sinterests. If the Security Council resolution 307 (71) of 21 December, and theGeneva Convention about repatriation of prisoners of war on cessation of activehostilities, had been implemented by India, this tragedy would not have occurred.

In this connexion, I have been instructed to inform Your Excellency that theGovernment of India have repeatedly changed their stand and introduced newconditions with regard to the repatriation of sick and wounded prisoners of war.It will be recalled that although, the Indian wounded and sick prisoners of warwere flown out to India on the agreed date in an ICRC plane, the repatriation ofthe first batch of wounded and disabled Pakistani prisoners was put off by India'several times on various pretexts. India has now gone back on the undertaking,given through the ICRC, to repatriate the remaining seriously sick and woundedPakistani prisoners of war. It will be recalled that this undertaking called forthe repatriation of these soldiers to commence on 5 March and then to continue onthe 12th and subsequent dates in March. To justify its non-compliance, India nowclaims that the repatriation of Pakistani prisoners has been held up pendingconcurrence of the Dacca authorities. Having secured from Pakistan the releaseof its prisoners of war, India is now prevaricating and using the unfortunatePakistani prisoners for political ends. India's stand is a clear violation ofarticle 188 of the Third Geneva Convention which unequivocally and withoutpreconditions obligates the Detaining Power to release and repatriate prisonersof war immediately on cessation of hostilities.

In continuation of the letter dated 2k January 1972 from the PermanentRepresentative of Pakistan to the United Nations (S/1052U), vhich listed cease-fireviolations by the Indian armed forces till 23 January 1972, I have the honour toforward, under the instructions of my Government, particulars of certain earliercease-fire violations from 6 January to 10 January 1972. These violations arelisted in the annex to this letter.

Aggressive breaches of the cease-fire have not been confined to occasional,minor infractions but have taken the form of attempts by the Indian forces tocapture territory on the Pakistan side of the cease-fire line and of veryfrequent, heavy shelling of Pakistani positions.

With reference to your notes of 26 December 1971 and 1 January 1972, I wouldwish to inform you of the position, in so far as it relates to my Government, onthe various allegations made in the letters dated 21, 25 and 30 December 1971sent to you by the Permanent Representative of Pakistan.

The allegations regarding large-scale atrocities and mass murders, as wellas lawless elements being on the loose in Dacca, are false and untenable. Therecent international press reports from Bangla Desh testify to the wildness andexaggeration of these allegations. The Government of India, whose forces are atpresent in the area on the request of the Eangla Desh Government, are doing theirutmost, in co-operation with that Government, to prevent the natural resentmentof the people against their former oppressors from erupting into violence. Theirefforts in this respect have met with much success, and full facilities havealso been given to the International Red Cross to bring help and relief to thosewho are in need.

The people of Bangla Desh were subjected by the former Pakistan militaryregime and its collaborators to massive violence and all kinds of brutalities formany months. This continued unabated right up to the surrender of the Pakistanmilitary occupation forces in Bangla Desh. Even in the week preceding thesurrender 3 Pakistani troops, para-military forces and armed organizations like theBadar Bahini and Razakars, committed mass murders, rape and looting all over thecountry. They systematically liquidated professionals and intellectuals in thecities of Dacca, Khulna and Jessore as late as 15 December 1971. Mass graves ofthese unfortunate people were discovered by the Bangla Desh and Indian forcessoon after they reached these cities. It is a measure of the success with whichlaw and order is being restored in Bangla Desh that natural local anger andresentment over these recent horrible incidents has not led to widespread violence.Instead, the consolidation of normalcy has received a powerful impetus with thereturn of Prime Minister Sheikh Mujibur Rahman to his people, and we are gratifiedthat the Government of Pakistan have at last released him. While there hadearlier been some unfortunate incidents, which received much internationalpublicity, it is noteworthy that they were both few and isolated. Even these fewincidents need be seen in the perspective of widespread public resentment followingmonths of massive repression. Prime Minister Sheikh Mujibur Rahman has moreover

In continuation of my letter of 30 December 1971, I have the honour to draw

your attention to the following further instances of serious cease-fire violations

by Pakistan: . ' '

1. On 28 December 1971 at 1630 hours Pakistani troops attacked an Indian

base in the area 8 1/2 miles south-west of Uri. The attack was repulsed, and one

junior commissioned officer and two other ranks belonging to 51 Baluch of Pakistan

Armed Forces were captured with their personal arms.

2. From 2200 hours on 28 December 1971 to 0500 hours on 29 December 1971,

Pakistani troops fired with artillery and small arms intermittently towards an

Indian post in the area 9 1/2 miles west-soutn-west of Uri. The Pakistan firing

recommenced again in the same area at 1530 hours on 29 December 1971, and was

returned.

3. en 29 December 1971, at 1030 hours, one Pakistani light aircraft flew

approximately 600 yards inside Indian territory in the area 7 miles north-west of

Ajnala in Punjab. On the same day, one Pakistani light aircraft intruded over

Indian territory 16 miles west-south-west of Amritsar, and a Pakistani helicopter

intruded about 500 yards in the area 18 miles west-south-west of Amritsar. In each

case, the aircraft was engaged by small arms ground fire.

k. On 29 December 1971, at 1600 hours, Pakistani troops fired 15 rounds

of LMG on Indian troops in the area 6 1/2 miles south-south-west of Naoshera. The

fire was returned with one reported Pakistani casualty.

5. On 3» December 1971, Pakistani troops opened fire with mortars and machine

guns on Indian troops in the areas 8 miles west-south-west of Uri and also 7 miles

south-east of Uri. The fire was returned.

Letter dated 31 December 1971 from theJPermanent Representativeof Pakistan addressed to the Secretary^General "

I am instructed to convey to you my Government's serious and most anxious

concern over official Indian statements, reported in the press, contemplating a

so-called "trial" of Dr. A.M. Malik, Governor of East Pakistan, his Ministers and

other high government and civilian officials in East Pakistan, as also of

prisoners of war "accused of serious crimes". The statements indicate that before

repatriation of prisoners of war and other detainees could take place, a list of

"criminals", prepared "by the so-called "Bangla Desh Government" 3 would "be

delivered to the Indian Government. It seems that these and similar statements

"by Indian spokesmen are meant to prepare world opinion for the intended handover

of civilian officials and prisoners of war to the "Bangla Desh authorities" in

Dacca.

2. My Government considers that the action reportedly contemplated would

constitute a flagrant violation of India's inescapable legal obligation to

observe the Geneva Conventions. It would also be a defiance of resolution 307 (1971)

of the Security Council.

3. The Geneva Conventions expressly stipulate that, in conflicts of an

international character, the responsibility for the safety and security of

prisoners of war and civilian persons is that of the Detaining or Occupying Power.

In the present conflict between India 'and Pakistan, the "Detaining Power", with

respect to the prisoners of war, and the "Occupying Power", with respect to

civilian persons, is India. The so-called "Bangla Desh" authorities have no

loeus standi and cannot be allowed to render inoperative the protection which India

is enjoined by the Geneva Conventions to afford to the prisoners of war andcivilian persons.

**. It vould be nothing but an evasion of India's obligations to afford such

protection if it brought charges of the kind contemplated by it against the

Under the instructions of my Government, I have the honour to draw your

attention to the following instances of serious violations by Pakistani armed

forces of the cease-fire since the adoption of Security Council resolution 307

(1971) on 21 December 1971:

1. On 21 December 1971 Pakistani troops attacked Indian troops from an area

9 miles south-west of Uri. The attack was repulsed.

2. On 22 December 1971 Pakistani troops opened fire with artillery and

armour on Indian troops in the area 5 1/2 miles west-north-west and 5 miles

north-west of Karanpur in Punjab. The fire was returned.

3. On 25 December 1971, Pakistani troops opened fire with light machine guns

and 2-inch mortars on Indian troops from the area 7 miles south of Atari in Punjab.

The fire was returned and the action continued on the night of 25/26 December 1971.

h. On 26 December 1971, one Pakistani light aircraft intruded approximately

200 yards into Indian territory in the area 7 miles north-west of Ajnala in Punjab.

The aircraft was engaged with small arms fire.

5. On the night of 26/27 December 1971 Pakistani troops shelled

intermittently the area 20 miles south-west of Amritsar.

6. On 27 December 1971, one Pakistani light aircraft flew over Indian border

posts in the area 22 miles north-west of Amritsar.

7. On 27 December 1971» 10 Pakistani armed personnel intruded into Indian

territory in the area 15 miles north of Khemkaran, and retreated when fired upon.

8. On 27 December 1971, at about 1820 hours Pakistani troops of one platoon

strength supported by six tanks and elements of RECCE and support battalion,

ingressed" about 50 yards inside Indian territory across the international boundary

I am instructed by the Government of Pakistan to put on record the fact,

already reported in the world press, that, on 27 December 1971, the President of

Pakistan initiated direct discussions with Sheikh Mujibur Rahman, an elected leader

of Pakistan who represents the people of East Pakistan, with regard to a political

settlement of the East Pakistan problem. The President stated that the talks would

continue and would be guided by the wishes and aspirations of the people.

2. The Government of Pakistan considers it appropriate to declare that any act

by any government with regard to a part of the territory of Pakistan forcibly

occupied by a foreign power which would prejudge or prejudice the outcome of these

negotiations or be detrimental to the integrity of Pakistan would not only be a

hostile act against Pakistan but also unwarranted and wholly contrary to the basic

norms of international relations.

3. I shall be grateful if this letter is circulated as a document of the Security

Council.

The Permanent Representative of Pakistan to the United Nations presents his

compliments to the Secretary-General of the United Nations and under instructions

of his Government wishes to bring to the attention of the Secretary-General certain

deplorable aspects of India's present aggression against Pakistan.

The Indian Air Force has resorted to systematic and deliberate bombing of

civilian targets in Pakistan, particularly in the Lahore area. On ih December 1971

four 500-pound bombs were dropped over civilian areas in Cotlakhpat, a suburb of

Lahore. Twenty-five civilians, including 15 children, were killed in this raid and

another 28 were seriously injured. Next day, the Indian Air Force dropped

11 500-pound bombs and four 1,000-pound bombs over Misrishah in the heart of Lahore.

Fifty-four dead bodies were recovered and more are still being unearthed from under

the debris. A total of 125 people received serious injuries in the bombing of

Misrishah. Among the people killed and injured are several children from a boys'

school situated in the locality.

The Permanent Representative of Pakistan requests that this be circulated as

a document of the Security Council and the General Assembly.

The Permanent Representative of Pakistan to the United Nations presents his

compliments to the Secretary-General of the United Nations and under instructions

of the Government of Pakistan is constrained to bring to the attention of the

Secretary-General some deplorable aspects of the actions undertaken by the

Government of India in its present aggression against Pakistan.

The General Assembly, in operative paragraph U of its resolution 2793 (XXVI),

urged "that every effort be made to safeguard the lives and well-being of the

civilian population in the area of conflict". From a purely legal point of view,

a blockade is considered a legitimate instrument once a state of war exists

between two countries. However, in its blockade of East Pakistan, India has

detained a large number of coasters and minibulkers engaged in the transportation

of foodgrains and relief supplies from the seaports to up-country stations. Though

there are adequate stocks of food supply available, the means of supplying these to

the areas experiencing shortages have been seriously disrupted. As a direct

consequence of this, the United Nations relief operations in East Pakistan have

come to an end. India's action in deliberately and callously inducing widespread

starvation and famine in East Pakistan cannot but be considered as an outrage to

world conscience.

immediately to submit a report to the Security Council on the implementation of the
