We are not aware of any potential conflict of interest for TMA to participate in this project for the Pelham Union Free School District.

Staffing

Tim Miller Associates has on staff seven senior professionals. including American Institute of Certified Planners (AICP) and Registered Landscape Architects (RLA) credentials. All projects undertaken by TMA are performed under the direction of a pOint of contact who is the professional in charge. Mr. Frederick Wells, RLA, will be the project manager responsible for coordinating all services provided under this assignment. Mr. Wells is a Senior Vice President, Senior Planner and NYS Registered Landscape Architect at TMA, and has over 35 years of experience in environmental review, site planning and permitting. Mr. Wells has worked for over half of the schools listed above, and others.

We will engage a professional archaeologist for a cultural resource investigation and initial submission to the State Historic Preservation Office regarding the demolition of the historic building. TMA has in-house capabilities for all other technical work that is typically required for the scope of services outlined herein.

For this assignment we will subcontract with Hudson Valley Cultural Resource Consultants, Ltd., of Poughkeepsie, NY (a Women Owned Business Enterprise. WBE). HVCRC Principals have extensive experience in all phases of archaeological investigation, fieldwork and documentation in accordance with Federal and State standards. Specifically relating to the Hutchinson School project. HVCRC has worked with the NYSDEC and the State Historic Preservation Office (SHPO) in obtaining approvals for building mitigation plans prior to

historic building demolition. This work typically includes documentation of the historic property and its past use and an architectural analysis. More information on HVCRC's experience and services can be found at their website: hvculturalresources.com

Scope of Services

We have discussed the overall concept of the proposed demolition of the existing building and construction of a new Hutchinson Elementary School building and site facilities with Russ Davidson at KG+D Architects and understand that the concept plan that we reviewed will have changes as the planning effort continues. The scope of the project being considered appears to be of a size that would be considered an 'Unlisted' action and could be reviewed with an "expanded' environmental assessment pursuant to 6 NYCRR Part 617 (SEORA). However, this proposal includes tasks required to process an environmental impact statement (EIS) if required. An action that could result in one or more significant impacts that cannot be mitigated would require and EIS.

We also acknowledge the possible additional projects under consideration by the District listed in Appendix A of the RFP which would need to be appropriately addressed in the environmental review process.

The SEORA process has a number of finite steps that we would assist the District in following. Typically, the District Board of Education ("the Board") is the Lead Agency for the SEOR review. The following steps would suit a project detennined to be an Unlisted action that would not result in a signficant impact to the environment.

1. Environmental Assessment Form (EAF) Part 1 and e Project Description are prepared to describe the ection, and the School District circulates its proposal to other approvals agencies with a Notice of Intent to be SEQRA Lead Agency.

2. EAF Part 2 end supplemental Part 3 narratives are prepared in coordination with the Project Team. Supplements expand on issues of concern for review of potential impacts.

3. A Determination of Environmental Significance is drafted based on the foregoing documents. Adoption end filing of e Negative Declaretion by the Lead Agency will conclude the SEQRA process. Adoption of a Positive Declaration would initiate more extensive review with an ElS.

Task 1: Agency Coordination with EAF

TMA will prepare Part 1 of New York State's Environmental Assessment Form (EAF) once the overall program and conceptual design plan are reasonably advanced (building size, layout and grading for building and circulation, building and site activities). This task will include the initial research and data collection for the subsequent studies anticipated. We will develop a project description narrative and identify the agencies from which permits or approvals will be needed ("involved agencies") in consultation with the project team (e.g. architect, engineer, attorney, construction manager, District representatives). We will assemble a package with the EAF Part 1, project description and location map, the architect's conceptual site plan, and a letter of intent to be SEORA Lead Agency, for circulation to the involved agencies in accordance with 6 NYCRR 617.6.

Presuming that no other agency objects to the District becoming the lead agency, the District would be responsible for determining whether there is any environmental area of concem that rises to the level of needing examination and mitigation In a Draft Environmental Impact Statement (DEIS). TMA will prepare EAF Part 2 to identify the topics of potential environmental concem and level of potential significance. Multiple sites can be addressed in one form.

1A: Cultural Resources

Information in the State's cultural resources database indicates that a prehistoric site was identified on the Hutchinson School grounds which will need to be investigated. The building appears to be National Register Eligible based on architectural style and age. The State Historic Preservation Office (SHPO) will require a full Phase 1 Cultural Resources Survey of the propertY prior to issuance of any State permit. The State database does not indicate a survey has been done for this site.

We propose to conduct a Phase 1 study of the propertY consisting of background research (1 A) and field testing (18) to the extent needed for the preparation of a report to be submitted to the SHPO. Reid testing would Involve physical disturbance (digging) in level areas of the propertY and would need to be coordinated with school activities and the weather. A description of the historic integrity of the existing school building will be Included for SHPO review.

Presuming the SHPO will consider the building is Historic Register Eligible, It will be looking for altematives to demolition and then possibly a building mitigation plan. We will prepare an altematives summary report to be submitted to the SHPO. We will look to KG+D Architects and the District to compile alternative plans, the cost of renovations and upkeep and any other substantiations that support the District's decision to remove the building. The SHPO would review the altematives analYSis (and possibly request additional information) prior to its concurrence with demolition.

Included in this Task is initial submission of the Phase 1A118 report, building evaluation and altematives report to the SHPO. Subsequent additional coordination effort is expected to be required to obtain SHPO authorization (a Letter of Resolution) to demolish the building. This effort is likely to extend beyond the SEQR review period and cannot be estimated at this time.

Task 2: Environmental Supplements to the EAF

Note: Tasks 2 & 2A would be omitted if an EIS is required.

Proceeding with the objective that any and all potential impacts of the project will be avoided or reduced to insignificant levels, TMA will prepare supplemental assessments as a "Part 3" to substantiate a determination of environmental non-significance. All relevant subject areas will be examined at a level of detail commensurate with the degree and importance of potential impacts and in conformance with the requirements of SEQRA. We will work with the project team to formulate mitigation measures where possible to minimize potential impacts.

The Part 3 supplements must address subject areas where a potentially moderate to large impact could occur using the standard that a "hard look" has been taken. These may include any or all of the following topics. While most of these areas of concern are unlikely to rise to the potential for an adverse impact, State guidelines require that they be reviewed and evaluated to the extent that a 'hard look" has been made.

Based on what we know right now, we estimate the necessary effort on the Part 3 analyses for the Hutchinson School site would be limited to:

• construction impacts (noise, air quality, dust, vibration from heavy construction, construction traffic),

• impacts to land resources (earthwork, rock removal), • impacts to water resources (stormwater management), • impact on traffic (changes in trip generation, bus and parent dropoff/pickup activity), • impact on cultural resources (possible archaeological site, historic building evaluation,

altematives to demolition), and • impact to community character (related to visual).

We will coordinate with and rely on KG+D Architects or project engineer relative to any architecture and engineering input needed for the EAF as may relate to the project description. site grading. drainage plans and stormwater management. building plans. and site utilities. We will also look to KG+D to provide information for the project description. the architectural characteristics of the existing building. and alternatives to its demolition. Any soil or other geophysical testing for engineering capabilities. topographic surveys. or other engineering-related work will need to be done by others. to the extent it is needed. We anticipate that the District will provide information on the funding and fiscal implications of the project if needed for the EAF.

We will circulate the draft EAF to the project team for review and comment. We have budgeted for one round of team revisions prior to submission of the document to the Board. Substantial revisions to any analysis completed. additional analysis. or changes in the proposed program that affect our work product (including a change in site access or circulation. building size or orientation of site features) after our work is initiated may require effort and cost above that outlined herein.

After team review and revisions. we will assemble and deliver the "Expanded EAF" document (Parts 1. 2 and 3) to the Board for its consideration.

2A: Additional Site Assessments

The possible additional projects under consideration by the District listed in the RFP involve up to five additional sites that would need to be considered for applicable topic areas listed above. For this proposal we have provided an average cost to evaluate each additional site.

Task 3: Determination of SignifICance

TMA will assist the Board in reviewing the EAF materials. as needed. to decide on the environmental significance of the proposed action. Based on the Expanded EAF document. if the Board determines that the project will not result in significant adverse effects. TMA will prepare a Determination of Non-Significance (Negative Declaration) and a resolution for the Board to adopt said Determination. Alternatively. if the Board determines that the project may result in one or more significant adverse effects for which a DEIS is needed. TMA will prepare a Determination of Significance (Positive Declaration) and a resolution for the Board to adopt said Determination. TMA will distribute and file the adopted Determination in accordance with 6 NYCRR 617.12(b).

Adoption of a Negative Declaration will conclude the SEQRA review process and allow the Board to proceed with scheduling a bond referendum.

Environmental Impact Statement

Note: Tasks 4A & 4B would be omitted if a Negative Declaration is adopted.

If Tasks 1. 2 or 3 result in a determination that the project could cause one or more Significant environmental impacts that cannot be avoided or mitigated and a Positive Declaration is made. the following steps outline the subsequent SEQR process necessary:

4A: Draft Environmental Impact Statement

Scoping to determine the contents of the Draft Environmental Impact Statement (EIS) is usually a public process. We will prepare a Draft Scope for the Draft EIS, which would be made available to the public prior to holding a public scoping meeting. A Scope is finalized and adopted by the Lead Agency based on the input from the scoping session.

We will prepare a Draft EIS per the requirements of the Scope adopted by the District Board of Education and in conformance with the requirements of SEQRA. Our work would focus on those areas already expected to be of concem (six bulleted topiCS listed in Task 2). All subject areas would be reviewed at a level of detail commensurate with the degree and importance ' of potential impacts. Both negative and poSitive implications would be addressed.

We would rely on the architect or engineer to provide engineering input to the Draft EIS: site grading plans, cut and fill estimates, roadway design and profiles, erosion control plans, stormwater management plans, and site utilities report. The architect or engineer may also need to develop design altematives if required by the Scope.

TMA has in-house capabilities for all technical environmental assessments that is typically required for an EIS. The cost we have estimated for this task accounts for assessments on the six topics identified above.

We will circulate !he preliminary DEIS to the team for review. We generally antiCipate one round of team revisions prior to acceptance. Substantial alterations to the project design after the DEIS work has been initiated or substantial revisions to the DE IS analyses required by team comments may require effort above that proposed herein.

Upon acceptance of the Draft EIS as complete by the Lead Agency, it is reproduced and distributed to involved agencies and interested parties and made available to the general public.

48: Final Environmental Impact Statement

A Public Hearing is scheduled on the Draft EIS and the project plans. We would make a presentation of the project and explain the SEQR process at the hearing. The proceeding is recorded and all comments received during the mandatory public review period are compiled

and responded to in the Final EIS. TMA will prepare the Final EIS as an addendum to the Draft EIS. Often details of the project and negotiated mitigation measures are presented in the Final EIS and become the basis for the SEQR Findings. This task thus includes preparation of the preliminary Final EIS for team review and subsequent revisions.

Upon acceptance of the FEIS as complete by the Lead Agency. it is reproduced and distributed like the DEIS. We will then draft a Findings Statement to be submitted to the Lead Agency for its consideration.

Adoption of a Findings Statement will conclude the SEQRA review process and allow the Board to proceed with scheduling a bond referendum.

Task 5: Coordination, Meetings, Planning Support

The District may wish to hold one or more public information meetings to ascertain if the program will be perceived to result in potential adverse impacts. We will be available to participate in such meetings and assist the team in identifying public concerns with an eye toward mitigating them. However. no formal response to comments obtained at a public meeting is included in this task.

TMA staff will be available to attend project meetings upon request, prepare meeting notes and project memos as necessary. coordinate and produce copies of documents. and coordinate those activities as may be needed by the project team relative to schedules and activities connected with the above tasks. We will provide draft notices relating to hearings. newspaper noticing, and other SEQRA-related noticing and filings as needed. and provide project planning advice to the team during the SEQRA process.

Exclusions

Our work under this proposal does not include any architectural, landscape architectural or engineering studies, surveys or inventories, site design, or testing. As stated in Task 1A, the coordination effort with SHPO to obtain its authorization to demolish the Hutchinson School building will likely extend beyond the SEQR review period and the effort beyond the initial submission to SHPO is not included in this proposal.

Schedule, Fees and Miscellaneous

Tasks 1 and 1A can be initiated within two weeks of authorization to proceed. The EAF Part 1 can be submitted to the District within two weeks after receipt of a conceptual site plan from the project architect. We will promptly proceed with work under Task 2. which we estimate can be completed within four to six weeks thereafter. We note that the Phase 1 B work is weather dependent. We provide a cost range which depends on the number of additional sites evaluated.

Tasks 4A and 4B (an EIS) would replace Tasks 2 and 2A. The schedule for an EIS is entirely dependent on the extent of the Scope. We provide a cost range for typical Draft and Final EIS preparation and processing.

Once the scope of possible additional projects under consideration is decided, we will work with the project architect, legal counsel and District representatives to develop a timeline for the environmental review and we will proceed with the outlined tasks expeditiously and in cooperation with the team toward an accepted target date for the District to have a Board vote to proceed to a referendum.

Fee Schedule

We are providing a labor fee estimate for the tasks outlined above based on our experience on other projects of similar complexity and scope. There can be great variation in the level of effort and analyses necessary to prepare an Expanded EAF or an EIS, particularly if there is controversy or local opposition to the project. Schedules and fees outlined herein are subject to timely receipt of necessary information from the project team and are predicated on limited if any negative public response to the SEQR materials or the project.

For the proposed demolition and replacement of the Hutchinson School, assuming a three month time frame for Tasks 1, 1A, 2 and 3, and a budget of $800 to cover project reimbursable expenses, our cost proposal to complete SEQR with a Negative Declaration is $29,000. The estimated cost for an EIS could range from $55,000 to over $70,000, could take 6-8 months.

Our fee can be expected to increase if design changes take place that require substantial revisions to our work product after work has commenced. Substantial changes in the project description (building or site layout, access changes that affect traffic distribution, etc.) may alter the above fee projections, as will public oPPOsition to the project, comments on the SEQR materials produced, or an unusual number of comments during the public review proceedings that require additional research or analyses. If the project schedule stretches out due to issues outside our control our fee can also be affected.

Should an unanticipated area of concern crop up during SEQRA proceedings (discovery of archaeological artifacts or hazardous materials, traffic issues beyond what is outlined above,

. for example) we will advise the client of the need to adjust our fee accordingly to conduct the additional analyses of potential impacts.

TMA's burdened labor rates are listed on the Fee Schedule form attached. Below are our standard conditions, subject to District approval.

Quoted fees do not include direct costs. Reimbursable direct costs may include mailing and express deliveries, aerial imagery, maps, database and document purchases specific to the project and will be passed on to the client without additional charge. Mileage is charged at

Our work is invoiced monthly based on actual labor and materials expenditures and payments are due upon receipt. Work may be stopped when project invoices are past due more than 60 days. Retainers are held against final invoice. We charge a minimum of four hours for attendance at evening or weekend meetings. Proposals are subject to change after 90 days, if not accepted.
