Tuesday morning starts the FDCC Insurance Coverage Training Academy’s Boot Camp designed from within the insurance industry and its outside counsel to teach 1-5 year lawyers in your offices and firms, as well as more curious senior lawyers the ins and outs of the coverage world all in a day!

You might wonder instead how to ‘boost your game’, and become a more polished, better public speaker. Program Chair Jennifer Johnsen’s fantastic program starts on Wednesday, March 4, with our kick-off speaker Erwin Chemerinsky, Dean of UC Berkeley School of Law. A renowned constitutional law and Supreme Court scholar, the Dean will dazzle all with deep insights into the new composition of the Court, the past term and the upcoming cases on the Court’s 2020 calendar. His knowledge of the Court is beyond measure.

“Stay Ahead of the Curve” through this premier program enabling you to face new and emerging issues, whether you are in-house or outside counsel. Great section programs abound, including a major dissection of a bad faith case.

Thursday’s compelling programming includes Trial Masters to ramp up your trial presentations prepared by trial lawyers for trial lawyers. Then, back by popular demand, is Friday’s Corporate Counsel Symposium Update, programming designed by corporate counsel for corporate counsel. Saturday, we begin with Richard Gergel, United States District Court Judge (South Carolina), about his book, Unexampled Courage: The Blinding of Sgt. Isaac Woodward and the Awakening of President Harry S. Truman and Judge Waties Waring. Judge Gergel’s book has been selected for Book Club and we are thrilled he’ll facilitate that discussion on Friday.

The plenary closes Saturday with an inspiring address focusing on the universal struggles everyone faces and the importance of trusting in one’s own potential. Our keynote speaker, Associate Professor of Law at Georgetown University Shon Hopwood provides his incredible story of transformation from convicted bank robber and jailhouse lawyer. As moving as ever, his story has been aired on “60 Minutes.”

Our meeting honors our American Veterans, with a special presentation of leadership for the Arizona Disabled Veteran Foundation, a 501(c)(3) organization, whose mission it is to support those rendered most vulnerable from their deepest commitment to keep us all free.

The FDCC is pleased to announce the launch of the exclusive Insurance Coverage Training Academy

with its first installment – the CGL Boot Camp to be held in Scottsdale, Arizona, on March 3, 2020.

What will be Covered The immersion-learning program is built around a hypothetical fact pattern and places the attendees directly in the environment, identifying and working through the coverage issues faced most often in commercial liability claims. Some of the highlights of the program include:

• In depth, true-to-life training program with small breakout sessions led by leading coverage attorneys and senior insurance claim executives from around the country.

• Practical hands-on focus on issue spotting, duty to defend considerations, preparing coverage position letters, dissecting additional insured and contractual indemnity tenders, evaluating risk transfer opportunities, and responding to time limit demands.

• Students will be given exemplar coverage position and tender letters to use for future reference.

Who Should AttendThe CGL Boot Camp is open to all FDCC members as well as others within their firms, companies and their clients who may not be members and is targeted to:

• associates who are defense coverage attorneys with one to five years of coverage experience

• insurance claims professionals who can benefit from hands-on training

• experienced defense trial attorneys who want to learn or sharpen their skill sets and learn CGL coverage protocols in the trenches.

Valet parking is available at a charge of $10 per day, or you may self-park.

GETTING THEREWith non-stop flights from just about every major city in the country, the Phoenix Sky Harbor International Airport (PHX) also features non-stop service from Toronto, London’s Heathrow and Gatwick airports, Mexico City, and Frankfurt, Germany. CONVENTION CANCELLATION POLICYRegistrations minus $90 and any applicable credit card fees charged to the FDCC will be refunded if the FDCC office receives written notice no later than February 7, 2020.

No refunds will be made after February 7, 2020. In the event of any “special circumstances” requiring cancellation after February 7, 2020, this refund policy may be amended (based on the member’s written request), only by the FDCC President upon recommendation of the Convention Chair. It is strongly recommended that all registrants purchase trip cancellation insurance. Please note that the FDCC has no authority to modify the hotel’s cancellation or refund policies.

Payments paid to the FDCC for separate events and/or tours may or may not be refunded in whole or in part. The decision to refund these charges will be made on a case by case basis by the Convention Chair, and will be based in part, on the upon timing of the cancellation and the refund policies of the event/tour provider.

WEATHERAt the beginning of March, Scottsdale will feature high’s in the mid-70’s and low’s in the evening in the mid-50’s. We will keep you posted as to the weather conditions as we get closer to our meeting dates.

WHAT TO WEARScottsdale is definitely “country casual” and the JW Camelback is generally “resort casual.”

Committee Meetings and Educational Events: Business casual which includes collared shirts and jeans or slacks for men and jeans, slacks, dresses, skirts and blouses for women.

Activities/Tours: All are casual, and some will require comfortable shoes. Please check the information for each activity. Desert Sands Opening Reception: Business casual will be the theme here. After a day of travel, it will be time to enjoy a beverage and a “nosh” while saying “hello” to old friends and welcoming our newcomers under the beautiful Scottsdale nighttime sky.

President’s Gala: Sonoran Sunset Dinner & Dance: This is the “dressier” evening event, but we’re “out West,” so although no tuxedos, jeans with a regular or bolo tie are “in!” For the ladies, cocktail dresses… and dancing shoes… or boots!

Great American West Theme Party: The Wonder of It All: We will “kick it up” on Mummy Mountain, an “abandoned” Western town on the property of the JW Marriott Camelback. Come as you are or dig out your boots and hats and “belly up” to the bar! Try your hand at Axe Throwing or grab a beer from our “beer burro!” It will be a wonderful evening under the stars… and you might even be able to get a close up view of them…!

KIDSWhile we do not have any specific activities for the kids, many of the offsite activities are definitely “kid friendly.” Please note that some of the tours do suggest participants be at least 21 years of age and, as always, no FDCC members or their guests under the age of 21 may be served or consume alcohol at any FDCC event. SOLOSFDCC has many activities for spouses and significant others, but we also want to make sure those of you attending “solo” enjoy the evening events and have opportunities to become better acquainted with your fellow FDCC members and guests. The registration form will include an opportunity to indicate if you would like to be part of any “solo” plans. Once onsite, we will have opportunities for you to get together with other solo attendees- whether this is your first meeting or your 10th!

CHARMHow could we choose anything other than a camel for our meeting at Camelback!

The Federation started selecting gold charms to commemorate its meetings in 1960. Over the years, it has become a tradition to select a specially designed charm that will bring to mind fond memories of the venue or theme of the meeting. We hope that our camel brings a smile to your face!

FDCC BOOK CLUB SELECTIONUnexampled Courage: The Blinding of Sgt. Isaac Woodard and the Awakening of President Harry S. Truman and Judge J. Waties Waring by Richard Gergel

On February 12, 1946, Sergeant Isaac Woodard, a returning, decorated African American veteran, was removed from a Greyhound bus in Batesburg, South Carolina, after he challenged the bus driver’s disrespectful treatment of him. Woodard, in uniform, was arrested by the local police chief, Lynwood Shull, and beaten and blinded while in custody.

President Harry Truman was outraged by the incident. He established the first presidential commission on civil rights and his Justice Department filed criminal charges against Shull. In July 1948, following his commission’s recommendation, Truman ordered an end to segregation in the U.S. armed forces. An all-white South Carolina jury acquitted Shull, but the presiding judge, J. Waties Waring, was conscience-stricken by the failure of the court system to do justice by the soldier. Waring described the trial as his “baptism of fire,” and began issuing major civil rights decisions from his Charleston courtroom, including his 1951 dissent in Briggs v. Elliott declaring public school segregation per se unconstitutional.

Three years later, the Supreme Court adopted Waring’s language and reasoning in Brown v. Board of Education. Richard Gergel’s Unexampled Courage details the impact of the blinding of Sergeant Woodard on the racial awakening of President Truman and Judge Waring and traces their influential roles in changing the course of America’s civil rights history.

Join the author, Judge Richard Gergel, as he moderates our FDCC Book Club discussion on Friday, March 6 at 11:00 am. Judge Gergel will also address the meeting’s plenary session on Saturday morning, March 7th.

FDCC CHARITYArizona Disabled Veteran Foundation www.advf.net

At each Winter and Summer Meeting, the President of the FDCC selects a local charity to support in the city where we are holding our meeting. At this 2020 Winter Meeting, the FDCC continues this tradition. FDCC President Elizabeth Lorell and her husband Jeff, have selected the Arizona Disabled Veteran Foundation, based in Phoenix as the charity the FDCC will ask our members to support.

The Arizona Disabled Veteran Foundation, Inc. (ADVF) was formed as an organization in 2010 and to aid and assist Arizona’s veteran and particularly Arizona’s disabled veterans. They are a 501(c)3 charity and all contributions to the Foundation stay in Arizona.

Generally, they do not provide services to veterans directly, rather they provide financial assistance to established veteran and non-veteran organizations that provide services to Arizona veterans. The ADVF does have a legal clinic program that has been in operation for the last seven years. They provide clinics across Arizona for veterans and their families to assist in the preparation of wills, medical directives and to provide support with family law issues, debt problems, landlord/tenant issues, etc.

Salt River Fields, opened just in 2011, hits a home run with a brand-new scoreboard for 2020 as the mostly shaded stadium is the Spring Training home for both the D-Backs and the Colorado Rockies of MLB’s National League. 12:30 pm – 4:30 pm Offsite: Annual Indian Fair at The Heard Museum Join with one of the jewels in the Valley of the Sun, the Heard Museum to walk among perhaps the greatest assembly of Native American artistry and culture in a given year. The Heard stands among the world’s foremost sites in presenting the story of the American Indian and carries international recognition of its collection, and among other things, its unmatched festivals. Come with your FDCC friends to be on site as the Heard presents its Annual Indian Fair bringing over 600 American Indian artists representing Nations of Indians together from throughout the Americas. Enjoy the costumery, dances, and magnificent art in this great annual assemblage of the Native American world. You will find this nowhere else! 1:30 pm – 3:30 pm Offsite: Segway Tour of Scottsdale The best way to see Scottsdale! If you can walk upstairs without a handrail, you can ride a Segway! After your instructions and test ride, your guide will take you on a narrated tour around Scottsdale and Old Scottsdale. Tour highlights: San Francisco Giants Spring Training Stadium, The Little Red Schoolhouse, Art Gallery Row, and Main Street Old Scottsdale. Each helmet is fitted with a mic and earbud, so no one misses the narration of the guide.

CAMELBACK MOUNTAIN & PIESTEWA PEAK Hikers can climb to the top of Camelback Mountain beginning at Echo Canyon Park off McDonald Dr. (about a mile from the Resort). This is not an easy climb as aspects of this trail are dangerous and involve considerable climbing. Piestewa (also called Squaw Peak) is a less difficult hiking trail about 4 miles from the Resort.

CAREFREE AND CAVE CREEK Carefree, an exclusive residential and resort area, is a 30-minute drive north on Scottsdale Rd. See the charming Spanish Village with its many fine shops and restaurants. Its neighbor, Cave Creek, is an authentic looking Western town located on some of the most beautiful desert in the Southwest.

EXPLORING SCOTTSDALE ON YOUR OWNScottsdale and the Camelback Mountain area, as well as greater Phoenix, have so many things to do that we couldn’t possibly fit them all into the Winter Meeting. There is something for everyone! Of course, if you like golf and seek to play more than the Winter Meeting’s golf outing on the JW Marriott’s challenging Ambiente Course, there are plenty of golf courses throughout the greater Phoenix area to keep you busy for quite a long time.

As for hiking, this is a desert climate. We have included a wonderful walk/hike opportunity at the Desert Botanical Gardens as an activity this week. There are some fun walks and power walks right in the resort proper and an enjoyable desert hiking loop at the foot of Mummy Mountain behind the resort to the North. Camelback Mountain itself, while the view from the top is spectacular, the ‘hike’ to the top becomes more of a ‘climb’ and can be considered dangerous for most but the more experienced and fit hikers among us. Whatever a hiker would like to tackle, have fun, plan well, be aware of where you are, bring plenty of water to drink, and be aware of the risks of both flora and fauna as well as the terrain.

Please note: Registration cannot be processed until payment is received at FDCC Headquarters. All fees are listed above and are payable in U.S. Currency. Registrations are processed in the order of the date payments are received.

Convention Cancellation Policy

A refund of registration fees less $90 and any applicable credit card fees will be given if the FDCC office receives written notice no later than February 7, 2020.

NO REFUNDS WILL BE GIVEN IF NOTICE OF CANCELLATION IS RECEIVED BY THE FDCC OFFICE AFTER FEBRUARY 7, 2020.

In the event of special circumstances such as illness or unforeseen family or professional emergencies, this refund policy may be suspended or modified (based upon the member’s written request) only by action of the president upon recommendation of the Convention Chair. It is highly recommended that all registrants get trip cancellation insurance.

Please notify the FDCC office by email ([email protected]) to cancel your hotel reservations. Neither the Convention Chair nor the FDCC office has authority to modify the hotel’s cancellation policy.

Charges paid to the FDCC for separate events/activities may or may not be refunded in whole or in part. The decision to refund these will be made on a case-by-case basis by the Convention Chair. Members seeking reimbursement for these payments must submit a written request to the Convention Chair.

The decision to refund fees will be based, in part, on the timing of the cancellation and whether there are available convention funds from which to make the refund. Please note that refunds of any payments to independent third parties for tours and other events and services are not the responsibility of the FDCC.
