• GDPR replaces previous Data Protection Directive

• Data Protection Directive created to regulate control of Personally Identifiable Information (PII)

• GDPR will harmonize data protection laws across 27 EU member states

• Clearer rules for data transfer across borders

• Better control over individual’s data

notification• Heavy non-compliance sanctions• Privacy by design and privacy by default• Right to be forgotten and data portability• Regulations in place now – full start will be 1st May 2018

Guidance on steps to be taken • Brief the board so they are aware of the risks to the business

and what needs to happen over the next two years to get GDPR compliant.

• Appoint/train a Data Protection officer – 28,000 still to be appointed in EU. Maybe this could be the Asset Manager?

• Conduct a data protection / assessment • Review and update existing data protection policies, training,

privacy notices etc• Assess what processing of personal data will need to be

consent based in the future • Implement new compliance tools the business might not have

had previously such as Data Protection Impact Assessments, Security Breach Handling Policy, Data Retention and Destruction Policy, Data Subject Access Request Handling Policy.

• Map personal data sharing around the group and to and from third parties and put in place mechanisms for compliant international personal data transfers.

• Update data processor and security provisions in contracts

Asset Management Best Practices: Summary1. Ensure there is Executive support for the AM Programme2. Establish an end to end plan with adequate budget3. Reduce the size of the Asset and data lake Destroy, clear or sanitize

data prior to asset decommissioning and/or prior to asset leaving your control. Use your outsource partner as the final validation point for data security

4. Develop a strong vendor audit qualification process. Visit the vendor prior to selection and know where your waste stream is going to end up

5. Create rigorous, documented, end-to-end control points and reporting to provide audit trails for any future legal issues

6. Select a partner with a brand name and reputation for trust & integrity – share the risk

7. Remember: Success = People, Processes and Technology8. Define where data management sits and ensure GDPR is

managed
