The Division of Criminal Justice Services (DCJS) works with state and local agencies to ensure collection of DNA from all eligible offenders. Effective August 2012, the DNA Databank was expanded, and presently anyone convicted of any felony in any state law, or any Penal Law misdemeanor, is required to provide a DNA sample. DCJS measures the rate of collection for DNA eligible sentences and provides local collecting agencies with lists of offenders owing a DNA sample. This report shows the number of DNA eligible sentences by county and by month, and the percentage of sentences for which a DNA sample is on file 90 days after sentencing. The 90-day lag allows sufficient time for collecting and processing. In order to appear on this report, an offender must have been convicted of a DNA eligible offense and must have received a sentence that does not include State prison. Although not shown in this report, the Department of Corrections and Community Supervision’s (DOCCS) collection rate is 100%. This report shows 12 months of data based upon sentence date, and the collection rates for DNA-eligible offenders sentenced during the month indicated. DNA Eligible Sentences During Month: Total number of DNA eligible sentences imposed during the month.

DNA On File as of mm/dd/yy: Eligible sentences for which an acceptable DNA sample has been received by the New York State Forensic Investigation Center. No distinction is made between whether a sample was received for the most recent DNA eligible conviction or if the sample was already on file in the DNA Databank from a previous offense.

Outstanding Collections: Number of sentences during the month for which no DNA sample is on file for the offender as of the date of this report.

NOTE: This report is used by law enforcement and other criminal justice agencies to monitor county DNA collections. A listing of outstanding offenders is available to law enforcement through the DNA Services Suite on eJusticeNY, a secure law enforcement network available to authorized criminal justice users only.

Interpretation: In Sample County, during January 2012, the Courts imposed 33 DNA eligible Jail/Split sentences. At the time of this report (4/7/13), DNA was on file for all 33 of the eligible sentences (100%). The percent on file would include if DNA was already on file from a previous conviction. The Probation, Other and Total sections can be interpreted in the same manner.
