Overview

The Texas Juvenile Justice Department's (TJJD) annual activity report provides information regarding the magnitude and nature

of juvenile criminal activity and the juvenile probation system's response. This information is offered to assist the state's effort in

improving the juvenile justice system and reducing juvenile crime in Texas.

During calendar year 2016, police agencies in Texas processed 49,562 arrests of juveniles between the ages of 10 and 16. Not all

arrests resulted in referrals1 to juvenile probation. In 2016, juvenile departments saw 55,174 referrals. Law enforcement accounted for

72.5% of all referrals (40,002). Schools, probation departments, municipal courts and TJJD referred another 15,172 cases for

delinquent conduct or conduct in need of supervision (CINS), totaling 55,174 referrals for calendar year 2016. This is a decrease of

6,099 (10.0%) referrals from calendar year 2015, with delinquent offenses decreasing 7.3%, violations of probation decreasing

12.4%, and CINS offenses decreasing 26.2%.

Most juveniles referred were attending regular school (76.1%) at the time of their referral to a juvenile probation department.

The remaining juveniles were in an alternative learning environment, had received their GED, had graduated, had dropped out of

school, or had been suspended or expelled. Juvenile Justice Alternative Education Programs (JJAEP) provide education services to

students who have been expelled from the public school system for committing specific offenses, and are mandated in counties with

a population of 125,000 or greater. During the 2015-2016 school year, there were 26 mandatory JJAEPs operating in Texas. Of the

2,931 student entries into JJAEPs, 47% of the students were expelled from school for a mandatory expulsion offense, and 39% were

expelled for a discretionary expulsion offense.

Disposition of a case may result from action taken by the juvenile department, the juvenile prosecutor, or the juvenile court.

There were a total of 57,241 dispositions given in 2016. Juvenile probation departments disposed of 19,285 (33.7%) of these cases.

Of cases disposed by departments, 16.0% were dismissed or withdrawn, 49.3% were given supervisory caution, and 34.7% were

given deferred prosecution. Juvenile prosecutors resolved an additional 12,412 cases, with 65.3% of cases found to have no

probable cause, or being dismissed, refused, or non-suited; 8.1% were given supervisory caution; and 26.6% were given deferred

prosecution.

The juvenile court resolved the remaining 25,544 cases. Of these, the court ordered supervisory caution for less than 1.0% of

cases (n = 160), deferred prosecution for 13.5% of cases, or ordered a new or modified probation in 55.7% of cases. The court

certified and transferred to adult court 143 juveniles, and committed 774 juveniles to TJJD or a post-adjudication secure correctional

facility2. Of juveniles receiving a commitment disposition, 650 were given indeterminate sentences and 124 were given determinate

sentences3. A disposition of not guilty was found in 98 cases. There were 4,654 cases the court transferred or adjudicated with no

disposition, or consolidated and disposed with another case.

Overall, dispositions most often resulted in adjudicated probation supervision or were dismissed (24.8% and 24.7%,

respectively). Cases resulting in a deferred disposition or disposed with a supervisory caution made up the next two largest

categories (23.5% and 18.6%, respectively). Only 1.4% of dispositions resulted in a juvenile being committed, and only 0.2%

resulted in adult certification.

In 2016, 166 juvenile probation departments served the 254 counties in Texas. The average length of adjudicated probation

supervision was 351 days while the average length of deferred prosecution supervision and pre-disposition supervision was 155

days and 113 days, respectively. The majority (85%) of adjudicated probation, deferred prosecution, and pre-disposition

supervision terminations during calendar year 2016 ended with successful completion..

Counties registered and operated 46 secure pre-adjudication facilities, 2 holdover facilities, 33 post-adjudication secure

correctional facilities, and 12 non-secure correctional facilities in 2016. In addition to the county-operated facilities, private

contractors provided services for juveniles in three pre-adjudication facilities and four post-adjudication secure facilities. The

secure facilities provided a combined 3,155 pre-adjudication, 22 holdover, and 2,546 post-adjudication beds.

There were 32,236 detentions in calendar year 2016. Approximately 24.6% of detained juveniles were released within one day.

There were 7,649 placements made to secure or non-secure residential facilities in 2016, generally following the juvenile’s

disposition. More juveniles were served in secure facilities (3,856) than non-secure facilities (3,793). The overall average length of

stay for residential placements (secure and non-secure) was 127 days. The majority of residential placements that terminated during

calendar year 2016 ended in successful completion.

The Texas Juvenile Probation System

Introduction

Since January 1999, juvenile probation departments have been required to submit individual case file data in an electronic

format initially to the Texas Juvenile Probation Commission (TJPC), and currently the Texas Juvenile Justice Department

(TJJD). In addition, annual reporting and periodic surveys from departments provide supplemental information to the agency.

Caution should be used in drawing general conclusions from the statistics. The data in this report portray neither

everything juvenile probation departments or courts do, nor how much time they spend on activities not represented by the

statistics. At least three factors are not represented in the juvenile probation activity statistics and should be considered when

evaluating them:

1. The juvenile justice system operates under the rules and authority of Title 3 of the Texas Family Code. 4 Many of the

cases statistically reported as being disposed as supervisory caution, dismissed, or otherwise disposed have received

rehabilitative and other services from the juvenile probation system. These services are not captured in the activities

presented in this report.

2. Only formal referrals are reported in referral, disposition, supervision, and detention statistics. Departments also handle a

number of informal referrals, such as crisis intervention and prevention/intervention, which are not captured in this report.

3. A number of juvenile probation officers serve both adult and juvenile capacities and often operate under widely varying

authorities and policies.

Funding. Juvenile boards work closely with the commissioner’s court to set budgets for operation of local juvenile probation

departments using both local and state funds. In fiscal year 2016, local commissioner’s courts provided approximately 74.0%

of the total funding to probation departments from county revenues. State funds, primarily channeled through TJJD,

accounted for approximately 25.0% of total funding for juvenile probation services. The remaining 1.0% of funding was Title

IV-E monies from the federal government.

Juvenile Population. The Texas juvenile justice system serves youth between the ages of 10 and 16. Youth ages 17 and

older fall under the jurisdiction of the juvenile justice system only if their alleged offense was committed when the youth was

16 years old or younger or for a violation of a juvenile court order if the youth is still under supervision. Using the Texas

State Data Center 0.5 migration scenario projections based on the United States Census 2010 population, there were 2,824,828

juveniles age 10 to 16 in Texas in calendar year 2016. Gender, race, and age breakdowns of the projected 2016 populations

are shown in Figure 1. Overall, 51.2% of the youth population was male, and 48.8% of the youth population was female.

This was consistent across race categories.

Juvenile Probation Departments

Juvenile Boards. State law requires each department to have a juvenile board. Some of these boards govern multiple

counties. Each board, consisting of district and county judges, is responsible for overseeing the operation of the juvenile

probation system in that county. This includes designating juvenile judges, appointing the chief juvenile probation officer,

and setting the policies and budget for the juvenile probation department. TJJD provides funding and technical assistance to

juvenile boards.

Structure. Juvenile probation departments implement the policies of juvenile boards, deliver services to juveniles referred to

juvenile courts, and provide services to at-risk youth in the community. In Texas in 2016, there were 122 single-county

departments and 44 multi-county departments, ranging in size from two to six counties. Eleven departments served both adult

and juvenile probationers in 2016. Seven of these combined adult and juvenile departments had designated juvenile probation

officers.

Certification of Officers. Certification is required for all Texas juvenile probation and supervision officers. Certification

requires that officers earn the necessary academic degree and complete 80 hours of approved continuing education. Probation

officers must hold, at minimum, a bachelor’s degree while supervision officers most hold, at minimum, a high school diploma

or GED. All officers must also undergo a criminal background check at initial certification and certification renewal. In

2016, TJJD certified 251 new juvenile probation officers and 1,022 new supervision officers. An additional 1,160 existing

probation and 1,353 supervision officer applications were re-certified.

Salaries, Staffing, and Caseload. Of the 166 local departments surveyed during the 2016 Annual Resource Survey5, 143

provided responses (response rate of 86%). Based on data received from respondents, juvenile probation departments across

the state employed 5,802 salaried personnel at the end of 2016. Two departments had only one employee, a Chief Probation

Officer. Table 1, below, shows the breakdown of department staff, average salaries, and salary ranges.6 The average daily

caseload per caseload-carrying juvenile probation officer in Texas ranged from one to 73 juveniles, with a statewide average

of 16 in 2016.

Juvenile Referral Activity

A youth may be referred multiple times in a year. In calendar year 2016, 39,616 juveniles accounted for 55,174 formal

referrals to juvenile probation departments. Importantly, despite an increase in the juvenile population of Texas (Figure 2),

referrals to juvenile probation departments continue to decline, as illustrated in Figure 3.

The state referral rate for calendar year 2016 was 19 youth per 1,000. As shown in Figures 4 and 5, most counties have a

referral rate between 11 and 25 per 1,000 youth, and a violent referral rate of less than 5 per 1,000 youth.

Offender Demographics

Male offenders accounted for 73.5% of all referrals to juvenile probation departments in calendar year 2016 and females

contributed the remaining 26.5% (Figure 6). While Caucasian youth made up 32.1% of the state’s juvenile population in 2016,

they accounted for only 22.1% of referrals to juvenile probation departments (Figure 7). Hispanic youth were the most populous

group in the state (49.6%) and accounted for 48.7% of referrals to probation in 2016. African American youth accounted for

11.6% of the population and 28.2% of referrals. Juveniles of “Other” race category, including Asian and Native American,

accounted for 6.7% of the state population and only 1.0% of referrals.

Of all juvenile referrals in 2016, the average age was 15 years. Despite this average, 16-year-old youth were referred to juvenile

probation more frequently than any other age group. Youth age 17 or older are included in Figure 8 as they may have been

referred for an offense committed while 16 or younger, or for a violation of a juvenile court order if they were under supervision

with a juvenile probation department.

Offense Distribution

As illustrated in Figure 9, referrals to juvenile probation departments have steadily declined since 2012. Referrals for alleged

delinquent offenses (including felony, misdemeanor A and B, and contempt of magistrate) make up the majority of all referrals in

a given year. A quarter (25.8%) of the referrals in calendar year 2016 were for alleged felony offenses. Only 10.4% of all alleged

offenses qualified as violent felonies in 2016.

Since 2012, referrals for alleged delinquent offenses have increased as a percent of total referrals (Table 2). Conversely, referrals

for alleged Conduct Indicating a Need for Supervision (CINS) offenses (including status and non-status) have decreased as a

percent of total referrals since 2012.

Referral History

Less than half of the juveniles referred in calendar year 2016 (41.2%) had been previously referred to juvenile probation

departments. As shown in Figure 10 below, 38.8% of juveniles with a referral history had only one prior referral since calendar

year 2007. More than a quarter (28.3%) of those with a referral history, however, had four or more prior referrals. Among

juveniles with a prior referral, 48.9% had at least one referral for a prior felony offense, 21.4% a prior violent felony offense, and

26.7% a prior violation of probation.

Juvenile Disposition and Supervision Activity

There were 57,241 juvenile cases disposed in calendar year 2016. The distribution of disposition by source indicates

juvenile courts disposed the largest percentage of cases (44.6%), followed by probation departments (33.7%), and prosecutors

(21.7%). Over half of the dispositional outcomes for these 57,241 cases were comprised of deferred prosecution or probation7

dispositions, (25.2% and 26.6%, respectively). Cases disposed as supervisory caution made up 20.0% of dispositions, and

dismissed8 cases another 26.4%. There were 3,877 cases, (6.7%) that received an outcome of consolidated or transferred with

no adjudication. Lastly, the disposition of commitment made up 1.5% of cases while adult certification dispositions totaled

0.3%.

The number of juveniles certified to stand trial as adults increased 19.2% between 2015 and 2016. During the same period,

TJJD commitment dispositions decreased by 12.2% from 882 youth to 774 youth (Figure 11). Since 2012, however,

commitment and adult certification dispositions have decreased 6.0% and 17.8%, respectively.

While dispositions of commitment and adult certification, along with probation, must be disposed through the juvenile court;

dismissed, supervisory caution, and deferred prosecution dispositions may be disposed of by way of the juvenile court, the

prosecutor, or the probation department. Overall, the prosecutor and the probation department were responsible for the majority

of the dismissed, supervisory caution, and deferred outcome activity (Figure 12).

Dispositions in 2016 varied by offense severity, with more serious offenses being more likely to receive formal sanctions.

As shown in Table 3, felony and violation of probation offenses had a much higher proportion of adjudications to probation than

did misdemeanor offenses, and CINS offenses were most likely to receive a supervisory caution disposition.

In calendar year 2016, African American youth were more likely to receive a disposition of probation than any other

disposition, whereas Caucasian youth and youth of Other races received more deferred prosecutions than any other disposition,

and Hispanic youth were more likely to receive a disposition of dismissed than any other disposition (Figure 13). African

American youth were more likely than any other racial group to receive a disposition of commitment or adult certification.

Figure 14 illustrates the proportion of disposition offense severity by race. Caucasian youth and African American youth had

the highest proportion of dispositions for a felony offense. A higher proportion of Hispanic youth and African American youth

received a disposition for a violation of probation offense.

Supervision Workload Activity

The average daily population (ADP) for adjudicated probation supervision in calendar year 2016 was 11,892. 9 Successful

completions accounted for 78.4% of the 12,539 adjudicated probation supervisions terminated during the year, while 21.6%

were unsuccessfully terminated prior to completing probation. Juveniles may have failed to complete probation for a number of

reasons including commitment to TJJD, transfer to an adult court for trial, absconding, or terminating early due to persistent

non-compliance of supervision requirements or transferring out of the department’s jurisdiction.

The ADP of juveniles on deferred prosecution during 2016 was 5,902. Successful completions of deferred prosecution

comprised 82.5% of the 14,413 deferred prosecution supervisions terminated during the year, while 17.5% were unsuccessfully

terminated prior to completion. Juveniles may have failed to complete their deferred supervision because of the reasons listed

above or they may have been disposed to court-ordered probation because of a violation of the deferred supervision agreement.

The ADP of juveniles under pre-disposition supervision (including Conditional Pre-Disposition Supervision and Temporary

Pre-Court Monitoring) during 2016 was 5,892. Of the 19,883 pre-disposition supervisions terminated during the year, 92.1%

were terminated upon completion of supervision, while 7.9% were terminated unsuccessfully.

There were 23,698 active supervisions on January 1, 2016. Of those under supervision on this date, 51.6% were on

adjudicated probation supervision, 24.5% were on deferred prosecution supervision, and 23.9% were on pre-disposition

supervision (Figure 15). Figure 16 displays the number of active supervisions on January 1, 2016 by county. Adjudicated

probation, deferred prosecution, and pre-disposition supervision types are included in this map. The vast majority (76.8%) of

counties had 50 or fewer active supervisions on this date.

Juvenile Detention and Residential Placement Activity

Facility Registry

Per the authority and responsibility established in Title 3, Chapter 51, Texas Family Code, the Texas Juvenile Justice

Department maintains a statewide registry for all local-level (i.e., non-state operated or contracted) public and private secure

juvenile detention and juvenile post-adjudication secure correctional facilities located within the state. TJJD’s facility registry

not only provides an all-inclusive listing of any such facilities, it also serves as a general database of facility-reported

information about each registered facility. As a relevant aside, per the Texas Family Code, no child may be placed into a secure

detention or post-adjudication secure correctional facility that is not registered with TJJD.

Effective 2011, TJJD obtained the responsibility for registering non-secure correctional facilities operated by local juvenile

probation departments. The primary difference between a non-secure and secure facility is the lack of construction fixtures

designed to physically restrict a juvenile’s movements or activities. While the vast majority of the state’s non-secure residential

facilities licensed through the Texas Department of Family and Protective Services serve all types of youth from varied referral

sources, the non-secure facilities registered with TJJD prioritize services exclusively for juvenile justice referred juveniles. In

2016, 12 non-secure facilities were registered with TJJD. These facilities had a combined rated resident capacity of 352 beds.

Table 4 provides the number and types of secure facilities registered with TJJD at any time during 2016. The rated capacity

figures in the table reflect the self-reported resident capacity of those facilities operating at the end of the calendar year.

Detention Activity

There were 32,236 placements made in the 46 pre-adjudication secure and two short-term detention (i.e. holdover) facilities

during 2016. The average daily population (ADP) for detentions in calendar year 2016 was 1,466. Youth were detained for an

average of 19 days per detention. Of youth released from detention in 2016, 24.6% were detained for 24 hours or less, 28.5%

for 2 to 10 days, and 46.8% for more than 10 days. Figure 17 provides the total number of detentions by county for 2016. As

shown, the vast majority of counties had fewer than 100 detentions during the year.

Residential Placement Activity

There were 7,649 out-of-home residential placements made during calendar year 2016, comprised of 3,793 non-secure

residential placements and 3,856 secure correctional placements10. The ADP of juveniles in non-secure residential placement or

secure correctional placement was 737 and 1,129, respectively. Figure 18 indicates post-adjudication secure correctional facility

ADP for the seven Texas regions. A star highlights counties with a post-adjudication secure correctional facility.11

In calendar year 2016, the overall average length of stay in placement was 127 days. Secure correctional placements had a

longer average length of stay than non-secure residential by just over 50 days (154 versus 99, respectively). Of the 3,132 non-

secure placement terminations during the year, 80.4% ended upon successful completion, while 19.6% ended unsuccessfully.

Successful completions accounted for 86.1% of the 2,747 secure placement terminations during the year, while 13.9% ended

unsuccessfully.

Appendix A: Glossary of Juvenile Probation Terminology

General Terms

Active Cases: All cases detained, placed, or supervised during a specified period.

Average Daily Population: The average number of active cases detained, placed, or supervised per day during a specified

period.

Average Length of Stay: The average number of days terminated cases spent in detention, in placement, or under supervision

during a specified period.

Child (Juvenile): Section 51.02(2) of the Texas Family Code specifies a “child” is a person who is 10 years or older and under

17; or 17 years or older and under 18, who is alleged or found to have engaged in delinquent conduct or conduct indicating a

need for supervision as a result of acts committed before turning 17.

Conduct Indicating a Need for Supervision (CINS): Section 51.03(b) of the Texas Family Code specifies that conduct

indicating a need for supervision is: conduct, other than a traffic offense, that is a fine-only misdemeanor under state law or

violates a penal ordinance of any political subdivision of the state; running away from home; inhalant abuse; an act that results

in expulsion from school under Section 37.007(c), Education Code; prostitution; and electronic transmission of certain visual

material depicting minor (i.e. sexting).

Delinquent Conduct: Section 51.03(a) of the Texas Family Code specifies the delinquent conduct is: conduct, other than a

traffic offense, that violates a criminal law of Texas or of the United States that is punishable by imprisonment or by

confinement in jail; conduct that violates a lawful order of a court under circumstances that constitute contempt of court in

justice or municipal court, county court for conduct punishable by a fine only; or truancy court; conduct that violations Section

49.04, 49.05, 49.06, 49.07, or 49.08, Penal Code; and the third or subsequent offense in violation of Section 106.041, Alcoholic

Beverage Code, relating to driving under the influence of alcohol by a minor.

Department: An organized juvenile probation department delivering services in one or more counties and which a juvenile

board supervises.

Detention: A secure facility administered by a governing board that includes construction and fixtures designed to physically

restrict the movements and activities of juveniles or other individuals held in lawful custody in the facility and used for the

temporary placement of any juvenile or other individual who is accused of having committed an offense and is awaiting court

action, an administrative hearing, or other transfer action. A pre-adjudication secure detention facility does not include a short-

term detention facility as defined by Section 51.12(j) of the Texas Family Code. For additional information, refer to

subchapters A, B, C, and E of 37 Texas Administrative Code Chapter 343.

Formal Referral: An event that occurs only when all three of the following conditions exist: (1) a juvenile has allegedly

committed delinquent conduct, conduct indicating a need for supervision, or a violation of probation; (2) the juvenile probation

department has jurisdiction and venue; and (3) the office or official designated by the juvenile board has made face-to-face

contact with the juvenile and the alleged offense has been presented as the reason for this contact or has given written or verbal

authorization to detain the juvenile.

Juvenile Board: A governing board created under Chapter 152 of the Texas Human Resources Code to oversee the provision of

juvenile probation services by a juvenile probation department.

Juvenile Court: A court designated under Section 51.04 of the Texas Family Code to exercise jurisdiction over proceedings

under Title 3 of the Texas Family Code.

Non-Secure Correctional Facility: Any public or private residential facility operated by or under contract with a juvenile

board in which the construction fixtures, hardware, staffing models, and procedures do not restrict the egress of residents from

the facility. For additional information, refer to 37 Texas Administrative Code Chapter 355.

Paper-Formalized Referral: Occurs when a referral that began as a Paper Complaint (paperwork only) is later formalized with

face-to-face contact.

Program: A program is a planned or coordinated activity or group of activities designed to address a specific purpose or goal

including, but not limited to, altering a juvenile’s behavior to reduce delinquency. To be considered a program, there must be a

curriculum, strategy, or plan to achieve the designated goal(s). Participation in a program is either required or tied to the

juvenile’s supervision.

Post-Adjudication Secure Correctional Facility: Secure facility operated by or under contract with a juvenile board that

includes construction and fixtures designed to restrict physically the movements and activities of the residents and is intended

for the treatment and rehabilitation of youth who have been adjudicated. As defined in 37 Texas Administrative Code Chapter

343, a post-adjudication secure correctional facility does not include any non-secure residential program operating under the

authority of a governing board.

Residential Placement: Supervision ordered by a juvenile court in accordance with Texas Family Code Section 54.04(d)(1)(B)

in which the child is placed on probation outside the child’s home in a foster home or a public or private institution or agency.

Status Offender: A child who is accused, adjudicated or convicted for conduct that would not, under state law, be a crime if

committed by an adult. For specific status offense categories, see Texas Family Code Section 51.02(15).

Dispositions

Adjudicated Probation: A disposition option set forth in Texas Family Code Section 54.04(d)(1)(A) in which a juvenile who

has been found to have engaged in delinquent conduct and/or conduct in need of supervision is formally placed on probation

under the supervision of the juvenile court for a specified period of time. The juvenile has been adjudicated and placed on

probation in the child’s own home or in the custody of a relative or other fit person. The juvenile may be required to participate

in a variety of appropriate programmatic services (e.g., counseling, community services, etc.) and may also be subject to other

reasonable court-ordered restrictions or conditions.

Adjudicated to Probation with Placement: A disposition option set forth in Texas Family Code Section 54.04(d)(1)(B) in

which a juvenile who has been found to have engaged in delinquent conduct and/or conduct in need of supervision is formally

placed on probation under the supervision of the juvenile court for a specified period of time. The adjudicated juvenile is placed

on probation and ordered to placement in a foster home, residential treatment facility, or post-adjudication secure correctional

facility. The juvenile may be required to participate in a variety of appropriate programmatic services and may also be subject

to other reasonable court-ordered restrictions or conditions.

Certification as Adult: A discretionary procedural action described in Texas Family Code Section 54.02 in which the juvenile

court transfers its jurisdiction to the criminal court in order to allow a juvenile to be prosecuted as an adult. Depending on the

type of felony conduct alleged, a juvenile as young as 14 years of age, and in some circumstances 10 years of age, may be

certified to stand trial as an adult.

Commitment: A juvenile committed to the care, control, and custody of the Texas Juvenile Justice Department (TJJD).

Beginning in 2007, all commitments to TJJD, except those under the Determinate Sentencing Act, were for an indeterminate

term not to extend beyond the juvenile’s 19th birthday. Beginning in 2013, juveniles in Travis County may be committed to the

Travis County Juvenile Probation Department’s post-adjudication secure correctional facility rather than to TJJD.

Consolidated Case and Disposed in Another Case: A situation wherein multiple offenses are alleged in one petition or in

multiple petitions. The offenses are disposed of in one disposition event.

Deferred Prosecution: A voluntary dispositional alternative to adjudication in which the juvenile, parent/guardian(s), and court

agree upon supervision conditions. The time period cannot exceed 6 months except that if a court places the child on deferred

prosecution as provided in 53.03(i) and (j), the juvenile may be supervised for up to one year or a combined period not to exceed

one year if the time is added to a previous order of deferred prosecution.

Determinate Commitment: A disposition in which a juvenile is adjudicated for delinquent conduct that violates a penal law

listed in Texas Family Code Section 53.045(a) or engages in habitual felony conduct as defined in Texas Family Code Section

51.031. A determinate sentence petition must be approved by a grand jury. Under determinate sentencing provisions of the

Texas Family Code Section 54.04(q), a juvenile may be committed to the Texas Juvenile Justice Department (TJJD) or to the

Travis County Juvenile Probation Department’s post-adjudication secure correctional facility for a specified term of up to 40

years with a possible transfer to the Correction Institution Division of the Texas Department of Criminal Justice. Section

245.051, Human Resources Code, establishes the minimum period of confinement for all determinate sentenced offenders.

Determinate Sentence Probation: A disposition authorized by the Texas Family Code Section 54.04(q) in which a child given

a determinate sentence commitment of 10 years or less may instead be ordered to determinate sentence probation by a court or

jury for a period of up to 10 years.

Determinate Sentence Probation with Placement: A disposition in which a child placed on determinate sentence probation is

ordered to placement in a facility. The juvenile may be required to participate in a variety of appropriate programmatic services

(e.g., counseling, treatments, programs, etc.), and may also be subject to other reasonable court-ordered restrictions or

conditions.

Dismissed/Withdrawn/No Probable Cause: A disposition possibility from either the probation department, prosecutor, or

court. At the department level, an alleged offense against the juvenile will not be pursued and no disposition will be imposed if

it is determined that there is no probable cause. At the prosecutor level, the prosecuting attorney reviews the circumstances and

allegations of a referral for legal sufficiency and the desirability of prosecution and determines that no probable cause exists or

that the case will be dismissed or withdrawn. At the court level, a court has reviewed the circumstances and allegations of a

referral for prosecution and determined there is lack of evidence, thereby terminating all proceedings.

Indeterminate Commitment: A disposition in which a juvenile who has been found to have engaged in delinquent conduct is

eligible for commitment to the Texas Juvenile Justice Department (TJJD) or to the Travis County Juvenile Probation

Department’s post-adjudication secure correctional facility for an indeterminate or unspecified term not to exceed his or her

19th birthday. Only a felony adjudication or probation modification for an underlying felony adjudication may result in a

commitment. TJJD has established minimum lengths of stay for all indeterminate sentenced offenders.

Modified and/or Extended Probation: An extension or revision of a prior court order in which the juvenile continues

probation in the child’s home or in the custody of a relative or other fit person. This extension may result in additional

supervision time or other programmatic sanctions and/or services.

Modified/Extended Probation with Placement: An extension or revision of a prior court order in which the juvenile continues

probation and is ordered to placement in a facility. This extension may result in additional supervision time or other

programmatic sanctions and/or services (e.g., counseling, drug rehabilitation program, mental health treatment, etc.).

Non-Suited: The prosecuting attorney reviews the circumstances and allegations of a referral for legal sufficiency and the

desirability of prosecution and files a petition with the juvenile court. The petition is subsequently dismissed with or without

prejudice.

Refused: An instance in which the prosecuting attorney reviews the circumstances and allegations of a referral for legal

sufficiency and the desirability of prosecution; and refuses to prosecute the case due to insufficient evidence, unavailable

witnesses, etc. The case is closed without a petition being filed or sanctions imposed.

Supervision: A process that involves the case management of a juvenile by the assigned juvenile probation officer or designee

through contacts (face-to-face, telephone, office, home, collateral) with the juvenile, the juvenile’s family, and other case

planning participants. For additional information refer to 37 Texas Administrative Code Chapter 341.

Supervisory Caution: A judicial summary disposition made by the court or other authorized person. This informal disposition

option may include counseling the juvenile about the consequences of his or her conduct, contacting the juvenile’s parents to

inform them of the juvenile’s behavior or referring the juvenile to a social service agency or a community-based first offender

program run by law enforcement. See Texas Family Code Sections 52.03, 52.031, 52.032, 59.004, and 264.302.

Supervision Types and Outcomes

Absent without Permission: The juvenile fails to report or cannot be found. The timeframe for not reporting for supervision is

no more than 45 days from the time the juvenile is considered absent.

Completed: The juvenile completed the supervision without incident.

Conditional Pre-Disposition Supervision: This supervision type is either ordered by the court or ordered by the probation

department with authority from the judge. Most conditional pre-disposition supervisions are done at the time of the detention

hearing, but juveniles can be placed under this supervision type without having been detained. The conditions should be limited

to those that are reasonable and necessary to ensure the juvenile will return to court.

Court Ordered Probation: A dispositional option set forth in Texas Family Code Section 54.04(d)(1) in which a juvenile who

has been found to have engaged in delinquent conduct or conduct indicating a need for supervision is formally placed on

probation under the supervision of the juvenile court for a specified period of time. A juvenile who has been adjudicated and

placed on probation may be required to participate in a variety of appropriate programmatic services (e.g., intensive supervision

programs, residential placement, community supervision, etc.) and may also be subject to other reasonable court-ordered

restrictions or conditions. This category also includes the disposition of determinate sentence probation authorized in Texas

Family Code Section 54.04(q) that may be ordered by a court or jury for a period of up to ten (10) years for specific violent or

habitual conduct.

Deferred Prosecution: A voluntary dispositional alternative to adjudication in which the juvenile, parent/guardian(s), and court

agree upon supervision conditions. The time period cannot exceed 6 months except that if a court places the child on deferred

prosecution as provided in 53.03(i) and (j), the juvenile may be supervised for up to one year or a combined period not to exceed

one year if the time is added to a previous order of deferred prosecution.

Failure to Comply: Supervision terminated before the anticipated end date because of a new offense or because the juvenile

refused to accept services and/or was persistently non-compliant with the terms of supervision.

Temporary Pre-Court Monitoring: This is an unofficial form of pre-dispositional supervision used only when a juvenile is

pending a disposition decision or court action. Temporary supervision can be done on a voluntary basis if agreed to by the

juvenile and the juvenile’s parents. There is no Family Code basis for this supervision type; therefore, a juvenile cannot be

sanctioned for not following the conditions set forth.

TJJD Commitment: The juvenile’s supervision ended as a result of commitment to the Texas Juvenile Justice Department.

Transferred out of Jurisdiction: The juvenile’s supervision ended because the juvenile moved from one jurisdiction to another

and services were transferred to the new jurisdiction. This outcome is used when a juvenile leaves one jurisdiction on an

Interstate Compact or Inter-County Transfer and for juveniles on determinate probation whose probation is transferred to the

adult system.

Transferred to the Adult System: The juvenile’s supervision ended because the juvenile was transferred to the adult system

due to new/additional charges.
