STATE GOVERNMENT INSTRUMENTS GAMING MACHINES REGULATIONS 2005

REGULATION 10 Variation of Notice of Exemption by the Minister–

Ocean Going Passenger Vessels entering South Australian State Waters (Variation of Notice) 1. Preliminary

1.1 On 13 April 2010 a Notice of Exemption—Ocean Going Passenger Vessels entering South Australian State Waters (Notice of Exemption) was granted by the then Minister for Gambling.

1.2 The Notice of Exemption was published in the South Australian Government Gazette, 6 May 2010 (No. 28 of 2010), page 1695. 1.3 The purpose of the Notice of Exemption was to grant an exemption from section 45 of the Gaming Machines Act 1992 (the

Act) in respect of persons who have possession of gaming machines on ocean going passenger vessels entering South Australian State waters, subject to conditions listed in the Notice of Exemption.

1.4 Condition (1) of the Notice of Exemption provides that the exemption will only apply to a vessel visiting a South Australian port on route to or from a destination port that is not in the State of South Australia.

1.5 The Notice of Exemption however does not contemplate intra-State journeys undertaken by ocean going passenger vessels transiting to or from a South Australian port or ports to or from another South Australian port or ports (which may include returning to the same port).

1.6 This Variation of Notice varies the Notice of Exemption to allow ocean going passenger vessels which undertake journeys outlined in clause 1.5 of this Notice to possess gaming machines while undertaking such journeys but not allowing them to be operated while in South Australian State waters during those journeys.

1.7 This Variation of Notice also varies the Notice of Exemption to change the definition of what constitutes a gaming machine for the purposes of the Notice of Exemption to include gaming machines that are capable of being operated by the insertion of banknotes and cards and also by the use of electronic credits or tokens (whether held, stored or accredited by the device or elsewhere), consistent with the definition of a gaming machine under section 3(1) of the Gaming Machines Act 1992.

2. Variation of Notice of Grant of Exemption 2.1 PURSUANT to regulation 10(6) of the Gaming Machines Regulations 2005, I, Vickie Chapman MP, Attorney-General,

vary the Notice of Exemption—Ocean Going Passenger Vessels entering South Australian State Waters as follows: 2.1.1 Delete the meaning of gaming machine for the purposes of the Act and the Notice of Exemption and substitute:

“For the purpose of the Act and this Notice, gaming machine means a device (whether wholly or partly, mechanically or electronically operated) that is designed so that– (a) it may be used for the purposes of playing a game of chance, or a mixed game of chance and skill; and (b) it may be operated wholly or partly by—

(i) inserting a token, ticket, card, coin or banknote into the device; or (ii) electronically transferring credits or tokens to the device; or (iii) using credits or tokens in the device (whether those credits or tokens are held, stored or accredited by

the device or elsewhere); and (c) because of making a bet on the device, winnings or other rewards may become payable.

2.1.2 Delete conditions 1 and 2 of the Notice of Exemption and substitute: “Conditions 1. The exemption applies to an ocean going passenger vessel that:

1.1 is transiting to or from a South Australian port or ports to or from locations overseas or interstate; or 1.2 is transiting to or from a South Australian port or ports to or from a South Australian port or ports

(which may include returning to the same port), in circumstances where such vessel is being predominantly operated for tourism and where any gaming conducted is ancillary; and includes where the vessel temporarily exits South Australian State waters at any time during that particular journey, but does not berth at a port located overseas or interstate during that particular journey.

2. A gaming machine must not be operated while the ocean going passenger vessel is located in South Australian State waters, when engaged in a journey described in clause 1.”
