DEVELOPMENT ACT 1993, SECTION 29: AMENDMENT TO

THE LIGHT REGIONAL COUNCIL DEVELOPMENT PLAN

Preamble

1. It is necessary to amend the Light Regional Council Development Plan (the Plan) dated 18 December 2014 in order to take action to correct an error.

NOTICE

PURSUANT to Section 29 (29) (2) (ii) of the Development Act 1993, I amend the Plan as follows:

(a) replace exception (g) within the Rural Living Zone non-complying table for Form of Development listed as ‘Land division located outside of the Rural Agistment Policy Area 12’, namely:

(g) it is located within the ‘Precinct 32 Rural Living Gawler Belt West’ and all of the resulting allotments have a minimum area of more than 4 hectares,

with:

(g) it is located within the ‘Precinct 32 Rural Living Gawler Belt West’ and the minimum allotment areas in respect to their locations specified in (i), (ii) or (iii) are met:

(i) 2 hectares in the area west of Clancy Road and north of Ward Belt Road;

(ii) 1 hectare in the area east of Clancy Road; and

(iii) 4 hectares in the area south of Ward Belt Road.

(b) fix the day on which this notice is published in the Gazette as the day on which the Section 29 Amendment will come into operation.

ENVIRONMENT PROTECTION ACT 1993

Approval of Category B Containers

I, ANDREA KAYE WOODS, Team Leader, Container Deposit Legislation and Delegate of the Environment Protection Authority (‘the Authority’), pursuant to Section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby:

Approval of Category B Containers

Approve as Category B Containers, subject to the conditions in subclauses (1), (2), (3) and (4) below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia:

(a) the product which each class of containers shall contain;

(b) the size of the containers;

(c) the type of containers; and

(d) the name of the holders of these approvals.

(1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for containers of that class. The Authority specifies the following refund markings for Category B containers:

(i) ‘10c refund at collection depots when sold in S.A.’; or

(ii) ‘10c refund at S.A./N.T. collection depots in State/Territory of Purchase’

(2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to containers of that class. For the purpose of this approval notice the company named in Column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

Trading Round for Gaming Machine Entitlements

TAKE notice that pursuant to Regulation 5B of the Gaming Machine Regulations 2005, I, Lyn Guerin, Delegate of the Liquor and Gambling Commissioner have established a trading round for the purchase and sale of gaming machine entitlements. This trading round will be known as Trading Round 8/2015.

Offers to PURCHASE or SELL gaming machine entitlements in Trading Round 8/2015 are invited from persons eligible to do so in accordance with the Gaming Machines Regulations 2005.

The closing date and time for the submission of offers is:

Livestock (Restrictions on Entry of Abalone Livestock for Purposes Other than Aquaculture) Notice 2015

under Sections 33 of the Livestock Act 1997

1—Short title

This notice may be cited as the Livestock (Restrictions on Entry of Abalone Livestock for Purposes Other than Aquaculture) Notice 2015.

2—Commencement

This notice will come into operation on date of gazettal.

3—Interpretation

In this notice, unless the contrary intention appears—

Abalone means abalone (Haliotis spp.) of all species.

Abalone Health Statement means the Abalone Health Statement for Entry of Abalone Livestock from Victoria and Tasmania for Purposes Other than Aquaculture, available at www.pir.sa.gov.au.

Accredited means a document that is signed and dated by a competent authority certifying that:

(a) AVG is notifiable condition in the jurisdiction; and

(b) The jurisdiction has a surveillance system that would detect AVG if it were present, and

(c) The abalone farm implements biosecurity measures to prevent AVG, monitor mortality rates, and report mortality and disease to the competent authority, and

(d) AVG has not been detected at the abalone farm in the past 12 months.

Aquaculture has the same meaning as in the Aquaculture Act 2001. Movement of abalone livestock for aquaculture is restricted under the Livestock (Restrictions on Entry of Aquaculture Stock) Notice 2014.

AVG means abalone viral ganglioneuritis.

Certified biosecure area means an area where measures are applied to mitigate the risks of introduction and spread of disease that has been annually inspected and certified as being biosecure by a competent authority.

Competent authority means a veterinary authority or government authority having the responsibility for ensuring the implementation of animal health measures or veterinary health certification.

Decontaminated means inactivation of the virus that causes AVG by a disinfection process using an aqueous solution of hypochlorite (200 ppm available chlorine) or other approved methods available at www.pir.sa.gov.au.

Diseased abalone means abalone livestock sourced from jurisdictions that have reported the occurrence of AVG, and which are not declared free of AVG in accordance with the standards set by the World Animal Health Organisation (OIE), and which have not met the conditions outlined in this Notice.

Livestock has the same meaning as in the Livestock Act 1997.

4—Introduction of abalone livestock for purposes other than for aquaculture

(1) Abalone entering South Australia must come from a licensed abalone farm that has been accredited by a competent authority within the previous 12 months; and

(2) Abalone sourced from Victoria or Tasmania must be accompanied by a completed Abalone Health Statement.

(3) Conditions for transporting, keeping and disposing of abalone livestock:

(a) the abalone must be transported directly to South Australia or through the certified biosecure area of a registered seafood processor; and

(b) the abalone must be transported in new, sealed containers; and

(c) all water, tanks and equipment that have come into contact with abalone livestock must be decontaminated before disposal or removal from the property; and

(d) unused abalone or abalone products must be disposed of in landfill; and

(e) abalone livestock must not be moved to an aquaculture facility within South Australia.

Notice of Prohibition on Taking Water from Wells in the Polda Basin in the Musgrave Prescribed Wells Area

PURSUANT to Section 132 (1) (a) (i) of the Natural Resources Management Act 2004 (the Act), I, Ian Hunter, Minister for Sustainability, Environment and Conservation in the State of South Australia and Minister to whom the administration of the

Act is committed, being of the opinion that the rate at which water is taken from wells that access underground water in the Quaternary Limestone aquifer in the Polda Basin in the Musgrave Prescribed Wells Area is such that the quantity of water available can no longer meet the demand, hereby prohibit the taking of water from wells in the area within the Musgrave Prescribed Wells Area labelled ‘Polda’ on the attached map, except in the circumstances specified in Schedule 1.

SCHEDULE 1

1. This Notice does not apply to the taking of water from a well or wells pursuant to Section 124 (4) of the Act for domestic purposes or for watering stock (other than stock subject to intensive farming).

2. Subject to Clause 3, a person may take water from a well or wells if the person is authorised to take the water as part of a water allocation under the terms of Water Licence 9603, 9604 or 9606.

3. The maximum volume of water that may be taken under the terms of the water licences specified in Clause 1 is:

3.1 Water Licence 9603—613 kL.

3.2 Water Licence 9604—997 kL.

3.3 Water Licence 9606—3 000 kL.

4. Any water taken in accordance with Water Licence 9606 must:

4.1 only be used for the purposes of maintenance of public water supply infrastructure; and

4.2 subject to any reasonable loss of water, be returned to the quaternary aquifer pursuant to a permit granted under Section 127 (3) (c) of the Act and in accordance with the Environment Protection (Water Quality) Policy 2003.

In this Notice:

Words used in this Notice that are defined in the Act shall have the same meanings as set out in the Act.

This Notice will have effect at the expiration of seven days from publication of this notice in the Gazette and in a newspaper circulating in that part of the State in which the abovementioned prescribed water resource is situated and will remain in effect for two years unless earlier varied or revoked.

BY Road Process Order made on 28 November 2014, the City of Port Adelaide Enfield ordered that:

COMMENTARY TO THE STATEMENT OF THE AMOUNTS CREDITED TO

AND ISSUED FROM THE CONSOLIDATED ACCOUNT FOR THE QUARTERS ENDED 30 JUNE 2014 AND 30 JUNE 2013

Receipts Taxation Payroll tax receipts in 2013-14 were higher than in 2012-13 mainly due to growth in taxable payrolls. Stamp duty receipts in 2013-14 were higher than in 2012-13 mainly due to improved property market conditions, with property transfers increasing from the very low levels experienced in recent years. Stamp duty receipts for the June quarter 2014 were higher than for the June quarter 2013 mainly due to the timing of payments to the Consolidated Account relating to stamp duty on motor vehicle registrations and renewal certificates for Compulsory Third Party insurance collected by the Department of Planning, Transport and Infrastructure. Gambling tax receipts in 2013-14 were lower than in 2012-13 mainly due to the conclusion of dividend payments from the South Australian Lotteries Commission following the appointment of a master agent. Land tax receipts in 2013-14 were lower than in 2012-13 mainly due to changes in the value of property ownerships. From 2013-14, the Save the River Murray Levy has been paid directly into the Save the River Murray Fund. Previously, levy revenues were deposited into the Consolidated Account and subsequently transferred to the Fund. Royalties Royalty receipts in 2013-14 were higher than in 2012-13 mainly due to the introduction of monthly royalty payments and higher petroleum production across the year. Fees and Charges Fees and Charges in 2013-14 were higher than in 2012-13 mainly due to an increase in land regulatory fees. Commonwealth – General Purpose Payments Growth in general purpose grants for 2013-14 compared to 2012-13 is not indicative of underlying Goods and Services Tax (GST) revenue growth. This is because monthly grants are paid according to a payment schedule prepared by the Commonwealth Government rather than in accordance with the actual emerging monthly GST collections. In its 2014-15 Final Budget Outcome, the Commonwealth Government indicated that the GST pool available for distribution to the states grew by 6.3 per cent in 2013-14.

Commonwealth – Specific Purpose Payments Special Purpose Payments (SPPs) for 2013-14 were higher than in 2012-13 mainly due to higher payments for government schools as a result of the National Education Reform Agreement. Commonwealth – National Partnership Payments NP payments in 2013-14 were lower than in 2012-13 mainly due to several large once-off payments in relation to an NP for public hospital services being made to the Consolidated Account in 2012-13. NP payments for the June quarter 2014 were higher than for June quarter 2013, mainly due to some payments for Remote Indigenous Housing for 2012-13 having been paid in 2011-12. Other receipts Other receipts in 2013-14 were lower than in 2012-13 mainly due to the recognition of proceeds from asset sales in the previous financial year. Payments Payments pursuant to the Appropriation Act (i.e. to agencies) are $112 million higher than forecast in the original 2013-14 Budget. Greater than budgeted payments were made to the following: – Department for Education and Child Development ($44 million) – Department of Further Education, Employment, Science and Technology ($43 million) – Department of Planning, Transport and Infrastructure ($50 million) – Administered Items for Department of Treasury and Finance ($78 million) – Department of the Premier and Cabinet ($19 million) This was partially offset by lower than budgeted payments to: – Administered Items for the Attorney-General’s Department ($45 million) – Department for Communities and Social Inclusion ($78 million) All appropriations were paid within approved limits established under the various acts. Further detail on the final budget result will be available in the 2013-14 Final Budget Outcome. Note Caution should be exercised in interpreting the quarterly statement of Consolidated Account transactions. Unlike the State Budget, which comprises transactions on an accrual basis, the information reflected in the quarterly statements is limited to cash transactions. Also, the Consolidated Account does not capture all the transactions undertaken by the general government sector (in particular, it does not record receipts to and payments from special deposit accounts). Finally, the timing of receipts and payments could be volatile within a particular year. As a result, apparently large movements between years may only be due to changes in the timing of receipts and payments and therefore may not have consequences for the underlying budget position.

Preamble

1 Section 5 of the Heavy Vehicle National Law (South Australia) Act 2013 provides that if—

(a) the Parliament of Queensland enacts an amendment to the Heavy Vehicle National

Law set out in the Schedule to the Heavy Vehicle National Law Act 2012 of

Queensland (the Queensland Act); and

(b) the Governor is satisfied that an amendment that corresponds, or substantially

corresponds, to the amendment made by the Parliament of Queensland should be

made to the Heavy Vehicle National Law (South Australia),

the Governor may, by regulation, amend the South Australian Heavy Vehicle National Law

text.

2 The Parliament of Queensland has enacted legislation to amend the Queensland Act and the

Governor is satisfied that the amendments corresponding to the Queensland amendments set

out in Part 2 of these regulations should be made to the South Australian Heavy Vehicle

National Law text.

(Amendment of Law) Regulations 2015.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Interpretation

In these regulations—

Act means the Heavy Vehicle National Law (South Australia) Act 2013.

4—Amendment provision

Pursuant to section 5 of the Act, the Heavy Vehicle National Law (South Australia) is

amended as specified in Part 2 of these regulations.

Part 2—Amendment of Heavy Vehicle National Law (South

Australia)

5—Amendment of section 468—Driver operating under BFM accreditation or AFM

Section 468(1)—delete "heavy vehicle accreditation" and insert:

1—Short title

These regulations may be cited as the Return to Work (Transitional Arrangements)

(Administration) Regulations 2015.

2—Commencement

These regulations will come into operation on 2 February 2015.

3—Interpretation

In these regulations—

Act means the Return to Work Act 2014.

4—Corporation change of name

The following provisions will apply in connection with the operation of clause 11 of

Schedule 9 of the Act:

(a) without limiting the operation of paragraph (b), a reference in any Act, regulation,

rule, instrument, notice or other document to the Corporation as the WorkCover

Corporation of South Australia will be construed as a reference to the Return to

Work Corporation of South Australia;

(b) the Corporation may, after clause 11 of Schedule 9 of the Act takes effect—

(i) continue to act in any case under the name WorkCover Corporation of

South Australia (or WorkCover), including for the purposes of issuing any

notice or taking any other action or step, or for the purposes of any process,

application or proceedings, under the Workers Rehabilitation and

(ii) act under the name Return to Work Corporation of South Australia (or

ReturnToWorkSA) for the purposes of issuing any notice or taking any

other action or step, or for the purposes of any process, application or

proceedings, under the Workers Rehabilitation and Compensation Act 1986

or the Return to Work Corporation of South Australia Act 1994 or under

any other Act or law (including with respect to any matter commenced

before clause 11 of Schedule 9 of the Act takes effect).

5—Common Fund

The following provisions will apply in relation to the continuation and application of the

Compensation Fund:

(a) the fund will be held subject to the provisions of the Workers Rehabilitation and

Compensation Act 1986 and the Return to Work Act 2014;

(b) the fund may be applied for the purposes of the Workers Rehabilitation and

Compensation Act 1986 or the Return to Work Act 2014 (including purposes that

relate to the cost of undertaking functions or establishing services or facilities in

connection with the Return to Work Act 2014 before 1 July 2015).

6—WHS administration costs

(1) In this regulation—

WHS Act means the Work Health and Safety Act 2012.

(2) The Corporation may, in setting the fee payable under Schedule 5, clause 2(5) of the WHS

Act for the 2015/2016 financial year, take into account the amendments effected to that Act

by Schedule 9 of the Return to Work Act 2014 and the provisions of the Return to Work

Act 2014 (whether or not those provisions are in operation on the commencement of these

regulations).

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in

the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in

these regulations.
