Preamble1. The New Tax System Price Exploitation Code (South

Australia) Act 1999 applies the New Tax System PriceExploitation Code as a law of South Australia.

2. The A New Tax System (Trade Practices Amendment) Act2000 of the Commonwealth provides for the modification of theNew Tax System Price Exploitation Code.

3. The modification takes effect for the purposes of the law ofSouth Australia subject to section 6 of the New Tax System PriceExploitation Code (South Australia) Act 1999.

4. It has been decided to bring the modification into force byproclamation under section 6 (2) of the New Tax System PriceExploitation Code (South Australia) Act 1999.ProclamationPURSUANT to section 6 (2) of the New Tax System PriceExploitation Code (South Australia) Act 1999 and with the adviceand consent of the Executive Council, I fix 27 July 2000 as thedate on which the modification to the New Tax System PriceExploitation Code text made by the A New Tax System (TradePractices Amendment) Act 2000 of the Commonwealth willapply as a law of South Australia.

DEVELOPMENT ACT 1993: SECTION 48Decision by the Development Assessment Commission as

Delegate of The GovernorPreamble

1. The decision of the Governor under section 48 of theDevelopment Act 1993 to grant development approval for theestablishment of stormwater diversion infrastructure and aseawater circulation system for the Patawalonga Lake, subject toconditions, and to reserve a decision on specified matters untilfurther assessment, was published in the Gazette on 23 December1999.

2. An amended proposal to develop the establishment ofstormwater diversion infrastructure and a seawater circulationsystem for the Patawalonga Lake has been under considerationunder Division 2 of Part 4 of the Development Act 1993.

3. The amendments to the development are contained in thefollowing:

(a) Letter from the Department of Administrative andInformation Services (DAIS) to Planning SA dated 8May 2000 (and amended by letters from DAIS toPlanning SA dated 9 June 2000, 4 July 2000, 6 July2000 and 13 July 2000);

The amendments to the development are:• amended landscaping plans;• a variation to the design of the diversion intake structure

and watercourse to the coastal dune by replacing thepumping system and open channel design with a venturisystem and buried pipe design as detailed in drawingsnumbered C11, C001, SK03, C07, C037, C007, C035 andC036; and

• a proposal that construction of the amended developmentproceed before an Environmental Management Planrelating to the operation of the amended development hasbeen approved, but that the completed development notbe used or operated until such a Plan has been approved.

5. The preparation of an Environmental Management Plan forthe construction of the development was a matter specified as areserved matter in the decision of the Governor referred to inparagraph 1. Such an Environmental Management Plan has beenunder consideration under Division 2 of Part 4 of theDevelopment Act 1993.

6. Application has now been made to the DevelopmentAssessment Commission as delegate of the Governor undersection 48 of the Development Act 1993 for approval of theamended development and the reserved matter namely anEnvironmental Management Plan for the construction of thedevelopment.

7. The Development Assessment Commission has, inconsidering the application and the reserved matter, had regard toall relevant matters under section 48 (5) of the Development Act1993.

8. The Development Assessment Commission is satisfied thatthe amendments do not require the preparation of a further oramended Environmental Impact Statement.DecisionPURSUANT to section 48 of the Development Act 1993 theDevelopment Assessment Commission, as delegate of theGovernor, grants development approval for the amendedproposal to develop stormwater diversion infrastructure and aseawater circulation system for the Patawalonga Lake in thevicinity of Glenelg and West Beach, as described in theapplication dated 11 October 1999 (amended by theEnvironmental Impact Statement, dated June 1999), andsubsequently amended by the letters dated 8 May 2000, 9 June2000, 4 July 2000, 6 July 2000 and 13 July 2000 (andaccompanying plans) and an Environmental Management Planfor construction submitted on behalf of the Minister forGovernment Enterprises, subject to conditions:

Conditions of Approval1. The development hereby approved must be undertaken in

2. The development hereby approved must be undertaken inaccordance with the Environmental Management Plan entitled‘Environment Management Plan for Construction. ThePatawalonga Seawater Circulation and Stormwater Outlet. Contract No 1650-E-99. Major Projects Group. Government ofSouth Australia’ (Rev 3) prepared by Baulderstone Hornibrookand Connell Wagner dated 12 July 2000.

3. The development must not be used for the carriage of anystormwater from the Patawalonga Lake or the PatawalongaCreek until an Environmental Management Plan relating tomanagement, maintenance and monitoring matters associatedwith the operation of the development has been produced by theproponent and approved by the Development AssessmentCommission.

4. The amended development hereby approved must beoperated in accordance with the Environment Management Planreferred to in condition 3.

5. The proponent must not commence construction of theamended development hereby approved, unless the proponent hastaken initial water quality samples of suspended solids, nutrients(including total nitrogen and phosphorous and solublephosphorous), heavy metals (including zinc, copper and lead),faecal coliforms and enterococci, turbidity and chlorophyll. Suchsamples to be taken at each of the test locations depicted in thedrawing titled ‘Excavation of Patawalonga Lake GeneralArrangement’ being drawing number AE4085.C.DV.001 andmarked ‘Suggested Test Location for Baseline Data’ dated27 June 2000. The proponent must notify the DevelopmentAssessment Commission in writing that such initial samples havebeen taken. Thereafter the proponent must undertake suchsampling on a calendar monthly basis and after significant rainfallevents (being falls in the area of the development of or exceeding12 mm within any period of 24 hours as measured at the AdelaideAirport), until the Environmental Management Plan referred toin Condition 3 has been approved by the DevelopmentAssessment Commission. The proponent must produce reports of

the results of all such sampling to the Development AssessmentCommission.

6. Any work that constitutes building work under theDevelopment Act 1993 must be certified by a building certifier ascomplying with the Building Rules, prior to commencement of that work.

7. The syphon structure under Africaine Road must be ofadequate capacity so that flooding will not occur in the vicinityof the northern reach of the Patawalonga Lake and the golfcourse.

8. If any acid sulphate soils or pockets of buried waste arefound while undertaking works on the site, the occupier of thesite must immediately provide a written report of such a find tothe Environment Protection Authority.

9. The coastal dune affected by the proposal must berehabilitated in accordance with the reasonable requirements ofthe Environment Protection Authority and the Coast ProtectionBoard and to the satisfaction of the Development AssessmentCommission.

10. Damage to the seawall as a result of the proposed worksmust be reinstated in accordance with the current design standardsfor seawalls of the Coast Protection Board.NOTES TO THE APPLICANT :

1. Environment Protection Authority licences would need tobe obtained for any prescribed construction works and activities,which would also need to be undertaken in accordance with a SoilErosion and Drainage Management Plan and appropriatemanagement practices in the Stormwater Pollution PreventionCode of Practice for the Building and Construction Industry(1999).

2. Tenure arrangements, including any Native Titlerequirements, should be finalised prior to constructioncommencing.

3. The potential use of the existing silt ponds at theintersection of Tapleys Hill and West Beach Road for thedisposal of any waste materials should be further investigatedduring the detailed design stage to ensure plans by the City ofWest Torrens to rehabilitate the site into a stormwater detentionbasin in this vicinity are not compromised. This must be resolvedin consultation with the Council and Adelaide Airport Ltd.

4. Consultation should be undertaken with the Department ofIndustry and Trade, the West Beach Trust and the City of WestTorrens in order to avoid any potential disruption to the plannedconstruction of a skating/BMX facility south of Africaine Road.

5. Strategies for reducing the volume of discharges from thePatawalonga Creek/Airport Drain Catchment into the Weir No. 2Basin (and potentially the Patawalonga Lake) should be preparedin consultation with the City of West Torrens, Adelaide AirportLtd and the Patawalonga Catchment Water Management Board.

6. The Patawalonga Catchment Water Management Boardshould consider the following matters:

• The installation of further silt traps/basins within thecatchment and the construction of proposed wetlands atOaklands Park and Morphetville as a matter of priority toensure predicted improvements to water quality areachieved by the time the Outlet is commissioned.

• Committing to a program of maintaining water qualityimprovement devices within the Patawalonga Catchmentto ensure they operate at maximum efficiency forremoving sediment and pollutants.

• The preparation of an Environmental Management Planfor the Weir No.1 Basin, that is similar to the proposedEMP for the Weir No. 2 Basin, so that maintenance andmonitoring requirements are addressed for these freshwaterwaterbodies in a co-ordinated manner.

• Further monitoring (and reporting) of the PatawalongaCatchment to measure the level of water qualityimprovements being made (especially as predicted).

• The preparation and implementation of a long-termsampling program to determine sediment movementwithin the catchment (especially the finer fractions thatcarry the majority of pollutants), as recommended by theAustralian Water Quality Centre (1999). In addition, thecurrent ambient and composite monitoring programsshould be continued to monitor changes in water quality asimprovements are made in the catchment. In particular,the effectiveness of works to capture and remove finesediment and organic matter should continue to bemeasured.

• The implementation of works to further reduce levels ofsediment (especially fine fractions) and organic matter atthe end of the catchment (and to a lesser degree,supplemented by works in the remainder of the catchmentto enable the progressive removal of silt, nutrients andother pollutants) as a matter of priority.

• Further investigation of the quantity and composition ofsediments in the lower reaches of the catchment in orderto assess their long-term remobilisation potential andlikely impacts on water quality. If remobilisation isidentified as a problem, satisfactory management should beundertaken.

• The potential impact of increased flows and sources ofsediment from the Patawalonga Creek and Airportcatchments on the operation of the Outlet and suitablemeasures to reduce volumes and remove pollutants.

• The establishment of further monitoring sites between theHeathfield Waste Water Treatment Plant and downstreamof the confluence of Sturt Creek and Minnow Creek (atleast until SA Water begins to monitor again for bothchemical composition and macroinvertebrates) to gain abetter understanding of the impact of the Plant, asrecommended by the Australian Water Quality Centre(1999). The extent of potential remobilisation and theresuspension and transport of assimilated nutrients andpollutants within the stretch of the Sturt Creek affected bydischarges from the Plant, should also be furtherinvestigated.

7. Further consultation should be undertaken with AdelaideAirport Ltd in regard to the potential for constructing a wetlanddetention system on Adelaide Airport land.

8. The proponent should consult with the Department forWater Resources, the Environment Protection Authority, theSouth Australian Research and Development Institute (PrimaryIndustries and Resources South Australia), the South AustralianHealth Commission, the City of Holdfast Bay, the City of WestTorrens, the Patawalonga Catchment Water Management Board,the Coast Protection Board, the West Beach Trust and AdelaideAirport Ltd in relation to the preparation of the EnvironmentManagement Plan referred to in condition 3.

9. The 2.5 m minimum width strip of land that will be providedbetween the headwall of the collection basin outlet and thesouthern boundary of Africaine Road should remain free of anypermanent structures or obstacles so as to enable the constructionof a pathway for public access.Dated 25 July 2000.

DEVELOPMENT REGULATIONS 1993, REGULATION 6AMinisterial Notice

Preamble1. Regulation 6A of the Development Regulations 1993,

provides that the Minister may, on application of the relevantcouncil, declare that certain provisions of that regulation relatingto the definition of ‘significant tree’ under section 4 (1) of theDevelopment Act 1993, will apply to trees of specified classeswithin the area of the council.

2. The City of Norwood, Payneham and St Peters has appliedto the Minister for a declaration under Regulation 6A of theDevelopment Regulations 1993.

3. I am satisfied that the declaration is appropriate as atemporary measure pending the making of amendments by therelevant council to the Development Plan that relates to the areaof the council under section 23 (4a) of the Development Act1993.

ForewordThis, the 3rd edition of the ANCI National Competency Standards for the Registered Nurse, presents theoutcome of a significant undertaking of the Australian Nursing Council Inc. (ANCI) to maintain the CompetencyStandards for Registered Nurses.

The ANCI National Competency Standards for Registered Nurses are core competency standards which allregistered nurses must be able to demonstrate.

The competency standards were originally developed during the 1980s and were adopted by the Australiannurse regulatory authorities in 1990. Following a review after five years of their implementation, the ANCIcommenced a project to update the registered nurse competency standards. This was carried out during 1997and 1998.

The project that was undertaken was of national significance, and involved consultation with a number ofnurses across Australia. A second edition of the competency standards was released in February 1999 andfollowing feedback from nurse regulatory authorities, further refinements were undertaken, resulting in this thirdedition.

A significant outcome of the refinement is the Introduction to the ANCI National Competency Standards forRegistered Nurses which replaces the previous philosophy and role statement.

The ANCI has pleasure in presenting to nurses and the community a viable set of competency standards whichhave been endorsed by the Australian nurse regulatory authorities, and which will be monitored and evaluatedwithin the next three years.

Introduction to the ANCI National Competency Standards for the Registered NurseNurses in Australia are regulated and accountable to the community for providing high quality care throughsafe and effective work practice. To assist in achieving this, the state and territory nurse regulatory authoritiesset standards of competence that describe the behaviour of nurses.

The state and territory nurse regulatory authorities establish and maintain standards and processes for theregulation of nursing within Australia.

The ANCI develops national standards that provide a framework for professional nursing practice. Thesestandards are:

• The ANCI National Competency Standards for Registered and Enrolled Nurses• The Code of Ethics for Nurses in Australia• The Code of Professional Conduct for Nurses in Australia

The competency standards take account of the various roles and functions nurses fulfil and identify acombination of the attributes a competent nurse must have.

PurposeNurse regulatory authorities apply the competency standards in order to:

• communicate to consumers the competency standards that they can expect of nurses;• determine the eligibility for registration of people who have undertaken nursing courses in Australia;• determine the eligibility for registration of nurses who wish to practise in Australia but have undertaken

courses elsewhere;• assess nurses who wish to return to work after being out of the work force for a defined period; and,• assess qualified nurses who are required to show they are fit to continue working.

The significance of the competency standards

1. For the public, employers and others:These core competency standards are designed to encourage understanding of their purpose in the communityas well as by others involved in providing health and related services.

They contribute to positive health outcomes because registered nurses are equipped to provide safe andeffective nursing care.

Nurses who are registered are required to demonstrate competence. They are accountable for their actions andthey take responsibility for the supervision of enrolled nurses. In addition, they have a professionalresponsibility to maintain the standards in order to renew their licence.

Education courses leading to registration are accredited by nurse regulatory authorities. These programs requiregraduates to demonstrate the competency standards. This assists in ensuring that registered nurses are fit toprovide safe, competent care in a variety of settings.

2. For nurses:The standards take account of the contemporary role of the registered nurse which covers clinical practice,management of care, counselling, health promotion, client advocacy, facilitation of change, clinical teaching,supervising, mentoring and research. They provide a benchmark for nurses in daily practice.

They may be used for academic assessment, workplace performance review and for measuring continuingfitness to practice.

The competency standards reflect the unique characteristics of nursing as well as broader attributes nurseshave in common with other professions and occupations. In addition, they identify the knowledge, skills andattitudes required by nurses and reflect the complex nature of nursing activities.

DomainsThe competencies which make up the ANCI National Competency Standards for the Registered Nurse areorganised into domains.

Professional and Ethical PracticeThis contains the competencies that relate to legal and ethical responsibilities, including being able todemonstrate a satisfactory knowledge base, being accountable for practice, functioning in accordance withlegislation affecting nursing, and the protection of individuals and group rights.Critical Thinking and AnalysisThis contains those competencies relating to self-appraisal, professional development and the value of research.Reflecting on practice, feelings and beliefs and the consequences of these for clients, was considered animportant professional benchmark.

Management of CareThis contains the competencies that relate to the assessment of patients/clients, planning, implementation andthe evaluation of care.

EnablingThis contains those competencies essential for establishing and sustaining the nurse/patient relationship. Itintegrates the maintenance of safety, skills in interpersonal and therapeutic relationships, and communication aswell as organisational skills to ensure the provision of care. It also includes the ability to interact with othermembers of the health care team.

COMPETENCY UNIT 1 FUNCTIONS IN ACCORDANCE WITH LEGISLATION AND COMMON LAWAFFECTING NURSING PRACTICE.

WATER RESOURCES ACT 1997Notice of Prohibition of Water Use in the Upper Willunga

Catchment Moratorium AreaI, MARK BRINDAL, Minister for Water Resources, am of theopinion that:

(a) the rate at which water is being taken from wells in theUpper Willunga Catchment Moratorium Area, which isthat part of the area bounded by the bold line in G.R.O.Plan No. 497/98 that does not comprise the Hundred ofWillunga (the ‘defined area’), is such that there is a riskthat the available water will not be sufficient to meetfuture demand; and

(b) the rate at which surface water is being taken from the‘defined area’ is having a serious effect on the level ofwater in an underground aquifer system (namely theWillunga Basin) that depends on the surface water forreplenishment; and

(c) the rate at which water is being taken from water-courses and lakes in the ‘defined area’ is having a seriouseffect on the level of water in an underground aquifersystem (namely the Willunga Basin) that depends on thesurface water for replenishment.

Accordingly, pursuant to section 16 (1) of the Water ResourcesAct 1997, I hereby prohibit the taking of water from anywatercourse, lake or well in the ‘defined area’ subject to theexceptions specified in Schedule 1.

SCHEDULE 11. A person may take water in accordance with the terms of a

written authorisation granted by me or my delegate pursuant tothe notice under section 16 of the Act published in theGovernment Gazette on 11 February 1999.

2. This prohibition does not apply to the taking of waterpursuant to section 7 (5) of the Act for domestic purposes orwatering stock (other than stock subject to intensive farming) orto the taking of water for firefighting or reticulating supplies ofpotable water for townships in the defined area.

The notice dated 2 February 1999 is hereby revoked.This notice will remain in force until 31 December 2000 unless

NOTICE is hereby given pursuant to subclause 2 (15a) ofSchedule 3 of the Water Resources Act 1997, of the variation ofthe Water Allocation Plan for the Padthaway Prescribed WellsArea (‘the Plan’) such that the Plan takes the form set out inSchedule 1 to this notice. This variation takes effect from 27 July2000.

SCHEDULE 1Part 1—Interpretation

1. Unless otherwise indicated, words used in this Plan that aredefined in the Water Resources Act 1997, shall have themeanings determined under that Act.

2. The terms set out below have the following meanings for thepurposes of this Plan:

‘Confined aquifer’ means the saturated sands and gravels ofeither the Dilwyn Formation in the Otway Basin or theRenmark Group in the Murray Basin.‘Unconfined aquifer’ means the saturated sequence of rocksoccurring above the aquitard on top of the Dilwyn Formationin the Otway Basin or the Renmark Group in the MurrayBasin whether occurring within the Gambier Lime-stone ofthe Otway Basin, the Murray Group Limestone of theMurray Basin or some other younger geological unit.

‘Management area’ includes a sub-area and means a part of aPrescribed Wells Area as shown on the map numbered G.R.O.346/00 lodged in the General Registry Office.‘Landowner’ means the registered proprietor in fee simple ofthe land (under the Real Property Act 1886), or the lessee ofa perpetual lease from the Crown (under the Crown LandsAct 1929), or a party to an agreement to purchase from theCrown (under the Crown Lands Act) and includes a personauthorised in writing by the landowner to take or hold waterin relation to that land.‘Landholding’ means the allotment or allotments comprisedin a certificate of title under the Real Property Act held infee simple or land held under a perpetual lease from theCrown, or under an agreement to purchase from the Crown.‘Draw-down’ means the occasional, seasonal or permanentlowering of the water-table or reduction in pressure (head) ofan aquifer resulting from the extraction of groundwater.

Part 2—Unconfined Aquifer3. In no case shall water from the unconfined aquifer be

allocated where the allocation would cause the total amount ofwater allocated on all licences for the Padthaway Prescribed WellsArea to exceed the combined amount allocated on all licences asat 5 p.m. on 27 July 2000, for the Padthaway Prescribed WellsArea.

Criteria for Transfers4. Except as provided by clause 18, only water allocations and

licences for water from the unconfined aquifer may betransferred.

5. Water (taking) allocations of water from the unconfinedaquifer shall only be transferred where the taking and use of thewater pursuant to the transfer is in accordance with clauses 4 to13 of this Plan.

6. Water may be transferred where there is no change in thelocation of the point of extraction of the water and thelandholding on which the water is to be used is the same.

7. Water shall not be allocated or transferred where it is to betaken and used for wild flooding. For the purposes of this clause,‘wild flooding’ means flood irrigation where no adequate system(e.g. land levelling, or irrigation bays) is used to ensure uniformdistribution of the water; water is simply flooded onto theunformed land from a bore, in some cases using roughly formedearth channels or a hose to direct the water to different areas.Active and Expeditious Use of Water

8. Water (taking) allocations with a condition or conditionsimposed requiring the expeditious use of the water (including arequirement that the equipment, or land by which or on which thewater is used be developed in a certain time):

(a) may be transferred where the equipment or land hasbeen fully developed to allow the use of the water at itsmaximum lawful rate (unless clause (c) applies); or

(b) where the allocation has not been fully developed, onlythat portion of the allocation that may be used inaccordance with the extent of development at the dateof receipt of the application to transfer by the Ministermay be transferred (unless clause (c) applies);

(c) where the allocation is to be transferred but will be takenand used on the same landholding, it may be transferredwhether or not the land or equipment has been fullydeveloped in accordance with the condition(s).

Hydrogeological Effects9. The taking of water shall not adversely affect to a

significant extent the:(a) quality of water in the unconfined aquifer by (including

but not limited to) an increase in salinity;(b) water level of the unconfined aquifer by causing or

contributing to a long term decline in groundwaterlevels; and

(c) structural integrity of the aquifer,the taking of water shall substantially comply with the 4 kmsquare test.

10. For the purposes of clause 9 ‘the 4 km square test’ is therequirement that the grant of a water (taking) allocation shall notcause the total volume of water (taking) allocations within asquare with 4 km long sides centred on the proposed point ofextraction of the water, to exceed 1.25 times the amount ofannual vertical recharge for the management area.

11. For the purposes of clause 10 the amount of annual verticalrecharge is whichever is the greater of:

(a) the annual vertical recharge rate set out in Table 1multiplied by 16 km2; or

(b) the amount determined by the following formula—Specific yield multiplied by long term seasonal ground-water level fluctuation multiplied by 16 km 2.

Divided Landholdings12. Where a landholding is, or two or more contiguous land-

holdings held by the same landowner are, divided by a manage-ment area boundary, but the allocation is taken from only one ofthe management areas in which the landholding, or all or part ofone or more of the contiguous landholdings lies, the allocationmay be used throughout the landholding or landholdings.Crop Rotations

13. An allocation of water from a management area may betaken from another management area (‘the second managementarea’) even though the water from the second management areamay be fully allocated provided:

(a) the water is taken for the purpose of irrigating a crop orcrops that require planting in different locations eachgrowing season (either absolutely or for a limitednumber of years);

(b) the water is only taken from the second managementarea for five years or less; and

(c) the taking of the water from the second managementarea is in accordance with clauses 9 to 11 (hydro-geological effects).

Part 3—Confined Aquifer14. The taking of water from the confined aquifer shall be

limited to the purpose of public water supply.15. The taking of water from the confined aquifer shall not

cause a draw-down at peak demand at any point beyond the 2 kmradius from the proposed bore(s) greater than 2 m.

16. Water from the confined aquifer may only be allocated inorder of receipt of applications.

17. Taking of water from the confined aquifer shall not occurif it is likely to cause the potentiometric level in the confinedaquifer to fall below the potentiometric level in the uncon-fined aquifer where the existing potentiometric level of theconfined aquifer is greater than the potentiometric level of theunconfined aquifer.

18. Water from the confined aquifer may be transferred wherethe water will continue to be taken from the same point ofextraction.

(a) the forested area of the landholding; and(b) the area of any permanent lakes on the landholding.

‘Eligible area of management area’ means the total area ofthe relevant management area, less:

(a) the forested area of the management area; and(b) the area of any permanent lakes in the management

area.‘Forested area’ means an area of 4 ha or more or a numberof contiguous areas in total of 4 ha or more of:

(a) trees planted and nurtured by humans which form aclosed canopy forest, or would form a closed canopyon or before maturity (other than windbreaks orshelter belts of five or less rows of trees);

(b) native vegetation (that is not planted by humans)generally containing woody (sclerophyllous) species,

and includes:(c) any area of the landholding that may lawfully be used

as a forested area pursuant to a development approvalunder the Development Act 1993, or that is subject toa development application under that Act for use as aforested area;

(d) any area of the landholding declared in an applicationfor a water licence or allocation as intended for use asa forested area within two years;

(e) any area of the landholding described or referred to ina binding agreement obliging or contemplating the useof the area as a forested area within two years; and

(f) any area of the landholding described in a writtendeclaration by a commercial or Government forestgrower as intended for use as a forested area withintwo years.

‘Industry’ means the carrying on, in the course of a trade orbusiness, of any process for or incidental to:

(a) the making of any article (or part thereof); or(b) the altering, repairing, ornamenting, finishing,

assembling, cleaning, washing, packing, bottling,canning or adapting for sale, or the breaking up ordemolition of any article; or

(c) the getting, dressing or treatment of materials.‘Landholding’ means the allotment or allotments comprisedin a certificate of title under the Real Property Act 1886,held in fee simple or land held under a perpetual lease fromthe Crown, or under an agreement to purchase from theCrown.‘Landowner’ means the registered proprietor in fee simple ofthe land (under the Real Property Act), or the lessee of aperpetual lease from the Crown (under the Crown Lands Act1929), or a party to an agreement to purchase from theCrown (under the Crown Lands Act) and includes a personauthorised in writing by the landowner to take or hold waterin relation to that land.‘Less than 10 ha landowner’ means a landowner as at 5 p.m.on 27 July 2000, of a landholding in a rural area of less than10 ha.‘Management area’ means for the unconfined aquifer, a partof a Prescribed Wells Area as shown on the map numberedG.R.O. 346/00 lodged in the General Registry Office and forthe confined aquifer, a part of a Prescribed Wells Area shownon Map 1 annexed hereto.‘More than 10 ha landowner’ means a landowner as at 5 p.m.on 27 July 2000, of a landholding in a rural area of 10 ha ormore.‘Permanent lakes’ includes Lake Bonney, George, St Clair,Eliza, Hawdon South, Hawdon North, Robe, Nadzab and theunnamed lakes contained in sections 427 and 428, Hundredof Lacepede and sections 18, 22, 69 and 70, Hundred ofDuffield.‘Pro-rata application’ means an application for a water(holding) or (taking) allocation (as the case may be) receivedby the Minister after 5 p.m. on 3 August 1999, and before5 p.m. on 1 September 2000.‘Pro-rata allocation’ means a water (holding) or (taking)allocation (as the case may be) granted pursuant to a pro-rataapplication.‘Rural area’ means any land within a zone set out in Table 3as delineated in a Development Plan under the DevelopmentAct 1993, relating to the Lacepede-Kongorong PrescribedWells Area.‘Unconfined aquifer’ means the saturated sequence of rocksoccurring above the aquitard on top of the Dilwyn Formationin the Otway Basin or the Renmark Group in the MurrayBasin whether occurring within the Gambier Limestone ofthe Otway Basin, the Murray Group Limestone of theMurray Basin or some other younger geological unit.

Part 2—GeneralLimit to Total Allocation

3. In no case shall water be allocated (by water (holding)allocation or water (taking) allocation) from the unconfinedaquifer where the allocation would cause the total amount ofwater allocated on all licences for the relevant management areato exceed the total amount allocated on all licences as at 27 July2000, plus the available water set out in Table 1 for the relevantmanagement area.Water (Holding) Allocations

4. Pursuant to section 35A of the Water Resources Act, waterlicences may be endorsed with water (holding) allocations ofavailable water in accordance with the provisions of this Plan.Except where a water (holding) allocation is transferred, a water(holding) allocation may not be endorsed on a licence pursuant toan after pro-rata application.Basis of Allocation

5. Allocations will be expressed in kilolitres.

Unconfined Aquifer6. All water allocations shall be from the unconfined aquifer

except as provided by this Plan.Precedence to Certain Applications

7. For the purposes of section 35B of the Water Resources Act1997, pro-rata applications for water (holding) allocations fromless than 10 ha landowners have precedence over applicationsfrom more than 10 ha landowners and applications for water(taking) allocations.Random Monthly Allocation Priority

8. Water will be allocated in the following manner:(a) This clause does not apply to applications for the

transfer of water (taking) allocations in managementareas where there is no available water shown in Table 1.

(b) Applications to transfer allocations or to vary licencesreceived by the Minister prior to 5 p.m. on 27 July2000, will be determined in order of receipt and beforeapplications in the clauses below.

(c) Applications received by the Minister after 5 p.m. on 3August 1999, for the grant of water (taking) allocationsfor water from a particular management area andapplications to transfer water (taking) allocationsreceived by the Minister after 5 p.m. on 27 July 2000,will be given a serial number, and accumulated with otherapplications from the same management area until5 p.m. on 29 September 2000. Each serial number willthen anonymously be given a random rank number forthe purposes of that management area. Applications willthen be determined commencing with number 1 (foreach management area) in order of increasing ranknumber.

(d) Subject to subclause (e), applications for the grant ofwater (taking) allocations (including applications totransfer water (taking) allocations) received after 5 p.m.on 29 September 2000, will be accumulated until 5 p.m.on the last Friday of each succeeding month when theywill be accorded a rank number in the same manner forthe relevant management area. The rank numbers foreach successive month shall follow any rank numbersfor applications from earlier months for that manage-ment area that have not yet been determined.

(e) Applications for the grant of water (taking) allocations(including applications to transfer water (taking)allocations) received by the Minister after 31 December2000, will be determined in order of receipt afterapplications under subclauses (a)-(d) have beendetermined.

Part 3—Pro-Rata Allocations9. Pro-rata applications for water (holding) allocations will be

determined in accordance with Parts 1, 2 and 3 of this Plan.10. Pro-rata applications for water (taking) allocations will be

determined in accordance with Parts 1, 2, 3 and clauses 30 (wildflooding), 34 (efficient use), 35-37 (hydrogeological effects), 38(use on divided landholding) and 39 (crop rotations).Landowners with Licences to Use on more than One Landholding

11. Landowners as at 5 p.m. on 27 July 2000, of landholdingsin rural areas who hold a licence with a before pro-rata allocationthat authorises the taking and use of water from or on more thanone landholding will, for the purposes of calculation, have thatallocation deemed as being distributed between the separate land-holdings in proportion to the eligible area of those landholdingsand may be allocated available water as follows:

(a) the landholdings of less than 10 ha will be dealt with asunder clause 12;

(b) the landholdings which are equal to or greater than10 ha will be dealt with as under clause 15.

Landholdings of Less than 10 ha12. Subject to clauses 13 and 14, less than 10 ha landowners

who applied for a pro-rata allocation in relation to their land-holding may be allocated available water from the unconfinedaquifer at a rate up to equal to the volume shown in Table 2 foreach hectare of eligible area on that landholding.

Landowners with Existing Allocations of less than the Pro-rataAmount

13. Less than 10 ha landowners who hold a licence endorsedwith a before pro-rata allocation less than would be granted underclause 12 who applied for a pro-rata allocation may be allocatedan amount from the available water up to equal the volume thatthey would have received under clause 12 less the amount thatthey are entitled to take under their existing licence.

14. Less than 10 ha landowners who hold a licence to takewater endorsed with a before pro-rata allocation greater thanwould be granted under clause 12 shall not be allocated availablewater under clause 13.Landholdings of 10 ha or More

15. Unless clause 17 or 18 applies, more than 10 ha landownerswho applied for a pro-rata allocation of water in relation to thatlandholding may be allocated an amount of available water fromthe unconfined aquifer up to equal an amount determined inaccordance with clause 16 in respect of each such landholding.

16. The volume of a water (holding) allocation shall notexceed the amount determined by the following formula:

Volume of Allocation = (available water) X [(eligible area oflandholding)/(eligible area of management area)]

Landowners with Before Pro-rata Allocations17. More than 10 ha landowners who hold a licence to take

water endorsed with a before pro-rata allocation less than wouldbe granted under clause 16 who apply for a pro-rata allocationmay be allocated an amount from the available water up to equalthe volume that they would have received under clause 16 less theamount which they are entitled to take under their existinglicence.

18. More than 10 ha landowners who hold a licence to takewater endorsed with a before pro-rata allocation equal to orgreater than would be granted under clause 16 shall not beallocated available water under clause 16.

Part 4—After Pro-rata Allocations19. After pro-rata applications for the conversion of water

(holding) allocations to water (taking) allocations shall bedetermined in accordance with Parts 1 and 2 and clauses 30 (wildflooding), 34 (efficient use), 35-37 (hydrogeological effects), 38(use on divided landholding) and 39 (crop rotations) of this Plan.

20. After pro-rata applications for water (taking) allocationsshall be determined in accordance with Parts 1 and 2 and clauses29 (purpose of use), 30 (wild flooding), 31 and 32 (quantity ofallocation), 33 (active and expeditious use), 34 (efficient use),35-37 (hydrogeological effects), 38 (use on divided landholding)and 39 (crop rotations) of this Plan.

Part 5—Criteria for Transfers21. Applications to transfer pro-rata water (holding)

allocations shall be determined in accordance with Parts 1 and 2and clause 26 of this Plan.

22. Applications to transfer pro-rata water (taking) allocationsshall be determined in accordance with Parts 1 and 2 and clauses27, 30 (wild flooding), 34 (efficient use), 35-37 (hydrogeologicaleffects), 38 (divided landholdings) and 39 (crop rotations) of thisPlan.

23. Applications to transfer before pro-rata allocations shall bedetermined in accordance with Parts 1 and 2 and clauses 27, 28(development before transfer), 30 (wild flooding), 34 (efficientuse), 35-37 (hydrogeological effects), 38 (use on dividedlandholding) and 39 (crop rotation) of this Plan.

24. Applications to transfer after pro-rata allocations shall bedetermined in accordance with Parts 1 and 2 and clauses 27, 28(development before transfer), 30 (wild flooding), 34 (efficientuse), 35-37 (hydrogeological effects), 38 (use on divided land-holding) and 39 (crop rotation) of this Plan and applications totransfer after pro-rata allocations with a condition or conditionsimposed requiring the expeditious use of the water (including arequirement that the equipment, or land by which or on which thewater is used be developed in a certain time) that have not beenfully developed in accordance with such conditions will be subjectalso to clauses 29 (purpose of use) and 33 (active and expeditioususe).

25. Except as provided by clause 49, only water allocations andlicences for water from the unconfined aquifer may betransferred.Transfers of Water (Holding) Allocations

26. Water (holding) allocations may be transferred to anyperson but will continue to be recognised as being held from thesame management area from which the allocation was initiallygranted.Transfers of Water (Taking) Allocations

27. Water (taking) allocations may only be transferred wherethe proposed location of the point of extraction from which theallocation will be taken will be in the same management area asthe existing location of the point of extraction from which theallocation may lawfully be taken.Development of Allocation before Transfer

28. Both before pro-rata allocations and after pro-rataallocations with a condition or conditions imposed requiring theexpeditious use of the water (including a requirement that theequipment, or land by which or on which the water is used bedeveloped in a certain time):

(a) may be transferred where the equipment or land hasbeen fully developed to allow the use of the water at itsmaximum lawful rate (unless clause (c) applies); or

(b) where the allocation has not been fully developed, onlythat portion of the allocation that may be used inaccordance with the extent of development at the dateof receipt of the application to transfer by the Ministermay be transferred (unless clause (c) applies);

(c) where the allocation is to be transferred but will be takenand used on the same landholding, it may be transferredwhether or not the land or equipment has been fullydeveloped in accordance with the condition(s).

Part 6—Taking and Use of WaterPurpose of Use

29. Available water from the unconfined aquifer may only beallocated to be taken and used for any one or more of thefollowing purposes:

(a) public water supply;(b) industry;(c) energy generation.

Wild Flooding30. Available water shall not be allocated where it is to be

taken and used for wild flooding. For the purposes of this clause,‘wild flooding’ means flood irrigation where no adequate system(eg land levelling, or irrigation bays) is used to ensure uniformdistribution of the water; water is simply flooded onto theunformed land from a bore, in some cases using roughly formedearth channels or a hose to direct the water to different areas.Quantity of Allocation

31. Where available water is to be used for irrigation purposes,the allocation shall not exceed the amount reasonably required toirrigate the area of the particular crop type on the relevant soiltype, and in the relevant climate of the landholding.

32. Where available water is to be used for purposes other thanirrigation, the allocation shall not exceed the amount reasonablyrequired (applying current industry best practice standards) for thepurpose proposed.Active and Expeditious Use of Water

33. Except for the portion of before pro-rata allocations equalto the amount of water that would have been allocated underclause 12, water shall be expeditiously used with the minimum ofdelay and in any case within three years of the granting of theallocation the land and equipment upon or by which the water isused shall be developed to a capacity to enable the allocation tobe used at its maximum lawful rate.Efficient Use of Water

34. Water shall be used and applied using water efficient tech-nologies and techniques.

Hydrogeological Effects35. The taking of water shall not adversely affect to a

significant extent the:(a) quality of water in the unconfined aquifer by (including

but not limited to) an increase in salinity;(b) water level of the unconfined aquifer by causing or

contributing to a long term decline in groundwaterlevels; and

(c) structural integrity of the aquifer,the taking of water shall substantially comply with the 4 kmsquare test.

36. For the purposes of clause 35 ‘the 4 km square test’ is therequirement that the grant of a water (taking) allocation shall notcause the total volume of water (taking) allocations within asquare with 4 km long sides centred on the proposed point ofextraction of the water, to exceed 1.25 times the amount ofannual vertical recharge for the management area.

37. For the purposes of clause 36 the amount of annual verticalrecharge is whichever is the greater of:

(a) the annual vertical recharge rate set out in Table 4multiplied by 16 km2; or

(b) the amount determined by the following formula—Specific yield multiplied by long term seasonal ground-water level fluctuation multiplied by 16 km 2.

Divided Landholdings38. Where a landholding is, or two or more contiguous

landholdings held by the same landowner are, divided by amanagement area boundary, but the allocation is taken from onlyone of the management areas in which the landholding, or all orpart of one or more of the contiguous landholdings lies, theallocation may be used throughout the landholding or land-holdings.Crop Rotations

39. An allocation of water from a management area may betaken from another management area (‘the second managementarea’) even though the water from the second management areamay be fully allocated provided:

(a) the water is taken for the purpose of irrigating a crop orcrops that require planting in different locations eachgrowing season (either absolutely or for a limitednumber of years);

(b) the water is only taken from the second managementarea for five years or less; and

(c) the taking of the water from the second managementarea is in accordance with clauses 35-37 (hydro-geological effects).

Part 7—Confined Aquifer40. All allocations of water from the confined aquifer shall be

in accordance with Part 7.41. Unless clause 42 applies, the taking of water from the

confined aquifer shall be limited to the purpose of public watersupply.

42. Subject to clause 43, within the Millicent management area(shown on Map 1 annexed hereto) the taking of water from theconfined aquifer shall be limited to the following purposes of use:

(a) public water supply;(b) industry.

43. Except for the purpose of public water supply water shallnot be allocated from the confined aquifer if:

(a) the quantity and quality of the unconfined aquifer waterat the proposed location of use is sufficient to providethe quantity and quality of water required for theproposed project (whether allocated to another personor not); and

(b) the taking of the same quantity of water from the samelocation from the unconfined aquifer could occur inaccordance with clauses 35 to 37 inclusive.

44. Water shall not be allocated to be taken from the confinedaquifer in the Kingston management area delineated on Map 1annexed hereto.

45. The taking of water from the confined aquifer shall notcause a draw-down at peak demand at any point beyond the 2 kmradius from the proposed bore(s) greater than 2 m.

46. Water from the confined aquifer may only be allocated inorder of receipt of applications.

47. Taking of water from the confined aquifer shall not occurif it is likely to cause the potentiometric level in the confinedaquifer to fall below the potentiometric level in the uncon-fined aquifer where the existing potentiometric level of theconfined aquifer is greater than the potentiometric level of theunconfined aquifer.

48. Water from the confined aquifer may be allocated to aperson who holds a before pro-rata allocation from theunconfined aquifer provided:

(a) since the grant or transfer to the person of the beforepro-rata allocation from the unconfined aquifer, thataquifer has become unable to supply the amount ofwater allocated to that person; and

(b) without an allocation from the confined aquifer, theperson or the business enterprise reliant on the waterwill suffer substantial financial detriment.

49. Water from the confined aquifer may be transferred wherethe water will continue to be taken from the same point ofextraction.

50. The amount of an allocation of water from the confinedaquifer shall not exceed the amount reasonably required (applyingcurrent industry best practice standards) for the purposeproposed.Table 1—Volumes Available for Allocation in Management Areas

WATER RESOURCES ACT 1997Notice of Variation to Water Allocation Plans

NOTICE is hereby given pursuant to subclause 2 (15a) ofSchedule 3 of the Water Resources Act 1997, of the variation ofthe Water Allocation Plans for the Tatiara Prescribed WellsArea, Naracoorte Ranges Prescribed Wells Area and ComaumCaroline Prescribed Wells Area (‘the Plans’) such that each ofthe Plans take the form set out in Schedule 1 to this notice. Thisvariation takes effect from 27 July 2000.

SCHEDULE 1Part 1—Interpretation

1. Unless otherwise indicated, words used in this Plan that aredefined in the Water Resources Act 1997, shall have themeanings determined under that Act.

2. The terms set out below have the following meanings for thepurposes of this Plan:

‘After pro-rata allocation’ means a water (holding) or(taking) allocation (as the case may be) granted pursuant toan after pro-rata application.‘After pro-rata application’ means an application for a water(holding) or (taking) allocation (as the case may be) receivedby the Minister after 5 p.m. on 1 September 2000.‘Available water’ for any management area means thevolume of water set out in Table 1 for the relevant manage-ment area.‘Before pro-rata allocation’ means a water allocation grantedpursuant to an application received by the Minister before5 p.m. on 3 August 1999.‘Confined aquifer’ means the saturated sands and gravels ofeither the Dilwyn Formation in the Otway Basin or theRenmark Group in the Murray Basin.‘Draw-down’ means the occasional, seasonal or permanentlowering of the water-table or reduction in pressure (head) ofan aquifer resulting from the extraction of groundwater.‘Eligible area of landholding’ means the total area of thelandholding less the forested area of the landholding.‘Eligible area of management area’ means the total area ofthe relevant management area less the forested area of themanagement area.‘Forested area’ means an area of 4 ha or more or a numberof contiguous areas in total of 4 ha or more of:

(a) trees planted and nurtured by humans which form aclosed canopy forest, or would form a closed canopyon or before maturity (other than windbreaks orshelter belts of five or less rows of trees);

(b) native vegetation (that is not planted by humans)generally containing woody (sclerophyllous) species,

and includes:(c) any area of the landholding that may lawfully be used

as a forested area pursuant to a development approvalunder the Development Act 1993, or that is subject toa development application under that Act for use as aforested area;

(d) any area of the landholding declared in an applicationfor a water licence or allocation as intended for use asa forested area within two years;

(e) any area of the landholding described or referred to ina binding agreement obliging or contemplating the useof the area as a forested area within two years; and

(f) any area of the landholding described in a writtendeclaration by a commercial or Government forestgrower as intended for use as a forested area withintwo years.

‘Industry’ means the carrying on, in the course of a trade orbusiness, of any process for or incidental to:

(a) the making of any article (or part thereof); or(b) the altering, repairing, ornamenting, finishing,

assembling, cleaning, washing, packing, bottling,canning or adapting for sale, or the breaking up ordemolition of any article; or

(c) the getting, dressing or treatment of materials.

‘Landholding’ means the allotment or allotments comprisedin a certificate of title under the Real Property Act 1886,held in fee simple or land held under a perpetual lease fromthe Crown, or under an agreement to purchase from theCrown.‘Landowner’ means the registered proprietor in fee simple ofthe land (under the Real Property Act 1886), or the lessee ofa perpetual lease from the Crown (under the Crown LandsAct 1929), or a party to an agreement to purchase from theCrown (under the Crown Lands Act 1929) and includes aperson authorised in writing by the landowner to take or holdwater in relation to that land.‘Less than 10 ha landowner’ means a landowner as at 5 p.m.on 27 July 2000, of a landholding in a rural area of less than10 ha.‘Management area’ means for the unconfined aquifer, a partof a Prescribed Wells Area as shown on the map numberedG.R.O. 346/00 lodged in the General Registry Office and forthe confined aquifer, a part of a Prescribed Wells Area shownon Map 1 annexed hereto.‘More than 10 ha landowner’ means a landowner as at 5 p.m.on 27 July 2000, of a landholding in a rural area of 10 ha ormore.‘Pro-rata application’ means an application for a water(holding) or (taking) allocation (as the case may be) receivedby the Minister after 5 p.m. on 3 August 1999, and before5 p.m. on 1 September 2000.‘Pro-rata allocation’ means a water (holding) or (taking)allocation (as the case may be) granted pursuant to a pro-rataapplication.‘Rural area’ means any land within a zone set out in Table 3as delineated in a Development Plan under the DevelopmentAct 1993.‘Unconfined aquifer’ means the saturated sequence of rocksoccurring above the aquitard on top of the Dilwyn Formationin the Otway Basin or the Renmark Group in the MurrayBasin whether occurring within the Gambier Lime-stone ofthe Otway Basin, the Murray Group Limestone of theMurray Basin or some other younger geological unit.

References in this Plan to applications for the grant of water(taking) allocations include applications for the conversion ofwater (holding) allocations to water (taking) allocations.

Part 2—GeneralLimit to Total Allocation

3. In no case shall water be allocated (by water (holding)allocation or water (taking) allocation) from the unconfinedaquifer where the allocation would cause the total amount ofwater allocated on all licences for the relevant management areato exceed the total amount allocated on all licences as at 27 July2000, plus the available water set out in Table 1 for the relevantmanagement area.Water (Holding) Allocations

4. Pursuant to section 35A of the Water Resources Act, waterlicences may be endorsed with water (holding) allocations ofavailable water in accordance with the provisions of this Plan.Except where a water (holding) allocation is transferred, a water(holding) allocation may not be endorsed on a licence pursuant toan after pro-rata application.Basis of Allocation

5. Allocations will be expressed in kilolitres.Unconfined Aquifer

6. All water allocations shall be from the unconfined aquiferexcept as provided by this Plan.Precedence to Certain Applications

7. For the purposes of section 35B of the Water Resources Act1997, pro-rata applications for water (holding) allocations fromless than 10 ha landowners have precedence over applicationsfrom more than 10 ha landowners and applications for water(taking) allocations.

Random Monthly Allocation Priority8. Water will be allocated in the following manner:

(a) This clause does not apply to applications for thetransfer of water (taking) allocations in managementareas where there is no available water shown in Table 1.

(b) Applications to transfer allocations or to vary licencesreceived by the Minister prior to 5 p.m. on 27 July2000, will be determined in order of receipt and beforeapplications in the clauses below.

(c) Applications received by the Minister after 5 p.m. on 3August 1999, for the grant of water (taking) allocationsfor water from a particular management area andapplications to transfer water (taking) allocationsreceived by the Minister after 5 p.m. on 27 July 2000,will be given a serial number and accumulated with otherapplications from the same management area until5 p.m. on 29 September 2000. Each serial number willthen anonymously be given a random rank number forthe purposes of that management area. Applications willthen be determined commencing with number 1 (foreach management area) in order of increasing ranknumber.

(d) Subject to subclause (e), applications for the grant ofwater (taking) allocations (including applications totransfer water (taking) allocations) received after 5 p.m.on 29 September 2000, will be accumulated until 5 p.m.on the last Friday of each succeeding month when theywill be accorded a rank number in the same manner forthe relevant management area. The rank numbers foreach successive month shall follow any rank numbersfor applications from earlier months for that manage-ment area that have not yet been determined.

(e) Applications for the grant of water (taking) allocations(including applications to transfer water (taking)allocations) received by the Minister after 31 December2000, will be determined in order of receipt afterapplications under subclauses (a)-(d) have beendetermined.

Part 3—Pro-rata Allocations9. Pro-rata applications for water (holding) allocations will be

determined in accordance with Parts 1, 2 and 3 of this Plan.10. Pro-rata applications for water (taking) allocations will be

determined in accordance with Parts 1, 2, 3 and clauses 30 (wildflooding), 34 (efficient use), 35-37 (hydrogeological effects), 38(use on divided landholding) and 39 (crop rotations).Landowners with Licences to Use on more than One Landholding

11. Landowners as at 5 p.m. on 27 July 2000, of landholdingsin rural areas who hold a licence with a before pro-rata allocationthat authorises the taking and use of water from or on more thanone landholding will, for the purposes of calculation, have thatallocation deemed as being distributed between the separatelandholdings in proportion to the eligible area of thoselandholdings and may be allocated available water as follows:

(a) the landholdings of less than 10 ha will be dealt with asunder clause 12;

(b) the landholdings which are equal to or greater than10 ha will be dealt with as under clause 15.

Landholdings of Less than 10 ha12. Subject to clauses 13 and 14, less than 10 ha landowners

who applied for a pro-rata allocation in relation to their land-holding may be allocated available water from the unconfinedaquifer at a rate up to equal to the volume shown in Table 2 foreach hectare of eligible area on that landholding.Landowners with Existing Allocations of Less than the Pro-rataAmount

13. Less than 10 ha landowners who hold a licence endorsedwith a before pro-rata allocation less than would be granted underclause 12 who applied for a pro-rata allocation may be allocatedan amount from the available water up to equal the volume thatthey would have received under clause 12 less the amount thatthey are entitled to take under their existing licence.

14. Less than 10 ha landowners who hold a licence to takewater endorsed with a before pro-rata allocation greater thanwould be granted under clause 12 shall not be allocated availablewater under clause 13.Landholdings of 10 ha or More

15. Unless clause 17 or 18 applies, more than 10 ha landownerswho applied for a pro-rata allocation of water in relation to thatlandholding may be allocated an amount of available water fromthe unconfined aquifer up to equal an amount determined inaccordance with clause 16 in respect of each such landholding.

16. The volume of a water (holding) allocation shall notexceed the amount determined by the following formula:

Volume of Allocation = (available water) X [(eligible area oflandholding)/(eligible area of management area)]

Landowners with Before Pro-rata Allocations17. More than 10 ha landowners who hold a licence to take

water endorsed with a before pro-rata allocation less than wouldbe granted under clause 16 who apply for a pro-rata allocationmay be allocated an amount from the available water up to equalthe volume that they would have received under clause 16 less theamount which they are entitled to take under their existinglicence.

18. More than 10 ha landowners who hold a licence to takewater endorsed with a before pro-rata allocation equal to orgreater than would be granted under clause 16 shall not beallocated available water under clause 16.

Part 4—After Pro-rata Allocations19. After pro-rata applications for the conversion of water

(holding) allocations to water (taking) allocations shall bedetermined in accordance with Parts 1 and 2 and clauses 30 (wildflooding), 34 (efficient use), 35-37 (hydrogeological effects), 38(use on divided landholding) and 39 (crop rotations) of this Plan.

20. After pro-rata applications for water (taking) allocationsshall be determined in accordance with Parts 1 and 2 and clauses29 (purpose of use), 30 (wild flooding), 31 and 32 (quantity ofallocation), 33 (active and expeditious use), 34 (efficient use),35-37 (hydrogeological effects), 38 (use on divided landholding)and 39 (crop rotations) of this Plan.

Part 5—Criteria for Transfers21. Applications to transfer pro-rata water (holding)

allocations shall be determined in accordance with Parts 1 and 2and clause 26 of this Plan.

22. Applications to transfer pro-rata water (taking) allocationsshall be determined in accordance with Parts 1 and 2 and clauses27, 30 (wild flooding), 34 (efficient use), 35-37 (hydrogeologicaleffects), 38 (divided landholdings) and 39 (crop rotations) of thisPlan.

23. Applications to transfer before pro-rata allocations shall bedetermined in accordance with Parts 1 and 2 and clauses 27, 28(development before transfer), 30 (wild flooding), 34 (efficientuse), 35-37 (hydrogeological effects), 38 (use on divided land-holding) and 39 (crop rotation) of this Plan.

24. Applications to transfer after pro-rata allocations shall bedetermined in accordance with Parts 1 and 2 and clauses 27, 28(development before transfer), 30 (wild flooding), 34 (efficientuse), 35-37 (hydrogeological effects), 38 (use on divided land-holding) and 39 (crop rotation) of this Plan and applications totransfer after pro-rata allocations with a condition or conditionsimposed requiring the expeditious use of the water (including arequirement that the equipment, or land by which or on which thewater is used be developed in a certain time) that have not beenfully developed in accordance with such conditions will be subjectalso to clauses 29 (purpose of use) and 33 (active and expeditioususe).

25. Except as provided by clause 49, only water allocations andlicences for water from the unconfined aquifer may betransferred.Transfers of Water (Holding) Allocations

26. Water (holding) allocations may be transferred to anyperson but will continue to be recognised as being held from thesame management area from which the allocation was initiallygranted.Transfers of Water (Taking) Allocations

27. Water (taking) allocations may only be transferred wherethe proposed location of the point of extraction from which theallocation will be taken will be in the same management area asthe existing location of the point of extraction from which theallocation may lawfully be taken.Development of Allocation before Transfer

28. Both before pro-rata allocations and after pro-rataallocations with a condition or conditions imposed requiring theexpeditious use of the water (including a requirement that theequipment, or land by which or on which the water is used bedeveloped in a certain time):

(a) may be transferred where the equipment or land hasbeen fully developed to allow the use of the water at itsmaximum lawful rate (unless clause (c) applies); or

(b) where the allocation has not been fully developed, onlythat portion of the allocation that may be used inaccordance with the extent of development at the dateof receipt of the application to transfer by the Ministermay be transferred (unless clause (c) applies);

(c) where the allocation is to be transferred but will be takenand used on the same landholding, it may be transferredwhether or not the land or equipment has been fullydeveloped in accordance with the condition(s).

Part 6—Taking and Use of WaterPurpose of Use

29. Available water from the unconfined aquifer may only beallocated to be taken and used for any one or more of thefollowing purposes:

(a) public water supply;(b) industry;(c) energy generation.

Wild Flooding30. Available water shall not be allocated where it is to be

taken and used for wild flooding. For the purposes of this clause,‘wild flooding’ means flood irrigation where no adequate system(eg land levelling, or irrigation bays) is used to ensure uniformdistribution of the water; water is simply flooded onto theunformed land from a bore, in some cases using roughly formedearth channels or a hose to direct the water to different areas.Quantity of Allocation

31. Where available water is to be used for irrigation purposes,the allocation shall not exceed the amount reasonably required toirrigate the area of the particular crop type on the relevant soiltype, and in the relevant climate of the landholding.

32. Where available water is to be used for purposes other thanirrigation, the allocation shall not exceed the amount reasonablyrequired (applying current industry best practice standards) for thepurpose proposed.Active and Expeditious Use of Water

33. Except for the portion of before pro-rata allocations equalto the amount of water that would have been allocated underclause 12, water shall be expeditiously used with the minimum ofdelay and in any case within three years of the granting of theallocation the land and equipment upon or by which the water isused shall be developed to a capacity to enable the allocation tobe used at its maximum lawful rate.Efficient use of Water

34. Water shall be used and applied using water efficienttechnologies and techniques.Hydrogeological Effects

35. The taking of water shall not adversely affect to asignificant extent the:

(a) quality of water in the unconfined aquifer by (includingbut not limited to) an increase in salinity;

(b) water level of the unconfined aquifer by causing orcontributing to a long term decline in groundwaterlevels; and

(c) structural integrity of the aquifer,the taking of water shall substantially comply with the 4 kmsquare test.

36. For the purposes of clause 35 ‘the 4 km square test’ is therequirement that the grant of a water (taking) allocation shall notcause the total volume of water (taking) allocations within asquare with 4 km long sides centred on the proposed point ofextraction of the water, to exceed 1.25 times the amount ofannual vertical recharge for the management area, recharge zoneor recharge sub-area (whichever is relevant).

37. For the purposes of clause 36 the amount of annual verticalrecharge for a management area, recharge zone or recharge sub-

area (or portion or portions thereof) is whichever is the greaterof:

(a) the annual vertical recharge rate set out in Table 4 forthe relevant management area (or recharge zone shownon Map 2 for the Stirling and Willalooka managementareas) or the annual vertical recharge rate for therelevant recharge sub-areas delineated on GeneralRegistry Office Plan 364/00 (whichever is relevant)multiplied by 16 km2; or

(b) the amount determined by the following formula—Specific yield multiplied by long term seasonal ground-water level fluctuation multiplied by 16 km 2.

Divided Landholdings38. Where a landholding is, or two or more contiguous land-

holdings held by the same landowner are, divided by a manage-ment area boundary, but the allocation is taken from only one ofthe management areas in which the landholding, or all or part ofone or more of the contiguous landholdings lies, the allocationmay be used throughout the landholding or landholdings.Crop Rotations

39. An allocation of water from a management area may betaken from another management area (‘the second managementarea’) even though the water from the second management areamay be fully allocated provided:

(a) the water is taken for the purpose of irrigating a crop orcrops that require planting in different locations eachgrowing season (either absolutely or for a limitednumber of years);

(b) the water is only taken from the second managementarea for five years or less; and

(c) the taking of the water from the second managementarea is in accordance with clauses 35-37 (hydro-geological effects).

Part 7—Confined Aquifer40. All allocations of water from the confined aquifer shall be

in accordance with Part 7.41. Unless clause 42 applies, the taking of water from the

confined aquifer shall be limited to the purpose of public watersupply.

42. Subject to clause 43, within the Zone 1A management area(shown on Map 1 annexed hereto) the taking of water from theconfined aquifer shall be limited to the following purposes of use:

(a) public water supply;(b) processing the products of primary industry.

43. Except for the purpose of public water supply water shallnot be allocated from the confined aquifer if:

(a) the quantity and quality of the unconfined aquifer waterat the proposed location of use is sufficient to providethe quantity and quality of water required for theproposed project (whether allocated to another personor not); and

(b) the taking of the same quantity of water from the samelocation from the unconfined aquifer could occur inaccordance with clauses 35 to 37 inclusive.

44. Water shall not be allocated to be taken from the confinedaquifer in the Kingston management area delineated on Map 1annexed hereto.

45. The taking of water from the confined aquifer shall notcause a draw-down at peak demand at any point beyond the 2 kmradius from the proposed bore(s) greater than 2 m.

46. Water from the confined aquifer may only be allocated inorder of receipt of applications.

47. Taking of water from the confined aquifer shall not occurif it is likely to cause the potentiometric level in the confinedaquifer to fall below the potentiometric level in the uncon-fined aquifer where the existing potentiometric level of theconfined aquifer is greater than the potentiometric level of theunconfined aquifer.

48. Water from the confined aquifer may be allocated to aperson who holds a before pro-rata allocation from theunconfined aquifer provided:

(a) since the grant or transfer to the person of the beforepro-rata allocation from the unconfined aquifer, that

aquifer has become unable to supply the amount ofwater allocated to that person; and

(b) without an allocation from the confined aquifer, theperson or the business enterprise reliant on the waterwill suffer substantial financial detriment.

49. Water from the confined aquifer may be transferred wherethe water will continue to be taken from the same point ofextraction.

50. The amount of an allocation of water from the confinedaquifer shall not exceed the amount reasonably required (applyingcurrent industry best practice standards) for the purposeproposed.

(7) For the purposes of those regulations, a Life Skills Development Program is a programof that name administered and funded by the Department of Human Services to assist peoplewith disabilities to participate to a greater degree in the life of the community through thedevelopment or improvement of basic life skills.

Insertion of reg. 91A6. The following regulation is inserted in Part 7 of the principal regulations after regulation 91:

Exemption from operation of s. 5291A. Pursuant to subsection (2)(c) of section 52 of the Act, subsection (1) of that section

does not apply in relation to the operator of—

(a) a centralised booking service for taxis; or

(b) a booking service for taxis operating outside Metropolitan Adelaide.

Notice is hereby given that the Council of the Corporation ofthe City of Adelaide at its meeting held on 10 July 2000, declareda separate rate, pursuant to Chapter 10 of the Local GovernmentAct 1999 and section 138 of the Water Resources Act 1997:

(1) A separate rate of 0.1645 cents in the dollar be declaredon rateable land within the council area falling withinthe Catchment Area of the Torrens Catchment WaterManagement Board, in accordance with the require-ments of section 138 of the Water Resources Act 1997.

Declaration of Separate Rate—Rundle Mall EnvironsNotice is hereby given that the Council of the Corporation of

the City of Adelaide at its meeting held on 10 July 2000, resolvedthat having taken into account the general principles of ratingoutlined in section 150 of the Local Government Act 1999, andthe requirements of Chapter 10 of the Local Government Act1999:

(1) Council, declare a separate rate (to be known as theRundle Mall Environs Separate Rate) of 2.64 cents inthe dollar for the period 1 July 2000 to 30 June 2001 onrateable land within the Rundle Mall Environs for thepurposes of marketing the Rundle Mall Environs,pursuant to section 154 (1) of the Local GovernmentAct 1999.

(2) Council fix the minimum rate payable by way of theRundle Mall Environs Separate Rate in respect of eachpiece of relevant rateable land (subject to the operationof section 158 of the Local Government Act 1999) at$100, pursuant to section 158 of the Local GovernmentAct 1999.

(3) The Rundle Mall Environs Separate Rate be payable bytwo equal instalments due on or before the first day ofSeptember 2000 and the first day of March 2001.

(4) For the purpose of securing the proper development ofthe Rundle Mall Environs, the Rundle Mall EnvironsSeparate Rate in respect of rateable land that is used as aplace of residence as at 1 July 2000, be rebated in full,pursuant to section 166 of the Local Government Act1999.

(5) For the purposes of securing the proper development ofthe Rundle Mall Environs, the Rundle Mall EnvironsSeparate Rate in respect of rateable land not fallingwithin (4) above and which received a rebate asCategory 3 rateable land, pursuant to the resolution ofcouncil made on 21 June 1999, to declare the RundleMall Environs Separate Rate for the period 1 July 1999to 30 June 2000 be (subject to (6) below) rebated by thelesser of:(a) an amount of 67% of the relevant rate; or(b) such amount as would reduce the relevant rate to

$100,pursuant to section 166 of the Local Government Act1999.

(6) The property known as Adelaide Central PlazaDevelopment (the whole of the land comprised in CT4402, folio 404) be excluded from the operation of (5)above having regard to the use to which that propertywill be put during the period 1 July 2000 to 30 June2001.

(7) For the purposes of this resolution, Rundle MallEnvirons be that area bounded by the:(a) southern alignment of North Terrace between

Pulteney and King William Streets;(b) eastern alignment of King William Street between

Declaration of General Rates3. In order to raise the amount required for general rate

revenue:(a) differential general rates be declared on all rateable

land as follows:(i) 0.717 cents in the dollar of the Capital Value

of rateable land of Categories 1 and 9 use(Residen-tial and Other Categories);

(ii) 1.240 cents in the dollar of the Capital Value ofrateable land of Categories 2, 3 and 4 use(Commercial Categories);

(iii) 1.051 cents in the dollar of the Capital Value ofrateable land of Categories 5 and 6 use (IndustrialCategories);

Declaration of Separate Rates4. (a) In exercise of the powers contained in section 154 of

the Act in order to provide carparking facilities for the benefitof properties within an area bounded by South Terrace,Swanport Road, Mannum Road, First Street, West Terrace,North Terrace, Railway Terrace, Bridge Street and EastTerrace, a separate rate of 0.0543 cents in the dollar of theCapital Value of rateable land in that area is declared on thatland;

(b) in exercise of the powers contained in section 182 (1) ofthe Act, a remission of rates be granted to ratepayers ofproperty in that area where the property is used for other thanCategories 2, 3 or 4 use, such remission being of an amount of0.0543 cents in the dollar of the Capital Value of the property;

(c) in exercise of the powers contained in section 154 of theAct in order to upgrade and improve the Town Centre Zone (asdefined in the Development Plan under the Development Act1993, applicable to the council’s area), a separate rate of0.2102 cents in the dollar of the Capital Value of rateable landin the Town Centre Zone is declared on that land;

(d) in exercise of the powers contained in section 182 (1) ofthe Act, a remission of rates be granted to ratepayers ofproperty in the Town Centre Zone where the property is usedfor other than Categories 2, 3 or 4 use, such remission being ofan amount of 0.2102 cents in the dollar of the Capital Value ofthe property.

Declaration of Service Rate5. Pursuant to section 155 of the Act, a service charge of

$300 per assessment, and a service rate of 0.1302 cents in thedollar of the Capital Value of rateable land comprisingallotments 1 to 30, 125, 126 in Deposited Plan 30450 andUnits 1 to 73 in Strata Plan No. 11238, is declared on the land,to which the council provides a service, namely the provisionof septic tank effluent disposal and water supply services to theland.

Payment6. Pursuant to section 181 (1) of the Act, all rates are

payable in four equal instalments as follows:(i) by 22 September 2000;(ii) by 22 December 2000;(iii) by 23 March 2001;(iv) by 22 June 2001.

Early Payment Incentive Scheme7. In exercise of the powers contained in section 181 (11) of

the Act, and being of the opinion that it is desirable toencourage ratepayers to pay their general rates and/or separaterates, and/or service rates, and/or service charges early, thecouncil offers to give a discount of 1% of the amount payableof general rates, and/or separate rates, and/or service rates,and/or service charges if paid in full by 25 August 2000.

Water Catchment ManagementBoard, the council fixed a separate rate of $8.60 in respect ofeach rateable property in the area of the council in theCatchment Area of the Board.

Payment of Rates by Quarterly Instalments7. That pursuant to section 184 of the Act the payment of

Government Act 1999, the council fixes, in respect of the yearending 30 June 2001, a minimum amount of rates payable byway of a differential general rate on rateable land within thetownships of Bordertown, Keith, Mundulla, Padthaway andWolseley in the sum of $190, and rateable land outside of thosetownships of $80.

That pursuant to section 155 of the Local Government Act1999, in respect of the year ending 30 June 2001, the councilimposes:

• An annual service charge, based on property units, onrateable and non-rateable land within its area which isserviced by Septic Tank Effluent Disposal schemes.

• In the area covered by the Bordertown Septic TankEffluent Drainage Scheme an annual service charge of$90 on each vacant allotment and an annual servicecharge of $106 on all other assessed properties.

• In the area covered by the Keith Septic Tank EffluentDrainage Scheme an annual service charge of $90 oneach vacant allotment and an annual service charge of$105 on all other assessed properties.

• In the area covered by the Mundulla Septic TankEffluent Drainage Scheme an annual service charge of$73 on each vacant allotment and an annual servicecharge of $86 on all other assessed properties.

• In the area covered by the Wolseley Septic TankEffluent Drainage Scheme an annual service charge of$150 on each vacant allotment and an annual servicecharge of $180 on all other assessed properties.

Declaration of Separate Rate—Catchment WaterThat in exercise of the powers contained in section 138 of

the Water Resources Act 1997 and section 154 (1) of theLocal Government Act 1999, in order to reimburse to thecouncil the amount contributed to the South East CatchmentWater Management Board, the council declares a separate rateof $8.60 on all rateable land in the council’s area in thecatchment area of the Board, based on a fixed levy of the sameamount on all rateable land.

Payment of RatesThat pursuant to section 181 of the Local Government Act

1999, the council declares that the rates and charges payable inrespect of the 2000-2001 financial year, are payable in fourinstalments due on 30 September 2000, 1 December 2000,1 March 2001 and 1 June 2001.

1. (a) Differential general rates be declared for the yearending 30 June 2001, on the Capital Valuation of all rateableproperty within the area of the council and the said differentialgeneral rates to vary by reference to the locality in which therateable property is situated.

(b) For the purposes of section 156 of the said Act, councilhereby resolves that the locality differentiating factor for thebasis of differential general rates shall be according to the zonein which the land is situated and in this context zone means azone defined as a zone by or under the Development Act 1993.

(c) The said differential general rates shall be and are herebydeclared as follows:

(i) In respect to such rateable property which islocated within the Residential, Commercial, Centre,Com-mercial (Cape Jervis), Rural Living, RuralCoastal, Country Township, Tourist Accommodation(Nor-manville), Wirrina Cove, Country Living,Historic (Conservation) Rapid Bay, ExtractiveIndustry, Randalsea Historic (Conservation),Residential (Ran-dalsea) and Residential (Golf Course)zones a differential general rate of 0.517 cents in thedollar on the Capital Valuation of such rateableproperty.

2. In respect to the 2000-2001 financial year and pursuantto section 158 of the Local Government Act 1999, the councilhereby fixes the sum of $360 as the minimum amount payableby way of rates in respect of rateable land within the area.

3. That pursuant to section 181 of the Local GovernmentAct 1999, the above rates be paid in a single instalment by 31October 2000, or in four equal, or approximately equal, instal-ments with the first instalment payable by 29 September 2000,or unless otherwise agreed with the principal ratepayer.
