Thanks to the hard work of this outgoing Board, our Chapter has received Platinum Classification for the ALA Presidents’ Award of Excellence Program – the highest level available. The ALA over the years has tried to find ways to make sure that all the Chapters are providing a somewhat equal opportunity for the ALA membership. They created this Award of Excellence to give each Chapter a guideline of what they should be offering to the membership as far as education opportunities, newsletters to update membership, webinar availability, encouraging members to become involved, developing good Business Partner relations and a whole host of other national and regional activities for the Board. It is definitely a challenge to include all the steps required in our planning of general meetings, board meetings and conferences. The fact that each member of this year’s Board worked together to complete enough activities to garner us the top honor is truly a testament to what a great group of people we have in this Chapter. It has truly been a challenging and rewarding year. So, while I’m still continuing on the Board as Past President, and will always be active in the Chapter – to each of you I extend my thanks for your help and encouragement; for the suggestions you have offered to make the Chapter better, for smiling at my pathetic attempts at humor, and for just being a great group of people to network with. One of the best things about ALA is getting to know our colleagues and learning with and from them which is the basis for this section of the newsletter. There are so many interesting people in our Chapter with varied careers and backgrounds and that adds to the depth of our group and shared experiences. That said, if you haven’t yet met Corinne Capps, you have likely seen her smiling face at a Chapter event. Corinne is a very active member, and she is about to get even busier because on April 1, she takes on a new title: the ALA Suncoast Chapter President! Congratulations Corinne and we look forward to your leadership.

How long have you been in the Tampa Bay area?I moved to Tampa in November of 2006 from Tallahassee after I took the job with Thomas & LoCicero. I worked for a law firm in Tallahassee for 20 years. My children moved away and most of my family is in this area. I live in St. Petersburg and have enjoyed living in this area. Tampa and St. Petersburg have a lot to offer. I am very happy I made the move.

How long have you been a legal administrator and how did you get into this career?I have been an administrator for 25 years. I worked as an accounting supervisor for a company in Savannah for a number of years and then for a CPA firm in Tallahassee. One of the CPA’s clients was looking for an administrator. I got the job and it was the beginning of this career and I am very glad I chose this path. I have learned a lot in 25 years and I continue to learn something every day.

What challenges you the most as a legal administrator?It is being pulled in so many directions. You have to be available to everyone in the firm. You might have a list of items that need to be done in a day and you might get lucky and get a few of them done. It is an ongoing list. I work for a great group and it does make it easier.

What is most rewarding?Being recognized and appreciated for everything you do. It is a great feeling to get positive feedback for your efforts. What are your goals for the Chapter for the coming year?To help increase membership and get the members more involved in the chapter meetings and events. The chapter and ALA National offer so much to the administrators and it would be wonderful for more members to take advantage of what is available to them. I am really looking forward to this year. What do you do when you are away from the office?I enjoy watching football, basketball, golf, and tennis; travel and see new places; reading. What is the best advise you have received and from whom?Over the years it has been from a number of people. One thing does not stand out as the best, but all of it put together has helped me grow as a person and as an administrator. I have learned over the years not to stress over situations that are out of my control and to always stay positive. It makes life so much better.

ALA’s Board of Directors recently approved amendments to the Bylaws of the Association of Legal Administrators. Chapter Presidents also have the opportunity to vote on these amendments. Their ballots must be received on or before May 7, 2012.

The proposed changes relate primarily to Articles III, V, VI and VII of ALA’s Bylaws, generally described as:

A modification to the membership criteria providing eligibility to administrators serving multiple legal organizations; A minor modification to Board composition and eligibility for an additional term for those receiving a Board term of less than 18 months; and Amendments to the duties and responsibilities of the Regional Councils, the Regional Directors and the regions’ roles in selecting Nominating Committee representatives. Also proposed are various grammatical edits, updated terminology and other minor changes.

Assuming a favorable vote, all members will receive notification in May that the amendments were adopted.

Management Sensitivity:Making a Case for Sensitivity and Leveraging

Sensitivity for Competitive AdvantageBy Andrew Froman, Esq.

If your mother was at all like my mother, then she probably told you more times than you can remember that “If you don’t have anything nice to say, don’t say anything at all.” Such was the theme of my presentation last month my presentation last month to the Suncoast Chapter of

the Association of Legal Administrators. The actual title of the presentation to approximately 30 members was “Management Sensitivity: Making a Case for Sensitivity and Leveraging Sensitivity for Competitive Advantage.” The idea, of course, is to treat employees so well they want to do all they can to help your law firm or in-house counsel’s office to compete and, indeed, to flourish.

During the recent recession, it probably is fair to say that the poor economy forced many employers to cut back sharply in order to avoid closing altogether, and when cutting back employers typically shed clerical and support staff first while retaining their “billers,” leaving those staff members still employed with many more responsibilities and that much more stress. It is incumbent upon employers in such circumstances to do the best they can to treat those remaining workers with respect, civility and dignity. After all, in a recession there are likely not a lot of extra financial resources available to motivate those employees to take on those added duties and stress.

In law firms, typically, the administrator is called upon to handle the difficult and occasionally unpleasant tasks of informing the employees what is expected of them, informing them when they are not doing what is expected of them, and informing them of the consequences if their underperformance continues. We need to handle each of those tasks professionally, cordially, respectfully. Praise can be given in front of co-workers, since we all appreciate being praised. But corrective action, discipline, certainly termination, should occur in private, behind closed doors. Nothing is gained from embarrassing an employee, and you can be sure a negative story about such an incident will be told and retold at every business where that embarrassed employee works thereafter. None of that is helpful to your organization.

As professionals, we do not (or certainly should not) call names, disparage an employee’s heritage, religion, or nationality. We shouldn’t raise our voices, use profanity (even when the employee does so to us), or issue threats. There is nothing to gain and everything to lose with such tactics. Our employees work for us, we are lawyers, and in this litigious world with giant plaintiff’s attorney billboards looming over us on every corner of every major thoroughfare, a former employee who feels they were mistreated will have no problem finding an attorney to sue us, and no problem doing so.

The Suncoast Chapter board members hosted the ALA National Board of Directors on January 20 at a dinner held at Island Way Grill in Clearwater. The national board members were in town for an annual board meeting and were thrilled to meet board members of the local chapter. ALA board members from as far away as Orlando also attended. The evening began with a cocktail hour on the terrace and then moved inside for the dinner. ALA board members tend not to be shy so there was plenty of conversation as introductions were made and flowed throughout the evening. Over 37 people attended in total. All appreciated the opportunity to meet, network and share experiences with colleagues spread across the country. A special thanks to Peggy Baier for organizing such an enjoyable evening.

Who are Legal Administrators?The profession of legal administration was created to support and enhance the practice of law thereby freeing attorneys from the task of management and allowing them to devote their time to providing quality legal services. Responsibilities encompass finance, technology, human resources, marketing and management-related issues. Driven by constant innovations in technology and ever-changing economic considerations, the role of the legal administrator has expanded to include a host of new managerial responsibilities. These changes have placed a renewed emphasis on groups such as the Association of Legal Administrators to offer continuing education, training and support.

Why Join?One of the most important functions of the Suncoast ALA is to provide a forum for members to foster friendships and to harness their collective talents and abilities in support of the legal community and the community at large.

The monthly chapter luncheons, and other high quality educational events are carefully planned by committee members to enhance the skills of our members in all aspects of legal administration, such as human resources, systems/technology, leadership, marketing, finance, and motivation.

The holidays were in full swing when the Suncoast chapter met

for lunch at Oystercatchers in Tampa on December 7. Chapter members were excited about the beautiful lunch venue which served delicious appetizers of shrimp and of course, oysters, as well as fish and salads as main courses. In addition, there was a lot of excitement about the raffle that was taking place to raise money for a charity for which the Chapter has great respect. Since 1967, Bay Area Legal Services (BALS) has been providing free legal services to qualified and low-income residents and nonprofits in the Tampa Bay area. This is a charity the Chapter has supported for a number of years not only financially, but also through its members’ volunteerism.

There were so many baskets to which members could bid and then a winner was chosen at random from those bids. Goodie baskets ranged from gift cards to food and wine baskets to sports tickets and one even had a Kindle in it! In total, $768 was raised at that lunch. Now that is a good meeting!

Gary Walker, board members of BALS, attended from BALS and was thrilled with the turnout of people and the funds that were raised. The Chapter is so proud of its sponsors and members’ generosity. Thank you to everyone who donated baskets and attended the luncheon. Together, we can make a difference and we hope we were able to help someone else’s holidays be just a little brighter.

The Republican National Convention is being held at the Tampa Bay Times Forum and

Tampa Convention Center in Tampa August 27-30, 2012. You may not be aware of the effect this event will likely have on you and your firm. There will be over 50,000 people participating in the convention including delegates, alternate delegates, staff, and members of the media. In addition, there are expected to be at least 10,000 or more protestors. Because Florida is a considered a vacation destination, many of these people can be expected to bring family members and to extend their stay to include the weekends before and/or after the actual convention. In addition, on every day during the Convention, the Tampa Police Chief expects to have as many as 4,000 officers on duty. Contrast that to the approximately 1,000 Tampa Police Officers in the entire agency. Officers are being sent from agencies across the state to ensure security during the Convention. Finally, the Secret Service will be a major presence, with authority do whatever is required to ensure the safety of the delegates. In short, the Tampa Bay area resources and roadways will be challenged.

Some of the facts from the Host Committee’s website (www.2012tampa.com) include the following:

• TheHostCommitteehasmorethan15,000hotelrooms booked for each night of the Convention and more than 75 event venues under contract.

• Approximately 350 full-size charter buses andmore than 500 private vehicles will be utilized during the week of the Convention.

• Inexcessof7,500volunteerswillbeactivatedand deployed to assist during the week of the Convention.

• TheConventionisdesignatedbytheDepartmentof Homeland Security as one of only four National Special Security Events (NSSE) to be held in 2012; other examples of potential NSSE events include G-8/G-20 Summits and the World Bank/IMF meetings.

The Convention is Coming –Are You Prepared?

Along with all of the official visitors, protestors are expected in the area. Over 10,000 protestors attended the 2008 Republican National Convention in St. Paul, MN. And that was before the creation of the Tea Party and Occupy movements. Most of these are legitimate, peaceful protestors who will remain in the designated protest areas, march in accordance with any permits they are issued, and generally not cause problems.

However, there is a small faction who are not legitimately advocating whatever their cause is, but consider themselves anarchists, merely out to wreak havoc. According to one such group, they are “committed to making 2012 and the RNC in Tampa a truly catastrophic celebration of liberty.” Over the years, generally beginning with the WHO debacle in Seattle in 1999, anarchists have used some combination of the following tactics:

• Recruitparticipantsnationallywiththegoalof“shutting down” the convention or conference;

• Utilizeblockadestostoptraffic;

• Attempt to attack and quickly disperse inmultiple groups in order to confuse police and spread their resources;

• Monitor police planning and responses toanarchist activity;

• Wear bandannas and other clothing to masktheir identities;

• Start out wearing black clothing and laterchange to everyday street clothing to confuse police, camouflage themselves and take on the appearance of peaceful protesters;

• Carryslingshots,anduserocks,feces,urineandother items to throw at police;

• Wearbackpackstocarryweaponsandachangeof clothes; and

• Utilize peaceful marches as their starting offpoint for attempts to shut down the conference or convention. (Report Of The Republican National Convention Public Safety Planning

One of the ways in which these groups “use blockades to stop traffic” is a method known as the Sleeping Dragon. They put their arms through pieces of PVC pipe and join hands – sometimes with the addition of handcuffs to prevent being separated – and barricade roads and bridges. The difficulty with disbursing this particular method is that you can’t tell where their arms are and it generally takes two hours to deconstruct the dragon, assuming you don’t want to break and/or cut off any arms. According to Paul Bertels, City of Clearwater’s Traffic Engineer, for every minute traffic is stopped on an arterial roadway, it takes four minutes to clear it. On an expressway, that number goes up to eight minutes. So a two hour delay over the bridge will back up traffic for over eight hours. On I-275 that means a minimum sixteen hour delay. These groups are also fond of driving vehicles into roadways and abandoning them in order to delay traffic.

If you are traveling in the Tampa Bay Area, especially in downtown Tampa, you can expect to see any or all of these tactics used. Because delegates, media, and staff are staying in hotels in Pinellas County as well as Tampa, the bridges are particularly vulnerable sites. You can’t have a convention if your delegates can’t get to it and that is the goal of these protestors. In addition to the protestors, legitimate participants and additional police presence, keep in mind that the Secret Service can declare an area a “hot spot” if there is reason for them to believe there is a threat to a nominee, family member, or, in this case, the actual event because it has been declared a National Special Security Event. They can then protect that area as they see fit, which means closing of roads, parking areas and such with little to no notice.

Further complicating the situation are Florida’s pro-gun laws. As of July 2011, there were over 843,000 valid concealed weapons licenses in the State of Florida. Add that to the Stand Your Ground law, and you have issues that other jurisdictions have not faced during previous Conventions.

So, what’s a law-abiding, non-gun-carrying Legal Administrator to do that week? I hope you’ve got some vacation time saved up!

To that end, several law firms, particularly those located near the Forum and Convention Center, are closing that week. Others are relocating their staff to satellite offices. Some are even renting temporary space and relocating their entire staff. Many are encouraging or requiring those employees who can do so to telecommute.

According to an article in the Tampa Tribune, the Hillsborough County Courthouse will have limited functionality that week. There will be no jury trials, non-mandatory hearings, or weddings. Also, any mandatory or first-appearance criminal hearings will probably be held at the Orient Road Jail or Falkenburg Road Jail.

There are several options open to limit the impact of the Republican National Convention on your firm’s day to day business. The key is to be sure you and your managing partners are aware of the logistical issues that will occur and to plan far enough in advance so that the disruptions to your business are kept to a minimum.

Another Successful Business PartnerAppreciation Event

By Julie Nowicky, Office Administrator at Macfarlane Ferguson & McMullen A number of members and Business Partners enjoyed a pleasant eve-ning at Sono Café (located in the Tampa Museum of Art) in downtown Tampa on Thursday, March 8, 2012. The evening’s weather was perfect for all to take advantage of the outside patio and indulge in a variety of hors d’oeuvres and cocktails. Gayle Wetherell, President, spoke on behalf of all of the Chapter members, thanking the Business Partners for their continued support, noting that the Suncoast Chapter valued all of the Business Partners and looked forward to many mutual beneficial years of association together.

One Business Partner mentioned that this get together not only presented an opportunity to visit with the Chapter’s members, but to also meet and network with other Business Partners in the Tampa Bay area. Another Partner said that they appreciated the Chapter’s members taking time out of their busy days to set aside face time with the Business Partners. This Partner further stated that one-on-one time is so crucial to the business world in this day of cell phones, emails, and computers.
