Lewis Four arrested after Brazil nightclub fire A co-owner of the nightclub handed himself in to police on Monday afternoon for questioning after police had detained another owner of the club, a member of the band Gurizada Fandangueira, and its security chief. The country's deadliest fire in five decades reportedly started after a member of Gurizada Fandangueira, which was performing at the venue, lit a flare on stage. Local journalist Marcelo Gonzatto told reporters that the flare had "started a huge and fast fire that grew quickly and made a very dark and heavy smoke". "Lots of people couldn't get out and died mainly because of the smoke not the fire," he said. Officials are currently investigating claims that many of those who died were unable to escape as only one emergency exit was available. Most of the dead were students from the Federal University of Santa Maria (UFSM) who were holding their freshers' ball. Witnesses spoke of scenes of panic after the fire started, and a stampede as people tried to escape. One told local television: "It was sheer horror. The emergency exits did not work." A large number of victims were trapped in the club's toilets, the witnesses said, possibly after mistaking them for an exit. Survivors and police inspector Marcelo Arigony said security guards briefly tried to block people from leaving the club. Police have arrested four people in connection with the fire at the Kiss nightclub that killed 231 people in the southern city of Santa Maria on Sunday.

Any of us could “popour clogs” at any time, nomatter what our ages, sowe should all make surethat those near and dearto us, family and friends,know exactly how muchthey mean to us. do itbefore it’s too late!

Bars in Brazil commonlymake customers pay theirwhole tab at the end of anevening before they areallowed to leave.

One of the owners of theclub is reported to haveconfirmed that they werein the process of renewingits licence to operate, andthat its fire safetycertificate had expired lastyear. He is said to havereceived threats on theinternet – as havesurviving members ofGurizada Fandangueira.Its guitarist, RodrigoMartins, told local radio:"It might have happenedbecause of the Sputnik,the machine we use tocreate a luminous effectwith sparks. It's harmless;we never had any troublewith it. When the firestarted, a guard passed usa fire extinguisher. Thesinger tried to use it but itwasn't working."

He said the band's

accordion player had diedin the fire.

The national sense ofloss is profound. Thegovernment declared threedays of national mourningand postponed a ceremonyscheduled for Monday inthe capital, Brasilia, tomark 500 days to the 2014football World Cup. InSanta Maria, 30 days ofmourning were declared.President Dilma Rousseff,

who cut short a visit toChile, has been visitingsurvivors at the city'sCaridade hospital alongwith governmentministers. "It is a tragedyfor all of us," she said.

Dr Eufemiano Fuentesappeared in court inMadrid on Monda, accusedof running one of theworld's largest dopingrings.

In May 2006, policecarried out a series of raidson offices, laboratories andflats in Madrid, Zaragozaand El Escorial as part ofan investigation known asOperation Puerto. Theyfound about 200 bags ofblood or frozen plasmawith labels that werebelieved to be code-namesfor Dr Fuentes's clients –athletes who wereallegedly benefiting from ahighly-sophisticateddoping programme.

Dozens of cyclists wereallegedly implicated in thescandal, including formerTour de France winnerAlberto Contador, who isexpected to give evidence

in the trial. Dr Fuentes,his sister and three formercycling coaches arecharged with breakingpublic health laws. Theycould not be charged withdoping-related crimesbecause Spain had no anti-doping law at the time oftheir arrest. Prosecutorsmust prove that thedefendants' actions put thelives of the athletes at risk– something the defence isexpected to deny.

The trial is expected tolast until mid-March. Iffound guilty, thedefendants could face upto two years in prison anda two-year professionalban. The case comes daysafter former seven-timesTour de France winnerLance Armstrongadmitted to using banneddrugs and blooddoping during his cyclingcareer.

Cyclists' dopingcourt case opens

The Cabinet has approveda draft bill to create asingle market that willallow companies andprofessionals in Spain tooffer their goods andservices across thecountry.

Under the proposedlegislation, a companythat has obtained a licensefrom one of the regionalgovernments to sell goodsthat comply with technicalspecifications can sell

them in the rest of thecountry.

Companies have beenlobbying the governmentto remove obstacles tosetting up new companies,and the Chambers ofCommerce have welcomedthe move. In a statement,they said: “This will serveto re-launch the trade,industrial and productivefabric in Spain andincrease competition.”The Chambers said there

are currently more than100,000 rules andregulations relating tobusiness activities in thecountry, two thirds ofwhich have been issued bythe regions.

When she announcedthe development, DeputyPrime Minister SorayaSáenz de Santamaría saidthe cost savings entailedcould add €1.5 billion tothe GDP over the nextdecade.

Single market createdPrime Minister MarianoRajoy told reportersduring an official visit toSantiago, Chile, lastFriday that thegovernment will extend asubsidy scheme toencourage people to scraptheir old vehicles for new,more efficient ones.

Rajoy said the movewould help to extensivelyrenew the pool of motorvehicles. “It has alsoserved to save many jobsin the automotive sector,”Rajoy said. The first so-called PIVE plan, whichexpired this month, hadfunding of €75 million for

people scrapping vehiclesover 12 years old for moreenvironmentally friendlyones. It took some 75,000old vehicles off the roads.This time, the programmehas been allocated €150million, which shouldcover about 150,000vehicles.

The NationalAssociation of Automobileand Truck Manufacturers(Anfac), estimated the firstPIVE had increased carsales by some 25,000units, boosted taxrevenues by €296 millionand helped save 4,500 jobsin the sector.

Prison minister Iris Varela has announced the closure ofUribana jail in Barquisimeto where more than 60 people diedin a riot last Friday. The riot started after soldiers entered theprison to search inmates for weapons after reports that rivalgangs were preparing for a fight. Ms Varela did not say howmany prisoners had died in the riot, but local hospital staff saidthere were 61 bodies in the morgue and that around 120 hadbeen injured. Vice-President Nicolas Maduro said there wouldbe a thorough investigation into the riot. Uribana prison wasamong the most dangerous in the country and suffered fromovercrowding. According to the non-governmental VenezuelanPrisons Observatory (VPO), in 2012 more than 50,000 inmateswere housed in prisons built to hold 14,000.

HelenDickinson, directorgeneral of the BRC, said:"The fact that totalemployment edged upduring this quarter, drivenby part-time workers, is ashaft of light against anotherwise challengingbackdrop. It shows that,despite relentlessly toughtimes, retailers arecontinuing to invest inpeople and support jobcreation as much as theycan. But the record drop instore numbers is starkevidence that thisinvestment should not betaken for granted. We'reby no means out of thewoods yet, and given theadministrations of recentweeks, the next quarter'sfigures are likely to makedifficult reading."

The reduction in thenumber of stores – 573 inDecember compared with

a year earlier – was thehighest since the BRCstarted monitoring thesituation four years ago.

Christina Tolvas-Vincent, of business lawfirm Bond Pearce, whichhelped with the report,added: "After a lacklustreChristmas, the New Yearhas started badly forretailers. Well publicisedfailures such as HMV,Jessops and Blockbustershave yet again placed thespotlight on the strugglinghigh street. This will havean even greater impact onstore numbers that arealready falling at thefastest rate for over fouryears."

A Department forCommunities and LocalGovernment spokesmansaid: "High streets arefacing challenges such asthe rise of internetshopping, which is whythe Government is offeringpractical support. That'swhy we've doubled theamount of small businessrate relief and extended itfor a year to help up to halfa million new and smallershops. For buddingentrepreneurs, we'reproviding over £80 millionof start-up loans for youngpeople starting their ownbusinesses."

Gangs now smugglingpeople OUT of the UK!Criminal gangs aresmuggling illegalimmigrants out of Britainfor up to £1,500 perperson, an undercoverinvestigation has revealed.

A secret travel network,which operates up to threetimes a week, shipsforeign nationals abroadunder the nose ofimmigration officials, theBBC Panorama probefound.

Some of those who usethe service have livedillegally in the UK foryears and want to move on

in the hope of findingopportunities elsewhere inEurope, while others arecriminals on the run fromBritish authorities.

During the course of ayear, Panorama madecontact with three suchcriminal gangs, all offeringto smuggle illegalimmigrants out of thecountry with no questionsasked.

In one case, reporterPaul Kenyon met with afixer as he posed as anillegal immigrant fromMoldova who wanted to

return home to his sickwife. The fixer, a formerIndian police officer called"Munga", explained thatfor a charge of £1,500 perperson, the gang wouldsmuggle groups of three orfour illegal immigrantsacross the Channel in theback of a lorry to Calaistrain station.

It is thought as many ashalf a million migrants arehiding from theauthorities in Britain –the equivalent to a city thesize of Sheffield.

Brits warned to get out of BenghaziThe Foreign Office urgedBritons to leave theLibyan city of Benghazion Friday in response to a"specific and imminentthreat" againstWesterners.

The FCO has beenadvising against travel tomost of the country sincelast September, but hasnow stepped up itswarning.

A spokesman said: "Weare now aware of a specific

and imminent threat toWesterners in Benghazi,and urge any Britishnationals who remainthere against our advice toleave immediately. Wehave updated our traveladvice to reflect this. TheBritish Embassy in Tripolihas been in contact withBritish nationals for whomwe have contact details toalert them to the advice."

Baby in stolen car is safeA thief drove off with aseven-week-old baby in acar after stealing thevehicle as the father stoodnearby talking to a friend.

The 24-year-old dad,who had briefly left theengine running, suddenlybecame aware thatsomeone had sneaked inthe driver's-side door andwas driving off with littleLeo on the back seat. Hetried to open the

passenger door shoutingthat his baby son was inthe back but the thiefdrove on. It was a frantic15 minutes before thechild was found safe andwell in the car, which hadbeen left close to a pub.

Police are nowappealing for witnesses tothe drama – whichhappened in Moor Road inOrrell, Wigan on Tuesday– to contact them.

Iwas appalled to discover last weekthat one of the country's mostreputable newspapers, El Pais, had

published a photograph of VenezuelanPresident Hugo Chávez lying in aCuban hospital bed with a life-supporttube in his mouth on the front page –only to realise about 3 am that it was afake. Fortunately, most of the copiesfor regions outside Madrid were stillsitting on planes at Barajas airportand were easily retrieved. Getting thepaper back from kiosks around thecapital took more time and no doubtquite a few people are waiting to seehow much they can ask for the copiesthey managed to keep once the furstops flying.

How the newspaper managed tocommit such a tremendousgaffe still has to be explained in

a satisfactory manner. Apparentlythree of the paper's top editors decidedto publish the photo – supplied by theGtres Online agency – over a briefcaption explaining that the newspapercould not verify its authenticity. Yetapparently the photo had been floatingaround on Facebook for a couple ofweeks, something any member of theirstaff could have told them if they'dbothered to ask. However, they seemedto be under the impression that theyhad a tremendous scoop on theirhands, and to add salt to the wound,they apparently paid €15,000 for thephoto.

El Pais was founded 35 years agoand quickly carved out areputation as being the

country's best daily paper. InVenezuela and other Latin Americancountries it was spoken of withreverence. But that reputation startedto bite the dust after the Socialists wonthe 2004 general election. It soonbecame obvious to the discerningreader that the Socialist governmentwas not be attacked or criticised underany circumstances, which is why Istarted reading El Mundo, ABC and LaRazon to get a more rounded view ofwhat was going on. A lot of otherpeople seemed to have done the same– all three newspapers, especially ElMundo, gained readers, although ElPais continued to lead the field andstill does.

The explanation offered at lengthin El Pais on Monday fails toconvince. The editors involved

seem to have been aware from the verybeginning that the photo could havebeen a fake. The Gtres agency refusedto give them the name of the source,saying it was a nurse at the hospital inCuba who was putting her life on theline. The agency claimed she had sentit to her sister who lives here in Spain,who in turn had passed it on.

Needless to say, I have instructedthe young lady who lays outthis page NOT to print the

photograph, which is still floatingaround out there. The Venezuelangovernment is threatening to sue ElPais and we don't want to becomeNumber Two on their hit list. Mindyou, nobody in the Venezuelangovernment seems to read my columnotherwise I might have been dead meata long time ago. So let's keep it thatway. It's easy to make a mistake,which is why most newspaper storiespass through a series of editors,subeditors and proofreaders, the"filters" who usually catch them.However, I remember "beautifying"Sister Theresa on the front page of TheTown Crier and nobody at the paperspotted it. Not many readers spotted iteither if the lack of letters wasanything to go by. As we were taughtin the good old days at the BBC –check, check, check again and thenagain. It saves you a lot of trouble.

Past his due date

As much as I love and admireKing Juan Carlos, I'm hopingQueen Beatrix's abdication will

give him pause for thought. TheSpanish Royal family can't sayabdication is not a tradition here as itis in Holland – Juan Carlos'sgrandfather Alfonso XIII left thecountry voluntarily in 1931 to avoidthe Second Republic abolishing themonarchy. And we won't even mentionthe kings and queens who were sentinto exile or otherwise disposed of.

I've been worried about the king'shealth for some time now and thelittle episode involving elephant

hunting last year did a lot to tarnishhis image, more because of thepresence of a German princess than adead elephant. But we won't go intothat!

However, inthe wingswe have a

handsome, stillyoung CrownPrince (just turned45), who hateshunting andbullfights andwhose marriage toan attractive,highly intelligent commoner seems tobe as solid as a rock, with not a whiffof an extra-marital affair. The latestpoll shows that more than 80 per centof Spaniards appreciate him – a far cryfrom the times when the acceptedwisdom was that Juan Carlos would bea one-off king. I think it's time to strikewhile the iron is hot – this countryneeds a stable, popular monarchy tooffset the havoc the Loonie Left seemsbent on wreaking.

Iñaki Urdangarin at Sunday’s worldhandball championship in Barcelonawhere Spain beat Denmark 35 to 19,racking up another global title to makeus all feel a bit better – albeittemporarily – as we continue to swimour way out of the economic doldrums.The future king and his brother-in-lawwere not on speaking terms, or itappeared that way in front of thecameras. Urdangarin didn't sit in thespecial honours box with the futureking (see pictures below). Just lessthan 24 hours before the RoyalHousehold announced that thescandal-plagued king’s son-in-lawwould no longer be listed among thefamily members on the Zarzuelapalace website. More trouble reignsover the family as Urdangarin awaitshis next day in court, scheduled forFebruary 23rd, when he will have toanswer all the latest allegations thathave popped up since he first testifiedin the so-called Nóos inquiry lastsummer.

Prosecutors are asking a BalearicIslands court judge to charge thehusband of the Infanta Cristina

with public fraud and embezzlementstemming from an alleged scheme inwhich some €2.3 million of publicmoney was diverted from the regionalgovernment and went to his privatebusinesses by way of the non-profitNóos Institute. His former partner,Diego Torres, now his bitter enemy,has been releasing barrages of emailsthat purportedly suggest members ofthe royal family, including King JuanCarlos, were privy to Urdangarin’sactions for quite some time. Asreported this week, the monarch mayhave known as early as 2005 that anti-corruption prosecutors were lookinginto Urdangarin’s business practices.The 45-year-old Duke of Palma hasdenied any wrongdoing. He blamesTorres for any irregularities that havemight taken place at Nóos but hisformer partner isn't going downwithout a fight. Torres is also thetarget of the inquiry as are severalothers who worked at Nóos.

It is alleged that the king told hisson-in-law to get out of thebusiness some time in 2006 when

he got wind of the inquiry. But despitethis, investigators say that the formerOlympic sportsman may havecontinued conducting his affairsbehind the monarch’s back. The batchof emails turned over to the court raisemany interesting questions, and willno doubt be part of Judge José Castro'sinterrogation later in February whenUrdangarin has been subpoenaed toappear. Interestingly, it comes on thesame day as the 32nd anniversary ofthe 1981 attempted coup against hisfather-in-law.

The Royal Household no doubt isin disarray. Instead of stickingtogether, the residents of

Zarzuela palace want to disconnectthemselves from Urdangarin – even ifit means removing his name from awebsite – as if the problem will goaway; never mind that he is stillthe Infanta Cristina's legitimatehusband.

On Monday, we saw theannouncement of QueenBeatrix’s abdication in favour of

her eldest son Willem-Alexander. TheHouse of Orange was also tainted inscandal in the 1970s when her fatherPrince Bernhard was accused ofreceiving $1.1 million in bribes in theinfamous Lockheed bribery scandalthat involved political figures inseveral nations. Queen Julianathreatened to abdicate if her husbandwas prosecuted. More controversyarose when it was discovered thatBeatrix’s late husband Prince Claushad been a member of the HitlerYouth. But that too was forgotten andhe later became a popular member ofthe Dutch Royal Family until his deathin 2002.

Now more dirt will be kicked upin the coming weeks whenaccounts will again be brought

to light about the new queen’s fatherand his role during the last militarydictatorship in Argentina. JorgeZorreguieta served as agricultureminister under former dictator JorgeVidela, who was responsible forinitiating the Dirty War in the 1970sin which as many as 30,000 peopledied or disappeared. Again, we have aninstance where the Royals will try tokeep the grime from visibly creepingup to the surface. MáximaZorreguieta’s parents won’t be“allowed” to attend her husband’sinvestiture on April 30th. Instead, theywill reportedly watch the ceremonieson television from London. If theHouse of Orange has survived manygruelling scandals within the past 40years, it unlikely that the House ofBorbón will collapse over a few millioneuros that Urdangarin may havepocketed.

NEW REPORTING REQUIREMENTS FORASSETS LOCATED OUTSIDE OF SPAIN part 1What’s it all about?First of all let’s talk aboutwhat the new law (Model720) is and why it has beenintroduced. The SpanishGovernment has launcheda new anti fraud plan toprevent tax evasion. Muchhas been written aboutSpanish politicians beinguncovered who have assetsoverseas.

Although aimed atdiscovering assets boughtby Spanish nationals withirregular money, it mayalso affect expats living inSpain who are titleholdersof assets abroad.

The law is to catchSpanish nationals, theexpats are merebystanders. However, it isimportant as expats thatwe don’t ‘bury our heads inthe sand’ in the hope thatit won’t affect us.

At Speed FinancialSolutions we often comeacross expats living inSpain who still deemthemselves to be UK taxresident. Very often, the

underlying reason behindthis is fear of the unknown.In fact, once our clientsunderstand how tonavigate the Spanishsystem (with ourassistance) they realisethat they can in fact takeadvantage of the taxbreaks available to themas residents of Spain.

What is very importantto remember, is that taxresidency is usually basedon the time we spend eachyear in a particularcountry, and that the onusis on individuals to be ableto prove to the authoritiesshould they investigate,that they do not in factreside in Spain.

The reality is that inmost cases, it would bevery difficult todemonstrate this to theSpanish Authorities and somost expats would be‘deemed’ Spanish taxresident by the authorities,particularly I imagine, if itwere to prove morebeneficial to theauthorities in terms ofrevenue!

Who has to report?Any person, permanent

establishment or companywho is tax resident inSpain and is the owner,titleholder, representative,authorised person,beneficiary, or hasdisposal powers of theassets located outside ofSpain worth more than€50,000 must report thevalue of these assets(converted to Euros whenheld in other currencies)as at 31st December 2012,or the year declared forfuture tax years.

When?

Between 1st Januaryand 31st March of thefollowing tax year onwhich information issubmitted.

However, according tothe draft of the new Model720, information for year2012 will be submittedduring March and April of2013.

‘Informative

statement of assets

and rights located

abroad’

We need to rememberthat this is an ‘informationreturn’ designed to putworldwide assets on theradar and does notnecessarily have to becompleted every year. Itshould be completed inany particular tax yearonly if:

• there are new assetsor rights that have notpreviously been reported.

• the values of assets orrights already reportedhave increased,

• in certain cases inwhich ownership in thoseassets or rights isrelinquished.

Which assets must

be reported?There are various

descriptions of exactly

what must be reported,but they can becategorised broadly underthe following headings:

•Bank/Building Societyaccounts located outside ofSpain (if you have anumber of accounts thatare each under €50,000,but together they totalmore than €50,000 theymust ALL be reported.

•Any values, assets,securities or rightsrepresenting capital,equity or assets of all typesof entities, or the transferto third parties of capitalwhich is held or depositedor located abroad. Thisincludes fiduciaryagreements and trusts.(where the total valueexceeds €50,000).

•Life or disabilityinsurance in which thetaxpayer is thepolicyholder. Thisincludes Life AssuranceBonds (Surrender value ofthe Bond). Life Assurancethat only covers the risk ofdeath and cannot berecovered does not need to

be declared. Please note,the surrender value of aLife Assurance Bondshould also be reported onyour Annual Wealth TaxReturn.

•Annuities ortemporary rents in whichthe taxpayer is abeneficiary, contractedwith entities establishedabroad (capitalisationvalue of the rent).

•Real estate andproperty rights of theholder located abroad,worth more than €50,000(including timesharerights, usufruct, and otherrights to use properties).

Allcharities need as muchhelp as you can give themright now as, with the“crisis” they are not gettingas much in their coffers.We all know that times arehard but there are thoseamong us that do have “afew bob” to spare so, please,give as much as you can.

Statement fromCudeca

“While 2011 was afinancially positive year,thanks to the unexpectedincome from the sale ofthree inherited properties,in 2012 Cudeca will closeaccounts with losses inexcess of €400,000, whichis of serious concern to theimmediate future of theHospice.

This situation is mainlydue to the worldwideeconomic crisis, whichsince 2010 has significantlyaffected public subventionsand donations fromsavings banks, and in2012, for the first time in20 years, has caused aconcerning drop in incomefrom individuals, both

Spanish and foreign, whohave been the firm basethat has supported Cudecasince the very beginning.This has therefore resultedin event revenues droppingby 15%, and donations by14%.

Furthermore, it was notpossible to sell anyproperties during 2012.Despite lowering pricevalues, the housing marketcrisis is severely affectingthis source ofextraordinary incomewhich in previous yearshad helped to overcome theannual deficit.

The Board of Trustees,the Hospice’s highest levelof management, togetherwith the Board ofDirectors, are constantlyevaluating this hardsituation, anticipating thatthe current economic crisiswill continue for someyears to come. Measuresare being explored toincrease revenue andreduce costs, which will beimplemented in the comingmonths. One of the firststeps which is alreadyunderway is to reduceemployee salaries, thanksto the effort andcommitment of all theemployees.

For the time being, it isnot contemplated that the

Hospice care programmeswill be affected, given thatthe reserves can sustainthe programmes in theshort-term, ever hopingthat the measures thathave been taken onboardwill improve expectationsfor the near future. In May2013 the situation will bere-assessed at anextraordinary Boardmeeting.

Cudeca in 2013 and2014 will be facing a hugechallenge: to continueproviding the necessarylevel of care to people withcancer or other advancedand non-curable illnesses,aiming to alleviatesymptoms and toaccompany them to the endof life. Each year 750patients and their familiesneed the special kind ofcaring provided by theHospice.

In the past Cudeca hassuccessfully overcomesimilar crises, and hopesthat this time they will winthe battle to keep theHospice care available toall who need them. Cudecafeels deeply grateful for theinterest, encouragementand support received fromeveryone who has sharedtheir journey over the past20 years.”

Family cases with aninternational or crossborder element haveincreased enormously.Reunite figures showed an88% increase in just undera decade. The most highprofile cases are thoseinvolving the “kidnap” ofchildren where one of theparents takes the childrento another country withoutthe other parent’s consent.Some statistics released inDecember are surprisingrevealing that 70% of casesare where the motherremoves the children fromtheir country of habitualresidence although mostpeople assume it is wherethe father takes them toanother country.

Reunite InternationalChild Abduction Centrehas also provided figuresthat show that a quarter ofpeople questioned wereunaware that it is acriminal matter if noconsent has been givenand one parent isdepriving the other ofcontact in the country oftheir habitual or normalresidence.

This impacts on thosefamilies who have movedto Spain from Britain andelsewhere and now wish toreturn to their countries oforigin – perhaps foreconomic reasons in thecurrent financial climate.The most important thingis to get advice beforemaking the move.

There is now aconvention which governschild matters in the

Spanish jurisdiction.Although originallydrafted in 1996 theconvention only came intoeffect in Spain in 2011.This means that a judge inSpain asked to decide onmatters of custody, visitsand parentalresponsibility must makethat decision based onSpanish law– and alwaysin the best interests of thechild. In some cases thisdoes mean allowing themother or father to returnto their country of originwith the children but thecourt will insist on apractical regime of visitsfor the parent whoremains in this country.

In most cases it ispossible to negotiate andcome to a sensiblearrangement withouthaving to involve thecourts. If it is necessary togo to court the applicationneeds to be not only legallyargued but also needs toshow a plan is in place forthe children’s social andeducational adjustment totheir new residence.

Divorce byconsentSpain has a system of

no fault divorce and aBritish or foreign couplewho live in Spain wishingto divorce can do so byagreeing the divorce andsubmitting to the law ofSpain providing the courtwith a ConvenioRegulador (similar to anEnglish consent order).This will allow them to

regulate arrangements forchildren and theirfinancial matters withouthaving to rely on theSpanish court to make adecision. The judge willrequire evidence of foreignlaw if the couple are bothof the same nationalityand this makes the mattermore complicated andcostly.

However if there arepensions, English or non-Spanish assets and othercomplicated valuationssuch as the value ofbusiness and mortgagedproperty it is best toconsider if the case shouldbe dealt with in Spain orwhether anotherjurisdiction is moreappropriate. With the newEuropean regulations(Brussels II) in place thematter of jurisdiction i.e.which country’s courtsshould hear the case isvery important. Theprinciple is “first come,first served” so it is best toget advice if you live inSpain and if you thinkthere may be difficulties individing the assets ondivorce.

Music Hall started atthe beginning of the 19thcentury with singers inpubs and saloon bars. Ittook off in such a way thatby the 1850s the pubswere being knocked downand replaced by purposebuilt theatres but ones inwhich you could eat, drinkand smoke. The mix ofentertainment withsingers, musicians andcomedians made this adifferent experience to the

normal theatres of theday. With drink involvedthe audience could get outof hand and the compere'sjob was not just to telljokes and introduce theacts but to try and keepthe audience in some sortof order. Colin Pollard israther good at this so ifyou bring your drink intothe theatre and eat asandwich or caviar andchips, he will spot you and....! No smoking now ofcourse.

The Grotesque FactorRanging from theunbelievably ugly, throughthe disgusting, thepitiable, the comic and thefrankly bizarre, theexhibits in the temporaryexhibition at the MuseoPicasso in Malaga provokea wide range of reactionsin visitors.

The Grotesque Factorhas brought together ahuge range of works – bymore than 74 Europeanand American artists –produced over the past 500years. From curiousdecorations adorning thepalace of Emperor Nero inthe First Century AD tothe meticulous linedrawings of Leonardo DaVinci; from the viciouspolitical satire of Hogarthto the horrors painted byGoya after his visits toSpain's terrible mentalasylums; through to thedark intensity of FrancisBacon and theunmistakable colours andlines of Picasso. Most ofthe works on show are

drawings or paintingsthough there are someequally strange modelsand sculptures, as well asa host of books andmagazine illustrations.The exhibits have beenlent from prestigious artgalleries and collectionsworldwide.

Back in 2009 whenTarantino’s

“Inglourious Basterds” wasreleased, I was awfullydistressed as I was unableto get to the cinema andhad to wait for the DVDrelease. As we all knowTarantino’s movies arevery cinematic and shouldbe seen on the silverscreen to get the fullTarantino experience. So,before it was too late, thisweek I made my way downthe cinema to seen“Django Unchained”, andboy, was it worth it!

Many people aren’tfond of Tarantino’s

work, they say he is tooviolent. Granted “Django”isn’t for the faint hearted,however, much ofTarantino’s violence isalmost cartoonish. Ofcourse he goespurposefully over the topwith the violence – givingit a comic element thatcomplements the quirkyscript and several ‘laughout loud’ moments.

Although “Django” isnominated for five

Oscars, I seriously doubtthat it will win “BestPicture”. The academy arewarming to Tarantino,however Spielberg’s“Lincoln” is a little more“factual and historical” andless violent, so I think“Lincoln” will win bestpicture.

The plot of “Django”consists simply of

bounty hunter, Dr Shultz(Christoph Waltz) freeingslave Django (Foxx) toassist him locate his‘bounties’ in return for hisfreedom and finding andreuniting him with his wife,Broomhilda.

You may recall ChristophWaltz was first brought

to our attention as the ‘JewHunter’ in “InglouriousBasterds”. He completelystole the movie with hischarismatic performanceand quite deservedlywalked away with an

Academy Award. Well, he’sdone it again, and from thevery beginning of the filmwe are intrigued andenchanted by hischaracter. I suspect hisOscar will be getting apartner in February whenthe winners areannounced.

Tarantino is well knownfor reviving the careers

of actors (e.g JohnTravolta) and it’s DonJohnson’s turn this time.Cast as plantation ownerBig Daddy, Johnson hasquite a small but verymemorable role, heading apre-KKK mob who are lessthan happy with the waythe eyeholes in their headsacks have been cut. OnlyTarantino could make ahilarious scene about theinfamous lynch mob.

Jamie Foxx’s performancewas also impressive and

I think that it is his bestwork to date. It certainlyseems that QT manages tobring the best out of hisactors.

On a negative note, I dothink that the film was

a little overlong and mayhave benefitted from a bitof editing. Eagle-eyedcritics will also have a fieldday spotting manyanachronisms, but hey,this is entertainment, not ahistory lesson!

Towards the end of themovie we see the

director himself andTarantino stable MichaelParks as The LeQuintDickey Mining Co.employee and I had to givea silent cheer for hisuntimely demise – if onlyfor his dreadful Australianaccent.

As with the majority ofMr Tarantinos’ films,

once you’ve stripped awaythe violence and the shockvalue, you are left with agood old fashioned lovestory which goes to provethe Big Movie Rebel, is justa Big Softy at heart!

Trout with green beans& almond butter

• 200g French or green beans,trimmed• 2 trout fillets, about 150g each• 25g unsalted butter• 50g toasted flaked almonds• ½ lemon , juiced

Preparation: 5 minsCooking Time: 10 mins

Bring a pan of water to the boil, thensimmer the beans for three minutes untiljust tender. Drain. Meanwhile, heat a non-stick frying pan. Season the fish, then fryskin-side down for 4-5 minutes until theskin is crisp underneath and the flesh iscooked almost all the way through. Youwon't need to add any fat to the pan. Flip the fish over and cook for 1 minute more.

Pile the beans on to warmed plates. Topwith the fish. Add the butter to the panand let it melt. Once it foams, add thealmonds and let the butter turn golden.Season with a squeeze of lemon juice (itwill foam up), then salt and pepper.Spoon the buttery almonds over the fishand beans to serve.

If you like spicy food and fancy something a little tastier as an accompaniment to rather plaindishes, then this is definitely a recipe to keep. Or you can just eat the rice on its own!

Preparation time: 15 mins Cooking time: 30 mins

Heat oven to 180C/fan 160C/gas 4. Rinseand soak the rice for 10 mins. Heat a large,ovenproof saucepan. Add the oil, then theonion, garlic and ginger. Cook on a low heatuntil the onion is soft. Add the cloves,cinnamon and cardamom pods and cookfor a further two minutes on a low heat.Add the curry powder and cook for afurther two minutes, then stir.Drain the rice and add it to the saucepan.Stir, so that the rice is coated in the oil and

spices. Add the peas, sweetcorn and half the flaked almonds, if using. Improving sleep 'may slow memory rot'

It may be possible to slowthe decline in memory andlearning as people growolder by tackling poorsleep problems,researchers at theUniversity of Californiahave said, after theirstudy of 36 people – 18 intheir twenties and 18 intheir seventies – revealedan intimate relationshipbetween an ageing brain,sleep and memory.Experiments showed thatchanges in the ageingbrain damaged the qualityof deep sleep, which inturn hampered the abilityto store memories.

However, theresearchers said it wasunknown whetherchanges in the brain, sleepand memory were allseparate signs of ageing ordeeply connected. Theirseries of experiments withthe 36 volunteers firstshowed that they could

use the state of a region ofthe brain, called themedial prefronal cortex, topredict how much deep, orslow-wave sleep a personwould have. That part ofthe brain is essential forentering deep sleep, butwith age the regiondegrades.

Secondly, they showedthat the amount of deepsleep could be used topredict how well peoplewould do on memory tests.The younger patientsgetting plenty of goodquality sleep performedbetter on tests than theirolder colleagues who hadworse quality sleep. Theysaid: "Taken all together,the deterioration of thebrain leads to thedeterioration of sleep tothe deterioration ofmemory."

However they saidthere might be a silverlining – they are not ableto restore the ageingsection of the brain, butthey believe they can dosomething about sleep.They said it is possible toboost the quality of sleepby stimulating the rightregion of the brain withelectricity during thenight, which had beenshown to boost memory

performance in youngpeople. The researchersnow want to beginexperiments on elderlypatients too, describingtheir aim as "jump-starting" the system.

In patients withdementia, the symptomsof brain cells dying, badsleep and memory loss arefar worse than in normalageing. A recent study hassuggested sleepingproblems may be an earlysign of Alzheimer's and aspokesman for the charityAlzheimer's Research UK,

said further studies wereneeded to confirm thelink.

"Increasing evidencehas linked changes insleep to memory problemsand dementia, but it's notclear whether thesechanges might be a causeor consequence. "Thepeople studied here werefollowed for a very shortperiod, and one of the nextsteps could be toinvestigate whether a lackof 'slow-wave' sleep mayalso be linked to a long-term decline in memory."

Graham Hughes, 33 fromLiverpool is about to gethimself into the Guiness Bookof Records. Did he spend thelongest time bouncing on aspace ball? Nope! Did he eatmore hamburgers in tenminutes than anyone had everdone before? Nope!

Graham Hughes is the guywho has visited every countryin the world, and he’s done itwithout getting on a plane.Other restrictions put on himby Guiness were that he

couldn’t use private transportover large distances, nor couldhe hitch-hike.

His odessey of visiting all 193UN-recognised countriesstarted in January 2009 andhe has done it all on a budgetof less than £7,000 a year forthe first couple of years andthen less than £3,000 afterthat.

He has also undertaken"surface journeys" to all theworld's hot spots – including

Iraq, Afghanistan and NorthKorea – and visited everysovereign nation in the worldincluding Vatican City,Palestine, Taiwan, WesternSahara and Kosovo, which donot have seats at the UN.

However, once he thought he’dfinished, the Guiness Book ofRecords ruled that his visit toRussia hadn’t counted becausehe had basically entered thecountry illegally by wadingacross the River Narva to getthere from Estonia. So, this

Monday he travelled by trainfor 25 hours from LondonVictoria to Gdansk, Poland,after which he got the bus –this time with a visa.

During his journey Grahamfilmed a TV show for theNational GeographicAdventure channel and raisedmoney for the charity WaterAid .

My interest in astronomy startedvery early on in the ‘60s as I satmesmerised in front of the TV

watching Mike Mercury in Supercar.Shortly afterwards came Steve Zodiac inFireball XL5, Thunderbirds and StarTrek, I was in sci-fi heaven!

And if that wasn’t enough to stir ayoung boy’s imagination, over inAmerica real astronauts were

flying in real spaceships in an attempt tobeat those pesky Russians in a space raceto the Moon. I was 10 years old when Neiland Buzz landed on the Moon in 1969 –my school teacher at the time had givenmy Mum permission for me to stay offschool on the Monday as the astronautswere due to land late on Sunday night.

My parents bought me my firsttelescope when I was nine yearsold but hard as I tried I could

never really see anything through it. Iwas distraught until a neighbour who hadhis own telescope heard about me andinvited me to look through his telescope.The first thing I saw was Saturn and itsrings, from then on I was well and trulybitten by it all.

Idiscovered there was an astronomysociety in Liverpool and when I was11 my Dad took me there. The other

members were much older than me and alot more knowledgeable but they showedme patience and taught me not only howto use my little telescope but also what Ishould be looking at – it opened up awhole new world to me. Up until then Ihad been on my own late at night in myparent’s garden –mostly being scared outof my senses – but soldiering on withPatrick Moore’s guide to the stars tryingto make sense of it all while learning theconstellations.

Joining an astronomy society or evenjust popping along every now andthen is the ideal learning ground.

For me, meeting people with a sharedinterest who were always more thanwilling to help out was really what keptmy enthusiasm alive. I think I probablywould have dumped my ‘useless’ telescopeif it hadn’t been for them showing me howto use it properly.

When I moved to Spain andstarted writing for ‘The News’and also the previous

newspaper (The Town Crier) I found a lotof people emailing me and asking me toform an English speaking astronomysociety. So in 2008 I formed theFuengirola Astronomy Society. Nothingfancy I thought, just a few people able tomeet up once a month or so to sharestories, tips and ideas. I was shocked!

People came from miles around and verysoon there was a call for a secondAstronomy Society. So my friend LaurieYates formed the Coin Astronomy Societywith the U3A for people living in thatarea. Laurie is an excellent astro-photographer and takes incredible imageswith his telescope using equipment thatin my youth could only be afforded byNASA.

As I had to move back to Liverpoolin 2011, my friend Lee Osborneagreed to take over the running of

the Fuengirola Astronomy Society. Leehas taken the society to new heights andholds regular monthly meetings on thethird Thursday of every month at theCafé Manila on the sea front just past theYaramar Hotel heading toward LosBoliches. Lee also holds observingsessions travelling to El Torcal naturereserve where there is a very impressiveobservatory and telescopes. My wife Marilyn and I will becoming back to Spain next weekfor a few days and I will be

Friends of mine who teach at SwansSchool in Marbella have also askedif I could spend the day talking to

some of their senior pupils whoapparently have been swept up byastronomy after watching the recent BBCBrian Cox Stargazing live programmes.I’m hoping to be able to do some eveningobserving with the students as many ofthem have their own telescopes.

So much for my little Spanishholiday!

Astronomy SocietyFor anyone who is interested in finding outmore about astronomy, the best place tolearn is at anastronomy society.

I apologise for once againtaking up precious space inyour columns.I thought we had put theWinter Fuel Allowanceissue to bed so to speak,however the letter fromLeighton Curtis deserves aresponse.First of all not all ex-patpensioners who move toSpain are RICH. Manymoved here for the betterclimate and the morerelaxed lifestyle and onlylive on their pensions.Many pensioners come herefor three to four months inthe winter to escape the UKclimate, staying in hotelswhich offer full board at aminimum price in orderthat they can stay open andnot have to lay off staff thusdamaging the country’seconomy. These pensionersuse their pension to coverthis.

As is well known and waswidely reported the eurodropped dramaticallyagainst the pound in 2008and still remains at around1/3rd less. That resulted inmany pensioners seeing abig drop in their incomeand for many this lead to astruggle to pay mortgagesand in some cases survive.The difference Mr. Curtisbetween ex-pat"immigrants" to Spain andimmigrants to the UK isthat we CONTRIBUTED tothe system ... in some casesfor up to 44 years!Immigrants to the UKcontribute NOTHING inthe vast majority of casesand milk the system to thefull."You chose to leave the UKso you should not beallowed to claim anything"claims Mr. Curtis. We areSTILL UK citizens and

many of us still pay taxes tothe UK Govt. therefore wehave the right the same ascitizens in the UK to claimthe same benefits they areentitled to.And finally Mr. Curtis youdefeat your own argumentby stating if pensionerscan’t make ends meet herethey should move back tothe UK. Well manypensioners who arestruggling here can’t affordto live in the UK either andthat is why they claimedbenefits there in the firstplace!!!!So go back and smell yourcoffee Mr. Curtis and havea think about people whoare obviously not as well offas you.

I was appalled by the letterfrom Mr Curtis in lastweek’s copy of The News.

What I would like to say inreply would be unprintablein a newspaper but, sufficeto say that I have rarelyread anything thatsounded so smug. Mostpeople who live here inSpain in part enjoy it somuch because it is cheaperthan living in the UK. Of

course, the sun plays ahuge part in our enjoymentof the country but to beable to afford to livesomewhere as well is anadded bonus.

I am a retiree living on apension. I never madeenough money in the UKto fund a private pensionalthough I worked all mylife, payed my dues intothe system and never,luckily, had to go “on thedole” and take money outof the system.

Idiots like Mr Curtistherefore just make myblood boil with hisinsinuation that people

here are just taking moneyfrom our mother countrybecause we can.

I don’t know if this manhibernates in the winterbut it does get rather coldhere and fuel for gasheaters and wood for“estufas” does not comecheap. Clearly the mandoesn’t feel the cold asmuch as the rest of us!

So, Mr Curtis, I would sayto you, we have paid ourdues and are not rich so weshould still get our entitledmoneys from the UK.What a po-faced idiot and Ithank my lucky stars thatI don’t know this man!

Holdem is now the mainformat of poker played inEurope and the USA. Backin the 1990s and `80sOmaha was the main gameplayed in Britain andEurope so let’s talk aboutOmaha this week. If you’rea Holdem player learningand playing Omaha willenhance your skills. AtOmaha every street bringsa new draw and AA/KK isnot such a good startinghand as in Holdem.

The hand rankings inOmaha are the same as inHoldem as well as thebetting pre flop, flop, turnand river. The onlydifference is each player isdealt four personal cardsface down. Unlike inHoldem you can't play theboard as you must use twofrom your hand and three

from the board. The beststarting hand isAK/AKsuited, single pairsdon't play well such asAcAd/7sJh because youneed to hit an A tomake a set but againat Omaha a set is not astrong hand. Ideally wewant to be able to make twogood starting hands fromour four hole cards – anexample being AdQd/Jc9c –because we have two flushdraws, one being the nutdraw, and all four cards areconnected for a straightdraw. Do not overplay twopairs, sets, weak straightsand flushes, if there arethree of a suit on the boardflushes are likely to be outthere and if the board pairsremember full houses arecommon in Omaha.

When the draw wasmade there were manycomments from themembers about thestrength of many of theresultant pairings. Thisled to an air of expectationof an exciting competitionwhich was to be fulfilled.

The semi-finals sawGraham Rowley & FrankTofts up against FredStevenson & Brian Hurst,while the other semi-finalhad Derek Shemmings &Bryan Collier playing PamShemmings & PamKinane. In the first semi,Graham & Frank got off toa flying start and Fred &Brian were unable torepair the damage andclose the gap, leavingGraham & Frank worthywinners. In the othersemi-final, Derek & Bryanalso got off to a good startleaving the two Pams withtoo big a hill to climb eventhough they kept battlingaway until the last end.
