Children and Families Act

• SEN extended to 25; pre- and post -16 becomes one system

• Education and Health Care Plans (EHCP) to replace Statements and LDAs

• LAs to produce a Local Offer giving information on what services are available locally

• Parents whose child has an EHCP to be offered personal budgets for some elements of the plan

• Parents to be offered mediation before going to Tribunal

The definition of SEN remains the same and is used across the 0 to 25 age range.

A pupil has SEN where their learning difficulty or disability calls for special educational provision, namely provision different from or additional to that normally available to pupils of the same age.

Changes for Schools

• BESD becomes SEMH

• SA and SA+ replaced by SEN support

• Evaluate the impact of interventions

• Cooperate with the LA in developing the Local Offer

• Support pupils with medical conditions and coordinate any provision with the healthcare plan

• SEN provision should be available to those who need it and underpinned by high quality teaching.
