On November 2, MPA, Sony Pictures Entertainment Motion Picture Group and the State Administration of Press, Publication, Radio, Film and Television of the People’s Republic of China (SAPPRFT) opened the 6th Annual China-International Coproduction Film Screenings with a reception and screening of Xuan Zang in Los Angeles. Attracting approximately 300 government officials, filmmakers, film industry executives and media representatives, the event cultivated and celebrated the relationship between the American and Chinese film industries, which continues to stimulate economic growth and increase cultural co-operation. On November 3, MPA supported the 7th Asia Society U.S.-China Film Summit, where Mike Ellis, President and Managing Director of MPA

Asia Pacific, delivered a keynote speech on the contrast in styles between the world’s two biggest film markets.

On the evening of November 3, the MPA joined UCFTI EXPO, The Hollywood Reporter and the China Film Coproduction Corporation to co-host the 1st Golden Screen Awards, a gala honouring excellence in film coproductions. Attendees included: Li Guoqi, Deputy Director General of the China Film Bureau, Bianca Chen, CEO of UCFTI EXPO, Jiang Ping, Vice Chairman and President of China Film Corp, Miao Xiaotian, President of China Film Co-Production Corporation, Hollywood actors including Paula Patton, Robert Patrick and Travis Fimmel and Chinese actress Lu Yan. Chinese film XUAN ZANG received honours for best co-production film, best director, best cinematography, best actor and best production design.

INDIA’S RAJKUMAR AKELLA SALUTED AT CINEASIA WITH MPA ASIA PACIFIC COPYRIGHT EDUCATOR On December 8, Rajkumar Akella was presented with the Motion Picture Association (MPA) Asia Pacific Copyright Educator (A.C.E.) Award at CineAsia in recognition of his significant contribution to improving the capacity for filmmakers and distributors in India to best protect their creative work in the digital ecosystem.

Acknowledging Rajkumar Akella’s major contribution to raising awareness about the importance of strong copyright, Mike Ellis, President and Managing Director Asia Pacific MPA, said, “Rajkumar has demonstrated incredible leadership in the field of educating people about the importance of robust copyright regimes. His drive and passion over many years is to be applauded and appreciated.

We are happy to continue our work with Rajkumar on a range of content protection initiatives over the coming months, and hope to see creative rights considerably advanced for the film and television community in India”.

Speaking after receiving the award, Rajkumar said, “I am thrilled, humbled and greatly motivated by this recognition. I accept it on behalf of the Indian movie industry and particularly the Telugu film industry. My heartfelt thanks go to the MPA, MPDA India and CineAsia for this award. Until recently film piracy used to be a cool thing in India. Now that perception is slowly but surely changing and it’s fighting piracy that is cool. To defeat the piracy threat, I believe that the creative industries across the world must join forces and speak and act as one - it sounds ambitious – but I believe it is achievable.”

The MPA A.C.E. Award was presented during an awards event at CineAsia, held at the Hong Kong Convention and Exhibition Centre and attended by over 350 people representing the exhibition and film community in the Asia Pacific region. CineAsia is the only international convention dedicated to Asian cinema exhibition and distribution and is now in its 22nd year.

Past recipients of the MPA A.C.E. Award include Indonesian filmmakers Sheila Timothy (2015), Maya Barack Evans (2014), Philippines filmmaker and lawyer Joji Alonso (2013), Tropfest founder John Polson (2012), Malaysian film producer and recording artist Norman Halim (2011), Australian actor Roy Billing (2010), Hong Kong film producer Raymond Wong (2009), Thai producer and director Jareuk Kaljareuk (2008), and New Zealand actor Temuera Morrison (2007).

MPA PARTNERSHIP WITH .FILM PUTS SECURE MOVIE WEBSITES CENTRE FRAME

In 2016, the MPA Asia Pacific entered into an agreement with the Motion Picture Domain Registry (.film) involving a series of film industry engagements throughout the Asia Pacific and the U.S. As a major supporter of MPA film workshops and industry screening events, .film shared with filmmakers and film industry organisations the many benefits for creating .film websites to promote their film titles, products and services. Independent filmmakers are fast recognising their need to protect their IP against piracy and cybersquatting, which is where .film comes in.

They play a vital role in the digital ecosystem, taking a strong position on IP rights, and actively taking measures against illegal entities. This year, .film joined the MPA in Hong Kong for promotions during Filmmart; in India for events at FICCI Frames; in Tokyo in support of the MPA DHU Film Workshop and MPA Seminar, in Los Angeles as a partner in the 6th China International Coproduction Film Screenings and in Sydney for the 2nd China International Coproduction Forum. .film has also become the preferred domain name for our program websites across Asia.

MPA PARTNERSHIP WITH .FILM PUTS SECURE MOVIE WEBSITES CENTRE FRAME (cont’d)

2016 MPA APSA ACADEMY FILM FUND RECIPIENTS ANNOUNCEDMPA announced the four filmmakers as the recipients of the 7th round of the MPA APSA Academy Film Fund. The Fund was created to support - at script stage - new feature film projects originated by APSA Academy members and their colleagues across Asia Pacific. The fund awards four development grants of US$25,000 annually, and is wholly supported by the MPA. To date, 28 projects have now been funded, with many going into production and garnering success at film

festivals around the world.

Mike Ellis, President and Managing Director Asia Pacific MPA, said, “We are thrilled to announce the grants going to APSA Academy members who have revealed such extraordinary talent in these new projects. My thanks go to the dedicated panel of industry experts chaired once again by Andrew Pike, joined this year by filmmakers Hanna Lee and Glenys Rowe.”

Recipients of the MPA APSA Academy Film Fund are:

• Haifaa Al Mansour (Saudi Arabia) for MISS CAMEL;

• Joo Young Park (Republic of Korea) for MORNING STAR (YEONBAEK);

• Rolf de Heer (Australia) for MR WARD’S INCREDIBLE JOURNEY;

• Emir Baigazin (Kazakhstan) for THE RIVER.

Meanwhile, WHEN THE DOLPHIN FLIES, a previous Film Fund project, was recently announced as an Australia-New Zealand co-production.

During the event, we shot a video featuring commentary from Lord David Puttnam, APSA founder Des Power, and the Director of the National Film and Television School Nik Powell, on the partnership MPA shares with the APSA Academy and its impact on the policy landscape in the region.

MPA DEVELOPS CLOSE RELATIONSHIP WITH GROWING ONLINE VIDEO SECTOR

SENATOR DODD MEETS WITH GOVERNMENT, U.S.E. AND SCREEN INDUSTRY REPRESENTATIVES IN ASIA PACIFIC

Throughout 2016 the MPA has partnered with the online video sector to improve awareness amongst consumers that there are now many new ways to access their favourite films and television shows through authorised online video channels, and that accessing pirate websites results in a number of negative consequences. These partnerships have resulted in outreach events in China, India, the Philippines, Indonesia, Vietnam and other markets, involving legal access awareness campaigns, student competitions, and film

workshops. Our work with Southeast Asia-based iFlix on multiple events, has involved the wide distribution of a blog on the future of online content delivery in Asia and the need for strong content protection polices by the organisation’s Patrick Grove, while Archana Anand, head of business for India’s Ditto TV, who featured in our Fast Track India forum in Mumbai, wrote a feature on her considerations that live TV will capture the future of OTT in India.

2ND AUSTRALIA CHINA CO-PRODUCTION FORUM

The 2nd Annual Australia China Co-production Forum was held on November 22 following on from the success of the inaugural event held last year. Aimed at establishing business and creative connections between the Australian and Chinese film industries, the second annual event focused on new co-production projects. Many markets around the world are competing to work with the Chinese film industry. Australia is fast attracting the interest of the Chinese with its offer of attractive production incentives, highly skilled crews, world-class sound stages, globally-awarded post and VFX studios and diverse locations. Across the Asia-

Pacific, emerging film industries are looking to adopt competitive film and production tax incentives as a means of stimulating film industry activity in their local market.

Direct outcomes from the inaugural Co-production Forum in Sydney last November included an announcement that Sky Films+ and Darkroom Films will collaborate on two co-production projects with anticipated locations involving Beijing, Shanghai, New South Wales, Victoria and Western Australia. Additionally, Yan Wang, founding partner of SkyFilm Capital is collaborating with Ausfilm member, Plastic Wax in Sydney on the project

Australia and China are developing a close film industry relationship which is already demonstrating notable results in the form of a number of recent co-productions such as NEST, TYING THE KNOT and 33 POSTCARDS. By way of encouraging this continuous level of engagement, the event took on an extended focus on individual project development with producers from both countries - China and Australia - presenting their projects.

The sessions include “Effective Australia China Collaborations” where attendees heard from NEST Producers, Mark Lazarus and Tim Phillips

and the team from BLEEDING STEEL l - Ellen Eliasoph - President and CEO, Village Roadshow Pictures Asia and Producers - Paul Currie and Sharon Miller. The sessions were moderated by Asia Editor of Variety magazine, Patrick Frater. Ausfilm will moderate a session on maximising Australian film incentives featuring Tony Clark from Rising Sun Pictures and Adam Scott from Spectrum Films. For the finale, the ICFF’s Lanwei Gong hosted a presentation on China’s newest projects including YOUNG DRAGON IN PARADISE, PAY OR DIE, SHANGHAI LOVE, BUS COFFEE and LOST IN AUSTRALIA.

The event was hosted by the Australian Screen Association (ASA), Motion Picture Association (MPA) International Chinese Film Festival (ICFF), China Co-Production Film Corporation and the China Cultural Centre in Sydney, and supported by Ausfilm, Fox Studios Australia, Village Roadshow Pictures Asia, Allianz Global Corporate and Specialty, Variety, .film and the China Culture Centre (Sydney), Screen NSW and in association with Screen Australia.

MPAA AND CHINA DRM FORUM MOU PROMOTES INTERNATIONAL CO-OPERATION On October 21, Zhao Li, Secretary General of the China DRM Forum and Dan Robbins, Senior Vice President and Associate General Counsel of the MPAA, signed a MOU between MPAA and the China DRM Forum to promote international cooperation in copyright and content protection. A signing ceremony in Hangzhou was attended by China DRM Forum Chairman Ding Wenhua, William Feng, Vice President of MPA Asia Pacific and Head of the MPA Greater China, Vivian Peng, Director of Copyright Protection for MPA China and MPAA member studios’ senior executives.

The MOU will establish a joint working group to facilitate digital copyright protection, foster communication and coordination

among content/service providers, vendors, China DRM and SAPPRFT, work to improve security for software, hardware and enhanced hardware and promote the commercial use of China DRM standards.

Supported by SAPPRFT, the China DRM Forum was jointly founded by CCTV and Tsinghua University on November 24, 2004 to highlight the importance of digital rights management, progress the development of new technologies, secure rights and establish a favourable environment for content distribution and consumption.

SCREEN TRAVELLER REINFORCES POSITION AS GO-TO PLACE FOR INDUSTRY COMMENTARY Over the last three years, Screen Traveller, available on both WeChat and Weibo, has become a highly effective social media platform for amplifying a range of film industry news, events and policy matters. Since its launch in 2013, the portal has grown to attract over 14,000 WeChat and 142,000 Weibo followers including many notable Government and screen industry figures such as Zhang Hongsen, Director General of the China Film Bureau, State

Administration of Press, Publication, Radio, Film and Television; Wang Zhonglei, CEO of Huayi Bros. Media Group; and Zhou Tiedong, scholar and former General Manager of New Film Association.

Along with coverage of the latest film and TV industry news, Screen Traveller has proved to be a go-to forum for policy updates, market analysis, and content protection developments. It provides comprehensive coverage of MPA events and activities, including workshops and forums at the Beijing International Film Festival, Shanghai International Film Festival, and during China International Co-Production Film Screenings in Los Angeles. Areas of focus in 2016 included hot button topics such as the China Film Industry Promotion Law, government regulation of the Internet and the China Film Corporation IPO. Golden Forum. During the opening address, guest speakers emphasised the importance of intellectual property rights (IPR) and outlined key content protection measures such as Infringing Websites List (IWL) initiatives and site blocking.

On November 4, HKISA partnered with the U.S. Consulate General in Hong Kong and Macau, co-organised a blockbuster screening of Inferno at the UA Cine Times Cinema in Causeway Bay. Over 140 guests including the government agencies, IPR stakeholders, ISPs and academia attended the screening to promote the Hong Kong IWL Scheme. their support on the implementation of “Infringing Websites List (IWL) System” in Hong Kong. Sam Ho also attended the debate to support the Hon. MA Fung-kwok (representing the Sports, Performing Arts, Culture and Publication) for his re-election campaign at Radio Hong Kong on August 25.

On September 4, the 2016 Legislative Council (LegCo) General Election was held. The 6th Hong Kong LegCo was formed, involving 70 seats made up of 35 members from the geographical constituencies and 35 members from the functional constituencies.

This year’s electors’ response has been the most enthusiastic on record with some 2.2 million electors having cast their vote (58% of the registered electorate) and a further record being set for the highest turnout rate.

The Hon. MA Fung-kwok was elected under the functional constituencies representing the Sports, Performing Arts, Culture and Publication. The Democratic Alliance for the Betterment and Progress of Hong Kong (DAB) remains the biggest political party,

occupying 12 seats in the Legislative Council.

HKISA will continue to seek the support from the legislator members on the implementation of Infringing Websites List (IWL) System in Hong Kong.

On October 7, the Hong Kong IWL Group (HK-IWL) was formed with MPA’s Michael Kwan elected as Convener. On November 8, the Reviewing Committee and Appeal Committee were set up. The Hong Kong Internet Service Providers Association (HKISPA) and the Hong Kong Association of Interactive Marketing (HKAIM) agreed to join the Reviewing Committee. As at the end of November, the group includes thirteen contributing members including key stakeholders from the animation, broadcast, comics, and movie and music industries. HK-IWL Group will continue to meet with other Advertising Organisations to seek their support for the Hong Kong IWL Scheme.

On November 25, HKISA and the Hong Kong Internet Service Providers Association (HKISPA) co-organised the 9th ISP Symposium in Hong Kong, with the theme ‘Corporate Social Responsibility and Infringing Website List’, and involving useful discussions on Internet and content protection issues. The event was attended by 38 delegates, including Hong Kong Legislative Council Members, Hong Kong Customs, Macau Customs, IPR stakeholders and representatives from ISPs, Data Centres and Net Mission Ambassadors. HKISA will continue to support these cross-industry meetings in order to best promote the success of the IWL scheme.

MPDA HIGHLIGHTS INDIA’S NATIONAL IPR POLICY AS EFFECTIVE COPYRIGHT INSTRUMENT

On August 30 and 31, HKISA and MPA’s Taiwan Program partnered with Content Overseas Distribution Association (CODA) to conduct two content protection seminars in Taipei and in Kaohsiung for the Taiwan Criminal Investigation Brigade (CIBr), the leading IPR enforcement agency in Taiwan. About 60 attendees, including 50 frontline enforcement officers were present at the sessions.

On October 5, HKISA assisted Content Overseas Distribution Association (CODA) to conduct a content protection seminar in Hong Kong for Hong Kong Customs (HKC&ED), the leading IPR

enforcement agency in Hong Kong. The seminar was well received by 86 attendees, including 80 frontline enforcement officers.

The interactive seminars supported by speakers from CODA and its members and hosted by the HKC&ED, provided front-line enforcement officers with the latest information on current online and high definition infringement trends, successful countermeasures taken against online piracy in Japan, and the identification of infringing products containing TV and movie content.

On July 7, MPDA joined a panel discussion on the National IPR Policy at an industry roundtable entitled ‘India’s National IPR Policy: A View from Global Innovators’ organised by the American Chamber of Commerce in India (AmCham India) and the Global Intellectual Property Center (GIPC). The Joint Secretary, Department of Industrial Policy and Promotion (DIPP) and senior representatives from the USPTO, Government of India’s IPR Policy Think Tank, film, broadcast and technology

sectors, attended the roundtable. MPDA highlighted the need for industry and government to work on a cohesive strategy to launch various initiatives under the IPR policy to raise awareness on content theft and respect for Copyright. On July 10, MPDA attended an industry workshop on ‘Strengthening Copyright Industries’, organised by the USPTO and the FICCI that featured presentations from senior officials from the DIPP. Taking forward MPDA’s earlier recommendations on the IPR policy,

MPDA RAISES NEED FOR BETTER COPYRIGHT ENFORCEMENT IN A DIGITAL AGEOn July 22, MPDA supported the capacity building program on IPR organised by FICCI and the USPTO for law enforcement officers at the Academy for Smart Policing in Delhi. Addressing senior police officers, a representative from MPDA highlighted emerging trends in online content theft and the need to implement a standard operating procedure for law enforcement at a national level through a specialised IP Enforcement Crime Unit. The SMART Police academy was

launched in early 2016, to train officers to combat crime in a digital age. Between September and November, MPDA also participated in capacity-building programs for law enforcement officers organised by the Confederation of Indian Industry (CII) for officers of the Economic Offences Wing, Mumbai Police and the UK IPO in association with FICCI for law enforcement officers from North India. Over 300 law enforcement officers participated in these sensitisation

DIGITAL CONTENT SPECIALISTS OUTLINE THE FUTURE AT FAST TRACK INDIAOn July 27, senior executives from India’s motion picture and digital industries concluded that accessibility; affordability, quality content and online content protection will be the key drivers to sustain growth in India’s digital economy. Fast Track India: Bolstering Growth in the Digital Content Economy, a Knowledge Series Forum by the Federation of Indian Chambers of Commerce (FICCI) in association with the Los Angeles India Film Council (LAIFC), assessed the extent to which screen content acts as a key driver of India’s digital economy.

Creative industry executives assessed the current regulatory and infrastructural challenges, reviewed future growth trends and underlined innovative ways of monetising digital content to stimulate growth in India’s digital economy. Eminent speakers at the conference concluded that

India is the second largest internet user market in the world with an accelerating 40% Internet growth rate. Further, Digital India has the potential to create opportunities for business, promote innovation and create jobs. Currently, the Indian M&E sector is at a tipping point for online businesses to provide for a multitude of options to consumers. However, online content theft, varying levels of broadband access and affordability in terms of data tariffs continue to present challenges for providers to deliver value to consumers. These factors will have a significant impact on how digital media evolves in the future. The conference featured panel discussions including the Economics of Digital Media, Regulatory and Infrastructural Challenges in Digital Media and Building a robust enforcement.

JAGRAN FILM FESTIVAL 2016 SUPPORTS THE MPA APSA ACADEMY FILM FUND

Between July 7 and September 28, MPDA collaborated with the 7th edition of the Jagran Film Festival to promote the MPA APSA Academy Film Fund. Key points were considered through a panel discussion in leading cities across the country entitled Finding Money for Films. The festival also featured the screening of the award-winning documentary NO BURKAS BEHIND BARS, a recipient of the grant in 2011 in key cities. This initiative focused on broadening awareness about the APSA and the associated grant from MPA for script development that has stimulated development in high quality new Asian film projects. NEGATIVE EFFECT OF ONLINE FILM PIRACY HIGHLIGHTED AT COMIC CON 2016Between September 24 and 25, The Telugu Film Chamber of Commerce (TFCC), Indian Movie Cop and the Motion Picture Dist. Association, India Pvt. Ltd. (MPDA) launched

an interactive campaign at Comic Con 2016 through Comicorner to raise awareness on the negative impact of online film piracy and its risks to consumers who watch illegitimate content online.

Comicorner aims to engage audiences at the two-day event through interactive activities that included ‘Creating your own Look as a Superhero’ and an opportunity to create your own comic strip. The annual Comicorner at Comic Con hosted jointly by the Telugu Film Industry and the MPDA serves as a great platform to connect and engage with the younger generation and to educate them on the significance of protecting creative content. Over 20,000 comic fans attended Comic Con 2016 over two days.

Between May and June, MPDA collaborated with India’s largest multiplex chain, PVR to launch the Be A Movie Cop Quiz for cinema staff and theatre managers across India. In a period of 30 days 2800 (managers and staff) across 43 cities and 102 cinema were trained. Further, through October and November, cinema staff from Carnival Cinemas - a multiplex chain - were sensitised on anti-camcording measures that need to be taken

to deter camcording. Launched in April 2014, the MPDA and APFCC have collaborated with leading Indian multiplex chains through the ‘Be a Movie Cop’ online quiz that aims to raise awareness on the threats of camcording and online content theft. To date, over 7,000 cinema staff from leading multiplex chains across India have been trained through this effective sensitisation program.

Between July and December, MPDA participated in key industry forums, roundtables and conferences to endorse ongoing industry – government dialogue to increase India’s screen density and highlight the need for effective site-blocking through global best practices. At the CEO’s Roundtable with the Minister - the Information and Broadcasting and the 12th Indo-US Economic

Summit by the Indo-American Chamber of Commerce (IACC), MPDA highlighted key reforms needed to increase screen density for better theatrical box office revenues in addition to establishing a single window mechanism that eases the process and permissions required in accelerating the growth of opening new screens in every state.

The LA India Film Council continues to be an effective platform to promote the need for film incentives in India and the necessity to streamline film shooting procedures and clearances through a Film Commission. The Council continues to engage with the newly setup Film Facilitation Office (FFO - India’s National Film Commission) to advocate for state level production and tax incentives, in addition to promoting initiatives which promote film tourism. In November, the Council supported the first workshop with Indian States organised

by the FFO at the 2016 Film Bazaar, the annual co-production market organised by the National Film Development Corporation of India (NFDC). MPA shared global best practices and insights at a discussion on ‘Film in India - Bringing International Productions to India’, welcoming officials from various Indian states. The Council’s monthly newsreel which focuses on Production & Tax Incentives, Film Tourism and Business & Technology continues to serve as a useful reference to local industry, government and partners with a circulation of over 500.

MPDA also highlighted key content protection issues at strategic seminars and roundtables, which included the Industry Stakeholders’ Piracy Workshop at Jindal Global Law School, led by South superstar Suriya, the FICCI –ICC International Conference on IP: Key Enabler to Growth and Innovation, Legal Era IP Conference and the National IPR Conference by the PHD Chamber

of commerce. MPDA highlighted the need for effective site-blocking by sharing global best practices, legislative redressal for suo moto site-blocking by the Computer Emergency Response Team (CERT) and urged the Government to expedite the amendments due on the Cinematograph Act, 1952 through the Draft Cinematograph Rules, 2013, which is yet to be tabled in parliament.

MPA in partnership with ICAD (Indonesia Contemporary & Art Design) and APROFI (Film Producers Association) organised a film conference ‘What’s Next for Online Content Distribution?’ on October 20 at the Grand Kemang Hotel, Jakarta. The event opened with a panel featuring representatives from online service platforms iFlix,

Viddsee (short film online platform) and FLIK (local film channel), providing an international, dynamic view of the rise of online distribution platform in Indonesia. A second panel involving MPA and government officials provided an update on global site-blocking, introduced the Infringing Watch List (IWL) initiative, and highlighted the ongoing efforts by DGIPR and Kominfo (Ministry of Comm & IT) in supporting the film community. The third panel on creating online content featured speakers including Joko Anwar (HBO’s HALFWORLDS), Dennis Adhiswara (Layaria Network) and Angga Dwimasasongko (Visinema Pictures). Approximately 250 participants from filmmaking communities, filmmakers and students attended the seminar.

In December, MPA together with APROFI submitted the third round of site-blocking recommendations to DGIPR and Ministry of Comm & IT. A total of 176 infringing sites are named.

To date, the Ministry of Communication & IT has ordered all Indonesian ISPs to block

a total of 85 infringing sites. APROFI and MPA are currently monitoring all major ISPs in Indonesia to verify that all sites remain blocked as instructed. As of August 2016, at least a 95% compliance rate was noted.

On October 28, UNIJAPAN and Motion Picture Association (MPA), with support from the Embassy of the United States of America and the Federation of Japanese Films Industry (FJFI), co-hosted the annual MPA Seminar at the Tokyo International Film Festival (TIFF), where distinguished representatives from the film industry promoted a number of important initiatives to combat online copyright infringement.

This year’s keynote speech was delivered

by Executive Producer and Director of CBS television series Elementary, John Polson, who talked about the need to protect creative rights during the digital renaissance.

Mike Ellis, President and Managing Director Asia Pacific, MPA, introduced a seminar that focused on the need for robust copyright laws to prevent large-scale online piracy, noting recent research that showed that 31% of Japanese Internet users were involved in

On October 30, 2016, Motion Picture Association (MPA)/ Japan and International Motion Picture Copyright Association (JIMCA) and Digital Hollywood University (DHU), with support from the Embassy of the United States of America and in cooperation with the 29th Tokyo International Film Festival

(TIFF), hosted the 4th MPA-DHU Film Workshop. John Polson, Executive Producer and Director of CBS television series ELEMENTARY appeared as special guest at the film workshop.

Welcome remarks were delivered by the hosts, Tomoyuki Sugiyama, President of

some form of movie or TV piracy in 2015.

Mike Weatherley, Vice President, Motion Picture Licensing Company (International), Ltd., who acted as UK Prime Minister David Cameron’s Intellectual Property Advisor, presented on the subject of how best to develop a healthy and prosperous digital video ecosystem, exploring global trends in site-blocking and Infringing Website Lists (IWLs).

Dr George S. Ford, Chief Economist of the Phoenix Center for Advanced Legal and Public

Policy Studies, looked to economic theory to better understand how laws should adapt in response to the profound technological changes that we describe as the digital age. In markets with high rates of online piracy, Ford concludes, there is no evidence that shows expanded fair dealing or switching to fair use has positive economic impacts.

On November 17, JIMCA delivered a lecture at the Faculty of Economics, Konan University

themed ‘Content Business – Movie and Animation Industries’ covered several topics including ‘The Activity of JIMCA’, ‘The Economic Contribution of the Film and Television Industry in Japan’ and ‘Movie Copyright Infringements and Measures’.

Approximately 75 senior students from the university’s Faculty of Economics attended the lecture.

The presentation provided a good platform to raise awareness about legal access to online content and the growing range of authorised online video services now available in Japan.

Ten finalist candidates pitched their film projects during the workshop. The five guest filmmakers were joined by three additional guests, Seigo Tono from the SHORTSHORTS FILM FESTIVAL Executive Committee, Mike Ellis and Marc Fuoti, Senior Advisor of JIMCA on the judging panel. Daisuke Yamaoka was awarded first place for HELLO BABY! and won a five-day film immersion program.

SUMMER CINEMA WORKSHOP FOR FILM STUDIES STUDENTS PUTS IP RIGHTS IN FOCUS The Japan and International Motion Picture Copyright Association (JIMCA) partnered with the Embassy of the United States of America, Japan Association of Theatre Owners and Warner Bros. Pictures Japan to host the ‘Summer Cinema Workshop 2016’ for over 100 intellectual property rights (IPR) and film studies undergraduates.

Students attended a special preview screening of feature film SUICIDE SQUAD and attended lectures on a range of intellectual property rights (IPR), film distribution and marketing topics.

Following the lectures, the participants tried their hand at creating their own IPR messages for SUICIDE SQUAD and shared them on social media platforms via a web system ‘KAKUSAN’ – the publicity platform for the movie.

The participants’ social networking service (SNS) followers numbered more than 50,000 people in total and the activity was amplified to more than 17,500 followers within 20 minutes of uploading.

MPA PARTNERS NO.1 WEB PORTAL IN KOREA TO FOCUS ON DIGITAL CONTENT PROTECTION In July, MPA Korea partnered with Naver (Korea No.1 portal site), NBC Universal and Korea Copyright Commission (KCC) to roll out a 2-way copyright campaign to encourage people to consume legitimate content on legal platforms and raise awareness about the need to protect digital content. Subscribers who purchased NBCU’s action movies on Naver’s OTT platform, Nstore, were given a chance to enter a sweepstakes that

offered free JASON BOURNE movie tickets and Nstore VOD vouchers. Concurrently, on Naver’s Movies section, visitors were able to win a chance to be invited to the MPA-hosted movie screening of JASON BOURNE by watching KCC’s copyright campaign trailer and entering a copyright quiz.

From the 20,570 people who participated in the copyright quiz, 180 people were selected to attend the event at CGV Yeoido for an IPR lecture on digital content protection, followed by the movie screening. The event served as an excellent tool to enlighten the public on the importance of protecting copyright and using legitimate content platforms.

KOREA’S NEW COPYRIGHT PROTECTION AGENCY LAUNCHEDOn September 30, a public body responsible for practical copyright protection roles known as the Korea Copyright Protection Agency (KCOPA) began operations.

KCOPA, which sits under the Ministry of Culture, Sports and Tourism, is the merged entity of the entire Copyright Protection Center (a private agency) and the Online Piracy team of the Korea Copyright Commission, both of which take direction from the amended copyright law which was established as of March 2016. Succeeding KCC’s copyright protection operations, the agency is tasked to monitor whether companies are employing legitimate software, give support to forensic investigation on digital piracy and send out

corrective recommendations to ISPs that operate rogue websites.

The agency’s other major anti-piracy activities include online monitoring of illegal reproductions, execution of rapid response systems against the illegal distribution of authorised content, site-blocking of infringing sites operating on overseas servers and the Illegal Content Obstruction Program known as ICOP. KCOPA will also actively engage in digital forensic investigations for copyright infringement, operate crack-downs on illegal reproductions, as well as engage in research and publicity activities related to copyright issues.

COPYRIGHT PROTECTION MEASURES HIGHLIGHTED AT 2016 SEOUL COPYRIGHT FORUM On November 1st, Karen Thorland, Senior Vice President, Associate General Counsel and Global Content Protection Counsel of the MPAA, spoke about site-blocking at the 9th Seoul Copyright Forum. The Forum, which is hosted by the Ministry of Culture, Sports

and Tourism, Korea Copyright Commission (KCC) and Korea Copyright Protection Agency (KCOPA) is an annual gathering of worldwide IPR academia and industry members who come together to identify the key challenges of the copyright environment today and share insights and solutions. The theme for this year’s forum was ‘Revolutionary Change in Future Copyright Environment: Challenges and Responses’.

The presentation revealed how the MPA(A) fights piracy globally by focusing on voluntary anti-piracy measures such as domain name suspension on pirate sites through the help of registries, and MPA(A)’s anti-piracy pacts with domain name registries such as Donuts and Radix, advertising industry initiatives supported by Operation Creative of the UK and the US Trustworthy Accountability Group (TAG) and voluntary efforts by payment processors.

DEDICATED ANTI-PIRACY HOTLINES PROVEN EFFECTIVEIn addition to the existing hotline with Naver, two more hotlines have been established by MPA Korea to closely monitor and take down individual postings on illegal content communities online. Daum, the 2nd biggest search portal in Korea, and MGoon, a streaming site that carries various kinds of video streaming, are now among the three dedicated websites accepting direct cease and desist requests from the MPA. During the month of October and November, a total of 725 cases were reported to the three designated hotlines and each case resulted in 100% compliance rate. Eliminated infringements include illegal

links exposed on an infringing streaming site called heyheyfriends.com that has been continually neglecting takedown notices by MPA Korea.

To boost efficiency, MPA Korea, in collaboration with the APAC Content Protection Hub, also sent out letters to the advertising industry asking to voluntarily cease advertising placement on these illegal websites to disrupt cash flow. All of the advertisers have complied and currently there are no advertisements displayed on the infringing site.

ANTI-CAMCORDING TRAINING AND MOVIE APPRECIATION CAMPAIGNS IN MALAYSIA

On July 14, Malaysian Screen Industry (MSI) conducted anti-camcording training sessions and security inspections for cinema operation staff for MBO and GSC in Kuching, Sarawak, East Malaysia. More than 40 participants attended the training. Staff members were briefed on the techniques used by camcorders to record video and audio clippings in theatres. They were also informed on precautionary steps needed to be taken to avoid their cinemas being used for illegal camcording. Collateral material such as the ‘Make a Difference DVD (MAD4)’, ‘Jom Watch Movies’

DVDs and Mr. Security’s warning stickers were also distributed to the staff during the training.

MSI, in collaboration with local exhibitors, conducted two movie appreciation campaigns on 23 July and 3 September at The Gardens Kuala Lumpur, GSC Signature. The key objective of the event is to increase the knowledge and level of awareness of the society on the importance of copyright. More than 350 attendees were treated to screenings of STAR TREK BEYOND, KUBO and THE TWO STRINGS.

As part of its efforts to address misconceptions about copyright law, and particularly the need for U.S.-style fair use, in New Zealand, in September NZSA worked with the local music association (RMNZ) to bring noted U.S. economist Dr George S. Ford of the Phoenix Centre, to New Zealand to meet with MPs, government policy officials, academics

and industry. On September 19, Dr Ford presented on the topic of ‘The Status of Empirical Evidence on Copyright Policies’ at New Zealand’s Centre for Economic Law at Victoria University Law School, and following a presentation on the same topic by a leading local academic, Professor Graeme Austin, Dr Ford held a Q&A with those in attendance.

MPA partnered with the Singapore International Film Festival and the Intellectual Property Office of Singapore to hold an industry networking event focusing on the importance of strong copyright as a foundation for creative endeavour. The event opened with remarks from Mr Hank Baker, Vice President, Government Affairs, Asia Pacific, MPA, Ms Teo Yi-Ling, Senior Faculty/Legal Counsel Group Head, IP Academy, and Ms Gladys Ng, filmmaker (director

of short film THE PURSUIT OF A HAPPY HUMAN LIFE which opened the festival). The reception provided an opportunity for many of the stakeholders involved in the upcoming Copyright Law review to share observations with one another. The event is part of SGIFF Connect - a series of industry networking activities organised for working professionals and festival guests at the Festival Lounge of the 27th Singapore International Film Festival.

In the second half of 2016, TISF continued to engage in educational campaigns in nine schools and 5,375 students had attended the events.

On July 26, MPA executives participated at an international conference Best Practices for Stemming Digital Piracy, hosted by the American Institute in Taiwan (AIT) and the Ministry of Economic Affairs IPO in collaboration with The National Chengchi University Graduate Institution of Technology, Innovation and Intellectual Property Management. The participants discussed court-ordered site-blocking and disrupting the flow of revenue to

pirate sites through the introduction of an Infringing Website List (IWL), either via the UK government & industry Police Intellectual Property Crime Unit (PIPCU) model, or a voluntary approach similar to the U.S.’s ‘Trustworthy Accountability Group’ (TAG). The local authorities are currently reviewing the IWL proposal.

MPA TAIWAN E-NEWSLETTER MPA Taiwan has published more than 10 issues of the e-newsletter in 2016, providing the latest updates on film industry news, events and policy issues ranging from advocacy to content protection. Since its launch, the e-newsletter has grown to reach more than 700 subscribers. The e-newsletter also spearheaded a series of special features on high profile local industry representatives and their view points on intellectual property rights. The e-newsletter is a valuable resource covering copyright related issues both locally and internationally and will continue to play a key role in the helping both the industry and the public understand the importance of strengthening copyright.

On October 13, MPA Thailand presented a seminar ‘Copyright and the Online Environment’ at an event organised by the Department of Intellectual Property (DIP) during the Thailand Book Expo. Other featured speakers include Pathom Intrarodom, Electronic Communication Specialist; Songphan Jermprayong, Lecturer from Chulalongkorn University and Naowarat Pongpaiboon, National Artist. About 200 participants including lawyers, academics and publishers were in attendance.

On 8 August, MPA Thailand was invited by

DIP to present on ‘Copyright in Digital Edge’ at Sunee Grand Hotel, Ubonratchathani Province. Other featured speakers include Suchart Tanmapitakkul (Copyright Specialist), Parichat Salikup (Writer) and Raksamanya Somthep (Editor/Writer). More than 500 participants including students, teachers and government representatives were in attendance.

On August 30, Thienchai spoke on the topic ‘IP Awareness: Think Big Inspiration’ at the Bangkok University to an audience of more than 500 students and teaching staff.

On December 7, MPA Thailand spoke at a training session at the Rama Garden Hotel organised by the Internal Security Operations Command for about 240 enforcement officers on how to identify fake media products. The National IP Committee, chaired by Prime Minister

Prayut, has authorised the Internal Security Operations Command to oversee IP violations and conduct regular compliance checks.

On November 16, the Vietnam Copyright Alliance (VCA) – a coalition made up by VTV, CASBAA, 21st Century Fox, MPA, the Korea Copyright Commission, K+ and BHD – recently co-ordinated with the Ho Chi Minh City IP Association (IPA) to hold an online safety workshop at the Caravelle Hotel, Ho Chi Minh city. More than 150 participants including

government officials, industry representatives, lawyers, filmmakers, students and media attended. Local and international speakers presented on measures for internet safety and the Infringing Watch List (IWL), where government and industry can co-ordinate to prevent advertising revenue flowing to pirate websites.

During the latter half of 2016, MPA Vietnam has worked closely with local film industry and copyright sector representatives to speak to a broader audience about some of the hot topics affecting the industry. In September, leading independent film director Phan Dang Di applauded Vietnam’s proposed film classification scheme, noting it as a major improvement on the Government’s discretionary censorship system. Producer Tran Thi Bich Ngoc highlights the need for Vietnam to embrace co-productions with others as a means of growing its local film industry, targeting production incentives as a necessary inducement for

foreign production companies to shoot in Vietnam. Finally, lawyer Dr Bui thi Bich Lien supported Vietnam’s intention to raise the bar on intellectual property protections despite the likelihood that the Trans Pacific Partnership will be delayed, dismantled or greatly revised. This commentary on topics most affecting filmmakers in Vietnam is appearing on the Centre for Content Promotion website and in high profile newspaper articles in Vietnam.
