Dear Reader,Welcome to our sixth edition of Preview and the fi rst edition for 2012. It was not long ago when we were all preparing for Christmas and the New Year and before you know it; we are all well and truly into 2012 with the festive season long behind us and the regular routine of day to day living back in full swing. In fact, we are almost 10% already into 2012! How time really does fl y.So as it is with this time of year, many have made their New Year’s resolutions with the fi ve most popular being 1. Spend more time with family and friends, 2. Lose weight and get fi t, 3. Quit smoking, 4. Get out of debt and 5 to get more organised!But as quickly and as committed we are when those resolutions are fi rst made, we fi nd that the motivation to stick to your personal promises begins to ween. So how do we stop this and how do we keep focussed on the goals set and our motivation high throughout the year? Simple solution is to plan for it. Set small incremental targets towards the fi nal goal and always be rewarding yourself with every small achievement. For example, as for the most popular New Year’s resolution being to spend more time with family and friends, start with the phone call. Make it a small goal to call a friend every second or third day. After doing this for two weeks, reward yourself by catching up with some friends over lunch and say after one month where you have probably spoken to approximately 10-15 people, reward yourself by a night out to a favourite restaurant. This could be with your immediate family or a group of friends. By the end of the year you would have connected with the majority of your social network, may have made new friends along the way and strengthened your relationships with the special people who are important to you. It really can’t get any better than that.As for your property goals, what have you got planned for 2012? Are you staying put, renovating or on the move? 2011 was a turbulent time in the real estate market for some, but the welcome interest rate cuts towards the end of the year was a welcome relief which fuelled a strong selling period during the fi nal month of December. We anticipate that this will continue throughout the 2012 period with a more balanced market in both selling and buying. The buy, renovate and sell strategy. How does it work?

Renovating a run-down property to on sell for a profi t is many a budding property investors’ goal. But for the few successful renovating entrepreneurs, there are many more who have failed in their attempt to get the ‘formula’ right. In this Property News article, we look at the successful strategies used by property developers and highlight the most common mistakes made by the uninitiated participants.

Firstly, is renovating for you?The most important question you can ask yourself before you even start. Renovating is not for everyone. In our time poor day to day, week to week living, most buyers would prefer to purchase a home they can move into straight away. It is with this circumstance and attitude that provides the opportunity for others to capitalize on the potential to renovate a run-down home to generate a future profi t.

Adding to the appeal of renovating and unlike other investment strategies, should you renovate whilst living in the property as your primary place of residence, the ‘profi t’ gains for most individuals is tax free.

But that’s as far as the appeal should be. You need to ask yourself before venturing down the path of renovating, are you up to the job, and for that matter stress? Inevitably, experience comes from making mistakes, and with mistakes comes the risk of both time and money.

What can a cup of coffee do for you?I have a favourite saying ‘what can a business card and cup of coffee do for you?’ As it is in business and personal life, there have been many people who have travelled the road before us, and often, those people have made mistakes. The best way to avoid making those same mistakes is by simply asking someone who has already renovated themselves. Ask them out for a cup of coffee and pick their brains; it can be one of the best investments you can make!

You may want to ask them what inspired them to renovate, and what they initially did to get started. What did they set out to achieve and if they had to do it again, what would they have done differently?

Everyone’s circumstances are unique; however there will be common goals which you can draw and learn from.

Do your homework before you even look at your fi rst property.Your personality fi t will have a strong bearing on the success of your renovating project. I can’t emphasize this statement enough. Renovating is as much a personal desire as it is a fi nancial goal; the former being the most important aspect of the renovating process. Do not let your emotions overtake the commercial reality of the project. Renovating puts many pressures both personal and fi nancial; make sure that you are prepared to handle the ups and downs and that all the family members (if any) are fully committed as well.

How much time do you have? Probably one of the most underestimated components of renovating, and many people have gotten unstuck at this point. It takes time to meet up with tradespeople to arrange quotes and if you are planning on doing much of the work yourself, I can almost guarantee that most have gotten their time allocation wrong. It may sometimes pay to do extra hours at work to pay for an experienced professional to do the renovating work for you. In renovating, time does equal money!

Research the cost of renovating.You need to get an idea of how much money it will take to renovate certain components of a home such as paining, new carpets, window furnishings and renovating a bathroom and/or kitchen. Unfortunately we have all been entertained by the reality TV shows which at times have provided a false indication of what items really cost in both logistics and fi nancial terms.

Be effi cient with your time and make a short list and write down estimates; take this list with you when viewing potential properties and simply add up the cost as you are viewing.

Get the numbers right. Renovate to the current market conditions. The number one strategy employed by the professional renovator is to fi rstly get the ‘numbers’ right; everything else is secondary! You can only do this by investing a substantial amount of time on property market research to become an ‘expert’ on house ‘pricing.’ That is, what are ALL types of homes selling for in the area? They include new, established, renovated and un-renovated, and the best way of doing this is by visiting as many open homes and searching the internet for homes currently on the market, and more importantly the sale prices of the most recent sales.

Most importantly, when deciding to renovate, you will want to look at the return of investment in the ‘current’ market climate. Not trying to predict future potential growth. That is, if you were to purchase a home for $500,000 and invested a further $50,000 in renovation costs, what would that property sell for with the improvements today? The best way of fi nding out is by researching properties which have recently sold with similar features to the features you will be changing. Therefore, if your researched showed a comparable home sold for $550,000 or possibly slightly less, then the idea to renovate may not be that appealing. If you were to hold onto the property long-term, then yes, you have not overcapitalized but in reality, all you have done is made your home more comfortable to live in. There is no real ‘gain’ in house value other than what you tipped into it.

On the other hand, should a comparable property have sold for say $650,000 then this is certainly a well worth investment. The added bonus to this scenario is that any future growth to the property would be refl ected at the $650,000 mark, not the total cost of purchase and renovation being $550,000. Besides the tangible benefi t of unleashing personal creativity, the net equity growth on the property should be the ultimate goal of any potential renovator.

Get started!Becoming a property investor and renovator fi rstly starts by making a ‘promise’ to yourself and setting a goal. However, just like a New Year’s resolution, you need to get started by taking action and keeping motivated! Believe it or not, this is where most people actually start and fi nish! The rewards are there for those who push through and commit the time and effort to doing the research and work involved in home renovating.

How to get access to your deposit.Welcome to 2012 and the team at Lisa Davies & Associates Conveyancing wish you all the best into the new year. This week’s topic is about getting access to your deposit money before settlement day. It’s not as straight forward as you think and you need to be careful especially if you buying another property.

Section 27 - The Facts The process of having a deposit released prior to the settlement day is commonly call “section 27”. In most property transactions it is normal for a Purchaser to commit up to 10% of the purchase price which is known as the deposit. The concept of the deposit is to show the Vendor the Purchaser is serious about buying and they pledge a deposit to prove it.

The following information details the process and highlights an underling fact that as a Vendor you may not get the deposit released prior to settlement.

Victoria law concerning deposit releaseVictoria has strict guidelines surrounding the release of deposit money held in either the real estate agent’s or conveyancer’s trust account. The law is known as section 27 deposit release and it details the guidelines of the process on how the deposit money may be released. The deposit cannot be released just on the Vendor’s request, irrespective if the Vendor wishes to use the money to buy another property.

Frequently asked questions about deposit releaseWho gets the interest earned on the money held?The deposit money is typically held by the estate agent in a trust account. The interest earned is placed into a separate trust which is like an insurance fund. Neither your Agent, conveyancer or you can claim this interest.

What is the process for the release?Your conveyancer will prepare a section 27 statement which relates to the fi nancial position of your property. It will detail any mortgages or caveats (if any) and is in the form of a notice which is served onto the Purchaser who bought your property.

The Purchaser has 28 days to consider the section 27 statement before the deposit money can be released without objection. If the Purchaser is satisfi ed with the details in the statement then deposit maybe released to the Vendor.

If the Purchaser objects to the release of the deposit they must have reasonable grounds to do so. This objection may simply

be confi rmation of the section 27 statement details from the Vendor’s lender or there is a condition in the contract in favour of the Purchaser which also allows the Purchaser validly object to the release. If the Purchaser fails to respond to the section 27 statement within 28 days then the deposit maybe released after the 28th day from the notice being served.

What if the Vendor needs the money for a deposit to purchase another property?The deposit can only used by the Vendor once it has been released. Upon its release the Vendor then can use it for a deposit on another property or any other purpose. This can cause a great deal of stress especially if the Vendor has committed to paying a deposit under a purchase contract. Lisa Davies & Associates Conveyancing can assist clients wishing to pay a deposit on a purchase contract upon the successful release of the deposit from their sale. Most agents will understand the position these clients are in and a well drafted Special Condition could see a contract being entered into and you being able to secure your next dream property. However the offer may not be as strong in comparison to other offers with a ready cash deposit.

Why does the Purchaser need to see the details of the Vendor’s mortgage?The Purchaser needs to be assured if the deposit is released there will be suffi cient monies available to discharge the Vendors debts secured against the title at settlement. If the Vendor cannot demonstrate to the Purchaser their fi nancial position then most likely the deposit will not be released.

Can an agent write a special condition releasing the deposit monies immediately?No, a special condition cannot be used to release the deposit.

IMPORTANT THINGS TO REMEMBER ABOUT DEPOSITS • There are NO guarantees the deposit will

be released prior to settlement. Even if there is suffi cient equity in the property and the Vendor has followed the correct section 27 release process.

The arrival of 2012 will see some bigchanges for local communities closelyfollowing Peninsula Link construction.The fi rst of many local road bridges crossingthe freeway will be completed and opento traffi c. Bungower and Robinsons Roadsare almost ready to open, with Skye, Golf Links and Mornington-Tyabb Roads expected to be carrying traffi c by the end of summer.Even those who have taken a casualinterest in the Peninsula Link corridor willhave noticed the freeway’s fi nal shape

being sculpted from the earth. The earthworks required to create the freeway are close to complete in most locations, and two distinct carriageways and a centre median can now be seen. This has allowed road paving to commence with the placement of crushed rock layers.At the northern end of the project, bridge beams have changed the skyline acrossEastLink. The work that is happening underneath is also well advanced, which willprovide the north bound exit ramp. At the other end of the project down south in

An early release of deposit is sometimes possibleMany people can’t afford to buy a new home until they sell their current one. Selling and buying at the same time has its advantages yet can also be stressful, as you not only need to successfully sell but also locate and successfully purchase.

From a cash-fl ow perspective it can be diffi cult, as you need a deposit for the home that you are buying. While some people apply for a deposit bond to bridge the gap, there is also the option of applying for an early release of the deposit from the home you have just sold.

The law in Victoria, specifi cally section 27 of the Sale of Land Act, allows the seller to apply for release of the deposit before the settlement date.

It outlines a number of conditions and a mechanism for the release, including the critical condition: the purchaser must be pleased to release it.

If you believe that you are able to meet the criteria, you need to issue a notice that contains specifi c information and asks the buyer of the property to allow the release of the deposit monies. They are held in

trust by your estate agent or solicitor.

While this may sound simple, it can also take some time; in fact, it may be no quicker than waiting on the settlement date of a short settlement period.

It is important to also note that if early release is agreed to, your agent may deduct their fees at this time.
