We kicked off the market season early this year starting with the Canada 150 Business Luncheon “Celebrating in McKellar”, April 29th, ’17 at the McKellar Community Centre hosted by David Moore (Canada 150 Representative).

The afternoon commenced with a tour of the McKellar Library followed by a delicious lunch prepared by (Jimmy’s Café) + Refreshments by the (Dunchurch Legion). After lunch, local businesses and market vendors enjoyed an informative itinerary of guest speakers followed by the distribution of Certificates by Reeve Peter Hopkins, Councillors Bonnie Beier, Morley Haskim, Mike Kekkonen, Debbie Zulak. Attendees enjoyed Cheese Platters and guest speakers were presented with a

thank you gift both courteous of Middle River Farms. Middle River Farms also donated a beautiful Gift Basket which was won by Vendors; Ewald and Charlene Kauk of Island Retreat Crafts, McKellar.

During the month of May and prior, I was busy connecting with vendors, coordinating with David Moore (Canada 150 Representative) and the Ontario 150 McKellar Heritage Regatta Committee; planning weekly market events, working on a promotional campaign and putting final touches on our Canada Day Sesquicentennial Market Grand Opening- July 1st, ’17.

Happy 150th Birthday, Canada! July 1st- Week One, we kicked off the official market season celebrating Canada’s Sesquicentennial. Despite the rain, umbrella’s and tents came

in handy 😊! Our market vendors, Good Guys Carting Dogs, visitors, township officials and their spouses, David (Ann) Moore (Canada 150th Representative), McKellar Historical Committee (Vivian Moore) unveiled historical plaques and township signs during the opening. Unfortunately, “Spur of the Moment” were rained-out, but agreed to return July 15th. Jimmy's Fry Shack and staff barbequed and the McKellar United Church Choir lead in the singing of our National Anthem and provided a free Pancake Breakfast at the community centre, while Face Painter- Mandy Cooper entertained the kids.

The rain didn’t deter this happy gal from enjoying the Canada Day

festivities 😊 All and all-a very successful day-with twenty vendors setting up regardless of the weather- Canadians are truly resilient!

July 8th, Week Two, The Kid's Fish 'n' Fun Day hosted by the McKellar Recreation Committee was a hit with the kids; with over 78 registering for the Fish Derby and outdoor games. The participants received prizes and a coupon for Ice cream at Jimmy's Fry Shack & Café. The MNRF handed out Fishing Licenses to the kid’s and displayed their Outreach Educational Trailer for our visitors to view. We had fourteen vendors set up and the weather was picture perfect.

July 15th, Week Three, Fifteen vendors were present. “Spur of the

Moment” returned and White Squall Paddling Centre joined us providing free test paddling for our visitors. Beautiful day for a well-attended market!

July 22nd, Week Four, Fifteen vendor’s were open for business. The Sweet Corn and Baked Goods were

sold out by noon and White Squall Paddling Centre provided free test paddling. Pictured below, Anne Moore test paddling a Kayak which she later purchased from White Squall. Thank you, Ann for

supporting our market 😊

July 29th, Week Five, Thirty-One vendors were open for business 10am-4pm during the Ontario 150

McKellar Heritage Regatta. Wayne Ward was back in the park barbequing his famous Peameal Bacon on a Bun and market goers enjoyed live music by Shawn Kerr and Harbour, while Painted Kids provided Free Face Painting for the kids.

August 5th- Week Six at the market was a "Splashing" hit with the kids; a tad damp and chilly, but that didn't stop the fun! So many great memories made today-thank you to the McKellar Fire Department, By-Law Enforcement, Deanna and Ken Jackson, and finally "Smokey the Bear" for providing a fun and educational experience for our community and visitors!

August 12, Week Seven, nine vendors set up. Despite the soggy weather, our vendors enjoyed another fun day at the market. We even had a new vendor join us, Madison Penney, Wellness Advocate with doTERRA.

August 19th, Week Eight, nine vendors came out and White Squall Paddling Centre provided free test paddling of their fleet of Kayaks, Canoes, and Sup’s. Thank you, White Squall Paddling Centre for partnering with the market once again this year! August 26th, Week Nine, was another beautiful day for a market, thirteen vendors popped up their

tents ! I would like to thank the Whitestone-McKellar Lions Club for hosting their 2nd Annual Corn Roast

, and to Rodney Matthews for bringing his Vintage 1949 International Farm All Cub Tractor for our visitors to view. Plus, a big shout out to White Squall Paddling Centre for providing our visitors free test paddling of their fleet of Kayaks,

Canoes and Sup's !

September 2nd, Week Ten, at the market we welcomed back The Good Guys Carting Dogs- they raised $242.30 (July 1st, September 2nd) providing dog cart rides for our wee visitors; proceeds raised went towards the Aspen Valley Wildlife Sanctuary, Muskoka. Thank-you Carol and friends for participating at the market once again this year! On behalf of our vendors- thank you to everyone for making our last Summer market so much fun!

The Thanksgiving Market was held at the community centre from 10am-3pm, October 7th- we had a full-hall of vendors and the community turn-out was fantastic. Jimmy’s Octoberfest themed lunch was a huge success. Door prizes provided by our gracious vendors added extra excitement for our visitors. All and all-a very profitable day for our vendors and community.

Jimmy’s Chicken Pot Pies were a

crowd pleaser during the Christmas Market.

Santa Claus arrived at noon ‘til 2pm and greeted the little ones with Candy Canes and mingled with our vendors and visitors.

The Christmas Market was held at

the community centre from 10am-3pm, November 18th- we had 23 vendors and the community turn-out was extraordinary. Jimmy’s Chicken Pot Pies were SOLD OUT by 2pm.

AMO Queen’s Park Legislative Update

The Ontario Legislature has about 3 weeks left in this legislative session and there are a large number of bills of interest to municipal governments still in significant motion. All of AMO’s submissions to Standing Committee (where done) and Members’ Updates on any of the Bills are available on the AMO website.

Here are the key highlights for your information:

• OMB becomes Local Planning Appeal Tribunal (LPAT)

• Bill reflects the AMO key ask to reform the OMB to better respect municipal government decision.

• Keep all provincial land use policy in the Provincial Policy Statement (PPS)

• The AMO asks to reform the OMB are reflected in this Bill.

Bill 142- An Act to Amend the Construction Lien Act, 2017 continued

Bill 148, Fair Workplaces, Better Jobs 2017

• The bill changes the ESA and LRA to require more on-call pay, longer pre-scheduling timeframes, and could undermine municipal public safety and emergency operations significantly unless amended

• It means paying volunteer firefighters wages equal to full time firefighters

• Provides for 2 paid personal leave days, new vacation pay calculations and equal pay for seasonal, p/t, casual and temp workers

• Exemption for municipal / local board employees re: "on call" provisions to deliver statutory public safety services.

• Exemption for volunteer firefighters re: matching pay to full-time firefighters

• Specific reference that Bill 148 does not override other statutory obligations.

• Enables the creation of a continuing education and professional development program for building officials, inspectors, designers and other relevant persons;

• Authorizes municipalities to establish administrative penalties for non-compliance and authorizes Building Code officials to impose such penalties;

• Improves public notification of orders and enables or in some instances requiring the registration of orders in a land registry office; and

• Permits building officials to enter into buildings and onto land without a warrant for the purposes of inspecting a building, subject to limitations on entry into dwellings.

• The approach the province took on Part 1 of the Elliot Lake Inquiry recommendations is appreciated rather than simply implementing all the recommendation without consideration of municipal impact

• Would have been better to see Elliot Lake legislation introduced as a standalone bill rather than as a budget item.

• It was recommended that any registry or complaints system (as part of the Building Condition Evaluation Program) be housed with the Province and not with individual municipal governments as additional administrative burden

or business entity from a municipal government and enables municipal governments to respond for the purposes of tax compliance, addressing the underground economy and with some limitations to protect privacy.

• Given the administrative burden this item may have on municipal governments, it is important that a municipal government’s response to the MOF’s request for information about a person or business entity remain voluntary.

Schedule 28 – Municipal Act • Amends sections of the Municipal Act on the

Vacant Unit Rebate Program enabling prescribed local municipalities to impose additional requirements or alternative requirements.

• The amendments also enable the Minister to make regulations on how the amount of the tax rebate is to be shared by municipal governments and school boards.

• These changes should provide municipal governments with more local flexibility as per requests

Schedule 35 – Provincial Offences Act • Amends ‘prosecutor’ to include persons

acting on behalf of a municipality • Introduces new procedure for ‘early

resolution meetings between defendant and the prosecutor’

• Requires court houses to be equipped to enable remote attendance of early resolutions meetings

• The legislation introduces changes to fine enforcement. Administrative penalties imposed for defaults will not be affected by payment extensions and there will be a requirement for defaulted fines to be paid in chronological order.

• The amendments enabling the transfer of responsibility for prosecuting Part III cases to municipalities may result in another unfunded mandate for municipal governments.

• Since the legislation requires municipal ‘agreement,’ it is important that a pilot project model not be used to eventually transfer this responsibility onto unwilling municipalities.

Schedule 45 – Workplace Safety and Insurance Act • The proposed amendments make workplace

mental stress claim provisions retroactive to 2014

• This change would result in increased costs for Ontario’s municipal governments.

• In 2017 and 2018, the WSIB’s Premium rate resulted in decreased rates for many employers with the notable exception of local governments, which saw premiums increase well above inflation.

• The implementation of the WSIB Workplace mental stress program is expected to be challenging for all employers.

The Ontario Legislature will rise on December 14th and will resume on February 13, 2018. We will keep members informed as more information is available.

Federal Government Releases National Housing StrategyToday, the federal government announced its much anticipated National HousingStrategy. AMO welcomes the announcement and the government fundingcommitments of $40 billion over ten years.

An overarching national strategy presents the opportunity for all orders ofgovernment to proactively work towards supporting Ontarians, and all people livingin Canada, to meet their immediate needs and future housing aspirations.

It is especially important for Ontario’s municipal governments, as housing is amunicipal responsibility unlike in other provinces and territories. Federal actionsand long-term investments should support municipal governments and DistrictSocial Service Administration Boards to address housing and homelessness in theircommunities. The plan includes investments to both expand affordable housing andas well to repair and renew existing social housing. AMO advocated that bothpriorities be addressed in the strategy.

Key highlights of the strategy are:

Focus on the needs of the most vulnerable through a human-rights-basedapproach to housing;

Introducing legislation within the next year obligating the federal governmentto maintain a National Housing Strategy and a report to Parliament on housingtargets and outcomes;

Establishing goals to:

decrease chronic homelessness by 50%

remove 530,000 families from housing need

invest in construction of 100,000 new affordable homes

Investments will include:

$15.9 billion for a new National Housing Co-investment Fund

$8.6 billion for a new Canada Community Housing Initiative

$200 million in land transfers to housing providers

Committing that at least 25% of funds go to projects for women, girls andtheir families; and,

Working with Indigenous leaders to co-develop distinctions-based housingstrategies.

AMO will analyze the impact of the strategy with its Affordable Housing andHomelessness Task Force, providing members with relevant updates. Furtherinformation and clarification is needed on the particulars and next steps, especiallyhow municipal governments in Ontario will be engaged. AMO looks forward toworking with both the federal and provincial governments to provide advice on thefinal details and implementation of the strategy; a vitally important initiative toensure housing stability and prosperity for the residents and communities inOntario.

FONOM Office contact: Katelyn Guertin, Projects and Operations Coordinator 705-567-9361 ext. 258 3 Kirkland Street W Kirkland Lake, ON P2N 3P4 Meeting of the Board of Directors’ held September 28, 2017 – The FONOM Board of Directors’ held their September Board meeting in Timmins to correspond with the Northern Ontario Business Awards. It was a great opportunity to show FONOM’s support of the business leaders in our communities. The Board discussed a number of issues including supporting a request to the government to reconsider its approach to tax registration procedures for out of court payments. FONOM received a significant number of resolutions and has since sent a letter to the Minister requesting action. The Board also discussed energy related concerns, broadband services, a pilot project for Indigenous Inter-Professional Primary Care Teams, to name a few. 2018 ROMA Conference – The FONOM Board will be attending the upcoming ROMA conference and has submitted its request to meet with the Premier and members of Cabinet. While FONOM ensures flexibility to include additional matters of concern as they arise, some of the issues of potential discussion include: railway rights-of-way property taxation, fire-medic proposal, public health units, electricity prices, and others. With provincial election year fast approaching, FONOM is looking forward to pressing the government on matters that demand attention and action. 2018-2019 FONOM Membership Fees – Membership invoices have been prepared and will be sent out in the next few weeks to ensure significant time is in place to meet the March 31, 2018 deadline. 2018 FONOM/MMA Northeastern Municipal Conference – Planning is underway for the upcoming annual conference taking place May 9, 10 and 11 in partnership with the Ministry of Municipal Affairs and the host community of Parry Sound. Update on policy matters: Bill 148, Fair Workplaces, Better Jobs Act FONOM provided a written submission to the Standing Committee on Finance and Economic Affairs requesting exemptions be made for municipal employers from the legislation. They included an exemption for municipal employees that are required to be on call to provide public safety and public health services and an exemption for volunteer firefighters for equal pay for equal work provisions of full-time firefighters. FONOM is pleased that the government has recognized the significant implications of these provisions and committed to exempting municipal employers from on-call provisions to ensure the delivery of essential services as well as exempting firefighters from the equal pay for equal work provisions. Bill 160, Strengthening Quality and Accountability for Patients Act, 2017 FONOM provided a written submission to the Standing Committee on General Government focusing on the fire-medic proposal that would see expanded medical services performed by fire fighters who are certified paramedics. FONOM requested that an amendment to the legislation be included that would prevent arbitrators from replicating the pilot projects onto unwilling municipalities, given the current interest arbitration system. Ontario’s Cannabis Act FONOM attended the Ministry of Community Safety and Correctional Services’ Cannabis Legalization: Enforcement Summit. The summit, which was attended by municipalities, Indigenous leaders, law enforcement representatives, public health and representatives from a number of government Ministries, consisted of roundtable discussions which raised several themes including education and training, better clarification about roles and responsibilities and communication, amongst law enforcement, communities, public health and the public. FONOM continues to advocate the need for resources to municipalities, community supports and law enforcement, local say in determining where storefronts will be located and the need for a long-term strategy to work with municipalities on economic development opportunities.

Forestry/Species at Risk FONOM continues to advocate on behalf of the forestry sector. President, Al Spacek attending Queen’s Park on November 22, 2017 along with community leaders, Indigenous leaders, unions, chambers of commerce and forestry professionals to urge the provincial government to avoid unintended consequences by rushing Species at Risk policy. The Weather Network’s application to CRTC FONOM submitted a letter of support to the Canadian Radio-television Telecommunications Commission (CRTC) to renew The Weather Network’s broadcasting license to ensure that weather information will remain on basic television where it is available to all subscribers rather than moved to more expensive television packages. Access to weather information is important in understanding local weather forecasts and road conditions to help make safe travel and planning decisions. AMO Task Forces Members of the FONOM Board are represented on a number of AMO Task Forces, providing key northern perspectives on a number of issues. October 26, 2017

PRESENT: Morley Haskim, Joyce Hopkins, Al Last, Mel Hammond, Dinah Ryeland Brown REGRETS; Wendy Debruge, Linda Filion, Krista LeBlanc Denhertog VISITORS- Jeremy Moore CALL TO ORDER; The meeting was called to order at 6:30 p.m. APPROVAL OF THE MINUTES: Moved by Mel Hammond and seconded by Dinah Ryeland Brown that the minutes of the Sept.7, 2017 McKellar Recreation Committee meeting be approved as presented. Motion Carried (17-54). APPROVAL OF AGENDA: Moved by Al Last and seconded by Mel Hammond that the agenda be accepted as presented. Motion Carried (17-55). DECLARATIONS OF PECUNIARY INTEREST: None CORRESPONDENCE RECEIVED; Zack Crafts of Treetop Community Forest forwarded a link to our Committee, showing MPP Norm Miller giving recognition to Treetops volunteers. Norm Miller also mentioned that the fund raising goal was reached at the Bike McKellar event. REPORTS OF MEMBERS: 1. Joyce reported that the Barb Kerr Expo event was a success and that our booth was well received. Joyce also reported that many in attendance took interest in McKellar events. 2. Joyce reported that the Balsam Trail Nature Hike was canceled and will be re-scheduled to the spring. The information for future signage on the trail will be decided during the next scheduled hike. 3. Morley reported that the McKellar Agricultural Fall Fair Parade was a huge success. The float put in the parade by the McKellar Recreation Committee was awarded 4th place. A prize consisting of a ribbon, pins and $60.00 was received. 4. Al has received the 150 celebration pins and certificates from David Moore to be distributed to McKellar Recreation Committee Members. Pins were also received for the many volunteers that were involved with the Ontario 150 McKellar Heritage Regatta. 5. Jeremy reported that the photo gallery on the township website is in place. Jeremy asked members to forward additional photos of various events to him so he can continue to expand the photo gallery. Go to page 2

Page 2 MOTIONS ARISING FROM CORRESPONDENCE AND REPORTS: None OTHER BUSINESS AND MOTIONS ARISING: 1.Movie Nights will begin on Friday November 3 with the showing of Passchendaele. The movie Lego Batman Movie will show on Friday November 17. Motion moved by Al Last and seconded by Mel Hammond that the Recreation Committee do approve the expenditure of up to $100.00 for concession items for the Movie Nights. Motion Carried (17-56). 2. Halloween treats will be given out by the Recreation Committee at the Community Centre on October 31, 5:30-7:00. Joyce,Carol Ann Miller and the firefighters will be present. Joyce and Dinah will decorate prior at 10:00a.m. 3. Adult Badminton will begin Monday Nov. 6 and Kids Badminton will begin Wednesday Nov. 8. 4. The committee discussed the possibility of having some money in a reserve account for items that may arise through the year that were not budgeted for at the start of the year. This account could also be utilized to receive donations for recreation purposes in the township. Morley informed the committee that there is presently a Recreation Committee Reserve. The present balance is $0.00. Moved by Al Last and seconded by Dinah Ryeland Brown that the Recreation Committee recommend that any surplus from the 2017 Recreation Committee budget be transferred to the Recreation Committee Reserve Account. Motion Carried (17-57). 5. Joyce circulated a draft 2018 Calender of Events newsletter. The committee will review the newsletter and bring concerns forward. 6. In reviewing a low attendance at the February Family Skating Parties , the committee had discussions on enhancing attendance with the possibility of also having Family Pick-up Hockey along with the Skating. BY-LAW NO 2017-34

Being a By-law to prohibit the deposit of snow and ice on Township roadways

WHEREAS Sections 8(1) and 10(2) of the Municipal Act, 2001, S.O. 2001, Chapter 25 as amended, authorize municipalities to pass by-laws for the health, safety and well-being of persons; AND WHEREAS Section 181(1) of the Highway Traffic Act RSO 1990, Chapter H.8 prohibits the deposit of snow or ice on a roadway without permission in writing so to do from the Ministry or the road authority responsible for the maintenance of the road; AND WHEREAS the Council of the Township of McKellar deems it in the public interest to pass a by-law prohibiting the deposit of snow or ice on a roadway under the jurisdiction of the Township of McKellar; NOW THEREFORE the Council of the Corporation of the Township of McKellar enacts as follows: 1. DEFINITIONS

In this by-law: “Contractor” means a person alone or with others conducting work on a property or on behalf of an owner or occupant. “Highway” means a common and public highway, and includes one or both of the following: (1) Any street, roadway, avenue, parkway, lane, driveway, boulevard, sidewalk, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles or persons, or (2) The area between the lateral property lines of any highway or road allowance including any curbs, gutters, culverts, ditches and retaining wall.

“Obstruction” means to obstruct, encumber, damage or foul and includes depositing of ice or snow. “Officer” means a Person employed by the Township to perform the duties of enforcing By-laws and appointed by Council as a Municipal Law Enforcement Officer. “Owner” includes, (a) The Person who is the registered owner of a property; and (b) The Person for the time being managing or receiving the rent of the property whether on the Person’s own account or as an agent or trustee of any other Person, or who would receive the rent if the land or premises were let. “Occupant” means a lessee, tenant, mortgagee in possession or any other Person who appears to have care and control of any property. “Person” in addition to its regular meaning, includes an individual, firm, proprietorship, partnership, association, syndicate, trust, corporation, department, bureau and agency or any director, officer, manager or person in charge of such entity or the collecting of rent of any property, or any other person who is the occupier of the property. “Roadway” means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and , where a highway includes two or more separate roadways, the term “roadway” refers to any one roadway separately and not to all roadways collectively. “Township” means the Corporation of the Township of McKellar.

2. GENERAL PROVISIONS 2.1 No person shall deposit snow or ice onto any municipal roadway without permission in

writing to do so granted by the Council of the Township of McKellar. 3. HAZARDOUS CONDITION If an Officer determines that an Obstruction of a Roadway is, or may create, a hazardous condition to the safety of any Person using the Highway or Roadway, the Officer may take any action necessary to have the Obstruction immediately removed and the Roadway repaired, if necessary, and all the costs incurred by the Township in undertaking this work shall be expenses owed to the Township by the Owner, Occupant and/or Contractor of the property from which the Obstruction comes from, relates to, or was created by. 4. ENFORCEMENT AND PENALTY 4.1 By-law Enforcement Officers of the Township of McKellar are hereby authorized to

enforce the provisions of this By-law pursuant to the Provincial Offences Act.

4.2 Every person who contravenes or fails to comply with any of the provisions of this By-law, and every director or officer of a corporation, is guilty of an offence and on conviction is liable to the fines and other penalties prescribed by the Provincial Offences Act and the Municipal Act. The fines specific to offenses under this Bylaw are identified on Schedule ‘A’ to this Bylaw.

5. SEVERABILITY Where a court of competent jurisdiction declares any section or part of a section of this By-law to be invalid, or to be of no force and effect, it is the intention of Council in enacting this By-law that the remainder of this by-law shall continue in force and be applied and enforced in accordance with its terms to the fullest extent possible according to law. This by-law shall come into force and take effect immediately upon the final passing thereof. The Schedule of Set Fines shall come into force and effect upon approval. WHEREAS Section 137 of the Highway Traffic Act, R.S.O. 1990, Chapter H.8, provides that theCouncil of a municipality may by by-law provide for the erection of stop signs at intersections onhighways under its jurisdiction, and every stop sigh so erected shall comply with the regulations ofthe Ministry;

NOW THEREFORE the Council of the Corporation of the Township of McKellar hereby enact asfollows:

1. The intersections on highways set out in Column 1 are designated as intersections wherestop signs shall be erected at the locations shown in Column 2.

Being a By-law to Confirm the Proceeding of Council of theTownship of McKellar

WHEREAS Section 5 of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that thepowers of a municipality shall be exercised by its Council; and

WHEREAS, Section 9 of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that amunicipality has the capacity, rights, powers and privileges of a natural person for the purposes ofexercising its authority under the Municipal Act or any other Act; and

WHEREAS Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, provides that amunicipal power, including a municipality’s capacity rights, powers and privileges under Section 9of the Municipal Act, 2001, S.O. 2001, c 25 as amended, shall be exercised by by-law unless themunicipality is specifically authorized to do otherwise; and

WHEREAS it is deemed expedient that the proceedings of the Council of the Corporation of theTownship of McKellar at this Session be confirmed and adopted by By-law.

NOW THEREFORE the Council of the Corporation of the Township of McKellar hereby enacts asfollows:

1. THAT the actions of the Council of the Corporation of the Township of McKellar at itsmeetings held on November 28, 2017 and December 4, 2017 in respect to each resolution andeach action passed and taken by Council at the meeting, are, except where the prior approvalof the Ontario Municipal Board is required, hereby adopted, ratified and confirmed as if thesame were expressly embodied in this By-law.

2. THAT the Reeve, or in his/her absence the Acting Reeve, and the proper officials of theCorporation of the Township of McKellar are hereby authorized and directed to do all thingsnecessary to give effect to the said action of the Council of the Corporation of the Townshipof McKellar during the said meeting referred to in Section 1 of this By-law.

3. THAT the Reeve, or in his/her absence the Acting Reeve, and the proper officials of theCorporation of the Township of McKellar are hereby authorized and directed to execute alldocuments necessary to the action taken by this Council as described in Section 1 of this By-law and to affix the Corporate Seal of the Corporation of the Township of McKellar to alldocuments referred to in said Section 1.
