WASHINGTON THIS WEEK

The Commission has denied a request by the National Association of Broadcasters for an extension of the comment period for the review of the policies affecting investment in the broadcasting industry. Comments are due June 24. Replies are

due July 2. The NAB had asked for more time so the issues could be discussed at

its board meeting June 23 -26. The FCC contends that since it does not routinely

grant extensions, and the NAB has not presented "sufficiently compelling" reasons

for an extension, the request is denied.

The Commission upheld a staff action granting the application of GAF Corp. to

transfer its wholly -owned subsidiary, GAF BRoadcasting C., Inc, licensee of WNCN

New York, from GAF's stockholders to a privately held stock company (GAF II) owned

by a GAF management -led group. A petition for reconsideration filed by Listener's

Guild, Inc. against the transfer was denied after several allegations were

dismissed by the Commission as unsubstantiated or moot.

Ellwood Beach Broadcasting, Ltd., has been ordered by the $25,000 for violationg the Commission's rules with intent failed to report a change in circumstances with respect to Ellwood was an applicant for a new FM station at Montecito,

The National Assn. of Broadcasters has asked the Federal Communications Commission

to "significantly alter" the comparative hearing process. NAB wants the FCC to

abandon preferences for non -group or hands -on owners, instead emphasizing "applicants who commit to long -term operation of a new station." In another one of

many recent nods to Canadian -style protectionism by U.S. broadcasters over the

last year, NAB also suggested that applicants "identify the need for new services

in a community" and "demonstrate a realistic proposal to ensure a local market can

support a successful operation of a new station." As it has in the past, NAB again

asked the FCC to reject a lottery or any other random -selection process.

Control Data Corporation, the folks who bring you Arbitron, have announced plans to split the parent company into two separate entities: Control Data Systems, Inc., --which is, in effect, being spun -off from the former entity -- and the Ceridian Corporation. CDC president /CEO Lawrence Perlman will assume those duties for Ceridian which will concentrate on "data services and information products for business and government." The D- I- V- O -R -C -E is considered good news for Arbitron since it distances the ratings service from the multi -million dollar losses of CDC's computer products division.

The Radio Advertising Bureau will present four sessions at NAB's upcoming Radio Show, held Sept. 9 -12 in New Orleans. Besides a repeat of its "Breaking The Mold" session held at NAB's recent spring convention, other sessions are "Small Market Sales Strategies," "Selling AM Radio," and "Stop Selling Spots: Start Selling Radio." Spring NAB's most talked -about session, the destruction of Ronald Reagan's Crystal Award by anti -nuclear testing protestors, will not be repeated.

They bought THAT for a dollar: Canada's ratings service, the HBM Bureau of Measurement, has announced its highest ballot response rate in the last 10

years --54.6% diary return. That's the service's highest increase since the Fall 1986 book when BBM posted a 47.0% response rata. What mad- the difference -- especially in 18 -34? Upping the diary- keeper's incentive from $1.00 to $2.00, according to a statement from BBM's Brian Parish.

WJFK Washington, DC engineers are busy hiding the microphones in preparation for midday host G. Gordon Liddy who will broadcast live from the Watergate complex on June 17, the 20th anniversary of the break -in at the Democratic National Committee. Those guests already announced include Charles Colson, the three police officers who arrested the Watergate burglars, and "Silent Coup" author Len Colodny.

WASHINGTON THIS WEEK

The National Association of Broadcasters this week challenged the FCC's revised ownership rules, asking to reconsider the use of audience ratings to determine market share and number of stations in a market. The NAB also recommended limiting national ownership to 25 AM's and 25 FM's, or 30 AM's and 30 FM's if five of each are minority controlled, and limiting local ownership to 2 AM's and 2 FM's in all markets with at least 15 stations.

The Commission has issued a notice of apparent liability of $2,000 to Sound Broadcasting Corp., licensee of KCNA Cave Junction OR for not notifying the other party before broadcasting a phone conversation. This time, the conversation with the receptionist from cross -town KBOY. After a lot of "he -said, she -said" in the proceeding, the maximum fine was levied because the station ignored the first warning letter and did not provide notarized affidavits from employees involved.

The Commission notified Alexander Mitchell Communications, licensee of WSKS -FM Milledgeville GA for an apparent liability of $8,000 for not properly lighting its antenna structure. A filed inspection revealed all the lights were out on the tower, and the FAA had not been notified.

Robert D. Greenberg has been appointed to Assistant Chief for Engineering of the FM Branch, Audio Services Division of the Mass Media Bureau at the Commission. Greenberg has been in charge of many special projects for the FCC, including coordinating the FCC's new engineer training program.

Martin Beck, chairman of the board of Beck -Ross Communications, Inc, has been named the 1992 recipient of the NAB's National Radio Award. The award recognizes significant contributions and a lifetime of service to the radio industry. Beck will be honored during the NAB Radio show at the New Orleans Convention Center this fall. The award will be presented during the Crystal Radio Awards luncheon.

The Richards Group of Dallas Motel 6 spot captured to $100,000 prize at the RAB's first annual Mercury Awards for Radio Advertising at a black -tie ceremony in New York last Thursday. More than 900 attended the dinner hosted by Dick Clark. Fourteen agencies, creative boutiques /production companies and freelancers walked away with a total of 21 cash prizes totaling $200,000. resigned last week after Westwood created the Network President position for Greg Batusic. Battison joined Westwood One in 1985 as Executive Vice President.

The Unistar Radio Networks announced this week that they have signed a new five -year contract with Turner Broadcasting System for the exclusive radio rights to CNN Radio and CNN Headline News. Earlier last month, Unistar Chairman Nick Verbitsky presented CNN Chairman Ted Turner with an antique radio to commemorate the signing of the agreement. Also announced this week, Unistar has decided to phase out its

four -year -old Special Blend soft AC format. Special Blend was heard on

approximately 30 stations across the U.S. The format will be phased into Unistar's Format 41 by October 4, 1992.

The CBS Radio Networks have promoted Traugott (Traug) Keller to New York Sales

Manager for the networks. Keller was previously an account executive in the

networks Eastern sales office.

Because the Commission did not issue broadcast applications for Friday, June 12, and broadcast actions for Thursday, June 11, or Friday, June 12, this issue is a little smaller than we'd like it to be.

Just in time for this year's presidential election, the Federal Communications Commission is conducting an audit of broadcast stations and cable television systems regarding political programming and lowest unit rate charge guidelines. According to Inside Radio, FCC field personnel audited 30 stations and cable television facilities last Wednesday, searching the stations' political files for ad rate disclosure statements and other documents required for compliance. Licensees and cable systems are required to provide to the Commission their political files for the last two years as well as a copy of their disclosure statements, if any. These statements describe to candidates information regarding rates and all value- enhancing discount privileges offered to commercial advertisers. If a station is found to be in violation of the political programming rules, it is subject to sanctions ranging from a letter of admonition to a forfeiture.

The National Association of Broadcasters has asked the Federal Reserve to not require disclosure detail in radio and television spots for financial services. The NAB contends that the amount of detail "may render the ad virtually worthless, both as a sales tool and a useful source of information to consumers." This comes after current automobile leasing disclosures in radio advertisements are already cumbersome to write, much less listen to. The Federal Reserve is considering the new rules to implement the "Truth in Savings Act."

The NAB's European Convention, Radio Montreaux, wrapped up last week, exceeding the association's expectations. L. Lowry Mays, co- chairman of the event, said in a statement that the attendance of approximately 1,000 was more than double what they had expected. Attendance included broadcasters from 38 countries on five continents. The NAB plans to expand next year's event, based on this year's success.

The Commission has ordered Stoner Broadcasting's WMXZ, New Orleans LA to forfeit $7,000 for airing a misleading contest back in the summer of 1990. According to Inside Radio, the winner of the "$100,000 People's Choice Contest" was supposed to get the keys to $100,000 worth of cars. The winner actually got just one --and it wasn't a Rolls Royce or a Bentley. The station was also fined for not airing legal ID's. Stoner successfully reduced the $8,750 fine because its legal ID omissions were "inadvertent and infrequent." Stoner also used its clean record with the FCC to have the fine reduced by twenty percent.

The Commission has also ordered Montachusett Broadcasting, Inc., licensee of WXLO Fitchburg MA to forfeit $4,000 for violation of the rules regarding broadcast of a recorded conversation without having first informed the party of its intended use. WXLO had argued that Infinity's KROQ -FM Los Angeles was only admonished for broadcasting a hoax while WXLO was fined. The Commission refused to hear the argument, stating that the hoax broadcast only violated FCC policy, while the broadcast of a recorded conversation without informing the party first is a violation of FCC rules. (The Commission has subsequently included hoaxes in the Rules). WXLO was successful in having the fine reduced from $5,000 because of its clean record.

The Sun Radio Network, has reached an interim management agreement with the intent to sell to Sound Communications, Inc. The purchase is expected to be completed by June 30. Sound Communications is a privately owned corporation whose majority stockholder is former professional rodeo cowboy and real estate financier Howard Carson. Carson is the president of Great Western Land and Mortgage Company, which has holdings in Colorado, Georgia, and the Ukraine. Bill Wardino, General Manager of Sun said in a press release that the sale will in no way alter plans. However, Wardino said some programming changes are in the works. The previous owner, Kayla Satellite Broadcasting Network, took Sun out of bankruptcy in 1989. The majority of Kayla is owned by the Liberty Lobby of Washington, D.C.

The Arbitron Company reports that Arbitron's Spring 1992 Radio Market Reports will contain updated guidelines on ratings distortion and special station activities. The guidelines will be effective immediately. The action was taken by Arbitron after a number of guideline violations occurred during the winter book in which station listeners were encouraged to participate in Arbitron survey activities. The purpose of the bulletin is to reiterate Arbitron's positions regarding specific activities which have been conducted in recent surveys by individual radio stations and to remind stations of the importance of previewing activities to avoid sanctions. The release asks station programmers to be wary of the fact that any station activity which has the potential to result in a station having access to current survey diaries or identify the whereabouts of diarykeepers is a violation of Arbitron's guidelines. The release also pointed out any sensitizing statement on the air that encourages participation in a current or future survey is a violation. Programmers are asked to "prereview" planned promotions through Nick Green at (301) 497 -4603.

The ABC Radio Networks walked away from the International Radio Festival of New York with the "Grand Award" for Best Overall News Program for its "American Agenda Radio Specials." These specials analyze problems and issues faced by Americans, and present possible solutions. ABC also won gold medals for Best News Magazine, Best Culture and The Arts Series, Best National Affairs Program, Best Announcer, and Best Narration. The competition collected 1,500 entries from 35 countries.

The Commission this week deleted an allotment granted in a 1991 R &O for 101.1 A to Hannahs Mill, Georgia, after Radio Georgia, Inc. successfully preved that Hannahs Mill is not a community for allotment purposes. Originally, the allotment was granted based on a petition for rulemaking filed by Dewitt Coleman, who proposed it as that community's first FM service. It was granted after Coleman successfully demonstrated that Hannahs Mill was, according to the 1980 U.S. Census, a community. At that time, the community was also listed in the Rand McNally Commercial Atlas. Radio Georgia pointed out that the community was not listed in the 1990 census, and also relied on testimony from a local sheriff to point out that Hannahs Mill has never been considered a separate community in that area. Radio Georgia, Inc. is the licensee of WTGA AM & FM, in nearby Thomaston GA.

The Commission has ordered CanXus Broadcasting Corporation, licensee of WCXU, Caribou ME, to pay $10,000 for unauthorized assumption of control of WKZX, Presque Isle, ME. In late 1987, CanXus and Colonial Broadcasting Company entered into a pre -sale agreement whereby CanXus was responsible for all of WKZX's contractual obligations. The Commission viewed this document as a strong indication that CanXus controlled WKZX before FCC permission for transfer of control was granted. A Notice of Apparent Liability was then issued. In a lengthy rebuttal, Canxus denied the charges, stating the FCC had overlooked or misinterpreted the arrangement the stations had. The FCC dismissed these allegations, stating that CanXus failed to reveal the management and programming arrangement in the transfer application and that " CanXus was fortunate in that the Commission did not find other compelling evidence of misrepresentation, sufficient to designate WCXU for a license revocation hearing."

In actions in docket cases, the review board added issues against First Coast Radio, Inc. to determine if it is financially qualified to become a licensee and added issues against LeeAnn Kendall Scopinich to determine misrepresentations, lack of candor, and financial qualifications in the proceeding for a new FM in Pointe Verde Beach FL.

Three stations have had cases certified to the Commission after license revocation hearings. They are WFRK Coleman FL, KOKY Jacksonville AR, and WPSC Pageland SC. The Commission also dismissed petitions for reconsideration to allocate frequencies in Arizona and Minnesota this week. It dismissed an attempt to reallocate 98.3 MHz to Prescott AZ and 107.5 MHz to Faribault MN.

The NAB has endorsed a proposal that will make it easier for radio and television broadcasters to issue stock to raise needed capital. The proposal by the SEC is actually part of a larger effort to help new small businesses raise operating and expansion capital. The proposal exempts small businesses from certain costly and cumbersome equity- raising rules.

The NAB announced this week the election of Wayne Vriesman as chairman of the Radio Board. Vriesman is Vice President of the Tribune Broadcasting Company's radio group. Bob Fox, Chairman /CEO of KVEN /KHAY Ventura CA was elected vice chairman. The two will serve one year terms and will also serve on the NAB's executive committee. Fox has served on many NAB committees, while Vriesman was general manager of WGN Chicago for ten years.

The battle of the network wires has begun. CBS Radio and Zapnews will launch their first customized news service for network affiliates, CBS ZAPNEWS, beginning July 1. ABC, in conjunction with Reuter's and Gannett, also announced this week their plans for rolling out a satellite -delivered news, weather, and sports text to affiliates to begin August 1. Both services intend to be an alternative to the Associated Press. Each company says its services can and will be customized for affiliates. Stations will pay a fee for the services based on market size and services used.

Rock lead the list of most popular music types sold for 1991 according to the results of the Recording Industry Association of America's annual consumer profile, reflecting record sales across the U.S. Rock held 36.3 percent of all record sales. Second - ranked urban contemporary slid to 18.2 percent in 1991, off from 18.3 in 1990. The most significant growth has been in country music, turning in a 3.7 percent increase over last year to 12.5 percent. Gospel and children's records also showed strong growth with children's record sales up almost 900 percent from .4 percent in 1990 to 3.3 percent in 1991. Record sales for 1991 totaled just over $7.8 Billion.

Rick Sklar, a noted broadcasting and media management consultant noted for his programming prowess at WABC New York during the early days of rock and roll, died unexpectedly during minor foot surgery Monday. A coroner's investigation is still pending. He was 62 years old.

The ABC Radio Networks successfully launched its new satellite services division May 22, producing an eleven -station simultaneous remote for Remote Possibilities at Sea World in Orlando FL. Middle East Broadcasting Centre won the bidding war for UPI after it raised its bid to almost $4 million, edging out real estate developer Leon Charney. UPI has continued operating out of bankruptcy during a bidding war that began when Pat Robertson invested $400,000 to keep the company afloat while he poured over the books.
