The KENT COUNTY COUNCIL, in exercise of its powers under Sections 32(1), 35(1), 45, 46, 49 and 53

of and Parts III and IV of Schedule 9 to the Road Traffic Regulation Act 1984, and of all other enabling

powers, and after consultation with the chief officer of police in accordance with Part III of Schedule 9 to

the Act, hereby makes the following Order.

PART I PRELIMINARY

Citation and Commencement

1. This Order may be cited as the KENT COUNTY COUNCIL (BOROUGH OF MAIDSTONE)

DESIGNATED PARKING PLACES CONSOLIDATION ORDER 2008 and shall come into force

on 5th February 2008

Interpretation

2. (1) In this Order a reference to a numbered Article or Schedule is a reference to the Article of, or

Schedule to, this Order which bears that number.

(2) In this Order:-

(a) “the 2002 Regulations” means the Traffic Signs Regulations and General Directions 2002;

(b) “cause” includes permit and causing shall be construed accordingly;

(c) “coach” has the same meaning as in Regulation 3 of the Road Vehicles (Construction and

Use) Regulations 1986;

(d) “disabled person’s badge” has the same meaning as in The Disabled Persons (Badges for

Motor Vehicles) (England) Regulations 2000;

(e) “disabled person’s vehicle” has the same meaning as in The Local Authorities’ Traffic

Orders (Exemptions for Disabled Persons) (England) Regulations 2000;

(f) “driver” in relation to a vehicle waiting in a parking place, means the person driving the

vehicle at the time it was left in the parking place;

(g) “goods vehicle” means a motor vehicle which is constructed or adapted for use of the

carriage of goods or burden of any description and is not drawing a trailer

(h) “parking attendant” means a person authorised by or on behalf of the Council to supervise

any parking place;

(i) “parking place” means an area of highway authorised or designated under Article 4 and

marked with a traffic sign specified in diagram in 1028.2, 1028.3, 1028.4, 1032 or 1033 in

Schedule 6 to the 2002 Regulations;

(j) “parking space” means an area of a parking place marked out as indicated in the 2002

Regulations and which is provided for the leaving of vehicles;

(k) “passenger vehicle” means a motor vehicle (other than a motor cycle or invalid carriage)

constructed or adapted solely for the carriage of not more than twelve passengers (exclusive

of the driver) and their effects and not drawing a trailer;

(l) “pay and display machine” means a parking meter as defined in Section 46(2)(a) of the

1984 Act;

(m) “permitted hours” in relation to a parking place in a schedule to this Order, means the

period specified at the beginning of that schedule;

(n) “relevant position” means:-

(a) in the case of a vehicle fitted with a front windscreen, on that windscreen, and

(b) in the case of a vehicle not fitted with a front windscreen, a conspicuous position on

the front or near side of the vehicle

and a permit shall be treated as displayed in the relevant position if it is readily readable by

a person without getting in or on the vehicle;

(o) “resident’s parking permit” means a current permit issued as provided in Article 21;

(p) “schedule” refers to a numbered schedule attached to this Order;

(q) “taxi” has the same meaning as in the Traffic Signs Regulations 2002;

(r) “undertaker” has the same meaning as in Section 48(4) of the New Roads and Street Works

Act 1991;

(s) “the Council” means the Kent County Council; and

(t) “vehicle” includes any part of a vehicle.

(3) “The Interpretation Act 1978 shall apply for the interpretation of this Order as it applies for the

interpretation of an Act of Parliament

Revocation

3. Without prejudice to the validity of anything done or to any liability incurred in respect of any act

or omission before the coming into force of this Order, the provisions of the Kent County Council

(Borough of Maidstone) Designated Parking Places Order 2002, as amended, are hereby revoked,

and are listed in Schedule 9 of this order.

PART II – DESIGNATION AND SUSPENSION OF PARKING PLACES

Designation of Parking Places

4. Each area of highway specified in a schedule to this Order, being an area of highway within the

area designated as a Permitted Parking Area by the Road Traffic (Permitted Parking Area and

Special Parking Area) (County of Kent) (Borough of Maidstone) Order 1997 and unless otherwise

so specified, bounded on one side of that area by the edge of the carriageway, is hereby designated

as a parking place.

Suspension of Parking Places

5. (1) A person duly authorised by the Council may suspend the use of all or any part of a parking place

in the manner specified in paragraph (2) below, and in the circumstances mentioned in paragraph

(3) below insofar as and for such time as those circumstances reasonably require the suspension.

(2) That manner is the covering of any traffic sign (other than one painted on the surface of the

highway) indicating that the parking place, or the relevant part of it, is available and the placing of

such signs in or near the parking place which indicate that the parking place, or the relevant part of

it, is not available.

(3) Those circumstances are:-

(a) works being done or intended to be done by:-

(i) an undertaker, or

(ii) with the consent of the Council, persons other than an undertaker; and

(b) the loading or unloading of goods being, or immediately to be, taken to or from premises

adjacent to the parking place; or

(c) lawful events which are occurring, or are likely to occur, on the highway and involve an

unusual use of the highway.

Removal and Alteration of Position of Vehicles

6. In a case where, pursuant to Regulation 5A of the Removal and Disposal of Vehicles Regulations

1986, a parking attendant who removes a vehicle from a parking place or arranges for its position to

be altered, may do so by driving the vehicle, towing it or in such other manner as he may consider

appropriate, and may take such measures as he may think appropriate to enable him to remove the

vehicle or alter its position.

PART III - GENERAL PROVISIONS AS TO USE

Running of Engine

7. Except as provided in Article 19, no person shall cause a vehicle to wait in a parking place unless

the engine is stopped as soon as the parking starts, nor start the engine running except immediately

prior to the vehicle leaving the parking place.

Prohibited Uses

8. While a vehicle is waiting in a parking place no person shall:-

(a) sound any horn or other audible warning device with which the vehicle is fitted except

immediately prior to the vehicle leaving the parking place;

(b) cause an work of maintenance or repair to be done to the vehicle except so far as may be

reasonably necessary to enable the vehicle to leave the parking place;

(c) cause any goods to be sold from the vehicle, unless the goods are immediately delivered to

premises adjacent to the parking place, or the vehicle to be used for the purpose of selling or

offering for hire any skill or service; or

(d) sleep in the vehicle.

Manner of Parking in Parking Places

9. Except as provided in Article 19, no person shall cause a vehicle to be waiting in a parking place

which is divided into parking spaces unless every part of the said vehicle is wholly within the limits

of a parking space.

PART IV - PARKING AT SPECIFIC TYPES OF PARKING PLACES

Pay and Display Parking Places

10. (1) Except as provided in Articles 19 and 20, no person shall cause any vehicle to wait in a designated

parking place specified in a schedule in Part A of the schedules to this Order during the permitted

hours unless all of the following conditions are complied with:-

(a) that the pay and display machine provided in respect of that parking place did not appear to

the person causing the vehicle to be parked to be out of working order when the period of

parking began;

(b) that, with the exception of a disabled person’s vehicle displaying in the relevant position a

disabled person’s badge, the person being the driver of the vehicle left in a parking place

has:-

(i) paid the permit charge immediately after the vehicle was first parked by inserting

the appropriate money into that machine and obtained from that machine a permit;

and

(ii) caused the permit to be displayed in the relevant position and to remain in that

position throughout the period during which the permit is valid and in which the

vehicle is parked in that space;

(c) the vehicle being left in the parking place is of a class that includes passenger vehicles,

goods vehicles, motor cycles or disabled persons vehicles;

(d) the minimum period specified in column 5 of that schedule has elapsed since the same

vehicle was parked in the same parking place; and

(e) the maximum period of 2 hours or in respect of item 4 in schedule 1 the maximum period of

4 hours in relation to the period of parking for a vehicle in a parking place has not expired.

(2) In this Article “permit charge” in respect to a parking place in Schedule 1, means the amount

specified in column (3) in relation to the period of waiting specified in column (2) in relation to

item numbers 1,2a, 2b, 3, 5,6, 7, 8, 9 of Schedule 1.

(3) In this Article “permit charge” in respect to a parking place in Schedule 1, means the amount

specified in column (3) in relation to the period of waiting specified in column (2) in relation to

item number 4 of Schedule 1.

Residents’ Parking Places

11. Except as provided in Articles 19 and 20 and with the exception of a disabled person’s vehicle

displaying in the relevant position a disabled person’s badge, no person shall cause a vehicle to be

parked in a designated parking place specified in a schedule in Part B of the schedules to this

Order, in relation to a parking zone specified in column (6) of that schedule, during the permitted

hours unless:-

(a) the person causing the vehicle to be parked in that space is the holder of a resident’s parking

permit relating to that zone and the afore-said permit is displayed in the relevant position

throughout the period during which the vehicle is parked in that space;

(b) the person causing the vehicle to be parked in that space is not the holder of a resident’s

parking permit but the maximum period for waiting referred to in column 5 of that schedule

is unexpired in relation to the period of parking of that vehicle; and

(c) the vehicle being left in the parking place is of a class that includes passenger vehicles,

goods vehicles, motor cycles or disabled persons vehicles.

Parking of Disabled Person’s Vehicles

12. Except as provided in Article 19, no person shall cause any vehicle to wait in a designated parking

place specified in a schedule in Part C of the schedules to this Order during the permitted hours

unless the vehicle displays in the relevant position a disabled person’s badge and a parking disc

which shows the time when the period of parking began, and no person shall cause a vehicle which

displays such a badge and disc to wait for a period exceeding 3 hours.

Motor Cycle Parking Places

13. Except as provided in Articles 19 and 20, no person shall cause any vehicle to be parked in a

parking place specified in a schedule in Part D of the schedules to this Order during the permitted

hours unless that vehicle is a motor cycle not having a side car attached to it.

Coach Parking Places

14. Except as provided in Articles 19 and 20, no person shall cause any vehicle to be parked in a

parking place specified in a schedule in Part E of the schedules to this Order during the permitted

hours unless that vehicle is a coach and the maximum period of waiting specified in column 5 of

that schedule has not elapsed in relation to the period of parking of that vehicle.

Taxi Parking Places

15. Except as provided in Articles 19 and 20, no person shall cause any vehicle to be parked in a

parking place specified in a schedule in Part F of the schedules to this Order during the permitted

hours unless that vehicle is a taxi in respect of which a licence has been granted by the Borough of

Maidstone.

Goods Vehicle Parking Places

16. Except as provided in Articles 19 and 20, no person shall cause any vehicle to be parked in a

parking place specified in a schedule in Part G of the schedules to this Order during the permitted

hours unless that vehicle is a goods vehicle and the maximum period of waiting specified in column

5 of that schedule has not elapsed in relation to the period of parking of that vehicle.

Street Parking Places

17. Except as provided in Articles 19 and 20 no person shall cause any vehicle to be parked in a

designated street parking place specified in a schedule in Part H of the schedules to this Order

during the permitted hours unless it is of a class of vehicle that includes passenger vehicles, goods

vehicles, motor cycles or disabled persons vehicles and the minimum period specified in column 5

of that schedule has elapsed since the same vehicle was parked in the same parking place.

Indications Given by Parking Permits

18. Any indication given by a parking permit of the time at which the permit was purchased from a pay

and display machine and any indication given by such a permit of the time at which that permit

ceases to be valid shall be treated as evidence of any such time.

General Exemptions

19. The restrictions specified in Articles 7, 9, 10, 11, 12, 13, 14, 15, 16 and 17 do not apply in respect

of a person causing a vehicle to be parked so that a person may board or alight from the vehicle or

if the person causing the vehicle to be parked is:-

(a) prevented from proceeding due to circumstances beyond his control;

(b) getting or giving help in consequence of an accident or emergency or otherwise taking

action for public safety;

(c) obliged to stop the vehicle so as to avoid an accident;

(d) opening or closing a gate or other barrier at the entrance to premises to which the vehicle is

being driven or from which it has emerged if it is not reasonably practicable to cause the

vehicle to wait at another place for that purpose;

(e) required by law to cause the vehicle to stop;

(f) using the vehicle in connection with the removal of any obstruction to traffic on the road or

in connection with the maintenance, improvement or reconstruction of the road;

(g) using the vehicle for ambulance, fire brigade or police purposes;

(h) using the vehicle (being a vehicle which displays the royal Mail livery) so long as may be

needed to collect or deliver letters or otherwise in pursuance of a statutory duty of the Post

Office;

(i) using the vehicle for the purposes of an undertaker; or

(j) acting in accordance with the permission or at the direction of a police constable in uniform

or a Parking attendant.

Exemptions for Loading and Unloading

20. The restrictions specified in Articles 10, 11, 13, 14, 15, 16 and 17 do not apply in respect of a

person causing a vehicle to wait for the purpose of it being loaded or unloaded provided that:-

(i) two of the wheels on one side of the vehicle are at the edge of the carriageway;

PART V - RESIDENTS’ PERMITS

Issue of Permits

21. (1) A resident’s parking permit shall only be granted by the Council if the following conditions are

complied with:-

(a) the applicant for the permit satisfies the Council that the applicant is normally resident, or

carries on business in all the parking zones excluding zone N5 in the Permitted Parking

Area mentioned in Article 4; and

(b) the applicant pays to the Council the appropriate sum specified in paragraph (2).

(2) That sum is:-

(a) if the permit is issued to a person who carries on a business in the Permitted Parking Area,

£70 for a year or any part of a year; and

(b) A charge of £25, where applicable, for the issue of a Second Residents’ Parking Permit for a year, or any part of a year. This charge will apply to all households remaining in Residents’ Parking Zones. The issue of the First Residents’ Parking Permit will be issued annually free of charge upon application.

(c) A charge of £25, where applicable, for the issue of a Visitors Permit for a year, or any part of a year. However, this Permit will be free of charge where no First or Second Residents Parking Permits has/have been issued (i.e. no vehicles are registered at the property).

(d) 22. (1) A maximum of three permits only can be issued for each property in a parking zone unless:-

(a) the property is in Parking Zone N5 when only 1 permit can be issued;

(b) the property is split into a number of bedsits where each bedsit will receive only 1 permit.

(2) Each property within a Parking Zone, if having applied for a permit(s) will be entitled to a visitor’s

permit.

Form of Permits

23. A resident’s parking permit shall not be valid before the date of its issue or after the date of

its expiry and states:-

(a) if the permit is issued to a person who is normally resident in the Permitted Parking Area,

the registration number of the vehicle in respect of which the permit is issued;

(b) if the permit is issued to a person who carries on a business in the Permitted Parking Area,

the name in which the business is carried on; and

(c) the date of issue of the permit and its date of expiry.

Duplicate Permits

24. (1) If a resident’s parking permit has been lost or destroyed, the person to whom it was issued shall

forthwith notify the Council, and the Council if it is satisfied that the permit has been lost or

destroyed shall, on payment of a sum of £10 for administrative expenses, issue a replacement

marked “Duplicate”.

(2) If a permit which has been lost and replaced is subsequently recovered by the person to whom the

replacement was issued he shall forthwith return the replacement to the Council.

(3) If a permit becomes defaced or illegible, the person to whom it was issued shall return it to the

Council and on such return the Council shall issue a replacement marked “Duplicate”.

(4) A permit marked “Duplicate” shall have the same effect as the permit which is duplicates would

have had.

Revocation of Permits

25. The Council may revoke a resident’s parking permit if it is satisfied that the person to whom it was

issued is no longer normally resident in the Permitted Parking Area mentioned in Article 4.

Surrender of Permits

26.(1) A person to whom a permit was issued shall surrender it to the Council immediately after it has

expired or been revoked.

(2) A person to whom a permit was issued may surrender it to the Council at any time.
