Well the 20 th anniversary fall confer- ence is just around the corner and it looks like the planners have done a very nice job. I look forward to the tour of the Capital Building, Kansas Judicial Cen- ter and the Docking Building-Driver control. Karen Kuffler and I went to driver control a few years ago and it was quite an eye opener, knowing how many of us that there are sending in information and how few of them to input all the work that needs to be done. The slide show at the reception on Thursday eve- ning sounds like a lot of fun. All those old hairdos and clothes are always good for a laugh. Oh the wonderful styles that we have worn over the years and now seeing young people wearing halter tops and low cut pants. Well as my term as President comes to a close after 2 years I would like to take the time to thank everyone. To all of those who have answered questions, helped to find things, or just gave advice, I would like to say thank you all very much. It has been a learning experience and I have truly enjoyed my time as President. It has been very trying at times, but I made it through with the help of my friends (members) that I have made thru the years. Again thanks to all and I look forward to seeing everyone at the fall conference in September. Good Morning Everyone, Kansas with all of its heat and humidity is just not my favorite place to be in the summer. Just finished up court for this week and it was a strange day. Of course we are just at the end of a full moon, so even the Judge noticed the way people were acting. Everyone just seems to be on edge, the prosecution clerk had several people make her nervous today. I have read reports that say it doesn�t affect people, but as an ex dispatcher for the Police Department I can tell you that the moon does affect people. We had more domestic prob-lems, fights and the heat doesn�t help either. Well enough about the moon. I hope everyone is having a nice summer. Well the 20th anniversary fall confer-ence is just around the corner and it looks like the planners have done a very nice job. I look forward to the tour of the Capital Building, Kansas Judicial Cen-ter and the Docking Building-Driver control. KACM HISTORY By Carla Rains Thank you Bettina for asking for a story. I really can brag on our Association. The History is that I was the first president to serve two terms. Everyone was patient; thank you for allowing me take my turn. Two terms is a good idea because the 1st year, for anyone, involves so much research, trying to imitate the good work done before and the 2nd year is learning from mistakes the 1st year. Telling about my growing, learning process, after my 1st year's conference, we set into print the steps for assuring a smooth conference. Actually, both of my terms were a learning process. We all worked extremely hard to maintain an association that dotted all the i's and crossed the t's because we were so new and growing so fast. We struggled to earn a respected, accredited status of integrity. I don't know of any other group that has closer bonds of friendship and respect for each other. I'm proud to say this Association has the best to offer in training and coaching for our job. And, an ideal opportunity to meet and make many really dear friends and share many funny and some tender-sad memories - indeed the best part of any job a person could have.

By Greg Nickel A number of significant bills were signed into law during this past session. Below is an abbreviated overview of the legislation, the actual language in the bills should be re-viewed when making policy and procedure decisions. My extreme gratitude goes out to Judge Arnold-Burger and �The Verdict,� which is the KMJA�s newsletter. Sig-nificant portions of this legislative update came from their publication, which has been sometimes quoted directly, sometimes loosely � in either case, I am deeply grateful for their willingness to allow us to use their research for our benefit.

State Court Costs Increased by $10 K.S.A §12-4117 has been amended, effective on July 1, 2006, to increase the amount we are required to submit to the state for each municipal court case (except for non-moving traffic violations). This $10 increase raises the amount from $9 to $19. The state treasury department will be sending updated forms which reflect this change to each municipal court. Depending on the way in which court costs are established in your city, this change may require an amendment to city ordinance. Also, check with your Judge to clarify whether this is to be effective on cases with violation dates after July 1st, with filing dates after July 1st, or with appearance dates July 1st. (HB 2122)

90 days & $1500 Mandatory on 3rd DWS SB 431 amends K.S.A. 8-262 by increasing the penalty on any 3rd or subsequent DWS occurring after July 1, 2006. The fine must now be at least $1,500 and the convicted defendant must serve 90 days. House arrest is an available option after service of 48 hours. In light of the expensive jail cost and possible hesitation by prosecutor�s to pursue such a severe sentence, it will be interesting to watch this unfold. Will we see an increased number of amendments to DWS cases?

Juveniles with �No Insurance� Prosecutable

in Municipal Courts �No Insurance� has been added to the definition of �traffic offense,� thus giving municipal courts jurisdiction over juveniles who drive without insurance. (HB 2706)

Supreme Court Rules on Municipal

Jurisdiction Question over DUI (State v. Elliott, April 2006) This ruling has signifi-cant implications for Municipal Courts. The Summer 2006 edition of �The Verdict� includes a more exten-sive review of this decision which is worth reading, but here is a Reader�s Digest version of that decision: While it has always been clear that a 3rd or subse-quent DUI becomes a felony, and therefore lies out-side our jurisdiction, DUI convictions have frequently been honored as prosecuted in the municipal court, even if it later appears that there were at least two pri-ors and if the DUI charge as a municipal misde-meanor could have actually been prosecuted as a fel-ony. State v. Elliott changes this. If there were two or more priors, even if the court was not aware of them at the time, municipal courts lack the jurisdiction to prosecute and any such conviction becomes invalid and void. As court clerks, we need to be extremely conscientious about our DUI background investiga-tions. While it appears that any DUI prosecuted in error can be re-filed in district court so long as the statute of limitations has not run, we should exercise extreme caution if there is any reason to suspect 2 or more priors.

Leaving the Scene Enhanced to Felony* For accidents involving great bodily harm or death. (HB2748)

Headlights On When Wipers On* Headlights must be on whenever windshield wipers �are in continuous use as a result of rain, sleet or snow.� Officer�s are only allowed to give a warning for violations of this new provision. (HB 2748) New Crime - Trafficking In Counterfeit Drugs SB 51 makes trafficking in counterfeit drugs a crime. If the value is less than $500 it is a class A misdemeanor. Above $500 pushes it to a felony.

Marry In Kansas Those of us with children can now breath easy.

$1,000 Fine For Unlawful Hosting* HB 2916 increases the penalties for unlawful host-ing from a mandatory minimum $200 fine to a man-datory minimum $1,000 fine. Indigent Defense Compensation Raised from

$50 To $80 Per Hour HB 2129, amending K.S.A. 22-4507, appears to per-tain directly to District Courts, but this may have significant implications for those municipal courts which base their public defender fees on those rates. Also, attorneys are frequently on public defender lists for both district and municipal courts and this bill may influence their expectations for compensa-tion from us.

Open Container Law Changed* SB 297 amends K.S.A. 8-1599 to accommodate mo-tor vehicles which do not have a trunk, allowing the transport of open containers �behind the last up-right seat or in an area not normally occupied by the driver or a passenger�

Enhanced Victim Rights K.S.A. 22-3436 now requires that victims shall be informed before dismissing or declining to prose-cute, entering into plea agreements, or conducting any hearings. Of the offenses handled by municipal courts, changes made by HB 2576 will relate most frequently to battery cases, but prosecutor�s offices should review their victim notification procedures light of this amendment.

As a result of this change by SB 366, certain crimes which previously rose to the level of felony are now misdemeanors and could potentially be prosecuted in municipal courts. Worthless Checks and Criminal Damage to Property are among these. �The Verdict� reports 20 such changes, which are as follows:

16-305 Misappropriation of funds - 19-3519 Fraudulent claims to water district- 21-3437 Mistreatment of dependent adult - 21-3707 Worthless check 6.16 21-3720 Criminal Damage to Property 6.6 21-3729 Criminal use of financial card 6.17 21-3734 Impairing a security interest - 21-3763 Counterfeiting - 21-3846 False claim for Medicaid - 21-3902 Official misconduct - 21-3904 False claim to public officer - 21-3905 False claim to the government - 21-4111 Criminal desecration 9.8 32-1005 Commercialization of wildlife - 39-717 Selling public assistance - 40-247 Broker�s misuse of premiums - 40-2,118 Fraudulent insurance acts - 40-5013 Violating contract settlement law - 44-5,125 Violating worker�s comp law - 47-1827 Damaging an animal facility -

*This change may require city governments to amend there adopted STO or UPOC to ensure legitimate prosecution.

RETIREMENT ANNOUNCEMENT Glenda Herring, Court Administrator for the City of Prairie Village, has announced her retirement effec-tive August 31, 2006. Glenda worked for the Over-land Park Municipal Court for eleven years before coming to Prairie Village where she has served 16 years, the last five as Court Administrator. Glenda has been a wonderful supervisor and will be greatly missed by her court staff. And we'll definitely bring her with us to the conferences! We love you and wish you the best Glenda!

KANSAS ASSOCIATION FOR COURT MANAGEMENT Scholarship Application for Fall KACM Conference

Regular membership shall be open to any appointed Court Clerk/Court Administrator or any municipal Court in

the State of Kansas. Any Assistant Court Clerk/Assistant Court Administrator or any person serving in a management position in any Municipal Court in the State of Kansas shall be eligible for regular membership in the

corporation.

The Kansas Association of Court Management offers new clerk orientation (those new clerks who have been ap-pointed within the last two years). The orientation is a basic course geared toward new clerks.

(Municipal Court Clerks attending the Municipal Court Clerks� Conference in the spring will be reimbursed di-

rectly to the Court Clerk (one clerk per city) by the Supreme Court. These reimbursements include mileage, lodg-ing, and meals served at the Conference.) This application is not for the Spring Conference, but for the Fall

Conference.

This scholarship is being offered to Court Clerks who have never been able to attend a KACM conference before. If your application is accepted, then KACM will waive registration fees, pay for the motel room and possibly

mileage.

Scholarship Silent Auction The Polly Mains Memorial Scholarship was awarded for the first time in September 2000 to a KACM member. The Scholarship was created with the intention of providing financial assistance to clerks whose city cannot afford to send them. The Scholarship pays for the clerks lodging and sometimes reimbursement for gas to and from the conference. The registration fee is also waived. Nine scholarships have been awarded since then. To fund the scholarship a Silent Auction is held at the Fall Conference with donated items from KACM members and sometimes from their court or city. There are usually a variety of items brought for the auction. For example, handmade items, crocheted/knitted blankets, wraps, doilies, cross-stitched pictures; candles; baskets with goodies from the respective city; tickets to sporting events, plays, concerts; craft items; cookbooks; floral arrangements; quilts; music CD�s; knick-knacks; the possibilities are endless. The Scholarship Committee encourages you to create, buy, build or request donated items to bring for the Silent Auction. Just bring them to the Fall Conference and we�ll set up on Thursday morning. The Auction is open all day during the conference Thursday. The winners will be announced either Thursday evening or Friday morning and asked to pick up their items and pay for them before leaving the conference. MINUTES AND TREASURER REPORT The minutes from the board meeting of April 6, 2006 at Holiday Inn in Salina were presented as printed in the newsletter. Bet-tina Jamerson (Prairie Village) made a motion to accept the board minutes. Theresa Durler (Dodge City) seconded. Motion carried. Education � Bettina Jamerson (Prairie Village) � Discussion was held on the Fall conference and the events taking place. Speakers are in place as well as tours and the reception for the 20th anniversary.

Hospitality � Janet Reimer (Wellington) � It was brought to the boards� attention that at the Spring Conference a mem-

ber under 21 was in possession of alcohol. Discussion was held on how the association should deal with any member who is under 21 in possession of alcohol. Ideas mentioned were having everyone checked for age, posting a sign of NO CONSUMP-TION if under 21, or eliminating alcohol. This situation puts KACM in an unfavorable light. The committee will pick a theme for the hospitality room and post signs on the door in reference to no consumption if under 21.

Legislative � Greg Nickel (Newton) - There is a lot of information that will be in the newsletter concerning the in-

crease in court cost, DUI, DWS, and electronic submissions.

Membership � Rod Edmondson (Baxter Springs) � The renewals have been coming in steadily with 259 and 20 new members. A new list will be ready for the Fall conference. Discussion was held on the region map for KACM to be used by the Ambassador committee. It was decided to use the judges� map using the same regions. Newsletter � Cindy McRae (Leoti) � Deadline for the newsletter is July 10th. She feels the electronic newsletters are being well received.

Promotion/Sales � Karen Kuffler (Parsons) Ideas were presented on the give aways for the Fall conference. The commit-tee can spend $1000 on promotional items. $1,009 profit from the Spring conference was reported, dividing it as follows: $150 for scholarships and $809 in the general fund. Gift bags will be purchased to put all of the 20th anniversary items in for the conference.

Scholarship � Candy Westhoff (Girard) � Two scholarship applications have been received for the Fall conference. There is a balance of $1312.00. Discussion was held on the silent auction about the need for items from the members and where the items will be kept during the conference as not to be moving them from room to room. A motion was made by Bettina Jamer-son (Prairie Village) that the scholarship recipients to be given a one (1) year membership at no cost with the approval of their ap-plication. NEW BUSINESS

Discussion on the KADR�s and the 10 print cards was held. There needs to be a 10 print card sent to the KBI for their records. The police department/detention center or the court needs to do them for the KBI. If the police department/detention center does the 10 print card, then the court will need to send in the KADR and it doesn�t have to have prints on it. If the court does the 10 print card, then the disposition can go on that card before it is submitted to the KBI. No KADR is necessary then. The membership renewals and new memberships need to be sent to Kristi Orbin, who is the treasurer. Discussion on the possibility of doing renewals via email was held and thought a good idea for Rod Edmondson (Baxter Springs) to investigate.

HELPFUL INFORMATION REGARDING THE CONFERENCE

PLEASE READ BEFORE FINALIZING YOUR REGISTRATION

KACM will be celebrating a milestone at this year�s fall conference - our 20th Anniversary! Some exciting events are scheduled for the conference agenda which include a tour on Thursday afternoon of sites in our State Capitol of Topeka that play a vital role in our profession as court clerks and in our state government. Trolleys will be provided from the Capitol Plaza Hotel on Thursday, September 14 to our tour sites. Please wear comfortable walking shoes and be ready at 12:30 p.m. sharp to board the trolleys. The trolleys will drop you off at your initial tour stop at the Kansas Judicial Center, the State Capitol or the Docking Building which houses the DMV. These three buildings are located within walking distance of each other at the corner of 10th St and SW Harrison. Your first tour begins at 1:00 p.m. When you have completed your first tour, you will walk to your next tour location to begin your 2:00 p.m. tour. When finished, please walk to your last tour which begins at 3:00 p.m. The tour of each building will last approximately 40-45 minutes. At the conclusion of all the tours, we will meet at the Legacy of Justice Foundation which is housed in an old fire house directly behind the State Capitol. You will be walking from your final tour location to the fire house. The KACM reception and 20th Anniversary celebration will be held at the old fire house beginning at 4:00 p.m. with beverages (tea and soda, part host & part cash bar), then a catered appetizer buffet. You can either make a meal of the appetizers or save room for a dinner out on your own after the reception. KACM members will share history tidbits, acknowledge members in our association, and mostly just celebrate us! Beginning at 5:30, a trolley will be available to return attendees to the Capitol Plaza Hotel. The trolley will shuttle between the hotel and fire house so you can board whenever you are ready to return to the Capitol Plaza. The last shuttle will leave the fire house at 7:30 p.m. We understand that this amount of walking may be difficult for some. So if you are in need of transportation between the tour sites, please indicate this on your registration form so that appropriate arrangements may be made. Come ready to celebrate 20 years of KACM!

VICE PRESIDENT 1. Chairman of KACM Education committee and plan the conferences. 2. Perform duties as requested by the Board or President. SECRETARY 1. Take minutes of all business and board of directors meetings and transcript them

within 45 days with a roster of attendees, then forward them to the Newsletter chairperson for publication.

2. Advise the President of all official correspondence received and addressed to KACM. 3. Prepare and send all correspondence in behalf of the President and Board of Directors. TREASURER 1. Deposit funds to a board approved bank. 2. Reimbursements and bills are to be handled in a timely manner. 3. Prepare and submit a State report for KACM. Obtain on the Internet. 3. Prepare financial reports for board meetings. 4. Prepare an annual financial report for the packets at the Fall conference. 5. Work in cooperation with the membership chairperson by reporting any new, retired,
