History in tHe makingWanaka Retirement Village is the first such development in the popular lakeside town.

The amount of interest shown by those wanting to be among the village’s first residents has been extremely high, and Presbyterian Support Otago, as the developer, is pleased to be able to offer this $8.5 million complex to satisfy obvious needs.

The site, adjacent to Elmslie House Rest Home and Hospital, is just a flat walk to town, close to the bowling, croquet and tennis clubs, plus the foreshore and lake walkway.

oCCupation rigHt agreement - expLainedAn Occupation Right Agreement (ORA) is a legal document that gives a person the right to occupy a residential unit in a retirement village.

It sets out the relevant terms and conditions in compliance with the provisions of the Retirement Villages Act 2003 and the Retirement Villages (General) Regulations 2006.

The agreement also contains the village Code of Residents’ Rights and the Village Rules.

WHat issues does tHe agreement HaVe to deaL WitH?

The ORA covers:the management of the village ȍ

the nature of the resident’s right to occupy ȍthe unit or apartment

the charges relating to the village and to the ȍuse of its services and facilities

the operator’s obligation to run the village ȍproperly

the resident’s rights to be given key financial ȍdocuments and other relevant information

safety, personal security, fire protection and ȍemergency management

the transfer of residents within the village ȍ

meetings of residents with the operator ȍ

maintenance and upgrading ȍ

termination of the agreement by a resident or ȍthe operator

a complaints facility and a disputes procedure ȍ

the consultation process about any proposed ȍchanges to the services or benefits provided or to charges that could affect residents’ ability to pay for them

the requirement that residents have their ȍrights respected, and to be treated with courtesy

the Code of Residents Rights and Rules of the ȍvillage

Where the village or unit hasn’t been built

If the village, apartment or unit is not yet completed when the ORA is signed, it must state the proposed completion date.

Cancellation for delay

The buyer can cancel the ORA if the unit is not finished to the point of practical completion within six months of the proposed completion date. They can do this any time after the six-month period has expired. They must then be refunded their deposit with interest and all progress payments made for the Occupation Right Agreement.

Who is a “resident”?

A resident is:anyone who enters into an ORA with a ȍretirement village operator

anyone who is entitled under an agreement ȍto live in an apartment or unit in the village (even if the agreement wasn’t made with that person)

a spouse or partner who is living in a unit ȍwith someone who’s entitled under an agreement to live there, or who is living in it after that person has died or left the village (as long as the agreement or the operator allows it)

All these people have the rights given to residents by the Retirement Villages Act 2003 and the Code of Practice 2008. For example, they have all the rights set out in the Code of Residents’ Rights, and they can use the village’s complaints procedure.

A “cooling-off” period after the agreement is signed

After new residents have signed an ORA, they have 15 working days in which they can change their mind and cancel the agreement without giving any reason. The cancellation must be notified in writing.

Once cancelled, the person will, on request, be refunded their deposit and all progress payments plus interest, within 10 working days after the request.

Getting independent legal advice before the agreement is signed

Intending residents must receive independent legal advice before they sign an occupation right agreement.

The resident’s lawyer must explain the general effect of the agreement and its implications, before the person signs it - in a way that is appropriate to their age and understanding.

The lawyer must then witness the person’s signature and certify that they have explained the general effects and limitations of the Agreement. If in some substantial way any of these requirements are not met, a resident can void the agreement.

the services and facilities offered ȍ

the arrangements for maintenance and ȍrefurbishment

the costs of entering and leaving a retirement ȍvillage, as well as the costs while living there and what you can expect to get back after you leave

the financial statements ȍ

The Occupation Right Agreement

This written agreement gives you the right to occupy a unit or apartment and is summarised in this brochure.

The Code of Residents’ Rights

The Code of Residents’ Rights is a summary of your basic statutory rights as a resident. It includes some obligations, contact details for the village manager and details of other people you might need to contact if you want information about your rights or to make a complaint.

The Code of Practice 2008

The Code of Practice sets the minimum requirements for the operation of the retirement village and protection of the residents.

Basic rights of residents

This is a summary of the basic rights given to you by the Retirement Villages Act 2003.

Services and other benefits

You have the right to services and other 1. benefits promised to you in your occupation right agreement.

Information

You have the right to information relating to 2. any matters affecting, or likely to affect, the terms or conditions of your residency.

Consultation

You have the right to be consulted by the 3. operator about any proposed changes in the services and benefits provided or the charges that you pay that will or might have a material impact on your: (a) occupancy; or (b) ability to pay for the services and benefits provided.

Right to complain

You have the right to complain to the 4. operator and to receive a response within a reasonable time.

Disputes

You have the right to a speedy and efficient 5. process for resolving disputes between you and the operator or between you and other residents of the village.

Use of support person or representative

You have the right, in your dealings with the 6. operator or other residents of the village, to involve a support person or a person to represent you. The cost of involving a support person or person to represent you must be met by you.

Right to be treated with courtesy and have rights respected

You have the right to be treated with courtesy 7. and have your rights respected by the operator,

the people who work at the village, and the people who provide services at the village.

Right not to be exploited

You have the right not to be exploited by the 8. operator, the people who work at the village, and the people who provide services at the village.

Your obligations to others

Your rights exist alongside the rights of other residents and the rights of the operator, the people who work at the village, and the people who provide services at the village. In the same way that these people are expected to respect your rights, it is expected that you in return will respect their rights and treat then with courtesy.

purCHase priCesThe starting price of purchasing an Occupation Right Agreement for the right to live at Wanaka Retirement Village is:

One-bedroom apartment ORA $300,000

Two-bedroom apartment ORA $375,000

Two-bedroom villa ORA $450,000

LeaVing Wanaka retirement ViLLageThe Occupation Right Agreement provides you with security of tenure although ownership of the villa or apartment remains with Presbyterian Support Otago.

When you terminate your ORA, a new Agreement for your home is then sold on the open market to a new resident.

You will receive the sale price less the Village Contribution, which is based on the time you have lived at Wanaka Retirement Village, any money due and any costs incurred in finding a new resident.

This contribution is 5% of the sale price of the new ORA (accrued on entry when you became a resident) plus 5% for up to four years (adjusted proportionately for part years) that you have lived in Wanaka Retirement Village, to a maximum of 25%.

Legal and other costs associated with selling your apartment/villa will be your responsibility.
