York, by' virtue of the power vested in them by law, will offer for sale at public auction on

WEDNESDAY, OCTOBER 18, 1944 at 11.30 a. tn., at Room 1030 Municipal Build-ing, Manhattan, N. Y. 7, the following described property:

All that certain lot, piece or parcel of land, with the buildings and improvements thereon situate, lying and being in the Borough of Brooklyn, County of Kings, City and State of New York, described as follows: Section 15, Block 4766, Lot 21, on the Tax Map of The City of New York for the Borough of Brooklyn as the said Tax Map was on March 22, 1933.

Notice to Taxpayers

PURSUANT TO THE PROVISIONS OF Section 172 of the New York City Charter,

notice is hereby given that the assessment rolls of real estate of The City of New York for the fiscal year commencing July 1, 1944, and ending on the 30th day of June, 1945, have been delivered to me as Treasurer of The City of New York and that the assessment rolls, together with the proper war-rants authorizing and requiring the Treasurer to collect the several sums therein mentioned accord-ing to law, have been filed in the respective bor-ough offices of the City Collector and all taxes on the said assessment rolls shall be due and payable at the office of the City Collector in the respective boroughs as follows:

All taxes upon real estate for the fiscal year beginning July 1, 1944, shall be due and payable in two equal installments, the first of which shall be due and payable on the 1st day of October, 1944, and the second of which shall be due and payable on the 1st day of April, 1945. Whenever, however, any property is acquired by the City in condemnation proceedings, the proportionate share of the amount of the tax on such property which would be due and payable on the next succeeding installment date, shall be due and payable on the date when the title to such property vests in the City.

All taxes shall be and become liens on the real

estate affected thereby and shall be construed as and deemed to be charged thereon on the respec-tive days when they become due and payable, and not earlier, and shall remain such liens until paid.

Any installment of taxes on real estate, which is due and payable on any date subsequent to the date upon which the first installment becomes due and payable, may be paid on the date when the first installment becomes due and payable or at any time thereafter, provided all prior installments shall have been paid or shall be paid at the same time; and on such payment of such subsequent install-ment prior to the the date upon which it becomes due and payable, a discount shall be allowed from the date of payment to the date when such in-stallment would otherwise be due and payable at the rate of 2 per centum per annum.

Plan of a Project for the redevelopment by clearance, rebuilding, reconstruction and rehabilita-tion of the area bounded by East 135th street, 5th avenue, East 138th street, and Harlem River, Borough of Manhattan, which Plan bears the pre-liminary approval of the Superintendent of Insur-ance of the State of New York and is submitted by the Riverton Redevelopment Corporation pur-suant to the provisions of Chapter 234 of the Laws of 1943 (CP-3398-September 20, 1944-Cal. Description of Proposed Plan Within the area derribed above it is proposed

to close East 136th and East 137th streets between 5th and Madison avenues, and between Madison avenue and Harlem River drive, as well as a por-tion of the east side of Madison a renue mately 35 feet wide, running tura from the south side of East 136th street. In exchange for the strip of land now constituting a portion of Madison avenue and those portions of East 136th and East 137th streets to be conveyed by the City for housing, there will be conveyed to the City for street purposes four strips of land containing in the aggregate approximately 32,100 sq. ft., being a stripapproximately 20 feet wide immediately south of East 138th street and running from 5th avenue to Madison avenue, two strips approxi-mately 30 feet wide immediately west of Madison avenue, one running from East 137th street to East 138th street and the other from East 136th street to East 137th street, and a strip approxi-mately 65 feet wide immediately west of Madison avenue and running from East 135th street to East 136th street. It is proposed that approximately 127,792 sq. ft. along Harlem River will be sold to the City for Harlem River drive. Madison avenue will traverse the area. No other through streets are contemplated.

Under this proposal the total private property to be acquired is approximately 426,244 sq. ft.; the area of streets to be closed and transferre4 for housing is approximately 65,945 sq. ft.; the area to be transferred to the City for street purposes is approximately 32,100 sq. ft.; the area to be sold to the City for Harlem River drive is ap-proximately 127,792 sq. ft.; and the net area of the site to be used for housing is approximately 332,297 sq. ft. or 7.6 acres. The gross area (al-lowing 50 feet around each of the two portions of the area lying respectively east and west of Madison avenue, all streets being 100 to 175 feet in width) is estimated at approximately 534,172 sq. ft. or 12.26 acres.

The application states that, if the number of rooms were to be the minimum of 4,020, the population provided for would be approximately 411 persons per acre of housing area. If the maximum number of rooms were to be constructed, the population provided for would be 479 persons per acre. Based on gross area, the population provided for would be: minimum 256 per gross acre, and maximum 298 per gross acre.

On the basis of net area, the coverage would be: minimum 22.5 per cent and maximum 26.4 per cent. On the basis of gross area, the cover-age would be: minimum 14.1 per cent and maxi• mum 16.4 per cent.

No business, commercial or garage facilities are contemplated within the area. The free land area, approximately 5 acres, will be devoted to parks, paths and playgrounds for small children.

NOTICE IS HEREBY GIVEN TO ALL parties interested in the above entitled proceed-

ing as follows: First—That the above named Court, after con-

sidering the testimony and proofs submitted on the trial of the above entitled proceeding, has completed its estimate of the compensation which should be made by The City of New York to the respective owners of the real property i be acquired in this proceeding, and the Third Partial and Separate Tentative Decree of the said Court as to the awards for damages was signed oa the 14th day of September, 1944, by Hon. Charles C. Lockwood, Justice of the Supreme Court presid-ing at the trial of the above entitled proceeding, and was filed with the Clerk of the County of Queens, on the 14th. day of September, 1944, for the inspection of whomsoever it may concern.

Second—That The City of New York, and all other parties interested in such proceding or in any of the real property affected thereby, having any objections thereto, shall file such objections, in writing, duly verified, in the manner required by law for the verification of pleadings in an action, setting forth the real property owned by the objector and his post office address, with the Clerk of the County of Queens, on or before the 6th day of October, 1944, and parties other than The City of New York, shall within the same time serve on the Corporation Counsel of The City of New York, at his office, Municipal Building, Room 1559, in the Borough of Manhattan, City of New York, a copy of such verified objections.

REGULATIONS =Ann 'TO CONTRACTS

11. Advertisements, proposals and bids. (a) Bids for contracts shall be solicited by public

advertisement in at least 10 successive issues of TES Ctrl Bacon. All advertisements soliciting bids for contracts shall be approved by the Corporation Counsel before publication. Bids shall be publicly opened on the day of the last insertion of the advertisement.

(b) Except with the approval of the Corporation Counsel, the advertisement shall include only:

1: The place where the proposals may be ob-tained;

2. The place where and the day and hour when the bids will be publicly opened;

3. A brief description of the supplies, materials and equipment to be furnished and of the work or labor to be done.

(c) Proposals for bids shall be in such form as may be presciibed by the agency issuing the same and shall state:

1. That the person making the bid shall deliver it in a sealed envelope, addressed to the head of the appropriate agency, on or before the time and at the place designated in the advertisement;

2. That the sealed envelope shall be endorsed with the name or names of the person or persons presenting the same, the date of its 'presentation and the title of the proposal;

3. The place where and the day and hour when the bids will be publicly opened;

4. The quantity and quality of the supplies, materials and equipment to be furnished and the nature and extent of the work or labor to be done;

5. That every bid shall be accompanied by a deposit in approximately the sum of two percentum of the amount of such bid; except that in the cue of a proposal for a single item or class of items, the deposit shall be approximately two percentum of the contracting agency's estimated cost of the supplies, materials and equipment to be furnished and the work or labor to be done. Such deposit shall consist of a certified check upon a state or National bank or trust company or a check of such bank or trust company signed by a duly authorized ofseer thereof, drawn to the order of the Comp-troller, of money, or of the obligations of the City described in section 241 of the New York' City Charter, which the Compttoller shall approve as of equal value with the sum so required, except that the check submitted as security deposit with a bid for supplies, materials or equipment need not be certified;

6. That in the event of the failure of the bidder to execute the contract within five days after notice of the award.of the contract to him, his deposit of so much therec.i as shall be applicable to the amount of award made to him shall be retained by the City, and he shall be liable for and shall agree to pay on demand the difference between the price bid and the price for which lush contracts shall be Subse-quently relet, including the cost of such reletting and less the amount of such deposit. No plea of mistake in such accepted bid shall,be available to the bidder for the recovery of his deposit or as a defense to any action based upon such accepted bid;

7. That upon the execution of a contract for work or labor, in which provision has been made for paymenu by iostallments, the contractor may be required b deposit not less than approximate!' two percentum nor more than approximately five per. centum of the amount of the contract, until the amount of the retained percentages under the coo• tract shall equal the amount of the deposit. Such deposit shall consist of a certified check upon a State or National bank or trust company signed by a duly authorized officer thereof, drawn to the order of the Comptroller, of money, or of the obligations of the City described in section 241 of the New York City Charter, which the Comptroller shall approve as of equal value with the sum so required;

8. That each bid shall contain : (a) The name, residence and place of btisinep

of the person or persons making the same; (b) The names of all persons interested therein

and if no other person is so interested, inch fact shall be distinctly stated;

(c) A statement to the effect that it is made without any connection with any other person making a bid for the same purpose, and is in all respects fair and without collusion or fraud;

(d) A statement that no Councilman or other officer or employee or persons whose salary is payable in whole or in part from the City treasury

• is directly or indirectly interested therein, or in the supplies, materials- and equipment and work or labor to which it relates, or in any portion of the profits thereof. (d) The bid shall be verified by the written oath

of the bidder that the several matters stated therein are in all respects true.

(e) Each agency shall keep a proper receptacle for the receipt and safe-keeping of bids. Upon the receipt thereof, bids which are duly presented shall be deposited in such receptacle. No bids shall be removed therefrom nor shall the sealed envelope in which it is contained be opened, except as pro-vided in paragraph (0 of this section.

(1) The bids shall be opened and read publicly at the time and place designated in the advertise-ment, in the presence, of the Comptroller or his representative and of such of the bidders u may desire to be present. The opening of such bids shall not be postponed if the Comptroller, or his repre-sentative shall, after due notice, fail to attend.

(g) -This regulation shall be published in THR CITY Rune daily. All advertisements for bids by any one agency appearing in any one issue of THE CITY Ricotta shall be published in sequence by date of opening and shall,refer to this regulation as advertised in Tux Cyr: Recoil,. Such reference shall immediately follow the name of the agency.

9. Purchase orders in excess of one thousand dollars.

(a) Medical, surgical, dental, laboratory supplies and implements and food supplies involving an expenditure of more than one thousand dollars may be procured on purchase orders based on competi-tive bids received after advertisement in at least three successive issues of TE1 CITY Bacon).

(b) Rentals of equipment involving an expendi tore of more than one thousand dollars for other than snow removal purposes may be effected by the Department of Purchase on purchase orders based on competitive bids received after advertisement in at least ten successive issues of THE CITY RECORD. Rentals of equipment for snow removal purposes

all be effected in accordance with sections 755(3)-7.0 and 7R25-2.0 of the Administrative Cod.
