CONDOMINIUM LIVING

Condominium living is different than owning your own home. When you purchase a home, you are buying a house and the private property. You are free to do whatever you like within the confines of the law of the city in which you live. When you purchase a condominium, not only are you buying a piece of property, (the inside space of your unit), you are also buying a percentage of common space that is an integral part of the entire development. You own the inside of your unit as well as 1/94th of all buildings and other common areas. No one exclusively owns the roof of the building they occupy or exclusively owns the patio area or driveway that they use each day. There are two types of common areas: common elements and limited common elements. Common elements are flowerbeds, grassy areas, sidewalks, building exteriors, roofs, fences, and sprinklers, to name a few. Limited common elements are those items that are exclusively used by one unit. They include driveways, patios, and porches. All common and limited common elements fall under the control and supervision of the Board of Administrators (Board). The Board, on behalf of the Council of Co-owners (COC), is responsible for and performs the maintenance and modification to these areas for the benefit of all owners. This requires that each owner requesting such maintenance or modification must receive approval before work is done.

GENERAL INFORMATION

1. Cable Television/Internet

Under the current contract, Cox Cable is your service provider.

All owners will be billed by the Board for basic cable and internet services. You must contact the Property Manager to fill out the required form for installation of services.

2. Mail

Advise your current post office to forward your mail to your new address.

The address for all condominiums (units) must include 2100 West New Hope Road plus your Villa Number; i.e., Villa 101, Rogers, AR 72758.

3. Insurance

The Council of Co-owners’ insurance policy covers the structures of the buildings, the common areas and liability for any injuries that occur in the common areas.

The owner’s condominium policy (not renter’s insurance policy) should cover his or her personal property and liability for any injuries that occur inside his or her unit.

4. Condominium Fees

The Board of Administrators of The Arbors at Pinnacle Ridge Horizontal Property Regime determines condominium fees each year, based on the current budget and projected projects and services.

You will be billed quarterly by the Property Management Company. Other billing arrangements must be approved by the Board.

5. One (1) Year Warranty

The Council of Co-owners is not responsible for any repairs to the interior or exterior of any condominium for the first year of ownership when sold by the developer or developer’s receiver.

6. Plumbing

b. Please take a moment to confirm this valve works properly prior to an emergency.

Condominium water main – for your unit only c. Valve is located in the black box near the city water meter for

your building in the lawn area. d. Please take a moment to confirm this valve works properly prior

to an emergency.

Home Plumbing Fixtures – for your unit only e. Individual shutoff valves are adjacent to each fixture in case a

repair is needed to that particular fixture.

ALWAYS REMOVE HOSES FROM HOSE BIBS LOCATED IN THE GARAGE DURING FREEZING CONDITIONS.

7. Fireplace

Operation of the fireplace flame will be through the wall switch located adjacent to your fireplace.

To turn on the flame, simply turn the wall switch on.

To turn off the flame, turn the wall switch off.

If the pilot light goes out, the valve has an automatic shutoff function that should shut off all gas to the fireplace.

If you wish to turn off the gas for an extended period of time, there is a manual gas shutoff located adjacent to or under the fireplace.

To ensure your fireplace will operate in the event of a power failure, here is a step by step checklist:

a. Lift the black grille at the bottom and remove. The battery holder is resting on the right side of the bottom of the fireplace. It is fastened down with Velcro; just lift to remove if needed. A flashlight will help!

b. The battery holder is connected to the fireplace by two small wires.

(1). If both wires are connected, and the holder has no batteries in it. Install two fresh D batteries (standard full-size flashlight size). (2). If both wires are connected, and the holder has two batteries installed, they are likely dead and may exhibit white corrosion about them. Clean the holder (baking soda helps) and install two fresh D batteries. (3). If one or both of the wires are disconnected, plug them into the nearby similar wires, red to red and black to black. Install two fresh D batteries.

To keep the batteries fresh, remove them from the holder when use is not anticipated. They will discharge when operating on regular power.

NEVER BURN ANTHING IN YOUR FIREPLACE OTHER THAN GAS LOGS.

8. Overhead/Garage Door

Insulated garage doors are not weatherproof, and entrance of air, dust, rain, snow, and light should be expected. Sweeping out any water or snow in the winter will keep the door from freezing shut. The moving parts of the garage doors should be lubricated every six (6) months and the cables should be checked for fraying. The screws connecting the hinges to the door should also be checked and tightened as necessary.

Owners are encouraged to keep their garage doors closed when not in use.

9. Changes to the Outside of my Condominium

Per the Bylaws, no change may be made to the exterior building structure or the common area surrounding your condominium without the prior written approval of the Board of Administrators.

10. Observation of Damaged Items in the Common Area

Report any damage to the Property Manager.

11. New Homeowner Information Sheet

All new owners must complete the attached form and return it to the Property Manager.

12. Architectural Control Committee Approved Changes There are preapproved specifications for storm doors, awnings, wrought iron gates, patio fence extensions, solar walkway lighting, and solar tubes, which you may add to your home after the execution of an authorization form received from the Property Manager. Requests for extension of patio fence depths must also be presented to the Committee for consideration on a case by case basis after execution of an authorization form received from the Property Manager.

Any other items will be considered by the Committee after an author-ization form is executed and submitted for consideration. The Com-mittee recommendation will be forwarded to the Board for final action.

WORK CANNOT COMMENCE on any request until the authorization form is completed, approved, signed, and provided to the Property Manager.

Any other items will be considered by the Architectural Control Committee after an authorization form is executed and submitted to the Committee for consideration with recommendation forwarded to the Board for final action.

13. Renting of Condominiums

Per the Bylaws, the maximum number of rental units allowed at any time is ten percent (10%) of the 94 units comprising The Arbors at Pinnacle Ridge. Units are considered to be rentals if anyone other than the owner lives there, with the exception of parents or children of the owner living in the unit rent free.

In the event of the death of an owner, representative(s) of the estate must contact the Board to discuss options available to the beneficiaries of the estate.

If you would like to rent your unit, you must contact the Property Manager to complete an authorization form to forward to the Board for approval to have your name added to the Rental Condominium Waiting List.

14. Personal Property

All personal property, such as lawn chairs, bicycles, tables, etc., must be kept inside the patio or porch area or in the garage. Personal prop- erty maintained within the patio area may not be visible above the patio fence, with the exception of patio tables, umbrellas, chairs, and

barbeque grills.

Nothing may be hung or displayed, nor may signs, shutters, antennae, satellite dishes or any other device or ornament be affixed to or placed upon the exterior walls, doors, fences or roof without prior written approval of the Board of Administrators through the execution of an authorization form.

15. Decorations

Holiday Decorations: Christmas lights and decorations are permitted to be placed inside the patio area and/or on building exteriors provided the decorations do not damage buildings, gutters or siding. Only wreaths may be placed on front doors. Decorations may not be displayed before Thanksgiving Day, and must be removed no later than January 7th of the following year.

16. Flags

The American Flag may be flown or displayed at any time following normal flag protocol. The following conditions apply if the flag is dis- played 24/7: the flag is lighted during hours of darkness; and the flag is not dishonored by fading, fraying, or tearing. The American Flag at the front of the Clubhouse may be flown at half-staff at the discretion of the Clubhouse Committee, as a sign of respect for the passing of a resident, former resident, employee, or other person of particular interest to residents. The flag shall remain at half-staff upon notifi- cation of the death, until the sunset following funeral or memorial services. When the flag is to be flown at half-staff, the request will be made to the Board.

Seasonal or holiday display of flags will be permitted one week before and one week after the holiday with the exception of Christmas, which can be displayed beginning Thanksgiving Day and must be removed no later than January 7th of the following year as stated in Item 15.

Personal display of sports-oriented flags, banners, etc. will only be permitted on the day of the sporting event.

17 .Landscape Flowers/Plants

Flowers/plants may be planted or grown in pots inside the patio fence. If no patio fence is present, only live plants contained in earth tone/natural colored pots may be maintained. Only flowers/plants which will not exceed the height of the patio fence shall be used.

Maintenance of the flowers/plants is the responsibility of the owner and dead flowers/plants are to be removed at the end of the season.

If the owner wants to plant items directly outside the patio fence in the existing mulched area, the owner must obtain an authorization form from the Property Manager for completion and forwarding to the Landscape Committee for recommendation to the Board for approval PRIOR TO PLANTING ANYTHING OUTSIDE THE PATIO AREA.

Flowers are not permitted to be planted around any tree.

Use of artificial flowers/plants also requires the owner to obtain an authorization form from the Property Manager for completion and forwarding to the Landscape Committee for recommendation to the Board for approval PRIOR TO DISPLAYING ARTIFICIAL PLANTS.

18. Prohibited Items

The following items will be strictly prohibited in any common area of the Community: any type of yard sign; statue; statuette; yard or lawn ornament; ornamental rocks or stones; cypress mulch; swing sets; mounted hose reels; laundry poles or clothes lines; or other such items. Laundry may not be hung over any patio fence (swimsuits, towels, rugs, etc… included).

19. Windows and Window Coverings

All window coverings, whether draperies, blinds (vertical or horizontal), or valances, must be white, off-white, light beige, or light gray on the exterior side.

20. Signs

“For Sale”: One 12 inch by 12 inch “For Sale” sign may be displayed from the inside window of the unit being sold.

“Open House” signs must be posted within the patio area of the unit being sold, one at the New Hope Road entrance and one at the 21st Street entrance.

Professional security system decals are permitted.

No real estate or rental signs are permitted in any common area.

Any exception requests will be considered by the Architectural Control Committee after an authorization form is received from the Property Manager, executed, and submitted for consideration. The Committee recommendation will be forwarded to the Board for final action.

21. Pets

No more than two household domestic pets, not bred or maintained for commercial purposes, may be kept in any one home. Pets shall be limited to dogs and cats. Any other “pet” desired to be kept must be approved by the Board.

All pets, when outdoors, shall not be allowed to run at large within the condominium community but shall at all times be on a leash. Pet owners shall be responsible for the immediate cleanup of all pet litter.

22. Parking/Vehicles

No boats, trailers, motor homes, trucks (larger than a ¾ ton pickup), travel trailers, or any vehicle with commercial advertising may be parked on any street or driveway overnight. Other vehicles used for

recreation (van conversions/RVs) not able to fit in a garage, will be permitted to park in the limited common area (in front of the garage) for forty-eight (48) hours to allow for loading and unloading. Such vehicles must not block normal access of other residents. Commer-cial moving vans, when conducting contract business, and com-mercial trucks, when in the area to perform service or repair work, are an authorized exception.

Residents must park their first vehicle inside their garage. Garages may only be used for parking of vehicles and may not be used as part of the residence or for storage purposes such as would prevent parking of at least one vehicle.

All parking by residents or guests, must be: (a) Within the garage, (b) In the limited common area in front of the garage door, (c) In the parking spaces at the Clubhouse area, or (d) On the side of the driveway in such a manner so as not to block any other residents’ access to the garage or street. (e) PARKING IS PROHIBITED IN THE “TURN AROUND” AREAS AT THE END OF THE DRIVEWAY. (f) No vehicle may be parked in the Clubhouse parking areas for more than forty-eight (48) consecutive hours. Vehicles parked there for more than forty-eight (48) hours are subject to being towed upon decision by the Board of Administrators. (g) If a resident has a party, parking will be allowed along one side of the street only for a period of not more than six (6) hours.

Inoperable vehicles (with flat tires, expired license tags, etc..), or vehicles which cannot be identified as belonging to an owner and are parked in any common or limited common area for more than forty-eight (48) consecutive hours, may be towed off the premises at the vehicle owner’s expense. No repair work is permitted on vehicles in limited common or common areas except for short-term emergency work (flat tire, battery charge, etc.).

No vehicle shall be parked in any manner which blocks any street or driveway, or the ingress/egress to any garage other than the owner. The speed limit within the community is 15 mph. Reckless operation, excessive speed, parking or driving on the lawn areas is prohibited.

23. Swimming Pool

The pool is for the exclusive use of the residents and their guests. Any person who cannot be identified as a resident, or who is not accompanied by a resident, will be asked to leave the pool area.

The pool rules are:

(a) All persons using the pool and pool facilities do so at their own risk and sole responsibility. There is no lifeguard. (b) All children under the age of eighteen (18) must be accompanied by an adult resident.

(c) Guests are limited to three (3) per household, and must be accompanied by a resident at all times. Guests will be asked to leave if the resident is not present. (d) Pool passes may be required.

The following are prohibited in the pool area: Animals or pets Glass or other breakable items Running, diving or disruptive behavior Excessive noise, splashing or radios without headphones Private pool parties All rafts and body floats Electrical Devices

Swimming is permitted only in garments sold as swimwear. Infants must also wear swimsuits – no diapers are permitted in the water.

Lounge chairs or tables may not be reserved and must be repositioned in the order intended (orderly fashion), after use.

The pool will be open daily during swimming season until 10:00 p.m.

Wet swimwear is not permitted in the Clubhouse lounge area.

The gas grill is only allowed to be used for Arbors social functions.

24. Clubhouse Rental Policy

The Clubhouse is for the private use of the owners. It is available for rental to owners only for parties or meetings. Reservations are granted on a first request basis. The following policy applies:

a. $175.00 refundable deposit and a $25.00 rental fee (for a party of 1 to 20), or a $50.00 rental fee (for a party of 21 or more), payable in two separate checks, are required. b. Children and teenage parties are prohibited. c. The renting owner will have exclusive use of the party room

only; the guests may not use the pool or exercise equipment, and the pool may not be reserved for any party. No party items will be furnished by the Council of Co-owners.

d. The renting owner is responsible for all cleanup and trash removal. Cleanup must be done (completely) on the day of the party. e. Damages to the Clubhouse or equipment and any follow up cleaning done by the Council of Co-owners will be deducted from

the deposit. If the deposit is an insufficient amount, the renting owner will be billed for the difference.

25. Trash Collections

Trash collection regulations require that trash containers not be set out prior to 5:00 p.m. the day preceding collection and the containers must be picked up and put away by 9:00 p.m. the day of collection. During vacation time, residents are encouraged to ask their neighbors to police their trash containers. In the event that is not preferred, residents are to call the Property Manager to report their need for assistance in retrieving their containers. Only trash containers provided by the company contracted by the City of Rogers are permitted for trash disposal.

All trash for collection must be set out at the main street, next to the curb at the end of the driveway no closer than two feet around each container with the lid opening toward the street. Trash containers, when not set out for collection, must be kept inside the garage. Residents will be responsible for cleanup of trash spillage from the containers.

26. Outdoor Lighting for Security and Convenience

a. Objective: To provide a uniform policy of general lighting within The Arbors. b. To aid the COC in keeping cost of lighting within a reasonable range. c. The COC maintains on existing poles within The Arbors, 100-watt sodium vapor lamps, monthly cost to be paid by the COC. d. Should an owner of The Arbors request lighting other than referenced above, it should be made in writing to the COC Architectural Control Committee stating exactly why the request is being made and how the proposed light would be installed and the affect it would have on neighbors and The Arbors.

e. The Board would consider the recommendation from the Archi- tectural Control Committee at its next regularly scheduled meeting, based on laws and ordinances imposed on the utility to assist in reaching a decision. f. Residents are requested to leave outside lights on at night at the entrances to the garage and front door areas for additional security, convenience, and to help emergency responders locate units.

27. Solicitation and Garage Sales

Solicitation by commercial enterprises is not authorized within the community. In a like manner and due to restricted parking availability,

garage sales and tag sales are specifically prohibited, unless approved by the COC as a planned community activity.

28. Condominium Sales

Any owner who sells his or her condominium is responsible for: a. Making certain the Property Manager is aware of ownership changes at the time a closing date is established. b. Making certain all condominium dues are current. c. Making certain new owners receive the governing documents to include the Bylaws with Amendments, the Master Deed with Amendments, and the Policies and Procedures of The Arbors at Pinnacle Ridge Horizontal Property Regime.

29. Amendments

These Policies and Procedures may be subject to change from time to time at the discretion and by a majority vote of the Board of Administrators.

RESPONSIBILITIES OF THE

BOARD OF ADMINISTRATORS

1. Responsibilities of the Board of Administrators

Your Board of Administrators is made up of fellow condominium owners. The Board is comprised of five (5) members, each serving a three (3) year term.

The Board will ask for homeowners to volunteer to serve on committees such as, Architectural Control, Bylaws, Clubhouse and Pool, Directory, Landscaping, Newsletter, Orientation and Hospi-tality, and Social.

The Board is responsible for the EXTERIOR of all buildings as well as all driveways, streets, lawns, landscaping, lawn/street lighting, the entrance improvements, the clubhouse and pool.

The Board hires a property management company to manage the day to day operations of the community.

Basically, you control the INSIDE of your condominium.

The elected Board provides the leadership for the Council of Co-owners and will determine community policies and procedures.

It will monitor finances in accordance with The Arbors at Pinnacle Ridge Horizontal Property Regime Bylaws.

The Board is responsible for selecting contracted vendors as well as managing costs and services.

It is important to understand that the Board is made up of five volunteer homeowners from this community: President, Vice President, Secretary, Treasurer, and Parliamentarian. No one in the community is above the law. Each resident, be it homeowner or renter, shall abide by the rules and regulations set forth in these Policies and Guidelines and those in the Bylaws that the homeowners received at the time of purchase of their condominium. CLUBHOUSE AND POOL To: All Arbors Homeowners From: Arbors Clubhouse and Pool Committee Subject: The Latest News and Helpful Information Relating to Your Clubhouse – WE NEED YOUR HELP Our Clubhouse and Pool Committee was set up by the Council of Co- owners Board to take on part of the management/oversite duties. Our team does daily tours of Clubhouse property in order to troubleshoot any problems, make sure all doors remain locked at all times, and everything is in good working order. Since we are there at limited times of the day, your help as the second part of the management team when you are there will be vital in making sure our Clubhouse remains a beautiful facility in which we all can entertain and relax. Ultimately these two parts of the team operating well together will cut down on the cost of maintenance which will help all of us in keeping homeowner fees down. Since our Committee has been checking the Clubhouse, we have found the front door unlocked as well as some of the side doors. Strangers (nonresi- dents) have been found inside the Clubhouse. One person told a resident that someone had given him the code to the front door and that person did not live at the Arbors. In one incident a resident had to threaten to call the police to eject a very unwelcome visitor. With everyone’s help, these probl- ems can be minimized. How You Can Help: * Securing Doors - Make certain that the front door is locked and securely closed each time you leave by pushing the center button on the keypad. The door is opened by a code but is only locked upon leaving by the center button. If you are so inclined you can help by doing a quick check of other doors before you leave. * Maintaining the Privacy of the Front Door Code - keep the front door code private within your household. Please accompany your guests includ- ing family members not living in your home when they want to visit the center and pool area. It is too easy for someone outside the household to forget and

casually pass on a code and cause a growing chain of “floating” codes out in the community. In order to lessen the possibility that a member of your household who is not the primary homeowner is questioned by our committee or another resident as to their presence in the Clubhouse and their possession of the code, please have the Property Manager add them to the resident list. * Temperature Control - In the winter we keep the thermostat setting at 60 degrees when the facility is not in use. Summer and winter we will post the nonuse temperatures above the thermostats. ARBORS CLUBHOUSE RENTAL POLICY

Please carefully review our policies. The Arbors will not be held responsible for your unfamiliarity with our rental policies. If you have questions, please feel free to call us and we will be happy to clarify.

1. A separate deposit check of $175.00 made payable to The Arbors at Pinnacle Ridge with “Party Room Rental” designated in the memo area is required for all rentals. If the party consists of 1 to 20 people, a $25.00 rental fee check made payable to The Arbors at Pinnacle Ridge with “Party Room Rental” in the memo section is required. If the party consists of 21 or more people, one $25.00 rental fee check made payable to The Arbors at Pinnacle Ridge with “Party Room Rental’ in the memo section is required and one $25.00 rental fee check made payable to the Arbors Social Fund with “Party Room Rental” in the memo area is required. The deposit will be returned after the Clubhouse is found to be in the same condition as before rented. 2. Reservations may be made only by a homeowner and he/she MUST be present during the period it is reserved. 3. The renting homeowner will have exclusive use of the Party Room only; guests may not use the pool or exercise equipment. 4. The renting homeowner is responsible for all cleanup and trash removal. Trash must be taken from the premises for disposal. Cleanup must be done com- pletely the day of the party. All leftover food from the event must be removed from the premises. 5. Damages to the Arbors Clubhouse or equipment and any followup cleaning will be deducted from the deposit. If the deposit is an insufficient amount, the home-owner will be billed for the difference. 6. No party items will be furnished by the Council of Co-owners. Supplies must be furnished by the host/hostess. This includes all paper products (paper towels, trash bags, plastic utensils, etc.) and supplies needed for cleanup (dish soap, hand towels, etc.). The supplies in the closets belong to the Arbors Social Com- mittee for our community functions only. 7. The pool may not be reserved for any party. Private pool parties are prohibited.

8. Children’s and teenage parties are prohibited. 9. Rentals are not allowed past 12:00 midnight. 10. ALL DOORS MUST BE LOCKED AFTER THE RENTAL EVENT.

**POOL TABLE MUST NOT BE MOVED** If moved you will be charged a $170.00 rebalancing fee.
