P27. Off-the-job training is a statutory requirement for an English apprenticeship

P31. for off the job learning , planned duration of the apprenticeship for standards is until the gateway for end-point assessment

All OTJ training must take place during the planned duration of training for an apprenticeship i.e. before the gateway assessment

• ensure Tripartite reviews track and address any 20% OTJ shortfall early and quickly.

• Ensure commitment statement and other documents setting out apprenticeship journey/schedules confirm 20% must be reached before gateway

P32. NEW When calculating the amount of off-the-job training, the apprentice’s statutory leave entitlement should be deducted - pro-rata’dfor part time workers. FOR APPRENTICE STARTING AFTER 1st AUGUST

Employees who work a 5-day week receive at least 28 days paid annual holiday (this is the statutory leave entitlement -5.6 weeks of holiday and it incl bank Holidays).

• Collect apprentice working hours on the eligibility form and apprenticeship agreement. add in the OTJ20% calculation/ outcome in hours into this form

• Put this calculation / hours into the commitment statement, contract annex and into the apprentices eligibility and responsibilities or declarations– somewhere where it is subject to signature and is visible

• Ensure induction emphasises the collection and recording of off the job as an apprentice duty in addition to provider duty

P32 It should be clear to all parties how you have worked out the amount of off-the-job training required to comply with paragraph P31 and you must record this in the evidence pack.

You must spell out how many hours OTJ is required and how you reached this figure for both employer and apprentice

Apprenticeship Agreement, Commitment Statement

RULE para No. EXPLANATION ACTION TO CONSIDER

P40. The start date set out in the apprenticeship agreement must match the date in the commitment statement.

Details in the commitment statement must be completed before the apprenticeship agreement can be signed.

Evidence about start dates from multiple sources needs to contain the same dates

Make sure the20% calc is clear before the Apprenticeship Agreement is collated and signed

• Check that ILR sources ( whether SITS or other admissions systems, or on paper ) are collecting and using the same date –and that this is also replicated in contracts and other evidence

• Timing of documents and activities to populate them probably needs to be changed. Evidence pack does not require a signed Commitment Statement until just before the first daet in learning

P46 For standards, the apprentice must be employed until the end-point assessment is completed.

Apprenticeship Agreement, Commitment Statement

RULE para No. EXPLANATION ACTION TO CONSIDER

P50 The apprentice must work enough hours each week so that they can undertake sufficient regular training and on-the-job activity. This is to ensure the apprentice is likely to successfully complete their apprenticeship. You must keep evidence of the agreed average weekly hours, including time spent on off-the-job training, in the evidence pack.

? UNCLEAR?You need to confirm the working pattern of the apprentice so that you can evidence that the OTJ 20% calculation is ‘correctly calculated’.

NEEDS CLARIFICATION :Is it a) a one off explanation and evidence e.g. in an employment contract / apprenticeship agreement, or b) a requirement for evidence collected to prove hours worked and off the job for each week of the apprenticeship collected as convenient or c) as b) but collected weekly

• Add working pattern hours and the 20% calculation to the apprenticeship agreement template and the Commitment Statement

• Add this specific commitment to the employer declaration and apprentice declaration

• The Commitment Statement provides space to set out the specific schedule and hours expected in off the job learning at least at a monthly level.

• Always review OTJ at the Tri-partite review and take action to address shortfall

Apprenticeship Duration

P52. Where the apprentice temporarily works fewer than 30 hours a week you must extend the duration. You must work with the employer to make sure that the apprenticeship agreement is also extended.

The end date of the apprenticeship and the duration must be extended if the apprentice changes their working hours during the apprenticeship. You need to reflect this change in the Apprenticeship Agreement and the Commitment Statement

• Update or clarify guidance for employers and for staff. Staff must notify relevant people if this change of circumstance occurs

• Change the apprenticeship agreement template and guidance for employers commitment statement templates

• Ensure that you receive a copy of the updated agreement from the employer for the Evidence Pack

Who Can be Funded

• Make the distinction between these two modes of learning so that apprentice understand that both count towards the 20% OTJ but one in particular is their sole responsibility to track and meet

91.7 Time spent by employees/managers supporting or mentoring apprentices; this must be directly linked to the apprenticeship training and assessment, including end-point assessment, and be in addition to generic line management responsibilities.

Expansion of the criteria and test for employer line manager activity to be counted (and paid for)as part of an apprenticeship.

The evidence pack must include the following:243.1 details of the cost negotiated by the employer and provider. By details we mean that it should be clear that only eligible costs have been included in the price. 243.2 details of how the 20% ‘off-the-job’ training, excluding English and maths, will be quantified and delivered. By details we mean a plan of delivery and evidence of delivery taking place against that plan 243.3 details of how English and maths will be delivered.

That it should be clear in the evidence pack that the price should only contain the applicable eligible costs.

• Consider creating / publishing a costing summary for employers for each apprenticeship

• Update employer and apprentice guidance - be clear on what is not eligible for funding and what you offer ‘free’

• Complete the funding table in the C Statement with what is not eligible for funding but is still paid for by you or the employer

• Create a module breakdown setting out clearly the activity and calculations. Track this learning and monitor progress

Prior Learning • P194. Funds must not be used to pay for training for skills, knowledge and behaviours

already attained by the apprentice. We may take action to recover apprenticeship funding where this happens.

• P195. You must account for prior learning when negotiating a price with the employer. You must reduce the content, duration and price, where the individual has prior learning necessary to achieve occupational competence.

• P196. Where you account for prior learning and the reduction of content would mean the apprenticeship would take less than the minimum duration to complete (as set out in paragraphs P44) or fail to meet the requirement for the apprentice to spend 20% of their time in off-the-job training (as set out in paragraph P31) the apprenticeship is ineligible.

• P197. You must assess the individual’s prior learning before starting the apprenticeship. You must evidence and quantify the proportion of prior learning already attained, quantify the proportion of off-the-job training content that will not be covered, and quantify the amount that the funding will be reduced by.

• P198. You must include a thorough appraisal of the apprentice’s existing knowledge, skills and behaviours against those required to achieve occupational competence. Where applicable, you must include in your appraisal any knowledge, skills and behaviours gained from the following:P198.1 Work experience, particularly where the apprentice is an existing employee.P198.2 Prior education or training and associated qualifications in a related sector subject area.P198.3 Any previous apprenticeship undertaken.

• you need a robust INA that assesses the apprentice existing education, experience and qualifications against the Standard / apprenticeship KSB.

Care Leavers Bursary P108 - 115 • Apprentices are eligible to receive a £1000 bursary payment if they have been in the care of the

local authority as defined in paragraph P100.

• You must tell the apprentice that they are eligible for the bursary as a care leaver and give them the opportunity to declare that they would like to access the funding

• You must have evidence that the apprentice is eligible for this payment before you claim or are funded for any associated additional payments for you or the employer.

• You must include signed consent from the apprentice to inform their employer that they have been in the care of their local authority and tell the apprentice that their declaration will be used to generate additional payments to both the main provider and their employer to support their transition into work.

• The signed declaration (see paragraph P286 for more information) must allow the apprentice to confirm that they:

– P110.1 Understand that they are eligible to and would like to receive a bursary as a care leaver.

– P110.2 That if they have been found to have accepted the payment incorrectly or when they are ineligible then government will require it to be repaid.

– P110.3 Have not been paid a care leavers bursary before.

• If the apprentice does not want to inform their employer that they were previously in care, then you must report the appropriate code in the ILR. This will generate the funding for you and the apprentice but not the employer

Care Leavers Bursary P108 - 115

• If they do go ahead :

– You need a signed email or letter confirmation from a local authority appointed Personal Advisor confirming that the apprentice is a care leaver.

– You receive the funding for the employer, yourselves and apprentice

– Funding is received 60 days after they start and you must pass it on in 30 days after receipt .You need evidence that the Bursary has been received. This must be a signed confirmation from the apprentice and not only a receipt of transaction. -and you need to keep this on file

• This is a one-off ‘lifetime’ payment, not a payment for each apprenticeship.

• It is your responsibility to ensure that the apprentice has not received this payment previously before you pass it on. [‘reasonable checks’ and a declaration needed ]

• ESFA will also monitor this to ensure that the apprentice only receives this payment once and may reclaim duplicate payments

ESFP275 Provision used as match funding will be subject to ESF compliance checks and we will review the evidence you have to support claims made to us to support the programme funding. You must read these rules in conjunction with the ESF 2014 to 2020 funding rules and adhere to the following requirements;

• P275.1 Display an ESF poster prominently in your premises.

• P275.2 Have Gender Equality and Equal Opportunities and Sustainable

• Development policies and action plans in place.

• P275.3 Inform all apprentices that they are on a programme part financed by ESF.

• P275.4 Retain documentation for audit including having in place a document retention policy that reflects the minimum date requirement of 31 December 2030 and, if you are chosen for an audit visit, you must allow external auditors into your premises and co-operate with the audit.

• P275.5 Participate in evaluations, surveys and reporting as required.

• P275.6 Return complete data in line with the 2018 to 2019 ILR specification with key focus to critical fields. Critical fields are;

– Employment status

– Prior attainment

– Household situation

– Destination

– Learner contact details for surveys, especially phone numbers

ESF• P275.7 Only return ‘not knowns’ within the ILR for the critical fields in exceptional

circumstances. If information is not provided, or ‘not known’ is not available, then you must use ‘learner has withheld this information’.

• P276. You, your subcontractors and other third-party organisations must not use our mainstream programme funds as match funding for your own projects through other European Union funds (for example, other European Social Fund, European Regional Development Fund, European Integration Fund).

• P277. You must keep to the rules of the ESF programme or you will break the conditions of your contract and this could result in us recovering funds

Action

• Print the posters and get them up.. Every where - e.g. reception for all buildings

• Put the logos on all print and web ASAP, and all in-house forms – especially eligibility declarations and signatories - if in doubt put it on

• Add information about the role of the ESF programme into all apprentice declarations and all employer declarations. E.g. ..I understand that my apprenticeship is part of the ESF programme’ etc etc

• Expect to be audited- add ESF compliance specifically to any compliance monitoring that you undertake

• P283.1 Confirmation that an apprentice is aged over 15 and has legally left school.

• P283.2 Confirmation from the apprentice that they are not enrolled on another apprenticeship or DfE funded HE / FE programme at the same time.

• P283.3 Confirmation that you have seen the learner’s immigration permission and are satisfied the learner is eligible for funding; where a learner’s permission to stay has expired you must hold evidence that an application to remain has been made.
