    ATTACHMENT-I

    INSTRUCTIONS TO TENDERERS

    The downloaded Tender Form from our corporate website(www.bharatpetroleum.in) is to be

    submitted along with a demand draft of Rs.1000/- (non refundable) drawn on any

    Nationalised/Scheduled Bank in favour of Bharat Petroleum Corporation Limited payable at

    Kolkata.

    The Tenderer having their own LPG Bottling Plant at the proposed location would only be

    considered as Existing PMC.

    Submission of Price and Technical bids.

    1. The bids in the sealed cover super scribing the Tender No. should be submitted on or before the due date and time specified in the tender. The bids clearly marked as PRICE

    BID and TECHNICAL BID shall be put in separate enclosed envelopes respectively

    and sealed. These two envelopes together shall be put in another envelope and sealed and

    submitted.

    2. All pages of the Tender document shall be signed and sealed appropriately by the person or the person holding the Power of Attorney. Necessary documents relating to the Power

    of Attorney should be enclosed with the tender. The tender should contain the following

    documents :

    Submission of Earnest Money Deposit :

    1. Tenderer shall furnish Earnest Money Deposit of Rs.1,00,000/ (Rupees One Lakh only) by a Demand Draft from a Scheduled Bank in favour of Bharat Petroleum Corpn.Ltd

    payable at Kolkata with Technical Bid only. The Tenderer can submit a bank guarantee

    from a Scheduled Bank, in lieu of Demand Draft for the same as per format given in

    Attachment IX. Tender with EMD submitted in any other Form or EMD not found

    enclosed with the Technical Bid shall be rejected.

    2. The validity of the Bank Guarantee shall be for 180 days from the Due date/extended due date for submission of the Tender.

    3. No interest shall be payable on Earnest Money Deposit (EMD).

    4. Units registered with NSCIC (Copy of valid registration certificate required to be submitted alongwith Technical Bid and Public Sector Enterprises (Declaration required

    to be submitted alognwith Technical bid) are exempted from submission of EMD.

    Security Deposit

    5. After the award of the job the successful tenderer shall furnish interest free security deposit towards product/equipment security in the form of Demand Draft/ Bank

    Guarantee from a Scheduled Bank in favour of M/s. Bharat Petroleum Corporation

    Limited, payable at Kolkata. The amount of Security Deposit shall be Rs.20,00,000/-

    (Rupees Twenty Lakh only). Out of this Rs.10 Lakhs would be paid by Demand Draft

    and balance Rs. 10 Lakhs by Bank Guarantee.

    This Security Deposit shall be released within two months of the expiry of Contract with BPCL

    and after completion of all product/equipment reconciliation is completed in all respects.

    6. Computer Hardware, Software, Stationery, electronic Data Transfer and Mail/ Courier.

    a. Contractor will make arrangement to provide at the Plant Y2K complied PC alongwith 180 column printer with necessary hardware and UP/constant voltage transformer or

    any other device for protection hardware/software BPCL will load the latest version

    of its ERP Package (SAP R/3) into the PC of the contractor for printing of Cash

    Memos/invoices and other related documents as well as maintenance of accounts.

    b. All computerized stationery for documentation shall be provided by BPCL. Other stationery items like floppies and papers etc. which are of small value can be purchased

    by the contractor from BPCL authorized supplier and debited to BPCL accounts at

    actuals.

    c. The transactions have to be done ONLINE through our ERP (SAP R/3) package and hence necessary hardware/ internet connections have to be provided by the

    Contractor and the Corporation shall arrange to load the ERP package. Necessary

    training also will be imparted by BPCL.

    7. The scope of the tender includes but not limited to :

    Storing bulk LPG at The LPG Bottling Plant of tenderer and bottling assistance of

    Liquefied Petroleum Gas (LPG) into cylinders and such related and ancillary activities

    connected with receipt and storing of LPG and bottling of the same and dispatch to

    Bharatgas distributors/BPCL LPG Plants in trucks.

    Scope of BPCL shall be limited only to providing Bulk LPG, cylinders for filling,

    valves, regulators, caps and seals, transportation of cylinders as per details provided in

    this agreement .

    Qualification Criteria :

    8 The Tenderer should be a private marketer within the meaning of Liquefied Petroleum Gas (Regulation of Supply & Distribution) Order 1993 and amendments made thereafter.

    9 Credentials bio-data and business standing as detailed in attachment II and Plant facilities and logistics detailed in attachment III shall be submitted. The tenderer shall have to

    submit bank solvency certificate.

    10 All things being equal, preference shall be given to the private marketing companies who are executing contract for bottling services for Public Sector Oil Companies Viz. Indian

    Oil, Hindustan Petroleum or IBP Co. Ltd. A proof of this has to be enclosed by the

    tenderer.

    11 The plant should have approval/License from CCE for Bulk LPG storage. LPG cylinder storage and for the filling facilities. The filling machines, the check scale and weigh

    bridge should be duly certified by Weights & Measurement Department. Approval should

    also be available from Local Factory Department, Pollution Control Board and other

    statutory authorities as applicable.

    12 The plant in operation shall have all approval/permissions from all the statutory and Non Government Agencies. BPCL shall in no way be held responsible if any of the

    permission is found to be not complied with by the tenderer.

    13 LPG plant or plants of the bottler shall be located in and around Jharsuguda in the state of Orissa only, preferably within 35 km radius from the city.

    14 The position of LPG bottling plant/plants shall be well located logistically to work economically for the BPCL for various markets as indicated. Each LPG bottling plant

    should have minimum bulk storage of 18 MT and also minimum filling capacity of about

    1000 MT of LPG per month (12000 MTPA approx.) LPG bottling plant should be

    equipped with adequate Fire Fighting Facilities , fire water storage as required to combat

    the emergency fire situation in the plant for four hours.

    15 i) The plant must have proper motorable approach road for smooth access of heavy vehicles with bulk as well as packed LPG.

    15. It is upto the discretion of BPCL to accept the whole or part of the capacity offered by the tenderer. Also BPCL at its sole judgement and discretion can accept the part

    capacity and later on enhance the same depending upon the increase in the market

    demand. Opening of new distributorships in future, as also to meet the rescue

    demand in case of disruption /stoppage of supply from any of its plants/assisted

    company plants, irrespective of market/location.

    16. The facilities in the plants in operation offered by the tenderer to BPCL for bottling shall be reviewed by BPCL, in line with its own requirements, and the vendor has to

    upgrade all the facilities as required by BPCL.

    17. The award of work will be subject to inspection of the plant carried out by BPCL officials BPCL reserves the right to reject the offer based on inspection.

    18. In case of power failure, provision of adequate No. of DG sets shall be available at the Plant for full load operation, lighting and critical equipment running.
