1 DESCRIPTION OF WORKS Supply of Pasteurized White Butter to our following milk unions in Uttar Pradesh as per our specification Lucknow ( 150 MT ) Meerut ( 150 MT )

2 ADDITIONAL INFORMATION Interested eligible bidders may obtain further information from the office of the Incharge Materials PCDF Ltd and inspect the bidding documents at the address given below

3 REQUEST FOR BIDDING DOCUMENT A complete set of bidding documents may be purchased by any interested eligible bidder on the submission of a written application to the Incharge (Finance) PCDF Ltd and upon the payment of a non-refundable bidding document cost as detailed below Bid document may be downloaded from the tender website wwwparagmilkupin and the cost (processing fees) of bid document should be deposited in the form of DD in the name of PCDF Ltd payable at Lucknow and must be kept in same envolope which contains Earnest money

4 Minimum Eligibility Criteria For the purpose of this particular contract bidder shall have to meet the following eligibility criteria as minimum

41 The bidder should be in business as manufacturer for a period of three years at the time of bid opening in the same name and style In order to support these the bidder has to submit-

a) Photocopy of the purchase orders executed in the last three years in same name and style b) Any document issued by Govt or Semi Govt Department which certifyprove that the bidder is in business for

the required period 42 The bidder should be registered under office of competent authority or under statuary bodies at the time of bid

opening in the same name and style In order to support this the bidder has to submit- Copy of the Registration Certificate issued by the Registration of firms in case of firms of proprietary nature OR Copy of partnership deed in case of partnership firms OR Copy of article of association in case of Public Pvt Ltd companies OR Copy of registration certificate for firms registered with NSICCentral or State Govt departmentLocal bodies for

similar work 43 The bidders annual financial turnover in the same name and style during any one of the last three years shall not

be less than 20 of the value of the contract as specified in the Invitation to Bid In order to support this copies of Balance Sheet along with Profit amp Loss statement for the last two years duly certified by Chartered

Accountant to reflect the annual turnover are to be submitted 44 Bidder should have income tax clearance certificate for previous years in original but not older than last two

years To support this the bidder has to submit photocopy of latest income tax clearance certificate but not older than two years in the same name and style along with PAN No Tax Deduction amp Collection Account Number(TAN) and Service Tax Registration No

45 Bidder should have credentials for satisfactory performance for the last two years To support this the bidder has to submit-

(i) Details of orders executed satisfactorily to Milk FederationMilk UnionReputed Milk Industries during last three years The statement should be duly signed by the bidder

(ii) Certificate issued by Milk FederationMilk UnionsReputed Milk Industries regarding satisfactory execution of purchase orders given by them

46 Bidders firm should be registered with Sales Tax Commercial Tax Department To support this the bidder has to submit photocopy of Sales Tax registration certificate duly renewed by the competent authority along with photocopy of TIN

47 The bidder shall have to furnish the Bankers Certificate issued by Nationalized Bank 48 Bidder should have valid MMPO FSSAI AGMARKLicense Registration amp valid BIS certificate To support

this bidder has to submit photocopy of valid MMPO FSSAI AGMARK and BIS certificate issued by competent authority

49 Minimum four sealed samples(in duplicate) of 200 gm each along with Batch No Date of Production etc is mandatoryAll Sealed Samples of White Butter should be made available in ICE ndash BOX to our Central Lab located at Lucknow Union to be submitted alongwith technical bid documents

IN THE ABSENCE OF ANY CERTIFICATE DOCUMENT SAMPLES OUT OF THE ABOVE MENTIONED AS REQUIRED FOR FULFILLING THE ELIGIBILITY CRITERIA THE CONCERNED PARTY SHALL BE CONSIDERED AS NON ELIGIBLE AND IN THE EVENT OF THIS THEIR BID EVEN IF LOWEST SHALL NOT BE CONSIDERED 5 BID DETAILS Detailed terms and conditions as well as the technical specifications for all the items of works as

INSTRUCTIONS FOR SUBMITTING TENDER 1 Tender should be sent BY POST or submitted BY HAND to the office of Incharge (Materials)

PCDF Ltd 29 Park Road Lucknow so as to reach this office by 100 pm on or before due date

2 Tender should be sent in a sealed cover superscribed by Tender for the Supply of

PASTEURIZED WHITE BUTTER IN 15 20 KG CARTON PACKINGto our different

milk unions in Uttar Pradesh containing two sealed envelopes one for Technical Bid and

another for Financial Bid all should be duly super scribed - Type of bid name of item

and opening date 3 TECHNICAL BID should comprise of all Eligibility Criteria of General Terms and Condition

and required Earnest money Bidders are required to provide all supporting documents along with Earnest Money in proper shape putting in a Sealed envelope super scribed withrdquo Technical Bid for helliphelliphelliphelliphellip helliphelliphelliphelliphelliphellip rdquo

Tenderer Over-Writing alterations additions etc will disqualify the tender unless such overwriting alterations additions are legibly attested and signed by the Tenderer

9 Supply has to be made to allany milk unionunit of PCDF Ltd Lucknow situated within the state of UP

10 Conditional Telegraphic FaxE-Mail tenders are liable to be rejected 11 Tender must be accompanied by requisite amount of earnest money as specified in the enclosed

specification sheet without which same shall liable to be rejected 12 Govt Cooperative Institutions are exempted from purchase of Bid document and deposition of

Earnest Money Security Money 13 Party whose earnest money is already lying with PCDF against previous rate contract or

due to any other reason will not be exempted for deposit of earnest money Such parties should deposit FRESH EARNEST MONEY

14 Earnest money of unsuccessful tenderers shall be returned immediately after finalizing the contracts

15 Only VALID offers shall be considered 16 Offers should be strictly according to our specifications failing which it shall not be considered 17 When any item is required to be BIS MMPO FSSAIAGMARK Marked photocopy of

the valid license granted by BIS or other statutory Authorities must be enclosed with the tender

18 Tenderer are required to provide the breakup of offered rate giving base price of raw material along with head wise details

19 Normally rate contracts will be finalized on the basis of lowest offer strictly as per NIT instructions and our terms and conditions

21 Price Basis Bidders are required to quote rate on FOR basis But they have to mention clearly the price basis for calculation purpose

22 Inspection We may depute our representative to inspect the quality and manufacturing process and only after being satisfied with the quality then commodity will be acceptable to us Bidders are required to ensure necessary quality control checks by your authorized representative before dispatch Batch wise 100 checking shall be done by us before accepting the material

23 Delivery Delivery may please be commenced on receipt of intimation If desired bidder may mention delivery schedule White Butter consignments will be delivered transported by Refreigerated Van

24 Validity of Offer Should be for 60 days from the date of opening of respective Bid 25 Documents to be enclosed with Bid

20 Bidder firms are requested to mention their rates both in the words and figures failing which their offer

may be rejected In case of ambiguity the rates mentioned in words shall be considered as correct one 30 PAYMENT- Full payment shall be made within 15 days only after receipt and verification of

consignment at site The payment shall be made through Cheque DD with bank charges to be borne by Party

40 PENAL CLAUSE- The material should strictly conform to our specification in all respects If any supply is found substandard with respect to any aspects of specification laid down such supplies shall not be accepted at a discount and shall be liable to be summarily rejected Such defectiveSubstandard material will have to be removed by the supplier from site at his or her own expenses In such case supplier may be allowed to replace such material by good quality material within one month from the date of issue of information to them regarding rejection PCDF reserves the right that under the above circumstances where material is found to be substandard the order placed and rate approved may be cancelled at any time during the contract period In such cases besides the consequences of Breach of Contract the security deposit shall also be forfeited If the supplier fails to make supplies within the stipulated time schedule deduction shall be imposed 05 of the value of material for each 07 days delayed supply to be imposed from the very first day of delay by the purchaser at their sole discretion Purchasers may even cancel the order besides confiscating the Earnest MoneySecurity Money of the supplier after expire of delivery period Delivery schedule shall not be extended in ordinary circumstances and the order placed shall stand canceled automatically in the event of supplies not being made as per schedule However under emergency situations the same shall be extended through a separate letter by the purchaser and in this event also the penal clause defined above shall be applicable If bidder fails to execute supplies in time and the purchaser is not in a position to accept the material even with late supply penalty the purchaser will have the right to arrange for the material from other sources and the bidder shall have to compensate the loss that the purchaser may sustain by procuring the material from other sources

50 SAMPLE- Will be made available in ICE- Box to our Central Lab located at Lucknow Milk Union

60 PRICE BASIS - The price must be quoted on FOR Basis shall be considered and it shall be deemed that the rates are inclusive of all taxes levies insurancetransportation etc and successful bidders shall be bound to supply the material at all inclusive rates The applicable rate of duties and levies should also be mentioned in the offer

70 VALIDITY- The tendering firms are required to keep their offer open for 60 days from the date of opening of the respective bid If any bidder withdraws bid before expiry of the said period PCDF may agree to allow such withdrawal but in such a case the Earnest Money deposited by the bidder will be forfeited If the Pradeshik Cooperative Dairy Federation Ltd does not agree to allow such withdrawal and accept the bid and the bidder fails to perform their part of contract the Earnest Money deposited by the bidder shall be liable to be forfeited besides other consequences of Breach of Contract

80 No amendment alternation or modification will be allowed in the terms and conditions mentioned in the bid documents The bidder will have to accept standard terms and conditions as prescribed in the declaration format without putting any condition from their side otherwise the bid will be rejected

90 EARNEST MONEY- 91 Earnest Money as mentioned in the Tender Notice is to be deposited in the form of DD issued by

Nationalized Bank which should be payable in favour of Pradeshik Cooperative Dairy Federation Ltd Lucknow without which the bid will not be considered EMD should be valid for at least 30 days beyond the bid validity period

92 Earnest Money will not be acceptable in any other form except as specified in the bid conditions 93 Earnest Money will also not be adjustable against any other pending claims of the bidder against

PCDF 100 AGREEMENT- On finalization of purchase of material the firm will have to enter into a formal

agreement with the concerned Milk Unions 110 SECURITY- Earnest Money deposited by party shall be kept by PCDF as security money In

addition to this amount equivalent to 5 contract value will have to be deposited by the successful bidder within 07 days from the date of receipt of Letter of Intent by them in the form of DD in favour of Pradeshik Coop Dairy Federation Ltd Lucknow to be issued by a Nationalized Bank The Security money shall be liable to be forfeited in the event of Breach of Contract in addition to any

other action which PCDF may think to be proper at their sole discretion Earnest Money deposited by the bidder will be adjusted against required amount of security money

120 BREACH OF CONTRACT - Any expenditure incurred by PCDF due to Breach of Contract on the part of the bidder effecting their production schedule will be realized out of the security deposit of supplier in addition to any other action taken which PCDF thinks proper which shall be its sole discretion

130 NEGOTIATIONS- Post Tender Negotiation shall not be held 140 Party should carefully note that bids which are not in conformity to the terms and conditions

mentioned in bid documents shall not considered 150 Splitting of quantities if quantity to be ordered is much more than L1 alone can supply In such cases

the quantity order may be distributed in such a manner that the purchase is done in a fair transparent and equitable manner

160 Bid may be awarded to other than L1 in the following circumstances - If past performance of L1 party is not good supported by documentary proof If the reputation of the L1 party is not good 170 BILLING- 171 Invoices are to be prepared in the name of respective milk union and are to be sent to them directly for

payment 172 Approved parties are required to send a copy of dispatch adviceinvoice to PCDF to Lucknow for

information and record 180 The quantity to be bought from successful bidder shall depend on competitiveness of rates

promptness of delivery quality and past performance etc 190 In case the scheduled date for opening of tenders is declared a Public Holiday the bid opening will

be held on the next working day at the same time 20 Delivery Schedule Immediately after approval of quality and as per delivery schedule which will be

provided by respective Milk Union Unit 210 Transportatioin White Butter consignments will be delivered transported by Refreigerated Van 220 Specification amp Packing Pasteurized White Butter satisfying the requirement of FSSA-2006

AGMARK Act and should be freshly produced (of JAN14 onwards) prepared out of fresh milk Minimum fat percentage in White Butter should be 84 The quality of White Butter should also meet the other norms as prescribed in enclosed Quality Standard ( Specification ) The 15 20 Kg butter blocks shall be strapped in food grade transparent unprinted polythene wrapper film of minimum 50 micron thickness Outer packing shall be of at least 5 ply cardboard cartons properly gummed cello taped The butter shall not be more than two months old as on date of receipt at our end PCDF QC Production staff shall be free to check inspect verify the production process

230 Pasteurized White Butter should also conform to PCDF specifications given in the TENDER document


250 Preference may be given to Cooperative sector manufacturers 260 OTHERS-

i Bids should be submitted in sealed covers super scribed with the name of item and date of opening of tender

ii The quantity of material as mentioned in bid documents is approximate and may vary by +-25 on the sole discretion of PCDF

iii The purchase order for quantity of material required shall be placed on as and when required basis

iv Material Inspection By our Union representatives at respective plants of the manufacturers 270 ARBITRATION- In case any dispute arises out of the contract period the same shall be referred

to the sole arbitration of Milk Commissioner UP whose decision shall be final and binding upon both the parties and the jurisdiction shall be Lucknow

28 Membership You are required to deposit Rs105-00 as nominal membership fee which is not returnable to you You shall not have the right to vote in the affair of FederationUnion to seek election to any concern office and shall not have any right to claim in the profit of FederationUnion

manufacturing facilities and Good Manufacturing Practices in the dairy The supplier

shall have to show and confirm the traceability of the product to the collection of

milk

3 PCDF or its Unions representatives shall check and confirm the available stock of

White Butter as on the date of Inspection

4 Before dispatching of consignment the Batch wise testing is to be ensured by the

representative of the Milk Union

5 In case of any consignment is rejected on basis of the presence of any foreign

adulterant all ensuring consignment shall be stand cancelled

6 PCDF or its Unions QC Production staff shall be free to check inspect verify the

production process

7 In case White Butter is being manufactured during the period of supplies PCDF or its

Unions may post a QC Prod Manager for inspection checking and verifying the

stocks

8 In case some of the cartons are found to be in non- conformance of the quality

standards these shall be segregated and rejected and supplier shall be take them back

and replace with the White Butter conforming to the quality norms provided rejection

is not on the basis of presence of adulterants

Wooden HDPE pallets and no old or rejected White Butter will be stored along with this

D We ensure to give you the product manufactured after JAN 14 onwards having an expiry date of one year

12 Validity of Financial Bid 60 days from the date of opening of Financial Bid 13 Price Revision We understand that no price revision shall allowed to us during the contract period due to

change in price of raw material We understand that changes in Govt levies will be applicable to us on furnishing documentary proof but if the rate of Excise duty is increased due to increase in our firms turnover the same shall not be admissible to us We also understand that any other revision shall not be allowed to us

14 White Butter consignments will be delivered transported by Refreigerated Van We understand that maximum two batches in one Van shall be arranged in proper order for easy identityfication

15 The material supplied by us will be used directly in food products for human consumption We understand that it is essential that the material conform to food grade standard and hygienic quality Towards this it is essential that our factory premises amp its surroundings where the material is produced manufactured is maintained in utmost clean amp hygienic conditions from dust dirt insect flies etc Absolute cleanliness and hygiene to avoid any chances of contamination shall be ensured by us The consequences of supplies not conforming to desired hygienic parameters will fall entirely on us

16 We undertake that White Butter be supplied by us is converted from clean fresh milk free from all extraneous matter and additives harmful chemicals neutralizers detergent urea added sugar including sucrose maltose dextrose and vegetable fat Responsibility of compliance of FSSAAGMARK norms will be with us

17 In case of rejections in supplies made by us no payment will be made by member unions 18 You reserve the right to get our materials tested from any authentic independent labsCentral lab PCDF the
