tune of Rs. 3.0 Lac in last three financial years in BSNL. Experience certificate must be signed not

below the rank of JAG/DGM.

Tender paper may be had by eligible contractor from the A.G.M. (Plg.) O/o

The General Manager, Telecom District, Chapra on any working day upto 14.01.2015 between 11:00

hrs and 17:00 hrs on payment of Rs.1,135.00 (Rupees One thousand one hundred thirty five) only non

refundable) in cash on ACG- 67 receipt.

Tender in a Wax sealed envelope as instructed in tender documents may be

dropped in tender box in chamber of the AGM(Plg) O/o the GMTD, Sahebganj, Chapra upto 14:00 hrs.

on 05.02.2015. It may also be sent by post to AGM(Plg.), O/o the General Manager, Telecom District,

Chapra so as to reach by 14:00 hrs on or before last date of receipt of tender paper (05.02.2015). BSNL

will not be responsible for any postal delay. The tender shall be opened on 05.02.2015 at 15:00 hrs. in

presence of tenderer or their representative who wish to be present there. At the date of opening only

technical bid shall be opened. Financial bid of only technically qualified bidder shall be opened for

which date of opening shall be intimated separately.

Tender papers may also be downloaded from BSNL, Chapra Website (URL http://www.tender.bsnl.co.in). In case of forms downloaded from BSNL, Chapra Website, Cash Receipt of cost of tender form deposited at counter of AO (Cash), O/o GMTD-Chapra or Demand Draft/Banker’s Cheque of an amount of cost of tender form in the favour of AO (Cash), BSNL, O/o GMTD, Chapra Payable at Chapra must be submitted along with Technical bid of the tender.

The General Manager,Telecom District, Chapra reserves the right to accept or

reject any or all tender/tenders wholly or partially without assigning any reason. Further General

Manager, Telecom District, Chapra reserves the right to award the work among more than one tenderers

on the lowest approved rate.

INSTRUCTION FOR THE TENDERERS

1. The tenderer should submit the tender in sealed envelope. The envelope should contain the following documents: -

(i) Earnest money in shape of D/D in favour of AO (cash), O/o G.M.T.D.,Chapra payable at Chapra in original.

(ii) An Experience Certificate from an officer not below the rank of JAG/DGM stating that the tenderer has satisfactorily completed work of

repairing of Power plant to the tune of Rs. 3,00,000/- in last three

financial years in DOT/ BSNL.

(iii) Income Tax return up to date And Photo copy of PAN Card. (iv) Tender document along with duly filled in “ Form for Quoting Rate”. (v) Deed/Declaration regarding Proprietorship/partnership/Ltd Company as

the case may be.

(vi) Declaration forms (A) &(B) duly filled in (Annexure-II & III). (vii) Firm registration certificate. (viii) EPF registration copy and paid Chelan up to date.

The tender will be submitted in two separate wax sealed envelopes superscribed

“Technical Bid” and “financial Bid”, put together in another separate wax

sealed envelope super-scribed for repairing of power plant module(100Amp,

50Amp & 25Amp). The tenderer must write their name and address on the

envelope.

Technical Bid:-This will contain all certificate/document and earnest money.

(a) EMD in form of Bank Demand Draft. (b) Experience certificate issued by an officer not below the rank of JAG of

DOT/BSNL as in (ii) above.

(c) Copy of partnership deed/proprietorship deed in case of a firm or MOA in case of a company.

(d) ITCC valid up to date/Photo copy of PAN Card. (e) Declaration forms (A) & (B) duly filled in. (f) Firm Registration Certificate.

Financial Bid:-It should contain only rates quoted for the work i.e. Financial bid at Page

No.10 as Annexure-I.

1. Financial Bid will be opened only if technical papers are found correct.

2. The date for submission of tender shall be 26.12.2014 till 14:00 hrs. 3. The envelope containing tender should be addressed to the AGM(Plg.), O/o the

G.M.T.D.,Chapra. The envelope containing tender can be dropped into tender box,

kept for in the office chamber of AGM(Plg),o/o the G.M.T.D.,Chapra before the

due date and time.

4. Tender will be summarily rejected if (i) They are received after due date and time. (ii) EMD is not attached. (iii) Envelope containing tender document is not sealed with wax and

personal seal.

(iv) All the pages of tender document is not signed and filled up. (v) Correction made are not initialed.

TERMS AND CONDITIONS

GENERAL CONDITIONS :-

1. Cost of tender paper is non-refundable. 2. The tenderer signing the tender (in case of firms) should specify clearly whether as

(i) Sole proprietor (ii) Partner.

3. Corrections in the tender, if any, should be initialed. 4. The tenderer must be available at his postal address furnished in the tender. Any

change in address must be communicated to this office well in time.

5. The recovered stores will have to be made over to BSNL. 6. Incomplete tender shall be summarily rejected. 7. The G.M.T.D.,Chapra reserves the right to accept, reject, prefer any tender or

tenders without assigning any reason.

8. (a) G.M.T.D.,Chapra further reserves the right to accept the tender in part and award the work to more than one tenderer at the lowest approved rate.

(b) G.M.T.D.,Chapra further reserves the right to demarcate area of operation of

various tenderers and award the work to various tenderers area wise.

(c) G.M.T.D.,Chapra reserves the right to vary the amount by ± 25% of tender

value.

(d) The BSNL reserves the right to award the contract to one or more bidders who

have qualifying bid at the rate of L1 bidder. The bidder with the lowest evaluated

rate will be considered for 70% of the tendered quantity and 30% of tendered

quantity of L2 i.e second lowest bidder. However BSNL reserves the right for

placement of full tendered quantity on the lowest bidder.

9. Any over/excess payment taken by the contractor shall be recovered/adjusted from the SD/EMD/Pending bills.

10. The bid shall remain valid for 120 days after the date of opening of bid. A bid valid for shorter period shall be rejected by BSNL as non responsive.

A bidder accepting the request of BSNL for an extension to the period of bid

validity, in exceptional circumstances, will not be permitted to modify the bid.

EMD & SD :-

11. Each tender must be accompanied with an earnest money of Rs.25,000/- (Rupees Twenty five thousand) only in form of crossed bank draft of any nationalized bank

in favour of A.O.(Cash), O/o the G.M.T.D.,Chapra payable at Chapra in original.

12. The earnest money deposited by the successful tenderer shall be deemed to have been converted into security deposit.

In addition to above, 7.5% of estimated cost shall be deposited by

the contractor in shape of DD/Bank guarantee as S.D. The security deposit shall be

refunded/returned after six months of completion of the last work order. All these

amount shall be a guarantee for performance of contractor. Any amount can be

deducted from this amount for bad performance of contractor. If agreement is not

made, offer will be cancelled & Earnest money forfeited.

13. If any tender is withdrawn before the final acceptance of the tender, the earnest money will be forfeited.

14. Earnest money of unsuccessful tenderers will be refunded to them in due course after finalisation of tenders.

15. Security deposit of such contractors which will remain unclaimed for a period of three years after their refund becomes due, shall lapse and no claim for

refund shall be entertained thereafter.

TAXATION :

16. Income tax (@ 2.26% or as may be determined by the Govt. of India from time to time) on the gross amount of each bill passed shall be deducted at source. Income

Tax PAN No. should be furnished by the contractor to the AO(Cash) concerned.

17. (a) The rate should be quoted in figures and in words. It should be inclusive of all taxes. In case of discrepancy in words and in figure, words will prevail. The form

for quoting rates is placed at ANNEXURE –I enclosed with this document. No

conditional offer will be accepted.

(b) The bidder will quote the rate per set for repairing of Power Plant Module

inclusive of spare parts and taxes.

(c) The contractor will give a warranty for 90 days after repairing of the Module if

any fault of repaired module within 90 days will be repaired the agency without any

extra cost.

EXPERIENCE :

18. For technical prequalification the tenderer must submit an experience certificate from an officer not below the rank of JAG stating that the tenderer has satisfactorily

completed work of repairing of Power Plant Module to the sum of Rs. 3,00,000/- in

past three financial years in DOT/BSNL. The tenderer must submit income tax

clearance certificate valid upto date/Photo Copy of PAN Card. In absence of these

certificates and earnest money tender will not be considered.

MODE OF WORK : 19. (a) Work shall be carried out only after the work order is issued by the concerned

work ordering authority.

(b) The contractor shall be responsible for any fault in the work done.

20. If the contractor desires any extension of time for completion of work on the ground of its having unavoidably hindered in its execution or any other ground he

shall apply to the concerned work order issuing authority within seven days of such

hindrance on account of which he desires such extension. The aforesaid concerned

work order issuing authority, as in his opinion, can authorize such extension, if

thanks fit. The decision of the work order issuing authority will be final in this

matter.

21. The tenderer should have technical and financial capabilities to execute the work. 22. The rate approved shall be operative for a period of one year. However The

G.M.T.D.,Chapra reserves the right to reduce or extend the validity of the contract

on mutual consent, if the circumstances so demand.

23. If the contractor fails to repair the Power Plant module and returns the faulty sets to concerned SDEs within 10 days after receiving the faulty sets or within 15 days of

issue of work order by concerned officers, The G.M.T.D.,Chapra reserves the right

to get the stated job done from any other source or agency even on higher rate and

the difference of the expenditure shall be recovered from the approved

contractor. In the event of contractor failing to execute the work to the satisfaction

of The G.M.T.D.,Chapra, the said authority reserves the right to reject or withhold

payment for such quantity of work till such time the defects are rectified to their

satisfaction or to terminate the contract by giving one month notice to the

contractor.

24. The faulty Power Plant module shall be given to the contractor for repairing only at the respective site (i.e. exchanges).

25. (a) Each repaired set shall be tested by concerned JTO/SDE/DE and if it is not O.K. it will be returned to the contractor for proper repairing. Contractor will have to

repair all Power Plant module given to him for repairing. If contractor fails to repair

any of the Power Plant module a penalty at the rate of Rupees 3,000/- per un

repaired set shall be deducted from the contractor bills.

(b) No part payment of a work order shall be allowed.

(c) The contractor will furnish a specimen signature duly attested by a Gazetted

officer at the time of agreement which shall be kept recorded any payment will be

made only to the authorized signatory.

(d) After completion of hundred percent work, the contractor will submit the bill to

the supervising officer in triplicate. The supervising officer after necessary

certification will submit the bill to the work order issuing authority concerned.

26. Estimated cost mentioned in the tender is merely a rough estimate and guideline.

ARBITRATION :

27. (a) All the disputes and differences arising out, this agreement (except those, the decision whereof is otherwise herein provided for) shall be referred to the sole

Arbitration of the CGMT, Bihar Circle, Patna or in case, his designation is changed,

or his office is abolished, to the sole arbitration of the officer, whom for the time

being it is entrusted, whether or not, in addition to other functions with the principal

functions of CMD New Delhi, by whatever designation such officer may be called

thereinafter (hereinafter referred to as the „said officer‟), and if The CMD New

Delhi or the „said officer‟ is unable or unwilling to act as the Sole Arbitrator, then

in such an event, to the sole arbitration of some other person appointed by the „said

officer‟. There will be no objection to any such appointment that the Arbitrator so

appointed, is a Govt. Servant, that he had to deal with the matters to which this

agreements relates to, or, that in the course of his duties as such the Govt. servant

has expressed views on all or any of the matters in dispute, or in difference or

question, the award of the arbitrator so appointed, shall be final and binding on the

parties. The provision of the Arbitration Act 1940, or, any other statutory

modification or, re-enactment thereof and of the rules made there under for the time

in-force shall apply to such arbitration.

(b) Upon every and any such reference, the assessment of the costs of incidental

expenses in the proceedings for award shall be in the discretion of the Arbitrator.

(c) The work under this contract shall, if reasonably possible, continue during the

arbitration proceedings and no payment due or, payable to the Government shall be

withheld on account of such proceeding except those relating to the dispute.

(d) The venue of the Arbitration shall be a place from which the acceptance notice

is issued or such other place, as the Arbitrator at his entire discretion may

determine. The contractor (S) are bound by the terms and conditions.

(e) General condition

In witness thereof, the parties to these presents have herein

set to subscribe their respective hands the day and year herein above, first written,

signed, sealed and delivered.

28. (a) The contractor shall comply with the provisions of the payment of wages Act 1936, workmen‟s compensation Act 1932, Industrial Dispute Act 1947 and the

contractor labour(Regulation and Abolition) Act, 1970 or the modification thereof

or any other law relating thereto and the rules made there under from time to time.

He shall also indemnify the Department against any payments to be made for due

observance of the said laws.

(b) The contractor shall be responsible for any losses/damages etc. that may have

occurred during execution of work and shall pay compensation to his/their

workmen payable under workmen‟s Compensation Act 1923 (VII) for injuries

caused to the workmen. If such a compensation is paid by the Govt. as a Principal

Employer under subsection (i) of section is the same Act on behalf of the contractor

it shall be recovered by the contractor under section (ii) ibid from security deposit

or any other dues payable by the Govt. to the contractor on any account.

(c) No minor labour (below the age of eighteen years) or a labour with a criminal

record shall be employed on the work.

IDEMNITY :

29. (a) The contractor shall indemnify and keep BSNL harmless from and against all actions, suits, proceedings, costs, damages, charges, claims and demands

whatsoever, either in law or equity and all costs and charges and expenses that the

Govt/Deptt. may sustain or incur arising from or out of omission or commission of

any Act/Acts of the contractor, his agents, employees, assignee or sub-contractors.

(b) Contractor shall pay all Rates, Levies, Fees, Realities, Insurance, Taxes and

Duties payable or arising from or out of, or by virtue or in connections with and /or

in respect of the works or operation(s) or any part thereof to be performed by the

contractor and the contractor shall indemnify and Keep BSNL indemnified from

and against the same or any default by the contractor in the payment thereof.

(c) The contractor shall indemnify BSNL and keep BSNL. Harmless and

indemnified against any claim or damages due to negligence or otherwise, in taking

due precautionary measures by the contractor.

(d) The labourers working should be covered under Group Insurance scheme.

Otherwise the contractor will be personally responsible for the compensation to be

paid in case of accidents if any. The contractor will also indemnify BSNL for such

payment arising due to accidents and also for the loss caused to any other agency

while carrying out the above work.

LIQUIDATED DAMAGES :

30. (a) The contractor should commence the work within seven days of the receipt of work order. If the contractor does not commence and complete the work within

the period given in the work order, a penalty charges of 2% of the billed amount

of work order for every day subject to a maximum of 20% will be charged from the

bill of the contractor or even from his security deposit. However at the end of

second week, if the officer I/C feels that the work is likely to be delayed further, in

order to safeguard the interest of BSNL, the remaining work will be withdrawn

from the original work order and will be offered to other willing and approved

contractors.

TIME FORCE MAJOURE :

31. If at any time, during the continuance of this contract, the performance in whole or in part, by either party, under obligation as per this contract is prevented or delayed

by reasons of war or hostility of public enemy, civil commotion sabotage, fire,

flood, earth –quake, explosion, lock-out or acts of God/nature/beyond human

control (hereinafter referred to “eventuality” provided notice of happening of any

such eventuality is given by either party to the other, within twenty one days of the

date of occurrence thereof, neither party shall, by reasons of such an eventuality, be

entitled to terminate this contract, nor, shall either party have any claim for

damages against the other in respect of such non-performance or delay in

performance and deliveries under this contract. The contract shall be resumed as

soon as practicable after such eventuality has come to an end or ceased to exist.

In case of dispute, the decision of the Chief General Manager

Telecom, Bihar Telecom Circle, Patna shall be final and conclusive, provided

further that if the performance in whole or part of any obligation under this contract

is prevented or delayed by reason of any such eventuality for a period proceeding

sixty days, either partly, may in its option, terminate the contract.

Provided, that if the contract is terminated under this clause, the

BSNL shall be at liberty to take over from the contractor, the cost of loss, to be

fixed by the CGMT, Bihar Circle, Patna, which shall be final, alongwith all un-

used, un-damaged and acceptable materials, issued/brought out components and/or

other stores in course of execution of this contract, which may be in the possession

of the contractor at the time of such termination, or such portion thereof, as, BSNL

may deem fit, except such material as the contractor may, with the con-currance of

the BSNL, erect to retain.

TERMINATION OF CONTRACT :

31. A. The contract may also be terminated by The G.M.T.D.,Chapra at any time

by giving a notice in writing of 30 (thirty) days to the contractor without assigning

any reason and his discretion so to terminate, shall be final.

B. Any attempt to negotiate directly or indirectly by tenderers with the authorities so this office or any endeavor to secure interest for actual or prospective

tenderer or to influence by any means will disqualify the tenderer and his quotation

will be summarily rejected.

C. In the event of the contractor being adjudged insolvent, The G.M.T.D.,Chapra may, by notice in writing, terminate the contract and forfeit the

security deposit of such contractor.

PENALTY CLAUSES :

32. I. If the contractor refuses to accept the work or refuses to execute the work,

BSNL reserves the right to get the work done through any other agency (or even at

departmental level) even with higher rate and the cost so incurred will be deducted

from the contractor‟s bill or his security deposit as the case may be.

II. In case of breach of any terms and conditions, Or

In case of poor quality of work done,

Or

In case of delay in execution of work beyond prescribed period in the work

order, the BSNL will be at liberty to take any or all of the following actions after

giving a15 days notice to the contractor and after examining the reply of the

contractor (if any),

(a) The Agreement may be cancelled. (b) The work order may be cancelled. (c) The course mentioned at clause 32 (I) may be adopted. (d) The SD/EM D may be forfeited. (e) Liquidated damages at the rate of 2% of value of billed amount of work

order for each day of delay subject to the upper limit of 20% of work order

may be imposed.

(f) The contractor can be blacklisted.

a) Breach of corrective maintenance schedule:- If the agency fails to rectify the fault

within 7 days of receipt of written/ telephonic complain, BSNL can get Module repaired on

market basis from any available recognized/ un-recognized agency and expenditure thus

incurred will be deducted/ realized from the contractors bill/security deposit.

b) Breach of preventive maintenance schedule:- In case the agency fails to visit the site

and attend the preventive maintenance schedule within 7 days after the schedule date,

BSNL will arrange the same from recognized/ un-recognized agency from the market on

market rate basis and expenditure thus incurred will be deducted/ realized from the

contractors bill/security deposit.

AGREEMENT :

33. An Agreement in form Annexure – IV duly signed by both the BSNL and the contractor will be executed. In case the contractor fails to complete the work within

the period given in the work order or the work is unsatisfactory or does not carry

out the work, BSNL reserves the right to terminate the contract without any notice

and the contractor is not liable to be paid any compensation for the loss arising out

of such termination and such termination will be in addition to the contract. Works

which have not been completed within the time schedule or incomplete and

abandoned works will be given to any other approved and willing contractor.
