Addendum No. 1: July 13, 2020
The following modifications and clarifications are taken into consideration when tendering on this
Contract and when entering into the Form of Tender to do the work they shall become a part thereof.
INSTRUCTIONS:
1. Remove and replace Page 3 of the Tender Specifications document and replace with the revised
Page 3, Addendum No. 1.
2. Remove page A-1 and A-2 in the Tender and Bonding Information and replace with A-1 and A-2,
Addendum No. 1.
3. Remove page C-3 in the Form of Tender and replace with C-3, Addendum No. 1.
4. Remove Section E Special Provisions General Pages E-6 and E-7 and replace with revised
Section E Special Provisions General Pages E-6 and E-7, Addendum 1.
5. Remove Fisheries and Oceans Canada Letter dated June 22, 2020 from Appendix G and replace
with revised letter dated July 8, 2020.

1. Page 3 has been amended to clarify the changes to the Tender Deposit requirements. Bid bonds are
now an acceptable for of Tender Deposit, in addition to Certified Cheque or Bank Draft. The
requirement for the Tender Deposit has been amended to 10% upon submission of the submitted
Tender Form.

Each tender must be accompanied by a certified cheque or bank draft payable to the
Municipality, equal to or greater than the amount shown in the following table and must be
enclosed in the same envelope as the tender. Bid Bonds are also an acceptable form of deposit.

7. Attached to this Tender is a tender deposit in the amount specified in the "Tender and Bonding
Information" made payable to the Municipality/Owner, the proceeds of which shall, upon
acceptance of this Tender, constitute a deposit which must be forfeited to the Corporation if I/WE
fail to file with the Corporation the completed Bonds specified in the "Tender and Bonding
Information" and an executed Contract Agreement for the performance of the work within ten
(10) days from the date of notification of the acceptance of this Tender by the Corporation.
Section E: Special Provisions - General
1. Work Permits: The Contractor is advised that DFO has provided the Town with an updated Letter of
Authorization outlining additional timing restrictions should a temporary clean rock pad be installed
for construction access at the site. A Fisheries Act Authorization is currently underway to permit
construction of the platform within the required construction timing windows required, however, for
the purposes of bidding, the Contractor shall assume that access can only be provided by means of a
floating barge / platform as outlined in the Contract Documents.
Remove and replace section 23: Work Permits, with the following:
The Contractor is hereby advised that the Town of Mattawa has obtained the Permit –
“Development, Interference with Wetlands, and Alterations to Shorelines and Watercourses” from
the North Bay-Mattawa Conservation Authority (NBMCA). The conditions of the permit requires
the Contractor’s submission of the Erosion and Sediment Control Plan, as well as confirmation of
access and construction staging that will be implemented as part of the Contractor’s operations.

A copy of the Permit and conditions are included in the Tender Documents reference material.
The NBMCA was also consulted on the potential for an alternative access platform utilizing a
temporary working platform constructed within the water (temporary clean rock pad). An
amendment to the Permit is required including confirmation on the Contractor’s proposed details
should a temporary clean rock pad be desired. A condition for NBMCA approval would also be
contingent upon DFO approval and authorization of the work. The submission of a tender will be
construed as the Tenderer’s declaration that they have visited the site, are familiar with the
conditions and are aware of the Permit conditions and agency permit requirements should
amendment to the proposed work plan be proposed by the Contractor.
The Contractor is alerted to the conditions outline by Fisheries and Oceans Canada (DFO) for
environmental provisions under the Contract. No authorization or permitting is required from DFO
for work outlined in the Contract Drawings. Fisheries Act Authorization is currently underway for
use of an alternative access platform utilizing a temporary platform constructed in front of the
abutment from the base of the riverbed. A copy of the Letter of Advice for the barge and temporary
clean rock pad from DFO is included in the Tender Documents reference material. The Contractor
is hereby alerted that Fisheries Act Authorization may not be in place upon Contract Award and
therefore, the Contractor shall assume work shall be completed with barge access only.

No other permits or authorizations are deemed required for completion of the work, based on the
work plan and procedures outlined in the Contract Documents for completion of the work.
Appendix G: Agency Permits and Communications
1. DFO provided an updated Letter of Authorization for the work considering the temporary rock
platform as a construction access option.

1. Project Description
Repairs to the Pont Mauril Bélanger (Mattawa River) Bridge including, but not limited to:
Infill voids below the footing of the West Abutment, which will require underwater
pressure grouting and dive team to facilitate the work.
Install soil anchors and complete associated modifications including localized concrete
repairs to the West Abutment.
Install permanent rock protection at the West Abutment.
All provisions for access, traffic control, and environmental protection as required to
complete the work.

Bidder. It is the responsibility of the Bidder to regularly check with the distributor of this RFT for
any addenda that may be issued prior to the closing date/time.

Enquiries will be received until 5 p.m. five (5) business days prior to the tender closing. All
responses to enquiries will be made by the distributor a minimum of two (2) business days prior
to tender closing.
The distributor of the RFT will respond to all Proponents as may be necessary and appropriate.
No other representative from the Owner or Contract Administrator is to be contacted for
clarification on any aspect of this tender. No oral interpretation must be effective to modify any
of the provisions of the Contract Documents.
5. Tender Deposit
Each tender must be accompanied by a certified cheque or bank draft payable to the

6. Agreement to Bond
Each tender must be accompanied by the attached Agreement to Bond Form or acceptable
equivalent completed by the Bonding Company.
7. Schedule Submission
The Contractor will submit, at the time of tending, the Contractor’s Preliminary Schedule of
Work. The Contractor’s Preliminary Schedule of Work will provide for, at a minimum, a simple
bar chart of activities of major headings or working items derived from the Form of Tender.
8. Performance & Labour and Material Payment Bonds
When the Contract Agreement is signed, the successful Bidder must furnish a Performance Bond
for 100% of the tender amount and a Labour and Material Payment Bond for 50% of the Tender
amount. Both bonds to be issued by a bonding company. The Labour and Material Bond must be
as per Form 31, Labour and Material Payment Bond under Section 85.1 of the Construction Act.
The Performance Bond must be as per Form 32, Performance Bond under Section 85.1 of the
Construction Act.

6. I/WE agree that this offer is to continue open to acceptance until the formal Contract is executed
by the successful tenderer for the said work or until 30 calendar days after said opening,
whichever event first occurs; and that the Municipality/Owner may, at any time within that
period, without notice, accept this tender whether any other tender had been previously accepted
or not.
7. Attached to this Tender is a certified cheque in the amount specified in the "Tender and Bonding
Information" made payable to the Municipality/Owner, the proceeds of which shall, upon
acceptance of this Tender, constitute a deposit which must be forfeited to the Corporation if I/WE
fail to file with the Corporation the completed Bonds specified in the "Tender and Bonding
Information" and an executed Contract Agreement for the performance of the work within ten
(10) days from the date of notification of the acceptance of this Tender by the Corporation.
8. I/WE hereby agree that notification of acceptance of this Tender must be in writing, and may be
sent by prepaid post, and if sent by prepaid post, acceptance must be deemed to have been made
on the date of the mailing of such notification.

with the Plan/Profiles, Standard Drawings, Specifications, Special Provisions and General

The Fire Department must be immediately notified of any gas leak and is available to assist with
other emergencies on the work site.
9. ROAD AUTHORITY/MUNICIPAL/BUSINESS SIGNS
The Contractor must carefully remove and satisfactorily replace all route marker, business
advertising, pedestrian and other identification and traffic signs which must be removed in order to
carry out the work. The Contractor is to co-ordinate with the Contract Administrator to verify
relocation points.
All legal traffic signs must be maintained. If they are to be moved, the local road authority must
be consulted and approve.
All costs associated with the removal, protection and relocation of signs will be deemed to be
included in the Contract price for the items associated with this requirement.
10. CONTRACTOR'S WORK AND STORAGE AREAS
The Contractor must make all necessary arrangements for his own work and storage areas at or
near the site.
11. WARRANTY PERIOD
The Contractor will be responsible for the warranty of the Work for a 12-month period in
accordance with OPSS.MUNI 100 GC 7.16 Warranty.
12. TREE PROTECTION
Protection from the Contractor’s operations of trees not designated for removal must be ensured
by, but not restricted to the following:
The Contractor must ensure that his operations do not cause flooding or sediment deposition on
areas where trees not designated for removal are located.
Unless the Contract requires work within the dripline of trees not designated for removal,
equipment must not be operated within that dripline area. When the Contract requires work within
the dripline of trees not designated for removal, operation of equipment within that dripline area
must be kept to the minimum necessary to perform the work required.
Equipment and vehicles must not be parked, repaired or refuelled, nor must construction materials
be stored, or earth materials be stockpiled within the dripline areas of any tree not designated for
removal.
The dripline of a tree must be considered to be the ground surface directly beneath the tips of its outmost branches.
13. WORK PERMITS

14. CONTRACT LIMITS
The Owner reserves the right to reduce or extend the limits of this Contract, should the Owner
determine it is necessary at their sole discretion and to coincide with the funds available.
Any change in the Contract limits or extent of the work must be considered as relating solely to
quantities and payment for the work must be made at the appropriate Contract unit price. In the
case of an extension of the Contract limits, the Contractor will be eligible for a pro rata extension
of time based on the value of the additional work when the Contract unit prices are applied to the
additional quantities.
The application of Subsection GC 8.01.02 of the OPSS.MUNI General Conditions of Contract, will
be based on the adjusted tender quantities subsequent to the change in the Contract limits.
15. CONTRACTOR'S SCHEDULE OF WORK
The Contractor will submit, at the time of Tendering, the Contractor’s Preliminary Schedule of
Work. The Contractor’s Preliminary Schedule of Work will provide for, at a minimum, a simple
bar chart of activities of major headings of working items derived from the Form of Tender.
Within 10 days of Contract Award, the Contractor must prepare and update, as required, a Detailed
Schedule of Work of the operations, indicating the critical path and controlling operations, the
proposed methods of construction and sequence of work and the time the Contractor proposes to
complete the various items of work within the time specified in the Contract Documents. If, during
the implementation of the Works, the Contractor’s schedule is materially affected by changes in
the work, the Contractor shall submit an updated construction schedule, if requested by the Contract
Administrator, within 7 days of the request. This updated schedule must show how the Contractor

Implementation of Measures to Avoid and Mitigate the Potential for
Prohibited Effects to Fish and Fish Habitat
Dear Francine Desormeau:
The Fish and Fish Habitat Protection Program (the Program) of Fisheries and Oceans
Canada (DFO) received your proposal on May 11, 2020. We understand that you propose
to:
Complete emergency repairs on the bridge west abutment due to severe
undermining;
Install a temporary (up to 2 months) access pad (150 m2 above water; 300 m2 at
base), as a result of insufficient clearance for equipment under the bridge; and
Repairs include placement of formwork around the base of the existing abutment,
structural injections, placement of soil anchors, and placement of rock riprap at
base of west abutment from downstream and upstream to prevent future scour.
Works will be performed from shore, barge, temporary access pad, and with
divers.
We understand the following aquatic species listed under the Species at Risk Act may use
the area in the vicinity of where your proposal is to be located:
Hickorynut Mussel (Obovaria olivaria) listed as Endangered
Lake Sturgeon (Acipenser fulvescens) listed as Threatened
Our review considered the following information:

Your proposal has been reviewed to determine whether it is likely to result in:
the death of fish by means other than fishing and the harmful alteration, disruption
or destruction of fish habitat which are prohibited under subsections 34.4(1) and
35(1) of the Fisheries Act; and
effects to listed aquatic species at risk, any part of their critical habitat or the
residences of their individuals in a manner which is prohibited under sections 32,
33 and subsection 58(1) of the Species at Risk Act; and
the importation, possession, transportation or release of aquatic invasive species set
out in Part 2 of the schedule of the Aquatic Invasive Species Regulations which are
prohibited under sections 6, 7, 8 and 9 of the Regulations; and
the introduction of aquatic species into regions or bodies of water frequented by fish
where they are not indigenous, which is prohibited under section 10 of the Aquatic
Invasive Species Regulations.
The aforementioned impacts are prohibited unless authorized under their respective
legislation and regulations.
To avoid and mitigate the potential for prohibited effects to fish and fish habitat (as listed
above), we recommend implementing the measures listed below:
Time in-water works, undertakings and activities observing the Restricted Activity
Period (RAP - Northeast ON: Spring Spawning Period: April 1 - June 15; Fall
Spawning Period: September 1 - June 15) to protect fish, including their eggs,
juveniles, spawning adults and/or the organisms upon which they feed;
Limit the duration of in-water works, undertakings and activities so that it does
not diminish the ability of fish to carry out one or more of their life processes (i.e.,
spawning, rearing, feeding, migrating);
In-water works, undertakings, and activities have been designed and planned such
that loss or disturbance to aquatic habitat is minimized and sensitive spawning
habitats are avoided, and impacts to SARA-listed aquatic species, their residences
or critical habitat are avoided;
Retain a qualified environmental professional to ensure appropriate protocols are
applied and applicable permits for relocating fish are obtained and to capture any
fish trapped within an isolated/enclosed area at the work site and safely relocate

them to an appropriate location in the same waters. Fish may need to be relocated
again, should flooding occur on the site;
Capture, relocate and monitor for fish trapped within isolated, enclosed, or
dewatered areas;
Limit impacts on riparian vegetation to those approved for the work, undertaking
or activity:
o Do not remove riparian vegetation if the riparian area is identified as part
of critical habitat of an aquatic listed species at risk;
o Clearing of riparian vegetation should be kept to a minimum: use existing
trails, roads or cut lines wherever possible to avoid disturbance to the
riparian vegetation and prevent soil compaction;
o Limit access to banks or areas adjacent to waterbodies;
o Prune or top the vegetation instead of grubbing/uprooting;
o Limit grubbing on watercourse banks to the area required for the footprint
of works, undertaking or activity;
o Construct access points and approaches perpendicular to the watercourse
or waterbody;
o Remove vegetation or species selectively and in phases;
o Re-vegetate the disturbed area with native species suitable for the site;
Replace/restore any disturbed habitat features and remediate any areas impacted
by the work, undertaking or activity;
Maintain an appropriate depth and flow (i.e., base flow and seasonal flow of
water) for the protection of fish and fish habitat;
Develop, implement, and maintain an erosion and sediment control plan to
minimize sedimentation of the waterbody during all phases of the work,
undertaking or activity:
o Install effective erosion and sediment control measures prior to beginning
of work, undertaking or activity in order to stabilize all erodible and
exposed areas;
o Conduct all in-water works, undertakings or activities in isolation of open
or flowing water to reduce the introduction of sediment into the
watercourse;
o Schedule work to avoid wet, windy and rainy periods (and heed weather
advisories) that may result in high flow volumes and/ or increase erosion
and sedimentation;
o Inspect and maintain regularly the erosion and sediment control measures
and structures during all phases of the project;
o Operate machinery on land, or from barges or on ice;
o Monitor the watercourse to observe signs of sedimentation during all
phases of the work, undertaking or activity and take corrective action;
o Immediately stabilize shoreline or banks disturbed by any activity
associated with the project to prevent erosion and/or sedimentation,
preferably through re-vegetation with native species suitable for the site;
Develop and implement a response plan to avoid a spill of deleterious substances:

o Plan activities near water such that materials such as paint, primers,
blasting abrasives, rust solvents, degreasers, grout, poured concrete or
other chemicals do not enter the watercourse;
o Ensure that building material used in a watercourse has been handled and
treated in a manner to prevent the release or leaching of substances into the
water that may be deleterious to fish;
o Keep an emergency spill kit on site during the work, undertaking or
activity;
o Ensure that machinery and equipment arrives on site in a clean condition
and is maintained free of fluid leaks, invasive species and noxious weeds;
o Wash, refuel and service machinery and store fuel and other materials for
the machinery in such a way as to prevent any deleterious substances from
entering the water;
o Remove all construction materials from site upon project completion;
If replacement rock reinforcement/armouring is required to stabilize eroding or
exposed areas, then ensure that appropriately-sized, clean rock is used; and that
rock is installed at a similar slope to maintain a uniform bank/shoreline and
natural stream/shoreline alignment;
Ensure that all in-water works, undertakings, and activities, or associated in-water
structures, do not interfere with fish passage, constrict the channel width, or
reduce flows, or result in the stranding or death of fish;
Minimize the removal of natural woody debris, rocks, sand or other materials
from the banks, the shoreline or the bed of the waterbody below the ordinary high
water mark. If material is removed from the waterbody, set it aside and return it to
the original location once construction activities are completed;
Prior to the installation of temporary and permanent structures in-water, utilize
divers to screen riverbed substrate and mussels presence;
In cases where sand substrate are encountered, a net should be used to sweep the
bottom of the river to investigate if mussels are present, if Hickorynut Mussel
presence is confirmed, then scouring so mussels can be washed out;
Avoid fording of the watercourse, if no alternative crossing method is available,
and repeated crossings of the watercourse are required, construct a temporary
crossing structure;
Aquatic invasive species are introduced and spread through transporting sands and
sediments and using contaminated construction equipment. To prevent aquatic
invasive species during construction in aquatic environment: clean, drain and dry
any equipment used in the water, and never move organisms or water from one
body of water to another.
Provided that you incorporate these measures into your plans, the Program is of the view
that your proposal will not require an authorization under the Fisheries Act or the Species
at Risk Act.
Should your plans change or if you have omitted some information in your proposal,
further review by the Program may be required. Consult our website (http://www.dfo-
mpo.gc.ca/pnw-ppe/index-eng.html) or consult with a qualified environmental consultant

to determine if further review may be necessary. It remains your responsibility to remain
in compliance with the Fisheries Act, avoid prohibited effects on listed aquatic species at
risk, any part of their critical habitat or the residences of their individuals, and prevent the
introduction of non-indigenous species.
It is also your Duty to Notify DFO if you have caused, or are about to cause, the death of
fish by means other than fishing and/or the harmful alteration, disruption or destruction of
fish habitat. Such notifications should be directed to (http://www.dfo-mpo.gc.ca/pnw-
ppe/CONTACT-eng.html).
We recommend that you notify this office at least 10 days before starting your
project. A copy of this letter should be kept on site while the work is in progress. It
remains your responsibility to meet all other federal, territorial, provincial and municipal
requirements that apply to your proposal.
