    I. INSTRUCTIONS TO BIDDERS: I.1. The prescribed non-transferable Bid Documents can be downloaded from IIMB Website

    www.iimb.ac.in/tender_notice during the period mentioned at Col.No.3.

    I.2. The Bid Document fee shall be submitted online according to the bank details of IIMB mentioned in this document.

    I.3. The Bid Document shall be submitted up to 15:00 hrs on the date mentioned above. The Bid Documents should be addressed to the Chief Manager (Infrastructure), Indian Institute of Management Bangalore, Bannerghatta Road, BANGALORE-560076, and the technical bid will be opened on the same day in the presence of the Bidder or their authorized representative.

    I.4. Please note, the authorized representatives should carry the letter of authorization for attending the Technical Bid opening. The authorization letter should be in their company letterhead issued in the name of the authorized representative, duly signed by the authorized representative with his name in CAPITALS and attested by the owner of the company. (Format of the letter is given under Proforma A).

    I.5. Bid Documents will also be accepted by post. However, Indian Institute of Management Bangalore (IIMB) shall not be responsible for late receipt of Bid Documents by post. IIMB will not take any responsibility whatsoever in respect of Bid Documents lost or delayed in transit by post or otherwise.

    I.6. Bid Documents duly completed in all respects shall be dropped in the Tender Box kept for

    the purpose in the Estate Section, II Floor, Admin Building, Indian Institute of Management Bangalore before the date and time indicated above. The Bids received after 15.00 hours shall be summarily rejected.

    I.7. Late Bids and conditional Bids are liable for rejection.

    I.8. If the last date of submission of Bid Document is declared as a Public Holiday by IIMB, the next

    official working day shall be deemed as the last date of submission of Bid Document.

    I.9. The bidder shall enter the rates only in figures in the online BOQ and need not enter the rates in words as the sheet will be software generated and total amount and amount in words will be calculated and displayed automatically by the computer itself.

    I.10. The period of contract is ONE YEAR from the date mentioned in the work order, to be placed on the successful bidder.

    I.11. A. The bidder should return the same document as downloaded from IIMB website without any modifications in the same, with seal and sign on every page after filling up the information wherever necessary.

    B. If any alternations are made by the bidder in the Tender Documents, such Tender will be liable for rejection.

    I.12. The successful bidder is requested to sign the work order prepared based on the quoted rates,

    placed on him by the accepting officer.

    I.13. Part-B: Financial Bid. (Will be issued only to the bidders who are qualified in Technical Bid).

    I.14. Financial Bid Document (Part-B): Rates should not be entered in the hard copy of the

    Financial Bid Document as the rates are to be entered only online and not in the hard copy.

    I.15. If the bidder indicates any commercial or technical conditions or clarifications of any sort in the Technical Bid or Financial Bid (Hard Copy), such tender is liable to be summarily rejected. Firms shall not contact IIMB on any matter relating to their Bid from the time of opening of the Technical Bid till the contract is awarded.

    I.16. However, the clarifications may be asked either telephonically or through e-mail till the submission of Technical Bid Document or in the Pre-Bid Meeting. Queries / Request received after the opening of the Technical Bid and/or other than the Pre-Bid Meeting will not be entertained.

    I.17. The bidders can ask for any clarification regarding the tender in writing through e-mail to the e-mail ids specified in the document, before submitting the Technical Bid only. Any reply issued by IIMB in response to clarification asked for by the bidders shall form an integral part of the Bid Document and it may amount to an amendment of relevant clauses of Bid Document. A copy of such clarification may be enclosed along with Bid Document for ready reference.

    I.18. PERMANENT EARNEST MONEY DEPOSIT (PEMD) / TENDER DOCUMENT FEE The bidder shall submit the PEMD / Tender Document Fee online. Submission of PEMD / Tender Document Fee Online: For online submission of PEMD / Tender Document Fee, the bidder shall pay the amount through RTGS / NEFT.

    Any tender not accompanied by an acceptable Permanent Earnest Money Deposit and Tender Document Fee and not secured in the payment modes as indicated below shall be rejected by the IIMB as non-responsive.

    The Permanent Earnest Money Deposit shall be forfeited:

    a) If the bidder withdraws from the Tender after tender opening during the period of tender validity; b) In the case of a successful bidder, if the bidder fails within the specified time limit to sign the

    Agreement; c) In case the bidder, after quoting, withdraws from the tender or refuses/delays in commencing the

    work or stops the work abruptly, such bidder’s PEMD/ SD, as the case may be, will be forfeited. d) If the bidder withdraws his offer after submission of his tender, fails to start the work in accordance

    with the instructions of the Officer-in-Charge, the Earnest Money deposited by him may be forfeited without prejudice to any other remedy available to the company under the contract.

    Permanent Earnest Money Deposit is compulsory for all the bidders including State Government / Statutory Bodies / Enterprises / Undertakings etc.

    Bidders may note the fact that their registrations with any other authority do not entitle them from exemption from payment of PEMD. RETURN OF PEMD: Unsuccessful Bidders: The Permanent Earnest Money Deposit (PEMD) will be returned to the unsuccessful bidders after the issue of Work Order to L1 Bidder through RTGS/NEFT.

    Bank Details: The bidders are required to submit the bank details along with the Technical Bid. The bank details are required to be filled in and submitted in the company letterhead, duly attested by the authorized person of the company and the banker. The bank details should be accompanied by a cancelled cheque duly attested by the banker. (The format of vendor bank detail from has been given in the document vide Proforma E). Successful Bidder: In case of submission of PEMD through Online Transfer: PEMD will be returned to the L1 bidder after completion of the term contract period of one year subject to satisfaction on the work as per the terms and conditions of the contract.

    I.19. SECURITY DEPOSIT:

    5% of the bill value will be deducted as security deposit from each running bill. This security deposit will be refunded AT PAR at the end of defects liability period of each work subject to satisfaction on the work as per the terms and conditions of the contract, deducting the claims if any.

    I.20. DEFECTS LIABILITY PERIOD: Pest control works under Term Contract will be distributed among different contractors. Defects Liability Period will be six (6) months commencing from the date of successful completion of any particular work assigned to a single contractor. Hence, start date and end date of defects liability period under Term Contract will be different based on the work awarded to each contractor.

    I.21. Only the bidders qualifying in the Technical Bid are allowed to participate in the Financial Bid.

    I.22. Incomplete details of the Technical Bid will be rejected summarily. IIMB has its right to reject any bid without assigning any reason therefor.

    I.23. Non-compliance with any of the conditions set forth herein above will result in the tender being rejected.

    I.24. Any other information required by the Bidder can be obtained from the Estate Office, IIMB during

    working hours on any working day.

    I.25. If the Headquarters of the successful Bidder are elsewhere other than the place of work, he shall have duly authorised Agent at the place of work from the commencement of the work until it is fully completed. Such Agent shall be authorised to act on behalf of the successful Bidder to operate and execute terms of contract.

    I.26. Bidder should check for any correction or Corrigendum related to this Bid Notice on Website before submitting their offer.

    I.27. The successful bidder should enter into agreement within 15 days of issue of Work Order. The value of the Agreement will be intimated after issue of Work Order.

    II. ELIGIBILITY CRITERIA The Bidders are requested to submit the following in the ‘TECHNICAL BID PART (Part A)’. The prospective bidder who meets the following requirements will be considered as qualified and will be invited to participate in the Online Closed Financial Bid. IIMB has the right to disqualify those bidders who do not meet these requirements.

    II.1. Financial position (Essential Criterion): Average annual financial turnover (during the last three financial years) ending 31st March every year should be at least Rs.8 Lakhs (Rupees Eight lakhs only). IT returns or Audited balance sheets in support of the three years’ financial status of the company shall be submitted.

    II.2. The bidder should have the valid Labour License. Copy of the same should be submitted along

    with Technical Bid. II.3. ESI & EPF Registration Copies: Bidder should have PAN No & should fulfill all statutory

    compliances like PF, ESI registration. The bidder must be registered under PF Act, ESI Act and Shops & Establishments Act. Copies of registration papers along with the code numbers attached to the bidder/company should be provided. The copies of the same should be furnished along with the Technical Bid.

    II.4. Copy of Registration with Labour Commissioner: The vendor should submit the copy of the

    Registration Certificate.

    II.5. After submission of the Technical Bid, the supporting documents will be verified for satisfaction of Essential Criterion. The Bid Documents of only those bidders who satisfy the requirements of Essential Criterion will be evaluated as per the statement given under IV.6.

    II.6. The firm shall have GST No. issued by the competent authority.

    II.7. Bidders should not carry any adverse remarks in IIMB or carry other similar report from any authority.

    III.1.1 IIMB will carry out the evaluation of bids of only those bidders who satisfy the above criteria on the

    basis of their responsiveness to the Terms of Reference, applying the evaluation criteria and marking system specified in the Data Sheet. Each responsive bid will be given a technical score. A bid considered unsuitable will be rejected at this stage if it does not respond to important aspects of the Terms of Reference or if it fails to achieve the minimum technical score indicated.

    III.1.2 Only those bidders who score at least 65 marks will be qualified for participation in the

    Financial Bid and they will be issued the Financial Bid Document (Hard copy).

    III.2. Explanation for the above mentioned criteria (Serial numbers given below are according to the serial numbers given in the Technical Evaluation Statement above):

    Sl.No.1: Experience in Similar Class of Work: Bidder should provide complete work details for the previous five years as per the Proforma –H. The bidder should enclose work completion certificates / work orders in support of relevant experience. (a) Single Work – Rs.18.00 lakhs – The bidder should have completed any one pest control work

    costing Rs.18.00 lakhs and above (excluding GST). The work should have been awarded as a whole. Stage-wise work orders issued for a single work will not be considered.

    (b) Two Works – Rs.11.25 lakhs – The bidder should have completed any two pest control works each costing Rs.11.25 lakhs and above (excluding GST). Each work should have been awarded as a whole. Stage-wise work orders issued for a single work will not be considered.

    (c) Three Works – Rs.9.00 lakhs – The bidder should have completed any three pest control works costing Rs.9.00 lakhs and above (excluding GST). Each work should have been awarded as a whole. Stage-wise work orders issued for a single work will not be considered.

    Sl.No.2: Work Experience:

    (a) In any Institute of Higher Learning such as IIMs / IITs / NITs or equivalent – The bidder should have completed the similar work in these institutions. (Work Completion Certificate should be attached as a proof of this work).

    (b) In Central or State Govt. / Central or State Govt. Autonomous Body / Central or State PSUs / PWDs / CPWDs / MES / Railways / Public Sector – The bidder should have completed the similar work in any of the above mentioned Government organizations. (Work Completion Certificate should be attached as a proof of this work).

    (c) In Reputed Private Organizations – The bidder should have completed the similar works in any private organization.

    IV. SEALING AND SUBMISSION OF BID DOCUMENTS

    For sealing and submission of the Bid Documents, the Bidders shall follow the procedure as indicated below:

    The bidders are required to submit three separate sealed envelopes, marked as under: Envelope -1 should contain: Details of Document Fee paid (Name of Work, Name and Address of the Bidder and the phrase “Document Fee” should be super-scribed on the envelope) Envelope-2 should contain: Details of PEMD paid (Name of Work, Name and Address of the Bidder and the phrase “Permanent Earnest Money Deposit” should be super-scribed on the envelope) Envelope-3 should contain: ‘Original Technical Bid Document (as downloaded from

    IIMB website) & prequalification Information including blank Price Bid without quoting rates’

    These three envelopes shall be wrapped in an outer envelope which should be properly sealed with wax and addressed to designated officer duly super-scribing on the cover, the name of the work, last date and time of submission and opening of the Bid and the name and address of the Bidder. The address of the designated officer of IIMB is as follows: Chief Manager (Infrastructure)

    Indian Institute of Management Bangalore, Bannerghatta Road, Bangalore -560 076 Note: If the outer cover of any tender is not addressed to the prescribed person mentioned in the tender conditions, such tenders will not be accepted. No responsibility will be accepted by IIMB for the opening out of the envelopes due to wrong / bad / defective sealing or marking or other causes contrary to the aforesaid instructions.

    IIMB / Officer may, at his discretion, extend the date of submission of the Bid Document by

    amending the Bid Documents in which case all rights and obligations of IIMB and the Bidder previously subject to the original date shall thereafter be subject to the new deadline as extended.

    If the last date for submission of Bid is declared as a Public Holiday by IIMB, the next official

    working day shall be deemed as the last date for submission of Bid. Bids as sealed above shall be submitted in person to the designated office. The bids may also be

    submitted by post. The bidders submitting the tender documents by post should post the documents early so that the documents reach IIMB before the scheduled date of submission. However, IIMB cannot take any responsibility for delay in transit. The tender documents received late i.e. after the last date of submission will not be considered.

    As the bids are to be submitted in closed sealed covers, they cannot be submitted through mail or

    fax. Tenders received through mail or fax if any, will be summarily rejected. V. LATE BIDS Any Bid received by IIMB after the deadline prescribed for submission of Bids will be returned

    unopened to the Bidder.

    VI. IIMB reserves the right to accept or reject any application and to annul the registrations process and reject all the applications at any time, without assigning any reason or incurring any liability to the applicants.

    VII. Other Conditions: a) The bidder should possess GST Registration Certificate and furnish the copy of the same along

    with the Technical Bid. b) Bidders who are debarred/ blacklisted in other utilities in India will not be considered. The bidder shall

    submit the certificate the to the effect that the bidder is not blacklisted by any Central / State

    Government organization / DGS&D / NCCF / Kendriya Bhandar / PSU during the last three years. Certificate should be given in the bidder’s company letterhead. (Please refer Proforma J)

    c) The bidder shall submit all the necessary documentary evidence to establish that the Bidder

    meets the above qualifying requirements.

    VIII. The bidders should have office based in Bangalore. Details of infrastructure in Bangalore (offices, No. of employees etc.).

    IX. The work should be immediately carried out as and when the work is awarded.

    X. The labour deployed by the vendor should possess Aadhar Card. The copy of the same shall be submitted on demand from IIMB.

    XI. Additional Conditions:

    XI.1 Bidder should provide information regarding any current litigation in which the bidder is involved.

    XI.2 In the event of the tender being submitted by a partnership bidder, the tender must be signed separately and legibly by each partner or member of the bidder, above their full names and current addresses, or, in their absence, the tender must be signed by a person holding Power of Attorney on behalf of the bidder concerned. In the latter case, a copy of the power of attorney duly attested by a Gazetted Officer must accompany the tender. Certified true copy (attested only by Gazetted Officer) of the partnership deed, full names and current addresses of all the partners of the bidder must be enclosed along with the tender submitted by the partnership bidder. The Partnership Deed must have been entered into before the date of notification.

    XI.3 If the application is made by a limited company or a limited Corporation, it shall be signed by duly authorized person holding the power of attorney which power of attorney shall accompany the application. Such limited company or corporation will be required to furnish satisfactory evidence of its existence before the contract is awarded.

    XI.4 If the application is made by a group of bidders, it shall be accompanied by a legal document signed by all parties to the joint venture/consortium considering therein a clear and a definite manner the proposed administrative arrangements for the management and execution of contract, the delineation of duties, responsibilities and scope of work to be undertaken by each such party, the authorized representative of the joint venture and an undertaking that the several parties are jointly and severally liable to the employer for the performance of the contract together with the details of experience and past performance of each of the parties to the joint venture on works of a similar nature within the past three years, current works on hand and other contractual commitments. Proof of the Registration of the Joint Venture shall also accompany this Tender, failing which the tender will be rejected by the accepting authority.

    XI.5 In the case of joint ventures, the Annual Maintenance Contracts executed by them after the registration of the joint venture will only be considered for Technical Evaluation.

    XI.6 Wherever the bidder is a joint venture of two or more bidders, a statement signed by all parties

    to the joint venture, of the proposed administrative arrangements for the management and execution the contract, the duties, responsibilities and scope of work to be undertaken by each party, the authorized representative of the joint venture, and an undertaking that the several parties are jointly and severally liable to the Employer for the performance of the contract.

    XI.7 Partnership or a limited company or corporation or a joint venture or a Consortium should have been in existence before the date of advertising this tender.

    XI.8 The bidder applying as a company or a joint venture or any other bidder / organization / Consortium should have the similar work experience in its own name.

    XI.9 MOUs shall not be considered.

    XII. CONDITIONS OF CONTRACT XII.1. Based on the works executed during the past three years, the quantum of work will be arrived

    at. Quantity mentioned in the BOQ is subject to vary based on the requirement at the time of execution.

    XII.2. Only the item rates will be binding on the bidder throughout the contract, but not the quantities

    in any case. XII.3. The tender is restricted to only local bidders to ensure that bidders are available immediately on

    call basis, to execute the work without any hindrance, by immediately mobilizing the men and material.

    XII.4. Sub-letting of the work is not allowed in any case. XII.5. The bidders would be pre-qualified based on their credentials submitted in the Technical Bids. XII.6. The Pre-qualified bidders would be allowed to submit their bids online and L1 would be arrived

    at on the basis of the rates quoted by the bidders without considering the GST element. XII.7. After finalization of the lowest rates for each item of works, the rates will be kept constant for a

    period of one year. XII.8. However, the period shall be extended further on mutual agreement of the terms and conditions

    of the term contract. XII.9. All the bidders who have participated in the commercial bids shall be called for negotiation and

    will be offered to execute the works at the lowest rates received among the quotes received for each category of work among all the bids which are applicable for a period of one year.

    XII.10. After due negotiation and acceptance of rates by the bidders, the record of negotiation and

    acceptance from the agencies will be documented which forms part of the contract. XII.11. Term contract will not be restricted to single agency. It will be distributed among the three

    bidders who have quoted the lowest amount i.e. L1, L2 and L3, who have accepted the rates finalized for the Term Contract, based on the requirements and nature of work. The distribution of work is at the whole discretion of the Chief Manager (Infrastructure) and this will be binding on the contractors. The work will be distributed on different slab basis with variation of 15% - 20% plus or minus as deemed required for completion of the work.

    XII.12. Lowest rate per each item of work will be arrived at after comparing the rates quoted by

    all the bidders. The total amount will be calculated by adding these lowest quoted rates per each item and the amount thus arrived at will be considered as Justified Amount. Work will be awarded to these three bidders at the justified rate in the following manner:

    XII.12.a) 50% to 60% of the work will be awarded to L1 bidder, 30% to 40% of the work will be

    awarded to L2 bidder and 10% to 20% of the work will be awarded to the L3 bidder provided they accept the offer to work at the justified amount.

    In case only two bidders (L1 and L2) agree to work at the justified amount, 55% to 65% of the total work will be awarded to L1 bidder and 30% to 40% of the work will be awarded to L2 bidder.

    In case only L1 bidder agrees to work at the justified amount, 100% work will be awarded

    to him. In case L1 bidder also does not agree to work at the justified amount, he will be awarded

    the work at the L1 quoted amount (rates quoted by L1 bidder and not the justified amount).

    XII.12.b) Bill of Quantities has been divided into three parts Part A, Part B and Part C. In case the three lowest quoted bidders (L1, L2 and L3) accept to carry out the work at the justified amount, works under Part C will be awarded to L1 bidder, works under Part A will be awarded to L2 bidder and works under Part B will be awarded to L3 bidder.

    If only two bidders (L1 and L2) accept to work at the justified amount, works under Part B and Part C will be awarded to L1 bidder and works under Part A will be awarded to L2 bidder. In case only L1 bidder agrees to work at the justified amount, whole work (Part A, Part B and Part C) will be awarded to L1 bidder.

    In case L1 bidder also does not agree to work at the justified amount, he will be awarded the whole work at the L1 quoted amount (rates quoted by L1 bidder and not the justified amount).

    XII.13. In the event none of the bidders accepting the lowest rates as applicable for term contract duly

    compared among the quotes received from all the bidders for each item individually, the Institute shall reserve its rights to award the entire work to L1 bidder at the lowest quoted amount or to cancel the same.

    XII.14. The general terms and Conditions of Contract and technical specifications for all the civil works

    adopted shall be applicable for the term contract. XII.15. Any other unforeseen works desirable to be executed based on Site Conditions, which are not

    covered under the scope of term Contract shall be treated as separate and to be taken up independent of term contract and shall be executed by the same bidder based on

    a) SR plus tender percentage for items SR available. b) Derived market rates based on the market rate analysis.

    XII.16. The estimate is prepared based on SR applicable while awarding the term contract for a period

    of one year. If any revision is notified in SR during the period of term contract, the revision in prices to that extent (revision in rates plus the revision in weightage) shall be applicable for the rates finalized for term contract.

    XII.17. Payment Terms: In consideration of the work done under this Agreement, IIMB agrees to pay the Bidder at different stages as set forth in the Tender in that behalf. The Bidder shall be responsible for payment of all applicable Taxes on the works contract.

    i. The Bidder shall promptly raise an invoice to IIMB on the completion of work at each stage as per the Tender terms before the 10th day of the subsequent month, for the works completed in the previous month.

    ii. IIMB shall pay such invoice within thirty (30) working days from the date of receipt of the undisputed invoice.

    iii. On receipt of the Final payments, the Bidder shall furnish a “No Demand Certificate” to IIMB. XII.18. Running Account Remittance: (R A R)

    Payment in respect of work done will be based on the certificate from Officer-in-charge of the concerned department as to the value of work done. This certificate should be supported by a bill from the bidder indicating the quantities of the work done and the rates adopted for evaluation of work or percentage of work.

    Memorandum of Payment: a. Total value of work done --------------- b. Deduct total value of the work done upto previous bills --- c. Deduct Security Deposit ------------ 5% d. Deduct for Income Tax -------------- 2% e. Deduct for Labour welfare cess ---------------- 1% f. Deduct for Material advance paid if any. ----------------- g. Deduct for Mobilisation advance with interest, if any. ------ h. Deduction of Electricity & water charges supplied, if any--- i. Any other dues recoverable by IIMB from the Bidder under existing or any previous contract.---------

    During the progress of work of each contract, the bidder shall prefer claims giving details of work done, rate and value to the Officer-in-charge. These claims are called RAR bills and RAR payments will be normally made once in a calendar month. The work is divided into three parts department-wise viz. Part A, Part B and Part C. The bills for the work carried out for the particular department (i.e. Part A work, Part B work or Part C work) should be billed separately and submitted to the concerned departmental heads. These bills will be checked by the Officer-in-Charge of the concerned departments with reference to either the percentage of the value of work done or on the basis of actual measurements wherever available and recommend payment of the bill with due adjustment for recoveries and RAR payment (including material advance) effected.

    XII.19. PRE-FINAL RAR’S:

    A pre-final RAR is raised only when the work is completed and the complete measurement is recorded in the MB’s by the Officer-in-charge duly accepted by the bidder. Pre-final RAR will be sent to accounts department by the Officer-in-charge only after the check measurements and endorsement in the MB’s.

    XII.20. FINAL BILL:

    On completion of the work, the complete measurements are recorded in measurement books and accepted by the bidder. There upon a final bill shall be submitted by the bidder within ONE MONTH from the date of completion of the work, so as to ensure payment being made before the expiry of six months from the date of completion of work. A ‘NO DEMAND CERTIFICATE ‘against the company under the contract.

    XII.21. ADHOC PAYMENTS:

    If payment for final bill could not be arranged within 6 months from the date of the completion of the contract for reasons other than undue delay in submitting the final bill by the bidder, the Accounts Department of the Division will make an adhoc payment against the final bill, based on the recommendations I\of the Officer-in-charge. The following guidelines may be adopted while making such adhoc payment.

    a) Such payment should normally exceed 95 % of the final bill value. b) All conditions of contract and recoveries to be effected should have been taken care of in the

    final bill. c) If a bidder has no other contract concurrently running in the Division. Adhoc payment need not

    be made. Instead, final bill should be expedited and paid at least within six months from the date of completion of the contract.

    XII.22. MEASUREMENTS OF WORK DONE:

    Officer-in-Charge shall, except as otherwise provided, ascertain and determine by measure the value in accordance with the contract of work done.

    All measurement of all terms having financial value shall be entered in Measurement book and / or level field book so that complete record is obtained of all works performed under the contract.

    All measurements and levels shall be taken jointly by the Officer-in-Charge or his authorized representative and by the bidder or his authorized representative from time to time during the progress of the work and such measurements shall be signed and dated by the Officer-in-Charge and the bidder or their representative in token of their acceptance. If the bidder objects to any of the measurements recorded, a note shall be made to that effect with reason and signed by both the parties.

    If for any reason the bidder or his authorized representative is not available and the work of recording measurements is suspended by the Officer-in-Charge on his representative, the Officer-in-Charge and the Department shall not entertain any claim from bidder for any loss or damages on his account. If the bidder or his authorized representative does not remain present at the time of such measurements after the bidder or his authorized representative has been given a notice in writing three (3) days in advance or fails to countersign or to record objection within a week from the date of the measurement, then such measurements recorded in his absence by the Officer-in-Charge or his representative shall be deemed to be accepted by the Bidder.

    The bidder shall without extra charge, provide all assistance with every appliance, labour and other things necessary for measurements and recording levels.

    Except where any general or detailed description of the work expressly shows to the contrary measurements shall be taken in accordance with the procedure set forth in the specifications notwithstanding any provision in the relevant standard method of measurement issued by the Bureau of Indian Standards and if for any item no such standard is available, then mutually agreed method shall be followed.

    The bidder shall give not less than seven days’ notice to the Officer-in-Charge or his authorized representative before covering up or otherwise placing beyond the reach of measurement of any work in order that the same may be measured and correct dimensions thereof be taken before the same is covered up or placed beyond the reach of measurement and shall not cover up and place beyond reach of measurement any work without consent in writing of the Officer-in-Charge or his authorized representative who shall within the aforesaid period of seven days inspect the work and if any work shall be covered up and placed beyond the reach of measurement without such notice having been given to the Officer-in-Charge’s consent being obtained in writing the same shall be uncovered at the Bidder’s expense, or in default thereof no payment or allowance shall be made to such work or the materials with which the same was executed.

    Officer-in-charge or his authorized representative may cause either themselves or through another officer of the department to check the measurements recorded jointly or otherwise as aforesaid and all provisions stipulated herein above shall be applicable to such checking of measurements or levels.

    It is also a term of his contract that recording of measurement of any term of work in the measurement book and/or its payment in the interim, on account or final bill shall not be considered as conclusive evidence as to the sufficiency of any work or material to which it relates nor shall it relieve the bidder from liabilities from any over measurement defects noticed till completion of the defects liability period.

    XII.23. COMPUTERIZED MEASUREMENT BOOK

    Officer-in-Charge shall, except as otherwise provided, ascertain determine by measurement, the value of work done in accordance with the contract. All measurements of all items having financial value shall be entered by the bidder and compiled in the shape of the Computerized Measurement entered by Book having pages of A-4 size as per the format of the department so that a complete record is obtained of all the items of works performed under the contract.

    All such measurements and levels recorded by the bidder or his authorized representative from time to time, during the progress of the work, shall be got checked by the bidder from the Officer-in-Charge or his authorized representative as per interval or program fixed in consultation with Officer-in-Charge or his authorized representative. After the necessary corrections made by the Officer-in-Charge, the measurement sheets shall be returned to the bidder for incorporating the corrections and for resubmission to the Officer-in-Charge for the dated signatures by the Officer-in-Charge and the bidder or their representatives in token of their acceptance.

    Whenever bill is due for payment, the bidder would initially submit draft computerized measurement sheets and these measurements would be got checked in his draft computerized measurements, and submit to the department a computerized measurement book, duly bound, and with its pages numbered. The Officer-in-Charge and/or his authorized representative would thereafter check this MB, and record the necessary certificates for their checks.

    The final, fair, computerized measurement book given by the bidder, duly bound, with its pages numbered, should be 100% correct, and no cutting or over-writing in the measurements would thereafter be allowed. If at all any error is notice, the bidder shall have to submit a fresh computerized MB with its pages duly numbered and bound, after getting the earlier MB cancelled by the department. The bidder shall submit two spare copies of such computerized MB’s for the purpose of reference and record by the various officers of the department.

    The bidder shall also submit to the department separately his computerized Abstract of Cost and the bill based on these measurements, duly bound, and its pages numbered along with two spare copies of the “bill. Thereafter, this bill will be processed by the Office and allotted a number as per the computerized record I the same way as done for the measurement book meant for measurements.

    The bidder shall, without extra charge, provide all assistance with every appliance, labour and other things necessary for checking of measurements/levels by the Officer-in-Charge or his representative.

    Except where any general or detailed description of the work expressly shows to the contrary, measurements shall be taken in accordance with the procedure set forth in the specifications notwithstanding any provision in the relevant Standard Method of measurement or any general or local custom. In case of items which are not covered by specifications, measurements shall be taken in accordance with the relevant standard method of measurement issued by the Bureau of Indian Standards and if for any item no such standard is available then a mutually agreed method shall be followed.

    ANNEXURE – B

    REGISTRATION OF CONTRACTORS (All the pages are to be signed by the contractor/applicant & Submitted along with the application) 1. To be eligible for the registration, Contractors must demonstrate that they possess the necessary

    qualifications, expertise and management systems, technical and financial capacity to take up the work.

    2. Applications shall be submitted in the prescribed application forms only. Details/information furnished

    in the application form should be supported with the self-attested copies of documents/credentials as stipulated and enclosed with the hard copy of the application. All these supporting documents should be serially numbered and appropriately linked to the respective serial numbers in the application form for easy reference. Applications received with incomplete details/documents and not found in accordance to the above requirement shall not be considered. Applications received in any other form, other than the prescribed form shall be summarily rejected.

    Minimum Registration Requirements: The Contractors should have provided completed pest control works or works of similar nature worth not less than an amount, as specified for a particular category in the last five years.

    The Contractor must comply with the Government’s Code of Practice for the Building and Construction and various laws applicable to establishments engaged in building and other construction work including compliance to latest norms laid down by the Government/statutory bodies with regard to security and five protect measures. The Contractor shall not, without the written approval of Indian Institute of Management Bangalore, assign or transfer the Contract or any part thereof or any share, or interest therein to any other person. The contractor shall not sublet any portion of the contract without the prior written approval of Indian Institute of Management Bangalore to any other person/firm.

    If necessary, the applicant shall also demonstrate the equipment (either owned or leased).

    The applicants are cautioned that not giving complete information called for in the application or not giving it in clear terms or making any changes in prescribed forms or deliberately suppressing the information may result in the application being summarily disqualified / rejected.

    The employer reserves the right, without being liable for any damages or obligation to inform the applicant, to:

    a. Amend the scope and value of contract to the applicant. b. Reject any or all the applications without assigning any reason.

    Even though an applicant may satisfy the above requirement, he would be liable to disqualification if he has:

    Inclusion on the panel of Contractors does not assure an invitation to tender or an engagement of services. All the divisions of Indian Institute of Management Bangalore may operate Panel of registered Contractors or may choose to advertise for tenders for special requirements/projects not envisaged here in. The employer reserves the right to accept or reject any application and to annul the registration process and reject all the applications at any time, without assigning any reason or incurring any liability to the applicants. Following shall be the rules with respect to the eligibility of a contractor: a. No individual, or a firm having such individual as one of the partners, who is a dismissed government

    servant; or removed from the approved list of contractors; or demoted to lower class; or having business banned/suspended by any government department in the past; or convicted by a court of low shall be entitled for enlistment.

    b. A Contractor is not permitted to have enlistment in more than one name.

    c. A partner of a firm or a director of a company enlisted as a contractor cannot be a partner/director in any other enlisted firm/company.

    The Contractor has to furnish a QUALITY CERTIFICATE ISSUED BY THE MANUFACTURER FOR EACH WORK AS DIRECTED BY Officer in-charge. This document has to be read along with the General Conditions of Contract of IIMB Estate Department. The General Conditions of Contract also is a part of this Tender Document and is binding on the Contractor. Detailed technical specification for pest control work with respect to materials & workmanship and mode of measurements will be as per IS codes and CPWD specifications, unless mentioned otherwise. All pest control material to be used should be of Premium/first quality. The Contractor has to get all the material enlisted by the Security (quantity bought to site should be clearly written on the letter Head and obtain Seal and Signature of the IIMB Security before use at Site) bought to site for each work of pest control carried out by the Contractor. The same must be produced upon demand from the Officer in-charge. The Contractor must take necessary Safety precautions while executing the Pest control Works. The Contractor has to execute the pest control Works as per instructions of IIMB at immediate Notice. No time would be allotted for mobilization etc. as certain Pest control requirements would have to be taken on a war footing basis based on the requirements of IIMB.

    During external pest control of Buildings, the Contractor must take all necessary precautions and ensure smooth flow of work. Further necessary Safety precautions as applicable time to time would be ensured by the Contractor. Contractor will arrange proper ladders, scaffolding and jhoolas (for pest control at higher levels) at his own cost and will take all safety measures like safety belts, extra labour to hold ladders/Jhoolas etc. If it is observed that work is proceeding without adequate safety precautions, work may be stopped by IIMB officer and in such cases, contractor will be solely responsible for delay and its consequences thereof. Contractor’s job will also include removing of all debris arising in the process of pest control including washing of floor, etc. to remove stains of chemicals, at no extra cost. The Contractor will be paid as per the work carried out by him after satisfactory inspection report from the EIC. The mode of measurements will be as per relevant IS Code and CPWD Specifications. Payment will be made through NEFT/RTGS. IIMB reserves the right of allotting pest control works from time to time based on the requirements, urgency, Specific needs of the Organization, etc from time to time. The Contractor has no bearing on the same whatsoever. DETAILS TO BE FURNISHED WITH APPLICATION Following details are required to be provided in the application form enclosed at Annexure for registration as Contractor: a. Name, address, details of the organization, financial backing. b. Constitution and legal status along with attested copies of Deeds/Articles and Memorandum of

    Association etc., as applicable. c. Name/s of the owner/Partners/Promoters and Directors of the Firm/Company. d. Details of Registration enclosing necessary certificates, indicating the class, value and the nature of

    work for which the firm is registered. e. In case the organization is an ISO Certified Organization, relevant documents of the same to be

    furnished. f. The contractors shall quote their PAN NUMBER IN THEIR TENDER OR OTHER RELEVANT

    DOCUMENTS. g. Financial standing as certified by Bankers, Details of Annual Turnover / Financial strength enclosing

    copies of Audited Balance Sheets for the last 3 years. h. Information regarding projects in hand and works for which bids already submitted. i. Information on litigation history, liquidated damage, disqualification, etc. j. Details of construction equipment available with the applicant/proposed to be purchased or leased. ASSESSMENT AND NOTIFICATION By signing the application form, the Contractor authorizes Indian Institute of Management Bangalore to seek verification. Applicants shall, on request, provide any necessary authority to enable relevant enquires to be carried out. Indian Institute of Management Bangalore, Bangalore reserves the right either to accept or reject the application for registration without assigning any reason.

    REVIEW/UPDATING OF PANEL OF CONTRACTORS Unless circumstances warrant an earlier review, a Contractor’s registration status will remain valid for the period of 1 year from the date of approval or the date of any review that confirms the status. After submission of their application for registration, Contractor must notify Indian Institute of Management Bangalore, Bangalore promptly, if there is any: a. Substantial change in their financial or technical capacity. b. Change in their business (such as company name, address) c. Change to ownership or holding, including any transfer of key personnel. d. Any other significant change in information provided in the application for registration. A review of the registration status of Contractors may be initiated by Indian Institute of Management Bangalore, Bangalore before expiry of the specified period of 1 year. a. If the registered Contractor consistently fails to meet the required. b. At the request of a registered Contractor (for their own review). The Contractor must provide all details required for the review upon request. Failure to comply with any request by Indian Institute of Management Bangalore, Bangalore for such information may result in suspension of registration. Registered Contractor will be notified in writing of the result of any review of registration. SUSPENSION AND REMOVAL FROM REGISTRATION LIST Indian Institute of Management Bangalore, Bangalore in its absolute discretion suspend or de-register a Contractor who, at any time, for the following: a. Breach of any of the registration conditions b. Habit of pressing unfair claims against Indian Institute of Management, Bangalore. c. The standard of work has been found unsatisfactory. d. Rate of progress in the execution of work has consistently been unduly slow. e. Persistently violates any important conditions of the contract. f. Has indulged in any type of forgery or falsification of records; or g. Changes constitution of the firm or Individual without prior approval of the enlistment authority; or h. Is declared or is in the process of being declared bankrupt, insolvent, wound up, dissolved or

    partitioned; or i. Persistently violates the labor regulations and rules, or j. Is involved in complaints of serious nature received from other departments which prima facie

    appear to be true. k. Defaults in settlement of tax dues like income tax/GST/ Service tax/ PF / ESI etc. Before such action is taken, the Contractor will be given details of the matters prompting the decision and will have an opportunity to show cause why registration should not be suspended or cancelled and the Contractor de-registered. A determination by Indian Institute of Management Bangalore, Bangalore of any application for registration or for reclassification, suspension or de-registration is at its absolute discretion.

    Indian Institute of Management Bangalore, Bangalore will not be liable for any costs or damages incurred in the above exercise of such discretion. TENDER AND CONTRACT CONDITIONS Registration entitles a Contractor to be considered for invitation to tender within categories of works and services for which they apply and are qualified. It does not obviate the need for the Contractor to fully comply with the terms of notice inviting, conditions of notice inviting tender, conditions of Tendering and other Contract Conditions that may apply to a particular project or tender invitation. ACCEPTANCE OF CONDITIONS By signing the application from and applying for registration with Indian Institute of Management Bangalore, Bangalore, Contractors agree to accept these Conditions of Registration. WHEREAS the Contractor indemnifies the Institute for any claims from any other agency/Statutory bodies which may arise due to operation or neglect or omission of that agency in hold in carrying out this Contractor in whatsoever to the Person/s or property of Indian Institute of Management Bangalore even though the Contractor has taken utmost precaution against accident or injury. WHEREAS the Contractor indemnifies the Institute for any claims from any other agency/Statutory bodies which may arise due to the statutory requirement of all acts and enactments pertaining to the Labour Laws enforcing maintenance of all records, payments of fees for obtaining Licenses etc all as per terms and Conditions laid in Tender Document. WHEREAS the Contractor further indemnifies for claims on payment of all wages or other money to his worker/s or employees under Payment of Wages Act 1963 or Employer's Liability Act 1933, Workmen Compensation Act, ESI Act or any Other Act or enactment relating thereto, and rules framed thereunder from time to time.
